Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1but in a Jewish court, once his verdict to be executed has emerged, they execute him.

2Abaye said to him: In a Jewish court as well, it is possible that the court will see fit to acquit him afterward and he will be released. Rav Yosef said: When the court sees fit to acquit him, it is before the verdict; after the verdict the court will not further see fit to acquit him, as it is uncommon for the court to find a reason to acquit him after his verdict has been delivered.

3The Gemara suggests: Let us say that a mishna ( Makkot 7a) supports Rav Yosef’s opinion: Concerning one who fled from the court after his verdict was issued, the mishna states: Any place where two witnesses arise and say: We testify about so-and-so that his verdict was finalized in the court of so-and-so, and so-and-so and so-and-so were his witnesses, the halakha is that this person should be killed. It is evident from the mishna in tractate Makkot that there is no concern that the court might later have found a reason to release him. The Gemara answers: Perhaps one who flees is different, as the court will not reconsider his verdict once he has fled.

4The Gemara suggests another proof: Come and hear: If one heard from a Jewish court that they were saying: The man so-and-so died, or: The man so-and-so was killed, then the court allows his wife to marry. If he heard from a gentile judicial registrar: The man so-and-so died, or: The man so-and-so was killed, then the court does not allow his wife to marry.

5The Gemara clarifies: What does it mean when it says: Died, and what does it mean when it says: Was killed? If we say that it means that he actually died, and that he actually was killed, such that the case concerning the gentiles is stated in a similar manner, i.e., that he heard from the gentile registrar that the person was actually dead, why may the court not allow his wife to marry? Don’t we maintain that with regard to any gentile who speaks offhandedly, the Sages deemed him credible? Therefore, the gentile should be deemed credible when he says that someone died or was killed.

6Rather, is it not necessary to explain that when it says: Died, it means that he is going out to die, and when it says: Was killed, it means that he is going out to be executed. And it teaches: If one heard in a Jewish court then the court allows his wife to marry, as it is assumed that he was already executed, in support of the statement of Rav Yosef.

7The Gemara answers: Actually, it can be explained that he actually died, and was actually killed; and with regard to that which you said: Such that the case concerning the gentiles is stated in a similar manner, why may the court not allow his wife to marry? Don’t we maintain that with regard to any gentile who speaks offhandedly, the Sages deemed him credible? The answer is that this credibility applies only in a matter that is not relevant to the gentiles; but in a matter that is relevant to the gentiles, such as here, where they desire to publicize that they carried out their verdict, it is common for them to reinforce their false verdict.

8MISHNA: With regard to an agent who brings a bill of divorce in Eretz Yisrael, where his only responsibility is to transmit the bill of divorce to the wife, and the agent became sick, this agent may send it in the possession of another agent. But if the husband said to the agent: When you transmit the bill of divorce to my wife, take for me such and such an item from her that I left with her as a deposit, then he may not send it in the possession of another agent. This is because it is assumed that it is not the desire of the husband that his deposit be in the possession of another person whom he did not appoint as his agent.

9GEMARA: Rav Kahana said: We learned in the mishna that the agent became sick; otherwise, he may not appoint a second agent. The Gemara asks: This is obvious, as the mishna teaches explicitly that the agent became sick. The Gemara answers: Lest you say that the same is true, i.e., that he may transfer the bill of divorce to another agent, even though the agent did not become sick, and the reason that the mishna teaches specifically that he became sick is that the mishna teaches the matter in the manner in which it typically occurs, as an agent typically fulfills his agency, barring unavoidable circumstances, therefore, Rav Kahana teaches us that an agent may appoint another agent only when he becomes sick.

10The Gemara clarifies: What are the circumstances of his appointment as an agent? If this is a case where the husband said to the agent: Deliver this bill of divorce to my wife, then even though the agent did not become sick, he may also appoint an agent in his place, as the husband did not state that he must be the one to deliver the bill of divorce. And if this is a case where he said to the agent: You, deliver this bill of divorce to my wife, then even if he became sick, he also may not appoint a second agent in his place, as the husband specified that he must be the one to deliver the bill of divorce. And if the mishna is in accordance with the opinion of Rabban Shimon ben Gamliel, then even if he became sick he also may not appoint a second agent, no matter what the husband said.

