    English translation — Bava Batra 21a

    Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

    1In the latter clause we arrive at the case of schoolchildren who come to learn Torah in his house, and this ruling applies from the time of the ordinance of Yehoshua ben Gamla and onward.

    2What was this ordinance? As Rav Yehuda says that Rav says: Truly, that man is remembered for the good, and his name is Yehoshua ben Gamla. If not for him the Torah would have been forgotten from the Jewish people. Initially, whoever had a father would have his father teach him Torah, and whoever did not have a father would not learn Torah at all. The Gemara explains: What verse did they interpret homiletically that allowed them to conduct themselves in this manner? They interpreted the verse that states: “And you shall teach them [ otam ] to your sons” (Deuteronomy 11:19), to mean: And you yourselves [ atem ] shall teach, i.e., you fathers shall teach your sons.

    3When the Sages saw that not everyone was capable of teaching their children and Torah study was declining, they instituted an ordinance that teachers of children should be established in Jerusalem. The Gemara explains: What verse did they interpret homiletically that enabled them to do this? They interpreted the verse: “For Torah emerges from Zion” (Isaiah 2:3). But still, whoever had a father, his father ascended with him to Jerusalem and had him taught, but whoever did not have a father, he did not ascend and learn. Therefore, the Sages instituted an ordinance that teachers of children should be established in one city in each and every region [ pelekh ]. And they brought the students in at the age of sixteen and at the age of seventeen.

    4But as the students were old and had not yet had any formal education, a student whose teacher grew angry at him would rebel against him and leave. It was impossible to hold the youths there against their will. This state of affairs continued until Yehoshua ben Gamla came and instituted an ordinance that teachers of children should be established in each and every province and in each and every town, and they would bring the children in to learn at the age of six and at the age of seven. With regard to the matter at hand, since this system was established for the masses, the neighbors cannot prevent a scholar from teaching Torah in the courtyard.

    5Concerning that same issue, Rav said to Rav Shmuel bar Sheilat, a teacher of children: Do not accept a student before the age of six, as he is too young, and it is difficult for him to learn in a steady manner. From this point forward, accept him and stuff him with Torah like an ox. And Rav further said to Rav Shmuel bar Sheilat: When you strike a child for educational purposes, hit him only with the strap of a sandal, which is small and does not cause pain. Rav further advised him: He who reads, let him read on his own; whoever does not read, let him be a companion to his friends, which will encourage him to learn to read.

    6With regard to a courtyard, the Gemara concluded that it is permitted for one to establish an elementary school to teach Torah and the neighbors cannot protest. The Gemara raises an objection to this ruling from a baraita : With regard to one member of a courtyard who wishes to become a doctor, a bloodletter, a weaver [ vegardi ], or a teacher of children, the other members of the courtyard can prevent him from doing so. This indicates that neighbors can protest the teaching of children in their shared courtyard. The Gemara answers: With what are we dealing here, i.e., when can they protest his teaching children? We are dealing with a case of gentile children, as there is no mitzva to educate them. In this situation, the neighbors can protest about the noise.

    7Come and hear another baraita : With regard to two people who are residing in one courtyard, and one of them sought to become a doctor, a bloodletter, a weaver, or a teacher of children, the other can prevent him from doing so. The Gemara answers: Here too, we are dealing with a case of gentile children.

    8The Gemara suggests: Come and hear another baraita : One who has a house in a jointly owned courtyard may not rent it to a doctor, nor to a bloodletter, nor to a weaver, nor to a Jewish teacher [ sofer ], nor to a gentile teacher. This indicates that one’s neighbors can prevent him from teaching Jewish children. The Gemara answers: With what are we dealing here? We are dealing with the scribe [ sofer ] of the town, who does not teach children but writes documents and letters for residents of the town. This type of work is not a mitzva, and since many people seek his services, the residents of the courtyard can prevent him from performing this job near their houses.

    9§ With regard to the ordinance of Yehoshua ben Gamla, and concerning teaching children in general, Rava says: From the time of the ordinance of Yehoshua ben Gamla, that schoolteachers must be established in each town, and onward, one does not bring a child from one town to another. Rather, each child is educated where he resides. But one does bring them from one synagogue where they learn to another synagogue. And if a river separates the areas one does not bring the children across, lest they fall into the river. And if there is a bridge spanning the river one may bring them across the river. But if there is only a narrow bridge [ gamla ] one does not bring them.

    10And Rava said: The maximum number of students for one teacher of children is twenty-five children. And if there are fifty children in a single place, one establishes two teachers, so that each one teaches twenty-five students. And if there are forty children, one establishes an assistant, and the teacher receives help from the residents of the town to pay the salary of the assistant.

    11And Rava said: If there is a teacher of children who teaches a few subjects, and there is another who teaches more subjects than him, one does not remove the first teacher from his position to hire the second, as perhaps the other teacher will come to be negligent due to the lack of competition. Rav Dimi from Neharde’a said: On the contrary, all the more so is it the case that he will teach in a better manner if he knows that he is the sole instructor in the place, as jealousy among teachers increases wisdom. The one who was dismissed will try to refine his skills so that he will be rehired, and this will prevent negligence on the part of the other teacher.

    12And Rava said: If there are two teachers of children, one who teaches a lot of material but is not precise in his statements, and one who is precise but does not teach a lot of material, one hires the one who teaches a lot of material but is not precise. Why is this? Errors will be corrected by themselves, and no lasting harm will be caused. By contrast, Rav Dimi of Neharde’a said: One hires the instructor who is precise and does not teach a lot of material, as once an error is taught, it is taught, and cannot be easily corrected.

    13The Gemara cites a proof for the opinion of Rav Dimi of Neharde’a: This is as it is written: “For Joab and all Israel remained there six months until he had cut off every male in Edom” (I Kings 11:16). When Joab came before King David after this episode, David said to him:

    2דאמר רב יהודה אמר רב: ברם, זכור אותו האיש לטוב ויהושע בן גמלא שמו, שאלמלא הוא, נשתכח תורה מישראל. שבתחלה, מי שיש לו אב מלמדו תורה, מי שאין לו אב לא היה למד תורה. מאי דרוש? (דברים יא, יט) ולמדתם אותם ולמדתם אתם.

    3התקינו שיהו מושיבין מלמדי תינוקות בירושלים. מאי דרוש? (ישעיהו ב, ג) ״כי מציון תצא תורה״. ועדיין מי שיש לו אב היה מעלו ומלמדו, מי שאין לו אב לא היה עולה ולמד. התקינו שיהו מושיבין בכל פלך ופלך. ומכניסין אותן כבן ט"ז כבן י"ז׃

    4ומי שהיה רבו כועס עליו מבעיט בו ויצא. עד שבא יהושע בן גמלא ותיקן, שיהו מושיבין מלמדי תינוקות בכל מדינה ומדינה ובכל עיר ועיר, ומכניסין אותן כבן שש כבן שבע.

    5אמר ליה רב לרב שמואל בר שילת: עד שית לא תקביל, מכאן ואילך קביל, ואספי ליה כתורא. וא"ל רב לרב שמואל בר שילת: כי מחית לינוקא, לא תימחי אלא בערקתא דמסנא. דקארי קארי, דלא קארי ליהוי צוותא לחבריה.

    6מיתיבי: אחד מבני חצר שביקש לעשות רופא, אומן, וגרדי, ומלמד תינוקות בני חצר מעכבין עליו! הכא במאי עסקינן בתינוקות דעכו"ם׃

    7תא שמע: שנים שיושבין בחצר, וביקש אחד מהן לעשות רופא, ואומן, וגרדי, ומלמד תינוקות חבירו מעכב עליו! ה"נ בתינוקות דעכו"ם׃

    8תא שמע: מי שיש לו בית בחצר השותפין ה"ז לא ישכירנו לא לרופא, ולא לאומן, ולא לגרדי, ולא לסופר יהודי, ולא לסופר ארמאי! הכא במאי עסקינן בסופר מתא.

    9אמר רבא: מתקנת יהושע בן גמלא ואילך, לא ממטינן ינוקא ממתא למתא; אבל מבי כנישתא לבי כנישתא ממטינן. ואי מפסק נהרא לא ממטינן. ואי איכא תיתורא ממטינן. ואי איכא גמלא לא ממטינן.

    10ואמר רבא: סך מקרי דרדקי עשרין וחמשה ינוקי. ואי איכא חמשין מותבינן תרי; ואי איכא ארבעין מוקמינן ריש דוכנא, ומסייעין ליה ממתא.

