    English translation — Gittin 12a

    Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

    1Perhaps that is not so. Perhaps this is not the point of dispute between Rabbi Eliezer and the Rabbis. There are two ways to explain why this might not be the case. First, it is possible that Rabbi Eliezer states his opinion only there, when the person took possession of the pe’a despite not being eligible to collect it for himself, since if the one who collected the produce desired, he could declare his property ownerless and become a poor person, and then the produce would have been fit for him to retain for himself. And since he could have acquired the pe’a for himself, he can likewise acquire it for another as well. However, here, where he seizes property on behalf of a creditor, he cannot seize this property for himself. Consequently, Rabbi Eliezer does not rule that he can do so when it is against the interests of another person.

    2Second, one can argue from the opposite perspective: The Rabbis state their opinion only there, that one cannot acquire on behalf of the poor person, as it is written: “The corner of your field you shall not reap and the gleaning of your harvest you shall not gather; for the poor you shall leave them” (Leviticus 23:22), and the Sages expounded this verse by reading it as though there were no break in the middle: You shall not gather for the poor, i.e., the poor person must collect the produce for himself. However, here, where one seizes property on behalf of a creditor, this verse does not apply, and therefore the Rabbis did not rule that the action of the third party is ineffective. Consequently, it is possible that the dispute between Rabbi Eliezer and the Rabbis is not with regard to the issue of whether one can seize property on behalf of a creditor in a case where it is to the detriment of others.

    3The Gemara asks: And as for Rabbi Eliezer, with regard to this verse: “You shall not gather,” what does he do with it? How does he interpret this phrase, from which the Rabbis derived that one may not collect pe’a on behalf of a poor person? The Gemara answers: He requires it to warn a poor person with regard to his own field, i.e., if a poor person had a field of his own he is not permitted to gather pe’a from it for himself, his poverty notwithstanding.

    4§ The mishna taught: As, if the master wishes not to sustain his slave he is allowed to act accordingly. The Gemara comments: Conclude from the mishna that the master is legally able to say to his slave: Work for me but I will not sustain you.

    5The Gemara rejects this claim: This is not a conclusive proof, as with what are we dealing here, in the mishna? We are dealing with a case where he said to the slave: Spend your earnings to sustain yourself. In other words, I will not provide for you; rather, you must work and earn money for your sustenance on your own. However, this does not mean that a master can force his slave to work for him without providing him with sustenance.

    6The Gemara asks: If so, in the corresponding situation in the mishna with regard to a wife, will one explain that he could have said to her: Spend your earnings to sustain yourself? The mishna rules that one cannot exempt himself from his obligation to provide sustenance for his wife. In the case of a wife, why may he not do so? It is certainly permitted for a husband to stipulate with his wife that she will keep her earnings and not receive sustenance from him, yet it is clear in the mishna that there is a difference between a slave and a wife with regard to his ability to refuse to provide sustenance. The Gemara answers: The wife mentioned in the mishna is one whose earnings are not sufficient for her sustenance, and in that case the husband may not stipulate in this manner.

    7The Gemara raises a difficulty: If so, the case of the slave also is referring to a situation where his earnings are not sufficient for his sustenance, and he is unable to sustain himself. Nevertheless, his master can refuse to sustain him. Therefore, one can conclude from the mishna that a master can say to his slave: Work for me but I will not sustain you. The Gemara explains: A slave who is not worth the bread that he consumes, for what is he needed by his master or his mistress? If the value of his labor does not even pay for the cost of his sustenance why is he needed at all? The mishna certainly does not refer to a case of this kind. By contrast, with regard to a wife, the marriage does not depend on her ability to provide for herself by means of her earnings. Consequently, one cannot prove from the mishna that a master can say to his slave: Work for me but I will not sustain you.

    8The Gemara suggests another proof: Come and hear a baraita ( Tosefta , Makkot 2:8): With regard to a slave who unintentionally killed someone and was exiled to one of the cities of refuge, his master is not required to sustain him. And not only that, but his earnings in his city of refuge belong to his master. Conclude from the baraita that a master can say to his slave: Work for me but I will not sustain you, as in the case of a slave exiled to a city of refuge the master is entitled to his earnings despite not providing for him. The Gemara answers: With what are we dealing here? With a case where the master said to him: Spend your earnings to sustain yourself.

    9The Gemara raises a difficulty: If so, if the master said this to the slave, then why do his earnings belong to his master? After all, his master stipulated that he should sustain himself. The Gemara answers: This halakha is referring to his surplus earnings, i.e., if the slave works and earns more than the cost of his sustenance, his surplus income belongs to the master.

    10The Gemara asks: Isn’t it obvious that any surplus belongs to the master, as he owns the slave? The Gemara answers: This ruling is necessary, lest you say that since, when he does not work enough the master does not give him all he needs to eat, then when he has a surplus from his work the master should also not take it. Therefore, the baraita teaches us that despite this consideration the surplus belongs to the master.

    11The Gemara asks: And what is different with regard to a slave who was exiled to one of the cities of refuge, concerning whom the baraita was stated? According to this reasoning, the surplus should belong to the master no matter where the slave is located. The Gemara answers: It might enter your mind to say that as the verse states with regard to one who is exiled to a city of refuge: “And that fleeing to one of these cities he might live” (Deuteronomy 4:42), one should act for him so that he has extra life, i.e., in this specific case the slave should be allowed to retain any additional amount he earns. Therefore, the baraita teaches us that no special obligation of this kind applies even if the slave had been exiled to a city of refuge.

    12The Gemara raises another difficulty: But from the fact that the latter clause of that baraita teaches: However, with regard to a woman who was exiled to one of the cities of refuge, her husband is obligated in her sustenance, by inference the baraita is dealing with a case where he did not say to her: Spend your earnings to sustain yourself, which is why he must sustain her. As, if he said this to her, why is her husband obligated to provide her with sustenance?

    13And from the fact that the latter clause of the baraita is speaking about a case where he did not say this to her, it may be inferred that the first clause is also dealing with a situation where he did not say to the slave: Spend your earnings to sustain yourself. The two clauses of the baraita must be referring to similar cases or they would not be taught together.

    14The Gemara rejects this claim: Actually, the baraita is referring to a case where the master said to the slave: Spend your earnings to sustain yourself, and the husband issued a similar statement to his wife. However, in the case of a woman it is referring to a situation when her earnings are not sufficient for her sustenance.

    15The Gemara raises an objection: But from the fact that the last clause teaches: And if the husband said to her: Spend your earnings to sustain yourself, he is permitted to act accordingly, it may be inferred that the first half of the last clause is referring to a case where he did not say this to her. The Gemara explains that this is what the baraita is saying: And if her earnings suffice to pay for her sustenance, and he said to her: Spend your earnings to sustain yourself, it is permitted for him to say that.

    16The Gemara asks: If the baraita is referring to a case where her earnings suffice, what is the purpose of stating this halakha with regard to one who was exiled to a city of refuge? The same halakha applies to all wives. The Gemara answers: It is necessary, lest you say that in light of the verse: “All glorious is the king’s daughter within the palace” (Psalms 45:14), from which it is derived that it is improper for a wife to spend too much time outside her home, this woman’s husband should be concerned that while his wife is in a city of refuge she should not work out of the home, but only in the home. Therefore, the baraita teaches us that there is no need to be concerned about this matter, and her husband may say to her: Spend your earnings to sustain yourself, even in a city of refuge.

    17With regard to the question of whether a master can decide to cease providing sustenance for his slave while the slave continues to serve him, the Gemara suggests: Let us say that this matter is the subject of a dispute between tanna’im , as it was taught that Rabban Shimon ben Gamliel says: A slave can say to his master in years of famine: Either sustain me from your property or emancipate me. And the Rabbis say: His master has permission to retain his ownership over him without sustaining him.

    18What, is it not correct to say that they disagree about this issue, that one Sage, the Rabbis, holds that a master can say to his slave that he should work for him and he will not sustain him. Consequently, he is not required to emancipate him even when he cannot provide for him. And one Sage, Rabban Shimon ben Gamliel, holds that the master cannot say this, and therefore he is required to free him.

    19The Gemara responds: And can you understand the dispute that way? If so, this expression: Either sustain me or emancipate me, is inaccurate, as the baraita should have said: Either sustain me or give me my earnings for my sustenance. And furthermore, if the dispute concerns this general issue, what is different about years of famine? The same dispute should apply in all years.

    20Rather, with what are we dealing here? This baraita is referring to a case where the master said to the slave: Spend your earnings to sustain yourself, and subsequently, during years of famine, the slave’s earnings do not suffice to provide himself with sustenance, as prices are higher than usual.

    21And Rabban Shimon ben Gamliel holds that in this case the slave can say to his master: Either sustain me or emancipate me, so that people will see me in my helpless state, and they will have mercy on me and provide me with charity. And the Rabbis hold that this is not a justification for emancipating a slave, as those who have mercy on freemen will also have mercy on a slave. Consequently, it is not necessary for the slave to be emancipated for him to receive help from generous people. According to this interpretation, the baraita has no bearing on the question as to whether a master can say to his slave: Work for me but I will not sustain you.

