    Chapter 1 - HaMevi Kamma

גם: גיטין דף ו׳ ע״ב, פרק א׳ המביא קמא

    English translation - Gittin 6b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1But if you do this then you provide benefit. The Gemara asks: What is the meaning of the expression: If you do this you provide benefit? This means that if the husband comes to contest the validity of the bill of divorce, we pay no attention to him and his claim.

2As it is taught in the Tosefta (1:3): An incident occurred involving a man who brought a bill of divorce before Rabbi Yishmael, and said to him: Am I required to say: It was written in my presence and it was signed in my presence, or am I not required to state that declaration? Rabbi Yishmael said to him: My son, where are you from? He said to Rabbi Yishmael: My teacher, I am from the village of Sisai. Rabbi Yishmael said to him: You are required to say: It was written in my presence and it was signed in my presence, so that you will not cause the woman to need to find witnesses if the husband contests its validity.

3After that man left, Rabbi Elai entered before Rabbi Yishmael and said to him: My teacher, but isn’t the village of Sisai located within the boundary of Eretz Yisrael, and it is even closer to Tzippori, which is within the main portion of Eretz Yisrael, more so than Akko. And we learned in the mishna that Rabbi Meir says: Akko is like Eretz Yisrael with regard to bills of divorce. And even the Rabbis disagree with Rabbi Meir only with regard to Akko, which is distant. However, with regard to the village of Sisai, which is close, no, they do not dispute the ruling of Rabbi Meir.

4Rabbi Yishmael said to Rabbi Elai: Be silent my son, be silent. Since the matter of her divorce was issued as permitted, it was issued, and her divorce is valid. This incident proves that the declaration: It was written in my presence and it was signed in my presence, is effective to the extent that the divorce is considered to have been performed in an entirely permitted manner, and the husband cannot contest its validity at a later stage.

5The Gemara asks: Why was it necessary for Rabbi Yishmael to explain the meaning of his ruling to Rabbi Elai? But after all, when he issued his ruling Rabbi Yishmael also stated his reason, as he said to the man: Do this so that you will not cause the woman to need to find witnesses. The Gemara answers: Those who were present did not conclude Rabbi Yishmael’s statement before Rabbi Elai. Rabbi Elai was unaware of Rabbi Yishmael’s reasoning, and therefore he questioned him.

6§ The Gemara relates that Rabbi Evyatar sent a letter from Eretz Yisrael to Babylonia to Rav Ḥisda in which he wrote the following: With regard to bills of divorce that come from there, Babylonia, to here, Eretz Yisrael, the agent is not required to say: It was written in my presence and it was signed in my presence. The Gemara asks: Shall we say that Rabbi Evyatar holds that the reason for the declaration: It was written in my presence and it was signed in my presence, is because they are not experts in writing a bill of divorce for her sake, and these residents of Babylonia are learned with regard to this issue?

7The Gemara challenges: And can you understand it in this way? After all, Rabba is of the opinion that the reason is also in accordance with the opinion of Rava, that the declaration serves to ratify the bill of divorce. Rather, everyone agrees that we require the declaration to ratify the document. But since there are many people who ascend to Eretz Yisrael and descend from there to Babylonia, witnesses are frequently available, and there is no reason to be concerned about the ratification of the bill of divorce.

8Rav Yosef said: Who will tell us that Rabbi Evyatar is a reliable authority? And furthermore, there is good reason to question his statement: He is the one who sent a letter to Rav Yehuda, and wrote: People who ascend from there, Babylonia, to here, Eretz Yisrael, fulfill by themselves the verse: “And they have given a boy for a prostitute, and sold a girl for wine, and have drunk” (Joel 4:3), i.e., these people abandon their families. And Rabbi Evyatar wrote him this verse without scoring, i.e., etching lines into, the parchment upon which he wrote the letter.

9And Rabbi Yitzḥak says with regard to the writing of a verse from the Torah: One may write two words without scoring the parchment, but one may not write three words without scoring the parchment. Instead, one scores the parchment before writing the verse, as one does when writing a Torah scroll. This ensures that the writing will be done on a straight line, thereby rendering it more beautiful. And it was taught in a baraita : One may write three, but one may not write four. Since Rabbi Evyatar wrote more than three words from a verse without scoring the parchment, his halakhic rulings are evidently unreliable.

