    Gittin 47a

    Chapter 4 - HaSholeach

גם: גיטין דף מ״ז ע״א, פרק ד׳ השולח

    English translation - Gittin 47a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1Redeem me. Rabbi Ami said to him: We learned in a mishna: With regard to one who sells himself and his children as slaves to gentiles, he is not redeemed. However, his children are redeemed due to the harm of becoming assimilated among the gentiles, and all the more so here, where there is a concern that leaving him in bondage may lead to his death, he should be redeemed.

2The Sages said to Rabbi Ami: This man is a Jewish apostate, as they saw him when he was eating unslaughtered animal carcasses and animals with a wound that will cause them to die within twelve months [ tereifot ]. He said to them: Say that he was eating them due to his appetite, not because he is an apostate, but because he was overcome by temptation.

3They said to him: But there are times when there are permitted and forbidden foods before him, and he sets aside the permitted food and eats the forbidden food, indicating that it is not temptation alone that causes him to transgress. Once he heard this, Rabbi Ami said to that man: Go, because they do not allow me to redeem you.

4The Gemara recounts a related incident: Reish Lakish sold himself to gladiators. He took a bag and a round stone inside of it with him. He said: There is a tradition that on the final day of a captive’s life, before his captors kill him, they do for him anything that he requests of them, so that he would forgive them for the spilling of his blood.

5On the final day before they were set to kill him they said to him: What is amenable to you? He said to them: I want to tie you up and have you sit, and I will strike each one of you one and a half times. He tied them up and had each one of them sit. When he struck each of them with one strike with the stone in the bag, the one whom he struck died, because Reish Lakish was of great strength. Reish Lakish gritted his teeth in anger, and said to the one whom he killed, in order to prevent the others from realizing what was happening: Are you laughing at me? You still have half of a strike remaining with me, as I struck you only once. He killed them all, and Reish Lakish escaped his captors.

6He left and came back home, and after some time had passed he was sitting, eating, and drinking, without concern for his livelihood. His daughter said to him: You don’t want something to lie upon? He said to her: My daughter, my belly is my pillow, and this is enough for me. When he died he left only a kav of saffron as an inheritance, and even so he recited this verse about himself: “And they leave their wealth for others” (Psalms 49:11), meaning that he was pained that he did not use all of his property. He exhibited his confidence that God would provide his needs by not saving money for the future.

7MISHNA: One who sells his field to a gentile must purchase and bring the first fruits from the field that he sold, for the betterment of the world.

8GEMARA: Rabba says: Even though a gentile has no capability of acquisition of land in Eretz Yisrael to cause the abrogation of the sanctity of the land, thereby removing it from the obligation to tithe its produce, as it is stated: “For the land is Mine” (Leviticus 25:23), which teaches: The sanctity of the land is Mine, and it is not abrogated when the land is sold to a gentile; a gentile does have, however, the capability of acquisition of land in Eretz Yisrael to allow him to dig pits, ditches, and caves in the land he has purchased, as it is stated: “The heavens are the heavens of the Lord; but the earth has He given to the children of men” (Psalms 115:16).

9And Rabbi Elazar says: Even though a gentile has the capability of acquisition of land in Eretz Yisrael to cause the abrogation of the sanctity of the land, removing it from the obligation to tithe its produce, as it is stated with regard to tithes: “The tithe of your grain” (Deuteronomy 12:17), which teaches that it is only the grain of a Jew that is obligated in tithes and not the grain of a gentile; a gentile does not have, however, the capability of acquisition of land in Eretz Yisrael to allow him to dig pits, ditches, and caves, in the land he has purchased, as it is stated: “The earth is the Lord’s” (Psalms 24:1).

10The Gemara asks: With regard to what principle do Rabba and Rabbi Elazar disagree? The Gemara answers: One Sage, Rabbi Elazar, holds that “your grain” teaches that only grain grown in the field of a Jew is obligated in tithes, but not the grain grown in the field of a gentile. And one Sage, Rabba, holds that “your grain” is not referring to the produce itself, but rather to your accumulation of the produce into a pile, which obligates the produce in tithes, and not the accumulation of the produce into a pile by a gentile, as Rabba holds that if a gentile harvests and gathers grain, the grain is not obligated in tithes.