    22The Gemara offers another suggestion: Come and hear a proof from a statement that Rav said: In the case of one who consecrates the hands of his slave, so that all the work he does becomes Temple property, preventing the slave from working on his own behalf, then that slave borrows and eats, and afterward performs work and repays what he borrowed, as will be explained. Conclude from Rav’s statement that the master is able to say to his slave: Work for me but I will not sustain you. In this case the master has prevented his slave from working for himself, and yet he is not required to provide for him.

    23The Gemara answers: With what are we dealing here? This is referring to a case where the master provides sustenance for him. The Gemara raises a difficulty: If so, for what reason

    Do for mework, but I will not sustain you; rather, circulate about the entryways [to beg for food].

    A case in which [her earnings] are not sufficientto sustain herself with her earnings, and [the husband] must add from his own [funds].

    And [the Gemara] asks[the case of] a slave also [is referring to a situation where his earnings] are not sufficient. And [the Gemara] answers: A slave who is not worth the bread of his stomach - a slave who is not worth the bread that he consumes.

    For what is he needed by..his master - therefore, [the master] does not add from his own funds; rather, [the slave] should circulate by the entryways, since who will force [the master] to sustain him and incur a loss? But as for a woman, he agreed to the following stipulation in her ketuba: "You will sit in my house and be sustained from my property." [Ketubot 4:12].

    Withinshe is modest, and is not accustomed to go out and circulate around a city that she doesn't come from. People do not know her [and therefore don't know] to bring her work at her home; rather, she has to circulate around the city in order to find work in order to make a profit.

    דילמא לא היא‎—Perhaps it is not so O VERVIEW רב חסדא stated that the argument between ר"א ורבנן regarding פאה is whether we maintain התופס לבע"ח במקום שחב לאחרים קנה (the view of ר"א), or not (the view of the רבנן). רב פפא rejected this interpretation and said that it is possible that the argument between ר"א ורבנן is regarding other issues; not תופס לבע"ח. Our תוספות qualifies the seriousness of sרב פפא' rejection. ------------------------ דחויא בעלמא היא‎ – This ( rejection of רב חסדא by רב פפא) was a mere rejoinder – דרב פפא אית ליה בהדיא תופס לבעל חוב במקום שחב לאחרים לא קנה (כתובות דף פד, ב): For רב פפא explicitly maintains that התופס לב"ח במקום שחב לאחרים לא קנה‎. S UMMARY רב פפא maintains התופס לב"ח במקום שחב לאחרים לא קנה (agreeing with רב חסדא). T HINKING IT OVER In the case of פאה there is the concept of מגו דזכי לנפשיה זכי נמי לחבריה‎. ר' יוחנן who maintains that התופס לב"ח וכו' לא קנה agrees that המגביה מציאה לחבירו קנה since מגו דזכי לנפשיה וכו'. When רב חסדא stated that the מחלוקת by פאה is dependent on התופס לב"ח, it turns out that the חכמים who maintain by פאה (where there is a מגו דזכי וכו') that לא קנה will also maintains that המגביה מציאה לחבירו is also לא קנה (since they do not say מגו דזכי לנפשיה וכו'). This is what רב פפא challenges, that even ר' אליעזר maintains התופס לב"ח לא קנה, and here he is קונה since there is a מגו, and similarly the רבנן, even though there is a מגו by פאה, nevertheless he is not קונה since there is a פסוק‎. However, all agree that התופס לב"ח לא קנה and המגביה מציאה לחבירו קנה‎! What is תוספות question?!

    אלא דכתיב לא תלקט לעני‎—Only because it states; do not gather for the poor O VERVIEW רב פפא explained that (it is possible) the reason the רבנן maintain יתננה לעני הנמצא ראשון (is not because of התופס לב"ח וכו'), but rather there is a פסוק which states לא תלקט לעני, indicating that it is forbidden to gather פאה for the עני‎. Our תוספות explains how this translates to the inability of the עני to acquire it. ---------------------- תוספות asks: ואם תאמר למאן דאמר בפרק קמא דתמורה (דף ד, ב) – And if you will say; according to the one who maintains in the first פרק of מסכת תמורה, regarding – כל מילתא דאמר רחמנא לא תעביד אי עביד מהני אם כן קנה העני – Anything which the ‘Merciful One’ orders not to do, if one transgressed and did it, the task is accomplished; if this is indeed so, the עני should acquire the פאה regardless that there is a prohibition to gather it for him. תוספות answers: ויש לומר דהכא בתר לא תלקט כתיב לעני ולגר תעזוב אותם משמע דלא קני‎ – And one can say; that here after the words of לא תלקט (from which we derive the prohibition for gathering for an עני), it is written in the תורה, ‘you should leave it for the poor and the convert’; indicating that (even) if one gathered for the עני, nonetheless the עני does not acquire it. תוספות asks: ואם תאמר ונילף מהכא בעלמא דהמגביה מציאה לחבירו דלא קנה חבירו – And if you will say; so let us derive from here that elsewhere (also) המגביה מציאה לחבירו לא קנה חבירו‎? תוספות answers: ויש לומר דהכא סברא הוא‎ – And one can say that here by פאה it is logical that the עני is not קונה‎ – שלא זכתה תורה לעני אלא מה שכל אחד מלקט לצורך עצמו – For the תורה limited the right of the עני to what each עני can gather for his own needs, however by מציאה where this סברא is not applicable, the ruling can be that המגביה מציאה לחבירו קנה חבירו – ולרב חסדא דמפרש הכא דטעמייהו דרבנן משום דתופס לבעל חוב לא קני‎ – However, according to רב חסדא who explains here that the reason of the רבנן (who maintain that the עני is not קונה) is because התופס לב"ח לא קני‎ – איכא למימר דמהכא יליף: We can indeed say that he derives from פאה, this rule that המגביה מציאה לחבירו לא קנה חבירו (and also the rule that התופס לב"ח במקום שחב לאחרים לא קנה). S UMMARY The עני does not acquire the פאה because of the repetition of לעני וגו' תעזב אתם‎. We can distinguish between פאה and מציאה regarding המגביה לחבירו‎. T HINKING IT OVER תוספות asks that even though one is not permitted to be מלקט for the עני, nevertheless the עני should be קונה according to the מ"ד of אי עביד מהני‎. Seemingly the one who is מלקט for the עני is זוכה for the עני מטעם שליחות, and by שליחות there is a rule that אין שליח לדבר עבירה, so therefore the שליחות is בטל and the עני cannot be קונה‎!

    עבד נמי בדלא ספיק‎—A slave also; when it is not sufficient O VERVIEW The גמרא states that there is a difference between a wife and a slave where the husband and master told them each respectively, ‘go support yourself with your handiwork’. Regarding a wife if her handiwork is insufficient to support herself, the husband is obligated to make up the difference; however by a slave, the גמרא concluded, the master is not obligated to make up the difference. תוספות clarifies why the גמרא initially thought the master would be obligated to feed the slave if he told him צא מעשה ידיך למזונותיך‎. ---------------------- תוספות asks: ואם תאמר אטו משום דלא ספיק יהא רבו חייב לזונו‎ – And if you will say; is it indeed so, that because the slave cannot earn sufficiently to support himself, his master should be obligated to feed him?! ולא יוכל לומר לו צא מעשה ידיך במזונותיך – And the master cannot tell the slave, ‘ spend your handiwork for your food’?! תוספות asks an additional question: ועוד קשה הלשון דקאמר עבדא דנהום כריסיה לא שוי – And furthermore the expression which the גמרא uses, namely ‘a slave who is not worth the bread of his stomach is not worth that his master should keep him ’, this expression is difficult – הוה ליה למימר בהדיא דלא מחייב לזונו‎ – The גמרא should have stated clearly that the master is not obligated to feed the slave – כיון דאמר ליה צא מעשה ידיך במזונותיך‎ – Since the master told him, צא מעשה ידיך במזונותיך‎! תוספות answers: ואומר רבינו יצחק דסלקא דעתיה דרגילות הוא שעבד עצמו הולך ועובד את רבו‎ – And the ר"י answers, that the גמרא initially assumed that (since) it is usual for a slave to work for his master – אפילו כשאמר ליה צא מעשה ידיך במזונותיך – Even if the master told him, צא מעשה ידיך במזונותיך‎ – משום הכי בעי למימר (אף על גב) דלא ספיק שיתחייב במזונות‎ – Therefore the גמרא assumed that the master should be responsible to feed the עבד (even) in a case where his work is insufficient to support himself – כיון שמכל מקום עובדו‎ – Since nonetheless the עבד is working for him – משום הכי מהדר ליה בלשון זה עבדא דנהום כריסיה לא שוי כולי – Therefore the גמרא responded with this expression 'עבדא דנהום כריסיה לא שוי, etc. instead of saying ‘but he told him צא מעשה ידיך במזונותיך’. תוספות explains that according to the abovementioned, another difficulty will be resolved: ולהכי קאמר לעיל שמע מינה יכול הרב לומר לעבד עשה עמי ואיני זנך – And therefore the גמרא said previously, we derive from the משנה, that the master can say, ‘work for me, but I will not feed you’ – דאפילו מיירי דאמר ליה צא מעשה ידיך במזונותיך‎ – For even if the משנה is discussing a case where the master said צא מעשה ידיך במזונותיך‎ – מכל מקום כיון שעובדו היה לו להתחייב במזונותיו אי לאו משום דיכול‎ – Nevertheless the גמרא assumed in the ס"ד that since the slave is working for the master, the master should be obligated to feed him, unless we assume that because the master can tell him עשה עמי ואיני זנך‎. תוספות offers an alternate explanation to the last question: ועוד דסלקא דעתיה דמיירי בלא אמר ליה דומיא דאשה דבדלא ספיק לא שכיח: And an additional explanation is that the גמרא assumed that the משנה is discussing a case where the master did not tell the slave צא מעשה ידיך במזונותיך (and nevertheless he is not obligated to feed him) just as by a woman (where the גמרא also assumed that we are not discussing a case where he told her צאי מעשה ידיך במזונותיך); the reason for this assumption is that it is not common that a person’s work should not be sufficient to sustain him. S UMMARY The מקשן assumed that (even if the master said צא מעשה ידיך במזונותיך) that he is obligated to feed his slave if the slave works for him (unless we maintain that the master can say עשה עמי ואיני זנך). T HINKING IT OVER Initially the גמרא assumed that in a case where the אדון told the slave צא מעשה ידיך במזונותיך, but the עבד continues to work for the אדון, the אדון is חייב במזונות even if the work of the עבד is insufficient to cover the cost of מזונות‎. The conclusion is that if the work of the עבד is insufficient, the אדון is פטור from מזונות (if he told him צא מעשה ידיך וכו'). What are the respective סברות of the הו"א and מסקנא of the גמרא‎?

