    Chapter 2 - HaMevi Batra

גם: גיטין דף ט״ו ע״ב, פרק ב׳ המביא בתרא

    English translation - Gittin 15b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1he, i.e., the agent, and another person testify with regard to the signature of the second witness, the bill of divorce is invalid. What is the reason for this? Perhaps people will come to confuse it with the typical case of ratification of legal documents, and will rely on one witness who testifies about his own signature and that of the other signatory, while another witness joins with him to testify with regard to the other signature. And as a result of this, the full sum of money, minus a quarter, will be extracted based upon the testimony of one witness. In order to ratify legal documents in general, two witnesses must testify as to the validity of each of the signatures. If the Sages were to allow one witness to testify about his own signature and another witness to join him in testifying about the other signature in the case of a bill of divorce, it may lead to the same method being employed with regard to other legal documents.

2Rav Ashi objects to this: Is there any situation in which if he himself would complete his entire statement by saying: It was written in my presence and it was signed in my presence, the document would be valid, and now that there is another one who testifies with him, the bill of divorce is invalid?

3Rather, Rav Ashi says that even if the agent says: I am the second witness who signed the bill of divorce, it is invalid. What is the reason for this? A bill of divorce cannot be validated by a combination of two types of credibility. It must be authenticated either entirely through the ratification of the bill of divorce, in the manner that other documents are ratified, or it must be entirely ratified via the rabbinic decree, in which case the testimony of the agent is considered equivalent to that of two people who ratify the signatures.

4The Gemara cites a proof for this claim: We learned in the mishna that if an agent for a bill of divorce said: All of it was written in my presence and half of it was signed in my presence, this bill of divorce is invalid. The Gemara clarifies: What are the circumstances with regard to the other half of the bill of divorce? If we say that there is no one who testifies about it at all, this is problematic: Now the mishna taught that if one agent says: It was written in my presence, and one agent says: It was signed in my presence, in which case this agent testifies with regard to all the writing and that agent testifies with regard to all the signing, it is invalid. When the agent testifies that only half of it was signed in his presence, is it necessary to say that the document is invalid?

5Rather, the mishna must be teaching that the bill of divorce is invalid even if there is additional testimony with regard to the second signature. This novelty can be explained either in accordance with the opinion of Rava, who holds that the agent joins with another person to testify about the second signature, or in accordance with the opinion of Rav Ashi, who holds that he testifies about his own signature.

6The Gemara adds: And this is to exclude the opinion of Rav Ḥisda, who declares that the document is invalid even when there is a full ratification of the second signature. Because the mishna merely alludes to the novelty in this clause, without specifying it, one may infer only the lesser novelty. Since Rav Ḥisda’s novelty is greater than that of the other two Sages, had the mishna been taught for that purpose, it should have issued an explicit statement to that effect.

7The Gemara rejects this suggestion: Rav Ḥisda could have said to you: And according to your reasoning, why do I need the ruling of the mishna which states that if the agent said: It was written in my presence but it was not signed in my presence, the bill of divorce is invalid? The mishna could simply have stated: If he said: All of it was written in my presence and half of it was signed in my presence, it is invalid. One would have inferred that it is invalid all the more so if one does not testify with regard to the signature at all. Rather, one must say that the tanna teaches the mishna employing the style: Not only this but also that, i.e., each ensuing statement adds something novel.

8If so, here too the tanna teaches the mishna employing the style: Not only this but also that. In other words, Rav Ḥisda would answer that the above inference, i.e., that the clause dealing with: It was written in my presence but it was not signed in my presence, must be teaching an additional novelty, is incorrect. This is because it is a stylistic feature of the Mishna to teach a less novel case followed by a more novel one, regardless of the fact that had it taught the more novel case first, there would have been no need to mention the less novel case at all. Therefore, there is no need to infer a special, unstated novelty from this clause at all, which means it cannot be cited as proof against Rav Ḥisda’s greater novelty.

9§ Tangentially, the Gemara cites a discussion that involves a similar underlying principle. Rav Ḥisda says, with regard to Shabbat domains: An embankment, i.e., a height disparity between two surfaces, of five handbreadths and an additional partition of five handbreadths, do not join together to form a partition of ten handbreadths, which is the minimum height for a partition to enclose a private domain. A halakhic partition is regarded as being composed of ten handbreadths only if it is composed entirely of a partition, e.g., a fence, or entirely of the embankment, e.g., a pit or incline.

10Mareimar taught: An embankment of five handbreadths and a partition of five handbreadths do join together to form a partition of ten handbreadths. The Gemara comments: And the halakha is that they join together. Rav Ḥisda’s opinion is analogous to the aforementioned case that a bill of divorce must be either entirely upheld by the agent or entirely upheld by the ratification of its signatures, although the halakha is ruled differently in the case of Shabbat domains.

11The Gemara cites another case that is based on the same principle. Ilfa raised a dilemma: With regard to ritual washing, can one’s hands be ritually pure in halves, or can they not be ritually pure in halves? The Gemara asks: What are the circumstances of this case? If we say that two people wash with the requisite one quarter- log of water, and therefore in actuality each one of them washes with only half of a quarter- log , but didn’t we learn explicitly in a mishna ( Yadayim 1:1): With the amount of a quarter- log one can wash the hands of one person and even of two? A quarter- log of water suffices for one person to wash his hands before eating bread, and even two may wash their hands simultaneously with this amount, if they do so in the correct manner.

12But rather, Ilfa is referring to a case where one washed his two hands one by one, not both hands at the same time. The Gemara asks: But didn’t we learn in a mishna ( Yadayim 2:1): With regard to one who purifies one hand by washing with a vessel and one hand by immersing it in a river, his hands are ritually pure? This mishna indicates that there is no need for both hands to be washed simultaneously.

13But rather, Ilfa’s dilemma refers to a case where he washes his hand in two halves, i.e., he first washes one half of his hand and next washes the second half of that same hand. The Gemara asks: But didn’t the Sages from the school of Rabbi Yannai say: Hands cannot be rendered ritually pure in halves? If so, one who washes half of his hand and pauses before washing the second half has not performed the act of washing the hands at all. The Gemara answers: No, Ilfa’s question is necessary only for a case where there is liquid that is still moist on his hand. When one washes the second half of his hand, some moisture remains on the portion of his hand that he already washed, and therefore one might think that this liquid joins with the water with which he washes the second half of his hand.

14The Gemara asks: And when there is liquid that rendered one’s hand moist, what of it? Is this a relevant factor? But didn’t we learn in a mishna ( Teharot 8:9):

מי איכא מידי דאילו מסיק לכוליה דיבורא כשר‎—Is there such a thing that if he would conclude the entire statement it would be כשר O VERVIEW רבא ruled that if the שליח said בפנ"כ ובפנ"ח חציו, and regarding the second עד, the שליח and another testify that they recognize his signature, nevertheless the גט is פסול‎. The reason רבא gave is that אתי לאיחלופי בקיום שטרות דעלמא, etc. רב אשי asked, can there be such a thing that if the שליח would be מסיק לכוליה דיבורא it would be כשר, and now that there is someone else with him (who concurs) it should be פסול‎! There is a dispute between רש"י and תוספות how to explain the challenge of רב אשי that מי איכא מידי וכו'. מה שפירש בקונטרס דלרבא חד כי אמר ידעתי כשר – Regarding this which רש"י explains that according to רבא if one שליח said, ‘I recognize the signature(s) of the עד(ים)’, it is כשר‎ – תימה מה עלה על דעתו של רבא לפסול כשמסייעו אחר‎ – It is astounding; what entered sרבא' mind to invalidate this גט when another person is assisting the שליח and confirming the חתימה of the עד שני‎ – כיון דלא חייש לאיחלופי כי ליכא אחר בהדיה כשר לפי שמעיד גם על הכתיבה‎ – Since רבא is not concerned for איחלופי when there is no other person testifying together with him (and the גט is כשר), since the שליח is also testifying on the כתיבה, therefore when he says בפנ"כ ובפנ"ח חציו and ידעתי on the other עד it is כשר – וכל שכן כי איכא אחר בהדיה‎ – So certainly when there is another person testifying with him on חתימת עד שני that it should be כשר (for there is certainly no חשש of איחלופי). תוספות offers his view: לכך נראה כדפירשתי לעיל דידעתי בחד לא מהני אף על גב דמעיד על הכתיבה‎ – Therefore the view of תוספות is as I explained previously that if one שליח\עד says, ‘I recognize the signature(s) it is not effective even though he is testifying בפני נכתב, nevertheless ידעתי לא מהני‎ – והשתא אתי שפיר דבעי רבא לפסול‎ – And now it is properly understood why רבא wanted to invalidate the גט in the case בהוא ואחר מעידין שמכירין חתימת השני משום איחלופי – where the שליח and another person testify that they recognize the second signature, it is פסול because of confusing it with שאר שטרות‎ – כמו שפסול כי ליכא חד בהדיה – (Just as) [since] the גט would be פסול, when there is no one assisting the שליח by saying we recognize the signature. תוספות continues explaining the גמרא‎ – ורב אשי פריך מי איכא מידי דאילו מסיק איהו לכוליה דיבורא ואומר גם בפני נחתם כשר‎ – And רב אשי asked; ‘is there such a thing that if he would have concluded the entire statement (as he began) by saying also בפני נחתם כולו, it would be כשר‎ – וכי איכא אחר בהדיה ומעידין שמכירין החתימה נמי אין לפוסלו‎ – And because there is another person with him and they both testify that the recognize the signature of the second עד, we can also not disqualify the גט‎ – דלא גרע אותו עדות משאם היה אומר בעצמו בפני נחתם: For that testimony where two people say ידענו is not any less than if the שליח himself would say בפני נחתם‎. Two עדים who recognize the signature are no less than one שליח who says בפני נחתם; they are both כשר‎. S UMMARY רב אשי challenges רבא (according to רש"י), if one שליח is believed to say ידעתי, how can two who say ידעתי make the גט פסול‎. However according to תוספות the question is that if בפנ"נ כולו is כשר, then two עדים are certainly כשר‎. T HINKING IT OVER 1. According to תוספות that ידעת לא מהני, why was it necessary for רבא to say that it is פסול because of אתי לאיחלופי בקיום שטרות, when in this case of גט, three quarters of the testimony is being delivered by one עד (the שליח, who testified בפנ"ח חציו for one עד הגט and ידעתי with another person for (half of) the second עד הגט)?! 2. How can רב אשי argue that if בפנ"ח is כשר then הוא ואחר should also be כשר (since there are two עדים), but רבא argues that by הוא ואחר there is the חשש of איחלופי by שאר שטרות (and נפיק נכי רבעא דממונא), which does not exist by בפנ"ח כולו‎?! 3. How do we interpret 'מסיק איהו לכולא דיבורא', according to רש"י‎? תוספות‎?

אני הוא עד שני פסול‎—I am the second witness; it is disqualified O VERVIEW רב אשי ruled if the שליח said בפנ"כ כולו ובפנ"ח חציו and I am the second עד, the גט is פסול‎. The reason is because the גט is either authenticated through קיום, or it is authenticated through the תק"ח (of saying בפ"נ ובפ"נ). Previously רב אשי maintained that by בפנ"ח חציו and the שליח and another person recognized the עד שני it is כשר, because (as רב אשי said) מי איכא מידי דאילו וכו' כשר השתא וכו' פסול‎. This means that if the other חתימה is properly authenticated (and not by בפנ"ח) it is כשר‎. Our תוספות explains how this case of רב אשי is different from the case of רבא‎. ----------------------- תוספות asks: ואם תאמר ומי איכא מידי דאילו אמר בפני נחתם כשר ומשום דאמר אני הוא עד שני פסול‎ – And if you will say; and is there such a thing that if the שליח would say בפנ"ח כולו, it would be כשר, and because he said, ‘I am the second עד’, it is פסול‎?! תוספות answers: ונראה לרבינו יצחק כמו שאומר בירושלמי דכי אמר אני הוא עד שני נעשה כנוגע בעדותו‎ – And it is the view of the ר"י that the reason for the ruling of רב אשי is as it states in תלמוד ירושלמי, that when the שליח states, ‘I am the second witness’ he has a vested interest in his testimony (which makes him an עד פסול); his interest is – דנראה דלכך בא להעיד על חתימת השני כדי שתתקיים עדות חתימתו – For it seems that he is specially coming to testify on the signature of the second עד (the one for whom he is saying בפנ"ח חציו), in order that his testimony on his signature (אני הוא עד שני) should be upheld. תוספות asks: ואם תאמר וכיון דטעמא משום הכי הוא למה ליה למימר משום או כולו בקיום הגט כולי‎ – And if you will say; and since the reason the שליח is not believed to say אני הוא עד שני, is because of this concern that he is נוגע בעדותו, why was it necessary for רב אשי to state that the reason it is פסול is because או כולו בקיום הגט, etc.?! תוספות answers: ויש לומר משום דלאו טעמא גמור הוא זה אי לאו טעמא דאו כולו בקיום הגט‎ – And one can say; because נוגע בעדות alone is not a sufficient reason to make the גט פסול, if not for the additional reason of או כולו בקיום הגט, because – דאין זה נוגע בעדות ממש: This is not exactly a case where he is actually נוגע בעדות‎. S UMMARY The גט is פסול if the שליח says בפנ"ח חציו ואני הוא עד שני, because he is partially נוגע בעדות and (therefore we say) או כולו בקיום הגט וכו'. T HINKING IT OVER 1. תוספות concludes that the שליח is not a נוגע בעדות ממש and therefore that is not the reason why it is פסול, similarly the reason of או כולו בקיום הגט וכו', is not sufficient either, as תוספות asked in his initial question; so why indeed is the גט פסול‎?! 2. תוספות explains that (part of) the פסול here is because the שליח is נוגע בעדות‎. However there (seemingly) is not פסול נוגע by שליח הגט, for we find that the wife is believed to bring her גט and say בפ"נ ובפ"נ, so why is there an issue of נוגע בעדות‎?!

גידוד חמשה ומחיצה חמשה כולי‎—An embankment of five טפחים and a partition of five, etc. O VERVIEW רב חסדא taught that גידוד חמשה ומחיצה חמשה do not combine. רש"י explains גידוד to mean a ditch. תוספות maintains that a ditch and a partition (above the ditch) are מצטרף‎. Our תוספות offers an explanation according to sרש"י' understanding of גידוד, and also offers an alternate explanation of גידוד‎. --------------------- פירש בקונטרס אם היה חריץ עמוק חמשה והקיפוהו מחיצה חמשה‎ – רש"י explained (that גידוד חמשה ומחיצה חמשה means) if there was a ditch which was five טפחים deep and it was surrounded on top with a partition five טפחים high, the rule is that the גידוד and the מחיצה‎ – אין מצטרפין להיות תוכו רשות היחיד‎ – Do not combine to make the enclosure a רה"י (even though the bottom of the ditch is surrounded by an enclosure which is ten טפחים high [five of the ditch and five of the מחיצה]). תוספות asks: וקשה לרבינו תם דאמר בשבת בפרק הזורק (דף צט, א) ובפרק בתרא דעירובין (דף צט, ב) – And the ר"ת has a difficulty with פירש"י for the גמרא states in מסכת שבת in פרק הזורק and in the last פרק of מסכת עירובין‎ – דבור וחולייתו מצטרפין לעשרה ואף על פי שזה בגובה וזה בעומק‎ – That a pit and its surrounding mound combine to make the inside of the pit a רה"י if the combined height of the בור וחולייתו is ten טפחים, and even though the חולייה is in the height and the pit is in the depth, nevertheless it is מצטרף‎. The same should be here that the גידוד and the מחיצה should be מצטרף‎. תוספות has an additional question: ועוד דאמר פרק כל גגות (שם דף צג, ב) בהדיא גבי שתי חצרות זו למעלה מזו‎ – And furthermore the גמרא explicitly states in פרק כל גגות, regarding two courtyards one higher than the other – ויש גידוד חמשה ומחיצה חמשה – Where there is an embankment of five טפחים and a partition of five טפחים‎ – דמודה רב חסדא בתחתונה הואיל ורואה פני עשרה דמערבת שנים ולא אחד – That ר"ח agrees regarding the lower חצר, since it ‘sees’ a ‘face’ of a wall which is ten טפחים high that it requires two (separate) עירובי חצירות but not one עירוב חצירות together with the upper חצר‎. תוספות answers: ויש לומר דלענין ב' חצרות זו למעלה מזו איירי הכא – And one can say that ר"ח is discussing here regarding two חצרות which are זו למעלה מזו, and when he says אין מצטרפין he is referring – ולגבי עליונה לענין עירוב כדמוכח פרק כל גגות (שם צג, ב) – To the upper חצר regarding an עירוב as is evident in פרק כל גגות‎. תוספות offers an alternate solution: אי נמי לענין תל ברשות הרבים גבוה חמשה והקיף על גביו מחיצה חמשה‎ – Or you may also say; ר"ח is discussing (not a ditch and a partition, but rather) a mound in the רה"ר which is high five טפחים and he surrounded it on top with a מחיצה of five טפחים, and ר"ח teaches us – דלא חשיב רשות היחיד לענין שבת – That this enclosed area is not considered a רה"י concerning שבת‎. תוספות asks on this interpretation of גידוד: ואם תאמר ויחשב רשות היחיד מטעם דאי בעי מנח עליה ומשתמש‎ – And if you will say; and let it be considered a רה"י for the reason that if he so desires he may place something on top of the מחיצות and he will utilize this area on top of the מחיצות‎ – כדאמר בפרק חלון (שם עח, א) גבי מילאו כולו ביתדות – As the גמרא states in פרק חלון regarding the case where he filled up the entire area with pegs. תוספות answers: ויש לומר דמיירי ברחב הרבה דלא שייך מנח עליה מידי אלא בדבר צר: And one can say; that here we are discussing a case where the area atop the partitions is very wide (therefore we cannot use the concept of דאי בעי מנח עליה ומשתמש), for the concept of placing something atop the partitions is applicable only for a narrow area, but not for a wide area. S UMMARY A ditch and a partition are מצטרף (except regarding the upper חצר, which is not considered separate from the lower חצר). A mound and a partition are not מצטרף (unless it is a small area and a cover can be placed over the width of the partition. T HINKING IT OVER 1. תוספות asks that a mound five טפחים and a partition of five טפחים should be מצטרף since he can place something atop the מחיצה (as we find by the beam). However in the case of יתדות the רה"י is formed atop the beam (and the cover); here however we wish to make the top of the תל (which is below the potential cover) into a רה"י. How can we compare the two?! 2. Why indeed does ר"ח maintain that גידוד ה' ומחיצה ה' are not מצטרף (according to תוספות)?

הנוטל ידו אחת בנטילה ואחת בשטיפה כולי‎—One who washes one hand by pouring and one by immersion, etc. O VERVIEW The גמרא initially assumed that the query of אילפא was regarding washing each hand separately (for נטילת ידים). The גמרא argued that this can be resolved from the משנה which states אחת בנטילה ואחת בשטיפה the hands are טהור‎. ----------------------- פירש בקונטרס נטל ידו אחת מן הכלי כתיקון חכמים ואחת בשטיפה בנהר במ' סאה‎ – רש"י explained that אחת בנטילה ואחת בשטיפה means he washed one hand by pouring over it from a vessel as the חכמים enacted, and washed the other hand by immersing it in a river of forty סאה‎. תוספות asks: ואם תאמר והיכי פשיט מהכא כי משי חדא ידא והדר משי לאידך‎ – And if you will say; but how can he resolve the query of אילפא, where he first washed one hand and then he washed the other, from this משנה‎ – דלמא הכא מיירי שעשה בבת אחת שטיפה לזו ונטילה לזו‎ – Perhaps here in the משנה we are discussing a case where he simultaneously did שטיפה to one hand and נטילה to the other, but the query was when they were done one after the other! תוספות answers: ויש לומר דקסבר הש"ס דאין חילוק דמסתברא דאי בזו אחר זו לא מהני – And one can say; the גמרא assumes that there is no difference, for logic dictates that if washing the hands one after the other is not effective then – הוא הדין דבבת אחת נמי לא מהני אפילו שתיהן בנטילה יד זו מכלי זה ויד זו מכלי אחר – The same law applies that if he washed both hands simultaneously it will also not be effective and even if both were done by נטילה, meaning one hand from this vessel and the other hand from another vessel. תוספות offers an alternate explanation: ורבינו תם גרס על פי המשניות נטל ידו אחת משטיפה אחת ידו טהורה – And the ר"ת, based on the משניות, reads the text of the משנה as follows: ‘ he washed one hand with one שטיפה that hand is טהורה’. This concludes the משנה‎ – וקפשיט מדקתני ידו טהורה שמע מינה דחדא חדא מהניא‎ – And the גמרא resolves the query of אילפא, since the משנה reads ידו טהורה (in the singular); it is evident that one hand at a time is effective. תוספות continues to explain the משנה: והכי פירושו משטיפה אחת שצריך לשפוך מן הכלי על ידיו ב' פעמים‎ – And this is the explanation of the משנה when it says משטיפה אחת; for it is known that [generally] it is necessary to pour from the vessel on his hands two times – כדמוכח בכמה דוכתי במסכת ידים דצריך מים ראשונים ושניים – As is evident in many places in מסכת ידים, that there is a requirement for the first waters and the second waters (one has to pour twice on his hands) – ועל זה קאמר ואם נטל ידו אחת משטיפה אחת גדולה שהיא כשתים ידו טהורה – And regarding this ruling of מים ראשונים ושניים, the משנה states that if he washed one of his hands from one large pouring of water, which is the equivalent of two individual pourings, his hand is טהורה‎ – כיון שיש בשטיפה זו כשיעור מים ראשונים ושניים‎ – Since this one שטיפה has the amount of water that is in מים ראשונים ושניים‎ – וקא מסיים בסיפא שתי ידיו בשטיפה אחת רבי מאיר מטמא עד שיטול מרביעית‎ – And the משנה concludes in the סיפא; if he washed both hands with one pouring, ר"מ considered his hands טמא unless he washes from a vessel which contains a רביעית of water - תוספות responds to an anticipated difficulty: אף על גב דכשנוטל בשתי שטיפות לא בעי רביעית – Even though, that when he washes in two pourings a רביעית is not necessary, nevertheless – השתא דליכא אלא שטיפה אחת צריך רביעית בשטיפה זו‎ – Now that there is only one pouring, this pouring requires a רביעית‎ – אבל ידו אחת אין צריך רביעית כי אתו משירי טהרה‎ – However, for one hand a רביעית is not necessary if it comes משירי טהרה – אלא שתהא אותה שטיפה מרובה כשתים: Provided that it should be a שטיפה which is equivalent to two שטיפות‎. S UMMARY According to רש"י the text of the משנה is אחת בנטילה ואחת בשטיפה, and שטיפה means immersion; according to תוספות the משנה reads ידו אחת משטיפה אחת, and שטיפה means pouring. Initially the vessel must contain a רביעית of water and each hand be washed twice. If part of the water was already used for נטילה, the remaining water is called שירי טהרה‎. When pouring on one hand (only), one may pour once (even less than a רביעית) provided that it is the amount of two שטיפות and the water is משירי טהרה‎. If one pours on both hands together from שירי טהרה; if he pours twice a רביעית is not necessary, however if he pours once מרובה כשנים, a רביעית is necessary. T HINKING IT OVER 1. תוספות initially asks on רש"י how the גמרא resolved the query from the משנה‎. Subsequently, תוספות explained the answer according to פרש"י. What changed in תוספות understanding between the question and answer? 2. Why was it necessary for תוספות to explain in detail the משנה in מסכת ידים‎?
