    Gittin 18a

    Chapter 2 - HaMevi Batra

    English translation - Gittin 18a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1and puts it in his pocket without giving it to her, as he thought that if she appeases [ mippayyesa ] him he will be appeased, what is the halakha when he then does give it to her? Since the date on the document is incorrect, did the Sages institute an ordinance that such a bill of divorce should not be used?

2Rava said to him: A person does not hasten a calamity on himself and will not ordinarily prepare a bill of divorce in advance. Rather, he will wait until he is ready to divorce his wife. Since this scenario is unlikely, the Sages did not see a need to institute an ordinance pertaining to it.

3Ravina said to Rav Ashi: When there are bills of divorce that come from a country overseas which are written, for example, in the month of Nisan, and they do not reach the woman until the month of Tishrei, what did the Sages accomplish with their ordinance to date the bill of divorce? All of the concerns about an undated bill of divorce still apply. He said to him: Concerning these bills of divorce from overseas, it is public knowledge that they do not take effect from the date on which they were written. Therefore, if there is a conflict over produce the husband has sold, the woman must bring witnesses to testify as to when she received her bill of divorce.

4§ The Sages decreed that it is prohibited for a woman to remarry within three months of her divorce or her becoming a widow, in order to prevent a situation of doubt concerning the paternity of a child. It was stated: From when does one begin counting the three months with regard to a bill of divorce? Rav says: From the time of the giving of the bill of divorce, and Shmuel says: From the time of the writing of the bill of divorce.

5Rav Natan bar Hoshaya objects to this: According to the statement of Shmuel, now people will say: If two women who live in one courtyard received their bills of divorce at the same time, but the first document was written at the time of the divorce and the second one was written earlier, then this woman is still prohibited from remarrying, as three months have not yet passed from when her bill of divorce was written; and that woman is already permitted to remarry. This does not seem reasonable. Abaye said to him: This is not difficult. With regard to this woman, the date of her bill of divorce proves concerning her that she may not remarry yet; and with regard to that woman, the date on her bill of divorce proves concerning her that she may remarry already.

6The Gemara comments: It is taught in a baraita in accordance with the opinion of Rav, and it is taught in a baraita in accordance with the opinion of Shmuel. The Gemara explains: It is taught in a baraita in accordance with the opinion of Rav that the three-month count begins from when the bill of divorce is given: In the case of one who sends a bill of divorce to his wife, and the agent tarries on the way for three months, once the bill of divorce reaches her hand she must wait three months before remarrying. And one need not be concerned that it is an outdated bill of divorce, i.e., that the husband and wife were secluded after it was written, rendering the bill of divorce invalid, because he was not secluded with her during the time the bill of divorce was being delivered.

7It is taught in another baraita in accordance with the opinion of Shmuel that the count begins from the time of the writing: In the case of one who is about to travel and deposits a bill of divorce for his wife with a trustee and says to him: Give it to her only after three months, once he gives it to her, she is permitted to marry immediately and is not required to wait an additional three months. And one need not be concerned that it is an outdated bill of divorce, as he was not secluded with her in the interim.

8It is told that Rav Kahana and Rav Pappi and Rav Ashi would in practice count three months from the time of the writing, but Rav Pappa and Rav Huna, son of Rav Yehoshua, would in practice count these three months from the time of the giving. And the halakha is that the counting begins from the time of the writing.

9§ The Gemara discusses another dispute between Rav and Shmuel with regard to documents. According to the terms of a marriage contract, a widow is entitled to payment of its value upon the death of her husband. By Torah law, all outstanding debts are canceled at the close of the Sabbatical Year. A woman need not take her marriage settlement as soon as her husband dies. The issue at hand is at what point the marriage contract generates a concrete debt that will be canceled by the Sabbatical Year. It was stated: From when is the debt established by a marriage contract canceled in the Sabbatical Year?

10Rav says: The marriage contract becomes like a debt and will be canceled in the Sabbatical Year from the time when the woman collects partial payment and establishes the rest as a debt in court. And Shmuel says: This occurs when she either collects partial payment although she did not establish it as debt, or she established the entire value of the marriage contract as a debt in court although she did not collect partial payment.