11The Gemara explains: As it is taught in a baraita in the Tosefta (2:13): If the husband said to an agent: Deliver this bill of divorce to my wife, then this agent may send it in the possession of another agent. However, if the husband said: You, deliver this bill of divorce to my wife, then this agent may not send it in the possession of another agent. Rabban Shimon ben Gamliel says: Whether the husband said it like this or whether the husband said it like that, the agent may not designate another agent. Therefore, Rav Kahana’s statement is difficult.

12The Gemara answers: If you wish, say that the mishna is referring to a case where the husband said to his agent: Deliver the bill of divorce, without specifying that he must be the one to do so, and Rav Kahana understood the baraita as follows: And this halakha , that he may send it in the possession of another agent, applies only when the agent became sick. And if you wish, say that the mishna is referring to a case where the husband said: You deliver, but one who became sick is different, and it is assumed that under those circumstances the husband would allow him to designate another agent. And if you wish, say that the mishna is even in accordance with the opinion of Rabban Shimon ben Gamliel, that an agent is ordinarily not permitted to designate another agent. But a case where the agent became sick is different, and the agent may designate another agent.

13We learned in the mishna: With regard to an agent who brings a bill of divorce in Eretz Yisrael, and the agent became sick, this agent may send it in the possession of another agent. And the Gemara raises a contradiction from a mishna (66a): If the husband said to two people: Give a bill of divorce to my wife, or if he said to three people: Write a bill of divorce and give it to my wife, then these people should write it and give it. The Gemara infers from the mishna: They themselves, yes, they should do so, but one whom they appoint as an agent may not do so.

14Abaye said: There, what is the reason that an agent may not be appointed? It is due to degradation of the husband, who does not want the matter to become known, and therefore they may not designate another agent. However, here, after he has already sent the bill of divorce, the husband is not particular that word not spread, and therefore the agent may designate another agent in his place.

15Rava said: There is a different reason that in the case of the mishna (66a) the agent may not appoint another to write the bill of divorce; it is because of the fact that in the case there, the husband’s instructions are mere words, and verbal directives cannot be delegated to an agent, i.e., an agent cannot be deputized to give instructions on behalf of another. Therefore, they cannot take their oral instructions and transfer them to another. In the case of the mishna here, the agent is able to give the physical bill of divorce to another agent and thereby transfer his agency.

16The Gemara asks: What is the difference between the explanations offered by Abaye and Rava? The Gemara answers: There is a practical difference between them in the case of an agent appointed to write a deed of a gift, and their disagreement is parallel to the dispute of Rav and Shmuel. Rav says: A deed of gift is not like a bill of divorce, as the gift giver does not care who writes the deed. Since it is not degrading to him if another agent writes the deed of gift instead of the agent that he appointed, the agent may appoint another agent. And Shmuel says: A deed of gift is like a bill of divorce, as the mere words instructing the agent to write the deed cannot be transferred to another agent.

17§ The mishna teaches: But if the husband said to the agent: When you transmit the bill of divorce to my wife, take for me such and such an item from her, then the agent may not appoint a second agent, as it is not the desire of the husband that his deposit be in the possession of another. Reish Lakish says: Here, Rabbi Yehuda HaNasi taught that a borrower is not allowed to lend the item that he borrowed to someone else, and a renter is not allowed to rent out the item that he rented to someone else. In those cases, the same reasoning applies, i.e., that it is not the desire of the owner that his item be in the possession of another.

18Rabbi Yoḥanan said to him: Even schoolchildren know this halakha , and this is not the novel idea expressed in the mishna. The novel idea expressed in the mishna is as follows: Not only is it not permitted for an agent to appoint another agent in this case, as it violates the desire of the husband, but sometimes it happens that the bill of divorce is also not valid if a second agent is appointed. This is because the first agent becomes as one that it was said to him: Divorce her only in the house, and he divorced her in the attic; or the husband said: Divorce her only with your right hand, and he divorced her with his left hand. Here as well, since the agent violated the instructions the divorce will not be valid.

