1The gentile told me that he purchased a field from you, this claim is deemed credible. The Gemara asks: Is there any case where if a gentile says it he is not deemed credible, but if a Jew said it in the gentile’s name he would be deemed credible?

2Rather, Rava said: If a Jew said to the prior owner: A gentile purchased a field from you in my presence, and then he sold it to me, this claim is deemed credible, since if he wanted to, he could have said to the prior owner of the land: I purchased it from you.

3The Gemara records a series of halakhot pertaining to presumptive ownership. And Rav Yehuda says: This one who is holding a sickle and rope and says: I will go cull the dates from the date tree of so-and-so, from whom I purchased it, is deemed credible. The reason for this is that a person is not so brazen that he would cull the dates from a date tree that is not his.

4And Rav Yehuda says: With regard to this one, who possesses a field only from the fence built to prevent the entry of the wild donkeys and outward toward the public property, this conduct is not sufficient to establish the presumption of ownership. What is the reason? The owner says to himself: Everything that he sows, the wild donkeys will eat as well, and cannot establish the presumption of ownership for him, as he is not profiting from the land as an owner would.

5And Rav Yehuda says: With regard to one who profited from the land by consuming produce from the first three years after it was planted [ orla ], during which time one is prohibited from deriving benefit from the produce, this conduct is not sufficient to establish the presumption of ownership. This is also taught in a baraita : With regard to one who profited from the land by consuming orla produce, or profited from the land by consuming produce of the Sabbatical Year, or consumed produce that was prohibited as it was of diverse kinds, this conduct is not sufficient to establish the presumption of ownership.

6Rav Yosef says: With regard to one who profited from the land by consuming fodder, i.e., produce that has grown stalks but is not yet ripe, this conduct is not sufficient to establish the presumption of ownership. Rava said: But if the land was located in the neck of Meḥoza, a valley where it was common to harvest unripe produce to feed animals, this conduct is sufficient to establish the presumption of ownership.

7Rav Naḥman says: Consumption of produce of land that is fissured is not sufficient to establish the presumption of ownership. This is due to the fact that produce does not grow well there, and therefore, owners do not bother to protest if a trespasser uses the land. Therefore, their silence should not be understood as an admission that it belongs to the possessor. Similarly, consumption of produce of land where one expends a kor of seed to sow and retrieves a kor of produce when harvesting it, is not sufficient to establish the presumption of ownership. Here, too, the owners do not bother to protest, as the land is of inferior quality.

8Rav Naḥman continues: And these members of the household of the Exilarch do not establish the presumption of ownership in our land, as people are afraid to lodge a protest against them, and we do not establish the presumption of ownership in their land, as, due to their wealth, they might not lodge a protest against one who trespasses on their land.

9§ The mishna teaches: And of slaves, presumption of ownership of them is established by using them for a duration of three years from day to day. The Gemara asks: With regard to slaves, is there presumptive ownership of them? But doesn’t Reish Lakish say: With regard to livestock [ hagoderot ], possession of them does not establish the presumption of ownership, since they wander from place to place. Therefore, one cannot claim that his mere possession of livestock demonstrates ownership as one can with regard to other movable items, because it may have wandered into his property on its own. The same halakha should apply with regard to a slave. Rava said: It is true that possession of them does not establish the presumption of ownership immediately, but there is presumptive ownership of them after three years.

10Rava said: If the slave in question was a small child placed in a cradle, possession of him does establish the presumption of ownership immediately, as it does with regard to other movable items. The Gemara asks: Isn’t that obvious, since he cannot move on his own? The Gemara answers: No, it is necessary in a case where he has a mother. Lest you say: One should be concerned that perhaps his mother brought him up to there, and his being on another’s property does not indicate that the latter is his master. Therefore, Rava teaches us that there is no concern about this possibility, since a mother does not forget her son. Therefore, possession of the infant slave does establish the presumption of ownership.

11The Gemara relates: There were these certain goats that ate peeled barley [ ḥushela ] in Neharde’a. The owner of the peeled barley came and seized the goats, and was claiming a large sum of money for the barley from the owner of the goats. Shmuel’s father said: He is able to claim up to the value of the goats, since if he wants to, he could say: The goats are purchased and that is why they are in my possession. The Gemara asks: But doesn’t Reish Lakish say: With regard to livestock, possession of them does not establish the presumption of ownership? The Gemara answers: Goats are different, as they are given to shepherds, and do not wander on their own.

