    Chapter 1 - HaShuttafin

גם: בבא בתרא דף ט׳ ע״ב, פרק א׳ השותפין

English translation - Bava Batra 9b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1who perverted the ways of his mother. He said in the name of Rabbi Elazar: What is the meaning of that which is written: “And He donned charity like a coat of mail” (Isaiah 59:17)? This verse serves to tell you that just as with regard to this coat of mail, each and every scale of which it is fashioned combines to form one large coat of mail, so too with regard to charity, each and every peruta that one gives combines to form a great sum. Rabbi Ḥanina says: The same idea is derived from here, as it is stated: “And all our charity is as a polluted garment” (Isaiah 64:5). Just as with regard to this garment, each and every thread in it combines to form one large garment, so too with regard to charity, each and every peruta combines to form a great sum.

2The Gemara comments: Why was this Sage called the infant who perverted the ways of his mother? It was because of the following incident: Rav Aḥadvoi bar Ami asked Rav Sheshet: From where is it derived that a leper renders a person impure through contact during his days of counting, i.e., during the seven days that the leper must count from the start of his purification process, when he brings his birds, until he completes that process with the bringing of his sacrifices? Rav Sheshet said to him: Since he renders his garments impure, as it states that on the seventh day of his purification he must wash his clothes (see Leviticus 14:9), he also renders people impure.

3Rav Aḥadvoi said to him: Perhaps connected impurity is different, meaning perhaps he renders his garments impure because they are connected to the source of the impurity, but this does not mean that he renders impure a person whom he touches. A proof for this distinction may be brought from the fact that if one moves an animal carcass, an action that renders him impure even if there was no actual contact with the carcass, he renders the garments that he is wearing impure but does not render another person impure.

4Rav Sheshet said to him: But from where do we derive that the carcass of a creeping animal renders a person impure? Is it not because we know that it renders his garments impure? Rav Aḥadvoi said to him: It is written explicitly with regard to the carcass of a creeping animal: “Or a man who touches any creeping animal, whereby he may be made unclean” (Leviticus 22:5). Rav Sheshet said to him: But from where do we derive that semen renders a person impure? Is it not because we say that since it renders his garments impure (see Leviticus 15:17) it also renders a person impure? Rav Aḥadvoi said to him: It is also written explicitly with regard to semen: “Or a man from whom semen is expelled” (Leviticus 22:4), and the Sages expound the superfluous word “or” as serving to include as impure one who touches semen.

5The Gemara relates that with each of his answers Rav Aḥadvoi responded to Rav Sheshet in a mocking tone, intimating that he doubted Rav Sheshet’s grasp of Torah verses. Rav Sheshet was deeply offended, and as punishment, Rav Aḥadvoi bar Ami became mute and forgot his learning. Rav Aḥadvoi’s mother came and wept before Rav Sheshet. She cried and cried but he ignored her. As she had once been Rav Sheshet’s nursemaid, she said to him: Look at these breasts of mine from which you suckled. Upon hearing that, Rav Sheshet prayed for mercy for Rav Aḥadvoi, and he was healed. And since it was Rav Aḥadvoi whose behavior led to his mother’s acting in this manner, he was referred to as the infant who perverted his mother’s ways.

6The Gemara comments: With regard to that which we arrived at, i.e., this particular subject, let us clarify the matter: From where do we derive that a leper renders impure a person with whom he comes into contact during his days of counting? As it is taught in a baraita : Rabbi Shimon bar Yoḥai says: Washing garments is stated with respect to his days of counting, and washing garments is stated with respect to his days of confirmed leprosy, after he has been declared conclusively impure by a priest. Just as there, when he is a confirmed leper he renders a person impure, as is explicitly stated in the Torah, so too here, during his days of counting he renders a person impure.

