1The Gemara answers: In accordance with whose opinion is this baraita ? It is in accordance with the opinion of Rabbi Meir, who says: A person does not make a statement of consecration for naught. If one declared an item consecrated, even if he did not use the correct formulation, his statement is interpreted in a manner to render it meaningful. Therefore, although the master did not say that the slave is consecrated with regard to his monetary value, his statement is interpreted in this way. However, Rav holds in accordance with the dissenting opinion of the Rabbis. In their opinion the slave is not consecrated.

2The Gemara comments: This too stands to reason, as it teaches in the latter clause of the baraita : And so too, a freeman who consecrated himself works and is sustained from his labor, as he consecrated only his monetary value and he did not consecrate his body. Granted, if you say that this baraita is in accordance with the opinion of Rabbi Meir, then the entire baraita works out well. According to the opinion of Rabbi Meir, even when he consecrated himself, his statement is interpreted so that it is referring to a type of consecration that is meaningful.

3Rather, if you say that it is the opinion of the Rabbis, granted, the first clause of the baraita that deals with one who consecrates his slave is understood, as his slave exists primarily for monetary value. It is logical that when the owner consecrates him he intends to consecrate his monetary value. However, in the case of the latter clause of the baraita , which is referring to one who consecrates himself, does he exist for monetary value? Therefore, the baraita must be in accordance with the opinion of Rabbi Meir.

4The Gemara suggests: Let us say that this dispute with regard to one who consecrates his slave is parallel to a dispute between tanna’im . A baraita taught: With regard to one who consecrates his slave, if one then makes use of the slave, there is no misuse of property consecrated to the Temple. Rabban Shimon ben Gamliel says: One misuses property consecrated to the Temple if one makes use of his hair. What, is it not that they disagree about this issue, as one Sage, Rabban Shimon ben Gamliel, holds that the slave is consecrated, and therefore the halakhot of misuse of consecrated property apply, and one Sage, the first tanna , holds that the slave is not consecrated?

5The Gemara asks: And how can you understand that to be their dispute? If that were the case, then these expressions of: One misuses property consecrated to the Temple, and: There is no misuse of property consecrated to the Temple, are not the correct expressions. They should have used these expressions, of: Consecrated, and: Not consecrated, if that were actually the subject of their dispute.

6Rather, everyone agrees that the slave is consecrated, in opposition to the opinion of Rav. And here they disagree about this, as one Sage, the first tanna , holds that a slave is considered equivalent to land, as slaves are compared to land in several areas of halakha . Just as the misuse of consecrated property does not apply in the case of land, so too, it does not apply to slaves. And one Sage, Rabban Shimon ben Gamliel, holds that they are considered equivalent to movable property, and therefore the halakhot of misuse of consecrated property do apply to slaves.

7The Gemara challenges this explanation: If that is so, and they disagree with regard to whether a slave is equivalent to land or movable property, instead of disagreeing with regard to whether making use of the slave’s hair constitutes a misuse of consecrated property, let them disagree with regard to whether making use of the slave himself constitutes a misuse of consecrated property.

8Rather, it must be that everyone agrees that a slave is considered equivalent to land, and making use of the slave himself does not constitute a misuse of consecrated property. And here they disagree with regard to his hair that is ready to be cut, whether it is still considered a part of the slave. One Sage, Rabban Shimon ben Gamliel, holds that it is considered as if it were already cut and is no longer part of the slave. Since it is viewed as detached, it is subject to the halakhot of misuse of consecrated property, like all movable property. And one Sage, the first tanna , holds that it is not considered as if it were already cut. Until it is cut, the hair is part of the slave, and, like all land, is not subject to the halakhot of misuse of consecrated property.

9The Gemara suggests: Let us say that the opinions of these tanna’im are parallel to the opinions of those tanna’im , as we learned in a mishna ( Shevuot 42b) that Rabbi Meir says: There are certain things that are like land with regard to their form but are not treated like land from a halakhic perspective, but the Rabbis do not admit to him that this is so. How so? If one makes the claim: I gave you ten grapevines laden with fruit to guard, and the other one says: They are only five vines, then Rabbi Meir obligates the defendant to take an oath, for one who makes a partial admission to a claim concerning movable property is obligated to take an oath that he is stating the truth. And the Rabbis say: The halakhic status of anything that is attached to the ground is like the ground itself, and therefore one does not take an oath in this case, as one does not take an oath if one makes a partial admission to a claim concerning land.