11With regard to this dispute, it is taught in a baraita in accordance with the opinion of Rav, and it is taught in a baraita in accordance with the opinion of Shmuel. It is taught in a baraita in accordance with the opinion of Rav: From when is the debt established by a marriage contract canceled? From when she accepts partial payment and establishes the rest as a debt in court. However, if she accepted partial payment but did not establish the debt, or established the debt but did not accept partial payment, then it is not canceled until she accepts partial payment and establishes the debt.

12It is taught in another baraita in accordance with the opinion of Shmuel: If the fine and damages paid by one who commits rape; or the fine paid by one who falsely claims his wife was not a virgin at the time of their wedding; or the fine paid for seduction; or the debt established by a woman’s marriage contract was established as a loan, then the Sabbatical Year cancels it. And if one did not establish these payments as loans, then the Sabbatical Year does not cancel them. From when is it considered that these payments have been established as a loan? From the time of standing trial, because the abstract obligation to pay becomes a debt once the court ruled that one is required to pay.

13§ The Gemara discusses other aspects of the marriage contract. Shmuel said: A marriage contract is considered to be like a court enactment. Just as court enactments may be written during the day and then signed at night, and the fact that the writing and signing were not performed on the same day does not present a problem, so too, a marriage contract may be written during the day and then signed at night. It is told: Rabbi Ḥiyya bar Rav’s marriage contract was written during the day and then signed at night, and Rav was there and he did not say anything to the people who wrote and signed it. This indicates that Rav agrees with the ruling of Shmuel.

14The Gemara asks: Shall we say he holds in accordance with the opinion of Shmuel? The Gemara rejects this: This cannot be proven from here because the scribe and witnesses were continuously engaged in that matter of writing the marriage contract, from when it was written in the day until they signed it at night, as it is taught in a baraita that Rabbi Elazar bar Rabbi Tzadok said: The Sages taught that a document written during the day and signed at night is invalid only when the scribe and witnesses were not continuously engaged in that matter, but if they were continuously engaged in that matter until nightfall, then it is valid.

15§ The mishna taught that Rabbi Shimon deems valid a bill of divorce written during the day and signed at night. Rava said: What is the reason for the opinion of Rabbi Shimon? He holds that once the husband has decided to divorce her, he no longer has the rights to the produce from his wife’s property, and it is clear that he has decided to divorce her when he writes a bill of divorce. Consequently, the woman obtains the rights to the produce from the moment the bill of divorce was written, regardless of when it was signed.

16Reish Lakish says: Rabbi Shimon deems such a bill of divorce valid only if it is signed immediately, when the witnesses signed the bill of divorce during the night after it was written. However, if the delay in signing was from now, i.e., when the bill of divorce was written, until ten days have elapsed, i.e., when there is an extended delay, he does not deem it valid.

    Rashi

From when do we count for a divorce document - three months that a woman must wait.

An old divorce document - Later on (Gitin, page 79b) we learn: It was taught in a Mishnah that one does not divorce with an old divorce document. And what is considered an old divorce document? It is one that has been specifically designated for her, since it was written for her. The reason is that we are concerned people might say that the divorce document predates the marriage, and perhaps she conceived and gave birth between the time of its writing and its delivery. And after some time, people might say that the divorce document came first, and in the case of adultery, she has already conceived.

She demands partial payment, indicating her intention to claim and settle the debt fully. It implies that her mind is inclined to pursue and collect the debt.

ותזקוף - And upon him is permitted to borrow money since it emerges for her sake, based on the ketubah (marriage contract), and it resembles the practice of a court that does not annul the ketubah, and it applies to a promissory note.

Once her intention is evident in pursuing payment, we deem it as not conflicting.

Concerning borrowing money.

One who seduces a virgin is obligated to pay fifty silver coins.

One who spreads a bad name incurs a penalty.

From when are they considered as having a subsequent correction? That is, from when does it count as a subsequent correction?

Placing it upright is considered a subsequent correction.

...The action of a similar court - it is a condition of a court:

What is the action of a court? Its obligations are due to a legal decision, and even though they were not confirmed, therefore there is no preliminary stage, and they are written during the day and signed during the night.

Similarly, a marriage contract - from the time of writing, when it enters the wedding ceremony, it is an effective legal document with obligations, and even though they were not confirmed.

