    Gittin 48a

    Chapter 4 - HaSholeach

    English translation - Gittin 48a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1in the time when the Jubilee Year is practiced, and every sale of land is only for its produce, because the land returns to its original owners in the Jubilee Year, Rabbi Yoḥanan says: The purchaser brings the first fruits and recites the verses. Reish Lakish says: The purchaser brings the first fruits but he does not recite the verses.

2The Gemara explains: Rabbi Yoḥanan says that the purchaser brings the first fruits and recites the verses, because he holds that the acquisition of an item for its produce is considered to be like the acquisition of the item itself. Consequently, the one bringing the fruits can truthfully recite: “The land which You, Lord, have given me” (Deuteronomy 26:10). Reish Lakish says that the purchaser brings the first fruits but he does not recite the verses, because he holds that the acquisition of an item for its produce is not considered to be like the acquisition of the item itself.

3The Gemara comments: And it is necessary to state the dispute between Rabbi Yoḥanan and Reish Lakish in both cases. Because if it was stated only in that case, with regard to one who acquires a field for its produce, one might say that it is only in that case that Reish Lakish says that he does not recite the verses, since already when he descended to the field, i.e., took possession of the land, he descended with the intention of acquiring only the produce, as stipulated at the time of the sale; but in this case, with regard to one who purchases the field when the Jubilee Year is practiced, when he descended to the field with the intention of acquiring the land itself, say that he concedes to Rabbi Yoḥanan that he recites the verses. Therefore, it is necessary to state explicitly that Reish Lakish holds that he does not recite the verses in this case as well.

4And if it was stated only in this case, with regard to one who purchases the field when the Jubilee Year is practiced, one might say that it is only in this case that Rabbi Yoḥanan says that it is like the acquisition of the item itself and recites the verses, as he purchased the field to fully own it; but in that case, where the sale was only with regard to the produce, say that he concedes to Reish Lakish that he does not recite the verses. Therefore, it is necessary to state the dispute in both cases.

5The Gemara offers a proof in support of Rabbi Yoḥanan’s opinion: Come and hear a proof from the mishna ( Bikkurim 1:11): One who acquires a tree and its surrounding land brings the first fruits of those trees and recites the verses, even though he is required to return the land in the Jubilee Year. The Gemara responds: With what are we dealing here according to the opinion of Reish Lakish? The mishna is referring to one who acquires a tree and its surrounding land in the time when the Jubilee Year is not practiced, so the acquisition is permanent.

6The Gemara suggests another proof in support of Rabbi Yoḥanan’s opinion: Come and hear a proof from the mishna ( Bikkurim 1:6): One who acquires two trees in another’s field brings the first fruits of those trees but does not recite the verses, as he acquires only the trees but not the land. But if one acquires three trees, he brings the first fruits of those trees and recites the verses, because he also acquires the land surrounding the trees, despite the fact that the land is returned in the Jubilee Year. The Gemara rejects this: Here too, Reish Lakish would explain that the mishna is referring to one who acquires three trees in the time when the Jubilee Year is not practiced.

7The Gemara comments: And now that Rav Ḥisda said: The dispute between Rabbi Yoḥanan and Reish Lakish is with regard to land sold during the second Jubilee, after the Jewish people already practiced the Jubilee Year once and people could trust that the land would be returned in the Jubilee Year, but with regard to land sold during the first Jubilee, which was practiced by the Jews immediately following their entry into Eretz Yisrael, everyone agrees that he brings the first fruits and recites the verses, as they did not yet rely on the fact that the fields would be returned, there is no need to claim that according to Reish Lakish these mishnayot are referring to when the Jubilee Year was not practiced. Instead, one could answer that it is not difficult: This, the mishnayot that state that he brings the first fruits and recites the verses, are referring to land sold during the first Jubilee. That, where Reish Lakish rules that he brings the first fruits but does not recite the verses, is referring to land sold during the second Jubilee.

8The Gemara suggests: Let us say that the dispute between Rabbi Yoḥanan and Reish Lakish is parallel to a dispute between tanna’im . The halakha is that if one consecrated but did not redeem his ancestral field, and the Temple treasury sold it to another Jew, it becomes the property of the priesthood in the Jubilee Year. However, if one purchases a field from another Jew and consecrates it, it reverts back to the original owner in the Jubilee Year. The baraita taught: From where is it derived that one who purchases a field from his father in the time when the Jubilee Year was practiced and consecrated it, and afterward his father died, from where is it derived that it should be considered before him like an ancestral field, and it does not revert to the son’s ownership in the Jubilee Year?