10Abaye said to him: Is that to say that anyone who does not know this halakha of Rabbi Yitzḥak is not a great man? Granted, with regard to a matter that depends on reasoning, it is well, as it is possible to say that an individual who does not know a halakha that can be inferred by logical reasoning cannot be considered a reliable authority. However, this halakha is a tradition, and it is possible that Rabbi Evyatar simply did not hear this tradition.

11And furthermore, Rabbi Evyatar is the one that his Master, the Holy One, Blessed be He, agreed with in his interpretation of a verse, as it is written with regard to the episode involving the concubine in Gibeah: “And his concubine went away from him” (Judges 19:2). The Sages discussed what occurred that caused her husband to become so angry with her that she left him, and Rabbi Evyatar says: He found her responsible for a fly in the food that she prepared for him, while Rabbi Yonatan says: He found her responsible for a hair [ nima ].

12And Rabbi Evyatar found Elijah the prophet and said to him: What is the Holy One, Blessed be He, doing now? Elijah said to him: He is currently engaged in studying the episode of the concubine in Gibeah. Rabbi Evyatar asked him: And what is He saying about it? Elijah said to him that God is saying the following: Evyatar, My son, says this and Yonatan, My son, says that. It is seen here that God saw fit to cite the statement of Rabbi Evyatar.

13Rabbi Evyatar said to him: God forbid, is there uncertainty before Heaven? Doesn’t God know what happened? Why does He mention both opinions? Elijah said to him: Both these and those are the words of the living God, i.e., both incidents happened. The incident occurred in the following manner: He found a fly in his food and did not take umbrage, and later he found a hair and took umbrage.

14Rav Yehuda says a different explanation: The man found a fly in the dish that she cooked for him, and he found a hair in that place, i.e., in her genital area. When he found a fly it produced a reaction of disgust, and he did not grow angry with her, but the hair was a matter of danger, as he might be hurt by it, and therefore he became angry with her. There are those who say: This and that were found in a dish. The difference is that the fly was a result of circumstances beyond her control, as it fell into the dish on its own, but the hair was found in the dish due to her negligence.

15Rav Ḥisda says: A person should never impose excessive fear upon the members of his household, as the husband of the concubine of Gibeah imposed excessive fear upon her and this ultimately caused the downfall of many tens of thousands of Jews in the resulting war (see Judges 19–20).

16Rav Yehuda says that Rav says: Anyone who imposes excessive fear upon the members of his household will ultimately come to commit three sins: Engaging in forbidden sexual intercourse, as the wife will be so fearful of her husband that she will sometimes tell him that she has immersed in a ritual bath after her menstruation has ended when she has not done so; and he will also end up committing bloodshed, as she is likely to run away from him and expose herself to dangers; and desecration of Shabbat, as she will cook for him on Shabbat because she is scared that he will be angry with her for neglecting to do so beforehand.

17Rabba bar bar Ḥana said a halakha with regard to this statement that the Sages said: There are three matters a person must say in his home on Shabbat eve at nightfall. He should ask the members of his household: Have you tithed the produce that required tithing? Have you placed the eiruv for joining the courtyards? If you have already done so, light the lamp in honor of Shabbat. Rabba bar bar Ḥana said that one must

ואי עבדת אהני‎—And if you do, it will be effective O VERVIEW We learnt in our משנה that בפ"נ is not required in א"י; the same applies to בבל‎. The question is what would be the status of המביא גט בא"י or בבל and the שליח said בפ"נ‎? Is it the same as חו"ל and therefore the בעל can no longer be מערער, or since there was no תקנה to say בפ"נ in א"י, the בעל can be מערער even if the שליח said בפ"נ. Our תוספות offers an opinion. ------------------ משמע דבפני נכתב מועיל בארץ ישראל‎ – It seems that saying בפ"נ in א"י accomplishes that we will pay no attention to any challenge by the husband. תוספות asks: והא דאמר בסוף פרק ב' (לקמן דף כג, ב) בארץ דלאו אדיבורה סמכינן מהימנא‎ – And that which the גמרא says at the conclusion of the second פרק: ‘In the land of ישראל where we do not rely on her statement, she is trusted’ to be a שליח הגט‎. The phrase ‘we do not rely on her statement ’ seems to indicate that we do not accept what she is saying, in contrast to what the גמרא states here that 'ואי עבדת אהני'. תוספות explains: the phrase later in the גמרא; that 'לאו אדיבורה דידה סמכינן' – היינו משום דאיירי בלא אמר בפני נכתב כסתם מביאי גט בארץ ישראל‎ – Is valid because we are discussing a case where the woman did not say בפ"נ, she merely brought the גט in the usual manner that גיטין are brought inside א"י; where the שליח says nothing, as is the rule. Therefore the גמרא there states דלאו אדיבורה דידה סמכינן; we are not dependent on her statement, since she made no statement. אבל אי אמר סמכינן אדבוריה כדאמרינן הכא: However, if the שליח הגט did say בפ"נ (whether man or woman) we will rely on their statement as the גמרא states here; ואי עבדת אהני‎. S UMMARY A שליח who says בפ"נ in בבל or א"י is believed to the extent that we pay no attention to ערעור הבעל‎. T HINKING IT OVER Why does תוספות say 'משמע' (it seems)? Seemingly the גמרא states so clearly!