Engaged in that matter - From the time of writing until the time of signing, and even in other documents, it is valid.

They did not teach - That documents written during the day and signed at night are invalid.

But engaged in that matter - Since the witnesses are summoned to sign, but the husband must wait until the scribe finishes writing the document, even though the signing is delayed.

It is valid - Because from the time of writing, it also has legal significance.

He does not have the rights to the produce (fruits) - And if there is a defect from the time of writing, it is considered a defective document.

ואנחיה בכיסתיה מאי‎—And he placed it in his wallet; what is the ruling O VERVIEW אביי asked ר"י what did the חכמים accomplish with their תקנה (of writing זמן בגיטין) in the case of כתביה ואנחיה and in the case of גיטין הבאין ממדה"י, since in both these cases the זמן הכתיבה (והחתימה) predates the זמן הנתינה‎. There is a dispute between רש"י and תוספות whether these questions were also according to the one who maintains that זמן was instituted because of פירות‎. --------------------- פירש בקונטרס מה הועילו חכמים בתקנתם בין לענין זנות – רש"י explained that the question is what did the חכמים accomplish with their regulation regarding writing a date in the גט, whether if the תקנה was regarding זנות, or – בין לענין פירות דטרפה לקוחות מיום הכתיבה – Whether the תקנה was regarding פירות; it will not accomplish anything in this case, for she will collect the פירות from the לקוחות from the day the גט was written – תוספות anticipates a difficulty (in פירש"י) regarding the question on פירות: אף על גב דלעיל אמר ריש לקיש דיש לבעל פירות עד שעת חתימה‎ – Even though previously ר"ל ruled that the husband owns the פירות only until the time of signing the גט, but not afterwards, so the woman rightfully collects the פירות from the לקוחות from the יום הכתיבה (והחתימה) – תוספות responds (in defense of רש"י): הכא מודה דיש לבעל פירות עד שעת נתינה כיון דאי מפייסה תיפייס – Nevertheless, here in this case of כתביה ואנחיה, (even) ר"ל admits that the husband owns the פירות until the time of giving the גט, since if he will appease her, she will be appeased (and he will not divorce her). תוספות has a difficulty with פירש"י (later): ומיהו ההוא דגיטין הבאין ממדינת הים דפירש בקונטרס דלתרווייהו פריך קצת קשה – However, there is a slight difficulty regarding that discussion of גיטין which come from overseas, that רש"י explained that the גמרא asks according to both ר"ל ור"י (פירות וזנות). ‘what did the חכמים accomplish with their תקנה’ – דלמה לא יפסיד משעת חתימה לריש לקיש כיון שאם היתה אצלו היה מגרשה לאלתר – For why should not the husband lose the פירות from the time of חתימה according to ר"ל, since he would have divorced her immediately if she were near him – תוספות has an additional question on פירש"י (regarding כתביה and מדה"י): ועוד קשה לרבינו יצחק דמה הועילו חכמים בתקנתם משמע‎ – And the ר"י has an additional difficulty with פירש"י; for the question of מה הועילו חכמים בתקנתם, indicates – דהשתא איכא למיחש כאילו לא היה בו זמן‎ – That now by these (two) cases we can be concerned as if there was no זמן‎ – וזה אינו דבאין בו זמן חוששים שלא תפסיד האשה – But this is not so (regarding פירות), for in a case where there is no זמן in the גט, we are concerned that woman should not lose out on the פירות‎ – וחששא דהכא לא משום אשה אלא משום לקוחות – However the concern here (in the two cases of כתביה ואנחיה or גיטין הבאין ממדה"י) there is no concern for the woman but rather we are concerned for the לקוחות, therefore the expression מה הועילו חכמים בתקנתם is not appropriate, for the תקנת חכמים of זמן accomplished what it set out to do, namely to protect the אשה‎. תוספות offers his explanation regarding these two questions: ונראה לרבינו יצחק דהנך תרי פירכי למאן דאמר שמא יחפה – And it is the view of the ר"י that these two challenges (regarding כתבי ואנחי and גיטין הבאין ממדה"י) are only according to the one who maintains שמא יחפה‎ – אבל למאן דאמר משום פירי ניחא דבדין מפסידין הלקוחות משעת חתימה: However, according to the one who maintains משום פירי it is fine, for the לקוחות legally lose their rights to the פירות from שעת חתימה‎. S UMMARY רש"י maintains that the questions on כתביה ואנחיה and גיטין הבאין ממדה"י are on ר"י ור"ל, while תוספות maintains they are only on ר"י. T HINKING IT OVER 1. תוספות writes that it is a קצת קשה regarding פירש"י on the question of גיטין הבאין ממדה"י. Why does תוספות write that it is merely קצת קשה‎?! 2. תוספות writes that these two questions are only according to the מ"ד of שמא יחפה, but not according to the one who says משום פירי‎. How is it that here תוספות does not find it a דוחק to say that the question is only according to the מ"ד משום שמא יחפה‎?!

