    Gittin 20a

    Chapter 2 - HaMevi Batra

גם: גיטין דף כ׳ ע״א, פרק ב׳ המביא בתרא

    English translation - Gittin 20a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1If there is a concern that the Torah scroll can effect a divorce due to the verses concerning severance of marriage that there are in it, as it is written: “And he writes her a scroll of severance” (Deuteronomy 24:1), this is also not problematic, since it is required, as it states: “And he writes her.” This indicates that the bill of divorce must be written for her sake, i.e., it must be written for the express intent of being used to effect divorce between this specific man and this specific woman, and this is not so in the case of a Torah scroll.

2And if you would say that there is reason to be concerned that perhaps he first gave a dinar to the scribe at the outset, when he wrote the Torah scroll, and told him to write the verses discussing divorce for his wife’s sake, isn’t there a need for other things to be written in a bill of divorce as well, as the mishna (80a) teaches: If the scribe changed his name or her name, the name of his city or the name of her city, then the bill of divorce is invalid. The validity of a bill of divorce depends upon these details being written, and they are not in the Torah scroll.

3The Gemara asks: But if so, what is Rav Yosef teaching us with his statement? It seems obvious that there is no reason why a Torah scroll could be used as a bill of divorce. The Gemara says: He is teaching us that gall water is not permanent when applied on top of gall water. The novel idea is that there is no need to be concerned that the scribe wrote a bill of divorce in gall water on the outside of the Torah scroll.

4§ Rav Ḥisda says: If a bill of divorce was written not for her sake, and the scribe passed over it with a reed pen, meaning that he wrote on top of what was already written, for her sake, then here we have arrived at the dispute between Rabbi Yehuda and the Rabbis.

5As it is taught in a baraita : If a scribe writing a Torah scroll was at a point in the text that he needed to write the name of God, spelled yod , heh , vav , heh ; and he erred and intended to write Yehuda, spelled yod , heh , vav , dalet , heh , but he made a mistake when writing Yehuda and did not place a dalet in the word, thereby unintentionally writing the name of God in the correct place, then he should pass over it with a reed pen. He writes over what was written and sanctifies it with the intention that he is writing the name of God. This is the statement of Rabbi Yehuda. And the Rabbis say: Even if he adds a second layer of ink, the name has not been written in the optimal manner. According to Rabbi Yehuda, one can supply the intention of writing the name of God for its own sake even when adding a second layer of writing over the first, while according to the Rabbis one cannot. The same dispute would presumably apply in the case of a bill of divorce.

6Rav Aḥa bar Ya’akov said: Perhaps that is not so, and the Rabbis say only there, in the case of a Torah scroll, that one may not write the name of God in this manner, because it is required that one perform anything sacred, including the writing of a Torah scroll, in accordance with the verse: “This is my God, and I will glorify Him” (Exodus 15:2). This verse requires that mitzvot be performed in a way that is glorious and aesthetically pleasing, and rewriting in this manner is not considered beautiful. But here, with regard to a bill of divorce, there is no requirement that the bill of divorce be written beautifully, and therefore writing over the bill of divorce is acceptable according to the Rabbis as well.

7§ Rav Ḥisda said: I am able to invalidate all the bills of divorce in the world. Most bills of divorce are written in a way that they could be declared invalid. If one were to be particular about certain details, then there would be no valid bills of divorce. Rava said to him: What is the reason that you could invalidate them? If we say: Most bills of divorce are invalid because it is written in the Torah: “And he writes her a scroll of severance” (Deuteronomy 24:1), and here, in the case of most bills of divorce, she writes it for him, as it is customary for a woman to pay a scribe to write the bill of divorce, but then perhaps it could be maintained that the Sages transferred the ownership of the bill of divorce to him, and it is considered as if he wrote it.

8But rather, you might say that it is because it is written: “And gives” (Deuteronomy 24:1), which is usually understood to mean that the item given must have some monetary value, and here in the case of most bills of divorce he doesn’t give her anything of value. Perhaps the mere giving of the bill of divorce is the giving mentioned in the Torah, even if it does not have any monetary value. Know that it is not a requirement that the bill of divorce have monetary value, as the Sages sent this message from there, from Eretz Yisrael: If he wrote a bill of divorce on items from which benefit is forbidden, then although the bill of divorce is completely lacking monetary value, the bill of divorce is valid.