9The baraita continues: The verse states: “And if he sanctify to the Lord a field which he has bought, which is not of the field of his ancestral field” (Leviticus 27:22). The addition of the phrase: “Which is not of the field of his ancestral field,” teaches that the halakha that the field reverts to the original owner applies specifically to a field that is not fit to be an ancestral field, meaning that he would not inherit it in the future. This field, which the son was entitled to inherit after he had consecrated it, is excluded, as it is fit to be an ancestral field, although the son had purchased it. This is the statement of Rabbi Yehuda and Rabbi Shimon.

10The baraita continues: Rabbi Meir says: From where is it derived that one who purchases a field from his father at the time when the Jubilee Year was practiced and his father died, and afterward he consecrated it, from where is it derived that it should be considered before him like an ancestral field, and does not revert to the son in the Jubilee Year? The verse states: “And if he sanctify to the Lord a field which he has bought, which is not of the field of his ancestral field.” The addition of the phrase: “Which is not of the field of his ancestral field,” teaches that the halakha that the field reverts to the original owner applies specifically to a field that is not an ancestral field, meaning that he did not inherit it. This field, which the son inherited before he consecrated it, is excluded, as it is an ancestral field, while according to the opinion of Rabbi Yehuda and Rabbi Shimon, a verse is not required to teach that in a case where his father died, and he consecrated it afterward, it is considered an ancestral field, as this is obvious. The Gemara explains why the other tanna’im do not require a verse to teach the halakha in the case discussed by Rabbi Meir:

11The Gemara clarifies: What, is it not that they disagree about this, as Rabbi Meir holds: The acquisition of an item for its produce is considered to be like the acquisition of the item itself, and in this case, when he purchased the field, i.e., the rights to the produce, from his father before his death, it is the case that he inherits nothing when his father dies, as he had already taken ownership of the field when he purchased it from his father, and nothing changed with his father’s death; and therefore, if his father died and he consecrated it afterward, then a verse is necessary to teach that it is treated like an ancestral field, as one might have thought that the field is his entirely as a result of the purchase, and not because of an ancestral inheritance.

12While Rabbi Yehuda and Rabbi Shimon hold that the acquisition of an item for its produce is not considered to be like the acquisition of the item itself, and in this case, when he had purchased the field from his father before his father died, with the death of his father he now inherits the field as well, since until now he owned only the rights to the produce; and therefore if his father died and he consecrated the field afterward, a verse is not necessary to teach that it is an ancestral field, as it is obvious that he now owns it due to his inheritance. And when a verse was necessary, it is for a case where he consecrated the field and his father died afterward that it was necessary.

13The Gemara rejects this explanation of the dispute. Rav Naḥman bar Yitzḥak said: Actually, I could say to you that in general Rabbi Yehuda and Rabbi Shimon hold that the acquisition of an item for its produce is considered to be like the acquisition of the item itself, and they agree that the verse is necessary to teach the halakha concerning a case where he consecrated the field after his father’s death. And here, Rabbi Yehuda and Rabbi Shimon found another element of the verse and they expounded it. They maintain that if the verse is teaching the halakha only in the case where he consecrated the field after his father’s death, then let the Merciful One write in the Torah: And if he sanctify to the Lord a field which he has bought, which is not his ancestral field. What is the meaning of the expression: “Of his ancestral field” (Leviticus 27:22)? This emphasizes: A field that is not fit to be an ancestral field, meaning that he would not inherit it in the future. This field, which the son was entitled to inherit after he had consecrated it, is excluded, as it is fit to be an ancestral field, although the son had purchased it.

14Rav Yosef said: If not for the fact that Rabbi Yoḥanan said that the acquisition of an item for its produce is considered to be like the acquisition of the item itself, he would not find his hands or his feet in the study hall, i.e., there would be a contradiction between Rabbi Yoḥanan’s statements. As Rav Asi says that Rabbi Yoḥanan says: Brothers who divided property received as an inheritance are considered to be purchasers from one another, and as purchasers of land they must return the portions to each other in the Jubilee Year, at which point they may redistribute the property.