    11ואמר רבא: האי מקרי ינוקי דגריס, ואיכא אחרינא דגריס טפי מיניה לא מסלקינן ליה, דלמא אתי לאיתרשולי. רב דימי מנהרדעא אמר: כ"ש דגריס טפי קנאת סופרים תרבה חכמה.

    12ואמר רבא: הני תרי מקרי דרדקי חד גריס ולא דייק, וחד דייק ולא גריס מותבינן ההוא דגריס ולא דייק; שבשתא ממילא נפקא. רב דימי מנהרדעא אמר: מותבינן דדייק ולא גריס; שבשתא, כיון דעל על;׃

    13דכתיב: ״(מלכים א יא״, טז) ״כי ששת חדשים ישב שם יואב וכל ישראל, עד הכרית כל זכר באדום״. כי אתא לקמיה דדוד, אמר ליה:

    זכור אותו האיש לטוב ויהושע בן גמלא שמו‎—That man should be remembered for good; and his name is יהושע בן גמלא OVERVIEW The גמרא imparts a great importance to יהושע בן גמלא (for establishing teachers for every city where the children could learn תורה). Our תוספות elaborates regarding this יהושע בן גמלא‎. ----------------------------- הוא אותו האיש דאמר רב יוסף (ביבמות דף סא, א) תרקבא דדינרי עיילא ליה מרתא בת בייתוס‎ – This יהושע בן גמלא is the same one, regarding whom רב יוסף related that מרתא בת בייתוס gave for him three קבין of דינרים‎ – לינאי המלך עד דאוקים ליהושע בן גמלא בכהני רברבי וצדיק גמור היה כדאשכחן הכא‎ – To the king ינאי until he appointed יהושב בן גמלא as a כהן גדול, and יב"ג was a צדיק גמור as we find here (that he is being praised effusively) – תוספות responds to an anticipated difficulty: והא דקאמר התם (שם) קטיר קא חזינא הכא לפי שהיו אחרים חשובים ממנו: And this which רב יוסף said there, ‘I see here a cabal of wicked people’; that is not to be understood the יב"ג was not fit to be כהן גדול, rather it was because there were others who were more prominent than יב"ג, but he was also fit to be כה"ג. SUMMARY יב"ג here is the same as יב"ג in מס' יבמות, and he was fit to be a כה"ג, although there were others who were more prominent than him. THINKING IT OVER Why is תוספות insisting that these two יהושע בן גמלא are the same person; perhaps there were two different people; or perhaps he changed for the better after he became a כה"ג‎?

    ולמדתם אותם ולמדתם אתם‎—And you will teach them; and you will teach OVERVIEW The גמרא relates that initially the people understood that it is incumbent on the fathers (only) to teach תורה to their children, for the פסוק states ולמדתם אותם את בניכם וגו'; however, the word אתם is written without a וי"ו, so it can be read a אתם (האלף פתוחה והתי"ו סגולה); meaning that אתם, you the father, should teach your children. תוספות offers an alternate גירסא and understanding of this דרשה‎. ------------------------------ יש ספרים דלא גרסי ולמדתם אתם ודריש מדכתיב ולמדתם משמע מעצמכם: There are text that are not גורס ולמדתם אתם, rather they expound this דרשה as follows, since it is written ולמדתם (and you shall teach); this indicates that you yourselves the fathers of בניכם are required to teach your children. SUMMARY We can derive the דרשה that a father is obligated to teach his children, from the word 'ולמדתם' by itself (without the אותם אתם דרשה). THINKING IT OVER Is there any advantage in one גירסא over the other?

    כי מציון תצא תורה‎—For the Torah will go forth from Tzeeyon OVERVIEW The גמרא relates that there was a time when the children were taught תורה in ירושלים based on the פסוק of כי מציון תצא תורה [ודבר ה' מירושלים]. Our תוספות explains why indeed does the פסוק state that תורה comes forth from ציון וירושלים‎. ------------------------------------- לפי שהיה רואה קדושה גדולה וכהנים עוסקים בעבודה‎ – For when the child would see the great holiness and the כהנים occupied in the service of the בית המקדש‎ – היה מכוון לבו יותר ליראת שמים וללמוד תורה‎ – He would direct his heart to the fear of heaven and to study תורה‎ – תוספות supports his view: כדדרשינן בספרי למען תלמד ליראה וגומר גדול מעשר שני שמביא לידי תלמוד‎ – As the ספרי expounds the פסוק of, ‘in order that you shall learn to fear, etc.’; this teaches us that מעשר שני is great, for it brings to studying the תורה‎. This concludes the ספרי‎ – תוספות explains how does eating מע"ש in ירושלים bring to תלמוד: לפי שהיה עומד בירושלים עד שיאכל מעשר שני שלו‎ – For the person who brought his מע"ש to ירושלים, would remain there until he finished eating all his מע"ש (which may be eaten only in ירושלים) – והיה רואה שכולם עוסקים במלאכת שמים ובעבודה‎ – And he would see that everyone is involved in the work of heaven and in the service of the ביהמ"ק – היה גם הוא מכוון ליראת שמים ועוסק בתורה: So he too would direct himself to fear heaven and be occupied in תורה study. SUMMARY Being in a place where people are acting in a holy manner has that same effect on the visitor. THINKING IT OVER 1. תוספות assumes that being in the environment of ירושלים causes one to be מכוין to יראת שמים ולימוד התורה, and תוספות cites the ספרי as proof. However there is no more proof from the ספרי that the environment causes it, than from our גמרא here. Why does תוספות cite the ספרי‎? 2. Why the different לשונות; regarding the child learning in ירושלים, תוספות writes, היה מכוון לבו יותר ליראת שמים וללמוד תורה, while regarding מע"ש, תוספות writes, היה גם הוא מכוון ליראת שמים ועוסק בתורה‎. [Similarly regarding their impression; by the child he writes, לפי שהיה רואה קדושה גדולה וכהנים עוסקים בעבודה, and regarding מע"ש he writes, והיה רואה שכולם עוסקים במלאכת שמים ובעבודה‎.]

    כבן שש כבן שבע‎—At about the age of six, at about the age of seven OVERVIEW יהושע בן גמלא instituted that there be teachers for young children in every city, and the children would be brought to learn of the age of six or seven years old. Our תוספות explains whether it was six or seven. -------------------------------- כבן שש בבריא כבן שבע בכחוש: By a healthy child he went to school when he was about six years old, and a weak child would go at about seven years of age SUMMARY Stronger children would go to school earlier than the weaker ones. THINKING IT OVER Why should we not say that the smarter children went at the age of six, and the others at the age of seven (regardless of their physical strength)?

    בבציר מבר שית לא תקבל‎—Do not accept less than the age of six OVERVIEW רב instructed רב שמואל בר שילת not to accept a student who is younger than six years of age. תוספות reconciles this with a seemingly contradictory משנה‎. ----------------------------- תוספות responds to an anticipated difficulty: והא דתנן במסכת אבות (פרק ה' משנה כ"א) בן חמש שנים למקרא בבריא לגמרי – And this which the משנה teaches in מסכת אבות, at five years old a child should be taught חומש, that is only if he is completely healthy – תוספות offers support to his view: כדאמר בכתובות (דף נ, א ושם) הלומד בנו פחות מבן שש רץ אחריו ואינו מגיעו – As רב קטינא states in מסכת כתובות, ‘one who teaches his son when he is less than six years old, he may run after him, but he will not reach him. The גמרא continues – ואיכא דאמרי חבריו רצין אחריו ואין מגיעין אותו ותרוייהו איתנהו דחליש וגמיר‎ – And some say that his friends run after him, but they cannot reach him; the גמרא concludes; ‘and both these statements are true, he is weak (like the first interpretation) and he is learned’ (like the א"ד). The גמרא offers an alternate view – ואיבעית אימא הא בכחוש והא בבריא: And if you want I can say, this (that he will be sick) is regarding a weak child, and this (the א"ד) is by a healthy child. SUMMARY A child who is בריא לגמרי can begin learning at five years old. THINKING IT OVER Perhaps בן חמש in the משנה means when he completed his five years and is entering his sixth year and כבן שש here means when he is entering his sixth year, so there is no contradiction at all!