9§ The Gemara discusses the matter itself: The Sages sent this message from there, from Eretz Yisrael: If he wrote a bill of divorce on items from which benefit is forbidden, the bill of divorce is valid. Rav Ashi said: We, too, learn in the mishna that a bill of divorce may be written on an olive leaf, which has virtually no monetary value. This teaches that the bill of divorce need not have any value on its own, and even forbidden items, which have no value at all, may be used as the base on which the bill of divorce is written. The Gemara rejects this: Perhaps an olive leaf is different, because it can combine with more leaves, and they will add up to have monetary value. However, an item from which one is prohibited from benefiting lacks value entirely, even in large quantities.

10With regard to the same halakha , the Gemara quotes an additional source. It is taught in a baraita that Rabbi Yehuda HaNasi says: If the scribe wrote a bill of divorce on items from which benefit is forbidden, it is valid. Levi went out and expounded upon this halakha in the name of Rabbi Yehuda HaNasi, and they did not praise him. He then expounded this halakha in the name of the majority, as an unattributed halakha , and they praised him. Apparently, the halakha is in accordance with the opinion of Rabbi Yehuda HaNasi. Therefore, when he stated the halakha in the name of Rabbi Yehuda HaNasi, an individual, which may have led the listeners to think that it was a minority opinion and not the accepted halakha , they did not praise him.

11§ The Sages taught that it is said in the Torah with regard to a bill of divorce: “And he writes her a scroll of severance,” in order to emphasize that one must write the document and not chisel it. The Gemara asks: Is this to say that chiseling is not writing? And the Gemara raises a contradiction based on what was taught in a baraita : If a slave is emancipated through a bill of manumission that was written by being chiseled on a slate [ tavla ] or on a tablet [ pinekas ], then he goes free. However, he does not go free through writing on a cap or on an embroidered adornment. If the master embroidered the bill of manumission onto a cloth and gave it to the slave, this is not considered to be like the writing of a document. In any case, the baraita teaches that a bill of manumission that is chiseled onto a slate is valid.

12Ulla said that Rabbi Elazar said: It is not difficult. This case, where the document is not valid because engraving is not considered to be writing, occurs when the scribe chiseled the area surrounding the letters, i.e., he chiseled on the surface around the shape of the letters, leaving the letters raised on the tablet. This case, where the document is valid because chiseling is considered to be writing, occurs when he chiseled the parts of the letters, i.e., he chiseled the shape of the letters themselves onto the slate. Since he formed the letters directly, it is considered like writing.

13The Gemara asks: And if he chiseled the area surrounding the letters, is this not considered to be writing at all? And the Gemara raises a contradiction based on what was taught: The writing of the High Priest’s frontplate was not embedded, i.e., it was not carved into the frontplate; rather, it protruded like the form on gold dinars. And isn’t the shape on gold dinars formed by chiseling the area surrounding the letters, by applying pressure around the shape, so that the image and writing protrudes, and yet this is considered to be writing?

14The Gemara answers: It means that the frontplate was fashioned like the form of gold dinars but not entirely like the form of gold dinars. It was fashioned like the form of gold dinars in that the writing protrudes, but it was not fashioned like the form of gold dinars entirely, as there, in the case of gold dinars, they chiseled the area surrounding the letters. Here, when making the frontplate, the inscription was done by chiseling the parts of the letter, i.e., they would carve the letters from the back of the frontplate so that they protruded from the front. Since the letters were carved directly, it was considered to be writing.

15With regard to this issue, Ravina said to Rav Ashi: Does the press that forms a metal coin carve out the background in the metal and the image of the coin is formed on its own, or does it compress the metal inward toward the empty space in the press and the letters are formed through this? He said to him: It carves out the background.