ויתנו (את) הילד בזונה‎ —And they gave away the child for a זונה Overview ר' אביתר taught that the people who come to study in א"י are practicing what the נביא decries as ויתנו הילד בזונה וגו'. Our תוספות explains what is meant by this comparison. ----------------- לפי שהן משתהין בארץ ישראל בניהם ובנותיהם משתעבדים בשביל מזונות‎ – Since the בני בבל, who would travel to א"י to learn תורה, would tarry in א"י, their sons and daughters would be ‘enslaved’ on account of food; they had to work in order to sustain themselves – והיינו בזונה בשביל מזונות‎ – And that it the meaning of the verse that the child was given away for a 'זונה'; that means on account of food. The word זונה has the same root as the word מזונות‎. תוספות offers an alternate explanation: ועוד מפרש כדאמר בירושלמי עובדא הוה בחד שמכר בתו ללמוד תורה והלך ולמד: And an additional explanation is as the תלמוד ירושלמי relates there was a story where one person sold his daughter (for a maid) in order to study תורה, and he left her and studied. Summary The בני בבל would cause their children to become enslaved for food since they left them. One even sold his daughter for a maid to enable him to study. T HINKING IT OVER What are the relative merits of the two explanations in תוספות‎?

אמר רבי יצחק שתים כותבין‎—Said ר' יצחק - two may be written O VERVIEW שירטוט is the process where the parchment is scored or etched in straight parallel lines for the entire width of the column to be written. [This enables that the lines be written straight and neat.] The תלמוד ירושלמי states that שירטוט is a requirement הלכה למשה מסיני when writing תורה scrolls. ר' יצחק adds that even when writing three words (four words according to the מתניתא) of a פסוק, there is a requirement of שירטוט‎. The גמרא in מגילה states: תפילין do not require שירטוט, however a מזוזה does require שירטוט‎. Our תוספות will discuss various aspects of שירטוט‎. ----------------- בעל הלכות גדולות פסק כרבי יצחק‎ – The בה"ג ruled like ר' יצחק; you may write (only) two words without שרטוט, but not three words – ואף על גב דפליג אמתניתא דיודע היה שאינה עיקר‎ – And even though ר' יצחק is disputing a ברייתא, which permits three words without שירטוט, nevertheless the בה"ג follows the ruling of the אמורא ר' יצחק against the תנא of the ברייתא, for ר' יצחק knew that this ברייתא was not correctly transmitted. ואומר רבינו תם וכן פירש רבינו יצחק בן אשר בשם רבינו אליהו‎ – And the ר"ת says and the ריב"א also expounded the same in the name of ר' אליהו, that this ruling requiring שירטוט, is valid only – דדוקא שמתכוין לכתוב הפסוק לדרשה כי הכא‎ – When he specifically intends to write the פסוק for the purpose of interpreting it, like here in this case when ר' אביתר quoted the פסוק to interpret it in a דרשה format; that it is referring to those תלמידים who come from בבל to א"י to study תורה‎ – אבל כשאדם שולח איגרת לחבירו מותר לכתוב לשון המקרא כדי לכתוב לשון צח‎ – However, when someone sends a personal letter to his friend it is permitted to (quote and) write a פסוק in order to write in an articulate syntax; this can be done even – בלי שרטוט‎ – without scoring the paper/parchment. תוספות now presents a contradiction to this assumption. מיהו בירושלמי פרק בתרא דמגילה משמע קצת דאסור‎ – However in the תלמוד ירושלמי in the last פרק of מסכת מגילה there is somewhat of an indication that it is forbidden to write (part of) a פסוק even in a personal letter without שרטוט‎ – דקאמר התם מהו לכתוב תרתין תלת מילין מן פסוקא‎ – For it says there in the תלמוד ירושלמי: ‘What is the ruling; is one permitted to write two or three words from a פסוק without שרטוט‎?’ ומייתי רב מונא שלח כתב לרבי אושעיא בר שימי‎ – And the ירושלמי relates the following: רב מונא sent a letter to ר' אושעיא בר שימי, stating (presumably in the salutation): ראשיתך מצער היה מאד ישגא אחריתך‎ – ‘Your beginning may have been paltry ; however your end will wax enormously great ’ – משמע שלא היה כותב אלא לשם איגרת שלומים ולא לדרשה‎ – It seems that he was [not] writing this phrase [ for any other purpose] only as a letter of personal greeting and he had no intent of writing this for a דרשה‎ – ואף על פי כן היה מקפיד שלא לכותבו כסדר‎ – And nevertheless he was scrupulous not to write the פסוק in its proper sequence. He changed the order of the פסוק, so as not to write a proper פסוק (of three words or more) without שרטוט‎. This would seem to contradict what the ר"ת and the ריב"א maintain. תוספות responds: ומיהו הרבה מביא שם שנראה שהיו כותבין לדרשה‎ – However the ירושלמי there relates about many others, who scrambled the פסוקים in their various letters where it appears they were writing it for the purpose of a דרשה – דקאמר מר עוקבא שלח כתב לריש גלותא דהוה קאי ודמיך בזמרא‎ – For the ירשלמי relates that מר עוקבא sent a letter to the exilarch who would arise and go to bed with song – פירוש כשהיה שוכב וקם היו מזמרין לפניו‎ – Meaning when he would lie down to sleep, and arise in the morning, they would sing for him. מר עוקבא disapproved of this conduct and sent him a letter reprimanding him, paraphrasing a פסוק: ישראל אל תשמח אל גיל בעמים וכן הרבה מביא שם‎ – ‘Do not rejoice O Israel do not be happy amongst the nations’. And the ירושלמי also relates there many other similar instances. תוספות poses a question ואם תאמר דאמר בהקומץ רבה (מנחות דף לב, ב) ובפרק ב' דמגילה (דף