    Chapter 1 - HaShuttafin

English translation - Bava Batra 7b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1i.e., Mar Yenuka and Mar Kashisha, sons of Rav Ḥisda, said to Rav Ashi: The Sages of Neharde’a follow their usual line of reasoning, as Rav Ḥama, who was from Neharde’a, issued his ruling in accordance with the opinion of Shmuel, who was also from that city. As Rav Naḥman says that Shmuel says: In the case of brothers who divided their father’s estate, they do not have a right-of- way against each other. Although the father would traverse the outer field from the inner field to access the public domain, the brother who received the inner field as an inheritance does not have the right to traverse his brother’s outer field.

2Shmuel continues: Nor do they have the right of windows against each other, i.e., the right to prevent the other from building a wall facing his windows; nor do they have the right of ladders against each other, i.e., the right to set up a ladder in the other’s property in order to get to his own; nor do they have the right of a water channel against each other, i.e., the right to pass a water channel through the other’s property. And be careful with these, since they are established halakhot . Rava says: The brothers do have all of the aforementioned rights. Rav Ḥama agrees with Shmuel’s opinion, that each brother can do as he pleases on his own property without the other one preventing him from doing so.

3Since Rav Ḥama’s rulings were mentioned, the Gemara cites another halakhic ruling in his name. There was a certain promissory note inherited by orphans from their father, stating that somebody owed them money, against which a receipt was produced by the borrower, stating that the debt was already paid. Rav Ḥama said: We cannot use the note to collect the debt on behalf of the orphans, nor can we tear it up. The Gemara explains: We cannot collect with the note because a receipt against it was produced by the borrower; and we cannot tear the note up because perhaps when the orphans grow up they will bring proof that the receipt was forged and undermine it.

4Rav Aḥa, son of Rava, said to Ravina: What is the halakha ? Ravina said to him: In all the cases in this discussion, the halakha is in accordance with the opinion of Rav Ḥama, except for the case of the receipt, because we do not presume that the witnesses are liars. Since witnesses signed the receipt, the court trusts that the debt was paid and they tear up the promissory note.

5Mar Zutra, son of Rav Mari, said: In this case as well, the halakha is in accordance with the opinion of Rav Ḥama, because the validity of the receipt is in doubt. As, if it is so that it is a valid receipt, the borrower should have produced it during their father’s lifetime. And since he did not produce it at the proper time, we learn from this that he may have forged it. Even though this is not an absolute proof, it is sufficient reason not to tear up the promissory note.

6MISHNA: The residents of a courtyard can compel each inhabitant of that courtyard to financially participate in the building of a gatehouse and a door to the jointly owned courtyard. Rabban Shimon ben Gamliel disagrees and says: Not all courtyards require a gatehouse, and each courtyard must be considered on its own in accordance with its specific needs. Similarly, the residents of a city can compel each inhabitant of that city to contribute to the building of a wall, double doors, and a crossbar for the city. Rabban Shimon ben Gamliel disagrees and says: Not all towns require a wall.

7With regard to this latter obligation, the mishna asks: How long must one live in the city to be considered like one of the people of the city and therefore obligated to contribute to these expenses? Twelve months. But if he bought himself a residence in the city, he is immediately considered like one of the people of the city.

8GEMARA: The Gemara asks: Is this to say that making a gatehouse is beneficial? But wasn’t there that pious man, with whom the prophet Elijah was accustomed to speak, who built a gatehouse, and after-ward Elijah did not speak with him again? The objection to the building of a gatehouse is that the guard who mans it prevents the poor from entering and asking for charity. The Gemara answers: This is not difficult: This, the case presented in the mishna, is referring to a gatehouse built on the inside of the courtyard, in which case the poor can at least reach the courtyard’s entrance and be heard inside the courtyard; that, the story of the pious man and Elijah, involves a gatehouse that was built on the outside of the courtyard, completely blocking the poor’s access to the courtyard’s entrance.

9And if you wish, say instead that in both cases the gatehouse was built outside the courtyard, and yet this is not difficult: In the one case, there is a door to the gatehouse, so that the poor cannot be heard inside the courtyard, while in the other case there is no door. Or if you wish, say that in both cases there is a door, and still this is not difficult: In the one case, there is a key needed to open the door, and the key is not available to the poor people, whereas in the other case, there is no key needed. Or if you wish, say that in both cases there is a key needed, and even so this is not difficult: In the one case the key is on the inside, so that the poor cannot reach it, while in the other case of the mishna, the key is on the outside.

