    English translation — Chullin 7b

    1The hosts sifted the barley with a utensil, but the donkey did not eat it. They separated the chaff from the barley by hand, but the donkey did not eat it. They wondered why the donkey would not eat the barley. Rabbi Pineḥas ben Ya’ir said to his hosts: Perhaps the barley is not tithed. They tithed it and the donkey ate it. Rabbi Pineḥas ben Ya’ir said: This poor animal is going to perform the will of its Maker, and you are feeding it untithed produce? Rabbi Zeira was referring to this donkey when it spoke of God preventing mishaps from occurring through animals of the righteous.

    2The Gemara asks: And is one who purchases grain that is demai in order to feed his animal obligated to tithe it? But didn’t we learn in a mishna ( Demai 1:3): One who purchases grain in the market for sowing or for feeding an animal, or flour to process animal hides, or oil to kindle a lamp, or oil to smear on vessels is exempt from the obligation of tithing demai ?

    3The Gemara answers: There, it was stated with regard to that mishna that Rabbi Yoḥanan says: They taught this only in a case where one purchased those items initially for the animal or for the other purposes enumerated in the mishna, but if he purchased them initially for a person and reconsidered his plans for them and decided to use them for an animal, he is obligated to tithe the demai . And it is taught in a baraita in support of that understanding: In the case of one who purchases produce from the market for human consumption, and he reconsidered his plans for it and decided to use it for an animal, that person may neither place it before his animal nor before the animal of another unless he tithed the produce.

    4Rabbi Yehuda HaNasi heard that Rabbi Pineḥas ben Ya’ir arrived, and he emerged to greet him. Rabbi Yehuda HaNasi said to him: Is it your desire to dine with me? Rabbi Pineḥas ben Ya’ir said to him: Yes. Rabbi Yehuda HaNasi’s face beamed [ tzahavu ], as it was well known that Rabbi Pineḥas ben Ya’ir did not accept invitations to dine with others.

    5Rabbi Pineḥas ben Ya’ir said to Rabbi Yehuda HaNasi: Are you under the impression that deriving benefit from the Jewish people is forbidden to me by vow? On the contrary, the Jewish people are holy. I avoid accepting invitations, as there is one who wants to invite guests to dine with him but he does not have the means, and I do not want to enjoy a meal that my host cannot afford. And there is one who has the means but does not want to host guests, and with regard to those people it is written: “Eat not the bread of him that has an evil eye, neither desire his delicacies. For as one that has reckoned within himself, so is he: Eat and drink, says he to you; but his heart is not with you” (Proverbs 23:6–7). But you want to invite guests to dine with you, and you have the means.

    6But now I am rushing [ mesarheivna ], as I am engaged in the performance of a matter involving a mitzva. When I come back I will enter to dine with you.

    7When Rabbi Pineḥas ben Ya’ir came back, he happened to enter through that entrance in which white mules were standing. He said: The Angel of Death is in this person’s house, and I will eat with him? White mules were known to be dangerous animals.

    8Rabbi Yehuda HaNasi heard the comment of Rabbi Pineḥas ben Ya’ir and emerged to greet him. He said to him: I will sell the mules. Rabbi Pineḥas ben Ya’ir said to him: You will thereby violate the prohibition: “Nor place a stumbling block before the blind” (Leviticus 19:14), as it is prohibited for any Jew to keep a destructive animal in his possession.

    9Rabbi Yehuda HaNasi said to him: I will declare the mules ownerless. Rabbi Pineḥas ben Ya’ir said to him: You will thereby increase the damage, as there will be no owner to restrain it. Rabbi Yehuda HaNasi said to him: I will remove their hooves so that they will be unable to kick and cause damage. Rabbi Pineḥas ben Ya’ir said to him: There is the requirement to prevent suffering to animals, and you will be violating it. Rabbi Yehuda HaNasi said to him: I will kill them. Rabbi Pineḥas ben Ya’ir said to him: There is the prohibition: Do not destroy items of value.