הנהו קלא אית להו‎—These are publicized O VERVIEW רב אשי explained that there is no concern (of שמא יחפה) by גיטין הבאין ממדה"י (even though the יום הכתיבה precedes the יום הנתינה), because it is well publicized that the יום הכתיבה is not the יום הנתינה‎. There is a dispute between רש"י and תוספות how this prevents the שמא יחפה‎. ------------------ פירש בקונטרס דבעיא לאיתויי ראיה אימת מטא גיטה לידה‎ – רש"י explained there is no concern of שמא יחפה (that she will be spared execution), for she is required to bring proof when the גט came into her possession (and up to that date she is presumed to be בחזקת א"א and she will be executed for any זנות prior to that date). תוספות disagrees with פירש"י and asks: תימה דלענין זנות דנהי דידוע שלא בא לידה ביום הכתוב בו‎ – It is astounding! For regarding the זנות, granted that it is known that she did not receive the גט on the written date – מכל מקום יכול לחפות ולומר שנתן לה קודם שזינתה כמו קודם שתיקנו זמן – Nevertheless the husband can be מחפה and claim that he gave her the גט, before she was מזנה, just as the husband can be מחפה before the חכמים instituted זמן, by claiming she was divorced before the זנות, and even though he cannot prove it, nevertheless since we are not certain when the divorce took place, we cannot execute her מספק‎. תוספות offers his explanation why there is no חשש of חיפוי by גיטין הבאין ממדה"י: ואומר רבינו יצחק קלא אית להו כשרואין בזמן שזמן הכתיבה היא קודם המסירה‎ – And the ר"י explains that קלא אית להו means that when בי"ד sees the date, that the date of the כתיבה precedes the date of the מסירה‎ – אית ליה קלא למילתא ומסקי אדעתייהו לידע יום המסירה – This becomes publicized and they are determined to verify the יום המסירה‎ – תוספות asks: ואם תאמר ובההוא למה תיקנו זמן – And if you will say; and in this type of גט, which comes ממדה"י why did the חכמים institute זמן (according to the view of שמא יחפה) – תוספות answers: ויש לומר על ידי הזמן יש לו קול לפי שרואים על ידי הזמן שבו שהנתינה אינה ביום הכתיבה- And one can say; it is publicized that the יום הכתיבה precedes the יום הנתינה, only through the זמן which is written in the גט; because they realize on account of the written זמן that it was not given on the day it was written. תוספות asks (a general question): ואם תאמר ומאן דאמר משום בת אחותו בזמן הזה למה כותבין זמן בגיטין – And if you will say; and according to the one who maintains that they were מתקן זמן בגיטין because of the concern of שמא יחפה על בת אחותו, why do we write זמן בגיטין nowadays (when there is no דין מיתה, so no concern of שמא יחפה) – דאפילו בזמן הזה משמע דבעי זמן כדתנן (לקמן דף פו, א) ג' גיטין פסולים – For it appears that even nowadays זמן is required, as we learnt in a משנה that there are three גיטין פסולין and one of them is אין בו זמן‎. תוספות answers: ויש לומר גזירה שמא יחפה על בניה ממזרים – And one can say that there is a גזירה that perhaps he will be מחפה on her children who are ממזרים‎. תוספות offers another answer: אי נמי מהרה יבנה בית המקדש‎ – Or you may also say; the ביהמ"ק will be speedily rebuilt (and all the laws will return including the ד' מיתות), therefore in order not to forget the תקנה of זמן we institute it now as well. תוספות offers a final answer: אי נמי שלא יאמרו זינתה אחר גירושין ויחזירנה – Or you may also say; we write זמן nowadays in order that people should not presume that she was מזנה after the גירושין and he will remarry her – דגרושה שזינתה מותרת לחזור כדאמרינן בפרק ב' דסוטה (דף יח, ב): For a divorcee who was מזנה is permitted to return to her previous husband, as the גמרא states in the second פרק of מסכת סוטה‎. S UMMARY גיטין הבאין ממדה"י are כשר for since בי"ד is aware (by the זמן הכתיבה) that this is a predated גט, they will determine when the יום הנתינה is. We write זמן nowadays, to prevent ממזרים בקהל, or מהרה יבנה ביהמ"ק or to prevent a remarriage to an א"א שזינתה‎. T HINKING IT OVER 1. תוספות proves that nowadays there is a requirement for זמן בגיטין from the משנה of ג' גיטין וכו'. Perhaps that משנה (as many other משניות in קדשים וכו') is discussing a previous time when they meted out מיתת בי"ד‎?! 2. תוספות previously stated that if there is a חשש of איסור עולמית, then even ר"ל agrees that we are concerned for זנות‎. According to תוספות last answer of יחזירנה, that is an איסור עולמית, why does not ר"ל agree with ר"י‎?! 3. Why did ר"י chose the reason of שמא יחפה על בת אחותו, why not use one of the reasons תוספות gave; either because יחפה על בניה ממזרים or יחזירנה לאחר גירושין‎?