16He raised an objection to his opinion based on what was taught earlier: The writing of the High Priest’s frontplate was not embedded, i.e., it was not carved into the frontplate; rather, it protruded like the form on gold dinars. And if it enters your mind to say that a press only carves out the background,

    Tosafot

אי משום כריתות דאית בה הא בעינן וכתב לה לשמה וליכא‎—If it is because of the כריתות which is there, but we require that he write it for her sake, and it is lacking O VERVIEW רב יוסף ruled that there is no concern for גירושין if the husband gave his wife a ספר תורה as a גט, for even though it mentions כריתות in the תורה (regarding גירושין) but it was not written לשמה‎. Our תוספות compares and distinguishes between the לשמה laws of גיטין and מגילת סוטה‎. --------------------- תוספות asks: תימה דלענין מגילת סוטה משמע בפרק קמא דעירובין (דף יג, א) דמוחקין לה מן התורה – It is astounding! For in the first פרק of מסכת עירובין, regarding the scroll of a סוטה it is apparent that we may erase it from the תורה scroll – אפילו למאן דבעי כתיבה לשמה‎ – Even according to the one who maintains that a מגילת סוטה requires כתיבה לשמה תוספות proves this: דקאמר רב פפא דלמאן דאמר אין מגילתה כשרה להשקות בה סוטה אחרת‎ – For רב פפא ruled that even according to the one who maintains that the scroll of one סוטה is not fit to be used for another סוטה to drink from it (indicating that the מגילת סוטה must be written לשמה); nevertheless – תורה דסתמא כתיבה הכי נמי דמחקינן – The תורה, which is written in general, indeed we can erase it and it is fit to be used by any סוטה‎. תוספות answers: ויש לומר דרב יוסף דשמעתין לא סבר לה כוותיה‎ – And one can say; that רב יוסף of our גמרא (who invalidates a ס"ת for a גט) does not agree with ר"פ. Rather he maintains that if a מגילת סוטה requires לשמה, then a ס"ת is not valid (and similarly by גט, since it requires לשמה, a ס"ת is פסול). תוספות offers an alternate solution: אי נמי סבר כאידך תנא דסבר אין מוחקין לה מן התורה – Or you may also say; the רב יוסף agrees with the other תנא who maintains one may not erase the פרשת סוטה from the תורה for a סוטה‎ – תוספות explains this (latter) view of רב יוסף‎ – וכמתניתין דבפרק כל הגט (לקמן דף כו, א) – And like the משנה of פרק כל הגט‎ – דתנן הכותב טופסי גיטין צריך שיניח מקום האיש כולי‎ – Where the משנה states, ‘one who writes the text forms of גיטין should leave blank the place for the name of the husband, etc.’ – ודייק מהתם בריש מסכת זבחים (דף ב, ב) דסתמא פסול‎ – And the גמרא in the beginning of מסכת זבחים infers from that משנה (in גיטין) that סתמא is פסול, when there is a requirement of לשמה; and since it is פסול if the סופר included the names – וכל שכן ספר תורה דלא איכתוב לשם גירושין כלל – So certainly a ס"ת is פסול for גירושין, since it was not written for גירושין at all. תוספות offers an alternate distinction between סוטה and גט : ועוד נראה דאפילו מאן דמכשיר במגילת סוטה למחוק מן התורה אף על גב דבעי לשמה – And it appears furthermore, that even the one who is מכשיר to erase a מגילת סוטה from a ס" ת, even though there is a requirement of לשמה by מגילת סוטה, nevertheless – מודה לענין גט דפסול‎ – He will admit that by גט it is פסול to use a ס"ת – תוספות proves this point: דבעירובין בפרק קמא (דף יג, א) משמע דכולהו תנאי מודו בהנך דפרק כל הגט – For it seems in the first פרק of מסכת עירובין that all the תנאים (that discuss מגילת סוטה) admit regarding all these cases of פרק כל הגט‎ – דחשיבי שלא לשמה‎ – That they are considered שלא לשמה and are פסול for a גט – מדפריך התם ולית ליה לרב אחא בר יאשיה כתב לגרש את אשתו ונמלך כולי – For the גמרא asks there (in עירובין), ‘ and does ראב"י not agree with the משנה that one who wrote a גט to divorce his wife and reconsidered, etc. another couple (with the same names) cannot use his גט’. תוספות continues to explain the difference between סוטה and גט: ובמגילת סוטה סתמא כשר‎ – And by מגילת סוטה if it is written סתמא (like a ס"ת), it is כשר (according to some views) – משום דמסתמא שאין הכהן שעליו לכתוב מקפיד ומסתמא ניחא ליה‎ – For presumably the כהן who has to write the מגילה is not particular and he is satisfied if it is written סתמא‎ – אבל גבי גט בעל סתמא לא ניחא ליה – However, regarding a גט, the husband presumably is not satisfied if it is written סתמא‎ – תוספות responds to an anticipated question: אף על גב דפריך ממתניתין דגט ארבי אחא בר יאשיה דאיירי במגילת סוטה‎ – Even though the גמרא asks from the משנה in גיטין on ראב"י who is discussing מגילת סוטה; this (seemingly) shows us that they are similar, so how are we differentiating between (סתמא of) סוטה and (סתמא of) גט, nevertheless – לענין שלא לשמה לא משמע ליה לחלק: Regarding שלא לשמה it did not seem a ppropriate to distinguish between the two, even though we can distinguish between the two סתמא‎. S UMMARY Regarding סתמא (or ס"ת) by סוטה, רב יוסף can maintain that there are תנאים who maintain that it is פסול or that (even though שלא לשמה is פסול by סוטה, nevertheless) the סתמא by סוטה is more לשמה than the סתמא by גט). T HINKING IT OVER 1. תוספות compares מגילת סוטה to גט and asks just as a ס"ת is כשר for מגילת סוטה it should also be כשר for a גט אשה‎. However, there are seemingly incomparable, for the מגילת סוטה is written exactly as it is written in the ס"ת; however the אשה is totally different than what is written in the ס"ת; how can תוספות compare the two?! The גמרא asks on the ruling of רב יוסף (that a ס"ת is not כשר for a גט), ‘what is the novelty’. Seemingly according to תוספות there is a חידוש that it is different than סוטה; why does the גמרא ask, מאי קמ"ל‎?!