    10Rabbi Yehuda HaNasi was greatly imploring him to enter his home until a mountain rose between them and Rabbi Yehuda HaNasi could no longer speak with him. Rabbi Yehuda HaNasi wept and said: If during their lifetimes it is so that the righteous are great, after their death it is all the more so true. The Gemara comments: This is as Rabbi Ḥama bar Ḥanina says: The righteous are greater after their death, more so than during their lifetimes, as it is stated: “And it came to pass, as they were burying a man, that they spied a raiding party; and they cast the man into the tomb of Elisha; and as soon as the man touched the bones of Elisha, he revived, and stood up on his feet” (II Kings 13:21).

    11Rav Pappa said to Abaye: This proof from the case of Elisha that the righteous are greater after death is not valid. And perhaps this transpired to fulfill with regard to Elisha the blessing of Elijah, as it is written: “Please, let a double portion of your spirit be upon me” (II Kings 2:9). Elijah revived one dead person and this one is the second revived by Elisha. Abaye said to Rav Pappa: If so, is this consistent with that which is taught in a baraita : The dead person arose on his feet but he did not go to his home, indicating that he had not truly been revived?

    12The Gemara asks: But if that is the case, in what manner was Elijah’s blessing fulfilled? It is as Rabbi Yoḥanan says: The blessing was fulfilled when he cured the leprosy of Naaman, since a leper is equivalent to a dead person, as it is stated with regard to Miriam when she was afflicted with leprosy: “Please, let her not be as one dead” (Numbers 12:12).

    13Apropos white mules, which were likened to the Angel of Death, Rabbi Yehoshua ben Levi says: Why are the mules called yemim (see Genesis 36:24)? It is because their terror [ eimatam ] is cast over all creatures, as Rabbi Ḥanina says: In all my days, no man has asked me about a wound caused him by a white mule and survived, indicating that they are extremely dangerous. The Gemara asks: But haven’t we seen that some people survive after being wounded by a white mule? The Gemara answers: Say instead, no man has asked me about a wound caused him by a mule and the wound healed. The Gemara asks: But haven’t we seen that such wounds heal? The Gemara answers: The wound that we say does not heal is one caused by a mule the top of whose legs are white.

    14The Gemara relates other statements of Rabbi Ḥanina: With regard to the verse: “There is none else beside Him” (Deuteronomy 4:35), Rabbi Ḥanina says: And even sorcery is ineffective against the will of God. The Gemara relates: There was a certain woman who would try to take dust from beneath the feet of Rabbi Ḥanina in order to perform sorcery on him and harm him. Rabbi Ḥanina said to her: Take the dust, but the matter will be ineffective for you, as it is written: “There is none other beside Him.” The Gemara asks: But doesn’t Rabbi Yoḥanan say: Why is sorcery called keshafim ? It is an acronym for makhḥishin pamalya shel mala , meaning: That they diminish the heavenly entourage [ pamalya ], indicating that they function contrary to the will of God. The Gemara answers: Rabbi Ḥanina is different, as, because his merit is great, sorcery has no effect on him.

    15And Rabbi Ḥanina says: A person injures his finger below, on earth, only if they declare about him on high that he should be injured, as it is stated: It is of the Lord that a man’s goings are established; and a man, what does he understand of his way (see Psalms 37:23 and Proverbs 20:24). Rabbi Elazar says: The blood of a wound effects atonement like the blood of a burnt offering. Rava said: This is stated with regard to a wound on his right thumb, as one applies force with that thumb and the wound is consequently more severe; and it is also stated with regard to a second wound in the same place before the first has healed, and it is provided that he is wounded while going to perform a matter involving a mitzva.

    16Apropos Rabbi Pineḥas ben Ya’ir, the Gemara notes that they said about Rabbi Pineḥas ben Ya’ir: In all his days he never broke bread and recited a blessing on a piece of bread that was not his, and from the day that he achieved cognition he did not benefit even from the meal of his father, because he eschewed benefit from everyone.

Behold, it did not become obligated for tithing until it is flattened on the threshing floor, as it is written (Deuteronomy 18:4), "The beginning of your grain." And it is taught explicitly (Peah 1:6), "One may feed domestic beasts, wild animals and birds [and be exempt from tithes] until he flattens (the threshing floor)." For any eating of animals is considered a casual eating (which is exempt from tithing).

    They separated it manually from the stones and the chaff.