19The Gemara elaborates: Everyone agrees that when it happens that the wife went out to greet him and gave him the item that the husband requested, and then she took the bill of divorce from him, in this case everyone agrees that the bill of divorce is a proper bill of divorce. When they disagree is in a case when the husband said to the agent:

אבל בבית דין של ישראל כיון דגמר דיניה לקטלא מיקטל קטלי ליה‎ —However, by a Jewish court, once the verdict was issued to kill, they will certainly kill him O VERVIEW The איכא דאמרי of רב יוסף maintains that by a בי"ד של ישראל if the death penalty verdict was issued, he will surely be killed. תוספות clarifies a possible difficulty. --------------------------- תוספות responds to an anticipated question: אף על גב דאמר בסנהדרין (דף מב, ב) שהיה אחד רוכב על סוס וסודרין בידו – Even though the משנה in מסכת סנהדרין states, that there was one person riding on a horse (following the one sentenced to death) and another person was standing by the בי"ד and was holding cloths in his hand – מצאו לו זכות היה הלה מניף בסודרין‎ – If the בי"ד found a merit for the accused which would nullify the death penalty, this person would wave the cloths and the one on the horse would run after the accused and return him back to בי"ד. In any event it is evident that even if he is יוצא ליהרג, he may be spared, so why does the גמרא assume that he will certainly be killed. תוספות replies: מכל מקום לא שכיח: Notwithstanding the above, it is uncommon for him to be recalled; therefore we assume that he was killed. S UMMARY It is uncommon for the accused to be recalled; therefore we assume that he was killed. T HINKING IT OVER What is the difference between the question of אביי and תוספות question?

רבן שמעון בן גמליאל אומר בין כך ובין כך לא ישלחנו ביד אחר‎—רשב"ג says; in either case he should not send it with another O VERVIEW רשב"ג maintains that whether the husband told the שליח, ‘bring this גט to my wife, or whether he told him, ‘you bring this גט to my wife’; in either case the שליח may not appoint another שליח‎. Our תוספות reconciles this ruling with a seemingly contradictory גמרא‎. ---------------------------------- תוספות responds to an anticipated difficulty: והא דדרשינן (קדושין דף מא, א) ושלח ושלחה מלמד שהשליח עושה שליח‎ – And regarding this which we expound the פסוק of ושלח ושלחה to teach us that a שליח may make another שליח, so how can רשב"ג say that לא ישלחנו ביד אחר‎ – היינו היכא דאין הבעל מקפיד: That דרשה applies only in a case where the husband does not mind, however if the husband minds then לא ישלחנו ביד אחר‎. S UMMARY Regarding שליח עושה שליח we can differentiate whether the בעל is מקפיד or not. T HINKING IT OVER Why did not תוספות asks his question on our משנה, which states that if חלה the שליח may appoint another שליח, indicating that if not חלה, he may not, but we have the לימוד from ושלח ושלחה that שליח עושה שליח‎?!

משום בזיון דבעל‎—Because of the embarrassment of the husband O VERVIEW The ברייתא taught that if the husband told three people, ‘write a גט and give it to my wife’, the rule is that they should write it and give it to her; indicating that they cannot appoint a שליח on their behalf. We see from here that one cannot appoint a שליח in his place. אביי explained that the reason they cannot appoint a שליח to write the גט because this will cause embarrassment to the husband that he does not know how to write a גט‎. He wants to limit the embarrassment to these three people, but not to anyone else. תוספות clarifies some difficulty with this interpretation. -------------------------------- פירש בקונטרס שעליו לכתוב את הגט ואינו רוצה שידעו רבים שאינו יודע לכותבו‎ – רש"י explained the embarrassment, that it is the husband’s obligation to write the גט, so he does not want that more people should know that he does not know how to write the גט‎. תוספות responds to an anticipated difficulty: והא דקאמר יכתבו ויתנו אגב יכתבו נקט יתנו – And this which the ברייתא states יכתבו ויתנו, it does not mean that they cannot make a שליח for נתינה; rather the ברייתא added יתנו since it said יכתבו‎. תוספות offers an alternate solution: אי נמי על ידי שיאמרו לאחר שיתן ירגיש בדבר שהבעל לא כתבו ומקפיד גם על הנתינה – Or you may also say; by appointing someone else to give the גט, this שליח will sense that the husband did not write it, so therefore the husband is also particular regarding the נתינה‎. תוספות challenges the whole concept of בזיון הבעל: ואם תאמר מאי בזיון איכא והא תנן (לעיל דף כב, ב) האשה כותבת את גיטה‎ – And if you will say, what embarrassment is there for the husband, since we the משנה taught, ‘the wife may write her גט’ – אלמא אין על הבעל לכתוב – It is therefore evident that it is not incumbent on the husband to write! תוספות answers: ויש לומר דלעולם על הבעל לכתוב – And one can say that really it is incumbent on the husband to write the גט‎ – אלא הא קא משמע לן דאפילו אשה כותבת כשר דידעת לאקנויי: Rather that משנה of האשה כותבת וכו' is teaching us that even when the wife writes the גט it is כשר, for she knows how to transfer the ownership of the גט to her husband. S UMMARY We can either assume that there is no בזיון הבעל by יתנו (only by יכתבו), but we can also assume that even by יתנו there is בזיון הבעל‎. The משנה of האשה כותבת את גיטה, merely teaches us that she knows how to be מקנה, but not that she should write the גט‎. T HINKING IT OVER תוספות writes in the א"נ, that even by נתינה there is בזיון הבעל (and therefore they must deliver the גט themselves). Why therefore does it state in the משנה that he may appoint another שליח; there will be בזיון הבעל there as well?!