השולח גט לאשתו כולי ולגט ישן אין חוששין‎—One who sends a גט to his wife, etc. and we are not concerned for an ‘old’ גט O VERVIEW The ברייתא states if one sent a גט to his wife and it took the שליח three months to deliver it to her, she is (nonetheless) required to wait an additional three months to remarry, and (continues the ברייתא) we are not concerned for a גט ישן‎. Our תוספות clarifies why the ברייתא adds ולגט ישן אין חוששין, which seems out of context. ------------------------ פירוש אף על פי שצריכה להמתין שלשה חדשים‎ – The explanation of this ברייתא is that even though she is required to wait three months before she may remarry, however the reason for this waiting – לאו משום דחיישינן שמא בתוך כך יבא עליה דהא לגט ישן אין חוששין – Is not because we are concerned that perhaps in the duration, the husband had relations with her, because we are not concerned for a גט ישן‎ – אלא כדאמרינן לעיל שמא יאמרו שתי נשים בחצר כולי: But rather the reason she is required to wait the three months, is as the גמרא stated previously that we are concerned that perhaps people will say, ‘two women in one courtyard’, etc. S UMMARY The reason she waits three months is not because of גט ישן, but rather because people might wonder that שתי נשים בחצר כו'. T HINKING IT OVER Why would we think that she has to wait three months because of גט ישן‎?

המשליש גט לאשתו‎—One who places in escrow a גט for his wife O VERVIEW The גמרא cited two ברייתות one regarding השולח גט לאשתו which supports the view of רב that the three month waiting period begins משעת נתינה, and the other ברייתא of המשליש גט לאשתו, which supports the view of שמואל that they begin משעת כתיבה‎. There is a disagreement between רש"י and תוספות regarding the case of המשליש גט לאשתו (where she is not required to wait) as to the whereabouts of the husband. --------------------- פירש בקונטרס והוא הלך לדרכו – רש"י explained, and the husband went on his way (he was not with his wife) – ובחנם פירש כן אלא מיירי אפילו הוא בעיר‎ – And it was unnecessary for רש"י to explain it thus, but rather the ברייתא is discussing a case even where the husband is in the same city as his wife – תוספות responds to an anticipated difficulty: ונקט הך ברייתא המשליש לרבותא דאף על פי שהוא בעיר – And this ברייתא mentions המשליש (and not השולח, which would indicate that he is elsewhere), to teach us a novelty that even though the husband is in the same city, nevertheless – מותרת לינשא מיד ואין חוששים לגט ישן – She is permitted to marry immediately for we are not concerned for a גט ישן‎ – ולעיל נקט השולח לרבותא דאף על פי שאינו בעיר צריכה להמתין שלשה חדשים: And previously the other ברייתא mentioned השולח to teach us the novelty that even though the husband is not in the same city (so there is certainly no חשש of גט ישן) ; nevertheless, she is obligated to wait three months (because יאמרו ב' נשים וכו', as the גמרא stated previously). S UMMARY We are never concerned that perhaps it is a גט ישן, T HINKING IT OVER According to תוספות that the חידוש of המשליש is that even though he is in the city we are not חושש for a גט ישן, why did the ברייתא need to teach it by המשליש, it could have taught us the same חידוש in a case where the husband wrote the גט and held it for three months before being מגרש with it (without a משליש)?