    מאי שנא לערי מקלט‎—Why are cities of refuge different O VERVIEW The גמרא cited a ברייתא which states that the master is not obligated to feed his slave who was exiled to the ערי מקלט, however the מעשה ידיו of that slave belongs to the master; proving that the master can tell the slave עשה עמי ואיני זנך‎. The גמרא rejects this proof saying that we are discussing a case where the master said צא מעשה ידיך במזונותיך, and when the ברייתא states that the מעשה ידיו belong to the master that is referring to the extra מעשה ידיו, that is more than his need for food. The גמרא then asks so why mention ערי מקלט, this rule applies everywhere. תוספות explains that if we would maintain יכול האדון לומר עשה עמי ואיני זנך, then it would be understood why ערי מקלט is mentioned. ----------------------- פירוש אי אמרת בשלמא יכול‎ – The explanation of the question (מ"ש לערי מקלט) is as follows: if we assume that יכול הרב לומר לעבד עשה עמי ואיני זנך then it is understood why the ברייתא‎ – אשמועינן ערי מקלט דאף על גב דאמר רחמנא וחי עביד ליה חיותא טפי‎ – Teaches us this rule (of עשה עמי וכו') by ערי מקלט; for even though the ‘Merciful One’ writes regarding one who is in an עיר מקלט that 'וחי', meaning that you should give him more sustenance which would therefore lead us to assume that in an עיר מקלט the master cannot tell his slave עשה עמי וכו', the ברייתא teaches us that – אפילו הכי יכול הרב לומר כולי‎ – Nevertheless the master can say, etc. עשה עמי ואיני זנך‎ – אבל לענין העדפה לא משמע ליה דמשום וחי תיהוי העדפה דידיה: However if we assume that the master cannot say עשה עמי וכו', and we are merely discussing the העדפה, it does not seem to the מקשן regarding העדפה, that on account of 'וחי' the העדפה should belong to the slave, therefore there is no חידוש by עיר מקלט‎. S UMMARY The difference between the מקשן and the תרצן is whether we may have assumed that the פסוק of וחי teaches that the העדפה (in an עיר מקלט) belongs to the slave (the תרצן), or not (the מקשן). T HINKING IT OVER The תרצן assumes that (without the ברייתא) we would have (mistakenly) derived from 'וחי', that the העדפה should belong to the עבד‎. When the גמרא previously asked that it is פשיטא that the העדפה belongs to the master, why did not the גמרא answer that it is not פשיטא at all, since the פסוק 'וחי' may teach us that even the העדפה belongs to the עבד (as the גמרא subsequently answered regarding ערי מקלט)?!

    מספקת מאי למימרא כולי‎—Why say it, if it is sufficient, etcO VERVIEW The גמרא cites the סיפא of the ברייתא regarding ערי מקלט, that by a woman who is exiled to ערי מקלט, the husband is obligated to feed her; indicating that the ברייתא is discussing a case where צא מעשה ידיך וכו' was not said (neither by the husband not by the master). The גמרא rejects this and maintains that the ברייתא is discussing where the husband said צאי מעשה ידיך and if it is insufficient, then the husband must feed her; however if her מעשה ידיה is sufficient then he is not obligated to feed her. The גמרא then asks, if her מעשה ידיה is sufficient then it is obvious that he need not feed her; what is the ברייתא teaching us? תוספות explains why this question is only if we assume that the רישא (of the סיפא) is a case of לא ספקה, but if we assume that in all cases it is ספקה, there will be no question. ----------------------- אי אמרת בשלמא כולה בדספקא – The ברייתא will be properly understood if we assume that the entire ברייתא is in a case of ספקא, for then we can say that the ברייתא – תנא סיפא דאמר לה לגלויי ארישא דאיירי בלא אמר לה‎ – Taught us the סיפא (דסיפא) that (when) he told her צאי מעשה ידיך וכו' (he does not have to support her), the purpose of this ruling is to reveal that the רישא (דסיפא) where it states that בעלה חייב במזונותיה is in a case where he did not say to her צאי מעשה ידיך וכו' – אבל השתא דמוקמת רישא בדלא ספקא – However, now that you have established the רישא in a case of לא ספקא‎ – ולא תנא הך סיפא אלא לאשמועינן‎ – And therefore the סיפא was merely taught to inform us – דבמספקת יכול לומר לה צאי מעשה ידיך במזונותיך‎ – That by מספקת he can tell her צאי מעשה ידיך במזונותיך, then the question arises- מאי למימרא דזה אינו שום חידוש: What is this teaching us ; for there is no novelty at all in this ruling?! S UMMARY There is a purpose in stating an obvious ruling if we can infer from this ruling a novelty regarding another ruling. T HINKING IT OVER 1. תוספות explains the sגמרא' question, that if the רישא is by צאי וכו' and לא ספקה, then the סיפא is superfluous. Why can we not say that the סיפא teaches us that the רישא is בלא ספקא (just as תוספות says [according to the מקשן] that the סיפא teaches us that the רישא is בלא אמר צאי וכו')?! 2. תוספות could have said that if we would assume that יכול הרב לומר עשה וכו', then we could establish the סיפא דסיפא (where it says ואם אמר לה צאי וכו') that it is לא ספקה and nevertheless he is not obligated to make up the לא ספקה, since he can claim that מזלה גרמה that she was גולה, and the רישא דסיפא (where it states בעלה חייב וכו') is where he did not tell her צאי וכו', and he mentions the סיפא לגלויי ארישא, that עבד is also not discussing צא (proving that יכול הרב וכו'). The advantage of this explanation is that there is a חידוש (by the סיפא דסיפא) as opposed to תוספות explanation!

    ומר סבר אינו יכול‎—And this master maintains, he cannot O VERVIEW The גמרא initially assumed that the dispute whether the slave could tell his master during a hunger, ‘either feed me or set me free (the view of רשב"ג)’, or he cannot (the view of the חכמים), depends on whether the master can tell his slave, 'עשה עמי ואיני זנך' (the חכמים) or not (רשב"ג). Our תוספות clarifies the meaning of הוציאני לחירות‎. -------------------- והא דקתני או הוציאני לחירות לאו דוקא – And that which the ברייתא teaches that the slave can say, ‘ or set me free’, it does not mean precisely that the slave can demand to be set free – אלא כלומר שיהיה מעשה ידי לעצמי כמו לבן חורין: Rather the ברייתא means to say that the עבד has the right to demand that my handiwork should belong to me just like a free man. S UMMARY הוציאני לחירות merely means that the עבד retains the right to מעשה ידיו‎. T HINKING IT OVER 1. Seemingly this which תוספות wishes to clarify (regarding הוציאני לחירות) is discussed immediately in the גמרא; what is תוספות concern (or alternately [if we accept תוספות explanation], what is the גמרא asking later)?! 2. Why did not תוספות attempt to explain the necessity of mentioning 'שנת בצורת' according to the הו"א, just as he explained 'הוציאני לחירות' according to the הו"א‎?

