1the bees will not find it; if it is referring to a leaf, it will grow back.

2§ The mishna teaches: Nor may one set up a launderer’s pond near his neighbor’s wall unless he distances it three handbreadths from the wall. Rav Naḥman says that Rabba bar Avuh says: They taught this only with regard to a soaking pond, in which soiled clothes are left to soak for several days. But in the case of a washing pond [ hanadyan ], where clothes are actively cleaned, four cubits are required. That opinion is also taught in a baraita : A launderer’s pond must be kept four cubits from one’s neighbor’s wall. But didn’t we learn in the mishna that one must keep a distance of only three handbreadths? Rather, must one not conclude from the baraita that the statement of Rav Naḥman is correct?

3And some raise this as a contradiction, and present the mishna and baraita as apparently conflicting sources. We learned in the mishna that a launderer’s pond must be kept three handbreadths from his neighbor’s property. But isn’t it taught in a baraita that four cubits are required? Rav Naḥman says that Rabba bar Avuh says: This is not difficult. Here, the mishna is referring to a soaking pond, which requires three handbreadths; there, the baraita is referring to a washing pond, in which case four cubits are necessary. Rav Ḥiyya, son of Rav Avya, teaches the mishna explicitly as reading: Unless he distanced three handbreadths from the rim of the soaking pond and the wall.

4§ The mishna teaches that one who digs a pit must distance it three handbreadths from another’s property and plaster it with lime. A dilemma was raised before the Sages: What is the precise wording of the mishna? Did we learn: And plasters with lime, meaning that the walls must be plastered with lime in addition to distancing the pit three handbreadths, or perhaps we learned: Or plasters with lime, i.e., one may plaster the walls with lime instead of digging the pit at a distance of three handbreadths.

5The Gemara answers: It is obvious that we learned: And plasters with lime, as, if it enters your mind that we learned: Or plasters with lime, which is the same as what is stated in the clause of the mishna discussing olive refuse, if so, let the tanna combine them and teach them together. If the same halakha applied in all circumstances, all of the mishna’s cases could be taught together.

6The Gemara answers: This is not proof, as perhaps these cases are taught separately because this type of damage is not similar to that type of damage. The first clause of the mishna addresses the issue of damage due to moisture, whereas the last clause addresses the issue of damage due to heat.

7The Gemara suggests: Come and hear a proof from a baraita . Rabbi Yehuda says: With regard to rock that is so soft it crumbles in one’s hands, this one digs his pit from here, on his property, and that one digs his pit from there. This one distances his pit three handbreadths and plasters with lime, and that one distances his pit three handbreadths and plasters with lime. The Gemara analyzes this ruling: The specific reason one must also plaster with lime is that he is using rock that crumbles in one’s hands, from which it may be inferred that if it is rock that does not crumble in one’s hands, one would not be required to plaster with lime as well.

8The Gemara answers: One could say that the same is true, i.e., that even though he is using rock that does not crumble in one’s hands, he must also plaster with lime. And it was necessary for the tanna to mention the case of rock that crumbles in one’s hands, as it might enter your mind to say that since it crumbles in one’s hands, let us require a greater distance. Therefore, the tanna teaches us that this is not the case.

9§ The mishna teaches that one must distance the solid residue of produce that has been pressed free of its oil, and animal manure, and salt, and lime, and rocks three handbreadths from the wall of another, or plaster its receptacle with lime. The Gemara comments: We learned in a mishna there ( Shabbat 47b): With what substances may one insulate a pot of cooked food on Shabbat eve, and with what substances may one not insulate it?

10One may insulate the pot neither with the solid residue of produce that has been pressed free of its oil, nor with manure, nor with salt, nor with lime, nor with sand, whether those materials are moist or whether they are dry. All of these materials spontaneously generate heat when piled up for an extended period of time. Therefore, they add heat to the pot they insulate. The Gemara asks: What is different here that the mishna teaches the halakha in the case of rocks and it does not teach the halakha in the case of sand, and what is different there that it teaches the halakha in the case of sand and it does not teach the halakha in the case of rocks?