הא בעינן שמו ושמה‎—For we require his name and her name O VERVIEW רב יוסף rules that a ס"ת cannot be used for גירושין and even if the husband paid the סופר to write the פרשה of גירושין for the purpose of divorcing his wife, nevertheless it will not be a valid גט since we require the husband’s and wife’s names in the גט‎. Our תוספות discusses the פסול of not writing the proper names in a גט‎. --------------------- תוספות anticipates the following question: אף על גב דמתניתן דפרק הזורק (לקמן דף פ, א) דשינה שמו ושמה – Even though that regarding the משנה in פרק הזורק, where ‘he changed his name and her name’ ( in the גט) the גמרא there – מוקמינן לה דהאי הולד ממזר כרבי מאיר – Establishes that which the משנה concludes (that if it was שינה שמו ושמה) the child is a ממזר, this ruling is according to ר"מ – משמע דלרבנן לא הוי בשינה שמו אלא פסולא דרבנן‎ – Indicating that according to the רבנן, the case of שינה שמו is only פסול מדרבנן‎ – ומדנקט שינה ולא נקט לא כתבו כלל משמע דבלא כתבו כלל כשר אפילו מדרבנן – And since the משנה mentioned שינה, but it did not mention a case where no name was written at all, this indicates that where they did not write any name(s) at all in the גט is כשר even מדרבנן, so what is רב יוסף stating that the ס"ת is not a valid גט since there are no names, when from the גמרא later it appears that a גט without names is כשר even מדרבנן‎ – תוספות responds: הא ליתא דעל כרחך לא כתבו כלל לרבי מאיר פסול מן התורה‎ – This is not so (that a גט without names is כשר), for perforce according to ר"מ if they did not write the names at all it is פסול מן התורה (not only מדרבנן) – דהא בעינן שיהא מוכיח מתוכו שהוא מגרש את אשתו ובלא כתבו כלל אין מוכיח – Because it must be evident from the גט that he is divorcing his wife and if they did not write the names there is no evidence at all – תוספות now resolves this issue: אלא אומר רבינו יצחק דלא מיירי בשינה שמו ממש‎ – Rather, states the ר"י that the משנה is not discussing a case where he actually changed his name (he wrote a false name) – דאם כן הוה ליה למינקט לא כתבו כלל דפסול לרבי מאיר‎ – For if indeed the משנה meant a false name, then the משנה should have rather mentioned the case where they did not write any names which is פסול according to ר"מ – דמתניתין רבי מאיר כדאמרינן התם דהוי רבותא טפי‎ – For that משנה is according to ר"מ as the גמרא states there, therefore instead of mentioning a case of a false name the משנה should have discussed a case of no name at all, w hich is a greater novelty (that it is פסול, than a false name), therefore we must conclude that שינה שמו does not mean a false name (for that is פסול מדאורייתא) – אלא שינה שמו היינו שכתב שם דגליל ביהודה – But rather שינה שמו means that he wrote the name that he is called in גליל, he wrote it in the גט that he was giving in יהודה (where he is not known by that name) – והשתא קאמר הכא שפיר הא בעינן שמו ושמה וליכא‎ – And now רב יוסף rightfully states here, ‘but we require that the שמו ושמה in the גט are to be the local names used here, and if it is lacking, the גט is פסול – [וכל שכן] דבלא כתבו כלל הוא דפסול: [So certainly] if they did not write any name at all, it is פסול‎. S UMMARY שינה שמו ושמה means he wrote שמו של יהודה in גליל‎. If there are no names in the גט it is פסול מדאורייתא according to ר"מ (and also if it is a false name). T HINKING IT OVER Is תוספות גורס שינה שמו ושמה in our גמרא or he omits the word שינה‎? Appendix The גמרא there actually states אמר ר"א אמר ר"ה אמר רב זו דברי ר"מ (referring to the other cases of the משנה such as כתב לשם מלכות שאינה הוגנת, etc.), אבל חכמים אומרים הולד כשר (in the aforementioned cases), ומודים חכמים לר"מ שאם שינה שמו ושמה וכו' שהולד ממזר‎. This seemingly contradicts entirely that which תוספות is stating that הולד ממזר by שינה שמו ושמה is (only) according to ר"מ. Many commentaries explain תוספות in the following manner; all the פסולים in that משנה (besides שינה שמו ושמה) are according to ר"מ only, because he maintains כל המשנה ממטבע שטבעו חכמים בגיטין יוציא והולד ממזר‎. This indicates that this rule of והולד ממזר is only מדרבנן (but not מדאורייתא), as the expression of כל המשנה ממטבע שטבעו חכמים בגיטין indicates. It therefore appears that when the גמרא states regarding שינה שמו ושמה that the חכמים are מודה to ר"מ that הולד ממזר, this means it is a ממזר מדרבנן (for in this case [as opposed to the others] the חכמים are מודה to ר"מ, who always maintains הולד ממזר [מדרבנן]). In conclusion both ר"מ and the חכמים agree that by שינה שמו ושמו the ולד is a ממזר only מדרבנן; indicating that in a case of no name at all (which is less שלא לשמה) there is not even a פסול דרבנן‎. It will be necessary to say that when תוספות writes: אף על גב דמתניתן דפרק הזורק דשינה שמו ושמה מוקמינן לה דהאי הולד ממזר כרבי מאיר, he is referring to the entire משנה as the משנה of שינה שמו ושמה (which includes other cases as well), but not (only) to the specific case of שינה שמו ושמה; for (even though the entire rest of the משנה is only according to ר"מ, nevertheless) the case of שינה שמו ושמה is both according to ר"מ and the חכמים‎.