11Rabba said: From where do I say that a gentile’s acquisition of land in Eretz Yisrael does not cause the abrogation of the sanctity of the land with regard to tithes? As we learned in a mishna ( Pe’a 4:9): With regard to the gleanings left for the poor, and the forgotten sheaves left for the poor, and the produce in the corner of the field, which is given to the poor [ pe’a ], of a gentile, one is obligated to tithe them unless the owner rendered them ownerless.

12The Gemara discusses: What are the circumstances? If we say that this is referring to the gleanings, forgotten sheaves, and pe’a of a Jew, and a gentile collected them and sold them to a Jew, then how could the mishna write: Unless he rendered them ownerless? But they are already ownerless, since gleanings, forgotten sheaves, and pe’a are already ownerless, as anyone can take them. Rather, is it not the case that the mishna is referring to produce of a gentile, who then separated gleanings, forgotten sheaves, and pe’a , and declared them to be ownerless, and a Jew gathered them.

13Rabba explains his inference: The reason that this produce is exempt from tithes is specifically because the gentile rendered it ownerless, but if he did not render it ownerless, then it would be obligated in tithes. One can infer from this mishna that the acquisition of land by a gentile does not cause the abrogation of the sanctity of the land with regard to tithes.

14The Gemara rejects this: No, actually it may be that these were gleanings, forgotten sheaves, and pe’a of a Jew, and a gentile collected them. And that which you said: But they are already ownerless, is incorrect. Let it be that he rendered them ownerless with the intent that a Jew would collect them, but did he render them ownerless with the intent that a gentile would collect them? He did not in fact render them ownerless, as he expected only a Jew to collect them. Therefore, if a gentile collects them and sells them to a Jew, the Jew is obligated to tithe them.

15The Gemara suggests: Come and hear another proof from a baraita : If there was a Jew who acquired a field from a gentile before its produce reached a third of its growth, at which point one is obligated to tithe the produce, and he then sold it to the gentile after its produce reached a third of its growth, then the owner is obligated to tithe the produce because the produce already became obligated in tithes when it reached a third of its growth while under Jewish ownership. The Gemara deduces from here: It is only when the produce became obligated in tithes while under Jewish ownership, that yes, the owner is obligated to tithe, but if the produce did not become obligated in tithes while under Jewish ownership, then no, the owner is not obligated to tithe. This teaches that produce that grows while the field is owned by a gentile is exempt from tithes, and a gentile’s acquisition in Eretz Yisrael abrogates the sanctity of the land with regard to tithes.

16The Gemara rejects this: With what are we dealing here? We are not dealing with Eretz Yisrael proper, but with land in Syria, and this tanna holds that the conquest of an individual is not called a conquest. Since Syria was conquered in battle by King David, and not by the Jewish people as a whole, it is not bound by all the same halakhot that apply in Eretz Yisrael.

17The Gemara suggests: Come and hear a proof from a baraita ( Tosefta , Terumot 2:10): If there were a Jew and a gentile who purchased a field in partnership,

ריש לקיש זבין נפשיה ללודאי‎— Reish Lokish sold himself to bandits O VERVIEW The גמרא relates a somewhat bizarre story how ר"ל sold himself to לודאי, and eventually killed them all. תוספות explains how ר"ל came to do this. ------------------------------------ קודם שחזר למוטב דמסתמא לא היה מזלזל בעצמו כל כך: This story occurred before ר"ל returned for the better (he did תשובה), for presumably after he did תשובה, he would not have denigrated himself so much. S UMMARY ר"ל sold himself to the לודאי before he was חוזר בתשובה‎. T HINKING IT OVER 1. Was the זלזול that he sold himself or that he killed them? 2. How could תוספות say that this happened before he was חוזר למוטב, the גמרא relates immediately after this story regarding the death of ר"ל, so seemingly this was in his later years?!