יח, ב) – And if you will say; that it states in פרק הקומץ רבה and in the second פרק of מסכת מגילה‎ – דתפילין אין צריכין שירטוט‎ – That the פרשיות of תפילין do not require שירטוט; but how can that be?! והלא אפילו שלש או ארבע תיבות צריכין שרטוט‎ – For do not even three or four words require שרטוט‎?! How can those גמרות state that תפילין do not require שרטוט‎. There seems to be a contradiction between those גמרות and ר' אביתר‎. תוספות answers: ואומר רבינו תם דתפילין לא בעי שרטוט על כל שיטה ושיטה‎ – And the ר"ת says; that when those גמרות said that תפילין do not require שרטוט it meant that תפילין do not require שרטוט on every single line of the פרשיות (as opposed to מזוזה) – אבל עושה שרטוט אחת למעלה וכותב תחתיו כמה שיטין‎ – However, he is required to make one line of שרטוט on the top of the page and he may write underneath this line of שרטוט many lines of the פרשיות של תפילין‎. ואומר רבינו תם דאין לשרטט תפילין על כל שיטה ושיטה‎ – And furthermore says the ר"ת that one should not be משרטט תפילין on each line; not only is it not required, but it should not be done! כדאמר עלה בירושלמי בפרק במה מדליקין כל הפטור מדבר ועושהו נקרא הדיוט‎ – As the ירושלמי states in פרק במה מדליקין concerning this type of issue; ‘ whoever is exempt from an obligation and nevertheless performs it, he is called a simpleton.’ This will apply by תפילין as well. Since the גמרא says that תפילין do not require שירטוט (on every line), therefore one who is משרטט on every line is a simpleton and not conducting himself in a praiseworthy manner. תוספות will offer proof for his contention that there should be no שירטוט for תפילין‎. וכן משמע בהקומץ רבה (שם דף לב, ב) דקאמר התם תפילין אין צריכין שרטוט‎ – And it is also indicated likewise in the previously quoted גמרא in מסכת מנחות פרק הקומץ רבה, that שירטוט should not be done for תפילין וס"ת for the גמרא there states, that there is no requirement of שרטוט for תפילין‎ – ופריך מהא דתניא ספר תורה שבלה ותפילין שבלו אין עושין מהן מזוזות‎ – And the גמרא challenges this statement from that which we learnt in a ברייתא; ‘a תורה scroll that decayed or תפילין that decayed, we are not permitted to utilize their remains for מזוזות – לפי שאין מורידין מקדושה חמורה לקדושה קלה‎ – Because we may not degrade an object which had a stricter level of holiness to an object which possesses a more lenient level of holiness’. The level of holiness possessed by a ספר תורה and תפילין is greater that that possessed by מזוזות‎. This concludes the ברייתא quoted in the גמרא in מנחות‎. The גמרא there continues to present its question: הא מורידין עושין והא מזוזה בעי שירטוט‎ – ‘If however, it would be permitted to degrade מקדושה חמורה לקדושה קלה it would be permitted to utilize the decayed ס"ת ותפילין for מזוזות; but מזוזה requires שירטוט; implying that we cannot use the ס"ת ותפילין for מזוזות since they do not have שירטוט and מזוזה requires שירטוט‎ – ומשני תנאי היא‎ – And the גמרא answers this question saying: that this law whether שירטוט is required by מזוזה or not is an argument between תנאים’. This concludes the entire quote from the גמרא‎. תוספות will now conclude his proof that one is not משרטט ס"ת ותפילין‎. ומדלא משני הכא במאי עסקינן במשורטטין משמע דאין רגילות לשרטט כלל‎ – And since the גמרא chose not to answer, that this case is discussing a special situation that the ס"ת ותפילין happened to be משורטטין, they were scored. That is why the reason they cannot be used for מזוזות is, not because of שרטוט but rather, because אין מורידין וכו'. The fact that the גמרא chose not to give this answer indicates that it is not customary at all to be משרטט‎ – לא ספר תורה ולא תפילין והיינו משום דנקרא הדיוט‎ – neither a ס"ת nor תפילין and that is because he who would do it is called a הדיוט‎. תוספות makes a proviso to his previous statement that שירטוט is not done for תפילין ומיהו אם אין הסופר יכול לכתוב יפה בלא שרטוט‎ – However, if the scribe cannot write nicely without שרטוט; e.g. the lines will not be straight, etc. צריך לשרטט על כל שיטה ושיטה משום זה אלי ואנוהו‎ – It is required that there be שרטוט for every line in order to fulfill the dictum based on the פסוק; ‘this is my G-d and I will adorn him’. We derive from this פסוק that it is an obligation to beautify the מצות‎. תוספות presents a problem with the conclusion that ס"ת does not require שירטוט: והא דאמר בפרק קמא דמגילה (דף טז, ב) דברי שלום ואמת‎ – And that which the גמרא says in the first פרק of מסכת מגילה concerning the פסוק in the מגילה ‘words of peace and truth ’, that this פסוק‎ – מלמד שצריכה שרטוט כאמיתה של תורה‎ – Teaches us that מגילת אסתר requires שרטוט like the ‘ truthfulness ’ of the תורה‎. The מגילה refers to itself as דברי וגו' אמת that it is comparable to the אמת of תורה‎. Just as the תורה requires שרטוט so too does the מגילה require שרטוט‎. This is in contradiction to what the ר"ת said previously that ס"ת (ותפילין) does not require שרטוט‎. תוספות answers: אומר רבינו תם דלאו היינו ספר תורה דהא לא בעי שרטוט אלא היינו מזוזה‎ – The ר"ת says that אמיתה של תורה does not refer to a ס"ת for a ס"ת does not require שרטוט as mentioned previously in this תוספות, rather אמיתה של תורה refers to a מזוזה, which does require שרטוט‎ – וקרי ליה אמיתה של תורה על שם שיש בו שם יחוד מלכות שמים‎ – And the גמרא refers to a מזוזה as אמיתה של תורה on account that in a מזוזה there is