7§ The Gemara resumes its discussion of the virtues of giving charity. Rabbi Elazar said: One who performs acts of charity in secret is greater than Moses, our teacher. Whereas with regard to Moses, our teacher, it is written: “For I was afraid of the anger and the wrath” (Deuteronomy 9:19), with regard to one who performs acts of charity it is written: “A gift in secret pacifies anger, and a present in the bosom fierce wrath” (Proverbs 21:14). The Gemara comments: And this statement disagrees with a statement of Rabbi Yitzḥak, as Rabbi Yitzḥak says: A secret gift pacifies anger, but it does not pacify wrath, as it is stated: “And a present in the bosom fierce wrath,” meaning that although a present is in the bosom, i.e., even if one gives charity in secret, nevertheless fierce wrath can still harm him. There are those who say that Rabbi Yitzḥak says as follows: Any judge who accepts a bribe brings fierce wrath upon the world, as it is stated: “And a present in the bosom fierce wrath.”

8And Rabbi Yitzḥak says: Anyone who gives a peruta to a poor person receives six blessings, and whoever consoles him with words of comfort and encouragement receives eleven blessings. The Gemara explains: One who gives a peruta to a poor person receives six blessings, as it is written: “Is it not to share your bread with the hungry, and that you shall bring the poor that are cast out to your house? When you see the naked, that you cover him” (Isaiah 58:7). And the next verses list six blessings: “Then shall your light break forth like the dawn, and your health shall spring forth speedily, and your righteousness shall go before you, the glory of the Lord shall be your rearguard. Then, shall you call, and the Lord shall answer; you shall cry, and He shall say: Here I am” (Isaiah 58:8–9).

9And whoever consoles a poor person with words of comfort and encouragement receives eleven blessings, as it is stated: “And if you draw out your soul to the hungry and satisfy the afflicted soul, then shall your light shine in darkness, and your gloom shall be as the noonday. And the Lord shall guide you continually, and satisfy your thirst in drought… And they that shall be of you shall build the old waste places, you shall raise up the foundations of many generations” (Isaiah 58:10–12).

10And Rabbi Yitzḥak says: What is the meaning of that which is written: “He who pursues charity and mercy finds life, charity, and honor” (Proverbs 21:21)? Is this to say that because one has pursued charity, he himself shall find charity? That is, shall the reward of one who has always given charity be that he will eventually become poor and other people will act charitably toward him? Rather, the verse serves to tell you that with regard to anyone who pursues charity, giving to the poor and leading others to do so, the Holy One, Blessed be He, furnishes him with money with which to perform his acts of charity.

11Rav Naḥman bar Yitzḥak says: The Holy One, Blessed be He, sends him people who are deserving of charity, so that he will reap his just reward for helping them. The Gemara comments: What does this statement serve to exclude? It serves to exclude Rabba’s homiletical interpretation of a different verse, as Rabba taught: What is the meaning of that which is written: “Let them be made to stumble before You; deal thus with them in the time of Your anger” (Jeremiah 18:23)? The prophet Jeremiah said before the Holy One, Blessed be He: Master of the Universe, even when those wicked men who pursued me subdue their inclinations and seek to perform acts of charity before You, cause them to stumble upon dishonest people who are not deserving of charity, so that they will not receive reward for coming to their assistance.

12Rabbi Yehoshua ben Levi says: Anyone who is accustomed to performing acts of charity merits blessing; he will have sons who are masters of wisdom, masters of wealth, and masters of aggada . The Gemara explains: Masters of wisdom, as it is written:

מנין למצורע בימי ספורו שמטמא אדם‎—From where do we derive that A מצורע is מטמא a person in his days of counting OVERVIEW Once a person is verified as a מצורע (מוחלט) he is מטמא אדם (במגע ובמשא) וכלים (במגע) and he is also מטמא משכב ומושב and is מטמא באוהל‎. When he is cleared of his צרעת, three steps are required to make him completely טהור‎. First phase is the birds, shaving his body, and טבילה followed by counting seven days (ימי ספורו). At this point בימי ספורו he is only מטמא אדם וכלים במגע‎. Second phase is an additional shaving and טבילה afterwards (on the seventh day). At this point he is not מטמא but cannot eat תרומה וקדשים (or enter the ביהמ"ק). On the eighth day he brings the קרבנות and is completely טהור‎. רב אחדבוי בר אמי asked from where we derive that the מצורע is מטמא a person בימי ספורו‎. Our תוספות explains why he assumed that he is מטמא, and why the גמרא seems puzzled from where we derive this. ------------------------------- פשיטא לן דמטמא כדתנן בריש מסכת כלים (פרק א' משנה א') – It was obvious to רב אחדבוי that a מצורע is מטמא בימי ספורו as we learnt in a משנה in the (very) beginning of מסכת כלים‎ – אבות הטומאות השרץ ושכבת זרע ונבלה וטמא מת ומצורע בימי ספורו כולי‎ – The אבות הטומאות of שרץ שכבת זרע וטמא מת ומצורע בימי ספורו, etc. – הרי אלו מטמאין אדם וכלים במגע וכלי חרס באויר‎ – The above-mentioned are מטמא people and utensils by touching them and they are also מטמא earthenware if they enter its air space. This concludes the משנה which clearly states that a מצורע בימי ספורו is מטמא אדם (וכלים). תוספות responds to an anticipated question: ולכך בעי מנלן דמטמא דהא כתיב ורחץ במים וטהר משמע דבאותה טבילה נטהר: And the reason רב אחדבוי queried from where we derive that a מצורע בימי ספורו is מטמא, is because it is written (regarding a מצורע immediately before ימי ספורו), ‘and he shall wash (immerse) in water and be טהור’; indicating that with this טבילה he is נטהר (from his צרעת), so why is he מטמא בימי ספורו‎? SUMMARY The משנה teaches that a מצורע בימי ספורו is מטמא אדם (even though the תורה writes ורחץ בימים וטהור [at the beginning of ימי ספורו]). THINKING IT OVER Was רב אחדבוי aware (when he asked מנין למצורע שמטמא אדם בימי ספורו) that there is a difference in the טומאה of a מצורע between ימי חלוטו and ימי ספורו‎?