    And is one obligatedDid they at all decree demai on animal food purchased from an ignoramus? And even though if [the seller] certainly did not tithe it, [the buyer] would be obligated to tithe it; it was not decreed, however, when there is [only] a doubt. As it was taught, "One who purchases [grain in the market] for sowing or for feeding an animal" - even though seeds and animal food are included with all grain and are obligated for tithing - they did not decree demai upon them. As, in general, most ignoramuses tithe, so the Sages were not so stringent about demai.

    He said to himRabbi Pinchas - "And did you hold that deriving benefit from the Jewish people is forbidden to me by vow."

    The Jewish people are holySo it is fitting to derive benefit from them.

    But there is one who wants to give benefit from what is his to others, but he does not have the ability in his hands. So I do not want to derive benefit from him, so that I do not burden him.

    And there is one who has the ability in his hands to give benefit to others; yet even though he says, "Come and dine," his heart does not desire [it]. So I do not benefit from him on account of it being written, "Eat not the bread of him that has an evil eye."

    Eat not the breadDo not dine. Bread is a term for a meal, as it is written (I Samuel 20:27), "did not come [...] to the bread"; and it is written (Daniel 5:1), "King Belshazzar made a great bread."

    As one who has reckoned ( shaar )It is as if you open a gate ( shaar ) in his stomach. But some say it is a term of bitterness, as in (Jeremiah 29:17), "like bitter ( shoerim ) figs."

    I am rushing ( mesarheivna )It is an expression of frenzy and quickness. That is to say, I need to hurry and go to a matter involving a commandment, so I have no time to dine.

For He caused this thing, that he should enter by the gate of the mules, so that he separate and not change his mind from at first, as it is was not his way to dine from that which belonged to others - as per the below.

    All the more soAs behold, they are greater [after] their death than in the their lifetimes, as Rabbi Chama said.

    They were burying a manHe was a wicked man, and he should not have been buried next to the righteous.

    And as soon as the man touched the bones of Elisha, he revived: Yet in his lifetime, when he wanted to revive the son of the Shunamite woman, he needed to place his mouth over his mouth and his eyes over his eyes and request mercy.

    And perhaps it was to fulfill the blessing of EliyahuFor it would be insufficient if it was not fulfilled; as it is written about the righteous (Job 22:28), "You will decree and it will be fulfilled." So it was not for the sake of Elisha.

    A double portionEliyahu revived the son of the Tzarfit woman and Elisha revived the son of the Shunamite woman. So he needed to revive still another.

He was nevertheless greater [after his death], in that which he had to take more effort to revive [the dead] during his lifetime than [after] his death! So it appears that he derived it from that which various wicked people touch the righteous and dwell with them in their lifetimes, whereas [in the grave,] this one was not given permission to [even] linger with him.

He was nevertheless greater [after his death], in that which he had to take more effort to revive [the dead] during his lifetime than [after] his death! So it appears that he derived it from that which various wicked people touch the righteous and dwell with them in their lifetimes, whereas [in the grave,] this one was not given permission to [even] linger with him.

    מדות האדם בנדיבות או בכילות חלוקות לכמה פנים יש מבני אדם שהוא רוצה ואין לו וכל כיוצא בזה אסור ליהנות ממנו שלא לביישו ולדחוק לו את שעתו ומהם שיש לו ואינו רוצה וראוי לכל חסיד ובעל מדות שלא ליהנות ממנו וכמו שאמר שלמה אל תלחם את לחם רע עין וגו' וכל שכן מי שאין לו ואינו רוצה ומהם מי שיש לו ורוצה וזהו שראוי לכל בן מעלה ליהנות ממנו אא"כ יש בו דבר שאינו הגון ואינו רוצה לשוב ממנו או שאי אפשר לו ועל דבר זה נמנע אחד מגדולי חסידיהם שלא לסעוד אצל רבינו הקדוש כשראה בביתו בהמות שהיזקן מצוי וכשאמר לו שימכרם הוא השיבו שיש בה נתינת מכשול וכשאמר לו שיוציאם מביתו ויפקירם אמר לו כל שכן שאתה מרבה בהיזק וכשאמר לו שיעקר את רגליהם שלא יהו מזיקות השיבו איכא צער בעלי חיים וכשאמר לו שיהרגם אמר לו איכא בל תשחית עד שמתוך כך גדל הרחוק בין שניהם הרבה:

    מיסודי התורה הוא להיות האדם מתבונן (האדם) ומכיר שכל מה שיארע לו מאיזה מין של צרה הכל במשפט מצד עונש משפטי ישרו יתברך והוא שאמרו אין אדם נוקף אצבעו מלמטה אא"כ מכריזין עליו מלמעלה ויבא מזה שיפשפש במעשיו וישוב מדרכיו הרעים והוא שאמרו דם ניקוף כדם עולה ואמר דרך צחות בגודל ימין מפני שהוא הולך בו במהירות ונוקף בכח ומצטער הרבה וכל שכן בניקוף שני עד שלא נתרפא הראשון שהוא מכאיב ביותר:

    הלוקח מעם הארץ פירות לזריעה או להאכיל לבהמה וקמח לעורות כדי לעבדן או למלוגמא או לרטיה ושמן להדליק בו את הנר או לסוך בו את הכלים כל אלו פטורין מן הדמאי ואם לקחן מתחלה לאכילה הרי נתחייבו בידו ואפי' נמלך עליהן לאחד מאלו לא הופקעה חובתן ולא יאכילם אפי' לבהמתו או בהמת חבירו וכן לא ימכרם אפי' לגוי עד שיעשר:

    שם ומי מחייבא והא תנן כו' דליכא למימר שאותן שעורין שהיו דמאי והיא היתה יודעת שלא עשרינהו דהא ודאי אין דעת בבהמה ולא שייך בבהמה גופה איסור אכילה דאינה מצווה כלל אלא שהקב"ה אינו מביא תקלה על ידה לבעלה שיתן לה מה שבעלה אסור לתת לה ומן השמים מנעו הבהמה לאכול שלא יהיה באכילתה תקלה לבעלה וכיון דהנך שעורין דמאי הוה ובעלה לא ידע שהן בודאי אינן מעושרין ומותר לתת אותן לבהמה אין זה תקלה לבעלה אף אם לא היו מעושרין באמת ובהכי יתיישב ג"כ מה שמקשין למה לא נתן החמור עיניו בצד זה ואכל בצד אחר וק"ל:

    בפרש"י בד"ה חבטינהו בנפה כו' דא"כ אמאי לא אכלה מעיקרא כו' עכ"ל וליכא למימר דמעיקרא לאו משום מעשר לא אכלה אלא משום שלא היו טובים לאכילה כך עם הפסולת ואחר שחבטינהו לא אכלה משום חיוב מעשר שנתחייב אז דא"כ מה אשמעי' תלמודא בהא דלא אכלה עד דחבטינהו מעיקרא ודו"ק:

    גמ' ישראל קדושים הם כו' עיין בפרש"י ותוספות ול"נ לפרש דה"ק אין אני מודר הנאה אבל ישראל קדושים הם והנהנה מהם כאילו נהנה מדבר קדוש וכאילו מעל דיש רוצה ואין לו ואסור ליהנות ממנו כדאמרינן אסור ליהנות מסעודה שאינה מסתפקת לבעלה ויש שיש לו ואין רוצה ואסור ליהנות ג"כ ממנו דכתיב אל תלחם גו' ובמסכתא סוטה אמרי' הנהנה מצרי עין עובר בלאו שנאמר אל תלחם גו' וק"ל:

    שם בכה רבי ואמר אם בחייהן כך כו' עיין בפרש"י שהוא דחוק לפי עניינו ונראה לפרש דאהא דגבה טורא בינייהו קאמר בכה רבי אם בחייהן כך שניתן לצדיק זה מחיצה המבדלת בפני עצמו שגבה טורא ביני ובינו במיתתו אעכ"ו שהרי הצדיקים בדבר זה במותן יותר מבחייהן שהרי באלישע לא מצינו לו מחיצה בפני עצמו בחייו ושם במותו לא היה יכול הרשע להתעכב במחיצתו כמו שפירשו התוספות וק"ל:

    עֲנִיָּה זוֹ הוֹלֶכֶת לַעֲשׂוֹת רְצוֹן קוֹנָהּ, וְאַתֶּם מַאֲכִילִין אוֹתָהּ טְבָלִים קראה עֲנִיָּה כי ממעשיה נראה שמגולגלת בה נפש אדם והיא אשר היתה מעוררת אותה בדברים של חסידות לעשותם וכיון דנפש אדם מתגלגלת בבהמה ודאי אין עניות יותר מזה ולכך קראה עֲנִיָּה דקאי על נפש המגולגלת שבה והרב פתח עינים ז"ל כתב בשם המקובלים שהיה מגולגל בה נפש ישמעאל עיין שם. ובדברי רבינו האר"י ז"ל בשער טעמי המצות מפורש ענין חמורתו של רבי פנחס בן יאיר שהיה בקי בכל אותם הדברים שספרו חכמינו ז"ל עליו עד שכמעט יתבהל האדם בדברים ההם ויש מהם מוציאין הדברים מפשטן שאינן יודעין לדרוש! אבל דע שורשו של דבר כי הדברים הם כפשטן וטעם הדבר הוא כי החמור ההוא היה מבורר ומתוקן לגמרי בכל הצריך לו כפי בחינתו ולא נתברר כשאר הבהמות המתבררות על ידי אדם אמנם נתקן מעצמו על ידי המשך הזמן ועל ידי רבי פנחס בן יאיר בעליו והוברר ממש כמו שאר הבהמות שנבראו בששת ימי בראשית. ודע שאותם הבהמות שהובררו מששת ימי בראשית היו מעולים יותר ממדרגת האדם של עתה אחר חטא אדם הראשון ולכן אין לתמוה מן החמור ההוא שהיה מכיר מה שלא היו מכירין החכמים אשר בזמן ההוא וזהו מה שאמרו בגמרא (שבת קיב:) על רבי זעירא שאמר אנחנו כחמורים ולא כחמורו של רבי פנחס בן יאיר ומזה תוכל לשער מדרגת האדם אחר אשר יוברר ויתוקן בכל הצריך לו כמה מעלתו גבוה לאין קץ וכו' עיין שם. ונמצא לפי דברי רבינו ז"ל הנזכר חמורו של רבי פנחס בן יאיר לא נתברר כשאר בהמות המתבררות על ידי אדם כי אם נתקן מעצמו על ידי המשך הזמן ועל ידי רבי פנחס בן יאיר בעליו ובזה יובן מה שאמר להם ' עֲנִיָּה זוֹ הוֹלֶכֶת לַעֲשׂוֹת רְצוֹן קוֹנָהּ ' הולכת דייקא שאינה צריכה לתיקון של אחרים כי היא מתוקנת מעצמה לעשות רצון קונה ' וְאַתֶּם מַאֲכִילִין אוֹתָהּ טְבָלִים ' אתם דייקא שמדרגתכם פחותה ממנה כי מדרגתה מעולה ממדרגתכם מאכילים אותה טבלים דייקא שהוא דבר שאינו מתוקן הלא בטבל אי אפשר להכשל אלא רק אדם שאינו מבורר ומתוקן דאז אפשר שיכשל בטבל שאיני מתוקן מפני שהוא עצמו טבל אך זו כבר מתוקנת ומבוררת, איך תכשל לאכול טבל שאינו מתוקן? על כן הרגישה וידעה זאת ולא אכלה. ולפי זה מובן שפיר נמי מה שקראה עֲנִיָּה כי מדרגתה מעולה ומתוקנת יותר משאר בני אדם ודא עקא שלמראה עינים נחשבת כשאר בהמות הפחותים מבני אדם.

    שָׁמַע רַבִּי, נָפַק לְאַפֵּיהּ בסוף שער הגלגולים כתב מהרש"ו [מורנו הרב רבי שמואל ויטאל] ז"ל דתרי רבי פנחס בן יאיר הוו והראשון נפטר בחיי רשב"י כנזכר בריש אדרא של האזינו והשני היה בן בנו של הראשון והוא אשר נפק רבי לאפיה ודבר עמו במכלתין עיין שם וזה אמת וברור.