דילמא נתינת גט הוא‎—Perhaps it is the giving of the גט O VERVIEW The גמרא concludes that when the תורה writes ונתן בידה by a גט, it does not mean that he must give her something of value, but rather that he merely must give her the גט (even if it is פחות משוה פרוטה). תוספות discusses whether the term נתינה means giving something of value. ---------------------- וכן שלף איש נעלו ונתן לרעהו (רות ד) לא בעינן שוה פרוטה אף על גב דכתיב ונתן‎ – And similarly regarding the פסוק of שלף איש נעלו ונתן לרעהו‎ – a person would remove his shoe and give it to his friend; there is no requirement that the item with which we perform קנין חליפין should be worth a פרוטה even though the פסוק writes ונתן (supporting our גמרא that even if it says ונתן there is no requirement for a שוה פרוטה)- וכן גבי תרומה חטה אחת פוטרת את הכרי אף על גב דכתיב (דברים יח) תתן לו‎ – And similarly regarding תרומה, the rule is that one kernel of wheat (which is set aside for תרומה) exempts the entire heap of grain even though concerning תרומה it is written תתן לו nevertheless there is no requirement of a שוה פרוטה; one חטה is sufficient – ובמתנות דם חטאת ובמתנות בהונות אין בו שיעור‎ – And there is no set amount by the placing of the חטאת blood on the מזבח or by the placing (of blood and oil) on the thumbs even though the term נתינה is mentioned there – תוספות anticipates a difficulty: והא דאמר אבא שאול בפרק כל שעה (פסחים דף לב, ב) דזר שאכל תרומה‎ – And that which אבא שאול ruled in פרק כל שעה that a non-כהן who ate תרומה‎ – לא מיחייב בפחות משוה פרוטה‎ – Is not liable to pay the extra חומש if it is less than a שוה פרוטה‎ – משום דכתיב (ויקרא כב) ונתן לכהן וגומר ואין נתינה בפחות משוה פרוטה‎ – Because it is written (concerning a זר שאכל תרומה), ‘ and he shall give to the כהן’, and there is no giving if it is less than a שוה פרוטה; this seemingly contradicts what (the גמרא and) תוספות are saying that ונתן does not require a שוה פרוטה‎ – תוספות responds that תרומה payment is unique – היינו משום דתשלומי תרומה ילפינן מתשלומי מעילה – That is because we derive the laws of תרומה payment from the laws of מעילה payment – דתרוייהו תשלומי קדש מיקרו וגמרי בחט חט מהדדי – For both of them are קדש payments and are derived from each other through the גזירה שוה of חט א חט א – תוספות anticipates an additional difficulty: ולמאן דבעי בכריתות (דף ו, ב) ואשר יתן ממנו על זר שתהא נתינה בכזית‎ – And according to the one in מסכת כריתות, regarding the prohibition of אשר יתן ממנו על זר (concerning rubbing someone with the שמן המשחה), who requires that the placing of the שמן המשחה must be a כזית in order to have transgressed the prohibition; indicating that the term נתינה (here יתן) requires a כזית, in contrast to what תוספות here maintains – תוספות responds: היינו משום דסיכה היא ואפקה בלשון נתינה לאפוקי ממשמעות דסיכה קאתי‎ – That it because placing שמן on someone is commonly referred to as סיכה (anointing), so since the פסוק utilized the expression of נתינה (which is inappropriate for smearing oil), we must conclude that the פסוק came to change it from the meaning of סיכה‎ – דמשמע כל שהוא וצריך נתינה חשובה‎ – Which (סיכה) would indicates even a כל שהוא, but rather that it requires a significant giving which is a כזית‎ – כמו ונתן לכהן את הקדש (ויקרא כב) דהוי בכזית לרבנן דאבא שאול – Just like according to the רבנן who argue with אבא שאול that ונתן לכהן את הקדש must be a כזית ; here too by הסך שמן it also must be a כזית – וכן לא יתן עליה לבונה דבפרק כל המנחות (דף ס, א) מצריך כזית‎ – And similarly concerning the prohibition of לא יתן עליה לבונה‎ – he should not place frankincense on a מנחת חוטא‎ – the גמרא in פרק כל המנחות requires that he place a כזית לבונה in order to transgress the איסור of לא יתן עליה לבונה‎ – היינו משום דשני מלשון שימה דאתחיל בה לא ישים עליה שמן‎ – That is for the same reason; since the פסוק changed for the expression שימה with which the פסוק began לא ישים עליה שמן and concluded with יתן therefore the change allows us to require a כזית of לבונה‎ – תוספות offers an alternate explanation why a כזית לבונה is required to transgress the איסור of לא יתן עליה לבונה: או משום דומיא דהקטרת לבונה בחוץ דהויא נמי הקטרת איסור דהוי בכזית: Or because this is similar to burning לבונה outside the ביהמ"ק, which is also a prohibited הקטרה, which requires a כזית, therefore the לא יתן עליה לבונה on a מנחת חוטא also requires a כזית‎. S UMMARY Generally when the תורה writes נתינה there is no requirement for a specific amount (like by גט, חליפין, תרומה, מתן דמים ובהונות). There are exceptions such as תרומה לזר, סיכה ונתינת לבונה, but they have special לימודים‎. T HINKING IT OVER 1. תוספות proves that נתינה does not require a specific amount since חטה אחת פוטרת את הכרי, even though the תורה writes תתן לו‎. Seemingly however the rule of חטה אחת וכו' is regarding the הפרשת תרומה, while תתן לו discusses the giving of the תרומה to the כהן, which is seemingly separate and distinct from הפרשת תרומה‎. How does תוס' prove that נתינה does not require a שיעור from הפרשת תרומה‎?! 2. Why does תוספות offer a second answer regarding לא יתן עליה לבונה‎?