    כי היכי דחזו אינשי ומרחמי‎—In order that people will see and have mercy O VERVIEW The גמרא explains that the dispute between רשב"ג ורבנן whether the עבד can demand from his master (in a hunger year) או פרנסני או הוציאני לחירות, depends on whether people are as merciful for slaves as for freemen (רבנן), or not (רשב"ג). תוספות explains how this גמרא does not contradict another which seemingly indicates that רשב"ג ורבנן maintain the exact opposite. --------------------- הקשה הרב רבינו יצחק בן הרב רבינו מאיר דבפרק השולח (לקמן דף לז, ב) – The ריב"ם asked that in פרק השולח‎ – גבי עבד שנשבה ופדאו ישראל אחר שמעינן להו איפכא‎ – Regarding a slave who was captured and another Jew redeemed him; we find that רשב"ג and the חכמים maintain there the opposite of what they maintain here – דקא אמרי רבנן לא ישתעבד לא לרבו ראשון ולא לרבו שני‎ – For there the רבנן rule that this slave shall not be indentured not to the first master (who owned him originally [when he was taken captive]) and not to his second master (the ישראל who redeemed him). אביי explains the ruling – לרבו שני לא דהא לשם בן חורין פרקיה‎ – The second master shall not enslave him, because the second ישראל redeemed him to become a free man (and not to keep him as a slave) – לרבו ראשון לא דלמא מימנעי ולא פרקי – The first master cannot enslave him, because perhaps people will be reluctant to redeem the slave from captivity if they know he will return to be a slave. This is the view of the רבנן‎ – ורבן שמעון בן גמליאל סבר כשם שמצוה לפדות בני חורין כן מצוה לפדות את העבדים- רשב"ג maintains that just as it is a מצוה to redeem free men, so too is there a מצוה to redeem the slaves, therefore even if he remains a slave by רבו ראשון, this will not deter people from redeeming slaves. תוספות answers: ואומר רבינו יצחק דרבן שמעון בן גמליאל סבר דלענין פדיון פרקי ליה טפי‎ – And the ר"י answers that רשב"ג maintains that regarding פדיון, people will be more apt to redeem an עבד (than feed him) in order – שלא יטמע בין העובדי כוכבים – That he should not become intermingled (assimilated) between the עכו"ם- ורבנן סברי דלענין מזונות מרחמי עליה טפי שלא ימות ברעב – While the רבנן maintain that regarding food, people will be more merciful on the עבד (than redeeming him), in order that he should not die from hunger – וגם כל אחד יתן לו מעט לחם אבל בפדיון צריך הרבה ביחד: And also (it is easier to feed him, because) each one needs to give the עבד only a little bread to sustain him, however regarding redeeming an עבד, much (money) is necessary at one time, which people may not have. S UMMARY On one hand it is more apt to save someone from assimilation than to worry about his sustenance (רשב"ג); on the other hand one is more concerned for dying from hunger than a possible assimilation, especially since feeding is less expensive than redeeming (רבנן). T HINKING IT OVER It appears from תוספות that according to the רבנן, people will give for hunger quicker than for פדיון שבויים‎. However the גמרא in ב"ב ח, ב states that captivity is worse than the others (including hunger) for in captivity one suffers from hunger as well. How can we reconcile תוספות with that גמרא‎?

    אמר רב המקדיש ידי עבדו‎—רב said one who sanctifies the hands of his slave O VERVIEW The גמרא cites a ruling of רב; if a master is מקדיש the hands of his slave, the rule is that anything which the slave accomplishes (with his hands) belongs to הקדש (and therefore appropriate steps need to be taken). תוספות first insists that the proper גירסא is המקדיש ידי עבדו (not המקדיש עבדו). תוספות then discusses the rule if one is מקדיש עבדו‎. ----------------------- גרסינן ולא גרסינן המקדיש עבדו דהתם יצא לחירות‎ – The text reads המקדיש ידי עבדו; however, the text does not read המקדיש עבדו (one who sanctifies his slave), for in that case, the slave is freed – כדאמר רב בהשולח (לקמן דף לח, ב) דליהוי עם קדוש קאמר – As רב ruled in פרק השולח, that when the master states that he is מקדיש עבדו, he means that the slave should be freed and become part of the ‘holy nation’. תוספות asks: ואם תאמר וכי היכי דמקדיש ידי עבדו אמרינן דהן קדושים למלאכתן‎ – And if you will say; that just as when one is מקדיש the hands of his slave, we say that they become holy regarding their work (that the work that he does with his hands belong to הקדש) – הכי נמי כשהקדיש כל עבדו הוה לן למימר שהקדישו למלאכתו‎ – Similarly we should also say, that when he is מקדיש the entire עבד, he is מקדיש every aspect of the עבד for its work, this means – פיו לדבורו ידיו למעשהו רגליו להילוכו – The mouth of the עבד is הקדש, regarding his speech, his hands are הקדש regarding what he does, his feet are הקדש regarding his walking – דבענין זה חשיב הקדש כדאמרינן בסוף פרק קמא דנדרים (דף יג, ב) – For being מקדיש in such a manner is considered a valid הקדש as the גמרא states in the end of the first פרק of מסכת נדרים‎. תוספות answers: ואומר רבינו יצחק דסברא הוא דלא נתכוין להקדישו למלאכתו‎ – And the ר"י answers that it is logical to assume that the master had no intention to be מקדיש the עבד for his work (that all his work should be הקדש) – לפי שיש חילוק במלאכתו שאין פיו ידיו ורגליו שוין במלאכתן‎ – Since there is a difference in his work; for his mouth, his hands and his feet are not equal in their work (they all do different types of work) – הלכך אית לן למימר דלשחררו נתכוין דהוי הכל בענין אחד – Therefore we rather assume that he intended to free him (when he was מקדיש the עבד) for then it is all in one context (the entire עבד is equally freed). תוספות offers a different distinction between המקדיש ידי עבדו (where his מעשה ידיו become הקדש) and המקדיש עבדו (where the עבד is freed): אי נמי יש לומר התם כשמקדיש עבדו סתם משמע יותר למיהוי עם קדוש‎ – Or you may also say; there when he is מקדיש his slave generally without being specific what he is מקדיש, it is more indicative that the master meant that the slave become an עם קדוש (by being freed) – דהא למלאכתו לא קאמר‎ – For the master did not mention that he is מקדיש him for his work – אבל מקדיש ידי עבדו הקדיש מלאכת ידיו דלא שייך למימר בענין אחר: However when he is מקדיש the hands of his slave (even though here too the master did not mention work, nevertheless), the master was certainly מקדיש his handiwork, for it cannot mean anything else! S UMMARY If one is מקדיש עבדו he becomes free and joins the עם קדוש; he does not become הקדש regarding his various actions, since the owner made only one general statement of הקדש and (in addition) he did not mention that he is מקדיש him for his work. T HINKING IT OVER תוספות second answer is that by מקדיש ידי עבדו, it cannot mean actual הקדש (for one cannot be מקדיש part of the עבד). However we know there is a rule of פשטה קידושי בכולה, that if one is מקדיש part of an animal, the קדושה spreads to the entire animal; let us say here as well that if he was מקדיש the ידים, they become actually הקדש and the קדושה spreads throughout the entire עבד, that he becomes completely הקדש‎!

    To his slave [his] Caananite [slave].

    Do for me work, but I will not sustain you; rather, circulate about the entryways [to beg for food].

    A case in which [her earnings] are not sufficient to sustain herself with her earnings, and [the husband] must add from his own [funds].

    And [the Gemara] asks [the case of] a slave also [is referring to a situation where his earnings] are not sufficient. And [the Gemara] answers: A slave who is not worth the bread of his stomach - a slave who is not worth the bread that he consumes.

    For what is he needed by.. his master - therefore, [the master] does not add from his own funds; rather, [the slave] should circulate by the entryways, since who will force [the master] to sustain him and incur a loss? But as for a woman, he agreed to the following stipulation in her ketuba: "You will sit in my house and be sustained from my property." [Ketubot 4:12].

    Within she is modest, and is not accustomed to go out and circulate around a city that she doesn't come from. People do not know her [and therefore don't know] to bring her work at her home; rather, she has to circulate around the city in order to find work in order to make a profit.

    דילמא לא היא‎—Perhaps it is not so O VERVIEW רב חסדא stated that the argument between ר"א ורבנן regarding פאה is whether we maintain התופס לבע"ח במקום שחב לאחרים קנה (the view of ר"א), or not (the view of the רבנן). רב פפא rejected this interpretation and said that it is possible that the argument between ר"א ורבנן is regarding other issues; not תופס לבע"ח. Our תוספות qualifies the seriousness of sרב פפא' rejection. ------------------------ דחויא בעלמא היא‎ – This ( rejection of רב חסדא by רב פפא) was a mere rejoinder – דרב פפא אית ליה בהדיא תופס לבעל חוב במקום שחב לאחרים לא קנה (כתובות דף פד, ב): For רב פפא explicitly maintains that התופס לב"ח במקום שחב לאחרים לא קנה‎. S UMMARY רב פפא maintains התופס לב"ח במקום שחב לאחרים לא קנה (agreeing with רב חסדא). When רב חסדא stated that the מחלוקת by פאה is dependent on התופס לב"ח, it turns out that the חכמים who maintain by פאה (where there is a מגו דזכי וכו') that לא קנה will also maintains that המגביה מציאה לחבירו is also לא קנה (since they do not say מגו דזכי לנפשיה וכו'). This is what רב פפא challenges, that even ר' אליעזר maintains התופס לב"ח לא קנה, and here he is קונה since there is a מגו, and similarly the רבנן, even though there is a מגו by פאה, nevertheless he is not קונה since there is a פסוק‎. However, all agree that התופס לב"ח לא קנה and המגביה מציאה לחבירו קנה‎! What is תוספות question?!