10The Gemara continues the comparison: And with regard to this, Rabbi Yosei, son of Rabbi Ḥanina, says that the practical difference between them is not concerning all vines. It exists only in a case of grapes that are ready to be harvested, as Rabbi Meir holds that since they are ready to be harvested, they are considered like they are already harvested, and the defendant must take an oath, as he is denying a claim concerning movable property. And the Rabbis hold that they are not considered like they are already harvested, and they still have the status of land. This dispute seems to be identical to the dispute between Rabban Shimon ben Gamliel and the Rabbis.

11The Gemara rejects this suggestion: The dispute in the baraita with regard to a slave’s hair is not necessarily parallel to the dispute with regard to grapes. Even if you say the opinion of Rabbi Meir, that grapes that are about to be harvested are considered like they are already harvested, this does not dictate one’s opinion with regard to a slave’s hair that is ready to be cut. Rabbi Meir states his opinion only there, with regard to grapes, since the longer they remain on the vine after ripening the more they become withered and are ruined. Since they no longer benefit from their attachment to the ground, they are considered to be like movable property. However, here, with regard to hair, the longer it remains on the slave the more it improves, i.e., grows, and therefore it should not be considered as if it were already cut.

12In connection with Rav’s statement that one who renounces ownership of his slave emancipates the slave, the Gemara recounts: When Rabbi Ḥiyya bar Yosef ascended from Babylonia to Eretz Yisrael, he stated this halakha of Rav, that one who renounces ownership of his slave emancipates the slave, before Rabbi Yoḥanan. Rabbi Yoḥanan said to him in astonishment: Did Rav actually say so? This indicates that Rabbi Yoḥanan disagreed with the statement of Rav, which leads the Gemara to ask: But didn’t Rabbi Yoḥanan himself say so? But didn’t Ulla say that Rabbi Yoḥanan says: With regard to one who renounces ownership of his slave, the slave is emancipated but nevertheless requires a bill of manumission. Why then was Rabbi Yoḥanan so surprised by Rav’s statement?

13The Gemara answers: The Gemara answers that Rabbi Yoḥanan was not objecting to Rav’s opinion, but this is what he said to him: Did Rav actually say in accordance with my opinion? And alternatively, there are those who say that Rabbi Ḥiyya bar Yosef did not conclude Rav’s statement before Rabbi Yoḥanan by saying that nevertheless the slave requires a bill of manumission. Therefore, Rabbi Yoḥanan said to him: And didn’t Rav say that the slave requires a bill of manumission? And Rabbi Yoḥanan conforms to his standard line of reasoning, as Ulla says that Rabbi Yoḥanan says: With regard to one who renounces ownership of his slave, the slave is emancipated but nevertheless requires a bill of manumission.

14§ The Gemara discusses the matter itself: Ulla says that Rabbi Yoḥanan says: With regard to one who renounces ownership of his slave, the slave is emancipated but nevertheless requires a bill of manumission to be fully considered a freeman and to be able to marry a Jewish woman.

15Rabbi Abba raised an objection to Ulla from a baraita : If a convert died and Jews plundered his property, as his possessions became ownerless property with his death because he had no heirs, and among his possessions were slaves, then, whether the slaves were adults or minors, they acquire ownership of themselves and become freemen, as they can acquire themselves from the ownerless property. Abba Shaul says: Adult slaves acquire ownership of themselves and become freemen. However, with regard to minor slaves, anyone who takes possession of them acquires them.

16This appears difficult for Rabbi Yoḥanan, as one could ask: But who wrote a bill of manumission for those slaves who became free men? Their owner died without freeing them, and nevertheless they are emancipated. Therefore, the baraita demonstrates that when a slave becomes ownerless, he is emancipated entirely and does not require a bill of manumission to be considered a freeman.

17Ulla said in reply: This one of the Rabbis, Rabbi Abba, is like a person who has not studied halakha . He refused to address Rabbi Abba’s objection, as he did not think it was worthy of a response. The Gemara asks: And what is the reason that these slaves do not require a bill of manumission? Rav Naḥman said that Ulla holds as follows: A slave of a convert is comparable to his wife in this case. Just as his wife is freed by his death without a bill of divorce, and she is no longer considered married with regard to any halakhot , so too, his slaves are freed without a bill of manumission.