11Rav Yosef says: There is a practical reason for this difference. Rocks are not mentioned there because it is not customary for people to insulate food with rocks. Abaye said to him: And is it customary for people to insulate food with wool fleece and tabs of purple wool? As it is taught in a baraita : One may insulate food with wool fleece; with combed wool clumps, which are unwoven; with tabs of purple wool; and with swatches of soft material; but one may not move them on Shabbat because they are set-aside [ muktze ].

12Rather, Abaye said that the tanna follows the biblical aphorism in the verse that states: “Its neighbor tells about him” (Job 36:33), i.e., one example is mentioned and the same applies to the other case. He taught the halakha in the case of rocks here and the same is true of sand; he taught the halakha in the case of sand there and the same is true of rocks. Rava said to Abaye: If this is correct, that “its neighbor tells about him,” let him teach the halakha of all of these examples in one case, and let him teach the halakha of just one in the other case, and it can be said that the same is true with regard to the others.

13Rather, Rava said: There, this is the reason that the tanna does not teach the halakha in the case of rocks: Because they break, i.e., scratch, the pot, and consequently people do not use them for insulating food at all. Here, this is the reason that the tanna does not teach the halakha in the case of sand: Because it heats hot items and cools cold items, and therefore it does not cause any damage to the wall.

14The Gemara asks: But Rabbi Oshaya taught in a baraita that one must distance sand from his neighbor’s wall. The Gemara answers: There, it is referring to damp sand, which must be kept at a distance due to its moisture. The Gemara challenges: Let the tanna of our mishna also teach the halakha in the case of sand and we will interpret it as referring to damp sand. The Gemara answers: This tanna already taught the case of a water channel, which is a source of dampness, and therefore there was no need to mention damp sand as well.

15The Gemara rejects this answer: That is incorrect, as is that to say that the mishna includes only one example of a source of dampness? Doesn’t the mishna teach the case of a water channel? And yet it also teaches the example of a launderer’s pond. This demonstrates that the mishna teaches many cases, despite the similarity between them, and therefore it should have mentioned the halakha in the case of sand as well.

16The Gemara answers: Both of those particular examples are necessary, as, had the tanna taught only the case of a water channel, one would have claimed that a distance must be kept because it is fixed, i.e., water constantly passes through it. But with regard to a launderer’s pond, which is not fixed, as it sometimes holds water and sometimes does not, one might say that one need not distance it from his neighbor’s property. And conversely, had the tanna taught only the case of a launderer’s pond, one might have said that this must be distanced because its water is fixed and standing in one location and therefore leaks out. But with regard to a water channel, one might say distancing it is not required. Consequently, it is necessary to state both examples. By contrast, including the halakha in the case of sand would not add any novel understanding.

17§ The mishna teaches: One must distance seeds, i.e., one may not plant seeds, and one may not operate the plow, and one must eliminate urine, three handbreadths from the wall of another. The Gemara asks: Why is it necessary to mention seeds? Let him derive this requirement to distance the seeds due to the requirement to distance a plow, as in any event the ground must be plowed before it can be sown? The Gemara answers: This is referring to planting with a single hand motion, which is performed without plowing.

18The Gemara further challenges: The mishna teaches that one must distance a plow; but let him derive this requirement to distance a plow due to the requirement to distance the seeds, as plowing is preparation for planting. The Gemara answers: This is referring to one who plows to prepare the ground for trees. The Gemara challenges: But if so, let him derive this requirement to distance a plow due to the requirement to distance the water. If there are trees, there must be a water channel to irrigate them, and arranging one’s field in such a manner should be prohibited for that reason. The Gemara answers: The tanna is referring to Eretz Yisrael, concerning which it is written: “And drinks water as the rain of heaven comes down” (Deuteronomy 11:11). In Eretz Yisrael, water channels were not needed.