    אחד מבני מבוי כולי‎—One of the Mohvooy dwellers, etcOVERVIEW Our גמרא cites a ברייתא, which states that if one of the בני מבוי decided to open a medical practice in the מבוי, or to become a אומן, גרדי or מלמד תינוקות, any other member of the מבוי can prevent him from doing so. תוספות rejects this גירסא‎. ------------------------------------ פירש רבינו שמשון בן אברהם דלא גרס מבוי אלא חצר – The רשב"א explained that the גירסא is not מבוי, but rather חצר‎ – דאי גרס מבוי תיקשי לאביי דשרי בחצר אחרת‎ – For if the גירסא is מבוי, there will be a difficulty according to אביי who permits opening a business in another חצר‎ – וההיא דעושה אדם חנות בצד חנות של חבירו שרי לכל הפחות בחצר אחר – And the גירסא of מבוי will also contradict that ברייתא, which states, ‘a person may open a store next to his friend’s store’, that permission is [also] granted at least to open a store in an adjacent חצר (in the same מבוי) – ורבא נמי לא פליג עליה אלא דמוקי מתניתין דשריא אף באותה חצר‎ – And even רבא does not argue with אביי (that members of another חצר cannot be מעכב), rather he establishes the משנה that it is permitted to establish a children’s school even in the same חצר and no one can protest – והכא אסר אפילו בחצר אחרת אלא אחד מבני חצר גרס: And here (if the גירסא is מבוי) it is forbidden even if the people of another חצר protest; therefore we must rather conclude that the גירסא is אחד מבני חצר, only they can protest. SUMMARY Only a dweller of the same חצר can prevent a fellow dweller from opening certain businesses in this חצר, but dwellers of other חצרים in this מבוי have no say. THINKING IT OVER Perhaps we can resolve the contradiction on אביי‎. In the case of אביי the noise of the תינוקות is their coming to the store, therefore the people of the מבוי cannot be מעכב for presumably they too use this store; however in the ברייתא of רופא וכו', this will attract people from other neighborhoods, therefore maybe even the בני מבוי can prevent him from increasing the foot traffic?

    וגרדי‎—And a weaver OVERVIEW The ברייתא taught that if one member of the חצר wants to become a weaver (in the חצר), another member of this חצר can prevent him from doing so. תוספות reconciles this ברייתא with other seemingly contradictory rulings. ---------------------------- תוספות asks: ואם תאמר ומאי שנא גרדי מבעל ריחים‎ – And if you will say; but why is a weaver different from a mill owner – דתנן במתניתין דאין יכול למחות בידו ולומר איני יכול לישן מקול הריחים ומקול הפטיש – For our משנה taught that ‘he cannot protest and say I cannot sleep because of the noise of the mill and the noise of the hammer’; why is a גרדי different?! תוספות answers: ויש לומר דמתניתין בעושה לעצמו והכא בגרדי העושה לאחרים דאיכא נכנסין ויוצאין‎ – And one can say that in the משנה the case is that the mill owner is working for himself (so there is no traffic, only the noise of the mill), however here we are discussing a גרדי who works for others (he weaves cloth for the pubic) so there are people coming and going, and one can protest this type of disturbance – תוספות asks: ואם תאמר הא אמרינן בסמוך האי בר מבואה דאוקי ריחייא כולי‎ – And if you will say; but רב הונא ruled shortly, this member of a מבוי who established a mill in his מבוי, etc. and another מבוי member intended to place another mill in the same מבוי‎ – דינא הוא דמעכב עליה משום דאמר ליה קא פסקת לחיותי‎ – The rule is that the first miller can prevent him from placing his mill in the same מבוי, since he can tell him, ‘you are infringing on my livelihood’. This concludes the ruling of ר"ה – משמע דאי לאו משום דקא פסקת לחיותי היה יכול להעמיד שם הריחים‎ – It seems that if not for the claim of קא פסקת לחיותי, the second one would be permitted to place his mill there – אף על גב דעושה לאחרים – And even though his is working for others; the mill is a business enterprise – תוספות continues to ask: ולקמן נמי תניא עושה אדם חנות בצד חנותו של חבירו כולי‎ – And later the ברייתא also teaches us that ‘one may make a store next to his friend’s store, etc.’; this is true – דאף על גב דאיכא נכנסין ויוצאין טובא‎ – Even though there are many people coming and going, and here we say that if it is a business one can prevent it from opening – תוספות rejects a possible solution: ודוחק לחלק דהתם כבר יש יוצאין ונכנסין לריחים הראשון או לחנות הראשון – And it is difficult to differentiate that there (in the cases of רחיים and חנות) there is already foot traffic from the first mill or the first store, therefore the additional foot traffic is somewhat bearable. תוספות rejects this answer as a דוחק‎. תוספות answers: ויש לומר דהתם בחצר אחרת שרי – And one can say that there it is permitted because the other business is opening in another חצר‎ – תוספות offers an alternate answer to his first question: אי נמי מתניתין נמי בעושה לאחרים‎ – Or you can also say that our משנה, which does not allow anyone to be מעכב on the mill and the banging of the hammer is also in a case where he works for others – ובריחים ובקול הפטיש אין נכנסין ויוצאין כל כך שנותנין לו פעם אחת וטוחן‎ – But nonetheless by a mill and hammer noise there is not so much foot traffic for they give him the wheat one time and he grinds it; the same is with the smith – אבל בגרדי יש הרבה יוצאין ונכנסין שהרבה מביאין לו מטוה: However by a weaver there is a lot of foot traffic for many people bring him yarn to weave – SUMMARY The משנה is when it is a private mill or smithy, the case of גרדי is a business, the case of ריחים וחנות is in two separate חצרים, or all cases are businesses, however there is more traffic by a weaver than by a mill or a smith. THINKING IT OVER תוספות answers that the case of a חנות (בצד חנותו וכו') is when they are in two different חצרים‎. However when תוספות asked his question he assumed that they were in the same חצר; why therefore did not תוספות ask how can we say that we cannot be מעכב the חנות, when in our משנה it clearly states חנות שבחצר יכול למחות‎?!

    ולא לסופר ארמאי‎—And not to a gentile teacher OVERVIEW The ברייתא teaches us that one may not rent out his house in a חצר השותפין to a gentile teacher (because of the noise the students will make). תוספות reconciles this ברייתא with a seemingly contradictory גמרא‎. ---------------------------------- משמע דאם לא סופר הוה שרי להשכיר לארמאי – It seems from this ברייתא that if this gentile was not a teacher, it would be permitted to rent out one’s house to a Gentile. תוספות asks: ואם תאמר דאמרינן בהגוזל בתרא (בבא קמא דף קיד, א) האי בר ישראל‎ – And if you will say, in פרק הגוזל בתרא where רב אשי stated, ‘this Jewish person – דזבין ליה ארעא לעובד כוכבים אמיצרא דבר ישראל חבריה משמתינן ליה‎ – Who sold to a gentile land, which bordered the property of another Jew, the rule is, the seller is placed in חרם (excommunication) – דאמר ליה אריא ארבעת אמיצראי – For the Jewish neighbor says to the seller ‘you placed a lion (the נכרי) at my border’; we see that it is forbidden to sell land to any gentile (next to a ישראל), so why here do we only prevent a סופר ארמאי to rent, but not a regular ארמאי – תוספות rejects an anticipated solution: ודוחק לחלק בין מכר לשכירות – And it is difficult to differentiate between a sale and a rental – תוספות answers: ונראה לרבינו יצחק דהתם כשישראל רצה לקנות אבל אם אין ישראל רוצה לקנות מותר: And it is the view of the ר"י that there in פרק הגוזל it is in a situation where a Jew wanted to buy this property, therefore the seller should not sell it to the נכרי, however if no ישראל wants to buy, it is permitted to sell it to a נכרי, and similarly it is permitted to rent it to a נכרי (near another ישראל). SUMMARY The prohibition of selling (or renting) to a gentile a property near another Jew, is only if there is another Jew who wants to buy (or rent) the property; otherwise it is permitted. THINKING IT OVER What would be the ruling if there is another ישראל who is interested in buying, however the נכרי is offering a higher price; may the ישראל sell it to the נכרי‎?