18The Gemara challenges this answer: If so, if a slave is comparable to a wife, then even the slave of a Jew that dies should be freed entirely as well, just as his wife is. Why should this halakha apply only to the slave of a convert? The Gemara answers: The verse states with regard to slaves: “And you may make them an inheritance for your children after you, to hold for a possession” (Leviticus 25:46). Therefore, slaves are not emancipated with the death of their owner, as the heirs have a right to the slaves. However, in the case of a convert who does not have heirs, the slaves are emancipated.

19The Gemara challenges: If so, then in a case of one who renounces ownership of his slave and dies, the slaves should not require a bill of manumission as well, as they are not part of the inheritance of the children. Why then did Ameimar say that with regard to one who renounces ownership of his slave and dies, there is no remedy for that slave and he cannot marry a Jewish woman, as there is no one to emancipate him? The Gemara states: This statement of Ameimar poses a difficulty to Rav Naḥman’s explanation of Ulla’s statement.

20Rabbi Ya’akov bar Idi says that Rabbi Yehoshua ben Levi says: The halakha is in accordance with the opinion of Abba Shaul with regard to a convert who died and left behind slaves. Rabbi Zeira said to Rabbi Ya’akov bar Idi:

הא מני רבי מאיר היא‎—This is according to רבי מאיר O VERVIEW The גמרא cites a ברייתא which contradicts רב (regarding המקדיש עבדו) and the גמרא responded that this ברייתא is according to ר"מ (who indeed disagrees with רב). ------------------------ הכא משמע דרב דלא כרבי מאיר – It seems from this גמרא that רב disagrees with ר"מ – תוספות anticipates the following difficulty: והא דאמר בפרק קמא דערכין (דף ה, א) האומר ערך כלי עלי נותן דמיו כרבי מאיר – And regarding that which רב ruled in the first פרק of מסכת ערכין, one who said, ‘I am obligating myself to give הקדש the ערך of this vessel’, he gives its value to הקדש, and the גמרא states that this ruling is according to ר"מ – וכן בפרק האומר שקלי עלי (שם כ, א) דתנן ערך ידי ורגלי עלי לא אמר כלום‎ – And similarly in פרק האומר שקלי עלי, where the משנה teaches, if one said ‘I am obligated to pay the ערך of my hand or foot’, nothing has been said – ואמר רב עלה נותן דמיה ומפרש לרבי מאיר‎ – And רב commented on this משנה, but he gives הקדש the value of ידי ורגלי, and the גמרא explained that sרב' ruling is according to ר"מ; we see in these two instances that רב rules like ר"מ (that א"א מוציא דבריו לבטלה) in contrast to our גמרא where רב disagrees with ר"מ – תוספות responds: אליבא דרבי מאיר קאמר וליה לא סבירא ליה‎ – רב taught us how the ruling would be according to ר"מ, but רב does not agree with it – תוספות responds to an additional anticipated difficulty: ואף על גב דבסוף פרק קמא דסנהדרין (דף טו, א) גבי הערכין המטלטלין – And even though that in the end of the first פרק of מסכת סנהדרין regarding ‘movable’ ערכין‎ – מפרש רב באומר ערך כלי עלי כרבי מאיר לא סבירא ליה הכי‎ – רב explained that ערכין המטלטלין means when a person says ערך כלי עלי, so even though רב explained the משנה according to ר"מ that א"א מוציא דבריו לבטלה (and he has to pay), nevertheless רב does not agree with this ruling – תוספות finds support for this explanation: וכי האי גוונא אשכחן בריש אלמנה נזונית (כתובות דף צו, א) – And we find something similar in the beginning of פרק אלמנה נזונית‎ – דבעי למימר שמואל דהניזונת תנן וכאנשי יהודה – Where the גמרא wanted to say, that according to שמואל the משנה reads הניזונת, like the אנשי יהודה‎ – אף על גב דבסוף נערה שנתפתתה (שם נד, א) אמר שמואל הלכה כאנשי גליל: Even though that in the end of פרק נערה שנתפתתה, there שמואל stated that the הלכה is like אנשי גליל (not like אנשי יהודה) and nevertheless he tried to interpret the משנה according to אנשי יהודה, similar to רב interpreting the משנה according to ר"מ. S UMMARY We find אמוראים citing rulings and interpreting משניות according to views which they do not share. T HINKING IT OVER תוספות (seemingly) presumes that רב disagrees with the view of ר"מ that א"א מוציא דבריו לבטלה‎. However it is possible that generally רב agrees that א"א מוציא דבריו לבטלה, however here by מקדיש עבדו he is not מוציא לבטלה, for למיהוי עם קדוש קאמר‎?!

