    Chapter 1 - HaShuttafin

English translation - Bava Batra 17a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1a taste of the World-to-Come. They are: Abraham, Isaac, and Jacob. Abraham, as it is written with regard to him: “And the Lord blessed Abraham with everything” (Genesis 24:1). Isaac, as it is written with regard to him: “And I have eaten from everything” (Genesis 27:33). Jacob, as it is written with regard to him: “Because I have everything” (Genesis 33:11). This teaches that already in their lifetimes they merited everything, i.e., perfection.

2There were three people over whom the evil inclination had no sway. They are: Abraham, Isaac, and Jacob, as it is written with regard to them, respectively: “With everything,” “from everything,” “everything.” The completeness of their blessings means that they did not have to contend with their evil inclinations. And some say that even David was not subject to his evil inclination, as it is written: “And my heart has died within me” (Psalms 109:22), meaning that the evil inclination in his heart was nullified as if his heart had died. And how does the other authority, who does not include David in his list, explain this verse? He is mentioning his travails. David means to say that his heart died within him owing to all the suffering that he endured, but he says nothing about his evil inclination.

3The Sages taught: There were six people over whom the Angel of Death had no sway in their demise, and they are: Abraham, Isaac, and Jacob, Moses, Aaron, and Miriam. Abraham, Isaac, and Jacob, as it is written with regard to them, respectively: “With everything,” “from everything,” “everything”; since they were blessed with everything they were certainly spared the anguish of the Angel of Death. Moses, Aaron, and Miriam, as it is written with regard to them that they died “by the mouth of the Lord” (Numbers 33:38; Deuteronomy 34:5), which indicates that they died with a kiss, and not at the hand of the Angel of Death.

4The Gemara asks: But with regard to Miriam it is not written: “By the mouth of the Lord.” Rabbi Elazar says: Miriam also died with a kiss, as this is learned through a verbal analogy between the word “there” mentioned in regard to Miriam: “And Miriam died there” (Numbers 20:1), and the word “there” mentioned in regard to Moses: “And Moses died there” (Deuteronomy 34:5). And for what reason is “by the mouth of the Lord” not stated with regard to her? It is unseemly to mention death by a kiss with regard to a woman.

5The Sages taught: There were seven people over whom the worm and the maggot had no sway, and they are: Abraham, Isaac, and Jacob, Moses, Aaron and Miriam, and Benjamin, son of Jacob. Abraham, Isaac, and Jacob, as it is written with regard to them, respectively: “With everything,” “from everything,” “everything.” Moses, Aaron, and Miriam, as it is written with regard to them: “By the mouth of the Lord”; Benjamin, son of Jacob, as it is written: “And to Benjamin he said: The beloved of the Lord, he shall dwell in safety by Him” (Deuteronomy 33:12). Even in death, he rests securely, unbothered by worms. And some say that even David is included, as it is written: “My flesh also dwells secure” (Psalms 16:9). The Gemara asks: And how does the other authority, who does not include David, explain this? The Gemara answers: He is asking for mercy, that his flesh should dwell secure and not be subject to worms and maggots, but his request was denied.

6The Sages taught in a baraita : There were four people who died only because of the counsel of the primordial snake, in the wake of which all of humanity became mortal, and not on account of any personal sin. And they are: Benjamin, son of Jacob; Amram, father of Moses; Yishai, father of David; and Chileab, son of David. And all of these are known through tradition except for Yishai, father of David, with regard to whom it is written explicitly: “And Absalom placed Amasa over the army instead of Joab, and Amasa was the son of a man whose name was Ithra the Israelite, who engaged in intercourse with Abigail, daughter of Nahash, the sister of Zeruiah, mother of Joab” (II Samuel 17:25). But was Abigail the daughter of Nahash? Was she not the daughter of Yishai, as it is written: “And their sisters were Zeruiah and Abigail” (I Chronicles 2:16)? Rather, she was called “daughter of Nahash” to indicate that she was the daughter of one who died only because of the counsel of the snake.

7MISHNA: A person may not dig a pit close to the pit of another, in order to avoid damaging the latter’s pit. And similarly, one may not dig a ditch, nor a cave, i.e., a covered pit, nor a water channel, nor a launderer’s pond, which is a pit used for washing clothes, unless he distanced all of these three handbreadths from the wall of another and he plasters lime on the place where there is water.

8And one must distance the solid residue of produce that has been pressed free of its oil, e.g., the refuse of olives from which oil has been squeezed, and animal manure, and salt, and lime, and rocks three handbreadths from the wall of another, as all these items produce heat and can damage the wall. Or, alternatively, he may plaster the wall with lime to prevent damage. One must likewise distance seeds, i.e., one may not plant seeds, and one may not operate the plow, and one must eliminate urine, three handbreadths from the wall of another.

9The mishna continues: And one must distance a mill from a neighbor’s wall by three handbreadths from the lower stone of the mill, which is four handbreadths from the smaller upper stone of the mill. And there must be a distance of three handbreadths from the protruding base [ hakalya ] of an oven until the wall, which is four handbreadths from the narrow upper rim [ hassafa ] of the oven.

שלשה לא שלט בהן יצר הרע‎—The יצה"ר did not have dominion over three OVERVIEW The ברייתא states that the יצה"ר had no power over אברהם יצחק ויעקב‎. Our תוספות clarifies and qualifies this statement. ----------------------- תוספות rejects the apparent understanding of this statement: אין לפרש שלא שלט כלל‎ – We cannot interpret this statement of ג' לא שלט בהן יצה"ר to mean that the יצה"ר had no power over them at all – דאם כן היכי קבלו עליה אגרא‎ – For if indeed that were the case how did the אבות receive any reward for their actions, since they had no יצה"ר to deter them – תוספות offers his interpretation of this statement: אלא כדאמר (יומא דף לח, ב) מאי דכתיב רגלי חסידיו ישמור‎ – But rather it is like that which the גמרא states, ‘what does the פסוק mean רגלי חסידיו ישמור (he guards the feet of his Chassidim); ר' יוחנן responds – כיון שעבר אדם רוב שנותיו ולא חטא שוב אינו חוטא – Once the majority of a person’s years have passed and he did not sin, he will not sin further’ – הכא נמי כיון שראה הקדוש ברוך הוא שהיו דוחקין עצמן כל כך להתרחק מן העבירה‎ – Here too, regarding the אבות since הקב"ה saw that the אבות were exerting themselves so much to distance themselves from an עבירה, therefore – סייעם הקדוש ברוך הוא מכאן ואילך שלא שלט בהן יצר הרע: הקב"ה helped them from this point onward that the יצה"ר had no power over them. SUMMARY Once הקב"ה saw the effort the אבות exerted to distance themselves from an עבירה, he helped them by removing from them the שליטה of the יצה"ר. THINKING IT OVER Does לא שלט בהן יצה"ר (regarding the אבות), have the same meaning as ולבי חלל בקרבי (which is written regarding דוד)? הדרן עלך השותפין ישבעו כל דכפין בהבנת דברי המוסיפין לפרק כל קושיות המסתירין ולהוציא לאור דברים מתוקנין בעזרת עילאה על כל עילאין

שבעה שלא שלטה בהן רמה‎—Seven; over whom the worms had no dominion OVERVIEW The ברייתא states that there seven people over whom the worms had no dominion after they passed on. תוספות reconciles our גמרא with a seemingly contradictory גמרא elsewhere. For this also applies regarding all צדיקים, as the גמרא states in מסכת שבת in פרק שואל regarding the פסוק of – ורקב עצמות קנאה מי שיש לו קנאה בלבו עצמותיו נרקבין‎ – ורקב עצמות קנאה (and the rotting of bones is caused by jealousy); he who has jealousy in his heart, his bones rot – ושאין קנאה בלבו אין עצמותיו מרקיבין‎ – And if there is no jealousy in heart his bones do not rot. Seemingly this applies to more than the seven mentioned here, but rather to all those that אין קנאה בלבו‎. תוספות answers: ויש לומר דיכול להיות שלא ירקב וישלוט בו רמה‎ – And one can say that it is possible that he should not rot, but nevertheless the worms have dominion over him – כדאמר במעשה דרבי אלעזר בן שמעון בהשוכר את הפועלים (בבא מציעא דף פד, ב) – As the גמרא states regarding the episode with ראב"ש in פרק השוכר את הפועלים‎ – דנפיק ריחשא מאודניה: That a worm came out from his ear (however his body was whole and did not rot). SUMMARY Anyone who has no jealousy will not rot (but his body may become wormy); however the seven mentioned here, did not even have any worms. THINKING IT OVER Why did not תוספות distinguish between the rotting of bones ([which applies to those who have no jealousy] which however is a lesser miracle) and the rotting of flesh (which is a greater miracle and applies only to these seven)?!

לא יחפור‎—One should not dig OVERVIEW The משנה rules that one may not dig all kinds of pits and water canals or a launderer’s pond near his friends well. תוספות discusses the reason for this prohibition. --------------------------------- כל הני איירי דאית בהו מיא וטעמא משום מתונתא כדאמרינן בגמרא – All these prohibition are in a case where there is water in these excavations, and the reason it is prohibited is because of the moisture, as the גמרא states – תוספות asks: ותימה לרבינו יצחק והא אמרינן בגמרא כל מרא ומרא דקא מחית כולי – And the ר"י is astounded, but the גמרא states, ‘every single strike of the shovel, etc. weakens my earth – תוספות answers: ואומר רבינו יצחק דלא קאמר אלא שמאותה שעה מתחיל ההיזק‎ – And the ר"י says that רבא only meant to say that the damage begins at that time of the digging – וכיון דבתחילת ההיזק הוו גירי דיליה מודה רבי יוסי – So since that at the onset of the damage (when he starts digging) it is ‘his arrows’ that are causing the damage, therefore ר' יוסי would admit that it is prohibited – ומיהו אי לאו משום מיא לא היה צריך הרחקה ג' טפחים: However if not for the water it would not be necessary to distance three טפחים from the בור‎. SUMMARY The damage done by digging makes it גירי דיליה, the damage done by the water requires distancing three טפחים‎. THINKING IT OVER 1. תוספות states that the damage caused by digging alone will not require distancing three טפחים; why therefore would ר"י agree with our משנה which requires distancing three טפחים, since the requirement is based on מתונתא which is not גירי דיליה‎?! 2. If there would be no water (no מתונתא), will it still be necessary to distance somewhat from the בור because of the digging?

לא שיח ולא מערה‎—Not a ditch and not a cave OVERVIEW The משנה mentions various different excavations that are required to be distanced from a בור‎. Our תוספות discusses why some are mentioned while others are omitted. ------------------------------ והוא הדין חריצין ונעיצין והני נקט אגב בור דבכל מקום רגיל לשנות שיח ומערה בהדי בור‎ – And the same rule applies to חריצין ונעיצין, and the משנה mentions (only) these, שיח ומערה (but not חריצין ונעיצין), on account of בור, for the תנא is accustomed everywhere to mention שיח ומערה together with בור‎ – ואמת המים ונברכת הכובסין דאין רגיל לשנותן גבי בור מפרש בגמרא דצריכי תרוייהו‎ – And regarding אמת המים and נברכת הכובסין, which are not usually taught together with בור, the גמרא explains that it was necessary to write them both. תוספות responds to the anticipated question: ומיהו הא לא מפרש אמאי לא הוה שמעינן להו מבור – However the גמרא does not explain why we could not have derived אמת המים ונברכת הכובסין from בור; the reason may be self-explanatory – דמצי למימר דבור ושיח דעמוקין טפי בעי הרחקת שלשה‎ – For we could have explained that בור ושיח, which are deeper, (than אמת המים וכו') requires a distancing of three טפחים‎ – אבל הנך דלא עמיקי כולי האי הוה אמינא דלא בעי הרחקת שלשה‎ – However these (אמת המים וכו') which are not that deep, we may have thought that they do not require distancing three טפחים‎ – ואי תנא הני הוה אמינא דבור ושיח דעמיקי טפי בעי הרחקה יותר מג' – And if the תנא would teach that these אמת המים ונברכת הכובסין, require distancing ג' טפחים but not mention בור וכו', we would have thought that בור ושיח which are deeper than אמת המים וכו', require distancing more than three טפחים‎. The גמרא may have felt that this distinction is obvious. תוספות anticipates a difficulty: ובפרק הפרה (בבא קמא דף נ, ב) דתנן אחד החופר בור ושיח ומערות ומצריך להו לכולהו בגמרא‎ – And in פרק הפרה where the משנה teaches that one is liable whether he dug a בור, a שיח, or a מערה, and the גמרא there explains why it was necessary for the משנה to teach all three cases; why was it necessary to explain it there but not here – תוספות replies: התם ניחא דלא הוה ליה לתנא למינקטינהו אגב בור כיון דכתיב בור בקרא – There it is understood, for the תנא should not have mentioned שיח ומערה on account of בור, since only בור is written in the פסוק‎ – אלא הוה ליה למיתני בור לחודיה: The תנא should have rather taught only בור, therefore the גמרא found it necessary to make the צריכותא‎. SUMMARY We can derive חריצין ונעיצין from בור, but not אמת המים ונברכת הכובסין; it is usual to write שיח ומערה together with בור (even without a צריכותא); however when the פסוק writes בור exclusively, the משנה (when referencing this פסוק) needs a reason why to mention שיח ומערה‎. THINKING IT OVER When תוספות makes the צריכותא for אמת המים ונברכת הכובסין and בור he uses one סברא, the depth; and explains if it would say the shallower we would think the deeper needs more than three and if it would say the deeper we would think the shallower needs less than three, However when the גמרא makes the צריכותא between אמת המים and נברכת הכובסין the גמרא uses two סברות (קביעי, וקוו וקיימי), where seemingly it could have used one of them and make the צריכותא in the same manner of more than three or less than three. Why the difference?!

סלעים‎—Rocks OVERVIEW The משנה rules that one must distance סלעים from a neighbor’s wall three טפחים‎. Our תוספות clarifies what is the meaning of סלעים‎. ----------------------------- אבנים שאש יוצא מהן ולא סלעי נחושת דאין דרך להניחן אצל הכתלים‎ – סלעים means stones from which fire is extracted, but not copper סלעים (coins) for it is not usual to place coins neat the walls – תוספות comments on a related issue: והא דאמר בירושלמי אית תנא תני טומנין בסלעים ואית תני דאין טומנין‎ – And this which is stated in תלמוד ירושלמי; ‘there is a תנא who teaches, one may be טומן in סלעים, and there is another [תנא] who teaches, it is forbidden to be טומן in סלעים’. The ירושלמי reconciles these two rulings כאן בסלעים של כסף כאן בסלעים של נחושת – Here where הטמנה is permitted, it is silver coins, and here where it is prohibited it is by copper coins. This concludes the citing of the ירושלמי there; תוספות continues – הוה מצי לשנויי כאן בסלעים של אבנים כאן בשל כסף אלא ניחא ליה לשנויי כולהו במתכת: The ירושלמי could have answered here it is by stone סלעים (where it is אסור), and here it is by silver סלעים (where it is מותר); however it was preferable to answer the contradiction where by all of them we are discussing metal coins. SUMMARY סלעים in the משנה refers to rocks, not copper coins since they are not found near walls. When differentiating between different rulings we prefer to make the difference as narrow as possible. THINKING IT OVER 1. תוספות (in the beginning) excludes copper coins (because they are not placed near a wall). Why did not תוספות also exclude silver coins as well (for the same reason)? 2. Is it permitted to place copper coins near a neighbor’s wall? Is it permitted to be מטמין in stones?

וסד בסיד‎—And he plasters it with lime OVERVIEW Regarding the first set of damagers in our משנה (בור וכו') the משנה writes 'וסד בסיד'. Regarding the second set of distancing (גפת וכו') it seems that it is not clear whether the גירסא is וסד בסיד or או סד בסיד‎. Our תוספות offers his opinion. ---------------------------- נראה לרבינו יצחק דבסיפא נמי גרס וסד בסיד ולא גרס או‎ – It appears to the ר"י that in the סיפא, the משנה reads וסד בסיד and it does not read או סד בסיד; תוספות proves this – דאי גרסינן בסיפא או סד בסיד אם כן תפשוט דברישא וסד בסיד תנן‎ – For if in the סיפא the גירסא is או סד בסיד, we can therefore resolve the query that in the רישא the ruling is וסד בסיד‎ – מדלא קתני או סד ברישא כמו בסיפא‎ – Since in the רישא it does not state או סד like it states in the סיפא; rather it states וסד, so what is the query?! אלא ודאי בסיפא נמי גרס וסד‎ – Rather in the סיפא we are also גורס, 'וסד' (not או סד); therefore the גמרא queries whether it is וסד or או סד in the רישא‎ – תוספות anticipates a difficulty: והא דפשיטא ליה בגמרא (לקמן דף יט, א) דבסיפא הוי או סד בסיד – And the reason that it is obvious to the גמרא that in the סיפא the ruling is או סד בסיד‎ – תוספות responds: היינו משום דאין ההיזק כל כך מרובה שלא יועיל לו סיד לחודיה: This is because the damage in the סיפא is not the great, that סיד alone could not prevent it; however the damage in the רישא is greater; therefore we are not certain whether in the רישא we require one or both of the remedies. SUMMARY We are גורס וסד both in the רישא and סיפא‎. The damage in the רישא is greater than in the סיפא‎. THINKING IT OVER 1. According to the ר"י we are גורס both in the רישא and the סיפא, וסד בסיד‎. It turns out according to the query of the גמרא that it is possible that in the רישא the word וסד means ‘and’, and in the סיפא the word 'וסד' means ‘or’. It seems unusual that the same word in the same משנה means two different things! 2. תוספות references the query later in the גמרא‎. Is the גמרא asking what is the proper גירסא (in the רישא), or is the גמרא asking how do we understand the גירסא‎?

כליא‎— OVERVIEW The משנה states regarding the distancing of an oven from the wall that it is three טפחים from the כליא, which turns out to be four טפחים from the שפה‎. It is evident that the כליא protrudes out a טפח from the שפה‎. There is a dispute between רש"י and תוספות as to how to interpret כליא‎. ------------------------------- פירש רבינו חננאל בטן דתנור צר מלמטה ובאמצעיתו מרחיב ובולט ויוצא כשיעור טפח‎ – The ר"ח explained that כליא means the ‘stomach’, for the oven is narrow at the bottom and in the middle (of its height) it widens and protrudes the size of a טפח‎ – ומאמצעיתו מיצר ועולה: And from the middle it narrows as it rises to the top (or rim) of the oven. SUMMARY כליא is the middle of the oven which protrudes a טפח (like a stomach). THINKING IT OVER Is there any advantage in the פר"ח over פרש"י, or vice versa?