    בסופר מתא‎—By a Soifayr of the city OVERVIEW The גמרא answered that when the ברייתא stated that one may not rent out his house בחצר השותפין to a סופר, it meant a סופר מתא (not a ‘regular’ teacher of children). There is a dispute between רש"י and תוספות how to explain ספר מתא‎. ------------------------------- אין נראה לפרש כפירוש הקונטרס דסופר מתא היינו מלמד תינוקות של כל העיר‎ – It does not appear to be correct to explain סופר מתא to mean as רש"י explained it that a סופר מתא is the teacher of the small children of the entire city – דאיכא קול גדול‎ – So there is much noise (therefore it is prohibited to rent him a house in the חצר השותפין). The reason תוספות rejects פרש"י is – דהא לקמן אמר רבא מקרי דרדקי וסופר מתא כמותרין ועומדין – For later רבא ruled that one who teaches small children to read, and a סופר מתא are considered as if they were duly forewarned, תוספות asks according to פרש"י – כיון דאשמועינן דמקרי דרדקי הוי פסידא דלא הדר הוא הדין מלמד כל תינוקות העיר‎ – Since רבא informed us that a מקרי דרדקי (who is negligent) is considered a damage that cannot be repaired, the same should apply to a סופר מתא who, according to רש"י is the teacher of all the city’s little children – ואמאי איצטריך תו למינקט סופר מתא – So why was it necessary for רבא to also mention סופר מתא, it is obvious! תוספות rejects another פרש"י elsewhere: ואין לפרש נמי כפירוש הקונטרס בהמקבל (בבא מציעא דף קט, ב) סופר מתא מספר אנשי העיר‎ – And we also cannot explain it as רש"י explains it in פרק (המקבל) [השואל] that ספר מתא means the barber for the city people – דהא קרי הכא בברייתא סופר‎ – For in the ברייתא here he is called 'סופר' (a teacher or scribe), not a ספר (barber) – תוספות offers his interpretation of a סופר מתא: אלא נראה כמו שפירש רבינו חננאל סופר מתא כותב שטרות העיר‎ – Rather תוספות prefers how the ר"ח explains it that סופר מתא means the scribe who writes the documents for the people in the city – ולהכי חשיב ליה לקמן פסידא דלא הדר אם נכתב השטר שלא כדין: And therefore the גמרא considers a mistake of the סופר מתא as an irreparable damage, for if the document is written improperly there is no recourse. SUMMARY סופר מתא can mean a master teacher, (a barber?), or the city scribe for documents. THINKING IT OVER 1. Why does not תוספות cite פרש"י on the עמוד ב' that סופר מתא means a לבלר (a scribe)? 2. According to the ר"ח that a סופר מתא writes the שטרות העיר, why indeed, can one prevent someone from renting him a house בחצר השותפין‎?

    מתקנת יהושע בן גמלא ואילך לא ממטינן ינוקא ממתא למתא‎—From the enactment of יהושע בן גמלא and onwards we do not bring a child from city to city OVERVIEW רבא taught that after the תקנה of יהושע בן גמלא that each city is required to provide teachers for the young children, we do not move the children from one city to another, but rather each city is obligated to provide a teacher for their city. [A teacher can teach from twenty five up to (but not including) forty students in a class. Once there are forty students (up to fifty) we need to hire an assistant. Fifty of more requires two teachers.] תוספות first qualifies and then explains this ruling. ------------------------------- וכגון שיש כאן כ"ה ינוקי שראויין להשכיר להם מלמד – And this rule is valid provided where for instance there are twenty-five children in this city that require that a teacher be hired for them – תוספות asks: ואם תאמר הא אי הוה ממטינן להו למתא אחריתי יצטרכו מלמד בפני עצמן‎ – And if you will say, but if the rule would be not like רבא, and we would be permitted to bring them (these twenty-five students) to another city, they would require a teacher for themselves – כיון דאיכא כ"ה ינוקי ואם כן מאי נפקא מינה – Since they are twenty-five children, so therefore what difference does it make whether we move them to another city, or not?! תוספות answers: ויש לומר דנפקא מינה דאי הוו ב' מלמדי תינוקות באידך מתא‎ – And one can say; that there is a difference in a case if there are two teachers in the other city (with a total of fifty students; twenty five in each class), if not for רבא‎ – היו יכולין להושיב חציים בפני זה וחציים בפני זה: They could place half the students (twelve) before one teacher and the other half (thirteen) before the other teacher. SUMMARY The rule of רבא is only if there are twenty five students. The rule is necessary in a case where in the other city there are fifty students and two teachers. THINKING IT OVER Why is it that if there are less than twenty-five students, they can be moved to another city (so the local city will not incur the expense of a teacher), so even if there are twenty-five students why can’t they be moved as well, to limit the expense?!

    סך מקרי דרדקי כ"ה ינוקי‎—The total for a teacher of beginners is twenty-five children OVERVIEW רבא taught that the total amount of students for one teacher is twenty-five. תוספות explains how we are to understand this. ------------------------------------ אבל פחות מכאן אין בני העיר יכולין לכוף זה את זה להשכיר להם מלמד: However less than this amount, if there are not twenty-five students in the city, the people of the city cannot force each other to hire a teacher for these children. SUMMARY We require a minimum of twenty-five children to coerce all the people of the city to hire a teacher. THINKING IT OVER Why did תוספות not want to learn that twenty-five is the maximum amount of children for one teacher?

    זכור אותו האיש לטוב ויהושע בן גמלא שמו‎—That man should be remembered for good; and his name is יהושע בן גמלא OVERVIEW The גמרא imparts a great importance to יהושע בן גמלא (for establishing teachers for every city where the children could learn תורה). Our תוספות elaborates regarding this יהושע בן גמלא‎. ----------------------------- הוא אותו האיש דאמר רב יוסף (ביבמות דף סא, א) תרקבא דדינרי עיילא ליה מרתא בת בייתוס‎ – This יהושע בן גמלא is the same one, regarding whom רב יוסף related that מרתא בת בייתוס gave for him three קבין of דינרים‎ – לינאי המלך עד דאוקים ליהושע בן גמלא בכהני רברבי וצדיק גמור היה כדאשכחן הכא‎ – To the king ינאי until he appointed יהושב בן גמלא as a כהן גדול, and יב"ג was a צדיק גמור as we find here (that he is being praised effusively) – תוספות responds to an anticipated difficulty: והא דקאמר התם (שם) קטיר קא חזינא הכא לפי שהיו אחרים חשובים ממנו: And this which רב יוסף said there, ‘I see here a cabal of wicked people’; that is not to be understood the יב"ג was not fit to be כהן גדול, rather it was because there were others who were more prominent than יב"ג, but he was also fit to be כה"ג. SUMMARY יב"ג here is the same as יב"ג in מס' יבמות, and he was fit to be a כה"ג, although there were others who were more prominent than him. THINKING IT OVER Why is תוספות insisting that these two יהושע בן גמלא are the same person; perhaps there were two different people; or perhaps he changed for the better after he became a כה"ג‎?

    ולמדתם אותם ולמדתם אתם‎—And you will teach them; and you will teach OVERVIEW The גמרא relates that initially the people understood that it is incumbent on the fathers (only) to teach תורה to their children, for the פסוק states ולמדתם אותם את בניכם וגו'; however, the word אתם is written without a וי"ו, so it can be read a אתם (האלף פתוחה והתי"ו סגולה); meaning that אתם, you the father, should teach your children. תוספות offers an alternate גירסא and understanding of this דרשה‎. ------------------------------ יש ספרים דלא גרסי ולמדתם אתם ודריש מדכתיב ולמדתם משמע מעצמכם: There are text that are not גורס ולמדתם אתם, rather they expound this דרשה as follows, since it is written ולמדתם (and you shall teach); this indicates that you yourselves the fathers of בניכם are required to teach your children. SUMMARY We can derive the דרשה that a father is obligated to teach his children, from the word 'ולמדתם' by itself (without the אותם אתם דרשה). THINKING IT OVER Is there any advantage in one גירסא over the other?