עבדא כמקרקעי דמי‎—A slave is comparable to land O VERVIEW The גמרא cited a dispute in a ברייתא whether there is מעילה if one was מקדיש an עבד‎. The גמרא initially assumed that this depends whether עבדא כמרקעי דמי or not. תוספות explains why the rule of מעילה is dependent on עבדא כמקרקעי דמי‎. ------------------------- ולכך אין מועלים בו דאין מעילה במחובר‎ – And therefore, since עבדא כמקרקעי דמי, there is no מעילה if one derives benefit from an עבד of הקדש, for there is no חיוב מעילה for something which is attached to the ground. דבפרק הנהנה (מעילה יח, ב) ילפינן מעילה חטא חטא מתרומה – For in פרק הנהנה we derive laws of מעילה from laws of תרומה through the גזירה שוה of חטא חטא‎. תוספות responds to an anticipated difficulty: והא דאמרינן בפרק המוכר את הספינה (בבא בתרא עט, א) – And regarding that which the גמרא states in פרק המוכר את הספינה‎ – הקדיש בור מלא מים מועלין בו ובמה שבתוכו‎ – If one was מקדיש a cistern full of water, there is a חיוב מעילה for the cistern and what is inside it (namely the water) if one derived benefit from them, the explanation of מועלין בו is – לא כמו שפירש שם רבינו שמואל שהצניע חפציו בבור דהא אין מעילה במחובר‎ – Not like the רש ב"ם explained it there, that he placed his belongings in the בור (and for that there is a חיוב מעילה), this is incorrect because there is no מעילה in something attached to the ground (like the בור; which is the ground) – אלא כשעקר מן הבור חוליא ונהנה ממנה: But rather מועלין בו means if he dug out a shovel full of earth from the בור and derived benefit from the earth, then there is a חיוב מעילה, for after he dug it out it is no more מחובר לקרקע‎. S UMMARY There is no מעילה by קרקע (and similarly by עבדים שהוקשו לקרקעות) since there is no מעילה by מחובר‎. T HINKING IT OVER תוספות states that (even though if you derive benefit from the בור itself there is no מעילה since it is מחובר לקרקע, nevertheless) if you uprooted a חוליא from this בור, there is מעילה since now this חוליא (which was מחובר previously) is now תלוש‎. It should therefore follow that there should be מעילה in the work (מעשה ידיו) of this עבד, since the מעשה ידיו (which originate in the עבד who is קדוש) are תלוש‎. In fact the עבד himself should be אסור במעשה ידיו‎!