15And if it enters your mind to say that the legal status of the acquisition of an item for its produce is not like that of the acquisition of the item itself, then according to Rabbi Yoḥanan’s opinion you will find that one brings first fruits by Torah law only when he is an only child the son of an only child, and so forth, dating back to the time of Joshua, son of Nun. Only in such a case does the child fully inherit the land. In any other case, the children inherit only the rights to the produce, as they must return the actual land to each other in the Jubilee Year, and would not be able to recite the verses connected with the first fruits, since they could not refer to the land that the Lord has given them. Since Rabbi Yoḥanan holds that the acquisition of an item for its produce is considered to be like the acquisition of the item itself, anyone who inherits land may recite the verses.

    Tosafot

מביא ואינו קורא‎—He brings, but does not read Overview ריב"ח taught that we require לקיחה והבאה כאחד, and if it is not כאחד the rule is מביא ואינו קורא‎. Our תוספות has some difficulty with this ruling. ----------------------------------- תוספות asks: ואם תאמר ונימא ירקבו כדאמרינן בפרק בתרא דמכות (דף יח, ב) – And if you will say; but let us say that the ביכורים should rot, as ר' אלעזר אמר ר' אושעיא says in the last פרק of מסכת מכות‎ – הפריש בכורים קודם החג ועבר עליהן החג ירקבו משום דנראו לקריאה ונדחו‎ – ‘He separated ביכורים before the holiday of סוכות, and the holiday passed, they should rot’, since initially these ביכורים were fit for ‘reading’ and were pushed away. The גמרא there continues – וכל שאין ראוי לבילה בילה מעכבת בו והכא נמי כשבצרן נראו לקריאה וכששיגרן נדחו – For anything which is not fit for mixing, the lack of mixing prevents it from being acceptable’, so, תוספות asks, here too when he harvested them they were fit for קריאה and when he sent them with the שליח they were pushed aside – תוספות answers: ויש לומר דאמר בירושלמי דמסכת בכורים (פרק א' הלכה ה') – And one can say; that it says in תלמוד ירושלמי on מסכת בכורים‎ – רבי אסי אמר ריש לקיש בשם רבי אושעיא כשליקטן לשלחן ביד אחר‎ – ר"א said that ר"ל said in the name of ר"א; when he gathered the produce for ביכורים with the intent to send them with someone else, only then can he send them with a שליח (an it will be מביא ואינו קורא) – אבל אם לקטן להביאן הוא לא ישלחם ביד אחר – However if he gathered them with the intent that he will bring them to ירושלים, he should not send them with someone else – שכל הבכורים שנראו לקריאה אין ניתרין אלא בקריאה‎ – For all ביכורים which were fir for קריאה cannot be ‘permitted’ (to be eaten by the כהן) only with קריאה‎ – ואמרינן התם מתניתין פליגא הפריש בכורים ומכר שדהו מביא ואינו קורא – And the ירושלמי asks there; it seems that our משנה argues with ר"א, for the משנה states; ‘ he separated ביכורים and sold his field he brings but does not read’ – קיימנוה כשנתן דעתו למכור משעה ראשונה – The ירושלמי answers; we have established that משנה that he intended to sell his field from the first hour (before he harvested), therefore it was never נראה‎ – ולפי זה אם הפריש בכורים קודם החג על מנת להביאן אחר החג לא ירקבו‎ – So according to this (regarding the rule of ר"א) if he separated ביכורים before סוכות with the intention to bring them after סוכות (so it was never נראה), they are not left to rot – אלא אחר החג מביא ואינו קורא: Rather after סוכות he is מביא ואינו קורא‎. S UMMARY ביכורים which were fit to be מביא וקורא and then they were not fit to be קורא they are left to rot; however if they were never fit to be קורא (either because he planned to send them with a שליח, or he intended to bring them after סוכות) the rule is מביא ואינו קורא‎. T HINKING IT OVER תוספות writes )from the ירושלמי) that if at time of the לקיטה he intends to send it with a שליח the rule is מביא ואינו קורא, since it was never נראה‎. However previously תוספות said that if the שליח brought it, the בעלים can be מביא וקורא (and it is considered לקיחה והבאה כאחד), since שלוחו של אדם כמותו‎. Why therefore does the ירושלמי state that he is מביא וקורא, seemingly it was נראה ונדחה‎?!