כריסי כרי‎—My stomach is my pillow O VERVIEW ר"ל told his daughter that he needs no pillow for his stomach is his pillow. ------------------------------- דרכן היה לשכב על בטנם כדאמרינן בזבחים (דף ה, א) ריש לקיש רמי אמעוהי ומקשה: It was their custom to lie on their stomachs, as the גמרא relates in מסכת זבחים, ‘ר"ל was lying on his stomach, and asked’ a question. S UMMARY The custom in those days was to sleep on their stomachs. T HINKING IT OVER The ערוך maintains that one is not permitted to sleep on his stomach (face down); how will he explain this story of ר"ל that כריסי כרי‎?

לוקח ומביא בכורים‎—He buys and brings Bikkurim O VERVIEW The משנה states, if someone sells his field to a נכרי, he must buy the ביכורים (first ripened fruits) from the נכרי and bring them to ירושלים as ביכורים‎. Our תוספות offers a different reading of the text. ------------------------------- זו גירסת הקונטרס דקנסינן ליה לחזור וליקח ממנו‎ – This is the text according to רש"י, that we penalize the seller to go back and buy the ביכורים from the נכרי, and bring it to ירושלים‎ – אבל כולי האי לא קנסינן ליקח ממנו להפריש תרומות ומעשרות‎ – However, we do not penalize him that much that he should buy from the נכרי sufficient produce in order to separate תו"מ from the crops – תוספות disagrees with פרש"י: ומיהו קשה לרבינו תם דבגמרא מייתי ראיה מהא דיש קנין לעובד כוכבים‎ – However the ר"ת has a difficulty with this פרש"י, for the גמרא brings proof from our משנה that a נכרי has an acquisition in ארץ ישראל to remove the חיוב תו"מ from the field which he bought in א"י; the proof is that we require the seller to buy ביכורים from the נכרי, (only) – דמפני תיקון העולם אין דאורייתא לא‎ – Because of תיקון העולם, but מה"ת there is no חיוב to buy the ביכורים from the נכרי, since once the נכרי bought the field he removed the חיוב from it, for יש קנין לעכו"ם. This concludes the גמרא‎. תוספות asks – מנא ליה דילמא תיקון העולם קאי אהא דחייבוהו ליקח – How does the גמרא know from our משנה that יש קנין לעכו"ם, perhaps אין קנין לעכו"ם and there is a חיוב ביכורים מה"ת, and the תיקון העולם is referring to this fact that they obligated the seller to buy?! תוספות offers his interpretation and rendition of the text: ואומר רבינו תם דברוב ספרים לא גרסינן ומביא בוי"ו – And the ר"ת says that in most texts it does not read ומביא with a וי"ו, but rather it reads לוקח מביא ביכורים‎ – והכי קאמר כל אדם הלוקח ממנו מביא בכורים לא שנא מוכר לא שנא אחר – And this is the meaning of the משנה, any person who buys from the נכרי, brings ביכורים, no difference whether it is the seller or someone else – ורבינו חננאל גרס הלוקח מביא כולי וכן בירושלמי: And the ר"ח is גורס that הלוקח מביא, etc. (without a וי"ו) and so too is the גירסא in תלמוד ירושלמי S UMMARY According to רש"י the seller must buy the ביכורים, while תוספות maintains that whoever buys produce from the נכרי, he must bring ביכורים‎. T HINKING IT OVER 1. תוספות learns that whoever buys the produce, he needs to bring the ביכורים‎. According to תוספות, what is the תיקון העולם; how does this accomplish anything?! 2. According to תוספות, why does the משנה states המוכר וכו' לעכו"ם לוקח מביא ביכורים, it should have simply stated הלוקח מן העכו"ם מביא ביכורים‎?! 3. Does תוספות distinction between ביכורים and תרו"מ apply only to פרש"י, or also to פי' התוס'?