קטנים כל המחזיק בהן זכה בהן‎—Whoever possesses the minors acquires them O VERVIEW The גמרא cites the view of אבא שאול in a ברייתא that if a גר died (the adult slaves acquire themselves and are freed, however), regarding the minor slaves whoever possesses them acquires them as slaves (while the ת"ק maintains that the עבדים קטנים are also freed). תוספות discusses the view of אבא שאול‎. ----------------------------- דאין להן יד לזכות בעצמן‎ – For the קטנים do not have a ‘hand’ (the capability) to acquire themselves – וכן בפרק מי שמת (בבא בתרא קנו, ב) גבי פלוגתא דזכין לקטן ואין זכין לגדול – And similarly in פרק מי שמת regarding the dispute whether we acquire on behalf of a קטן (since he cannot acquire on his own) but we do not acquire on behalf of a גדול (since he can acquire on his own) – תוספות anticipates the following difficulty: ואף על גב דאית ליה זכיה במציאה כדאמרינן בהניזקין (לקמן נט, ב) – And even though a קטן has זכיה by a lost object as the משנה states in פרק הניזקין, it is evident that a קטן does have זכייה – תוספות responds: היינו מדרבנן מפני דרכי שלום והכא לא שייך ההוא טעמא – That זכייה by מציאה is only מדרבנן because of דרכי שלום, however here by a גר שמת that reason is not applicable. תוספות asks: ואם תאמר בפרק לולב וערבה (סוכה מו, ב) אמר לא ליקני איניש לולבא לינוקא ביום טוב ראשון‎ – And if you will say; ר' זירא taught in פרק לולב וערבה, a person should not grant his לולב to a child on the first day of סוכות (before the adult he is יוצא), the reason is – דינוקא מקני קני אקנויי לא מקני – Because a child can acquire, but he cannot grant to others – תופסות rejects a possible solution: וליכא למימר דהתם בפיקח כגון צרור וזרקו אגוז ונוטלו‎ – And we cannot say that the גמרא there in סוכה is discussing a bright child, that if he is given a pebble he throws it away, but if he is given a walnut he takes it, and the rule of ר' זירא was only by such a child, this is not so – דהא בפרק קמא דקדושין (דף כב, ב) בההוא עובדא דאמר ליה שלוף לי מסנאי‎ – Because in the first פרק of מסכת קדושין, in that story where מר זוטרא said to the slave, ‘ take off my shoe and bring it to my house ’ – משמע דהוה בו דעת וקאמר התם איכא דאמרי קטן הוה – It seems that the slave was mindful, and the גמרא says there, some say this עבד was a קטן – תוספות answers: ויש לומר דדעת אחרת מקנה אותן שאני: And one can say; it is different if there is another mind granting a gift to minors; in that case a קטן can be קונה‎. S UMMARY A קטן can acquire for himself only if someone else is granting him the item (and he is a בר דעת), otherwise there is no זכיה for a קטן except by מציאה because of דרכי שלום‎. T HINKING IT OVER 1. תוספות states that קטנים have no יד to acquire themselves, as a reason why according to אבא שאול the rule is כל המחזיק בהם זכה בהם‎. Should we infer that the רבנן who maintain that even the קטנים acquire themselves as בני חורין, argue and maintain that קטנים do have a יד לזכות‎? 2. תוספות distinguishes between מציאה where a קטן can acquire it מדרבנן because of דרכי שלום, and גר, where there is no זכיה לקטן because the idea of דרכי שלום is inapplicable. This indicates that if it were applicable the גר קטן would acquire himself as a בן חורין; however since מדאורייתא he is an עבד, how can we be מתיר an איסור דאורייתא (of עבד) because if דרכי שלום‎?!

וכי מי כתב גט שחרור לאלו‎—But did then someone write a writ of emancipation for these O VERVIEW עולא states in the name of ר' יוחנן that if someone emancipates his slave, the slave requires a גט שחרור in order to marry a בת חורין‎. ר' אבא challenged this ruling from a ברייתא which states that if a גר dies his (adult) slaves become בני חורין‎. The question on עולא is that they did not receive a גט שחרור, so how can they be בני חורין‎? ----------------------- אלמא לא בעי גט להתירו בבת חורין‎ – It is evident from this ברייתא that a גט שחרור is not required in order to permit the עבד to marry a בת חורין, contrary to the ruling of עולא‎ – והיינו כשמואל דאמר מי שאין לו רשות רבו עליו אינו קרוי עבד – And the explanation why indeed they do not require a גט שחרור is because of the ruling of שמואל who maintains that whoever is not under the jurisdiction of his master is not considered an עבד‎ – וטעמא דאבא שאול בקטנים דחשיב רשות רבן עליהן כיון שאין להן יד בעצמן: And the reasoning of אב שאול regarding קטנים (that they remain עבדים) even though we are following the view of שמואל is because he considers that these קטנים are still under the jurisdiction of their master since that have no יד to acquire themselves. S UMMARY According to שמואל it is necessary to maintain according to אבא שאול that regarding the עבדים קטנים it is considered as if רשות רבן עליהן even after מיתת הגר‎. T HINKING IT OVER Could we interpret the dispute between the ת"ק and אבא שאול is based on the dispute whether המפקיר עבדו צריך גט שחרור or not?