    כי מציון תצא תורה‎—For the Torah will go forth from Tzeeyon OVERVIEW The גמרא relates that there was a time when the children were taught תורה in ירושלים based on the פסוק of כי מציון תצא תורה [ודבר ה' מירושלים]. Our תוספות explains why indeed does the פסוק state that תורה comes forth from ציון וירושלים‎. ------------------------------------- לפי שהיה רואה קדושה גדולה וכהנים עוסקים בעבודה‎ – For when the child would see the great holiness and the כהנים occupied in the service of the בית המקדש‎ – היה מכוון לבו יותר ליראת שמים וללמוד תורה‎ – He would direct his heart to the fear of heaven and to study תורה‎ – תוספות supports his view: כדדרשינן בספרי למען תלמד ליראה וגומר גדול מעשר שני שמביא לידי תלמוד‎ – As the ספרי expounds the פסוק of, ‘in order that you shall learn to fear, etc.’; this teaches us that מעשר שני is great, for it brings to studying the תורה‎. This concludes the ספרי‎ – תוספות explains how does eating מע"ש in ירושלים bring to תלמוד: לפי שהיה עומד בירושלים עד שיאכל מעשר שני שלו‎ – For the person who brought his מע"ש to ירושלים, would remain there until he finished eating all his מע"ש (which may be eaten only in ירושלים) – והיה רואה שכולם עוסקים במלאכת שמים ובעבודה‎ – And he would see that everyone is involved in the work of heaven and in the service of the ביהמ"ק – היה גם הוא מכוון ליראת שמים ועוסק בתורה: So he too would direct himself to fear heaven and be occupied in תורה study. SUMMARY Being in a place where people are acting in a holy manner has that same effect on the visitor. THINKING IT OVER 1. תוספות assumes that being in the environment of ירושלים causes one to be מכוין to יראת שמים ולימוד התורה, and תוספות cites the ספרי as proof. However there is no more proof from the ספרי that the environment causes it, than from our גמרא here. Why does תוספות cite the ספרי‎? 2. Why the different לשונות; regarding the child learning in ירושלים, תוספות writes, היה מכוון לבו יותר ליראת שמים וללמוד תורה, while regarding מע"ש, תוספות writes, היה גם הוא מכוון ליראת שמים ועוסק בתורה‎. [Similarly regarding their impression; by the child he writes, לפי שהיה רואה קדושה גדולה וכהנים עוסקים בעבודה, and regarding מע"ש he writes, והיה רואה שכולם עוסקים במלאכת שמים ובעבודה‎.]

    כבן שש כבן שבע‎—At about the age of six, at about the age of seven OVERVIEW יהושע בן גמלא instituted that there be teachers for young children in every city, and the children would be brought to learn of the age of six or seven years old. Our תוספות explains whether it was six or seven. -------------------------------- כבן שש בבריא כבן שבע בכחוש: By a healthy child he went to school when he was about six years old, and a weak child would go at about seven years of age SUMMARY Stronger children would go to school earlier than the weaker ones. THINKING IT OVER Why should we not say that the smarter children went at the age of six, and the others at the age of seven (regardless of their physical strength)?

    בבציר מבר שית לא תקבל‎—Do not accept less than the age of six OVERVIEW רב instructed רב שמואל בר שילת not to accept a student who is younger than six years of age. תוספות reconciles this with a seemingly contradictory משנה‎. ----------------------------- תוספות responds to an anticipated difficulty: והא דתנן במסכת אבות (פרק ה' משנה כ"א) בן חמש שנים למקרא בבריא לגמרי – And this which the משנה teaches in מסכת אבות, at five years old a child should be taught חומש, that is only if he is completely healthy – תוספות offers support to his view: כדאמר בכתובות (דף נ, א ושם) הלומד בנו פחות מבן שש רץ אחריו ואינו מגיעו – As רב קטינא states in מסכת כתובות, ‘one who teaches his son when he is less than six years old, he may run after him, but he will not reach him. The גמרא continues – ואיכא דאמרי חבריו רצין אחריו ואין מגיעין אותו ותרוייהו איתנהו דחליש וגמיר‎ – And some say that his friends run after him, but they cannot reach him; the גמרא concludes; ‘and both these statements are true, he is weak (like the first interpretation) and he is learned’ (like the א"ד). The גמרא offers an alternate view – ואיבעית אימא הא בכחוש והא בבריא: And if you want I can say, this (that he will be sick) is regarding a weak child, and this (the א"ד) is by a healthy child. SUMMARY A child who is בריא לגמרי can begin learning at five years old. THINKING IT OVER Perhaps בן חמש in the משנה means when he completed his five years and is entering his sixth year and כבן שש here means when he is entering his sixth year, so there is no contradiction at all!

    אחד מבני מבוי כולי‎—One of the Mohvooy dwellers, etc OVERVIEW Our גמרא cites a ברייתא, which states that if one of the בני מבוי decided to open a medical practice in the מבוי, or to become a אומן, גרדי or מלמד תינוקות, any other member of the מבוי can prevent him from doing so. תוספות rejects this גירסא‎. ------------------------------------ פירש רבינו שמשון בן אברהם דלא גרס מבוי אלא חצר – The רשב"א explained that the גירסא is not מבוי, but rather חצר‎ – דאי גרס מבוי תיקשי לאביי דשרי בחצר אחרת‎ – For if the גירסא is מבוי, there will be a difficulty according to אביי who permits opening a business in another חצר‎ – וההיא דעושה אדם חנות בצד חנות של חבירו שרי לכל הפחות בחצר אחר – And the גירסא of מבוי will also contradict that ברייתא, which states, ‘a person may open a store next to his friend’s store’, that permission is [also] granted at least to open a store in an adjacent חצר (in the same מבוי) – ורבא נמי לא פליג עליה אלא דמוקי מתניתין דשריא אף באותה חצר‎ – And even רבא does not argue with אביי (that members of another חצר cannot be מעכב), rather he establishes the משנה that it is permitted to establish a children’s school even in the same חצר and no one can protest – והכא אסר אפילו בחצר אחרת אלא אחד מבני חצר גרס: And here (if the גירסא is מבוי) it is forbidden even if the people of another חצר protest; therefore we must rather conclude that the גירסא is אחד מבני חצר, only they can protest. SUMMARY Only a dweller of the same חצר can prevent a fellow dweller from opening certain businesses in this חצר, but dwellers of other חצרים in this מבוי have no say. THINKING IT OVER Perhaps we can resolve the contradiction on אביי‎. In the case of אביי the noise of the תינוקות is their coming to the store, therefore the people of the מבוי cannot be מעכב for presumably they too use this store; however in the ברייתא of רופא וכו', this will attract people from other neighborhoods, therefore maybe even the בני מבוי can prevent him from increasing the foot traffic?

    וגרדי‎—And a weaver OVERVIEW The ברייתא taught that if one member of the חצר wants to become a weaver (in the חצר), another member of this חצר can prevent him from doing so. תוספות reconciles this ברייתא with other seemingly contradictory rulings. ---------------------------- תוספות asks: ואם תאמר ומאי שנא גרדי מבעל ריחים‎ – And if you will say; but why is a weaver different from a mill owner – דתנן במתניתין דאין יכול למחות בידו ולומר איני יכול לישן מקול הריחים ומקול הפטיש – For our משנה taught that ‘he cannot protest and say I cannot sleep because of the noise of the mill and the noise of the hammer’; why is a גרדי different?! תוספות answers: ויש לומר דמתניתין בעושה לעצמו והכא בגרדי העושה לאחרים דאיכא נכנסין ויוצאין‎ – And one can say that in the משנה the case is that the mill owner is working for himself (so there is no traffic, only the noise of the mill), however here we are discussing a גרדי who works for others (he weaves cloth for the pubic) so there are people coming and going, and one can protest this type of disturbance – תוספות asks: ואם תאמר הא אמרינן בסמוך האי בר מבואה דאוקי ריחייא כולי‎ – And if you will say; but רב הונא ruled shortly, this member of a מבוי who established a mill in his מבוי, etc. and another מבוי member intended to place another mill in the same מבוי‎ – דינא הוא דמעכב עליה משום דאמר ליה קא פסקת לחיותי‎ – The rule is that the first miller can prevent him from placing his mill in the same מבוי, since he can tell him, ‘you are infringing on my livelihood’. However when תוספות asked his question he assumed that they were in the same חצר; why therefore did not תוספות ask how can we say that we cannot be מעכב the חנות, when in our משנה it clearly states חנות שבחצר יכול למחות‎?!