מאימתי כתובה משמטת‎—From when is a כתובה released O VERVIEW The laws of שמיטת כספים do not apply to a כתובה‎. However, if the woman made a partial collection (פגמה) and placed the remainder as a loan (זקפה) owed to her by her husband or his heirs, then שמיטה is משמטת‎. According to שמואל it is משמטת if either פגמה or זקפה‎. Our תוספות applies this to resolve another ruling. תנאי כתובה ככתובה דמי לשביעית – Regarding that which ר' איבו אמר ר' ינאי stated in the beginning of פרק אע"פ, that a תנאי כתובה is like a כתובה for (many things including) שביעית‎ – קשה לרבינו יצחק מאי איריא דאין תוספת כתובה משמטת – The ר"י has a difficulty with this statement, why is it necessary to teach us that the תוספות כתובה is not משמטת‎ – משום דתנאי כתובה ככתובה דמי והוי כמעשה בית דין – Because a תנאי כתובה is like a כתובה, so it is like a מעשה בי"ד, this is not necessary – תיפוק ליה דלא משמט כתובה ותוספת מידי דהוה אשכר שכיר והקפת החנות – We can derive that כתובה and תוספות כתובה is not משמט because they are similar to the wages of an employee and credit in a store – דאיכא מאן דאמר במסכת שביעית (פרק י' משנה א') דלא משמט אלא מלוה‎ – For there is one who maintains in מסכת שביעית that only a מלוה is משמט‎ – וכל שכן כתובה ותוספת – And certainly not כתובה and תוספות כתובה‎ – תוספות rejects a possible solution to the question: ודוחק לומר דאתיא כרבי יוסי דפליג התם ואמר דמשמט – And it is awkward to assume that the ruling regarding תנאי כתובה is according to ר"י who argues there and maintains that (things other than מלוה) are משמט‎. תוספות answers (and disagrees with רש"י there): ונראה לרבינו יצחק דהא דקאמר לשביעית היינו שפגמה וזקפה כתובה לרב‎ – And it is the view of the ר"י that when the גמרא said there לשביעית that means in a case of פגמה וזקפה according to רב‎ – או פגמה או זקפה לשמואל דמשמטת נמי תוספת: Or a case of either פגמה or זקפה according to שמואל; in those instances the תוספות is also משמטת‎. S UMMARY תנאי כתובה is not משמט because it is not a loan. If she is פוגם/זוקף the כתובה then even the תנאי כתובה is משמט‎. T HINKING IT OVER 1. What would be if פגמה וזקפה the תנאי כתובה, would the כתובה be משמטת‎? 2. According to שמואל (who maintains that זקפה alone is משמט), if she was זקפה only part of the כתובה (not the entire כתובה), seemingly שביעית would be משמט only the part that was זקפה (not the rest), therefore (even) if she was זקפה the entire כתובה, why should it affect the תנאי כתובה‎?

אונס קנס ופתוי‎—Assault, fine and seduction O VERVIEW The ברייתא mentions three things, אונס קנס ופתוי, that שביעית is not משמט (if לא זקפן עליו במלוה). תוספות explains what קנס is referring to, for seemingly there is קנס by אונס ומפתה as well. --------------------- קנס הוא מוציא שם רע ומשום דלית ביה אלא קנס קרי ליה קנס‎ – קנס refers to the case of a מוציא שם רע, and since he is only liable for קנס (there is no additional liability), therefore it is called קנס‎ – אבל באונס יש בו בושת ופגם: However by אונס there is the liability of shame and depreciation, besides the קנס, therefore it is referred to merely as אונס (and not as קנס). S UMMARY A מוצש"ר pays only קנס, while a מאנס pays קנס as well as בושת ופגם‎. T HINKING IT OVER 1. Why did not the ברייתא state מוציא שם רע explicitly as it states אונס ופתוי‎? 2. Is שביעית משמט the בושת ופגם or does it have the same rule as the קנס‎?