דהא הסיט נבלה מטמא בגדים ואינו מטמא אדם‎—For if he moved a carcass he is מטמא clothes but he is not מטמא a person. OVERVIEW רב ששת told רב אחדבוי that we derive the rule that a מצורע בימי ספורו is מטמא אדם from the fact that he is מטמא בגדים in ימי ספורו‎. רב אחדבוי rejected this proof saying that טומאה בחבורים is different from being מטמא either אדם or בגדים שלא בחיבורין‎. And רב אחדבוי proves his point (that טומאה בחבורין is different) for we find that one who is מסיט a נבילה (through carrying it, for instance), [he and] his clothes become טמא, however he cannot be מטמא an אדם [or other כלים/בגדים]. There is a dispute between רש"י and תוספות regarding טומאה בחיבורין and what does this exclude, as well as the reading of the text in our גמרא‎. ---------------------------- לאו משום דטומאה בחבורין שאני‎. – Is not [the reason] for this difference (that the clothes he is wearing become טמא but he cannot be מטמא אדם וכלים) because טומאה בחבורין is different than other טומאות‎. פירש הקונטרס דאינו מטמא אלא בגדים שהוא לבוש – רש"י explained that טומאה בחבורין means that the מסיט נבילה is only מטמא the clothes that he is wearing. תוספות disagrees with פירש"י (regarding טומאה בחיבורין): וקשה לרבינו יצחק בן מאיר דבתורת כהנים פרשת ויהי ביום השמיני – And the ריב"ם has a difficulty with פירש"י for in תו"כ פרשת ויהי ביום השמיני‎ – מרבה שמטמא אפילו כלים (בחבורים) אף על גב דלא שייך בהו לבישה‎ – It is evident that a מסיט נבילה is מטמא even כלים (בחבורים), even though the idea of wearing כלים is not applicable; one does not wear כלים, and nevertheless the מסיט נבילה is מטמא כלים‎ – ואינו ממעט מבגדיו אלא אדם וכלי חרס שנוגע בהן‎ – And the תו"כ does not exclude from the word בגדיו only a person or earthenware which the מסיט touches that he is not מטמא them (even while he is מסיט the נבילה), but the תו"כ does not exclude that the מסיט is not מטמא כלים (or בגדים which he is not wearing) while he is מסיט – תוספות offers his view regarding the מיעוט of טומאה בחיבורין: אלא ודאי מטמא בגדים בשעה שמסיט אפילו אין לבוש בהן – But rather the מסיט is certainly מטמא בגדים (which he is contact with) at the time he is מסיט even if he is not wearing those clothes; it is only an אדם and כלי חרס that he is not מטמא‎. תוספות proves his point: וכן משמע מדקאמר אלא מעתה שרץ דמטמא אדם מנלן‎ – And this is also indicated in the גמרא, for since רב ששת said to רב אחדבוי; ‘but ‘as of now’ I ask you from where do we derive that a שרץ is מטמא an אדם‎ – לאו משום דמטמא בגדים מטמא אדם נמי כולי‎ – Is it not because since a שרץ is מטמא בגדים it is also מטמא אדם, etc. – ואי קרי חבורים בגדים שהוא לבוש מאי פריך משרץ דלא שייך ביה לבישה‎ – And if the term חבורים means the clothes he is wearing, what is he asking from שרץ where the whole concept of wearing is not applicable, so – התם ודאי ילפינן אדם מבגדים – There by שרץ we certainly can derive אדם from בגדים‎. In summation: According to רש"י a מסיט נבילה is מטמא only the בגדים which he is wearing and not (other בגדים or כלים and certainly not) an אדם‎. A מצורע בימי ספורו is certainly מטמא the בגדים he is wearing; the question of רב אחדבוי is from where we derive that he is also מטמא אדם (and בגדים which he is not wearing). According to תוספות a מסיט נבילה is מטמא בגדים וכלים (besides כלי חרס) while he is touching the נבילה, but not אדם‎. A מצורע בימי ספורו is certainly מטמא בגדים וכלים; the question of רב אחדבוי is from where we derive טומאת אדם בימי ספורו‎. תוספות offers an alternate explanation and reading of the גמרא: ונראה לרבינו יצחק בן מאיר דלא גרס בחבורים אלא הכי גרס ודילמא טומאת בגדים שאני‎ – And it is the view of the ריב"ם that the text does not read '[ודלמא טומאה] בחבורים [שאני]', but rather this is the correct reading, 'ודילמא טומאת בגדים שאני', [and perhaps the טומאה of clothes is different from טומאת אדם] (but no mention is made of טומאה בחבורין) and רב אחדבוי continues – תדע דהא מסיט נבלה דמטמא בגדים ואינו מטמא אדם‎ – You can know that טומאת בגדים is different, because a מסיט נבילה is מטמא בגדים and is not מטמא אדם‎ – ולא גרסינן מאי טעמא לאו משום דטומאה בחבורים שאני‎ – And the text does not continue with מ"ט לאו משום דטומאה בחבורים שאני [what is the reason מסיט נבילה is מטמא בגדים and not מטמא אדם, is it not because טומאה בחבורים is different], we are not גורס that at the conclusion of sרב אחבוי' rebuttal – דלא מהדר אלא שיש חילוק בין טומאת בגדים לטומאת אדם – For sרב אחדבוי' reply was merely that there is a difference between טומאת בגדים and טומאת אדם‎ – וכן משמע דאיהו גופיה לא קא מיבעיא ליה אם מטמא בגדים וכלים במגע אלא אאדם בעי: And this (that a מצורע (and a מסיט) is מטמא בגדים וכלים) is also indicated in our גמרא, for רב אחדבוי himself did not query whether a מצורע בימי ספורו is מטמא בגדים and כלים by touching them but rather he only queried regarding a person. THINKING IT OVER Can we differentiate (according to רש"י) that by היסט נבילה there is a difference between the clothing which he is wearing (that the מסיט is מטמא בחיבורין) and בגדים which he is not wearing (which he is not מטמא בחבורין); however by מצורע where he is מטמא בגדים there is no difference (according to רב ששת) between the clothes he is wearing and the clothes he is not wearing (they are both טמא)?