the unity of the heavenly kingdom. The מזוזה contains פרשת שמע which states: ה' אלהינו ה' אחד, this יחוד מלכות שמים is considered אמיתה של תורה. וכן פירש רבינו חננאל‎ – And the ר"ח also explains the phrase אמיתה של תורה in the same manner, תוספות will bring a support to this contention that אמיתה של תורה refers to מזוזה, not ס"ת. וכן נראה דאי בספר תורה כדפירש שם בקונטרס‎ – And this is the apparent interpretation, that it refers to מזוזה, not ס"ת, for if אמיתה של תורה would be referring to a ס"ת as רש"י explains it there in מס' מגילה פ"ק, there would be a difficulty – הא דפסלינן התם בפרק ב' דמגילה (דף יט, א) אדיפתרא ושלא בדיו דאתיא כתיבה כתיבה‎ – That which we invalidate in the second פרק of מסכת מגילה, if the מגילה was written on דיפתרא or it was written not with proper ink. In these two instances the מגילה is פסול‎. The גמרא derives this פסול through a גזירה שוה 'כתיבה כתיבה' – מדכתיב (ירמיה לו) ואני כותב על הספר בדיו‎ – Since it is written in נביא ירמיה: ‘ and I am writing on the ספר with ink; and in the מגילה it states ותכתוב אסתר, so we derive just as the כתיבה in ירמיה was על הספר בדיו, so too must the מגילה be written על הספר בדיו‎. This excludes דיפתרא and שלא בדיו‎. This concludes the quote from the גמרא in מגילה‎. תוספות continues with his challenge to רש"י. If אמיתה של תורה refers to the ס"ת why is it necessary to derive the דין that דיפתרא ושלא בדיו is פסול by מגילה using a גז"ש from ירמיה ואמאי לא ילפי מאמיתה של תורה‎ – Why do we not derive it from אמיתה של תורה of a ס"ת where we know that דיפתרא ושלא בדיו is פסול‎?! ואי במזוזה מיירי ניחא דאם כן הייתי מצריך דוכסוסטוס כמו במזוזה‎ – If however the term אמיתה של תורה refers to a מזוזה then it is understood why the גמרא chose to derive the פסול of דיפתרא ושלא בדיו using a גז"ש from ירמיה, as opposed to מזוזה; even though by מזוזה if it is written בדיפתרא ושלא בדיו, it is also פסול; for if this were so that we derive מגילה from מזוזה concerning the parchment on which it is to be written (thereby being פוסל דיפתרא) then I would also require that the מגילה be written on דוכסוסטוס just as a מזוזה requires דוכסוסטוס‎. We do not permit דוכסוסטוס for a מגילה; therefore we must derive the פסול of דיפתרא using the גז"ש from ירמיה‎. According to רש"י, however, that אמיתה של תורה is a ס"ת, we could derive the פסול of דיפתרא from ס"ת since ס"ת does not require דוכסוסטוס but rather קלף, just like a מגילה‎. Therefore the גז"ש is superfluous. תוספות presents an additional question: והא דאמר במסכת סופרים (פרק א, הלכה א') אינו רשאי לכתוב אלא אם כן סרגל‎ – And that which is said in מסכת סופרים concerning a ס"ת it is not permitted to write a ס"ת unless he scored the parchment – ויריעה שאינה מסורגלת פסולה‎ – And a ‘curtain’ (segment) of parchment which is not scored is unfit for writing a ס"ת. This is in direct contradiction to what the ר"ת taught that a ס"ת does not require שרטוט, and in fact שרטוט should not be done. תוספות responds; that in מסכת סופרים where he requires שרטוט‎ – היינו ד' שרטוטים מלמעלה ומלמטה ומצדדין‎ – That means only four שרטוטים; on top and on bottom and on both sides of the parchment; that is where שרטוט is required; not for every line. תוספות concludes: ודוחק: And this answer is difficult to accept. The simple reading of the text in מסכת סופרים would indicate that שרטוט is required on every line of the ס"ת. This contradicts the opinion of the ר"ת. S UMMARY The הלכה is that three words or more of תנ"ך require שירטוט on top (on bottom, and both sides?). שירטוט is not required for a personal letter unless it is written for a דרשה‎. Scrambled פסוקים that do not contain three words in the proper order are permitted without שרטוט even when written לדרשה‎. תפילין וס"ת do not require שירטוט on each line; only on top, on bottom and both sides of the column being written. It is forbidden (!) to have שירטוט on each line for תפילין וס"ת (one who does so is called a הדיוט); unless the סופר requires it for neatness. מזוזה requires שירטוט on each line (הלמ"מ‎?). ס"ת, תפילין ומגילה are written on גויל or קלף not דוכסוסטוס‎. מזוזה is written only on דוכסוסטוס‎. שירטוט is required for a מגילה since it says in מגילת אסתר, דברי שלום ואמת; it is required that it be כאמתה של תורה‎. According to רש"י this refers to a ס"ת; according to תוספות it refers to מזוזה‎. דיפתרא is פסול for a מגילה‎. We derive this with a גז"ש כתיבה כתיבה from ירמיה‎. [This גז"ש also teaches us that דוכסוסטוס is פסול for a מגילה despite the fact that מגילה is compared to מזוזה by דברי שלום ואמת‎.] From מס' סופרים it seems that ס"ת require שירטוט for each line. T HINKING IT OVER 1. Why should there be difference concerning שירטוט whether it is written for a דרשה or for צחות הלשון‎? 2. How do we explain that we do not make שירטוט by ס"ת ותפילן on every line, but we are to make a שירטוט on top etc.? 3. How can we reconcile this statement of כל הפטור מדבר ועושהו נקרא הדיוט with the expression והמחמיר תבוא עליו ברכה‎? 4. How did תוספות derive from the ברייתא concerning ס"ת ותפילין שבלו that we are not משרטט ס"ת ותפילין‎? Perhaps we are not משרטט only תפילין, however ס"ת we are משרטט‎. The גמרא was perhaps discussing only the תפילין aspect! 5. Concerning the question of using ס"ת ותפילין שבלו for מזוזה, why did not the גמרא say that the סופר was משרטט in order to write neatly?