ומילי לא מימסרן לשליח‎—And words cannot be delegated to a Shliach O VERVIEW Regarding the ברייתא which stated that in a case where the husband said to three people, ‘write a גט and give it to my wife’, the rule is that they must write it [and give it] themselves, but they cannot appoint a שליח‎. The reason for this, explained רבא, is because he only gave them words (a directive), but did not give them anything of substance (like a גט), and a directive of words cannot be transmitted to another שליח, but rather it must be accomplished by those who received the directive. -------------------------------- רבי מאיר ורבי יוסי פליגי לקמן בפרק התקבל (דף סו, ב) באומר לשלשה תנו – ר"מ and ר"י argue later in פרק התקבל in the משנה, in a case where one said to three people, ‘ give a גט to my wife’ – דקסבר רבי מאיר דעשאן בית דין‎ – Where ר"מ maintains, since he said it to three people, he made them into a בי"ד, and they can appoint others to write the גט and deliver it – ורבי יוסי פליג דאפילו אמר לבית דין הגדול שבירושלים ילמדו ויכתבו ויתנו לה‎ – And ר"י argues that even if he said תנו to the בי"ד הגדול in ירשלים (not just to three ordinary people) they should learn and write the גט and give it to her, and they cannot appoint a שליח, neither for the כתיבה or the נתינה‎ – אבל באומר לשנים תנו או לשלשה כתבו ותנו אפילו רבי מאיר מודה דיכתבו ויתנו – However when he said to two people 'תנו', or he told three people 'כתבו ותנו, even ר"מ agrees that they have to write it and deliver it themselves – ולא מימסרי לשליח כדמוכח מתניתין דהתם‎ – And the כתיבה ונתינה cannot be given over to a שליח as is evident in the משנה there – והא דקאמר בגמרא שלחו ליה מבי רב לשמואל אמר לשנים כתבו ותנו גט לאשתי‎ – And this which the גמרא there (following the משנה) states; ‘they sent from sרב' academy to שמואל, what would be the ruling in a case where one said to two people, ‘ write and give a גט to my wife’ – ואמרו לסופר וכתב וחתמו הן מהו‎ – And they told a scribe and he wrote and they signed it, what is the ruling? שלח להו תצא והדבר צריך תלמוד – שמואל responded to them, if she remarried after receiving this גט, she should leave her present husband, and the matter requires more study’ – ופריך מהא דאמר שמואל הלכה כרבי יוסי דאמר מילי לא מימסרן לשליח And the גמרא there asks on this ruling of שמואל, from this which שמואל ruled that the הלכה is like ר"י who maintains מילי לא מימסרן לשליח, words cannot be delegated to a שליח, so why did שמואל say והדבר צריך תלמוד, when the ruling of שמואל in this matter is that the גט is invalid since מילי לא מימסרן לשליח‎ – תוספות comments on the sגמרא' question: הוה מצי למיפרך דבשנים אפילו רבי מאיר מודה דלא מימסרן – The גמרא could have asked that when he said to two people, even ר"מ agrees that it cannot be given over to a שליח‎ – אלא ניחא ליה לאקשויי שמואל אדשמואל – However the גמרא preferred to ask a contradiction from שמואל on שמואל‎ – תוספות offers another answer why the גמרא preferred to ask שמואל אדשמואל, rather than asking that by אמר לשנים everyone agrees that they must do it themselves and לא מימסרן לשליח: ועוד דהוה מצי למימר דטעמיה דרבי מאיר משום בזיון דבעל‎ – And additionally the גמרא could have answered that the reason ר"מ is מודה by אמר לשנים וכו', is because of בזיון דבעל, but not because לא ממסרי לשליח‎ – וקסבר שמואל דבכתיבה ליכא בזיון אבל בחתימה כשיחתמו אחרים הוא דאיכא בזיון- However שמואל maintains that there is no בזיון דבעל by כתיבה, however regarding חתימה that others should sign, there is בזיון דבעל‎ – דמיפרסמא מילתא בחתימה טפי – Because there is more publicity by חתימה than by כתיבה‎ – תוספות anticipates another difficulty: ומיהו הוה מצי למיפרך מדשמואל דהכא דקסבר טעמא משום מילי‎ – However, the גמרא could have asked from sשמואל' ruling here, where he maintains the reason is because of מילי לא מימסרן לשליח, דאמר מתנה הרי היא כגט – For he says that מתנה is like a גט, so why does he rule there והדבר צריך תלמוד‎?! תוספות responds: אלא כיון שהיה צריך להביא משמואל דהכא הכי נמי פריך מאידך דשמואל דהתם: However, since it would be necessary to cite from שמואל here, so he could just as well ask from the other ruling of שמואל, which is cited there. S UMMARY It is preferable to ask a contradiction from the person’s own view elsewhere. We cannot prove that ר"מ maintains מילי לא מימסרא לשליח, if we assume that there is a greater בזיון הבעל by חתימה than by כתיבה‎. T HINKING IT OVER Why is תוספות here getting involved in a גמרא later; he can ask his questions there?!