לא דכולי עלמא קנין פירות כקנין הגוף דמי‎—No; for all agree acquisition of the fruit is like acquisition of the body O VERVIEW The גמרא cited a ברייתא in which there was a מחלוקת between ר' יהודה ור' שמען and ר' מאיר‎. The גמרא initially assumed that they argue whether קנין פירות כקנין הגוף דמי (the view of ר"מ), or לאו כקנין הגוף דמי (the view of ר"י ור"ש). רב נחמן בר יצחק rejected this assumption saying that it is possible that all agree (even ר"י [ור"ש]) that קנין פירות כקנין הגוף דמי‎. Our תוספות qualifies this approach of רנב"י. -------------------------------- דיחויא בעלמא הוא‎ – This is merely an attempted rejection of the contention of the גמרא that whether קנין פירות is כקנין הגוף דמי or not, is a מחלוקת תנאים‎ – דרבי יהודה אית ליה בהחובל (בבא קמא דף צ, א) גבי דין יום או יומים דלאו כקנין הגוף דמי : For ר"י maintains in פרק החובל, regarding the rule of ‘a day or two days’ that קנין פירות is not like קנין הגוף‎. S UMMARY ר"י maintains קנין פירות לאו כקנין הגוף דמי‎. T HINKING IT OVER When the גמרא here wanted to say לימא כתנאי, why did it not cite the מחלוקת between ר"מ ור"י regarding יום או יומים where the גמרא there states clearly that ר"מ maintains כקנין הגוף דמי, and ר"י maintains לאו כקנין הגוף דמי‎?!