    אלא דכתיב לא תלקט לעני‎—Only because it states; do not gather for the poor O VERVIEW רב פפא explained that (it is possible) the reason the רבנן maintain יתננה לעני הנמצא ראשון (is not because of התופס לב"ח וכו'), but rather there is a פסוק which states לא תלקט לעני, indicating that it is forbidden to gather פאה for the עני‎. Our תוספות explains how this translates to the inability of the עני to acquire it. ---------------------- תוספות asks: ואם תאמר למאן דאמר בפרק קמא דתמורה (דף ד, ב) – And if you will say; according to the one who maintains in the first פרק of מסכת תמורה, regarding – כל מילתא דאמר רחמנא לא תעביד אי עביד מהני אם כן קנה העני – Anything which the ‘Merciful One’ orders not to do, if one transgressed and did it, the task is accomplished; if this is indeed so, the עני should acquire the פאה regardless that there is a prohibition to gather it for him. תוספות answers: ויש לומר דהכא בתר לא תלקט כתיב לעני ולגר תעזוב אותם משמע דלא קני‎ – And one can say; that here after the words of לא תלקט (from which we derive the prohibition for gathering for an עני), it is written in the תורה, ‘you should leave it for the poor and the convert’; indicating that (even) if one gathered for the עני, nonetheless the עני does not acquire it. תוספות asks: ואם תאמר ונילף מהכא בעלמא דהמגביה מציאה לחבירו דלא קנה חבירו – And if you will say; so let us derive from here that elsewhere (also) המגביה מציאה לחבירו לא קנה חבירו‎? תוספות answers: ויש לומר דהכא סברא הוא‎ – And one can say that here by פאה it is logical that the עני is not קונה‎ – שלא זכתה תורה לעני אלא מה שכל אחד מלקט לצורך עצמו – For the תורה limited the right of the עני to what each עני can gather for his own needs, however by מציאה where this סברא is not applicable, the ruling can be that המגביה מציאה לחבירו קנה חבירו – ולרב חסדא דמפרש הכא דטעמייהו דרבנן משום דתופס לבעל חוב לא קני‎ – However, according to רב חסדא who explains here that the reason of the רבנן (who maintain that the עני is not קונה) is because התופס לב"ח לא קני‎ – איכא למימר דמהכא יליף: We can indeed say that he derives from פאה, this rule that המגביה מציאה לחבירו לא קנה חבירו (and also the rule that התופס לב"ח במקום שחב לאחרים לא קנה). S UMMARY The עני does not acquire the פאה because of the repetition of לעני וגו' תעזב אתם‎. We can distinguish between פאה and מציאה regarding המגביה לחבירו‎. T HINKING IT OVER תוספות asks that even though one is not permitted to be מלקט for the עני, nevertheless the עני should be קונה according to the מ"ד of אי עביד מהני‎. Seemingly the one who is מלקט for the עני is זוכה for the עני מטעם שליחות, and by שליחות there is a rule that אין שליח לדבר עבירה, so therefore the שליחות is בטל and the עני cannot be קונה‎!

    עבד נמי בדלא ספיק‎—A slave also; when it is not sufficient O VERVIEW The גמרא states that there is a difference between a wife and a slave where the husband and master told them each respectively, ‘go support yourself with your handiwork’. Regarding a wife if her handiwork is insufficient to support herself, the husband is obligated to make up the difference; however by a slave, the גמרא concluded, the master is not obligated to make up the difference. תוספות clarifies why the גמרא initially thought the master would be obligated to feed the slave if he told him צא מעשה ידיך למזונותיך‎. ---------------------- תוספות asks: ואם תאמר אטו משום דלא ספיק יהא רבו חייב לזונו‎ – And if you will say; is it indeed so, that because the slave cannot earn sufficiently to support himself, his master should be obligated to feed him?! ולא יוכל לומר לו צא מעשה ידיך במזונותיך – And the master cannot tell the slave, ‘ spend your handiwork for your food’?! תוספות asks an additional question: ועוד קשה הלשון דקאמר עבדא דנהום כריסיה לא שוי – And furthermore the expression which the גמרא uses, namely ‘a slave who is not worth the bread of his stomach is not worth that his master should keep him ’, this expression is difficult – הוה ליה למימר בהדיא דלא מחייב לזונו‎ – The גמרא should have stated clearly that the master is not obligated to feed the slave – כיון דאמר ליה צא מעשה ידיך במזונותיך‎ – Since the master told him, צא מעשה ידיך במזונותיך‎! תוספות answers: ואומר רבינו יצחק דסלקא דעתיה דרגילות הוא שעבד עצמו הולך ועובד את רבו‎ – And the ר"י answers, that the גמרא initially assumed that (since) it is usual for a slave to work for his master – אפילו כשאמר ליה צא מעשה ידיך במזונותיך – Even if the master told him, צא מעשה ידיך במזונותיך‎ – משום הכי בעי למימר (אף על גב) דלא ספיק שיתחייב במזונות‎ – Therefore the גמרא assumed that the master should be responsible to feed the עבד (even) in a case where his work is insufficient to support himself – כיון שמכל מקום עובדו‎ – Since nonetheless the עבד is working for him – משום הכי מהדר ליה בלשון זה עבדא דנהום כריסיה לא שוי כולי – Therefore the גמרא responded with this expression 'עבדא דנהום כריסיה לא שוי, etc. instead of saying ‘but he told him צא מעשה ידיך במזונותיך’. תוספות explains that according to the abovementioned, another difficulty will be resolved: ולהכי קאמר לעיל שמע מינה יכול הרב לומר לעבד עשה עמי ואיני זנך – And therefore the גמרא said previously, we derive from the משנה, that the master can say, ‘work for me, but I will not feed you’ – דאפילו מיירי דאמר ליה צא מעשה ידיך במזונותיך‎ – For even if the משנה is discussing a case where the master said צא מעשה ידיך במזונותיך‎ – מכל מקום כיון שעובדו היה לו להתחייב במזונותיו אי לאו משום דיכול‎ – Nevertheless the גמרא assumed in the ס"ד that since the slave is working for the master, the master should be obligated to feed him, unless we assume that because the master can tell him עשה עמי ואיני זנך‎. תוספות offers an alternate explanation to the last question: ועוד דסלקא דעתיה דמיירי בלא אמר ליה דומיא דאשה דבדלא ספיק לא שכיח: And an additional explanation is that the גמרא assumed that the משנה is discussing a case where the master did not tell the slave צא מעשה ידיך במזונותיך (and nevertheless he is not obligated to feed him) just as by a woman (where the גמרא also assumed that we are not discussing a case where he told her צאי מעשה ידיך במזונותיך); the reason for this assumption is that it is not common that a person’s work should not be sufficient to sustain him. S UMMARY The מקשן assumed that (even if the master said צא מעשה ידיך במזונותיך) that he is obligated to feed his slave if the slave works for him (unless we maintain that the master can say עשה עמי ואיני זנך). T HINKING IT OVER Initially the גמרא assumed that in a case where the אדון told the slave צא מעשה ידיך במזונותיך, but the עבד continues to work for the אדון, the אדון is חייב במזונות even if the work of the עבד is insufficient to cover the cost of מזונות‎. The conclusion is that if the work of the עבד is insufficient, the אדון is פטור from מזונות (if he told him צא מעשה ידיך וכו'). What are the respective סברות of the הו"א and מסקנא of the גמרא‎?

    מאי שנא לערי מקלט‎—Why are cities of refuge different O VERVIEW The גמרא cited a ברייתא which states that the master is not obligated to feed his slave who was exiled to the ערי מקלט, however the מעשה ידיו of that slave belongs to the master; proving that the master can tell the slave עשה עמי ואיני זנך‎. The גמרא rejects this proof saying that we are discussing a case where the master said צא מעשה ידיך במזונותיך, and when the ברייתא states that the מעשה ידיו belong to the master that is referring to the extra מעשה ידיו, that is more than his need for food. The גמרא then asks so why mention ערי מקלט, this rule applies everywhere. תוספות explains that if we would maintain יכול האדון לומר עשה עמי ואיני זנך, then it would be understood why ערי מקלט is mentioned. ----------------------- פירוש אי אמרת בשלמא יכול‎ – The explanation of the question (מ"ש לערי מקלט) is as follows: if we assume that יכול הרב לומר לעבד עשה עמי ואיני זנך then it is understood why the ברייתא‎ – אשמועינן ערי מקלט דאף על גב דאמר רחמנא וחי עביד ליה חיותא טפי‎ – Teaches us this rule (of עשה עמי וכו') by ערי מקלט; for even though the ‘Merciful One’ writes regarding one who is in an עיר מקלט that 'וחי', meaning that you should give him more sustenance which would therefore lead us to assume that in an עיר מקלט the master cannot tell his slave עשה עמי וכו', the ברייתא teaches us that – אפילו הכי יכול הרב לומר כולי‎ – Nevertheless the master can say, etc. עשה עמי ואיני זנך‎ – אבל לענין העדפה לא משמע ליה דמשום וחי תיהוי העדפה דידיה: However if we assume that the master cannot say עשה עמי וכו', and we are merely discussing the העדפה, it does not seem to the מקשן regarding העדפה, that on account of 'וחי' the העדפה should belong to the slave, therefore there is no חידוש by עיר מקלט‎. S UMMARY The difference between the מקשן and the תרצן is whether we may have assumed that the פסוק of וחי teaches that the העדפה (in an עיר מקלט) belongs to the slave (the תרצן), or not (the מקשן). T HINKING IT OVER The תרצן assumes that (without the ברייתא) we would have (mistakenly) derived from 'וחי', that the העדפה should belong to the עבד‎. When the גמרא previously asked that it is פשיטא that the העדפה belongs to the master, why did not the גמרא answer that it is not פשיטא at all, since the פסוק 'וחי' may teach us that even the העדפה belongs to the עבד (as the גמרא subsequently answered regarding ערי מקלט)?!