כאן שנה רבי אין השואל רשאי להשאיל‎— Rebbee taught here; the borrower is not permitted to lend O VERVIEW The משנה taught that if the husband told the שליח הגט, ‘retrieve for me an object from my wife’, the שליח may not appoint another שליח‎. From this ריש לקיש inferred that רבי in this משנה taught us the rule that a borrower (שואל) may not lend out (להשאיל) what he borrowed to someone else. תוספות reconciles our גמרא with a seemingly contradictory גמרא‎. -------------------------------- אפילו למאן דאמר בהמפקיד (בבא מציעא דף לו, א) שומר שמסר לשומר פטור – Even according to the one who maintains in פרק המפקיד, a watchman who delivered what he was watching to another שומר, the first שומר is פטור if the item was destroyed, the reason is – שהרי מסרו לבן דעת דאין יכול לומר לו אין רצוני שיהא פקדוני ביד אחר – That since he gave it over to a responsible person, therefore the owner cannot say to the original שומר, ‘ I do not want my deposit to be in the hand of another’, but rather the שומר is פטור‎ – תוספות replies: נהי דלא מיחייב מכל מקום לכתחלה אין לו לעשות: Granted that this מ"ד maintains that he is not חייב, nevertheless initially one should not do this; giving over a deposit to another. S UMMARY One can maintain שומר שמסר לשומר פטור and that אין השואל רשאי להשאיל לכתחלה‎. T HINKING IT OVER How can we compare the two cases; in our משנה if he gave the גט to another שליח and the second שליח took the object from the woman and lost it, the first שליח will be פטור, therefore in this case the husband is מקפיד that he should not give the גט to a שליח שני, since he will suffer a loss, however by שומר שמסר לשומר, the first שומר will be חייב (for whatever he is חייב as a שומר) even if he gives it to a שומר שני, so the owner does not care that much if he gives it over to another שומר‎! Why is there a contradiction?!

היכא דנפקה לאפיה‎—When she went out towards him O VERVIEW The גמרא states that in a case where the woman approached the שליח and gave him the object, and then she received the גט; it is a valid גט‎. The question is why mention that she approached him, the issue at hand is whether she took the גט first or she gave the object first, why mention היכא דנפקה לאפיה‎. ------------------------------ נקט הכי משום דמתניתין איירי בחלה השליח הראשון ולא הגיע לעיר שהאשה שם: The גמרא mentions this case (of היכא דנפקה לאפיה), since our משנה is in a case where the first שליח became ill and did not reach the city where the woman is. S UMMARY She came to him since he did not come to her. T HINKING IT OVER In this case of נפקה לאפיה; what did the husband say; שקול חפץ והדר יהיב לה גיטא, or did he say יהיב לה גיטה ושקול חפץ‎?