זבוב מצא לה נימא מצא לה‎—He found a fly by her; he found a hair by her Overview There is a dispute (between ר' אביתר and ר' יונתן), what was the transgression of the פלגש which caused the ensuing furor. תוספות explains the source of the dispute and why they did not agree to the literal meaning of ותזנה עליו פלגשו‎. --------------------- מותזנה עליו דריש לשון זנות ולשון מזון – They interpreted ותזנה as an expression of זנות and as an expression of food. תוספות asks: ואם תאמר ומנלן דלא הוי זנות ממש‎ – And if you will say; and how do know that it was not actual זנות (instead of merely a נימא באותה מקום [and certainly not a זבוב בקערה]) – תוספות answers: ואמר רבינו חננאל מדרצה להחזירה כדמוכח קראי – And the ר"ח explained, since he wanted to take back this פלגש as is evident in the פסוקים, this proves that she was not מזנה‎ – דאפילו פילגשים לא היה דרכם להחזיר אחר זנותם‎ – For it was not customary to make back even פילגשים after they were מזנה‎ – כדכתיב בא אל פילגשי אביך וכתיב ותהיינה צרורות עד יום מותן אלמנות חיות: As it is written; ‘come to the פלגשים of your father, and it is written that these פלגשים were tied up as live widows until the day they died. S UMMARY ותזנה has the connotation of both (relating to) זנות and food. There was no real זנות because people would not take back פילגשים who were מזנה‎. T HINKING IT OVER Is תוספות question only on ר' יונתן or on ר' אביתר as well?