    יִשְׂרָאֵל קְדוֹשִׁים הֵם עיין פירוש רש"י ז"ל. ויש להקשות שכח של קדושים הוא מצד ערוה כמו שאמרו רבותינו ז"ל (ויקרא רבה כד, ו) כל מקום שאתה מוצא גדר ערוה אתה מוצא קדושה ומה שייכות לזה הכא בענין אורחים? ונראה לי בס"ד כונתו לומר אל תחשוב שאני נמנע לבלתי התארח אצל בעל הבית מפני שחושש אני פן תבא אשתו של בעל הבית ותדבר עמי או תלך לפני ואבא לידי הרהור ח"ו זה אינו כי ישראל קדושים הם ויש להם צניעות גדולה לנשים שהוא גדר ערוה וברור לי שלא תתראה לפני וכל שכן שלא תדבר עמי. ודע כי מה שאמר לו 'רְצוֹנְךָ סְעֹד אֶצְלִי' ואמר לו 'הֵן' השיבו הֵן על הרצון רצונו לומר שיש לו רצון בכך אבל אין הכי נמי הוא אינו יכול לקיים אותה שעה את הרצון הזה בפועל מפני שהיה טרוד במצוה.

    כִּי אָתָא אִיתְרַמִי עַל בְּהַהוּא פִּיתְחָא דַּהֲווּ קַיְּמִין בֵּיהּ כּוּדְנַיְתָא חִיוַרְתָּא. קשא איך רבינו הקדוש הכניס לביתו מזיקין אלו, ומאי סלקא דעתיה מעיקרא? ונראה לי בס"ד דאותם הכודנייתא שלח אותם המלך אליו מנחה כי היה אוהבו הרבה ומשום כבוד מלכות הוכרח להניחם אצלו דגנאי למכרם או ליתנם במתנה והא דאמר קטילנא להו הכונה על ידי סם דליכא צער בעלי חיים.

    גְּדוֹלִים צַדִּיקִים בְּמִיתָתָן יוֹתֵר מִבְּחַיֵּיהֶם (מלכים ב יג, כא) פירש רש"י ז"ל דדייק לה משום דבמיתתו החייהו בנגיעה ולא הוצרך לטרוח כאשר טרח בבן השונמית שהחייהו בחייו. והקשו התוספות אם כן מאי פריך 'וְדִלְמָא לְקִיּוּמֵי בִּרְכְּתָא דְּאֵלִיָּהוּ' דאין הכי נמי החייהו לקיומי ברכתא דאליהו? אך אכתי משמע דגדולים במיתתם כי אחר מותו החייהו בנגיעה בלא טורח ובהיותו בחיים הוצרך לטרוח עד שהחייהו. ונראה לי בס"ד דמה שהחייהו בנגיעה בלא טורח אין זה יתרון כי זה הדבר מוכרח להיות כך יען כדי לקיים ברכת אליהו זכור לטוב צריך להחיות שנים בעודו בחיים וזה שהחייהו אחר מותו אין בו כדי סיפוק להשלים קיום ברכת אליהו זכור לטוב כיון דלא החייהו בעודו בחיים כאשר ברכו אליהו זכור לטוב ועל כן הוצרך הדבר להיות כך לפייס דעתו של אלישע הנביא ע"ה שיתרצה בכך להשלים קיום ברכת אליהו זכור לטוב דאף על גב דברכתו שיחיה שנים בעודו בחיים הנה צריך שיחייהם שניהם בטרחה ויגיעה אך עתה אף על פי שהחיה השני אחר מותו יש כאן יתרון דהחיהו בלי טרחה ויצא זה היתרון שהחיהו בנגיעה כנגד היתרון שהיה ראוי להיות שיחייהו בחיים. ומה שהקשה הרי"ף ז"ל אדרבה יש לדון להפך דהא בחייו החייהו לגמרי ואחר מותו לא החייהו לגמרי דהא קאמר לביתו לא הלך? נראה לי בס"ד דאם לביתו לא הלך אלא חזר ומת אין זה החסרון מצד הנביא ע"ה כי הוא החייהו ממש אך מזלו גרם שיחזור וימות. ומה שהקשה עוד הרי"ף ז"ל הלא גם בחייו לא הוצרך להניח פיו ברפואת נעמן? עיין שם. ונראה לי בס"ד ברפואת נעמן עשה תפלה כי מה שאמר לו וישוב בשרך לך וטהר דברי תפלה הן שנתכוון בהם לתפלה ולפי זה עיקר ההפרש היא משום דהכא בקש רחמים והתם בקבר לא בקש ולא דבר כלום והחייהו בנגיעה בלבד.