12The Gemara challenges: But there is morning and evening to consider, when the goats are unsupervised when traveling between the owner and the shepherd, and during those times this halakha of livestock should apply with regard to them. The Gemara explains: The case under discussion took place in Neharde’a, and Arabs [ tayya’ei ] who steal animals are common in Neharde’a, and goats there are delivered from hand to hand and are never left unsupervised.

13§ The mishna teaches that Rabbi Yishmael says: Three months of possession in the first year, three months of possession in the third year, and twelve months of possession in the middle, which are eighteen months, suffices to establish the presumption of ownership. Rabbi Akiva disagrees, and says that one month in the first and third year, in addition to the full middle year, is sufficient. The Gemara asks: Shall we say that the difference between them is whether plowing the land is sufficient to establish the presumption of ownership? As Rabbi Yishmael holds that plowing is not sufficient to establish the presumption of ownership, and three months are needed for the crop to grow, and Rabbi Akiva holds that plowing is sufficient to establish the presumption of ownership, and therefore one month is sufficient.

14The Gemara asks: And how can you understand their opinions this way? If so, according to Rabbi Akiva, why specifically require a full month?

    Tosafot

הכי גריס רבינו חננאל אכלה ערלה שביעית וכלאים הויא חזקה‎—The text of ר"ח reads;if he ate while it was either ערלה, שביעית or כלאים it is a חזקה OVERVIEW The גמרא cites a מימרא from ר"י and a supporting ברייתא regarding one who made a חזקה by eating the produce of ערלה, שביעית or כלאים‎. In our גמרא it states that it is not a חזקה‎. Our תוספות cites the גירסת ר"ח who maintains that it is a חזקה‎. -------------------- וכן נראה לרבינו יצחק עיקר ואיירי כשאכלה זמורות וכן מוכח בהאשה שנפלו (כתובות דף עט, ב) – And this is also the view of the ר"י that the correct גירסא is הויא חזקה, and we are discussing a case where the מחזיק consumed the twigs, as this is evident in פרק האשה שנפלו‎ – דתנן המוציא הוצאות על נכסי אשתו הוציא הרבה ואכל קימעא קימעא ואכל הרבה‎ – Where the משנה taught, ‘one who laid out expenses for his wife’s estate, whether he expended a lot and con-sumed little, or he expended little and consumed a lot, the rule is – מה שהוציא הוציא ומה שאכל אכל – Whatever he expended he expended and whatever he consumed he consumed’ – ואמר בגמרא עבד רב יהודה עובדא בחבילי זמורות – And the גמרא there relates that ר"י made such a ruling in a case where the husband managed to consume only bundles of twigs – ורב יהודה לטעמיה דאמר רב יהודה אכלה ערלה שביעית וכלאים הויא חזקה‎ – And the גמרא there concludes that ר"י follows his ruling elsewhere, where ר"י ruled that if the מחזיק consumed produce that was ערלה, שביעית or כלאים that it is a proper חזקה‎. תוספות antic-ipates a possible refutation of his proof: ואין לומר דלעולם גרס הכא אינה חזקה והתם כשאכלה זמורות – And one cannot say that really the text here reads 'אינה חזקה', and there where it states הויא חזקה that is because there we are discussing a case where he ate the twigs, which is a valid אכילה (according to ר"י) – והכא כשאכלה פירות שהן אסורים ולכך לא הויא חזקה שלא אכל כדרך האוכלים – However here it is a case where he ate the fruits which are forbidden, and therefore here it is not a חזקה, for he did not consume the produce in the normal manner of con-sumption – תוספות rejects this refutation: דאם כן הוה ליה לאיתויי ההיא דהתם נמי הכא דאיירי בדיני חזקה – For if indeed this is so, (that ר"י made two statements one regarding אכלה זמורות [where it is a חזקה] and the other regarding אכלה פירות [where it is not a חזקה]), the גמרא should have brought also here (in our גמרא) that ruling of ר"י there (that by אכלה זמורות it is a חזקה) since we are discussing the laws of חזקה, so why not mention that there are times [when אכלה ערלה וכו' is not a חזקה (if he was אוכל פירות), and times] when it is a חזקה (if אכל זמורות)! That fact that it is not cited here shows that there is only one ruling of ר"י, namely that הויא חזקה when he was אכלה זמורות‎. תוספות asks: ואם תאמר דהכא משמע דזמורות ועצי כלאים שרו‎ – And if you will say; that from the גמרא here it seems that it is permitted to derive benefit from the twigs and wood of כלאים‎ – ומאי שנא מהא דאמרינן בפרק כל שעה (פסחים דף כו, ב) – And why is this different from what we learnt in פרק כל שעה in a ברייתא‎ – תנור שהסיקוהו בקליפי ערלה או בקשין של כלאי הכרם חדש יותץ מכלל דאסירי – ‘An oven which was heated with the shells/peels of ערלה fruit, or with the straw of כלאי הכרם; if the oven is new, it should be destroyed’; indicating that the straw [and similarly the twigs or wood] of כלאי הכרם are prohibited from deriving benefit from them – תוספות offers an additional proof that by כלאי הכרם even the non-edibles are אסור: ואמרינן נמי התם (דף כה, א) כלאי הכרם עיקרן נאסר‎ – And the גמרא also states there that regarding כלאי הכרם their planted seeds are אסור; indicating (again) that the prohibition by כלאי הכרם is not limited only on the fruit, like by ערלה, but rather it applies to the entire plant both the edible and non-edible parts alike – תוספות rejects this last proof: ומיהו הא לא קשה דאיכא למימר דעיקרן נאסר משום דכתיב (דברים כב) הזרע‎ – However this (last ruling of עיקרן נאסר) presents no diffi-culty, for one can say that the seeds are אסור because the תורה writes הזרע; indicating the זרע will be תקדש; however the twigs which are not זרע may not be prohibited. However the question still remains from קשין של כלאי הכרם which are אסורין בהנאה, so why should the זמורות be מותר בהנאה‎! תוספות answers: ויש לומר דהתם איירי בזרוע מעיקרן‎ – And one can say; that there (by קשין של כלאי הכרם), we are discussing a case where they were initially planted as כלאים, meaning – שנזרעו הזרעים עם נטיעות הכרם שגדלו הזמורות באיסור‎ – That the seeds (of grain) were sown together with the saplings of the vineyard, so the twigs grew באיסור; they were created in a כלאים environment – אבל הכא איירי בזמורות שהיו כבר גדולים קודם שנזרעו כלאים‎ – However here (where ר"י rules דאכלה זמורות) we are dis-cussing a case of vine twigs which were already full grown, before כלאים (with grain) was planted near the vines – שאותן אינן נאסרים אלא כשהוסיפו מאתים‎ – For those vines do not become prohibited only if they added in growth, a two hundredth [half a percent] (after they became כלאים) כדאמר בפרק כל שעה (שם דף כה, א) ובפרק כל הבשר (חולין דף קטז, א) – As the גמרא states in פרק כל שעה and in פרק כל הבשר that – זרוע ובא הוסיף מאתים אין לא הוסיף מאתים לא – If it was already planted before it became כלאים and then כלאים was sown, the rule is that if a two hundredth was added it is כלאים, but if a two hundredth was not added it is not כלאים‎. תוספות now explains the case of אכלה זמורות by כלאים: ומיירי הכא שזמורות לא הוסיפו מאתים והפירות הוסיפו ולכך לא הויא חזקה אלא בזמורות‎ – And we are discussing here (the ruling of ר"י that אכלה זמורות הויא חזקה) that the זמורות were not מוסיף מאתיים after כלאים were planted, but the פירות were מוסיף מאתיים, and therefore it can only be a חזקה with consuming the זמורות which are still מותר but not with the פירות which have become אסור‎. תוספות realizes the anticipated difficulty with this situation that the פירות were מוסיף מאתיים and the זמורות were not: ואין זה דוחק דהכי הוי אורחא דמילתא שקודם מוסיפין הפירות מאתים מן הזמורות‎ – And this is not uncommon, for this is the usual manner that that the פירות are מוסיף מאתיים before the זמורות are מוסיף מאתיים‎ – לפי שהזמורות כבר היו גדולות קודם זריעת כלאים: Since the זמורות were full grown already before the planting of כלאים; so for them to add a two hundredth of their present size takes a while; however for the פירות to grow מאתיים it takes much quick-er. SUMMARY There can be a חזקה by ערלה and שביעית if he consumed the זמורות‎. It can also be a חזקה by כלאים, if the זמורות were already grown before כלאים was planted and the זמורות were not מוסיף מאתיים while the פירות were. THINKING IT OVER 1. Would אכילת זמורות be a proper חזקה in a regular field (which is not ערלה, etc.)? 2. Why is אכילת פירות (by כלאים for instance) not a חזקה; the מרא קמא should have been מערער, since he could have eaten the פירות properly by uprooting the כלאים; why is the אכילת איסור of the מוחזק insufficient to make it a חזקה‎? 3. When we say that הוסיף מאתיים it is אסור, does that mean that only the הוספה is אסור, or the whole branch (fruit) is אסור, even the part that was originally מותר‎? 4. Is there any connection between תוספות question (regarding the per-missibility of זמורות) and the beginning of תוספות (regarding the גירסא)?