אלמה אמר אמימר כולי‎—Why did אמימר say, etc - O VERVIEW The גמרא explained that according to עולא אמר ר"י who maintains that המפקיר עבדו יצא לחירות וצריך גט שחרור, nevertheless the עבדים of a גר who died without יורשים are freed, since עבדו כאשתו and the עבדים are freed with the death of the master. Nonetheless if the master has יורשים the ownership of the slaves is transferred to the יורשים‎. The גמרא asked if this is indeed true (אי הכי) how can we understand אמימר who ruled that המפקיר עבדו ומת וכו' אין לו תקנה, but since there are no יורשים regarding this slave (for he freed the slave), why אין לו תקנה, he should be freed. תוספות explains that the difficulty with אמימר is not necessarily only according to עולא אמר ר"י. ------------------ תוספות asks: ואם תאמר מאי אי הכי כל שכן דלשמואל תקשי דאמימר – And if you will say; what is the אי הכי, for if we follow the ruling of שמואל, there will certainly be a difficulty with the ruling of אמימר‎?! תוספות answers: ויש לומר דהא לא קשיא ליה משום דשמואל תנאי היא‎ – And one can say; that this contradiction with שמואל was not difficult to reconcile with אמימר, since the ruling of שמואל is a dispute between תנאים, as we find – בפרק החולץ (יבמות מח, א) ובפרק בתרא דנזיר (דף סב, ב) – In פרק החולץ and in the last פרק of מסכת נזיר, therefore אמימר has no need to agree with שמואל since he can maintain like the תנא who disagrees with שמואל‎ – אבל הא קשיא ליה אי אתיא דאמימר דלא כרבי יוחנן רביה – However the גמרא was troubled if it turns out that אמימר disagrees with his master, ר"י – תוספות (based on the above) resolves another difficulty: ולהכי נמי לא מצי למיפרך לאמימר מדרבנן דאבא שאול‎ – And therefore the גמרא could not have also asked on אמימר [directly] from the רבנן (and) [of] אבא שאול who maintain that the עבדים of the גר are freed without a גט שחרור‎ – דאיהו מוקי להו כההוא תנא דאית ליה דשמואל – For אמימר would establish their argument (of אבא שאול ורבנן) according to that תנא who agrees with שמואל (that הפקיר עבדו יצא לחירות וא"צ גט שחרור) – אבל איהו סבר כההוא תנא דפליג עלייהו וסבר דלדידיה צריך גט שחרור ואין לו תקנה: However אמימר maintains like the תנא who argues with them, so אמימר maintains that according to this other תנא (who disagrees with שמואל) the עבד requires a גט שחרור and therefore since the owner died the עבד has no recourse. S UMMARY The question on אמימר is how can he disagree with ר"י his רבי‎. However it is obvious that he can disagree with שמואל since שמואל is כתנאי‎. T HINKING IT OVER 1. תוספות explains that there is no direct question on אמימר from the ברייתא of the רבנן ואבא שאול regarding a גר because אמימר can interpret that ברייתא according to שמואל‎. However if that is the case, then there is no question on אמימר at all, for אמימר need not explain the ברייתא in the manner of ר"נ (that עבדו כאשתו וכו'), but rather simply state that the entire ברייתא is according to שמואל‎! 2. How do we understand the phrase, ' א"ה המפקיר עבדו ומת נמי'?

הלכה כאבא שאול‎—The ruling is like אבא שאול O VERVIEW ריב"א said in the name of ריב"ל that the הלכה is like אבא שאול regarding a גר שמת that the עבדים גדולים are freed, however regarding the עבדים קטנים anyone can acquire them. תוספות accepts this ruling even though it is against ר' יוחנן‎. -------------------------- אומר רבינו תם דהלכה כרבי יהושע בן לוי לגבי רבי יוחנן – The ר"ת says the הלכה is like ריב"ל against ר"י and the הלכה is like אבא שאול‎ – כדמוכח בפרק בתרא דמגילה (דף כז, א) דאמר כוותיה דרב פפי מסתברא‎ – As is evident in the last פרק of מסכת מגילה where the גמרא states it is reasonable to rule like רב פפי‎ – דאמר רבי יהושע בן לוי בית הכנסת מותר לעשותו בית המדרש‎ – Since ריב"ל states it is permissible to make a ביהכנ"ס into a ביהמ"ד – ואף על גב דרבי יוחנן פליג עליה התם דייק מדרבי יהושע בן לוי דהלכה כרב פפי: And even though ר"י disagrees with ריב"ל, nevertheless the גמרא infers from ריב"ל, who maintains that one can make a ביהמ"ד from a ביהכנ"ס that the ruling is like רב פפי‎. S UMMARY We follow ריב"ל against ר"י. T HINKING IT OVER Is it possible to refute תוספות proof from מס' מגילה‎?