אתיא אימיה וקא בכיא קמיה‎—His mother came and wept before him OVERVIEW The גמרא relates that רב אחדבוי was refuting rather smugly the proofs רב ששת attempted to offer. As a punishment רב אחדבוי became speechless and forgot his learning. The גמרא continues (according to רש"י) that sרב ששת' mother interceded on behalf of רב אחדבוי and pleaded with her son tearfully that he should restore to רב אחדבוי his speech and knowledge. תוספות offers an alternate version of the story. ------------------------- פירש רבינו חננאל דהיינו אימיה דרב אחדבוי‎ – The ר"ח explained that this refers to the mother of רב אחדבוי; she pleaded with רב ששת‎ – ולדידיה קרי עולא משגש אורחא דאימיה שגרם לאמו להתבזות לפני רב ששת‎ – And it was רב אחדבוי whom רבא referred to as ‘a child who contorts the ways of his mother’, because רב אחדבוי caused his mother to embarrass herself before רב ששת‎ – והיא היתה מניקתו של רב ששת לכך אמר חזי הני חדיי דמצית מינייהו: For sרב אחדבוי' mother was the wet nurse of רב ששת, therefore she said to רב ששת, ‘see these breasts from which you nursed’. SUMMARY It was the mother of רב אחדבוי (who was the wet nurse of רב ששת) who pleaded with רב ששת‎. THINKING IT OVER What are the relative advantages of פרש"י and פר"ח‎?

מה כיבוס בגדים האמור בימי חלוטו כולי‎—Just like the washing of the clothes which is written regarding the ימי חלוטו, etc. OVERVIEW The גמרא derives טומאת אדם in the ימי ספורו from טומאת אדם in ימי חלוטו through the common term of כיבוס בגדים, which is mentioned by both of them. תוספות qualifies what can be derived from this commonality. ------------------------------ תוספות anticipates a difficulty בכמה דברים חמור ימי חלוטו מימי ספורו ולא גמר מהיקשא – ימי חלוטו is stricter that ימי ספורו in many ways, and we do not derive from this same היקש of כיבוס בגדים that they should be similar in all respects, so why do we derive that they should be similar regarding טומאת אדם (and not in other respects)? תוספות responds: והיינו טעמא משום דלגמרי לא מצי למגמר‎ – And the reason to distinguish between טומאת אדם and other matters is because we cannot derive completely that all the rules of ימי חלוטו should apply בימי ספורו‎ – דהא כתב וטהר דמשמע דנטהר מכמו שהיה מתחלה‎ – For the תורה wrote וטהר after the ימי חלוטו (and before the ימי ספורו), which indicates that in the ימי ספורו, the מצורע was נטהר from the way he was טמא previously בימי חלוטו, we cannot therefore say that all the stringencies which applied בימי חלוטו apply בימי ספורו‎ – אלא דוקא להך מילתא גמרי לפי שהן שוין‎ – However only regarding this issue (of לטמא אדם) we do derive from the היקש, because they ([טומאת] אדם וכלים) are similar – דאין אדם וכלים מקבלין טומאה אלא מאב הטומאה: For אדם וכלים cannot be מקבל טומאה (from any טומאה), but only from an אב הטומאה, like a מצורע‎. SUMMARY We include טומאת אדם on account of the היקש (because of its commonality with טומאת בגדים [they require an אב הטומאה]) and utilize the וטהר to exclude טומאת אוהל and other stringencies of ימי חלוטו‎. THINKING IT OVER How will רב ששת and רב אחדבוי react to the לימוד of כיבוס בגדים (why did not רב ששת mention it and will רב אחדבוי reject it)?

גדול העושה צדקה בסתר יותר ממשה רבינו‎—One who gives charity discreetly is greater that משה רבינו OVERVIEW The גמרא states that one who gives צדקה בסתר is greater than משה רבינו‎. Our תוספות clarifies this mystifying statement. ------------------------- פירוש יותר משכך חמה ממשה רבינו בתפלתו‎ – The explanation of this statement is that he quiets the anger of Hashem through צדקה בסתר; more that משה was able to quell the anger of Hashem with his prayer- תוספות responds to an anticipated difficulty: ואף על גב דמשה נמי עשה צדקה בסתר שמא אותה שעה כבר פסק אותו זכות: And even though משה also performed צדקה בסתר; perhaps at that time (after the מעשה העגל when משה said כי יגורתי וגו') the merit of that צדקה בסתר had already terminated. SUMMARY Giving צדקה בסתר has a greater capacity of quelling Hashem’s anger, than the power of תפילת משה‎. THINKING IT OVER How does תוספות indeed know that משה רבינו preformed צדקה בסתר, perhaps in the מדבר (where there were no poor people [for all their needs were met]), there was no opportunity for משה רבינו to give צדקה בסתר‎?