19The Gemara asks: Is this to say that seeds

הכי גריס רבינו חננאל בא בידים אין לא בא בידים לא‎— This is the text according to Rabeinu Chananel If it crumbles in one’s hand, yes; it does not crumble in one’s hand, no O VERVIEW The גמרא queried what the משנה meant when it said that one must distance his pit from his friends pit three טפחים and סד בסיד; does the משנה require both; three טפחים and סד בסיד or either one is sufficient. The גמרא cited a ברייתא in which ר' יהודה ruled that by a סלע הבא בידים each one must separate three טפחים וסד בסיד‎. There are different גירסאות how there is any proof from this ברייתא‎. --------------------------- תוספות states that according to the גירסת ר"ח we understand the proof as follows: אלמא או סד בסיד תנן דדוקא בא בידים בעי הרחקה וסיד – It is evident (from this ברייתא) that our משנה is teaching 'או סד בסיד', for we can infer that the ברייתא states only by בא בידים do we require both distancing and סד בסיד‎ – ומשני הוא הדין לא בא ובא בידים איצטריך ליה כולי – And the גמרא rejects this proof, saying, not necessarily so, for the same ruling (requiring both הרחקה and סד בסיד) applies even by לא בא בידים, however it was necessary for ר"י, etc. תוספות mentions another גירסא: ויש ספרים דלא גרסי האי דיוקא אלא משני בא בידים שאני ודקארי לה מאי קארי כולי – And there are other texts that do not mention this inference (of טעמא דבא בידים, etc.), but assume that the proof is self-understood, rather according to this גירסא, the גמרא immediately rejects the proof by saying that בא בידים is different, and then the גמרא asks, and the one that cited this proof why did he cite it, etc. is it not obvious that it is a flawed proof since we cannot compare בא בידים to לא בא בידים‎ – תוספות is dissatisfied with this גירסא of the ויש ספרים: ואין נראה דהיכי בעי למיפשט וסד בסיד תנן‎ – And this גירסא does not appear to be correct, for how did the גמרא attempt to resolve that our משנה teaches וסד בסיד (that we require both) – הא איכא למיבעי ההיא דרבי יהודה גופיה אי תרוייהו בעי אי לאו‎ – For we can pose the same query on the very ברייתא of ר"י, whether we require both (הרחקה וסד) or not; we can ask what does he mean when he says וסד; is it וסד or או סד – כיון דהשתא סבר דאין חילוק בין בא בידים ללא בא: Since now we are assuming that there is no difference between בא בידים and לא בא‎! S UMMARY The ר"ח infers that או סד, while the יש ספרים resolve that וסד‎. They argue whether ( a priori) we can compare בא בידים to לא בא בידים‎. T HINKING IT OVER Can we justify the גירסא of the ויש מפרשים by saying that they disagree with תוספות premise that the גירסא in the משנה is 'וסד' and the query is (merely) what does 'וסד' mean. However the ויש ספרים can maintain that the query is concerning the גירסא in our משנה; is it סד, or או סד‎. However in the ברייתא the גירסא certainly is וסד‎!