משמיה דרבים וקלסוה אלמא הילכתא כוותיה‎—In the name of many and they praised him; indicating that the ruling is according to him O VERVIEW The גמרא states that לוי first stated the ruling of רבי (that כתבו על איסורי הנאה כשר) in the name of רבי and they did not praise it. Later when he said the same הלכה משמיה דרבים, they did praise it; proving that this is indeed the הלכה‎. There is a dispute between רש"י and תוספות how we derive from this episode that הלכתא כוותיה‎. ---------------------- פירש בקונטרס מדטרח עלה דלקלסוה – רש"י explained since he troubled himself regarding this ruling that they should praise it, by saying it משמיה דרבים; this indicates that the הלכה is according to רבי\לוי‎ – תוספות has a difficulty with פרש"י: ובפרק מי שאחזו (לקמן דף עז, א) לא יתכן לפרש כן – However in פרק מי שאחזו it cannot be explained in this manner – דקאמר נפק רבי חייא דרשה משמיה דרבי וקלסוה משמיה דרבים ולא קלסוה‎ – For the גמרא states there, ר' חייא went out and explained it in the name of רבי and they praised it; however when he said it over in the name of many, they did not praise it – אלמא לית הלכתא כוותיה‎ – It is evident that the הלכה is not like רבי\ר' זירא‎. Here too ר' זירא troubled himself to say it משמיה דרבים (just like לוי in our גמרא) and nevertheless the הלכה is not like רבי\ר' זירא‎! תוספות offers his explanation of both גמרות: ואומר רבינו תם דהכא דייק מדקלסוה כי אמר משמיה דרבים‎ – And the ר"ת explains that here the גמרא infers from the fact that the people praised it when לוי said it משמיה דרבים (for that indicates that this is the הלכה) – ולפיכך נמי לא קלסוה כי אמר משמיה דיחיד מעיקרא‎ – And therefore for the very same reason they did not praise it originally when לוי said it משמיה דיחיד for they felt that since this is the הלכה it should not be stated as the opinion of a single individual (but rather as the view of a רבים) – ולקמן איפכא: And later in פרק מי שאחזו it is the opposite; they praised it when ר' זירא said it משמיה דיחיד (because they felt that this is not the הלכה and therefore it should only be said משמיה דיחיד ) and they did not praise it when it was said משמיה דרבים since it is שלא כהלכתא it should not be said משמיה דרבים‎. S UMMARY According to רש"י we know that לוי maintained that the הלכה is כרבי since he was טרח to say it משמיה דרבים (so they will praise it). According to תוספות we know that the הלכה is כרבי since the בני הישיבה praised it when it was said משמיה דרבים (and vice versa). T HINKING IT OVER תוספות states that פירש"י is not appropriate for the גמרא in מי שאחזו‎. Seemingly we can apply פירש"י to מי שאחזו as well. Initially ר"ח (who felt that the הלכה is not like רבי) said it משמיה דרבי וקלסוה (but he was not satisfied), so he was טרח to say it משמיה דרבים so it will be ולא קלסוה which will impress everyone that the הלכה is not like רבי‎!

למימרא דחקיקה לאו כתיבה היא‎—Do you mean to say that engraving is not considered writing O VERVIEW The ברייתא taught that a גט must be written but not engraved (or etched). The גמרא challenged this for we find by a גט שחרור that an עבד is freed with a גט שחרור which was engraved on a טבלא; proving that engraving is also considered writing. תוספות explains why the גמרא did not challenge this ruling from a more obvious source. ------------------------- תוספות responds to an anticipated difficulty: הוה מצי לאקשויי מלוחות דכתיב בהו כתיבה בכמה קראי – The גמרא could have asked from the לוחות, where the term כתיבה is written regarding the לוחות in many פסוקים‎ – והיה כתבם חקוק כדכתיב (שמות לב) חרות על הלוחות‎ – Even though their writing was actually engraved as it is written חרות על הלוחות‎ –engraved on the לוחות‎ – אלא דניחא ליה למיפרך מגט אגט: However, the גמרא preferred to ask from גט שחרור on a גט אשה. S UMMARY It is preferable to contrast similar items than to contradict from non-similar items. T HINKING IT OVER Why did תוספות initially assume that we should ask from the לוחות, and why did תוספות conclude that it is preferable to ask מגט אגט rather than to ask from the לוחות‎?