חמה אינו כופה‎—It cannot overpower חמה OVERVIEW רב יצחק states that צדקה בסתר has the power to be כופה 'אף'; however (even)צדקה בסתר cannot be כופה the more powerful (wrath of) 'חמה'. Our תוספות cites a contradictory גמרא‎. --------------------------- תוספות asks: תימה דבפרק ארבעה נדרים (דף לב, א) אמרינן דחמה משה הרגו: It is astounding! For in פרק ארבעה נדרים the גמרא states that משה killed חמה‎. תוספות does not resolve the contradiction. SUMMARY From the גמרא in נדרים it appears that חמה is more powerful that אף‎. THINKING IT OVER The גמרא in נדרים states that there are two (types of) חמה; one which משה killed and the other from which משה was afraid. What is תוספות question; the חמה that משה killed is indeed weaker than אף; however the remaining חמה is stronger than אף, which is in accordance with out גמרא that חמה אינו כופה (referring to the more powerful חמה”?!

והמפייסו בדברים מתברך בי"א—And the one who appeases him with words is blessed with eleven OVERVIEW רב יצחק stated one who gives a פרוטה to a poor person receives six blessings, and one who appeases the עני with words receives eleven blessings. Others wish to amend the text, and תוספות rejects their amendment. יש מגיהין והנותן פרוטה לעני והמפייסו‎ – There are those who amend the text to read; ‘and one who gives a פרוטה to an עני and is also מפייסו בדברים, he receives eleven ברכות’. תוספות explains their reason for this amendment: משום דמשמע להו דקראי איירי בנותן צדקה דכתיב ותפק לרעב נפשך ונפש נענה תשביע‎ – Because it seems to them that these verses (which contain the eleven blessings), are discussing one who gives צדקה also (and is not only appeasing the עני) for it is written in the פסוק that ותפק לרעב נפשך ונפש נענה תשביע (and you will extend your soul to the hungry, and you will satiate the afflicted soul); indicating some alleviation of the suffering by giving him צדקה‎. Therefore they conclude that in order to receive the eleven blessings it is necessary to both give him צדקה and appease him. תוספות rejects this proof: ולאו מילתא היא דנפש נענע תשביע היינו תשביע בדברים שתפייסנו בדברים‎ – And this proof is of no import, for the words נפש נענע תשביע means you will satisfy the נפש נענה with words; that you will appease him with words, but not necessarily with giving צדקה also. תוספות completely rejects this view that צדקה must be given in addition to פיוס דברים in order to be מתברך בי"א: ועל כרחך לא גרסינן ליה‎ – And perforce we do not read in our text 'והנותן פרוטה לעני' והמפייסו כו' – דלההיא גירסא הוה ליה למימר מתברך בי"ז הנך שש דלעיל והני אחת עשרה: For according to that גירסא the גמרא should have said that (the נותן and מפייס) is blessed with seventeen ברכות; the previous six (which are mentioned by הנותן alone) and these eleven (which are mentioned in the פסוקים of פיוס [alone]). Therefore since he says מתברך בי"א (only) we must conclude that for פיוס דברים alone he receives eleven ברכות‎. SUMMARY One who is (just) מפייס an עני בדברים (even if he does not offer financial aid) is מתברך בי"א. One who is both נותן ומפייס is מתברך בי"ז. THINKING IT OVER How can we justify that המפייסו alone is greater than הנותן פרוטה; when the עני receives sustenance his hunger is satiated; however the מפייסו seemingly did nothing for his hunger?!