משום דמשתכי‎—Because they break O VERVIEW Our משנה taught that one must distance סלעים (stones) from his neighbor’s wall, presumably because they emit heat. The גמרא asked why does the משנה in מסכת שבת, not include סלעים as one of the items in which one is not permitted to be טומן‎. Initially רב יוסף answered because it is not usual to be מטמין in סלעים‎. However אביי asked that it is also unusual to be מטמין in גיזי צמר and nevertheless the משנה mentions them. רבא answered that it is not usual to be מטמין בסלעים because they are משתכי‎. ---------------------------------- פירש הקונטרס דמשברין הקדירה אין דרך להטמין בהן‎ – רש"י [here] explained that משתכי means that since the סלעים break the pots it is not customary to be מטמין in them. תוספות asks: ואם תאמר אכתי תיקשי וכי דרך להטמין בגיזי צמר כדפריך לעיל – And if you will say, the question still remains, ‘ and is it the custom to be מטמין in גיזי צמר’, as the גמרא asked previously?! תוספות answers by differentiating between the two 'אין דרך להטמין': ויש לומר דלעיל הוה בעי למימר דאין דרך להטמין בסלעים‎ – And one can say the previously רב יוסף wanted to say that אין דרך להטמין בסלעים‎ – לפי שההבל יוצא מבין הסלעים ואינו מתקיים ואף על פי כן לפעמים טומנין בהן‎ – Because the heat escapes from between the stones, so the heat does not last, therefore it is אין דרך generally, but nevertheless sometimes people are טומן in סלעים‎ – להכי פריך שפיר מגיזי צמר דתני לה משום דלפעמים טומנין בהן – Therefore אביי correctly challenged this answer from גיזי צמר which are taught, since occasionally we are טומן in גיזי צמר, even though generally we are not טומן בהם‎ – אבל הכא קאמר דאין דרך להטמין כלל בהן לפי שמשברין הקדירה‎ – However here רבא is saying that it is not the custom at all to be מטמין with סלעים because they break the pots (if you are מטמין with them) – והואיל ומילתא דלא שכיח היא כלל לא חש למיתנייה – So since it is something completely uncommon the תנא was not concerned to teach it – תוספות offers an alternate approach: ועוד יש לפרש דכיון דלא שכיחא היא כלל שרי להטמין בהן – And additionally one can explain that since הטמנה בסלעים is totally uncommon, it is permitted to be מטמין in סלעים‎ – דבמילתא דלא שכיחא לא גזרו בהו רבנן – For the רבנן did not make an injunction in something which is totally uncommon – וכן מנהג שלנו שאנו נוהגין להטמין בסלעים שהאש יוצא מהן שקורין קיילו"ש – And so too is our custom that we regularly are מטמין in the type of סלעים which emit fire which are called ‘Kayloosh’. תוספות asks: אבל מכל מקום קשיא מה שהקשה בקונטרס דבכל מקום הוי שיתוך לשון חלודה‎ – However in any event there remains the difficulty which רש"י asked, that everywhere else the word שיתוך is an expression of rust (not breaking) – כמו באלו מציאות (בבא מציעא דף כו, א) דשתיך טפי – Like in פרק אלו מציאות where it states ‘ it is exceedingly rusty’ – ובפרק הבונה (שבת דף קב, ב) דכיון דמשתכי לא עבדי הכי – And in פרק הבונה the גמרא states since they will rust they do not do it – ובפרק קמא דתענית (דף ח, א) אם ראית דור שהשמים משתכין עליו כנחושת‎ – And in the first פרק of מסכת תענית it states, if you see a generation that the heavens appear rusty as the color of copper. In any event we see that שתיך means rust, why here is it used to mean breaking?! תוספות answers: ומפרש רבינו תם בענין אחר דמשתכי דהבל שלהן מקלקל המאכל – And the ר"ת explains משתכי in a different manner, that their heat (of the סלעים) spoils the food (therefore they are not מטמין בסלעים) – תוספות offers an alternate explanation of רבא: ולרבינו יצחק נראה כפירוש רבינו חננאל דמה שאמר להרחיקם משום דמשתכי‎ – And the ר"י prefers the פי' ר"ח that רבא was explaining, this which our משנה states that we must distance the סלעים from the כותל is because דמשתכי; meaning – שמלקין את הארץ ומחלידים