מה מעשה בית דין נכתב ביום כולי‎—Just as מעשה בי"ד is written by day, etc. O VERVIEW מעשה בי"ד may be written by day and signed by night and are כשר, not like other שטרות that need to be signed on the day (date) it was written. תוספות explains why מעשה בי"ד is different. ---------------------- The reason מעשה בי"ד is כשר even if נכתב ביום ונחתם בלילה is – דמשעת פסק דין איכא קלא כמו בשטר כדאמרינן בכל דוכתא כשעמד בדין דגבי ממשעבדי: Because from the moment the ruling is issued by בי"ד it is publicized, just as if it was written and signed in a שטר (where there is a קול), as the גמרא states continually that once the creditor won his case in בי"ד, he can collect from משעבדי from that point onward, because once בי"ד gave a ruling there is a קול‎. S UMMARY A פסק דין creates a קול (without witnesses or the בי"ד signing it). T HINKING IT OVER תוספות explains that the reason מעשה בי"ד are נכתבין ביום and נחתמין בלילה because there is a קול from the time of the פס"ד. If indeed it is so, so why limit it to נחתמין בלילה, it can be (written and) signed any time after the פס"ד‎?!

אף כתובה נכתבת ביום ונחתמת בלילה‎—A כתובה may also be written by day and signed at night O VERVIEW שמואל rules that just as a מעשה בי"ד can be נכתב ביום ונחתם בלילה, so too a כתובה can also be נכתב ביום ונחתם בלילה‎. Our תוספות qualifies this ruling somewhat. ---------------------------- יש מקומות שנוהגין לכתוב הכתובה בערב שבת ולחותמה במוצאי שבת‎ – There are places where the custom is to write the כתובה on ערב שבת (when the אירוסין ונשואין take place) and to sign it מוצ"ש – תוספות is not pleased with this custom: ואין נכון לעשות כן משום תוספת דדלמא לית ליה קלא – And it is not proper to do so, on account of the תוספות כתובה; for perhaps that has no קול‎ – תוספות qualifies his concern: ומיהו היכא דקנו מיניה ליכא למיחש מידי – However, where the עדים were קונה from the חתן at the time of the wedding (that he obligates himself for the [כתובה and] תוספות כתובה), there is nothing to be concerned about (if it is written on ע"ש and signed on מוצ"ש) – כדאמרינן בבבא בתרא (דף קעב, א) אי ידעיתו יומא דאקניתו ביה כתובו יומא דאקניתו ביה: As רבא(ה) בר שילא said in מסכת ב"ב, ‘if you know on which day you made the קנין, write in the שטר אקנייתא that date on which you made the קנין’. S UMMARY Whenever there is a קנין בעדים, there is a קול; but not otherwise. T HINKING IT OVER 1. What are the respective explanations of רש"י ותוס' why a כתובה may be נכתבת ביום ונחתמת בלילה‎? 2. Does תוספות rule like שמואל (that כתובה נכתבת ביום ונחתמת בלילה) or not?

אבל עסוקין באותו ענין כשר‎—However if they are discussing the same topic, it is כשר O VERVIEW The ברייתא rules that שטרות, which are נכתבים ביום ונחתמים בלילה, are כשר, provided that the people were עסוקין באותו ענין from the time of כתיבה until the time of חתימה‎. ---------------------- דאית ליה קלא כאילו חתמו כיון שהם מזומנים לחתום כדפרישית לעיל: For since the עדים are prepared to sign, there is already a קול as if they signed, as I explained previously. S UMMARY עסוקין באותו ענין is כשר because there is a קול (before the חתימה). T HINKING IT OVER Is this rule of עסוקין באותו ענין referring to גיטין, כתובות, שאר שטרות or to all (or some) of the above?