נימא מצא לה‎—He found a hair by her O VERVIEW ר' יונתן maintains that he found a נימא by the פלגש באותו מקום‎. Our תוספות explains how this does not contradict a גמרא in סנהדרין‎. -------------------------- תוספות asks: ואם תאמר והא אמר בסנהדרין בפרק כהן גדול (דף כא, א) – And if you will say; but the גמרא states in מסכת סנהדרין in פרק כ"ג, that – שאין להם לבנות ישראל שער לא בית השחי ולא בית הערוה – Jewish daughters have no hair neither under their arms nor by their ערוה; so how is it that he found a נימא באותה מקום‎?! תוספות answers: ויש לומר דבת יפת תואר היתה כדמשני התם גבי תמר: And one can say that this פילגש was the daughter of a יפת תואר, as the גמרא there answers regarding תמר‎. S UMMARY A בת יפת תואר can have hair as opposed to a regular בת ישראל‎. T HINKING IT OVER תוספות obviously knew (in the question) that there is hair by a בת יפת תואר; why did תוספות not assume immediately that the פלגש was a בת יפת תואר‎?!

שלש עבירות‎—Three transgressions O VERVIEW רב יהודה אמר רב stated (seemingly in connection with פילגש בגבעה) that one who causes excess fear in his house comes to transgress three עבירות‎. Our תוספות attempts to find these עבירות by פילגש בגבעה‎. ---------------------- בסדר עולם אמר דאותו יום דפילגש בגבעה שבת היה – In סדר עולם it is written that the day of פלגש בגעה was on a שבת‎. תוספות offers a different גירסא and explanation: ורבינו חננאל כתב ג' עבירות גילוי עריות ושפיכות דמים וחילול השם‎ – And the ר"ח writes that the three עבירות were גילוי עריות, שפיכות דמים and חילול השם (not חילול שבת) – וג' היו בפילגש בגבעה ולהכי לא חשיב אבר מן החי: And these there occurred by the פילגש בגבעה, and that is why רב יהודה אמר רב did not mention אבר מן החי (since it did not happen by פילגש בגבעה). S UMMARY The story of פילגש בגבעה occurred on שבת or we need to substitute חילול השם for חילול שבת‎. T HINKING IT OVER 1. Why does תוספות assume that the ג' עבירות have a connection to פילגש בגבעה‎?! 2. Why does not our גירסא include חילול השם as the גירסת הר"ח‎?