    מספקת מאי למימרא כולי‎—Why say it, if it is sufficient, etc O VERVIEW The גמרא cites the סיפא of the ברייתא regarding ערי מקלט, that by a woman who is exiled to ערי מקלט, the husband is obligated to feed her; indicating that the ברייתא is discussing a case where צא מעשה ידיך וכו' was not said (neither by the husband not by the master). The גמרא rejects this and maintains that the ברייתא is discussing where the husband said צאי מעשה ידיך and if it is insufficient, then the husband must feed her; however if her מעשה ידיה is sufficient then he is not obligated to feed her. The גמרא then asks, if her מעשה ידיה is sufficient then it is obvious that he need not feed her; what is the ברייתא teaching us? תוספות explains why this question is only if we assume that the רישא (of the סיפא) is a case of לא ספקה, but if we assume that in all cases it is ספקה, there will be no question. ----------------------- אי אמרת בשלמא כולה בדספקא – The ברייתא will be properly understood if we assume that the entire ברייתא is in a case of ספקא, for then we can say that the ברייתא – תנא סיפא דאמר לה לגלויי ארישא דאיירי בלא אמר לה‎ – Taught us the סיפא (דסיפא) that (when) he told her צאי מעשה ידיך וכו' (he does not have to support her), the purpose of this ruling is to reveal that the רישא (דסיפא) where it states that בעלה חייב במזונותיה is in a case where he did not say to her צאי מעשה ידיך וכו' – אבל השתא דמוקמת רישא בדלא ספקא – However, now that you have established the רישא in a case of לא ספקא‎ – ולא תנא הך סיפא אלא לאשמועינן‎ – And therefore the סיפא was merely taught to inform us – דבמספקת יכול לומר לה צאי מעשה ידיך במזונותיך‎ – That by מספקת he can tell her צאי מעשה ידיך במזונותיך, then the question arises- מאי למימרא דזה אינו שום חידוש: What is this teaching us ; for there is no novelty at all in this ruling?! S UMMARY There is a purpose in stating an obvious ruling if we can infer from this ruling a novelty regarding another ruling. T HINKING IT OVER 1. תוספות explains the sגמרא' question, that if the רישא is by צאי וכו' and לא ספקה, then the סיפא is superfluous. Why can we not say that the סיפא teaches us that the רישא is בלא ספקא (just as תוספות says [according to the מקשן] that the סיפא teaches us that the רישא is בלא אמר צאי וכו')?! 2. תוספות could have said that if we would assume that יכול הרב לומר עשה וכו', then we could establish the סיפא דסיפא (where it says ואם אמר לה צאי וכו') that it is לא ספקה and nevertheless he is not obligated to make up the לא ספקה, since he can claim that מזלה גרמה that she was גולה, and the רישא דסיפא (where it states בעלה חייב וכו') is where he did not tell her צאי וכו', and he mentions the סיפא לגלויי ארישא, that עבד is also not discussing צא (proving that יכול הרב וכו'). The advantage of this explanation is that there is a חידוש (by the סיפא דסיפא) as opposed to תוספות explanation!

    ומר סבר אינו יכול‎—And this master maintains, he cannot O VERVIEW The גמרא initially assumed that the dispute whether the slave could tell his master during a hunger, ‘either feed me or set me free (the view of רשב"ג)’, or he cannot (the view of the חכמים), depends on whether the master can tell his slave, 'עשה עמי ואיני זנך' (the חכמים) or not (רשב"ג). Our תוספות clarifies the meaning of הוציאני לחירות‎. -------------------- והא דקתני או הוציאני לחירות לאו דוקא – And that which the ברייתא teaches that the slave can say, ‘ or set me free’, it does not mean precisely that the slave can demand to be set free – אלא כלומר שיהיה מעשה ידי לעצמי כמו לבן חורין: Rather the ברייתא means to say that the עבד has the right to demand that my handiwork should belong to me just like a free man. S UMMARY הוציאני לחירות merely means that the עבד retains the right to מעשה ידיו‎. T HINKING IT OVER 1. Seemingly this which תוספות wishes to clarify (regarding הוציאני לחירות) is discussed immediately in the גמרא; what is תוספות concern (or alternately [if we accept תוספות explanation], what is the גמרא asking later)?! 2. Why did not תוספות attempt to explain the necessity of mentioning 'שנת בצורת' according to the הו"א, just as he explained 'הוציאני לחירות' according to the הו"א‎?

    כי היכי דחזו אינשי ומרחמי‎—In order that people will see and have mercy O VERVIEW The גמרא explains that the dispute between רשב"ג ורבנן whether the עבד can demand from his master (in a hunger year) או פרנסני או הוציאני לחירות, depends on whether people are as merciful for slaves as for freemen (רבנן), or not (רשב"ג). תוספות explains how this גמרא does not contradict another which seemingly indicates that רשב"ג ורבנן maintain the exact opposite. --------------------- הקשה הרב רבינו יצחק בן הרב רבינו מאיר דבפרק השולח (לקמן דף לז, ב) – The ריב"ם asked that in פרק השולח‎ – גבי עבד שנשבה ופדאו ישראל אחר שמעינן להו איפכא‎ – Regarding a slave who was captured and another Jew redeemed him; we find that רשב"ג and the חכמים maintain there the opposite of what they maintain here – דקא אמרי רבנן לא ישתעבד לא לרבו ראשון ולא לרבו שני‎ – For there the רבנן rule that this slave shall not be indentured not to the first master (who owned him originally [when he was taken captive]) and not to his second master (the ישראל who redeemed him). אביי explains the ruling – לרבו שני לא דהא לשם בן חורין פרקיה‎ – The second master shall not enslave him, because the second ישראל redeemed him to become a free man (and not to keep him as a slave) – לרבו ראשון לא דלמא מימנעי ולא פרקי – The first master cannot enslave him, because perhaps people will be reluctant to redeem the slave from captivity if they know he will return to be a slave. This is the view of the רבנן‎ – ורבן שמעון בן גמליאל סבר כשם שמצוה לפדות בני חורין כן מצוה לפדות את העבדים- רשב"ג maintains that just as it is a מצוה to redeem free men, so too is there a מצוה to redeem the slaves, therefore even if he remains a slave by רבו ראשון, this will not deter people from redeeming slaves. תוספות answers: ואומר רבינו יצחק דרבן שמעון בן גמליאל סבר דלענין פדיון פרקי ליה טפי‎ – And the ר"י answers that רשב"ג maintains that regarding פדיון, people will be more apt to redeem an עבד (than feed him) in order – שלא יטמע בין העובדי כוכבים – That he should not become intermingled (assimilated) between the עכו"ם- ורבנן סברי דלענין מזונות מרחמי עליה טפי שלא ימות ברעב – While the רבנן maintain that regarding food, people will be more merciful on the עבד (than redeeming him), in order that he should not die from hunger – וגם כל אחד יתן לו מעט לחם אבל בפדיון צריך הרבה ביחד: And also (it is easier to feed him, because) each one needs to give the עבד only a little bread to sustain him, however regarding redeeming an עבד, much (money) is necessary at one time, which people may not have. S UMMARY On one hand it is more apt to save someone from assimilation than to worry about his sustenance (רשב"ג); on the other hand one is more concerned for dying from hunger than a possible assimilation, especially since feeding is less expensive than redeeming (רבנן). T HINKING IT OVER It appears from תוספות that according to the רבנן, people will give for hunger quicker than for פדיון שבויים‎. However the גמרא in ב"ב ח, ב states that captivity is worse than the others (including hunger) for in captivity one suffers from hunger as well. How can we reconcile תוספות with that גמרא‎?