    ולא לסופר ארמאי‎—And not to a gentile teacher OVERVIEW The ברייתא teaches us that one may not rent out his house in a חצר השותפין to a gentile teacher (because of the noise the students will make). תוספות reconciles this ברייתא with a seemingly contradictory גמרא‎. ---------------------------------- משמע דאם לא סופר הוה שרי להשכיר לארמאי – It seems from this ברייתא that if this gentile was not a teacher, it would be permitted to rent out one’s house to a Gentile. תוספות asks: ואם תאמר דאמרינן בהגוזל בתרא (בבא קמא דף קיד, א) האי בר ישראל‎ – And if you will say, in פרק הגוזל בתרא where רב אשי stated, ‘this Jewish person – דזבין ליה ארעא לעובד כוכבים אמיצרא דבר ישראל חבריה משמתינן ליה‎ – Who sold to a gentile land, which bordered the property of another Jew, the rule is, the seller is placed in חרם (excommunication) – דאמר ליה אריא ארבעת אמיצראי – For the Jewish neighbor says to the seller ‘you placed a lion (the נכרי) at my border’; we see that it is forbidden to sell land to any gentile (next to a ישראל), so why here do we only prevent a סופר ארמאי to rent, but not a regular ארמאי – תוספות rejects an anticipated solution: ודוחק לחלק בין מכר לשכירות – And it is difficult to differentiate between a sale and a rental – תוספות answers: ונראה לרבינו יצחק דהתם כשישראל רצה לקנות אבל אם אין ישראל רוצה לקנות מותר: And it is the view of the ר"י that there in פרק הגוזל it is in a situation where a Jew wanted to buy this property, therefore the seller should not sell it to the נכרי, however if no ישראל wants to buy, it is permitted to sell it to a נכרי, and similarly it is permitted to rent it to a נכרי (near another ישראל). SUMMARY The prohibition of selling (or renting) to a gentile a property near another Jew, is only if there is another Jew who wants to buy (or rent) the property; otherwise it is permitted. THINKING IT OVER What would be the ruling if there is another ישראל who is interested in buying, however the נכרי is offering a higher price; may the ישראל sell it to the נכרי‎?

    מי שיש לו בית בחצר השותפין הרי זה לא ישכירנו לא לרופא ולא לאומן וכו'. לא ידעתי למה אמר לא ישכירנו, דהוא הדין לעצמו, שלא יעשה רופא או אומן, כדאיתא באידך ברייתא דלעיל.

    הכא במאי עסקינן בספר מתא פירש רש"י ז"ל מלמד כל תינוקות העיר, ומתוך שמתקבצים שם כולם מרבים עליו את הדרך עליו ביותר. ואינו מחוור, דאי מדינא אפילו עשרים וארבעה ואפילו פחות נמי לא, אלא מן התקנה ומשום מצוה התירו, והילכך אפילו במלמד את כולן כן. ונראין דברי ר"ח ז"ל שפירש סופר שטרות שבעיר, שאין שם משום תקנה, וכל בני העיר צריכין לו ובאין אצלו ומרבין על בני החצר את הדרך.

    אמר רבא מתקנת רבי יהושע בן גמלא ואילך לא ממטי' לינוקא ממתא למתא. פירוש אפילו אין שם עשרים וארבעה כופין זה את זה להושיב ביניהם מלמד תינוקות ולא ממטינן להו למתא אחריתי, דאי אתא רבא לאשמועינן דהיכא דאיכא תינוקות כדי שיעור שישכרו לעצמן מלמד אחד, מאי אתא רבא לאשמעינן, פשיטא, דהיינו עיקר תקנתו של רבי יהושע בן גמלא. ולפי זה הא דאמר רבא סך מיקרי דרדקי עשירין [וארבע] ינוקי, לאו למימר דבפחות מכאן אין כופין זה את זה להושיב ביניהן, כמו שפירשו במקצת המפרשים, אלא לומר שאם יש רבים בעיר ורצו מקצתן להשכיר להן מלמד לכולן ומקצתן אומרים לחלקם, עד עשרים וארבעה, שומעין לזה שאומר רק אחד, מכאן ואילך מוסיפים ריש דוכנא עד ארבעין, ומשם ואילך שנים, וכן לעולם. וכן פירש הרמב"ן נ"ר.

    אי איכא חמשין מותבין תרי ארבעין מותבין ריש דוכנא אף על גב דאמרינן חמשין מותבין תרי, לאו למימרא דאם ליכא חמשין ממש לא מותבין תרי, דודאי מחמשין עד ארבעין נמי מותבין תרי, מדאמרינן ארבעין מותבין ריש דוכנא, אלמא למעלה מארבעין לא סגי בריש דוכנא. והא דאמרינן ארבעין מותבין ריש דוכנא ומסייעין ליה ממתא, פירש רבי' מורי הרב ז"ל דלהכי איצטריך היכא דשכרוהו סתם ללמד כל תינוקות העיר. וקא משמע לן דאפילו הכי אי איכא טפי מעשרים וארבעה סתמא דמילתא לאו אדעתא דמיקריא להו לחוד הוא אלא דמקמו בהדיה ריש דוכנא. ונראה לי דהא דאמרינן ומסייעין ליה ממתא, לאו למימרא דיהא שוכר מדנפשיה ריש דוכנא ולידרו בהדיה בני מתא בפלגא או בתילתא, דאם איתא הוה להו לפרושי בכמה מסייעין ליה. אלא הכי קאמר, מותבין ריש דוכנא כי היכי דמסייע בהדיה, וסיוע זה מסייעין ליה ממתא.

    אחד מבני חצר שבקש ליעשות רופא או אומן או גרדי או מלמד תינוקות של גוים בני חצר מעכבין עליו מפני הנכנסין והיוצאין וכן הדין במבוי הסתום שאחד מבני מבוי מעכב ובמבוי שכלו לבני מבוי על הדרך שכתבנו בפרק ראשון ויש חולקין במבוי כמו שכתבנו בפרק ראשון ומי שיש לו בית בחצר השותפין לא ישכירנו לא לרופא ולא לאמן ולא לגרדי ולא לספר מתא והוא שכותב כל שטרות העיר ואין צריך לומר לסופר ארמאי ומ"מ במכירה מותר אלא אם כן הם רוצים ללקחו ולגוי מיהא אסור וכן כתבוה קצת מפרשים וכבר ביארנו למעלה בפרק ראשון שאם היה שם כבר מאמנות זו אינו מעכב עליו אפילו בחצר והוא שאמרו ולשכנו אינו כופהו כמו שכתבנו בפרק ראשון מעתה אחד מבני מבוי שהיו לו שם ריחים ובא אחד משכניו ורצה להעמיד ריחים גם כן אינו מעכב עליו שעושה אדם חנות בצד חנותו של חברו ומרחץ בצד מרחצו של חברו ואינו יכול למחות שאף הוא אומר לו את עושה בתוך שלך ואני עושה בתוך שלי וכן יכול חנוני לחלק קליות ואגוזים לתינוקות כדי להרגילן אצלו ואע"פ שהיו רגילין אצל האחר אף הוא אומר לו אנא פליגנא אמגוזי את פלוג שביסקי ר"ל שקדים ומ"מ גר שבא ממדינה אחרת ובא להושיב חנותו במבוי זה בצדו של זה הרי הוא מעכב עליו ואם היה פורע עמהם מנת המלך בעיר הזאת אינו מעכב עליו ויש אומרים אף בעיר אחרת הואיל ולאותו מלך הוא נותנה ואין הדברים נראין ומ"מ בן מבוי אחר שבא במבואו של זה להושיב חנות בצדו הרי זה ספק אם יכול לעכבו אם לאו ומעתה מעכב עליו מתחלה ואם עשאו אינו כופהו לסלקו ובמלמד תינוקות אף אינו מעכב עליו תקנת עזרא היא שלא לימנע מלהושיב סופר בצד סופר קנאת סופרים תרבה חכמה:

    כל מה שכתבנו הוא באמנות אבל הסחורות כל בני העיר נעשים סוחרים בכל מקום ואין מוחה בידם ומ"מ בני אדם שבעיר אחרת שבאו למכור סחורתם בעיר כל בני העיר יכולים לעכב ומ"מ רוכלים המחזרים בעיירות להביא בשמים ותכשיטין לבנות ישראל אין בני העיר יכולים לעכבם תקנת עזרא היא שיהו רוכלים מחזרין בעיירות שיהו תכשיטין ובשמים מצויים לבנות ישראל ומ"מ בני העיר מעכבין עליהם שלא לקבוע להם הושבת חנות אלא שיחזרו בכל העיר ויסבבו במבואות על כל הרוצה לקנות וישובו לעירם ואם רוכל זה תלמיד חכם קובע בכל מקום שירצה ושאר סחורות יכולים כל בני אדם שממדינות אחרות למכרן בכאן ביום השוק שהרי יש כאן גם כן קונים ממקום אחר ויש אומרים שאף ביום השוק לא הותרו אלא למכור לאותם הבאים מחוץ ואין דבריהם נראין ומ"מ דוקא ביום השוק אבל לא ביום אחר ואף ביום השוק דוקא בשוק אבל לחזר ולסבב בכל העיר ובמבואותיה אף ביום השוק מעכבין עליהם ואם היו לסוחרים אלו חובות אצל בני עיר והם צריכים לגבותם ואין להם מעות להוציא רשאין למכור אף בלא יום השוק בכדי פרנסתם עד שיגבו את חובותיהם וילכו וכן הדין בכל דבר שהם צריכים להתעכב בשבילו:

    זה שאמרו בכאן כופין בני מבוי זה את זה שלא להושיב ביניהם חייט וכו' ולשכנו אינו כופהו כבר ביארנו פירושה ופסק שלה בפרק ראשון וכבר כתבנו גם כן הפסק בכאן ומ"מ חכמי פרווינשאה פירשו בה שדרכן של בני מבואות חייטין במבוי אחד בפני עצמן וכן בורסיים וגרדיים ורופאים ולבלריים וכן שאר אומניות ועל זה אמרו שכופין שלא להושיב חייט ממקום אחר במבוי של גרדיים וכן בכלם אמנות בשל חברתה ולשכנו אינו כופהו שיכול להושיב עמו חייט ממקום אחר:

    תלמיד חכם שבא לעיר והביא סחורות למכרן ביום השוק מונעין כל שאר בני אדם שלא למכור מאותה סחורה בשוק עד שימכור הוא את שלו לא מן הדין אלא לכבוד תורה והואיל ונודע בתלמיד חכם אין בודקין אחריו יותר מדאי לנסותו והמעכב על ידו נענש:

    גאוני ספרד כתבו בכל אלו שאמרו שמעכבין בשאין פסידא ללוקחים לא בדמים ולא בחשיבות הסחורה אבל כל שיש ללוקחים תועלת בכך אין מעכבין ואף בתלמיד חכם שאין שום תקנה להפסיד את הלוקחים ואף מה שאמרו באחד מבני חצר שלא להשכירה לרופא וכו' דוקא שהוא מוצא לשכרה בדמים כאלו וכן כל כיוצא בזה:

    מקצת מפרשים למדו מסוגיא זו שאם רצה אחד מבני עיר אחרת להלוות מעותיו ולהתעסק ברבית בעיר של אחרים בני העיר מעכבין עליו ואם פורע עמהם במס המלך אין מעכבין עליו ויש אומרים שאף כל המחוז בכלל העיר ולדעתי לא נאמרו דברים אלו אלא באמנות ומיני סחורות אבל בהלואות יראה שאין למחות:

    ממה שכתבנו למדת שזו שאמרו מרחיקין מצודת דג מן הדג כמלא ריצת הדג והוא פרסה ר"ל שהצייד שנתן עיניו בדג אחד ופירש לו מצודה אע"פ שלא זכה בה אין צייד אחר פורש לו מצודה אין הלכה כן אלא פורש ואינו נמנע ואפילו נתן מזונות בתוך המצודה שהיה לנו לומר שהדגים נותנין סימן למקום שיודעין שם מזונות והוא שנאמר כאן דיהבי סמכא והרי הוא כאלו הם לשם וכשהאחר פורש מצודה אחריו כעין גזל הוא אעפ"כ פורש ואינו נמנע:

    מצות עשה על האב ללמד את בנו תורה שנאמר ולמדתם אותם את בניכם ואף לבן בנו שנאמר והודעתם לבניך ולבני בניך ומ"מ מצוה על כל חכם ללמד לכל מי שרוצה ללמוד אלא שאין עליו לשכור מלמדים אלא לבניו ובני בניו בראשונה מי שהיה לו אב היה מלמדו כמצות עשה של תורה ומי שאין לו אב לא היה למד תורה התקינו שיהיו מושיבין מלמדי תינוקות בירושלם ועדין מי שהיה לו אב היה מעלה ומלמדהו מי שלא היה לו אב לא היה עולה ולמד התקינו שיהו מושיבין בכל פלך ופלך והיו מכניסין אותם כבן שש עשרה כבן שבע עשרה ומשהיה רבן כועס עליו מבעט ויוצא עד שבא יהושע בן גמלא כהן גדול בעצת חכמי דורו והתקינו שיהו מושיבין מלמדי תינוקות בכל מדינה ומדינה ובכל עיר ועיר ושיהו מכניסין אותם כבן שש כבן שבע כפי כחו של בן ובריאותו והתבאר במסכת שבת קי"ט ב' שכל עיר שאין בה מלמד תינוקות מחרימין את יושביה עד שיושיבו ואם לא הושיבו מחריבין אותה שאין העולם מתקיים אלא בהבל פיהם של תינוקות וכן התבאר שם שאין מבטלין תינוקות של בית רבן אפילו לבנין בית המקדש אין מקבלין את התינוקות ללמד בפחות מבן שש שמזמן זה ולמעלה ראוי להכבידו ולהלעיטו כשור וכשמכין אותן אין מכין אותם מכת מרדות אלא מכה קלה כדי להזהירם ולא יכה אותם בשוטים אלא ברצועה וכן התבאר בתלמוד המערב שאין מכין אותם בתקופת תמוז אלא מעט אמרו שם ז"ל על ר' יוחנן מפקד לספריא דלא לימחון לטליא בתקופת תמוז מן גו דשליט בה קטב מרירי מאחר שנתקנה תקנה זו ר"ל להושיב מלמדי תינוקות בכל עיר ועיר אין מוליכין את התינוק מעיר לעיר אבל מוליכין אותו בעיר אחת ממלמד אחד למלמד אחר ואם היה נהר מפסיק בין זה לזה אין מוליכין אותו מזה לזה אפילו היה שם גשר קצר והוא הנקרא גמלא בלשון תלמוד אבל אם היה שם גשר רחב והוא הנקרא בלשון תלמוד תיתורא מוליכין ויש מפרשים גמלא גשר של עצים ותיתורא גשר של בנין מושיבין לפני מלמד אחד חמשה ועשרים תינוקות וכך היא מדה בינונית ואם הגיעו התינוקות לחמשים מושיבין שנים ואם לא הגיעו אלא לארבעים מושיבין אחד ומוסרין לו תלמיד חשוב מן האחרים לסייעו בלמודו והוא הנקרא ריש דוכנא ובני העיר מסייעין לו לשכירות אותו ראש דוכן ר"ל שלא יפחתו שכרו בשכר התלמיד היה שם מלמד תינוקות שהוא גורס בקבע אלא ששונה בטעות ויש שם אחר שגורס בדייקות אלא שהוא בטל מסלקין את המוטעה ומושיבין את המדוקדק שהטעות שנטמעה נטמעה וכל שגורס בטעות או שמתרשל בלמודו הרי הוא בכלל ארור עושה מלאכת י"י רמיה וכל שגורס כראוי לו אע"פ שיש אחר גורס יותר הימנו אין מסלקין אותו אא"כ הוא בטל יותר מדאי:

    כבן שש כבן שבע שש לבריא וכו' ככתוב בתוספות. והא דתנן במסכת אבות בן חמש למקרא היינו לגלגל עמו שאביו מלמדו מעט מעט ובן שש ספי ליה כתורא.

    שנים שדרים בחצר בהא ברייתא קמייתא אשמועינן שרבים מעכבים את היחיד והכא אשמעינן דאפילו יחיד על יחיד ונראה דהוא הדין יחיד על רבים. תוספות הרא"ש ז"ל.

    מתקנת יהושע בן גמלא לא ממטינן כו' כתוב בתוספות ואם תאמר הא אי הוה ממטינן להו למתא כו'. יש לומר דאם ממטי להו ממתא למתא הוה ממטי להו לתרי מתי. עד כאן מגליון תוספות.