אי לאו דאמר רבי יוחנן קנין פירות כולי‎—Were it not that Rabi Yochonon said; acquisition of the fruits, etc. O VERVIEW רבי יוחנן maintains that brothers who divided up their estate are considered as if they are buyers who bought out their brothers for their share. The גמרא said that if ר' יוחנן would not maintain קנין פירות כקנין הגוף דמי we could not find anyone who could bring ביכורים unless he was a חד בר חד עד יהושע‎. Our תוספות reconciles these two הלכות (of האחין שחלקו לקוחות הן and קנין פירות לאו כקנין הגוף דמי) according to how we rule. ---------------------------------- תוספות asks: הקשה רבינו תם ואנו איך מצאנו ידינו ורגלינו‎ – The ר"ת asked but how can ‘we find our hands and feet’ to reconcile these two rulings – דקיימא לן כריש לקיש דלאו כקנין הגוף דמי כדאמרינן בריש החולץ (יבמות דף לו, ב) – For we have established the הלכה is like ר"ל that קנין פירות is not like קנין הגוף, as the גמרא states in the beginning of פרק החולץ‎ – וקיימא לן נמי דבדאורייתא אין ברירה – And we have also established that regarding דאורייתא issues the rule is אין ברירה‎. תוספות offers various proofs that we maintain אין ברירה בדאורייתא – דבסוף מסכת ביצה (דף לח, א) פסקינן כרבי אושעיא‎ – For in the end of מסכת ביצה we rule like ר"א that בדאורייתא אין ברירה‎ – ורב נחמן דקיימא לן (כתובות יג, א) כוותיה בדיני קאמר בריש פרק ב' דקדושין (דף מב, ב) – And regarding ר"נ, whose rulings we follow in monetary issues, states in the beginning of the second פרק of מסכת קדושין‎ – האחים שחלקו הרי הן כלקוחות פחות משתות נקנה מקח‎ – The brothers who divided an estate are considered like לקוחות in this regard [as well] that if the assessment was off less than a sixth, the sale is accomplished – ופסקינן נמי בהמוכר את הבית (בבא בתרא דף סה, א) דאין להן דרך זה על זה – And in פרק המוכר את הבית we also rule that brothers who divided the estate have no claim of right of way, one on the other; the reason is – דמוכר בעין רעה מוכר אלמא לקוחות הן – For one who sells, does so with a ‘(bad) [good] eye’; it is evident that אחים שחלקו are לקוחות‎. תוספות addresses various challenges to his assertion that we maintain לקוחות הן: והא דפסקינן בפרק בית כור (שם דף קז, א) כרב דאמר בטלה מחלוקת – And regarding this which we rule in פרק בית כור like רב who maintains the division is nullified – תוספות replies: לאו משום דיורשין הוו אלא משום דהוו כלקוחות באחריות‎ – The reason of רב why בטלה מחלוקת is not because they are יורשין, but rather because they are considered as buying with a guarantee – ויורשין דקאמר רב לאו יורשין ממש אלא כלומר כיורשין – And this which רב says that they are יורשין, it does not mean actual יורשין, but rather it means like יורשין‎ – וברוב ספרים גרסינן הכי בפרק קמא דבבא קמא (דף ט, א) – And in most text in the first פרק of ב"ק it reads this way; כיורשין (but not יורשין). תוספות addresses a related contradiction: ומיהו רב אסי דאמר יחלוקו ומספקא ליה אי יורשין הוו היינו יורשין ממש‎ – However רב אסי who maintains that they divide the loss, for he is unsure whether they are כלקוחות or whether they are יורשין, there it means actual יורשין (not כלקוחות באחריות) – כדמוכח בפרק יש בכור (בכורות דף מח, א) גבי חמש ולא חצי חמש‎ – As is evident in פרק יש בכור regarding, ‘five but not five halves’. On the other hand – ורבי אסי אמר רבי יוחנן האחין שחלקו לקוחות הן לאו היינו רב אסי – ר"א אמר ר"י maintains האחין שחלקו לקוחות הן, which would seem to contradict this which רב אסי said מספקא ליה אי יורשין הוו‎. We must answer that רבי אסי is not the same as רב אסי‎ – אי נמי הא דידיה הא דרביה‎ – Or you may also say; one is his ruling (מספקא ליה אי יורשין הוו), and the other (לקוחות הן) is his teacher’s view (ר"א אמר ר' יוחנן), so there is no contradiction. תוספות discusses an additional contradiction: והא דפסקינן בנדרים בפרק השותפין (דף מו, ב) כרבי אליעזר בן יעקב‎ – And regarding this that we rule like ראב"י in מסכת נדרים in פרק השותפין‎ – בשותפין שנדרו הנאה זה מזה דמותר ליכנס לחצר – In connection to the case of partners who vowed not to derive benefit from each other, the view of ראב"י is that they may enter into a courtyard which belongs to both of them – תוספות responds; the הלכה indeed is like ראב"י; however – לאו מטעמיה דטעמיה משום ברירה כדמוכח בפרק הפרה (בבא קמא דף נא, ב) – It is not because of his reason, for his reason for permitting them to enter into the חצר is on account of יש ברירה as is evident in פרק הפרה; that however is not the reason we rule like ראב"י – אלא משום דויתור הוא כרבינא בחזקת הבתים (בבא בתרא דף נז, ב) ומותר במודר הנאה‎ – However the reason we rule like ראב"י that they may enter the