    אמר רב המקדיש ידי עבדו‎—רב said one who sanctifies the hands of his slave O VERVIEW The גמרא cites a ruling of רב; if a master is מקדיש the hands of his slave, the rule is that anything which the slave accomplishes (with his hands) belongs to הקדש (and therefore appropriate steps need to be taken). תוספות first insists that the proper גירסא is המקדיש ידי עבדו (not המקדיש עבדו). תוספות then discusses the rule if one is מקדיש עבדו‎. ----------------------- גרסינן ולא גרסינן המקדיש עבדו דהתם יצא לחירות‎ – The text reads המקדיש ידי עבדו; however, the text does not read המקדיש עבדו (one who sanctifies his slave), for in that case, the slave is freed – כדאמר רב בהשולח (לקמן דף לח, ב) דליהוי עם קדוש קאמר – As רב ruled in פרק השולח, that when the master states that he is מקדיש עבדו, he means that the slave should be freed and become part of the ‘holy nation’. תוספות asks: ואם תאמר וכי היכי דמקדיש ידי עבדו אמרינן דהן קדושים למלאכתן‎ – And if you will say; that just as when one is מקדיש the hands of his slave, we say that they become holy regarding their work (that the work that he does with his hands belong to הקדש) – הכי נמי כשהקדיש כל עבדו הוה לן למימר שהקדישו למלאכתו‎ – Similarly we should also say, that when he is מקדיש the entire עבד, he is מקדיש every aspect of the עבד for its work, this means – פיו לדבורו ידיו למעשהו רגליו להילוכו – The mouth of the עבד is הקדש, regarding his speech, his hands are הקדש regarding what he does, his feet are הקדש regarding his walking – דבענין זה חשיב הקדש כדאמרינן בסוף פרק קמא דנדרים (דף יג, ב) – For being מקדיש in such a manner is considered a valid הקדש as the גמרא states in the end of the first פרק of מסכת נדרים‎. תוספות answers: ואומר רבינו יצחק דסברא הוא דלא נתכוין להקדישו למלאכתו‎ – And the ר"י answers that it is logical to assume that the master had no intention to be מקדיש the עבד for his work (that all his work should be הקדש) – לפי שיש חילוק במלאכתו שאין פיו ידיו ורגליו שוין במלאכתן‎ – Since there is a difference in his work; for his mouth, his hands and his feet are not equal in their work (they all do different types of work) – הלכך אית לן למימר דלשחררו נתכוין דהוי הכל בענין אחד – Therefore we rather assume that he intended to free him (when he was מקדיש the עבד) for then it is all in one context (the entire עבד is equally freed). תוספות offers a different distinction between המקדיש ידי עבדו (where his מעשה ידיו become הקדש) and המקדיש עבדו (where the עבד is freed): אי נמי יש לומר התם כשמקדיש עבדו סתם משמע יותר למיהוי עם קדוש‎ – Or you may also say; there when he is מקדיש his slave generally without being specific what he is מקדיש, it is more indicative that the master meant that the slave become an עם קדוש (by being freed) – דהא למלאכתו לא קאמר‎ – For the master did not mention that he is מקדיש him for his work – אבל מקדיש ידי עבדו הקדיש מלאכת ידיו דלא שייך למימר בענין אחר: However when he is מקדיש the hands of his slave (even though here too the master did not mention work, nevertheless), the master was certainly מקדיש his handiwork, for it cannot mean anything else! S UMMARY If one is מקדיש עבדו he becomes free and joins the עם קדוש; he does not become הקדש regarding his various actions, since the owner made only one general statement of הקדש and (in addition) he did not mention that he is מקדיש him for his work. T HINKING IT OVER תוספות second answer is that by מקדיש ידי עבדו, it cannot mean actual הקדש (for one cannot be מקדיש part of the עבד). However we know there is a rule of פשטה קידושי בכולה, that if one is מקדיש part of an animal, the קדושה spreads to the entire animal; let us say here as well that if he was מקדיש the ידים, they become actually הקדש and the קדושה spreads throughout the entire עבד, that he becomes completely הקדש‎!

    בד"ה בגיטי נשים כו' בירושלמי בעי הרי שהיה עבדו של קצין הרי חובה הוא לעבד כו' עכ"ל. ויש לדקדק מה קושיא דודאי כשהוא עבדו של קצין והעבד אומר דלא ניחא ליה דפשיטא שאין זה נעשה שלוחו בע"כ דנהי דזכין לאדם שלא בפניו היינו שלא מדעתו אבל בע"כ מיהא לא אשכחן וכה"ג ודאי לא אמרי רבנן דאין יכול לחזור בו כיון שאין זה שליח לקבלה. ודין זה מבואר כמ"ש הרשב"א והר"ן ז"ל בחידושיהם בפ"ק דקידושין גבי בכסף ובשטר ע"י אחרים ע"ש. וכן איתא בטוא"ע סי' קמ"א גבי גט. והנראה בזה דהא דמקשה הירושלמי הרי שהיה עבדו של קצין היינו שאפי' אם העבד רוצה בשיחרור לבסוף מ"מ כיון דבשעת קבלתו של זה לא פסיקא מילתא שהוא זכות לעבד לא שייך לומר זכין לאדם שלא בפניו וא"כ אין כאן שליחות לקבלה ואפילו אם העבד רוצה בסוף אפ"ה לא ליהוי משוחרר כיון שחזר בו הרב ביני ביני וגם זה הדין מבואר בא"ע סי' קמ"א לענין גט אשה שאף שראינו שהיתה מהדרת לבקש גט וגם בסוף אומרת דניחא לה אפילו הכי לא הוי שליח לקבלה בכה"ג דסתם גיטי נשים חוב הוא לה וזה ברור ודו"ק:

    בא"ד הרי שהיתה אשתו של מוכה שחין עכ"ל ולכאורה יש לדקדק דנהי דבמוכה שחין לא מיתדר לה (בהדיא) אפ"ה חוב הוא לה מצד המזונות וליכא למימר כגון שהיא אומרת בפירוש שהגירושין יפין לה יותר שהרי בסמוך כתבנו מבואר דלא תליא מידי במה שהיא אומרת בתחלה ובסוף כ"א במאי דניחא מסתמא תליא מילתא ושלא יהא שום צד חובה כמבואר לקמן בשמעתין דקאמר השבתוני על המזונות מה תשיבוני על התרומה. מיהו נראה דהא דקתני במתניתין דחוב הוא לאשה מצד המזונות אין זה עיקר הטעם דרוב נשים מעשה ידיהם מספיקים למזונותיהם כמ"ש התוספות בסמוך דלא ספקה לא שכיח וא"כ אין זה חובה אלא הגירושין בעצמם הן חוב דטב למיתב טן דו וא"כ מקשה שפיר הרי שהיתה אשתו של מוכה שחין וכגון שמעשה ידיה מספיקין למזונותיה כן נ"ל. ומה שנחלקו הפוסקים בענין גט מומר ולא הביאו הטעם דמזונות היינו משום דסתם מומר אינו מעלה מזונות לאשתו. מיהו כל זה לשיטת הירושלמי אבל בגמרא דידן מסקינן בפרק האשה שהלכה דאפי' במקום קטטה נמי לא שייך לזכות גט ע"י אחר משום דטב למיתב טן דו ובפרק המדיר משמע דאפילו במוכה שחין נמי אמרינן טב למיתב טן דו וא"כ צ"ע ועיין בטוא"ע סי' ק"מ לענין גט מומר ובב"י שם לענין מוכה שחין ובש"ע שם:

    בא"ד לית לך אלא כהדא אילו המוכר עבדו שלא מדעת כו' עכ"ל עיין מה שכתב מהרש"א ז"ל בזה ומילי דסברא נינהו אבל מ"מ הקושיא במקומה עומדת דלא משני הירושלמי מידי אמתניתין דהא תליא טעמא בהדיא משום שאם ירצה שלא לזונו ואי כשיטת מהרש"א ז"ל הו"ל למימר בהדיא דבעבד אין יכול לחזור בו משום דיכול למוכרו לגמרי בע"כ ע"י אחר משא"כ באשה ולענ"ד נראה לפרש בע"א משום דעיקר קושיית הירושלמי הרי שהיה עבדו של קצין ויודע בו העבד שלא יאמר לו עשה עמי ואיני זנך וכן למאי דמשני בא"ל צאי מעשה ידיך וכיון שהוא קצין יודע בו שאינו מקפיד על המזונות ויתן לו בריוח ואף שעכשיו רוצה לשחררו מ"מ שמא יחזור בו נמצא שקבלת השיחרור הוא חוב מצד המזונות עצמן וע"ז משני דכיון שיכול למכרו לאחר א"כ ודאי זכות הוא לו להיות בן חורין דאף אם הוא עבדו של קצין אעפ"כ מפחד תמיד שמא ימכרנו לאיש בזוי ונקלה ויהיה עבד לו והלה יאמר עשה עמי ואיני זנך נמצא שהשיחרור הוא לעולם זכות גמור. משא"כ באשה לעולם הוא חוב דאע"ג דעכשיו ספקה זימנין דלא ספקה ויצטרך להשלים וכוונת הירושלמי דמה שאמר אין יכול לגרש אשתו שלא מדעתה פירוש שאינו יכול להפקיע ממנה מזונות שלא מדעתה כן נ"ל נכון ואף דלענין האשה אין הלשון מכוון כבר כתבתי דמילתא דאשה לא נקיט בלא"ה אלא אגב גררא וק"ל:

    גמ' ש"מ יכול הרב לומר לעבד כו' וי"ל טובא דמהיכי תיתי בעי למידק ממתני' דיכול לומר דהא במתני' אין הרב חפץ כלל בעבודת העבד שהרי נותן לו גט שיחרור אלא דהתנא יהיב טעמא למילתיה דלא תימא שקבלת השיחרור הוא חוב מצד הפקעת המזונות על זה קאמר שפיר דאין כאן חוב דבלא"ה רשאי שלא לזונו עוד כיון שאינו חפץ עוד בעבודתו משא"כ באשה דלעולם חייב במזונות עד דמטי גיטא לידה אבל היכא דשקיל הרב מעשה ידי העבד לעולם אימא לך דאין יכול לומר והנלע"ד בזה דהמקשה סובר דהא דקאמר מתני' שאם ירצה שלא לזונו רשאי אין כוונתו לשלול ולומר דאין כאן חוב לעבד מצד הפקעת המזונות כדפרישית וכפרש"י במתני' דקשיא ליה למקשה דא"כ מאי האי דקאמר שאם ירצה שלא לזונו רשאי ותיפוק ליה דאפילו אינו רשאי נמי אין כאן חוב העבד דאף שע"י השיחרור יפטור הרב לזונו האיכא מיהא מעשה ידיו ויתפרנס ממעשה ידיו דרוב עבדים מעשה ידיהם מספיקים למזונות כדאמרינן בשמעתין אע"כ דעיקר כוונת התנא במאי דקאמר שאם ירצה שלא לזונו רשאי היינו שזה הוא הזכות של העבד ומש"ה נעשה שלוחו שלא בפניו דתנא דמתני' לא נחית לטעמא דמתירו בבת חורין אלא הזכות הוא מצד המזונות עצמן וא"כ מדייק הש"ס שפיר דלא מצינן שום זכות מצד המזונות אלא אי אמרינן דיכול הרב לומר לעבד עשה עמי ואיני זנך דאי ס"ד אין יכול לא מצינו זכות בזה השיחרור לענין מזונות דלעולם קודם השיחרור נמי יש לו מזונות או מן הרב או ממעשי ידי עצמו והתרצן משני דבא"ל צאי מעשה ידיך כו' והיינו כדמסיק בדלא ספיק ולפ"ז כוונת התנא לאו כדס"ד דאזכותא קא מהדר שהזכות הוא מצד המזונות אלא כוונת התנא לשלול מניעת החוב דזכות איכא בלא"ה אי משום שמתירו בבת חורין ואי משום מעשה ידיו דע"פ הרוב עודפין על המזונות אלא כי היכי דלא תימא נהי שהוא זכות מצד זה איכא נמי חוב מצד אחר דזימנין דלא ספיק על זה קאמר התנא דמתני' שאם ירצה שלא לזונו רשאי וא"כ בדלא ספיק לעולם א"צ להשלים וממילא אין כאן חוב כלל והזכות כדקאי קאי. כן נלע"ד אבל מלשון התוספות נראה דלא נחתו להאי סברא לפמ"ש בסוף ד"ה עבד נמי ויבואר בסמוך לפי שיטתם ע"ש ודו"ק:

    רש"י בד"ה ועבד נמי כו' אבל אשה כך התנה בכתובתה כו' עכ"ל נראה שכוונתו בזה דלא תקשי מאי פסקא דבאשה חייב להשלים בדלא ספקה טפי מעבד דהתינח למ"ד בכתובות דמזונות עיקר אי מדאורייתא אי מדרבנן ותיקנו מעשה ידיה תחת מזונות א"כ פשיטא בדלא ספקה צריך להשלים לה כל מזונותיה משלם כיון דמזונות עיקר אבל לריש לקיש דאמר בכתובות דמעשה ידיה עיקר ותיקנו מזונותיה תחת מעשה ידיה א"כ איכא למימר דבדלא ספקה א"צ להשלים דיכול הבעל למימר אי אפשי בתקנת חכמים כמו שהקשו התוספות שם בפ' נערה דף מ"ו לכך כתב רש"י שכך התנה בכתובתה ולפ"ז ליכא למ"ד דמצי הבעל לומר צאי מעשה ידיך במזונותיך וכ"כ שם התוס' אלא שלא נתנו טעם לדבר ואפשר שכיוונו למאי שכתב רש"י ז"ל כאן דמספר כתובתה נלמד ובאמת דמדברי ריש לקיש גופא מוכח כן דקאמר מעשה ידיה עיקר ותיקנו מזונות תחת מעשה ידיה משמע דשתי תקנות תקנו וא"כ קשה דתקנה דמזונות למה דמעיקרא שתיקנו מעשה ידיה לבעל ממילא נתחייב הבעל במזונות דהא מילתא דפשיטא היא שאין הבעל יכול לומר לאשתו עשה עמי ואיני זנך מק"ו דעבד עברי דכתיב כי טוב לו עמך כ"ש אשתו כדאמרינן פרק אף על פי דף נ"ז אע"כ דאפ"ה הוצרכו לתקנה דמזונות לענין שלא יוכל הבעל לומר צאי מעשה ידיך במזונותיך אלא לעולם צריך להשלים כן נראה לי נכון ודו"ק:

    גמרא עבד נמי בדלא ספיק ולכאורה יש לדקדק דכל האי שקלא וטריא דמייתי הש"ס לדקדק מדכוותיה גבי אשה אין לו מקום בסוגיא דמעיקרא דמשני דאיירי דא"ל צאי מעשה ידיך במזונותיך ע"כ כוונת התנא דא"צ להשלים בדלא ספיק דאלת"ה מאי איכפת לן במאי דרשאי שלא לזונו ויכול לומר צא מעשה ידיך דאכתי אין כאן לא זכות ולא מניעת חוב בקבלת השיחרור שהרי זולת השיחרור נמי יפרנס עצמו במעשה ידיו אע"כ דנפקא מיניה דלא תימא שהוא חוב אי לא ספיק וא"כ תיכף יכול להקשות אי לא ספיק יצטרך להשלים אי ס"ד דאין יכול לומר צא מעשה ידיך וכמ"ש התוס' דהא בהא תליא ובשלמא אם נפרש דסוגיא דשמעתין תליא בג"ש דלה לה מאשה דמ"ד דאין יכול לומר עשה עמי ואיני זנך היינו מחמת ג"ש א"כ אתי שפיר דהא דמקשה עבד נמי דלא ספיק היינו לבתר דדייק דבאשה צריך להשלים בדלא ספקה אם כן בעבד נמי חייב בג"ש דלה לה מאשה ותיקשי למ"ד מזונות אשה דאורייתא אם כן ה"ה בעבד. אבל מלשון רש"י ז"ל ותוספות משמע דלא איירי הכא מג"ש וכמו שכתבתי א"כ צ"ע ויתיישב בסמוך בל' התוספות:

    תוספות בד"ה עבד נמי וא"ת אטו משום דלא ספיק כו' עכ"ל ויש לתמוה על תמיהת התוספות דמאי קושיא אין ה"נ דהמקשה סבר דחייב להשלים בדלא ספיק כיון דמקמי הכי הוי שקיל העדפה ותדע דהא רשב"ג סובר דקושטא דמילתא יכול העבד לומר בשני בצורת או פרנסני או הוציאני לחירות ואוקמינן דלא ספיק וא"כ המקשה דהכא נמי איירי בהאי גוונא גופא דתנא דמתניתין פסיק ותני דלעולם קבלת השיחרור אין בו חוב ואמאי הא בשנת בצורת הוא חוב גמור אי לא ספיק אליבא דרשב"ג. מיהו בגופא דמילתא לדינא נראה ברור דמילתא דפשיטא היא דאין חייב להשלים אע"ג דזימנין שקיל העדפה ותדע דהא האב זוכה במעשה ידי בתו ואפ"ה תנן בכתובות פרק נערה שאין האב חייב במזונות בתו ונהי דע"כ איירי בא"ל צאי מעשה ידיך במזונותיך דאל"כ הא ודאי חייב במזונות תחת מעשה ידיה דהא פשיטא לן דאין האב יכול לומר לבתו עשה עמי ואיני זנך כדאמרינן בהחובל מק"ו דע"ע אע"כ בדא"ל צאי מעשה ידיך וקמ"ל דאין חייב במזונות בתו והיינו לענין שא"צ להשלים בדלא ספקה א"כ כ"ש בעבד אבל התוס' ודאי לא נחתו להכי ומכח סברא גופא מקשו א"כ הדרא קושיא לדוכתיה ונראה דרשב"ג גופא לא קאמר אלא כשהרב אינו רוצה לשחררו דמצי העבד לומר או פרנסני או הוציאני לחירות משא"כ במתניתין דאיירי שהרב רוצה לשחררו אלא דאנן אמרינן שהשיחרור אינו כלום שהוא חוב לעבד דאפשר שישמיט עצמו לקבל השיחרור ובתוך כך יהא רבו חייב לזונו וע"ז מקשו התוס' שפיר דמהיכי תיתי יהא חייב לזונו כיון דא"ל צאי מעשה ידיך במזונותיך והעבד לא מצי למימר או פרנסני או הוציאני לחירות שהרי אינו רוצה להשתחרר ובזה א"ש נמי דלא תיקשי לרשב"ג א"כ בבתו נמי אמאי אמרינן שאין חייב לזונה אע"ג דשקיל מעשה ידיה וא"צ להשלים בדלא ספקה ומשמע דאף בשני בצורת והיינו משום דהתם לא שייך לומר או פרנסני או הוציאני לחירות אלא דלפ"ז לא א"ש תירוץ התוס' דרגיל הוא שהולך ועובד כו' ותיפוק ליה שהרב אינו רוצה בעבודתו אלא לשחררו ועיי' מה שכתבתי לעיל בזה ויש ליישב ודוק היטב:
