    English translation - Gittin 5a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1If we say that this is referring to a deaf-mute, is a deaf-mute fit to bring a bill of divorce? But didn’t we learn in a mishna (23a): Anyone is fit to serve as an agent to bring a bill of divorce to a woman except for a deaf-mute, an imbecile, and a minor, all of whom may not be appointed as agents at all, as they are not intellectually competent according to halakha .

2And Rav Yosef said: With what are we dealing here? This is a case where the agent gave the bill of divorce to her when he was halakhically competent, but he did not manage to say: It was written in my presence and it was signed in my presence, before he became a deaf-mute. In other words, although at the time he was appointed he was fit to be appointed as an agent, he is currently unable to say anything. This works out well according to the opinion of Rava. However, it is difficult according to the opinion of Rabba, as he requires testimony that the bill of divorce was written for the woman’s sake.

3The Gemara answers: With what are we dealing here? This does not refer to the main period of the decree. Rather, it is speaking of later generations, after the residents of countries overseas learned that a bill of divorce must be written for her sake, so there is no need for the declaration. The Gemara raises a difficulty: If so, meaning that this is referring to a situation where everyone is assumed to be knowledgeable, even if the agent is able to testify he should also not be required to say: It was written in my presence, as it should be sufficient to confirm the witnesses’ signatures. The Gemara explains: Nevertheless, Rabba maintains that the agent must testify, due to a rabbinic decree lest the matter return to its corrupt state, i.e., they might forget that a bill of divorce must be written for the woman’s sake.

4The Gemara asks: If it is so, that the Sages decreed that the statement must be issued even in this case, then one who is unable to speak should also be obligated to state the declaration, and be disqualified from serving as an agent due to his inability to speak. The Gemara answers: This case of a halakhically competent individual who became a deaf-mute is an uncommon matter, and the Sages did not decree with regard to an uncommon matter.

5The Gemara asks: But the case of a woman who brings her own bill of divorce is also an uncommon matter, and yet we learned in a mishna (23a): The woman herself may bring her own bill of divorce, provided that she too is required to say: It was written in my presence and it was signed in my presence. Why do the Sages obligate her to state this declaration when it is uncommon for a woman to be the agent of delivery for her own bill of divorce? The Gemara answers: The Sages instituted this ordinance so that you will not distinguish with regard to different types of agency. To avoid confusion, the Sages decreed that all agents who bring a bill of divorce must state the declaration, even the woman herself.

6The Gemara asks: If so, then a husband who brings his wife’s bill of divorce should also be required to say that it was written and signed in his presence, as the Sages do not differentiate between different agents. Why then, is it taught in a baraita : In the case of the husband himself who brought his own bill of divorce, he is not required to say: It was written in my presence and it was signed in my presence?

7The Gemara explains: What is the reason that the Sages said that the agent of a bill of divorce is required to say: It was written in my presence and it was signed in my presence? The reason for the decree is that perhaps the husband will come to contest and invalidate the bill of divorce. However, here the husband himself now holds the document in his hand, and yet you are concerned that he will contest it? If he does not wish to give the bill of divorce to the woman he can simply tear it up. Therefore, the Sages did not apply their decree to this case.

8§ The Gemara attempts to cite an additional proof: Come and hear, as Shmuel raised a dilemma before Rav Huna: With regard to two people who brought a bill of divorce from a country overseas, are they required to say: It was written in our presence and it was signed in our presence, or are they not required to state this declaration? Rav Huna said to him: They are not required to say it. Rav Huna explained his ruling: And if these two individuals would say, testifying: She was divorced in our presence, even without bringing a bill of divorce, aren’t they deemed credible and isn’t she considered divorced? Therefore, in this case too, they are deemed credible when they claim that the bill of divorce was written correctly.

9The Gemara comments: This works out well according to the opinion of Rava, as the matter depends on the availability of witnesses to ratify the bill of divorce, and there are two witnesses in this case. However, according to the opinion of Rabba, it is difficult, as he requires the additional testimony that the document was written for the woman’s sake. The Gemara explains: According to the opinion of Rabba, with what are we dealing here? He maintains that this ruling is referring to the period after the people living overseas learned the halakha that a bill of divorce must be written for the woman’s sake.

10The Gemara raises a difficulty: If so, one person who brings a bill of divorce should also not be required to say that it was written and signed in his presence. The Gemara explains: One witness is still required to state the declaration for the aforementioned reason: It is a rabbinic decree lest the matter return to its corrupt state.

11The Gemara further asks: If so, two who bring a bill of divorce should also be required to say that it was written and signed in their presence, due to this same decree. The Gemara answers: Two people who bring a bill of divorce is an uncommon matter, and the Sages did not decree with regard to an uncommon matter.

12The Gemara asks: But the case of a woman who brings her own bill of divorce is also an uncommon matter, and yet we learned in a mishna (23a): The woman herself may bring her own bill of divorce, provided that she too is required to say: It was written in my presence and it was signed in my presence. Why do the Sages obligate her to state this declaration when it is uncommon for a woman to be the agent of delivery for her own bill of divorce? The Gemara answers: The Sages instituted this decree so that you will not distinguish with regard to different types of agency.

13The Gemara asks: If so, then a husband who brings his wife’s bill of divorce should also be required to say that it was written and signed in his presence, as the Sages do not differentiate between different agents. Why then, is it taught in a baraita : If the husband himself brings his own bill of divorce he is not required to say: It was written in my presence and it was signed in my presence? The Gemara explains: What is the reason that the Sages said that the agent of a bill of divorce is required to say: It was written in my presence and it was signed in my presence? The reason for the decree is that perhaps the husband will come to contest and invalidate the bill of divorce. However, here the husband himself now holds the document in his hand, and yet you are concerned that he will contest it?

14§ The Gemara suggests: Come and hear a proof from the Tosefta (1:1): With regard to an agent who brings a bill of divorce from a country overseas and gave it to the woman, but did not say to her: It was written in my presence and it was signed in my presence, if the bill of divorce is ratified through its signatories, i.e., other people testify about the witnesses’ signatures, it is valid, but if not it is invalid. This is because the Sages did not require him to say: It was written in my presence and it was signed in my presence, so as to be stringent with her. Rather, they required the agent to state this declaration so as to be lenient with her, to spare the court from having to ratify the bill of divorce.

15The Gemara explains the proof: This works out well according to the opinion of Rava, as according to him the statement of the agent is to avoid the need for the court to ratify the bill of divorce, which is a leniency for her. However, according to the opinion of Rabba it is difficult, as he holds that the agent is required to state the declaration due to the concern that the bill of divorce may not have been written for her sake, which is a stringency for her. The Gemara answers: With what are we dealing here? With the period after they learned the halakha that a bill of divorce must be written for the woman’s sake.

16The Gemara asks: But didn’t you say that there is a rabbinic decree lest the matter return to its corrupt state? Why didn’t the Sages enforce their decree in this case? The Gemara answers: This is referring to a case where the woman had already married again after having received the bill of divorce, and the Sages did not want to enforce their decree at the expense of forcing her to get divorced. The Gemara questions this explanation: If so, the explanation provided by the Tosefta for the ruling in the mishna, that the reason is because the Sages did not require him to say: It was written in my presence and it was signed in my presence, so as to be stringent with her. Rather, they required the agent to state this declaration so as to be lenient with her, is not accurate. Instead, the true reason for this leniency is because she had already married someone else.

17The Gemara answers: This is what the tanna of the baraita is saying: And if you would say that one should be stringent with her and remove her from her new husband, to counter that claim the tanna adds: This is because the Sages did not require him to say: It was written in my presence and it was signed in my presence, so as to be stringent with her. Rather, they required the agent to state this declaration so as to be lenient with her.

אילימא חרש‎—If you will say we are discussing a deaf mute O VERVIEW The גמרא quotes a משנה in an attempt to refute רבה‎. The משנה states that if the שליח cannot say בפ"נ, then קיום is required. The גמרא continues to analyze the phrase: ‘ואינו יכול לומר’, and comments, can it mean a חרש‎? The גמרא continues in this vein and concludes that it refers to a פקח שנתחרש‎. Our תוספות will explain why the גמרא did not choose other, simpler, options to explain the phrase, 'ואינו יכול לומר'. ---------------- תוספות presents (negatively) the anticipated question: ולא בעי למימר כגון אלם או שלא ראה כתיבת הגט‎ – And the גמרא did not attempt to mention other options to explain the phrase: ‘and he was not able to say בפ"נ’ for instance a mute, or one who did not see the writing of the גט‎. In these two cases, the גמרא could not have asked (as it subsequently does): ‘are they eligible to bring a גט‎?!’ Why then does the גמרא assume that we are discussing only a חרש, and not these two cases that תוספות mentions? For if it was so ; that the משנה is discussing an אלם or מי שלא ראה כתיבת הגט, the משנה should have said ‘and he did not say’. Instead the משנה states: 'ואינו יכול לומר', ‘and he cannot say’; meaning that he has no capability al all of testifying בפ"נ. In the cases of אלם ולא ראה כתיבת הגט, there is a possibility of them saying בפ"נ. The אלם may write his testimony; the other could have seen the כתיבת הגט had he chosen to. It is only the חרש who is incapable of testifying. S UMMARY The phrase 'ואינו יכול לומר', leads the גמרא to understand that we are discussing only a חרש, not a mute nor one who was not present at the writing of the גט‎. T HINKING IT OVER If we are to interpret תוספות according to the תוספות הרא"ש etc., why would תוספות mention the case of שלא ראה כתיבת הגט‎? That case would seemingly not remove the refutation of רבה‎. Our תוספות should only have mentioned the case of אלם‎.

אי הכי יכול נמי‎—If so then even if he can say בפ"נ, the same rule should also apply O VERVIEW It would seem obvious that given a choice between requiring a שליח to say בפ"נ or having עדים to be מקיים the גט, saying בפ"נ is the easier and therefore the more practical method of validating the גט‎. The גמרא, in two instances of attempting to refute רבה (from the משנה of ואינו יכול and from the איבעיא of שמואל), rejects the purported refutation by stating that we are discussing לאחר שלמדו‎. Therefore בפ"נ need not be said (and קיום is sufficient in the case of אינו יכול). To which the גמרא responds (in the first א"ה case): אי הכי, if it is אחר שלמדו then יכול נמי, that even if he is capable of saying בפ"נ, nevertheless we should treat him in the same manner as אינו יכול; namely that קיום should suffice. This would seem bizarre; קיום is more difficult than saying בפ"נ, why would we want קיום instead of בפ"נ‎?! The difficulty becomes even greater in the second 'אי הכי', where the גמרא asks 'חד נמי'; seemingly suggesting that חד should be treated as תרי and no בפ"נ should be said since it is אחר שלמדו‎. This cannot be; for בפ"נ must certainly be said (at least) for קיום‎. This תוספות will address the difficulty in these two 'אי הכי'. -------------- פירוש יכול נמי סגי בקיום חותמיו‎ – The explanation of the question 'א"ה יכול נמי' is: Even if he can say בפ"נ the authentication of the signatures should suffice, and he need not say בפ"נ. תוספות asks how can the גמרא even suggest that two witnesses should suffice ; two witnesses are an additional requirement! ואם תאמר מאי קשיא ליה לרבה‎ – And if you will say; why is there a question on רבה more than on רבא? כי היכי דלרבא ניחא ליה דמפרש אינו יכול צריך קיום‎ – Just like according to רבא, the משנה (of ואינו יכול לומר) is understood, for he explains the משנה in the following manner: if he is incapable of saying בפ"נ, then קיום is required – אבל יכול סגי באומר בפני נכתב ונחתם ואין צריך שנים‎ – However, if he is capable, it is sufficient when he says בפנו"נ and two witnesses are not required to be מקיים the גט‎. – הכי נמי יפרש רבה דלאחר שלמדו רבה ורבא שוים‎ – רבה will explain the משנה in the same manner; for after the people learnt the requirement of לשמה, then רבה and רבא are equal. Therefore (according to רבה also) if he cannot speak, two עדים are required for קיום (and no בפנו"נ is necessary since it is לאחר שלמדו), however if he can speak then one שליח is sufficient to say בפנו"נ. תוספות answers: ואומר רבינו תם דלרבא ניחא דתנא אינו יכול לאשמועינן דבעי קיום חותמיו‎ – And the ר"ת says; that according to רבא the משנה is understood, the משנה teaches us the case of 'אינו יכול' to let us know that (only/even) in the case of אינו יכול, is קיום חותמיו required – אבל ביכול סגי באומר בפני נכתב אף על גב דלא חשיב לרבא כמו קיום חותמיו‎ – However, when he is capable, saying בפ"נ is sufficient even though that the saying of בפ"נ is not as desirable according to רבא as קיום חותמיו is. The entire תקנה of בפ"נ, according to רבא, was only for קיום‎. It is understood that קיום חותמיו accomplishes it more effectively than merely saying בפ"נ. Therefore, קיום has a greater status than בפ"נ. We cannot ask that by 'יכול נמי', let the greater status suffice! That קיום should suffice. קיום is not merely sufficient, קיום is the optimal resolution. אבל לרבה בפני נכתב עדיף מקיום חותמיו שמעיד שנעשה לשמה‎ – However, according to רבה, בפ"נ is preferable to קיום חותמיו for by saying בפ"נ he testifies that the גט was executed לשמה‎ – על כרחך תנא אתא לאשמועינן דאינו יכול סגי בקיום חותמיו‎ – Perforce we must conclude that since בפ"נ enjoys a higher status than קיום חותמיו, then it is understood that the משנה comes to teach us ( not that קיום is required, for the ultimate requirement would be בפ"נ, but rather) that in the case of אינו יכול then קיום חותמיו (which has a lesser status) is merely sufficient. The reason it is sufficient is – כיון דאוקמינן לאחר שלמדו יכול נמי תיסגי ליה בקיום חותמיו‎ – Since we have established the משנה in the period of לאחר שלמדו; the גמרא therefore rightfully asks; if קיום is sufficient for אינו יכול, then even if he is capable, קיום חותמיו should also be sufficient; בפ"נ should not be required. ולקמן מפרש‎ – And concerning the question later in the גמרא, which is similarly difficult to understand, the ר"ת explains it in the same manner. This is what the גמרא later means to ask when it states: 'אי הכי חד נמי' – אי הכי חד נמי ליבעי שמואל מרב הונא‎ – If this is so that שמואל and רב הונא were discussing the time of לאחר שלמדו, then שמואל should have asked of רב הונא, also in a case where one שליח brought the גט‎ – אי סגי בקיום חותמיו כיון דליכא למיחש למידי‎ – Is קיום חותמיו sufficient without saying בפ"נ since there is nothing to be concerned about? It is לאחר שלמדו; there is no חשש of לשמה only of קיום‎. We do not need בפנו"נ, for קיום is sufficient. – או דילמא לא פלוג בין למדו ללא למדו‎ – Or perhaps the חכמים did not differentiate between the times of למדו and the times of לא למדו‎. In all eras the חכמים required the saying of בפנו"נ, for קיום alone is not sufficient. ומשני פשיטא ליה דצריך גזירה משום שמא יחזור הדבר לקלקולו‎ – And the גמרא there answers ; שמואל did not ask this question, because he was certain that בפנו"נ is required and קיום is not sufficient, because there is a decree that קיום alone is insufficient, on account that we are concerned perhaps the situation will revert to its original faulty status. People may again not be careful concerning לשמה‎. [Concerning both questions of א"ה, the גמרא argues that the original statements (the משנה of אינו יכול and the איבעיא of שמואל) should not be limited to אינו יכול and שנים, but should include יכול and חד‎.] תוספות will now offer another explanation for the two questions of 'אי הכי': ורבינו יצחק מפרש דהכי פריך אי הכי יכול נמי‎ – And the ר"י explains; this is what the גמרא is asking: if so that we are discussing לאחר שלמדו, the even when he is capable of saying בפ"נ, nevertheless in a situation – היכא דאין צריך קיום לא יצטרך לומר לרבה בפני נכתב ונחתם כיון דלמדו‎ – Where קיום is not required, he should not be required to say בפנו"נ according to רבה since the people learnt to write גיטין לשמה; so why is it that – ולעיל אמרינן באתיוה בי תרי ובאותה מדינה במדינת הים‎ – Previously the גמרא says concerning a גט that was brought by two people, and also concerning a גט that was brought in the same country overseas – דלרבה בהני נמי קתני מתניתין דצריך‎ – That according to רבה, even in these situations mentioned our משנה states that it is required to say בפ"נ. The question is why is בפ"נ required, since/if it is לאחר שלמדו‎. There is no חשש of either קיום or לשמה‎. תוספות will respond to the anticipated question: Perhaps the differences mentioned between רבה and רבא concerning our משנה is in the time of קודם שלמדו‎. Why does the ר"י assume that these differences are even לאחר שלמדו‎? תוספות explains: דכולא מתניתין אית לן לאוקמא בלמדו‎ – For it is proper that we interpret the entire set of our משניות after the time of למדו‎. To prove this point, תוספות continues – מדפריך ממתניתין דהאשה עצמה מביאה גיטה‎ – Since the גמרא asks from the משנה of האשה עצמה מביאה גיטה, which is in פרק ב'. The גמרא attempts to refute that which was said (prior) that לאחר שלמדו then by a מילתא דלא שכיחא, an unusual occurrence, בפ"נ is not required. The גמרא challenges this assumption for we see that by האשה עצמה שהביא גיטה which is a מילתא דלא שכיחא and nevertheless בפ"נ is required. The fact that the גמרא attempts this refutation proves that the גמרא assumes that the משנה of האשה עצמה is לאחר שלמדו; otherwise there would be no refutation – ואם כן רישא נמי איירי בלמדו‎ – And if so, that the גמרא assumes the משנה of האשה עצמה to be לאחר שלמדו, then the beginning of the מסכת, i.e. our משנה, is also discussing לאחר שלמדו‎. Therefore the question is; since our משנה is occurring לאחר שלמדו, and רבה ורבא are discussing our משנה, then why should רבה require בפ"נ in the case of אתיוהו בי תרי or באותה מדינה‎?! ובענין זה יש לפרש אי הכי חד נמי‎ – And in this same manner we can interpret the other אי הכי (namely), ‘if so then even one’ שליח that brings a גט where קיום is not required, i.e. באותה מדינה, then בפ"נ should not be required, Why do we say in the מאי בינייהו that according to רבה even לאחר שלמדו, that בפ"נ is required באותה מדינה‎. תוספות will now cite sרש"י (initial) interpretation: ומתחילה כתב רש"י בפירוש כתב ידו דהך קושיא דאי הכי יכול נמי ואי הכי חד נמי‎ – And initially רש"י wrote in his own handwritten commentary that this (first) question of אי הכי יכול נמי and the later question of אי הכי חד נמי, that these two questions – איירי למאי דסלקא דעתא מעיקרא דרבה לית ליה דרבא‎ – Are discussing according to that which we originally thought that רבה does not agree to רבא, and רבה maintains that there is no concern of קיום‎. The two questions are then simply understood. If it is לאחר שלמדו and רבה לית ליה דרבא, there is no need for בפ"נ at all. תוספות anticipates the obvious question; how can we say that רבה לית ליה דרבא we have just previously concluded that רבה אית ליה דרבא‎. תוספות responds: דכן דרך הש"ס דבתר דאיתותב מחדא הדר מותיב ליה מאידך‎ – For this is customary in the גמרא that after there was a refutation from one source, and therefore we reached a new conclusion, as in our case that רבה אית ליה דרבא, the גמרא continues to refute him from another source; as if he was not already refuted from the first source. ושוב מחקו רש"י – But רש"י consequently erased this interpretation from his handwritten פירוש‎. If we are to assume that רבה לית לי' דרבא in these two refutations, then: why by אינו יכול do we need קיום (and how will it help). תוספות will offer another possible explanation and reject it: ואין לפרש יכול נמי לא יצטרך לרבה בפני נכתב כיון דלמדו‎ – However, one cannot interpret the question of יכול נמי to mean that even if he is capable of speaking, he should not be required, according to רבה, to say specifically בפני נכתב; only בפני נחתם should be required; since people are learned in the requirements of לשמה, there is no need for בפני נכתב‎. There is only a need for בפני נחתם since רבה אית ליה דרבא‎. תוספות continues to explain why this question of not saying בפני נכתב is only on רבה and not on רבא‎ – בשלמא לרבא דחייש לאיחלופי ניחא‎ – It is understood according to רבא, who is concerned about איחלופי, the saying of בפני נכתב is justified אבל לרבה דידענו לא מהני אם כן לא אתי לאיחלופי מה צריך בפני נכתב‎ – However, according to רבה who maintains that ידענו is not valid, one must say בפני therefore it will never come to איחלופי, so why is בפני נכתב necessary לאחר שלמדו‎? It would seem that בפני נחתם should be sufficient. תוספות does not accept this interpretation of אי הכי (יכול\חד) נמי‎. For in the beginning of the second פרק it is apparent that since בפני נכתב was instituted originally according to רבה on account of לשמה‎ – מודה רבה דצריך לאומרו אפילו אחר שלמדו משום איחלופי: רבה admits that בפני נכתב is required to be said even לאחר שלמדו on account of איחלופי, and not merely משום שמא יחזור דבר לקלקולו‎. Therefore we cannot say that the גמרא thought that בפני נכתב should not be said. For in פ"ב it seems that once בפ"נ was instituted משום לשמה, then even לאחר שלמדו that תקנה of saying בפני נכתב remains משום איחלופי‎. S UMMARY The question of א"ה יכול נמי and א"ה חד נמי are not readily understood. Did the גמרא expect in the first א"ה, that לאחר שלמדו we should require קיום and not בפ"נ‎?! The second א"ה is even more difficult to understand; did the גמרא expect that by חד לאחר שלמדו there should be no בפ"נ and no קיום‎?! תוספות offers four possible solutions. 1. The ר"ת maintains that according to רבה the saying of בפ"נ is preferable over קיום (even לאחר שלמדו), since בפנו"נ offers us both קיום and לשמה‎. The first א"ה asks that קיום should be sufficient and בפ"נ not be required לאחר שלמדו‎. The second א"ה asks that שמואל should have also inquired of רב הונא if קיום חותמיו is sufficient by חד; that we not require בפ"נ since it is אחר שלמדו‎. 2. The ר"י explains that the two א"ה ask the same question; if the גט will not require קיום as in באותה מדינה (or אתיוהו בי תרי), there should be no need of בפ"נ. From the גמרא previously it seems however, that even לאחר שלמדו, nevertheless רבה maintains that even in these instances בפ"נ is required. 3. רש"י בכת"י originally maintained that the two א"ה questions did not assume that רבה אית ליה דרבא‎. The questions are therefore straightforward; לאחר שלמדו there is no need for בפ"נ if רבה לית ליה דרבא‎. Ultimately רש"י himself rejected this interpretation. 4. The two questions א"ה argued that לאחר שלמדו only בפני נחתם be said (for קיום) but not בפני נכתב‎. There is no need to say בפני נכתב משום איחלופי, since רבה maintains that ידענו לא מהני, therefore לא אתי לאיחלופי‎. תוספות rejected this explanation for in פ"ב it is משמע that once בפ"נ was instituted משום לשמה, the חכמים maintained it even לאחר שלמדו because of איחלופי‎. T HINKING IT OVER 1. It seems from the sר"ת' answer that בפנו"נ is preferable to קיום עדים even after שלמדו‎. Seemingly לאחר שלמדו (before we conclude thatגזירה שמא יחזור דבר לקלקולו), קיום is more preferable than בפ"נ, even according to רבה‎. What does the ר"ת mean when he says that בפ"נ עדיף מקיום חותמיו‎? 2. According to רבה what is the ruling לאחר שלמדו if an אלם brought a גט‎? Does the requirement of בפ"נ remain; or is קיום sufficient? 3. What are the relative advantages and difficulties of the פירושי ר"ת ור"י‎? 4. לאחר שלמדו, but before we accepted the סברא of גזירה שמא יחזור דבר לקלקולו, is ידענו valid according to רבה or not? If not, then why not, since there is only the concern of קיום‎? If yes, then there is the חשש of איחלופי; so how can we explain the הו"א of the 'ואין לפרש', who claims there is no חשש of איחלופי‎? 5. תוספות states that ידענו לא מהני according to רבה even לאחר שלמדו‎. How can we reconcile this with what the גמרא here states clearly that by שנים there is no need to say בפ"נ‎?

שלא תחלוק בשליחות‎—So as not to differentiate in שליחות O VERVIEW The גמרא concluded that even לאחר שלמדו nevertheless בפ"נ is required (according to רבה) because of the גזירה שמא יחזור דבר לקלקולו‎. The exception is by a מילתא דלא שכיחא, such as a פקח ונתחרש, and then קיום is sufficient. The גמרא attempts to refute this by quoting the משנה of האשה עצמה מביאה גיטה provided that she say בפ"נ; even though it is a מילתא דלא שכיחא‎! To which the גמרא responds that even by a מילתא דלא שכיחא the חכמים still require saying בפ"נ, because שלא תחלוק בשליחות‎. The obvious question here is: If לא תחלוק בשליחות requires saying בפ"נ even by a מילתא דלא שכיחא, how is it that the משנה of ואינו יכול states that by a פקח ונתחרש, קיום is sufficient?! Why do we not say there שלא תחלוק בשליחות as well?! תוספות answers this question. -------------------- פירוש בשליחות דיכול‎ – The meaning of the phrase שלא תחלוק בשליחות, that all שליחות should be the same, is referring (only) to those שליחות where the שליח is capable of saying בפ"נ. In those cases the חכמים insisted that all שלוחים say בפ"נ, even if it is a מילתא דלא שכיח, such as the case where the wife herself is the שליח הגט‎. However in cases where the שליח is not capable of saying בפ"נ, as in the case of פקח ונתחרש, then this rule of שלא תחלוק בשליחות does not apply. We permit that there be קיום instead of saying בפ"נ, since it is impossible to say בפ"נ. S UMMARY According to רבה, all שלוחים who are physically capable of saying בפ"נ, are required to do so, even if their שליחות is a מילתא דלא שכיחא, in order שלא תחלוק בשליחות‎. However in the case of a מילתא דלא שכיחא where one is physically incapable of saying בפ"נ, then קיום is sufficient, and בפ"נ is not required. T HINKING IT OVER Why is it that even after we conclude שלא תחלוק בשליחות; that all שליחות be the same, nevertheless we continue to differentiate between יכול and אינו יכול‎?

אי הכי בעל נמי‎—If this is so then the husband should also be required to say בפ"נ. O VERVIEW The גמרא previously concluded that (according to רבה) even לאחר שלמדו and even by a מילתא דלא שכיחא one is required to say בפ"נ. If that is so, that בפ"נ must always be said, then (the גמרא asks) why does the בעל not have to say בפ"נ when he delivers the גט‎. It seems from the entire גמרא, that only according to רבה, is the requirement to say בפ"נ somewhat diminished לאחר שלמדו‎. However, according to רבא this requirement retains its original status. Therefore we find questions only on רבה why is בפ"נ required in certain situations (by יכול, by אשה). These questions do not apply to רבא, for it is understood that his requirement to say בפ"נ is applicable unequivocally to all cases. Therefore it seems somewhat unusual, that the גמרא asks a question in which according to רבה there should be a requirement to say בפ"נ, and according to רבא there is no requirement. תוספות will explain this apparent inconsistency. -------------------- לרבא ניחא דכי מייתי ליה בעל ליכא למיחש לזיוף‎ – According to רבא it is understandable that the husband who brings a גט ממדה"י is not required to say בפ"נ (nor to have קיום), for when the husband brings the גט there can be no concern of forgery; he himself is bringing it. How can he claim that it is a forgery?! The only other possible option is that (he will claim that) the witnesses that he signed on the גט are פסול; that he forged them himself. This, however, is no real concern – דאינו חשוד להכשילה במתכוין‎ – for he is not suspect to intentionally harm her. He would never give her such a גט, that he himself knows that it is פסול‎. There is no reason to have him say בפ"נ. אלא לרבה בבעל נמי ליחוש שלא יערער דמתחילה לא היה יודע שצריך לשמה‎ – However, according to רבה, who maintains that בפ"נ is still required for לשמה on account of שמא יחזור דבר לקלקולו let us also be concerned if the husband brought the גט, to have him say בפ"נ, in order that he will not challenge the authenticity of the גט, by saying that originally he did not know that there is a requirement of לשמה by a גט‎. Now that he realized it, he is coming to notify בי"ד, of his inadvertent mistake that the גט was written (or signed) שלא לשמה‎. This is the question that the גמרא asks on רבה, that אי הכי בעל נמי; his saying בפ"נ will remove any possibility of ערעור‎. ומשני מינקט נקיט בידיה‎ – And the גמרא answers; ‘He is bringing it with his own hand’, so how can he possibly be מערער‎. Our תוספות will explain the meaning of the answer the גמרא gives: כיון דערעור זה אינו אלא לעז‎ – Since this challenge that the husband will level against the גט (that it was written שלא לשמה), is not taken seriously; it is merely only gossip. We do not suspect that the גט was written שלא לשמה, even if the husband claims so. The גמרא previously taught us; that since רוב בקיאין הן and סתם ספרא דדייני מיגמר גמירי, there is no real חשש of שלא לשמה‎. Therefore – ליכא למיחש שיערער כיון דנקיט ליה: There is no concern that he will challenge the גט since he is holding it. S UMMARY If a בעל, brings a גט to the אשה from מדה"י, he is not required to say בפ"נ. According to רבא it is obvious that it would be impossible for him to be מערער that he did not write it. He is also not suspect to intentionally forge the signatures of the עדי הגט‎. According to רבה we do not suspect that he will later be מערער‎. The entire ערעור is merely a לעז; there is no real concern for the כשרות הגט‎. When he himself delivers the גט, he will not challenge it. T HINKING IT OVER תוספות states that אינו חשוד להכשילה‎. It seems that if חשוד להכשילה, we would require the בעל to say בפ"נ. However if חשוד להכשילה, what would בפ"נ accomplish?!

בי תרי דמייתו גיטא כולי‎—Two שלוחים that bring a גט, etc - O VERVIEW The גמרא concludes that לאחר שלמדו there is a requirement to say בפ"נ (according to רבה) on account of שמא יחזור דבר לקלקולו‎. However by a מילתא דלא שכיחא such as בי תרי דמייתי גיטא then בפ"נ is not required. ------------------ לפי זה ליכא בינייהו לאחר שלמדו דאתיוה בי תרי‎ – According to this ; that when two שלוחים bring a גט they are not required to say בפ"נ, there is no difference לאחר שלמדו between רבה and רבא in the case where two brought the גט‎. The גמרא originally mentioned that by אתיוה בי תרי there would be a difference between רבה and רבא‎. According to רבה they would be required to say בפ"נ to testify that it was written לשמה‎. According to רבא, however בפ"נ is not required. There can be no ערעור of מזוייף‎. Now לאחר שלמדו even רבה will agree to רבא that by אתיוה בי תרי, no בפ"נ is required. אבל איכא בינייהו מקויים‎ – However there is a difference between רבה ורבא if the גט was מקויים‎. According to רבה there is a חיוב to say בפ"נ on account of לשמה because of the גזירה שמא יחזור דבר לקלקולו‎. A גט מקויים is not a מילתא דלא שכיחא‎. However according to רבא there is no need for saying בפ"נ by a גט מקויים‎. ולקמן בריש פרק שני (דף טז, ב) איכא למאן דאמר דשנים צריכין לומר‎ – And in addition later in the beginning of פרק ב' there is one who maintains that two שלוחים are required to say בפ"נ according to רבה‎ – אפילו לאחר שלמדו דלא חשיב לה מילתא דלא שכיחא‎ – Even לאחר שלמדו for he does not consider it to be a מילתא דלא שכיחא‎. According to that מ"ד, the איכא בינייהו of אתיוה בי תרי still remains. ולמאי דחשיב ליה מילתא דלא שכיחא‎ – And according to those that consider אתיוה בי תרי to be a מילתא דלא שכיחא‎ – הא דקתני בפרק ב' (לקמן טו, א) וב' אומרים בפנינו [נחתם] – That which the משנה teaches us in the beginning of פ"ב, ‘and two say that it was [signed] in our presence’, it is כשר providing that one of them say בפני נכתב‎. דדייק מינה רבה דידענו לא מהני‎ – From which רבה infers that saying ידענו even by two people is not sufficient; since the משנה did not say ושתים אומרים ידענו כשר but rather only if שנים אומרים בפנינו נחתם כשר; that proves they must say בפני[נו] אף על גב דמסתמא איירי אחר שלמדו‎ – Even though presumably that משנה is discussing the period of אחר שלמדו; why then indeed does the משנה state בפנינו which leads us to infer that had they said ידענו it would not be a גט כשר‎. This cannot be, for לאחר שלמדו, even if the two שלוחים said nothing it would be a גט כשר‎. מכל מקום נקט בפנינו משום דקודם שלמדו הוה בפנינו דוקא: Nevertheless, the משנה stated specifically the term בפנינו because before the era of למדו, when they were still אין בקיאין לשמה, then only saying בפנינו would suffice. If the people are אין בקיאין לשמה we need to be assured that the גט was executed לשמה‎. This can be accomplished only through saying בפנו"נ. However, ידענו only informs us that the חתימות העדים are not forged, but not that it was signed לשמה‎. It is only לאחר שלמדו when there is no חשש of שלא לשמה, and we say בפ"נ only on account of the גזירה שמא יחזור דבר לקלקולו, therefore by אתיוה בי תרי since it is a מילתא דלא שכיחא, the חכמים were not גוזר‎. The משנה states בפנינו to inform us that the original תקנה of saying בפ"נ was instituted (also) on account of אין בקיאין לשמה, wherefore ידענו would have been insufficient. S UMMARY There is a מחלוקת in פ"ב whether שנים שהביאו גט is considered a מילתא דלא שכיחא and does not require בפ"נ, or whether it is not a מילתא דלא שכיחא and בפ"נ is required (according to רבה). The גמרא originally stated that one practical difference between רבה ורבא is the case of אתיוה בי תרי‎. If we maintain that אתיוה בי תרי is not a מילתא דלא שכיחא then that difference remains. If however we consider אתיוה בי תרי to be a מילתא דלא שכיחא, then that difference ceases to exist between רבה ורבא for they both agree that בפ"נ is not required. Nevertheless there will be a similar case where there will be the same difference between רבה ורבא‎. This is the case of a גט מקויים‎. According to רבה the שליח will have to say בפ"נ, for this is certainly not a מילתא דלא שכיחא (and שלא תחלוק); and according to רבא there will be no need to say בפ"נ. In addition, according to the opinion that אתיוה בי תרי is a מילתא דלא שכיחא, then לאחר שלמדו there will be no need to say בפנינו נחתם (in fact they have to say nothing). The reason the משנה states in the beginning of פ"ב that ושנים אומרים בפנינו נחתם, is to teach us that originally the תקנה was on account of לשמה, whereupon בפני was required and ידענו is insufficient. However לאחר שלמדו there is no requirement of בפני in the case of בי תרי דמייתי גיטא‎. T HINKING IT OVER The גרע"א poses the following challenging question in the גליון הש"ס. This rule that בי תרי דמייתא גיטא is a מילתא דלא שכיחא and does not require בפ"נ, is only if they are both שלוחים‎. For two שלוחים are a מילתא דלא שכיחא, and לאחר שלמדו they are not required to say anything. If however there is only one שליח, who says בפני נכתב and two others who are not שלוחים say ידענו, it is not valid (according to רבה). It is not a We do not have confirmation that it was נחתם לשמה‎. We are required to say בפני even לאחר שלמדו by a מילתא דשכיחא because שמא יחזור דבר לקלקולו‎. The גמרא states clearly in פ"ב that according to the מ"ד that שנים שהביאו גט אין צריכים לומר בפ"נ, then the משנה in פרק ב' is discussing only cases where only one is a שליח and the other(s) are not שלוחים. The case תוספות is discussing here from פ"ב where א' אומר בפני נכתב וב' אומרים בפנינו נחתם, there is only one שליח‎. The two that state בפנינו נחתם are not שלוחים‎. It is definitely not a In such a case ידענו is certainly not sufficient (according to רבה). We are required to say בפני even לאחר שלמדו because of the גזירה שמא יחזור דבר לקלקולו‎. How can תוספות say that it says there בפנינו only because of קודם שלמדו, when in truth even לאחר שלמדו, nevertheless בפנינו נחתם is required since the two are not שלוחים‎?!

שלא תחלוק בשליחות‎—So as not to differentiate in שליחות Overview The גמרא concluded that even לאחר שלמדו nevertheless בפ"נ is required (according to רבה) because of the גזירה שמא יחזור דבר לקלקולו‎. The exception is by a מילתא דלא שכיחא, such as שנים שהביאו גט, where nothing is required; neither בפ"נ nor קיום‎. The obvious question here is: If לא תחלוק בשליחות requires saying בפ"נ even by a מילתא דלא שכיחא, how is it that by שנים שהביאו גט nothing is required?! Why do we not say there שלא תחלוק בשליחות as well?! תוספות deals with this question. ------------------- פירוש בשליחות דחד דגזרינן חד שלא שכיח אטו חד דשכיח – The explanation of the phrase שלא תחלוק בשליחות is to be understood to be referring to a שליחות of one person, for then we make a decree in the case of one שליח even when it is not שכיח, that he be required to say בפ"נ on account of one שליח where it is שכיח‎. If we would not require this one שליח to say בפ"נ (even) in a case which is not שכיח (for instance האשה עצמה שהביאה גיטה), then it may lead that we may inadvertently not require even by a case that is שכיח, that the שליח say בפ"נ. People may not distinguish between שכיח and לא שכיח‎. However, we do not make a decree that two should say בפ"נ on account of one. There is no concern that if we exempt two שלוחים from saying בפ"נ that it may lead that we will not require בפ"נ from even one שליח‎. Everyone will be able to distinguish two שלוחים from one שליח‎. Therefore it is understood that even though we maintain שלא תחלוק בשליחות that all שליחות be required to say בפ"נ; nevertheless this ruling is limited only to single שלוחים, but not if there is more that one שליח‎. In a case of two שלוחים then בפ"נ is not required. S UMMARY שלא תחלוק בשליחות applies to a שליחות of one; not to a שליחות of two. T HINKING IT OVER There is a similar תוספות previously discussing the same idea concerning יכול and אינו יכול‎. In that תוספות, there was no explanation given why אינו יכול is not included in the תקנה of שלא תחלוק בשליחות‎. It was just a terse statement of fact. Why did תוספות find it necessary here to explain the difference between חד and בי תרי‎?

כשניסת‎—When she was married already O VERVIEW The גמרא concluded that according to רבה, the ברייתא that states that if the שליח did not say בפ"נ the גט will be כשר if נתקיים בחותמיו, is under the following two conditions: a) לאחר שלמדו, and b) כשניסת‎. There are two differing opinions regarding sר' יוחנן' position in the case of שנים שהביאו גט; whether בפ"נ is required or not. If we assume the position that בפ"נ is required it would also indicate that ר"י agrees with רבה that saying בפ"נ is on account of לשמה‎. If however we assume that בפ"נ is not required it would also indicate that ר"י agrees with רבא that בפ"נ is on account of קיום‎. ------------- תוספות responds to an anticipated difficulty: והא דתניא לקמן לא אמר בפני נכתב ובפני נחתם הולד ממזר – And regarding that which we learnt later in a ברייתא, ‘if the שליח did not say בפנו"נ, the child that is born to a woman who remarried after receiving this גט, that child is a ממזר‎.’ We see from this ברייתא that even if the woman remarries, nevertheless if בפ"נ was not said she is not מגורשת‎. Here however we say that if she remarried it does not matter that בפ"נ was not said. It is כשר בדיעבד and the child is certainly not a ממזר‎. תוספות answers; the ruling there that the child is a ממזר‎ – היינו כשלא נתקיים בחותמיו – is applicable only when the גט was not מקויים בחותמיו‎. However our גמרא states that (only) if it was מקויים (and she is already married), then the גט is כשר בדיעבד‎. תוספות asks: ואם תאמר וליחשביה (לקמן דף פו, א) בהדי ג' גיטין פסולין ואם ניסת הולד כשר‎ – And if you will say; let this case be counted among the three types of גיטין that are פסול, however if she remarries the child is כשר‎. This case of ולא אמר בפ"נ ונתקיים בחותמיו should be a fourth case (according to רבה), in which the גט is initially פסול, however if she remarries on the basis of this גט, the child is not a ממזר‎. תוספות answers: ויש לומר דקסבר רבה דבג' גיטין תצא והכא לא תצא‎ – And one can say; that רבה maintains that concerning the three גיטין mentioned in that משנה she must leave her new husband; even though the child is not a ממזר, however here in the case of לא אמר בפ"נ she is not required to leave her new husband. She may remain married to him. Therefore the משנה did not add this case to the three mentioned there. תוספות asks: ואם תאמר להאי לשנא דבפרק ב' (לקמן דף יז, א) דאית ליה לרבי יוחנן‎ – And if you will say; according to the view in פ"ב in which ר' יוחנן maintains, that – שנים שהביא גט ממדינת הים צריכין לומר בפנינו נכתב כולי‎ – Two שלוחים who brought a גט ממדה"י, are required to say בפ"נ etc. – משמע דקסבר לפי שאין בקיאין לשמה‎ – This indicates that ר' יוחנן maintains that the reason for saying בפ"נ is on account of אין בקיאין לשמה‎. For if the reason were on account of קיום there is no need to say בפ"נ if two שלוחים brought the גט, so according to this לישנא‎ – היכי משני הך ברייתא דהכא‎ – How will ר"י explain this ברייתא here which states that if בפ"נ was not said, and there was קיום it is כשר‎. If he agrees with רבה that בפ"נ is required on account of לשמה, how can קיום validate the גט‎ – דאי משני ליה כשניסת אם כן ליחשביה (לקמן דף פו, א) בהדי ג' גיטין פסולין‎ – For if ר"י will interpret the ברייתא in a case where she already remarried; if that is indeed so, then let him include this case of כשניסת among the three גיטין that are פסול, and nevertheless ואם ניסת הולד כשר‎. The same question תוספות asked previously on רבה‎. We cannot answer in the same manner as previously, namely that ר"י maintains that concerning the ג' גיטין the דין is תצא, and in our ברייתא the דין is לא תצא‎ – דהא ר' יוחנן אית ליה בפרק ט' (שם) דג' גיטין נמי לא תצא‎ – For ר"י maintains in פ"ט that by those ג' גיטין the דין is also לא תצא, just like in our ברייתא‎. The question remains according to ר"י why does not the משנה add the case of the ברייתא to the ג' גיטין פסולין ואם נישאת הולד כשר‎. תוספות will present a possible answer and refute it. ואין לומר דלא חשיב אלא פסול התלוי בגט עצמו‎ – And we cannot answer, that the reason our case is not added to the ג' גיטין, is because the משנה does not count every פסול, only a פסול that is dependent in what is written in the גט itself. The פסול of the ג' גיטין is in the manner in which the גט was written; אין עליו עדים, אין בו זמן, אין בו אלא ע"א, however the פסול in our ברייתא is not a פסול in the גט, but rather in the אמירת בפ"נ. That may be the reason why the משנה does not include it. תוספות refutes this answer; it cannot be so – דהא אמרינן בפרק ט' מנינא דסיפא למעוטי‎ – For the גמרא says in פ"ט concerning the משנה of ג' גיטין, ‘ the number in the סיפא comes to exclude.’ The משנה states ג' גיטין פסולין וכו' and enumerates them ; afterwards the משנה concludes הרי אלו שלשה גיטין פסולין‎. After explaining what the first number (ג' גיטין) comes to exclude, the גמרא explains that the second number (הרי אלו ג' גיטין) comes to exclude a case – נתנו לה ולא אמר בפני נכתב יוציא והולד ממזר‎ – Where he gave her the גט and did not say בפ"נ and there was no קיום, the new husband must send her away and the child from the new husband is a ממזר‎. If the משנה is only discussing פסולין in the גט itself, and it is not discussing פסולין arising from אמירת בפ"נ, then how does the גמרא say that the second number comes to exclude a case of ולא אמר בפ"נ; that case is not within the range of פסולין which we are discussing. The fact that the גמרא maintains that the second מנין comes to exclude ולא אמר בפ"נ, proves that the משנה is discussing all types of פסולין, whether a פסול in the גט itself or a פסול in the אמירת בפ"נ. The question remains why according to ר"י did the משנה of ג' גיטין פסולין not include the case of לא אמר בפ"נ ונתקיים בחותמיו that it is a פסול לכתחילה and בדיעבד כשניסת הולד כשר‎? תוספות answers: ואומר רבינו יצחק דההוא מילתא דרבי יוחנן דסבר לא תצא‎ – And the ר"י states; this ruling of ר' יוחנן in which he is of the opinion that by the ג' גיטין פסולין the דין is לא תצא, this ruling – קאי כלישנא קמא דבפרק ב' (לקמן דף טז, ב) דאית ליה לרבי יוחנן‎ – Follows the first view in פ"ב that ר"י is of the opinion that בפ"נ is required – לפי שאין עדים מצויין לקיימו וכמסקנא דשמעתין‎ – Because אין עדים מצויין לקיימו as is the conclusion of that גמרא‎. Therefore there is no question. ר"י who maintains לא תצא by ג' גיטין פסולין also maintains that קיום is sufficient; therefore this ברייתא that states: ולא אמר בפ"נ אם נתקיים בחותמיו כשר is discussing even קודם שניסת‎. This גט is כשר לכתחילה if נתקיים בחותמיו‎. It is not one of the גיטין פסולין‎. However the other opinion of ר"י which agrees with רבה may also maintain that by the ג' גיטין תצא and therefore this ברייתא cannot be included. תוספות offers another answer: אי נמי יאמר דהך דרבה ורבא תנאי היא – Or you may also say that the מחלוקת between רבה ורבא is indeed a מחלוקת of תנאים‎. ר"י who maintains that ג' גיטין פסולין לא תצא, also maintains the טעם of לשמה, which will force us to say that this ברייתא is discussing only כשניסת‎. Concerning the question why the משנה does not add the case of this ברייתא to the list of גיטין פסולין ואם ניסת הולד כשר, that is because the משנה of ג' גיטין follows the opinion of רבא, therefore it could not include this ברייתא in the ג' גיטין, because according to רבא it is a גט כשר לכתחילה‎. However ר"י himself as well as רבה will maintain that it is a גט פסול ואם ניסת הולד כשר‎.The fact that this specific משנה did not include it does not disprove רבה\ר"י for they follow the opinions of other תנאים who argue with that משנה, and maintain that the טעם for saying בפ"נ is on account of לשמה‎. כדבעינן נמי למימר בפרק שני (גם זה שם) לרבי יוחנן: as the גמרא also attempted to say in פ"ב according to ר"י. At one point the גמרא thought that the מחלוקת between ר' יהודה and the רבנן in the case of שנים אומרים בפנינו נכתב ואחד אומר בפני נחתם פסול ור"י מכשיר is equivalent to the מחלוקת between רבה ורבא (which is mirrored in the two לשונות of ר' יוחנן). The רבנן follow רבה therefore it is פסול and ר"י follows רבא therefore it is כשר‎. We see that the גמרא considered that רבה ורבא תנאי היא‎. We can say so as well according to this opinion of ר"י. S UMMARY According to רבה, if בפנו"נ was not said, if the woman remarries the דין is: (according to ר"מ) תצא והולד ממזר, provided it was not מקויים‎. If it was מקויים then the גט is כשר בדיעבד‎. The case of לא אמר בפנו"נ and נתקיים בחותמיו is not included in the (ג') גיטין פסולין ואם נשאת הולד כשר, because according to רבה in our ברייתא the דין is לא תצא and by the ג' גיטין the דין is תצא‎. There are two differing opinions regarding sר' יוחנן' position in the case of שנים שהביאו גט; whether בפ"נ is required or not. If we assume the position that בפ"נ is required it would also infer that ר"י agrees with רבה that בפ"נ is required on account of לשמה‎. ר"י is also of the opinion that concerning the ג' גיטין the דין is לא תצא‎. Nevertheless according to ר"י the case of the ברייתא is not added to the ג' גיטין; either because we will assume that the position of ר"י of לא תצא regarding the ג' גיטין, follows the other opinion of ר"י concerning ב' שהביאו גט that בפ"נ is not required; which places ר"י in agreement with רבא‎. Or we can maintain that the opinion concerning לא תצא is according to either view of ר"י in the case of ב' שהביאו גט‎. However the משנה of ג' גיטין follows the view of רבא and not of רבה‎. ר"י and רבה follow the view of other תנאים who may argue with the implications of this משנה‎. T HINKING IT OVER 1. Explain the difference: If בפ"נ was not said and there was no קיום then תצא והולד ממזר‎. If however there was קיום and no בפ"נ then it is כשר בדיעבד (even according to רבה). 2. Can we reconcile the previous issue if we assume that the ר"י in תוספות on ג, א ד"ה חד is referring to רבא as well?