10§ The mishna teaches that the residents of a courtyard can compel each inhabitant of that courtyard to financially participate in the building of a gatehouse and a door to the jointly owned courtyard. It is taught in a baraita that Rabban Shimon ben Gamliel says: Not all courtyards require a gatehouse. Rather, a courtyard that adjoins the public domain requires a gatehouse to prevent people from peering in. But a courtyard that does not adjoin the public domain does not require a gatehouse. The Gemara asks: And why don’t the Rabbis make this distinction? The Gemara answers: Even if a courtyard does not adjoin the public domain, people in the public domain sometimes are forced toward the courtyard due to crowding in the public domain, and come and enter the courtyard.

11§ The mishna teaches that the residents of a city can compel each inhabitant of that city to contribute to the building of a wall, double doors, and a crossbar for the city. The Sages taught in a baraita : The residents of a city can compel each inhabitant of that city to build double doors and a crossbar for the city. And Rabban Shimon ben Gamliel says: Not all cities require a wall. Rather, a city that adjoins the state border requires a wall, whereas a city that does not adjoin the state border does not require a wall. The Gemara asks: And why don’t the Rabbis make this distinction? The Gemara answers: Even if a city does not adjoin the border, it sometimes happens that invading troops come into the area. Therefore, it is always good for a city to be protected by a wall.

12With regard to this issue, Rabbi Elazar asked Rabbi Yoḥanan: When the residents of the city collect money to build a wall, do they collect based on the number of people living in each house, or perhaps they collect based on the net worth of each person? Rabbi Yoḥanan said to him: They collect based on the net worth of each person, and Elazar, my son, you shall fix nails in this, i.e., this is an established halakha , and you must not veer from it.

13There are those who say that Rabbi Elazar asked Rabbi Yoḥanan: When they collect money to build a wall, do they collect based on the proximity of the houses to the wall, so that those people who live closer to the wall pay more? Or perhaps they collect based on the net worth of each person. Rabbi Yoḥanan said to him: They collect based on the proximity of the houses to the wall, and Elazar, my son, you shall fix nails in this.

14§ It is related that Rabbi Yehuda Nesia once imposed payment of the tax for the wall even on the Sages. Reish Lakish said to him: The Sages do not require protection, as it is written: “How precious are your dear ones to me, O God… If I should count them, they are more in number than the sand” (Psalms 139:17–18). If I should count whom? If we say this is referring to the righteous, and the verse is saying that they are greater in number than the grains of sand, this is difficult. Now if it is written about all of Israel: “As the sand which is upon the seashore” (Genesis 22:17), can the righteous themselves, who are a part of Israel, be greater in number than the grains of sand? How can they possibly outnumber the grains of sand upon the seashore?

15Rather, this is what the verse is saying: If I should count the deeds of the righteous, they are greater in number than the grains of sand. And it follows by an a fortiori inference: If the grains of sand, which are fewer in number, protect the shore from the sea, barring it from flowing inland (see Jeremiah 5:22), do not all the more so the deeds of the righteous, which are greater in number, protect them? Consequently the Sages do not need additional protection.

    16When Reish Lakish came before Rabbi Yoḥanan and reported the exchange to him, Rabbi Yoḥanan said to him: What is the reason that you did not quote this verse to him: “I am a wall and my breasts are like towers” (Song of Songs 8:10), which may be explained as follows: “I am a wall”; this is referring to the Torah. “And my breasts are like towers”;

מר ינוקא‎—The young master O VERVIEW The גמרא states that מר ינוקא and מר קשישא (the sons of רב חסדא) addressed רב אשי‎. The word ינוקא and קשישא mean young and old respectively. It seems odd that מר ינוקא (the younger) should be mentioned before מר קשישא (the older). תוספות addresses this issue. -------------------------- הוא הגדול ועל שם שנולד בינקותו של רב חסדא קרי ליה מר ינוקא‎ – מר ינוקא is older than מר קשישא, but he was called מר ינוקא since he was born when רב חסדא was (relatively) young – ומר קשישא הוא הצעיר ונולד בקשישותו של רב חסדא (ועיין רש"י כתובות פט, ב ד"ה מר): And מר קשישא is the younger brother and he was born when ר"ח was (relatively) older. S UMMARY מר ינוקא was older than מר קשישא and their names indicated the age of רב חסדא‎. T HINKING IT OVER Why cannot we assume like רש"י that מר ינוקא was younger, and he was mentioned first, because he was the brighter of the two?

נהרדעי לטעמייהו‎—The rabbis of נהרדעא follow their logic O VERVIEW מר ינוקא ומר קשישא told רב אשי that the reason רב חמא ruled בדין קאמר ליה (regarding the case of the אספלידא ותרביצא) is because נהרדעי לטעמייהו (and they then cite a ruling by ר"נ אמר שמואל). Our תוספות clarifies who are the נהרדעי‎. ------------------------- רב חמא נהרדעי הוא כדאמרינן בפרק קמא דסנהדרין (דף יז, ב) [אמוראי] דנהרדעי רב חמא‎ – ר"ח was from נהרדעא as the גמרא states in the first פרק of מסכת סנהדרין; ‘the אמוראים of נהרדעא is רב חמא‎ – ושמואל נמי נהרדעי הוא‎ – And שמואל also was from נהרדעא‎ – כדאמר שמואל (ברכות דף נח, ב) נהירין לי שבילי דרקיע כשבילי דנהרדעי: As שמואל stated the pathways of the heaven are as clear to me as the pathways of נהרדעא‎. S UMMARY רב חמא who was a נהרדעי based his ruling, on a ruling of שמואל who was also a נהרדעי‎. T HINKING IT OVER What (if anything) is תוספות adding to פירוש רש"י‎?!

אין להם דרך זה על זה‎—They have no right of way, one on another O VERVIEW ר"נ אמר שמואל ruled that after the brothers divided their father’s estate they have no easement rights on each other. If for instance one brother received a house and the other received a field, the בעל הבית cannot walk through the field unless his brother (the בעל השדה) chooses to grant him this easement right (even though in the past they would walk through this field to enter the house). תוספות explains and clarifies this rule. ------------------------ טעמא משום דפסיק שמואל בפרק המוכר את הבית (לקמן דף סד, א.) כרבי עקיבא‎ – The reason why אין להם דרך זע"ז is because (the same) שמואל rules like ר"ע in פרק המוכר את הבית‎ – דאמר מוכר בעין יפה מוכר‎ – Who (ר"ע) says that a seller sells with a ‘benevolent eye’ – ולפיכך אין להם דרך זה על זה שלא שייר לעצמו כלום כל אחד חלק בחלק חבירו‎ – And therefore (since מוכר בעין יפה) the brothers have no claim of ‘right of way’ against each other since each brother did not retain any rights in the portion which he granted to his friend (brother) – והוה לו כמוכר‎ – And the division is considered as if each brother is selling to the other brothers all of his rights in the portions which are assigned to them. And even though we rule, according to the one who maintains מוכר בעין יפה מוכר, one who sells a house and retains the courtyard for himself, he sold him the house together with right of way through the חצר to enter the house; the buyer has the right of way to use the path in the חצר which belongs to the seller. Similarly here too, in this division, if one brother received a house and the other the courtyard, why do we not consider that the בעל החצר sold (his rights to) the בית and retained the חצר, in which case the בעל הבית should have an easement in the חצר‎. Why do we say that תוספות responds: לא דמי דהכא כולם מוכרין וכל אחד מכר ולא שייר לעצמו כלום בחלק חבירו‎ – The cases are not comparable, for here by האחין שחלקו, all the brothers are selling, and each one sold his share and did not retain in his brother’s share anything at all, therefore the בעל הבית (who sold his interest of the חצר to the בעל החצר) has no easement rights in the חצר‎ – והוה ליה כמוכר חצר ושייר בית דצריך ליקח לו דרך מבעל החצר: And the בעל הבית is considered as if he sold the חצר and retained the בית, in which case he would be required to buy his easement from the בעל החצר since כל המוכר בעין יפה מוכר‎. S UMMARY The ruling of אין להם דרך זע"ז is based on the ruling of כל המוכר בעין יפה מוכר‎. By האחין שחלקו all the brothers are considered sellers and relinquish any rights in the portions that now belong to their brothers. T HINKING IT OVER Why does not the בעל הבית have a דרך in the חצר‎? Granted that when the בעל הבית sold his share of the חצר to the בעל החצר he relinquished all rights to the חצר, but when the בעל החצר sold his share in the בית to the בעל החצר he was מוכר בעין יפה and give him a דרך in the חצר (just as if the בעל החצר would have sold the בית to a stranger)?!

ולא סולמות זה על זה‎—And no claim of ladders one on the other O VERVIEW ר"נ אמר שמואל taught that brothers after dividing the estate have no easement claims on each other, nor do they have ‘rights of placing ladder’ claims on each other. There is a dispute between רש"י and תוספות as to the meaning of ולא סולמות זע"ז. ------------------------ פירש בקונטרס אם נטל זה בית וחצר וזה נטל עלייה‎ – רש"י explained the meaning of ולא סולמות זע"ז that if one brother took the house and courtyard for his share and the other brother took the attic for his share – אין לקבוע סולם בחצירו של זה לעלות לעלייתו‎ – The בעל העלייה cannot place a ladder in the חצר of the בעל (הבית ו) החצר, in order to go up to his עלייה‎. תוספות asks on פירש"י: וקשה לרבינו יצחק דהיינו ולא דרך זה על זה – And the ר"י has a difficulty with פרש"י for ולא סולמות זע"ז is included in the ruling of ולא דרך זע"ז, nothing is being added by stating ולא סולמות זע"ז. תוספות offers an alternate explanation: ונראה לרבינו יצחק כגון שלקח זה בית וזה עלייה וחצר – And it is the view of the ר"י that ולא סולמות זע"ז is discussing a case where for instance one brother took the house for his share and the other brother took the עלייה and the חצר, and the rule is that the בעל העלייה (וחצר) – אין לו לסמוך הסולם בכותל של זה ולעלות בעלייתו: Cannot support the ladder on the wall of the בעל הבית in order to go up to his עלייה‎. S UMMARY ולא סולמות זע"ז means either (רש"י) that the בעל העלייה cannot place the foot of the ladder in the other’s חצר; or (תוס') that the בעל העלייה והחצר cannot support the ladder on the wall of the בעל הבית‎. T HINKING IT OVER Is it necessary to say, according to the פירוש ר"י, that the בעל העליה owns the חצר or will the ruling be the same if the בעל העליה and the בעל הבית share the ownership of the חצר‎?

ואי בעית אימא הא והא מבראי‎—And if you wish I can say; this and that are from the outside O VERVIEW The גמרא reconciles the משנה which requires a בית שער for a חצר, with the episode which indicates that it is not desirable, in the following manner. 1. If the בית שער is inside the חצר it is undesirable; outside the חצר it is desirable. 2. Alternately even if it is outside the חצר, nevertheless if it has a door it is undesirable; no door - it is desirable. 3. And even with a door nevertheless without a lock (פותחת) – desirable; with a lock it is undesirable. 4. In addition even if it is [outside the חצר] with a door and a lock, but if it can be opened from the outside it is desirable, from the inside –undesirable. תוספות explains why other options are not offered. ------------------------- ולא גרסינן הא והא מגוואי דמגוואי אין שייך לחלק בין אית ליה דלת ללית ליה‎ – And our text do not read, ‘[הא והא מגוואי] both cases are where the בית שער is inside the חצר’ for if the בית שער is inside the חצר, it is not possible to differentiate whether the בית שער has a door or whether it does not have a door; in both cases it would not be desirable since the בית שער is in the חצר‎ – ובין אית ליה פותחת ללית ליה‎ – And if the בית שער is מגוואי we could also not differentiate whether the בית שער has a פותחת or whether it does not have a פותחת‎ – דבכל ענין הוא רע כיון שאין יכול לבא אלא עד פתח החצר – For in any event (with or without a דלת or פותחת), having a בית שער מגוואי is bad, since the poor man cannot come only up to the door of the חצר, and the בית שער does not let his screams to be heard inside the חצר‎. תוספות rejects an alternate explanation which would allow us to be גורס הא והא מגוואי: ואין לפרש הא דאית ליה דלת כולי אחצר קאי – And we cannot explain that which the גמרא differentiates, that this case where it is undesirable is in a situation where it has a door, etc., it is referring to the door of the חצר and not to the door of the בית שער; this would seemingly remove תוספות misgivings. However תוספות negates this interpretation – דהא במתניתין בהדיא קתני כופין אותו לבנות דלת לחצר‎ – For the משנה states explicitly that we force each member of the חצר to build a door for the חצר, therefore presumably every חצר has a דלת, so we cannot say that one case is where the חצר has no דלת‎. We must conclude that the differentiation of whether it has a דלת or not is referring to the בית שער and not to the חצר‎. תוספות anticipates a difficulty: ולמאי דגרסינן מבראי קצת קשה דלא הוי כשאר שינויי דנקט צד דלא מעלי – And according to our גירסא of הא והא מבראי there is a slight difficulty, for this answer of הא והא מבראי is not like the other answers where the גמרא mentions (that both cases are discussing) the negative side and nevertheless it can be reconciled; for instance the גמרא states – הא והא דאית ליה דלת והא והא דאית ליה פותחת‎ – Both cases are where there is a door (which is a negative factor), or both cases are where there is a פותחת (which is also a negative factor) – והכא נקיט ההוא דמעלי: However, here the גמרא mentions the positive factor (that the בית שער is outside). S UMMARY A בית שער מגוואי is never desirable. Every חצר has a דלת‎. The flow of the answers is not symmetrical (first assuming the desirable option and later the undesirable). T HINKING IT OVER תוספות is disturbed that the answer of הא והא מאבראי does not follow the syntax of the last two answers. However תוספות stated that it is impossible to state otherwise! Why therefore is it troublesome?!

לפי שבח ממון הן גובין‎—They collect according to the monetary value O VERVIEW ר' יוחנן resolved the query of ר' אלעזר that for building the חומת העיר we collect from the inhabitants based proportionately on their wealth (the rich pay more than the poor), but we do not tax them all equally per capita (as one option of the query suggested). תוספות explains the reason for the ruling of ר' יוחנן‎. ------------------------- כיון דאין סכנת נפשות לא אזלינן אלא בתר ממון‎ – Since [here] primarily there is no danger to life if there would be no חומה, therefore we do not go according to the people (that they should contribute per capita) but rather we go according to the wealth of the citizens. They each pay proportional to their assets (which may be stolen, if there is no חומה). תוספות offers a corollary case: והכי נמי אמר בהגוזל בתרא (בבא קמא דף קטז, ב) שיירא ההולכת במדבר ועמד עליה גייס‎ – And the גמרא also states a similar ruling in פרק הגוזל בתרא; ‘a caravan that was traveling in the wilderness and marauders entrapped them. The גייס and the שיירא agreed on the amount of money to be given to the גייס, so the שיירא will continue on its way – מחשבין לפי ממון דליכא סכנת נפשות כיון דאין הגייס בא רק בשביל ממון‎ – We assess the members of the שיירא according to the money they have with them, and they each give proportionally (this concludes the גמרא); תוספות continues the reason for this is since there is no סכנת נפשת because the גייס only came for money, but not to kill and maim. תוספות responds to an anticipated difficulty: ואף על גב דאמר בפרק בן סורר (סנהדרין דף עב, א) דהבא במחתרת נידון על שם סופו – And (we rule in this case that מחשבין לפי ממון) even though the גמרא states in פרק בן סורר that a thief who burrows through a tunnel is judged according to the consequence of his actions – ומפרש רבא טעמא בגמרא משום חזקה דאין אדם מעמיד עצמו על ממונו כולי – And רבא explained the reason there in the גמרא, because there is a presumption that a person cannot hold himself back regarding his money, etc. ואפילו הכי אין מחשבין אלא לפי ממון כיון דהגייס ברצונו אינו בא על הנפשות‎ – But nevertheless we only assess the שיירא according to the money (and not according to נפשות even though it can come to נפשות as in the case of הבא במחתרת); since the intent of the גייס is not come for נפשות only for ממון‎. We know this is true – דאם לא יעמדו נגדם לא יזיק לגופם הילכך לא חשיב סכנת נפשות – For if the people of the שיירא will not rise up against the גייס, the גייס will not cause them bodily harm, therefore since the main intent of the גייס is ממון, it is not considered סכנת נפשות (even though it is possible that it may eventually turn out to be a סכנת נפשות [if the שיירא refuses to cooperate]). לפיכך אם יעמדו עליהם לסטים ונתפשרו עמהם גובין לפי ממון‎ – Therefore if robbers apprehend the שיירא and they came to a monetary agreement with the לסטים, we collect according to the money and not לפי נפשות‎ – אבל היכי דטעו במדבר אמר התם דמחשבינן אף לפי הנפשות – However, in a case where the שיירא was lost in the מדבר, the גמרא rules there that we assess also according to נפשות‎ – משום כיון דטעו איכא סכנת נפשות: Because, since they are lost in the מדבר, there is סכנת נפשות‎. S UMMARY Where there is no immediate סכנת נפשות but only a monetary loss, we collect לפי ממון (even if it can deteriorate to a סכנת נפשות situation). T HINKING IT OVER 1. Is the obligation to pay לפי ממון because of the (additional) money that the (richer) person is being protected from losing, or is it based on the cause of the problem, that the thieves come because of the (larger) amounts of money that is there (which belong the richer people)? [In the case of שיירא would they pay according to how rich they are, or according to how much money they are traveling with?] 2. Is there more reason to say גובין לפי ממון by חומה over שיירא or vice versa?

לפי קירוב בתים הן גובין‎—They collect according to the closeness of the houses O VERVIEW In response to the query whether we are גובה לפי ממון or לפי נפשות, the ruling was לפי ממון, and in response to the query (according to the איכא דאמרי) whether we are גובה לפי קירוב בתים or לפי ממון, the response was לפי קירוב בתים‎. Our תוספות clarifies the resolution according to the איכא דאמרי‎. -------------------------- פירש רבינו תם ונותנין עניים קרובים יותר מרחוקים‎ – The ר"ת explained that the resolution of לפי קירוב בתים הן גובין means that the poor who live closer to the חומה must give more than the עניים who live further from the חומה‎ – וכן עשירים קרובים יותר מעשירים רחוקים‎ – And similarly the rich who live closer give more that the rich who live further – אבל עשירים רחוקים נותנין יותר מעניים קרובים דלפי שבח ממון נמי הן גובין: However (even) the rich who live further give more that the poor who live closer, because the collection is also based according to monetary value of the citizens. S UMMARY לפי קירוב בתים הן גובין does not negate that we are also גובה לפי ממון‎. T HINKING IT OVER 1. Is there a מחלוקת between the לישנא קמא and the איכא דאמרי (according to תוספות) since they both agree לפי ממון הן גובין‎? 2. What was the initial query if לפי ממון or לפי קירוב בתים (according to תוספות)?!

אילימא לצדיקים כולי‎—Can I say, for the righteous, etc - O VERVIEW The גמרא cites the פסוק of אספרם מחול ירבון; ‘can I count them, (when) they are more numerous than the sands’, and asks can this פסוק be referring to צדיקים (and rejects this notion). תוספות explains why the גמרא initially assumed that this פסוק is referring to the counting of צדיקים‎. ----------------------- דבהכי מיירי קרא‎ – The גמרא assumes that אספרם מחול ירבון refers to צדיקים, since this is what the פסוק is discussing – דלעיל מיניה כתיב ולי מה יקרו רעיך אל מה עצמו ראשיהם – Because in the previous פסוק it is written, ‘and as for me how precious are your friends, oh Lord, how mighty are their leaders [numbers]’ – וכתיב בתריה אספרם מחול ירבון: And in the next פסוק it is written אספרם מחול ירבון, obviously the אספרם is referring to the רעיך in the previous פסוק‎. The רעיך א-ל are the צדיקים‎. S UMMARY It was assumed that אספרם refers to צדיקים from the continuity of the previous פסוק‎. T HINKING IT OVER According to the conclusion of the גמרא that the פסוק of אספרם does not refer to צדיקים, how do we explain the continuity of the פסוקים‎?