    אמר רבא מתקנת יהושע בן גמלא ואילך לא ממטינן ינוקא ממתא למתא פירוש אף על גב שאין בעיר עשרים וחמשה תנוקות כופין זה על זה להושיב ביניהם מלמד תנוקות ולא ממטינן להו למתא אחריתי דאי אתא רבא לאשמועינן דהיכא דאיכא תנוקות כדי שיעור שישכרו לעצמן מלמד אחד פשיטא ומאי אתא רבא לאשמועינן היינו עיקר תקנתו של יהושע בן גמלא. הרשב"א. אי נמי אתא לאשמועינן רבא דאפילו לעיר הסמוכה לה לא ממטינן להו ואפילו מבי כנישתא לבי כנישתא היכא דמפסיק נהרא וכופין בני העיר זה את זה על כך. עליות בתרא להר"י ז"ל. ואי מפסיק נהרא וצריך לעברו בספינה לא ממטינן שיטה לא נודעה למי. גמלא גשר של עצים והיינו טעמא דלא ממטינן ליה לינוקא עליה משום דאיכא למיחש דלמא מתלעי הנך עצים אי נמי שטיף להו נהרא ונפל ליה ינוקא לגו נהרא תיתורא גשר של אבנים דליכא למיחש להכי. ריש דוכנא מלמד אחר שישב עמו מסייע לסייע אותו ללמד הנערים ולחנך אותם לפניו. ומסייעינן ליה להאי ריש דוכנא ממתא כלומר אין פוחתין להאי מקרי דרדקי משכרו מה שנותנים להאי רישא דוכנא אלא נותנים לו שכרו משלם ונותנים להאי ריש דוכנא שכירותו מבני מתא. הר"י ן' מיגש ז"ל. וכן כתב הרשב"א ז"ל וזה לשונו: ונראה לי דהא דאמרינן ומסייעי ליה ממתא לאו למימרא דיהא הוא שוכר מדנפשיה ריש דוכנא ולידרו בהדיה בני מתא בפלגא או בתילתא דאם איתא הוה להו לפרושי בכמה מסייעי ליה אלא הכי קאמר מותבינן ריש דוכנא כי היכי דלסייע בהדיה וסיוע זה מסייעין ליה ממתא. וזה לשון ה"ר יהונתן ז"ל: ואותו ריש דוכנא נוטל שכר מן המלמד ומסייעין לו קצת אביהן של תנוקות או גבאי צדקה לשכור לו ריש דוכנא. עד כאן לשונו. האי מקרי דרדקי דגריס ואיכא אחריני דגריס טפי מיניה לא מסלקינן ליה מפני ההוא דגריס טפי מאי טעמא דאי מסלקי ליה אתא לאיתרשולי בנפשיה ומעקר מיניה כל מאי דהוה גריס מקמי הכי ורב דימי מנהרדעא אמר כל שכן כיון דסלקינן ליה משום דלא גריס כחבריה אזיל וטרח וגריס לנפשיה עד דהוה גריס טפי מחבריה דאמר מר קנאת סופרים תרבה חכמה. והר"י פירש בעליותיו וזה לשונו: כל שכן דגריס מאי טעמא קנאת סופרים הראשון יתחזק לקבוע עצמו ללמד מקנאת השני לפיכך לא יתרשל השני כי יאמר אולי יחזרו להושיב את הראשון. כן נראה בעיני. עד כאן לשונו.

    והשטה לא נודעה למי פירש דלמא אתי לאתרשולי פירוש כל מלמד תנוקות תרפה ידו שחושב היום או מחר יסלקוהו כשיבא טוב ממנו ורב דימי מנהרדעא אמר כל שכן דגריס טפי כדי שיחשבוהו שלא יקלקלוהו בגלל שום אדם דאמר מר קנאת סופרים תרבה חכמה כלומר כל אחד מתאמץ להתחכם שלא יחשבו יותר חברו ממנו. עד כאן. אמר רבא מקרי דרדקי דאיתרשיל ושתלא דאפסיד וטבחא דאגרים ואומנא דלא מאיץ כולם כמותרים ועומדים דמי ומסלקי להו בלא אתרייתא. הר"י ן' מיגש ז"ל.

    וּמַכְנִיסִין אוֹתָן כְּבֶן שֵׁשׁ־עֶשְׂרֵה וּכְבֶן שְׁבַע־עֶשְׂרֵה פירוש מכניסין הבריא בן חמש־עשרה שנראה כבן שש־עשרה הכחוש בן שש־עשרה שנראה כבן שבע־עשרה. ונראה בס"ד טעם לזה כי קודם ארבע־עשרה האדם קטן ואין חזקה ליצר הרע בו דאין מחזיקין בנכסי קטן (כתובות יז:) וכמו שכתב הרב עוללות אפרים ז"ל ואחר גמר שלש־עשרה שנכנס בשנת ארבע־עשרה אם לא ילמוד תורה עד אחר שלש שנים משנת ארבע־עשרה יהיה ליצר הרע דין חזקה בו כי חזקת הבתים היא שלש שנים (בבא בתרא כח.) והגוף נקרא 'בית' לכן מכניסין אותו ללמוד בהיותו בן חמש־עשרה שנראה כבן שש־עשרה דאז לא נעשה ליצר הרע בו חזקה שלש שנים כי לא עבר אחר שלש־עשרה אלא שתי שנים שהם ארבע־עשרה וחמש־עשרה ולכחוש מכניסין אותי בן שש־עשרה שנראה כבן שבע־עשרה דהיינו בסוף שש־עשרה קודם שתגמר שלש שנים גמורות. ואומרו כְּבֶן שֵׁשׁ וּכְבֶן שֶׁבַע היינו הבריא בן חמש גמורות שנראה כבן שבע והכחוש בן שש גמורות שנראה כבן שבע ובבריא עושין כנגד תורה שבכתב שהיא חמשה ספרים ובכחוש כנגד תורה שבעל פה שהיא ששה סדרים. והא דקאמר אִלְמָלֵא הוּא נִשְׁתַּכְּחָה תּוֹרָה מִיִּשְׂרָאֵל לאו דוקא דהא איכא בכל פלך ופלך ובירושלים, אלא כונתם לומר מרובו של ישראל דלאו כולי עלמא יתבי במקום שיש מלמדי תנוקות. ואמר עליו זָכוּר לַטּוֹב בשביל שהשתדל בלימוד התורה הנקראת טוב דכתיב כִּי לֶקַח טוֹב נָתַתִּי לָכֶם תּוֹרָתִי אַל תַּעֲזֹבוּ (משלי ד, ב) לכך אמר עליו יזכר לטוב. ברם צריך להבין כיון דהם תקנו בכל פלך ופלך משום דראו שבתקנה הראשונה שהיו בירושלים דוקא לא הועילו מפני דכל מי שאין לו אב אינו עולה אם כן איך נחה דעתם בתקנה זו שתקנו בכל פלך ופלך דאכתי לא עשו בזה תיקון שלם מאחר דליכא בכל עיר ומדינה לא יעלו מן עיר ומדינה כמו דלא היו עולין לירושלים? גם לא פורש בברייתא בתחילה כשעשו בירושלים דוקא איך היו מכניסין במידת השנים? ונראה לי דבתחילה כשהתקינו בירושלים דוקא היו מכניסין אותם כשהם קטנים ולכן מי שאין לו אב אינו עולה כי קטן איך יוכל לעלות לבדו? ואחר כך כשהושיב מלמדים בכל פלך ופלך תיקנו שיכניסום כבן שש־עשרה וכבן שבע־עשרה דאז יוכל לעלות לבדו אפילו אם אין לו אב ולכן חשבו כי עתה יעלו גם מן העיירות ומדינות אך דא עקא כיון דתקנו שיכניסום גדולים כבן שש־עשרה ובן שבע־עשרה היה מבעט ברבו ויצא ולכן בא יהושע בן גמלא ותיקן שיכניסום כבן שש ובן שבע דאז הוא קטן וכיון דקטן צריך לו אב שיעלהו ובודאי מי שאין לו אב לא יעלה לכך תיקן שישבו בכל עיר ובכל מדינה דאז אין צריכין לעלות ממקום למקום.

    כִּי מַחִית לִינוּקָא, לָא תִּמְחִי לֵיהּ אֶלָּא בְּעַרְקְתָא דִּמְסָנָא פירוש חתיכת עור רחבה שמשמעת קול גדול כשיכה בה ואינה מזקת לגוף ולא כאיב ליה כל כך. ומאן דְּקָרִי בשאר ילדים קָרִי ואין צריך לעשות לו הפחדה ומאן דְּלָא קָרִי לִיהֲוֵי זה הילד המוכה בערקתא דמסאנא צַוְותָא לְחַבְרֵיהּ כי השומע קול גדול בהכאה זו חושב שרבו מכה הכאות גדולות ומפחד ממנו ונותן לב ללמוד.
