    Gittin 41b

    Chapter 4 - HaSholeach

    English translation - Gittin 41b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1It is also not possible for him to marry a free woman, as he is still a half-slave. If you say he should be idle and not marry, but isn’t it true that the world was created only for procreation, as it is stated: “He did not create it to be a waste; He formed it to be inhabited” (Isaiah 45:18)? Rather, for the betterment of the world his master is forced to make him a freeman, and the slave writes a promissory note accepting his responsibility to pay half his value to his master. And Beit Hillel ultimately retracted their opinion, to rule in accordance with the statement of Beit Shammai, that a half-slave must be set free.

2GEMARA: The Sages taught: With regard to a master who emancipates only half of his slave, Rabbi Yehuda HaNasi says: He has acquired himself, i.e., the transaction is complete and half of the slave is emancipated, and the Rabbis say: He has not acquired himself.

3Rabba said: Their dispute pertains only to a case where the master emancipated him with a bill of manumission, as Rabbi Yehuda HaNasi holds: In the context of a Jewish man who engages in sexual intercourse with a maidservant who had been designated to cohabit with a Hebrew slave, the Torah writes that neither the Jewish man nor the maidservant is liable to receive the death penalty, though the man is liable to bring a guilt-offering. If the woman had been emancipated, she would be a regular married woman, and they would incur the death penalty for their act of intercourse. In describing the woman in that case, the Torah writes: “And not at all redeemed, nor was freedom given to her” (Leviticus 19:20). This is referring to two methods of emancipating a slave: Redemption via money, in the phrase: “And not at all redeemed,” and emancipation via a bill of manumission, in the phrase: “Nor was freedom given her.”

4The verse juxtaposes the freeing of a slave via a bill of manumission to the freeing of a slave via payment of money, to teach that just as with money the slave can free either all of him or half of him, for if he were to pay half of his value to the master he would be half-redeemed, so too, by receiving a bill of manumission either all of him or half of him can be emancipated.

5And the Rabbis derive their opinion, that a slave cannot acquire half of his freedom via a bill of manumission, from a verbal analogy of the word “her [ lah ]” written here: “Nor was freedom given to her [ lah ]” (Leviticus 19:20), and the word “her [ lah ]” written with regard to a man who divorces a woman: “And he writes her [ lah ] a scroll of severance” (Deuteronomy 24:1). Just as in the case of a woman, one is not able to divorce half of her with a bill of divorce, so too, in the case of a slave, one is not able to emancipate half of him with a bill of manumission. However, with regard to a slave who frees himself by giving money, everyone agrees that the slave acquires half of himself, and a female slave would also be partially redeemed but not fully redeemed.

6The Gemara suggests: Let us say that they disagree about this: As one Sage, Rabbi Yehuda HaNasi, holds that a derivation from a juxtaposition is preferable, and consequently he derives the halakha of emancipation via a bill of manumission from the halakha stated in the same verse concerning redemption via money. And one Sage, i.e., the Rabbis, holds that a verbal analogy is preferable and therefore derives the halakha of emancipation via a bill of manumission from the halakha of the divorce of a woman, where the verse employs an analogous term.

7The Gemara rejects this: No, everyone agrees that generally a verbal analogy is preferable, but it is different here because the verbal analogy can be refuted by stating the following: What is unique about a woman is that she cannot leave a marriage via money at all, shall you say that one should compare her case to that of a slave, who does leave his servitude via money? Since there are differences between divorce and emancipation, Rabbi Yehuda HaNasi holds that it is preferable to derive the halakha from a juxtaposition.

8And Rav Yosef said: The dispute between Rabbi Yehuda HaNasi and the Rabbis pertains only to a case where the slave was freed via money, for Rabbi Yehuda HaNasi holds: The halakha that a slave can be half-freed can be derived from the phrase: “And not at all redeemed [ vehofde lo nifdata ]” (Leviticus 19:20), indicating that she has been partially redeemed but not fully redeemed. And the Rabbis hold: The Torah spoke in the language of people, and the repetition of the verb in the verse is not to be used as a source for deriving a halakha . However, when the slave is half-emancipated via a bill of manumission, everyone agrees that the slave has not acquired himself and remains a full slave.

9The Gemara raises an objection against Rav Yosef’s statement based on what was taught in a baraita : With regard to one who emancipates half of his slave with a bill of manumission, Rabbi Yehuda HaNasi says: He has acquired himself, and the Rabbis say: He has not acquired himself. The Gemara concludes: The refutation of the opinion of Rav Yosef is a conclusive refutation.

10The Gemara suggests: In this baraita , they disagree in a case where the slave is half-emancipated via a bill of manumission. However, they do not explicitly disagree in a case where the slave is half-redeemed with money. Shall we say that this is a conclusive refutation of the statement of Rav Yosef with regard to two aspects: First, as above, Rabbi Yehuda HaNasi holds that he is half-freed via a bill of manumission; second, according to his statement, the dispute pertains to redeeming with money, yet the baraita gives no indication that the Rabbis would hold that the slave can be half-redeemed with money?

11The Gemara rejects this: Rav Yosef could have said to you: They disagree with regard to emancipation via a bill of manumission, and the same is true, that they would disagree, with regard to redeeming with money. And this, that they explicitly disagree with regard to emancipation via a bill of manumission, is to convey to you the far-reaching nature of the opinion of Rabbi Yehuda HaNasi, that a slave can be half-freed even by receiving a bill of manumission.

12The Gemara asks: And let them disagree with regard to redeeming with money, and to convey to you the far-reaching nature of the opinion of the Rabbis, that they hold he cannot be half-freed even through redeeming with money. The Gemara responds: It is preferable to the tanna to emphasize the power of leniency, and therefore the dispute is presented as it is.

13The Gemara suggests: Come and hear a proof with regard to this discussion based on a baraita : The verse in Leviticus employs the double expression “ vehofde lo nifdata ,” literally: And redeemed not redeemed, in discussing the designated maidservant. The baraita analyzes this wording. If the verse had stated only “and redeemed,” one might have thought that the verse discusses a maidservant that is entirely redeemed. Therefore, the verse states “not redeemed.” If it had stated only “not redeemed,” one might have thought that it means an entirely unredeemed maidservant, i.e., a full maidservant. Therefore, the verse states “and redeemed.” How can these texts be reconciled? The verse is discussing a case where she is partially redeemed but not fully redeemed. This was accomplished via money or an equivalent value of money.

14The baraita continues. And I have derived only that she can be partially redeemed via money. From where do I derive that she can also be emancipated via a bill of manumission? The verse states: “And not at all redeemed, nor was freedom given to her” (Leviticus 19:20), and later on, in the case of divorce, it states: “And he writes her a scroll of severance” (Deuteronomy 24:1). Just as later on freedom is granted via a bill of divorce, so too here, a maidservant is freed via a bill of manumission.

15I have derived only that half of a slave can be redeemed via money, as detailed above, or that all of him can be emancipated via a bill of manumission. From where do I derive that half of him can be emancipated via a bill of manumission? The verse states: “And not at all redeemed, nor was freedom given her,” and thereby juxtaposes a bill of manumission to money. Just as a slave can be either fully redeemed or half-redeemed via money, so too, he can be either fully emancipated or half-emancipated via a bill of manumission. This marks the end of the baraita .

16The Gemara analyzes the baraita in light of the earlier opinions. Granted, according to Rav Yosef after he was conclusively refuted, who now holds that Rabbi Yehuda HaNasi and the Rabbis disagree both with regard to money and a bill of manumission, in accordance with whose opinion is this baraita ? It is the opinion of Rabbi Yehuda HaNasi, for half of the slave is freed, whether via money or a bill of manumission. However, according to the opinion of Rabba, that Rabbi Yehuda HaNasi and the Rabbis disagree only with regard to a bill of manumission, but everyone agrees that the slave can redeem half of himself with money, do all agree with the statement of the first clause, but the last clause is in accordance with the opinion of only Rabbi Yehuda HaNasi?

17Rabba could have said to you: Yes, all agree with the statement of the first clause, and the last clause is in accordance with only Rabbi Yehuda HaNasi. Rav Ashi said: This baraita is entirely in accordance with the opinion of Rabbi Yehuda HaNasi.

18The Gemara asks: But with regard to the mishna that teaches: In the case of one who is a half-slave half-freeman, granted, according to the opinion of Rabba, he establishes the mishna as referring to a case where the slave was half-redeemed with money, and everyone agrees that this is effective. However, according to the opinion of Rav Yosef, shall we say that the mishna is in accordance with the opinion of only Rabbi Yehuda HaNasi and not in accordance with the opinion of the Rabbis? According to the opinion of Rav Yosef, the Rabbis hold that a slave cannot be half-free, regardless of whether he is freed via money or a bill of manumission. Ravina said:

לא תוהו בראה לשבת יצרה‎—He did not create it for a waste; he formed it to be settled O VERVIEW The משנה taught regarding an עבד כנעני who is half free and half slave, that he cannot marry neither a שפחה כנענית, nor a בת ישראל, and he cannot remain unmarried, since the world was created for פריה ורביה as it is written לא תוהו בראה לשבת יצרה‎. Our תוספות discusses why the גמרא cites the פסוק of שבת and not the פסוק of פרו ורבו, which is written in the תורה‎. תוספות responds to an anticipated difficulty: הא דלא נקט קרא דפרו ורבו‎ – The reason the ב"ש did not cite the פסוק of פרו ורבו (instead of שבת), is – משום דאי הוה יכול לקיים שבת כל דהו משום מצות פרו ורבו לא הוה כפינן ליה – Because for if the עבד would have been able to fulfill somewhat the מצוה of שבת, the חכמים would not have forced the master to free the עבד on account that he should also fulfill the מצוה of פו"ר – והכא כפינן ליה כדפירשנו – But here we do force him to free the עבד, and that is because he cannot even fulfill the מצוה of שבת as we have explained – תוספות offers an alternate reason why he mentions שבת and not פו"ר: אי נמי נקט האי קרא משום דמוכחא דמצוה רבה היא – Or you may also say; he mentions this פסוק of שבת because it proves that שבת is a great מצוה‎ – וכן בפרק בתרא דמגילה (דף כז, א) מייתי לה גבי מוכר ספר תורה ללמוד תורה ולישא אשה – And similarly the גמרא cites this פסוק of שבת in the last פרק of מסכת מגילה regarding the discussion whether one may sell a ס"ת in order to study תורה or to marry a wife – דקאמר שאני תלמוד תורה דאמר מר גדול תלמוד תורה כולי אשה נמי לא תוהו בראה‎ – Where ר' יוחנן rules in the name of ר"מ that ת"ת is different since the master said that ת"ת is great, etc. for it brings to action, so we may sell a ס"ת to learn תורה and also to marry a woman, for it is written לא תהו בראה‎. We see that in order to express the greatness of the מצוה of having children, the גמרא chooses the פסוק of לא לתוהו בראה as opposed to פו"ר, for לא לתוהו shows that it is a great מצוה (a מצוה רבה). Al final explanation why the גמרא mentions שבת instead of פו"ר: והרב רבינו יצחק ברבי מרדכי מפרש דנקט לשבת יצרה משום דשייך אף בצד עבדות‎ – And הרב ריב"ם explains that the גמרא here cites לשבת יצרה, because it is applicable even to the צד עבדות‎ – אבל פרו ורבו לא שייך אלא בצד חירות‎ – However the מצוה of פו"ר is applicable only to the צד חירות, but not to the צד עבדות, so therefore since the entire עבד is no מצווה on פו"ר we would not force the master; however since the entire עבד is מצווה on שבת (an he cannot do it in his present state), therefore we force the master – וכן משמע קצת בירושלמי דפרקין (הלכה ה') ודפרק קמא דמועד קטן (הלכה ד') – And this is also somewhat indicated in the תלמוד ירושלמי of our פרק and in the first פרק of מסכת מו"ק – דאמר תמן תנן אין נושאין נשים במועד‎ – Where the ירושלמי states, ‘the משנה there taught, one may not marry women on חול המועד‎ – שמעון בר אבא בשם רבי יוחנן אומר מפני ביטול פריה ורביה‎ – שב"א stated in the name of ר"י the reason for this rule is because it prevents פו"ר – פירוש שלא ימתין מלישא עד המועד שהוא זמן שמחה ופנוי מכלום‎ – This means that one should not wait until חוה"מ to get married because it is a time of rejoicing and one is free from obligations; there is no work to be done, rather he should marry as soon as possible so he can commence with פו"ר – בעון קומי רבי אסי העבד מהו שישא במועד אמר להון נשמענה מן הדא – A query was posed before ר"א; ‘can an עבד marry on חוה"מ’, he answered them, ‘we know it from this ruling – יבטל והלא לא נברא העולם אלא לפריה ורביה‎ – Shall he cease from marrying, but the whole world was created only for פו"ר’ – ואמר שמעון בר אבא בשם רבי יוחנן כל שהוא מצווה על פריה ורביה אסור לו לישא במועד‎ – And שב"א said in the name of ר"י whoever is commanded on פו"ר is forbidden to marry on חוה"מ – פירוש כל שהוא מצווה על פריה ורביה משום לשבת יצרה כגון עבד‎ – The meaning is, ‘whoever is commanded for פו"ר because of לשבת יצרה, for instance an עבד (is forbidden to marry on חוה"מ) – אבל אפרו ורבו ודאי לא מיחייב ולפי זה בשפחה נמי שייך בה שבת – However an עבד is certainly not liable for transgressing פו"ר, so according to this, the חיוב of שבת applies to a שפחה as well (even though פו"ר does not apply to her) – והא דלא כפינן בחציה שפחה וחציה בת חורין אלא היכא דנהגו בה מנהג הפקר‎ – And so the reason why we do not force the master of a חציה שפחה וחציה בת חורין to free her, unless they are promiscuous with her – היינו משום כיון דלא מיפקדא אפרו ורבו שמא גם לאחר שתשתחרר לא תקיים: That is because, since she is not commanded for פו"ר we are concerned that even after she is freed she will not be מקיים (even) the מצוה of שבת‎. S UMMARY The משנה cites שבת (instead of פו"ר) because, a) שבת is the deciding factor to force the master to free him, b) שבת is a מצוה רבה, and c) there is a חיוב of שבת on the עבד (ושפחה), but no חיוב of פו"ר. T HINKING IT OVER תוספות proves from the ירושלמי that an עבד is not מצווה on פו"ר, since we query what is the status of an עבד after we already determined that פו"ר precludes one from marrying בחוה"מ. However this itself may be the query whether an עבד is מחוייב בפו"ר or not; what is the proof.

כופין את רבו ועושה אותו בן חורין‎—We force his master and he makes him a free man O VERVIEW The משנה teaches that we force the master of a חצי עבד וחצי בן חורין to free his part of the עבד, so the עבד can be מקיים פו"ר (שבת). When freeing an עבד כנעני one transgresses the עשה of לעולם בהם תעבודו, and nevertheless we force him to transgress this עשה in order to benefit the עבד‎. Our תוספות discusses when we take such steps and when not. -------------------------- תוספות asks: ואם תאמר וכי אומרים לאדם חטא כדי שיזכה חבירך – And if you will say; but do we then say to a person; ‘sin in order that your friend shall merit’?! דהכי אמר בפרק קמא דשבת (דף ד, א) גבי הדביק פת בתנור – For this is what רב ששת stated in the first פרק of מסכת שבת regarding the case where one stuck a dough in the oven – תוספות answers: ויש לומר דדוקא התם אמרינן הכי משום דפשע שהדביק סמוך לחשיכה – And one can say that it is only there (by שבת) that we say this (וכי אומרים לאדם חטא בשביל שיזכה חבירך) b ecause he was negligent for he stuck it on close to nightfall – אבל הכא דלא פשע לא‎ – However here where the עבד was not פשע, we do not say וכי אומרים לאדם וכו', but on the contrary we encourage (coerce) one to do a (smaller) sin to enable another to do a מצוה‎. וכן בפרק בתרא דערובין (דף קג, א) אמר כהן שעלתה לו יבלת חברו חותכה לו בשיניו‎ – And similarly in the last פרק of מסכת ערובין the ברייתא states if a wart appeared on a כהן, his friend would cut it off with his teeth – דקעביד שבות כדי שיזכה חברו בעבודה‎ – So the friend (who is biting off the יבלת) is transgressing a שבות in order that his friend (the one with the יבלת) should merit doing the עבודה‎ – וכן בריש תמיד נשחט (פסחים דף נט, א) אמר מחוסר כפרה בערבי פסחים And similarly in the beginning of פרק תמיד נשחט, the ברייתא states; ‘a מחוסר כפרה on ערב פסח‎ – שמביא כפרתו אחר תמיד של בין הערבים דעשה דפסח שיש בו כרת דחי עשה דהשלמה – That this מחוסר כפרה can bring his כפרה even after the תמיד של בין הערביים was brought, for we say that the מצות עשה of bringing the קרבן פסח for which there is כרת if one does not bring it, that מ"ע pushes aside the מצות עשה of השלמה’ – אלמא קא עברי כהני בעשה דהשלמה כדי שיזכה זה בפסח – It is evident that the כהנים who bring his קרבן transgress the עשה of השלמה, in order that he should be זוכה to bring the קרבן פסח‎. In summation; when the person we wish to assist was a פושע (like by הדביק פת בתנור) we do not say חטא בשביל שיזכה חברך, however if he was not פושע (like the חצי עבד or the כהן וזב) we say חטא בשביל שיזכה חברך‎. תוספות anticipates a difficulty: וחציה שפחה וחציה בת חורין דכפו את רבה (לעיל לח, ב) משום דנהגו בה מנהג הפקר‎ – And regarding the חציה שפחה וחציה בת חורין where the בי"ד forced her master to free her, because the people conducted themselves with her in a promiscuous manner – אף על גב דהם פושעים – Even though that the people were negligent, so why do we force the master to do a sin for the benefit of others who are also sinning; the answer is – כיון שהיתה מחזרת אחריהם ומשדלתן לזנות חשיבי כאונסים‎ – That since the שפחה was seeking them out and encouraging them for זנות, they are considered as אונסים ועוד דמצוה דרבים שאני : And furthermore a מצוה for the benefit of the public is different. S UMMARY We say חטא בשביל שיזכה חברך if the חבר was not negligent or it is preventing a רבים from sinning. T HINKING IT OVER תוספות justifies freeing the slave even though the master is עובר on a מ"ע and proves it from the case of the יבלת‎. However there the כהן biting off the יבלת is merely transgressing a שבות מדרבנן, while by the עבד the master is עובר on a מ"ע מה"ת‎?!

דכולי עלמא גזירה שוה עדיפא‎—For everyone agrees that a G’zayroh Shovoh is preferable O VERVIEW The ברייתא cites a dispute whether one can free half an עבד with a שטר‎. Initially the גמרא wanted to say that רבי, who maintains that he can be freed, relies on the היקש (of שטר to ממון), and the חכמים, who maintain he cannot be freed halfway, rely on the גזירה שוה of לה לה (from עבד to אשה). Their argument is which is more effective a גז"ש or a היקש‎. However רבא argues that all agree that a גז"ש is preferable than a היקש (and their argument hinges on something else). תוספות qualifies this statement of רבא‎. תוספות anticipates a difficulty: בריש איזהו מקומן (זבחים דף מח, א) ובפרק דם שחיטה (כריתות דף כב, ב) פליגי רבי עקיבא ורבנן‎ – In the beginning of פרק איזהו מקומן and in פרק דם שחיטה there is a dispute between ר"ע and the רבנן‎ – בספק מעילות ומשמע דלכולי עלמא הקישא עדיפא – Regarding questionable מעילות, and it seems that all agree that a היקש is preferred over a גז"ש, so how can רבא state here that כ"ע גז"ש עדיפא‎?! תוספות responds: הכא שאני משום דעיקר שטר מגזירה שוה נפקא לן : Here (by עבד) it is different because the entire concept that שטר is effective by an עבד is derived through a גז"ש from אשה, therefore in this case only, the גז"ש is dominant S UMMARY Generally הקישא עדיפא, however here, since the entire concept of שטר by עבד is derived from this גז"ש, therefore רבא can say גז"ש עדיפא‎. T HINKING IT OVER Why was it necessary for רבא to say that כ"ע גז"ש עדיפא, he could have said that כ"ע הקישא עדיפא (as it says in the other גמרות) however here the חכמים maintain that since עיקר שטר מגז"ש נפקא לן, therefore here we cannot follow the היקש; why the need to say כ"ע גז"ש עדיפא, when generally this is not the case?!

מה לאשה כולי‎—Why is it by a woman, etc - Overview רבא explained that even though all agree that גז"ש עדיפא, nevertheless רבי felt that here הקישא עדיפא because we can refute the גז"ש לה להfrom אשה, by distinguishing between אשה and עבד‎. Our תוספות explains the view of רבי‎. ------------------------------------- תוספות anticipates a difficulty: אף על גב דגזירה שוה מופנה היא דילפינן מינה מילי טובא – Even though that the גז"ש of לה לה is מופנה, since we know that we derive many things from this גז"ש, so how can there be a refutation – תוספות responds: מכל מקום כיון דאיכא למיפרך שבקינן לה משום הקישא: Nevertheless, since we can ask that there is a difference between עבד ואשה, we abandon the גז"ש because of the היקש‎. S UMMARY Where there is a היקש to the contrary of the גז"ש, the rule of למידין ואין משיבין by a גז"ש מופנה does not apply (according to רבי). T HINKING IT OVER Are the words ‘לה’ extra (מופנה) both by אשה and עבד, or only by one of them?