חצר השותפין is because of ויתור as רבינא states in פרק ח"ה, and ויתור is permissible even by a מודר הנאה‎. In summation; תוספות has proven the we maintains האחין שחלקו לקוחות הן, and קנין פירות לאו כקנין הגוף דמי, so how can we reconcile this with the bringing of ביכורים‎. תוספות answers: ויש לומר דדוקא בההיא לחודה בהכותב לבנו מהיום ולאחר מיתה קיימא לן כריש לקיש – And one can say; that it is specifically in that case alone, where he wrote over his assets to his son מהיום ולאחר מיתה, that we rule like ר"ל – דלאו כקנין הגוף דמי משום דאבא לגבי ברא אחולי מחיל‎ – That קנין פירות is not like קנין הגוף, because a father in regards to his son gives up his rights that he has in the גוף on account of his פירות‎ – תוספות proves that this is a valid reason why here there is this exception: דהכי מצריך להו בפרק יש נוחלין (שם דף קלו, ב) לתרי מילי דריש לקיש דהכא ודהתם – For this is how the גמרא in פרק יש נוחלין explains the necessity for ר"ל stating his two rules here and there – אבל בעלמא קיימא לן דכקנין הגוף דמי – But generally we establish the rule that קנין פירות כקנין הגוף דמי‎ – תוספות responds to an anticipated difficulty: ואף על גב דקאמר הכא רבא קרא ומתניתא מסייעי ליה לריש לקיש לרבא לא סבירא ליה הכי‎ – And even though that רבא states here that the פסוק and the ברייתא support ר"ל (that by קנין פירות the rule is מביא ואינו קורא, since it is לאו כקנין הגוף דמי), nevertheless רבא does not agree to ר"ל that לאו כקנין כגוף דמי‎ – דאם לא כן לא מצא ידיו ורגליו דרבא סבר לקוחות הן בפרק ב' דקדושין (דף מב, ב) – For if you will not say so (but rather that he agrees with ר"ל that לאו כקנין הגוף דמי), רבא will not find ידיו ורגליו, since רבא maintains in the second פרק of מסכת קדושין that האחין שחלקו לקוחות הן‎ – תוספות will prove that even though רבא states קרא ומתניתא מסייע ליה לר"ל, nevertheless רבא does not necessarily agree with ר"ל: ובפרק הזהב (בבא מציעא דף מח, א) קאמר רבא נמי גבי משיכה מפורשת מן התורה‎ – And in פרק הזהב, where רבא also states regarding the view of ר"ל that קנין משיכה is explicit in the תורה‎ – קרא ומתניתא מסייעי ליה לריש לקיש‎ – The פסוק and the ברייתא support ר"ל that משיכה is קונה מה"ת – אף על גב דרבא קאי כרבי יוחנן בר מתלת (יבמות דף לו, א) – Even though that רבא always agrees with ר"י except for three cases where we rule like ר"ל, we see that even though he say קרא ומתניתא מסייע ליה לר"ל, nevertheless he disagrees with ר"ל and maintains מעות קונה מה"ת like ר"י. We can say the same regarding קנין פירות‎. This is תוספות first answer that we maintain לקוחות הן; however we also maintain קנין פירות כקנין הגוף דמי therefore the יורשין may be מביא וקורא‎. תוספות now offers an alternate solution: ועוד יש לומר דדוקא רבי יוחנן אית ליה דמחזירין זה לזה ביובל‎ – An additionally one can say; it is specifically only ר"י who maintains that the brothers must return the properties to each other on יובל and redivide them since לאו כקנין הגוף דמי‎ – אבל שאר אמוראים סברי אף על גב דלקוחות הן אין מחזירין‎ – However the rest of the אמוראים maintain that even though לקוחות הן (since מה"ת אין ברירה), nevertheless אין מחזירין זל"ז ביובל‎ – דמכר הוא דאמר רחמנא דליהדר ירושה ומתנה לא והשתא אתי שפיר – For only by a sale did the תורה state that it must be returned, but not by ירושה ומתנה so therefore it works out – תוספות asks: ואם תאמר לרבי יוחנן דמחזירין זה לזה ביובל תו לא משכחת שדה אחוזה – And if you will say; according to ר"י that the heirs return the properties to each other on יובל, you will never find a case of a שדה אחוזה‎ – דכולהו הוו שדה מקנה ולא תתחלק לכהנים – For all fields are considered as a שדה מקנה and it will not be divided amongst the כהנים‎ – וגם יפדוה בשוויה ולא בית זרע חומר שעורים בחמשים שקל כסף – And also it will be redeemed from הקדש for its worth, but not according to the assessment of בית זרע חומר שעורים for fifty silver שקלים‎ – תוספות answers: ויש לומר כיון דתחת זו תחזור לו אחרת לא קרינן בה שדה מקנה אלא שדה אחוזה: And one can say; since that instead of this field which he received from his father’s estate, another field from his father’s estate will be returned to him; it is not considered a שדה מקנה, but rather a שדה אחוזה‎! S UMMARY Generally קנין פירות כקנין הגוף except where the father (who has קנין פירות) is מוחל to the son (who has קנין הגוף). Alternately, although we maintain T HINKING IT OVER Why according to ר' יוחנן that since קנין פירות כקנין הגוף one may bring ביכורים, even though לקוחות הן, so we should apply it to שדה אחוזה as well that since כקנין הגוף דמי it is considered a שדה אחוזה‎?! הדרן עלך השולח We shall return to you