אותה ומעלין עפר תיחוח כדאמרינן לקמן גבי זרעים‎ – That the סלעים ruin the land and corrode it (like rust corrodes) and it causes to loosen the land as the גמרא states later regarding seeds – ולא משום הבל דאין מוסיפין שום הבל וטומנין בהן‎ – But not because of any heat. For סלעים do not exude any heat, so therefore one may be טומן in סלעים, therefore the משנה there (by הטמנה) does not mention סלעים‎ – תוספות reconciles the פר"ח even according to our גירסא: ואפילו לפי הספרים דגרסי סלעים היינו טעמא דלא קתני להו התם – And even according to the texts that read; ‘this is the reason why the משנה does not mention סלעים there’ – תוספות responds: יש לפרש דהכי קאמר דלהכי לא קתני להו התם משום דטעמא דהכא‎ – It can be explained that this is what רבא is saying, that therefore the משנה there does not mention סלעים is because of the reason given here, namely – שצריך להרחיקם לא משום הבל אלא משום דמשתכי‎ – That it is necessary to distance סלעים, not because of הבל, but rather because דמשתכי (it corrodes) therefore it is מותר to be מטמין in them – תוספות offers support to the פר"ח: והרב רבינו מרדכי הביא ראיה מירושלמי דגרסינן התם איתמר שהסלעים מרתיחין‎ – And הרר"מ brought proof from the תלמוד ירושלמי to the פר"ח, for we read, ‘there it was stated in one place because the סלעים heat, therefore it must be distanced from the כותל – והכא איתמר שאין הסלעים מרתיחין‎ – And here concerning הטמנה it was stated that the סלעים do nor heat up, so it is מותר to be מטמין in סלעים‎. These two statements contradict each other – אמר רבי יוסי כאן וכאן אין הסלעים מרתיחין‎ – ר"י answered both here (in ב"ב) and there (by הטמנה) the סלעים do not heat up Therefore we understand why טומנין בהן, however why are we מרחיקין; it cannot be because of הבל‎ – אלא מפני שעושים עפר תיחוח ומלקין ארעית הכותל: But rather it is because they loosen the earth and ruin the ground of the wall. S UMMARY People are never טומן בסלעים since they break (דמשתכי) the pots. Either it is אסור להטמין בסלעים, but the משנה does not mention it since it is לא שכיח, or since it is לא שכיח it is מותר להטמין בסלעים‎. Alternately (ר"ת) the סלעים ruin the food in the pots (like rust [דמשתכי] ruins the metal). Finally (ר"י ור"ח), רבא is explaining our משנה that סלעים must be distanced because they ruin the earth, but no heat (and מותר להטמין בסלעים). T HINKING IT OVER How are we to understand that on one hand תוספות writes that it is אין דרך להטמין כלל בסלעים since they break the pots, and on the other hand nowadays we are טומן בסלעים; but how will the סלעים not break the pots?!

דמחממי חיים‎—Because it warms hot O VERVIEW רבא explained; the reason our משנה does not include 'חול' in the items that need to be distanced because they emit heat, is that sand heats things that are already hot (therefore one cannot be טומן a hot pot in חול), however here where it is not near anything hot it does not emit heat. תוספות reconciles our גמרא with a seemingly contradictory גמרא‎. ---------------------------- תוספות anticipates a difficulty: והא דאמר בפרק כירה (שבת דף לח, ב ושם דיבור המתחיל ולא) ביצה‎ – And regarding this which the משנה states in פרק כירה regarding a raw egg – אין טומנין אותה לא בחול ולא באבק דרכים‎ – One may not cover it up (in order to cook it) ; neither with sand or the dust of the roads – תוספות replies: התם בחול שהוחם מחמת השמש דומיא דאבק דרכים: There we are discussing sand which was warmed from the heat of the sun, similar to the ‘dust of the roads’ which can cook the egg only if it was heated by the sun. S UMMARY Only heated sand can cook an egg. T HINKING IT OVER Where is there more reason to prohibit הטמנה in sand; is it if the דבר הנטמן is hot and the sand is cold, or is it if the דבר הנטמן is cold and the sand is hot?