ערבתם‎—Did you make an עירוב O VERVIEW There are two types of עירוב that one may need to make before שבת; one is עירובי חצירות and the other is עירובי תחומין. There is a dispute between רש"י and תוספות, as to what is meant by ערבתם; is it עירובי חצירות (רש"י) or עירובי תחומין (תוס'). --------------------- פירוש בקונטרס עירובי חצירות‎ – רש"י explained that the request of 'ערבתם' is referring to עירובי חצירות‎. תוספות disagrees with רש"י: ואין נראה אלא כמו שפירש בקונטרס בבמה מדליקין (שבת דף לד, א) – And תוספות does not agree with this פירש"י, but rather he prefers פירש"י in פרק במה מדליקין‎ – דפריך התם הא גופא קשיא אמרת עם חשיכה ערבתם הא ספק חשיכה לא‎ – Where the גמרא there asks; ‘but this is an inherent contradiction! You say that one should say ערבתם as darkness is approaching, but once it is possibly night one should not say ערבתם, because at ספק חשיכה one is not permitted to make an עירוב‎ – והדר תני ספק חשיכה מערבין‎ – But then the משנה teaches that one may make an עירוב by ספק חשיכה‎! ומשני כאן בעירובי תחומין‎ – And the גמרא answers that here we are discussing עירובי תחומין and there we are discussing עירובי חצירות‎. This concludes the citation of the גמרא there. However the גמרא was not clear as to which עירוב is permitted ספק חשיכה and which not, so – פירש בקונטרס דרישא בעירובי תחומין דבספק חשיכה אין מערבין‎ – רש"י there explained that the רישא which states that ספק חשיכה no עירוב is made that is referring to עירובי תחומין (there it is permitted only עם חשיכה). וכן פירש רבינו חננאל והיינו משום דבעירובי תחומין מחמירין טפי שיש לה סמך מן הפסוק- And the ר"ח also interprets it as רש"י does there, and the reason for the difference between עירובי תחומין and עירובי חצירות regarding ספק חשיכה is because we are more strict by עירובי תחומין for it has support from a פסוק (as opposed to עירובי חצירות which is entirely מדרבנן without a סמך from a פסוק). תוספות proves that עירובי תחומין is more stringent that עירובי חצירות: וכן משמע בפרק מי שהוציאוהו (עירובין דף מו, ב) גבי הלכה כדברי המיקל בעירוב – And this is also indicated in פרק מי שהוציאוהו regarding that we follow the lenient view concerning עירוב‎ – רב פפא אמר אצטריך סלקא דעתך אמינא הני מילי בעירובי חצירות‎ – רב פפא explained we would have thought that when is this so (that הלכה כדברי המיקל בעירוב) only in regards to עירובי חצירות (where we can be lenient) – אבל בעירובי תחומין אימא לא: However regarding עירובי תחומין, I would have said that we cannot be lenient. This proves that we are more strict by עירובי תחומין that by עירובי חצירות‎. S UMMARY It is by עירובי תחומין when one must be careful to say ערבתם only עם חשיכה and not later (however עירובי חצירות may be done even by ספק חשיכה). T HINKING IT OVER When should one (remind and) ask his household whether they made עירובי חצירות‎?