אמר רבה אף על פי שאין קנין כולי‎— Rabboh said, even though there is no acquisition, etc. O VERVIEW The גמרא cites a dispute between רבה who maintains אין קנין לעכו"ם בא"י להפקיע מידי מעשר, and רבי אלעזר who maintains יש קנין לעכו"ם וכו'. Our תוספות reconciles the view of רבה with seemingly contradictory sources. ------------------------------- תוספות anticipates a difficulty: והא דתניא לעיל (דף מג, ב) אף על פי שעשה ישראל נימוסו פטורה מן המעשר אלמא יש קנין‎ – And this which the ברייתא taught previously, ‘even though the נכרי made his field as collateral for the ישראל, nevertheless it is exempt from מעשר’; it is evident that יש קנין, which contradicts the view of רבה‎ – תוספות responds: איכא לאוקמא בסוריא כדמשני לקמיה – We can establish that ברייתא that the field was in סוריא as the גמרא answers shortly – תוספות anticipates another difficulty: וההיא דהשואל (בבא מציעא דף קא, א) דהמקבל שדה אבותיו מן העובד כוכבים דמעשר ונותן לו‎ – And regarding that משנה which is cited in פרק השואל, ‘one who contracts to service the field of his fathers from a נכרי, the rule is that he must first give מעשר from the entire produce and then give to the נכרי his share’ – ודחי לה התם דלעולם יש קנין – And the גמרא there rejects the proof, that really יש קנין, and the reason he is required to give the entire מעשר is a קנס‎. תוספות responds: אף על פי שהדיחוי אמת כדדייק מדנקט מציק מכל מקום ראיה גמורה ליכא‎ – Even though the rejection is valid, as the גמרא infers from another ברייתא which mentions that the נכרי was a מציק, nevertheless it is not a perfect proof – ולעולם מצי למימר רבה דסבר אין קנין – So really רבה can still maintain that אין קנין‎. תוספות anticipate a different contradiction, regarding the view of רבי מאיר: ומיהו אשכחן רבי מאיר דסבר יש קנין בסוף פרק קמא דעבודה זרה (דף כא, א) – However we do find that ר"מ maintains in the end of the first פרק of מסכת ע"ז that יש קנין‎ – דאמר אין משכירין להן שדות משום דמפקע להו ממעשרות‎ – Where ר"מ states there in the משנה, we do not rent out fields to נכרים, and as the גמרא there explains, because he exempts the field from מעשרות‎ – דכל זמן שהיא של ישראל כל מי שזורעה חייב במעשר‎ – For as long as it is owned by a ישראל, whoever plants it is חייב במעשר‎ – וכי זבנה לעובד כוכבים הזורעה פטור דיש קנין‎ – But when he sells it to a נכרי, whoever plants it is פטור from מעשרות since יש קנין‎ – דאי אין קנין אין זו הפקעה מה שאין עובד כוכבים מעשר קרקע החייבת‎ – For if we maintain אין קנין, the fact that the נכרי is not מעשר land which is מחוייב במעשר, would not be considered הפקעה from מעשרות; תוספות proves this – דהתם פריך בית נמי מפקיע ממזוזה ומשני מזוזה חובת הדר היא ואין זה הפקעה‎ – For the גמרא asks there, by a house he is also exempting it from מזוזה, and the גמרא answers that the obligation of putting up a מזוזה is on the dweller, and it is not considered הפקעה‎. We have thus established that ר"מ maintains יש קנין – תוספות therefore asks: והא דאמר רבי מאיר בפרק רבי ישמעאל (מנחות דף סו, ב) – And this which ר"מ stated in פרק ר"י – תורמין משל עובד כוכבים על של ישראל‎ – One may separate תרומה from the produce of a נכרי on the produce of a ישראל; this would indicate that אין קנין, for if יש קנין the produce of the נכרי is פטור from תו"מ (and we cannot be תורם מן הפטור על החיוב); this contradicts what we said previously that ר"מ maintains יש קנין‎ – תוספות responds: התם איירי כשגדלו ביד ישראל ולהכי מוקי פלוגתייהו במירוח העובד כוכבים ולא ביש קנין‎ – There we are discussing that it grew by a ישראל, and therefore the גמרא there establishes that their dispute is regarding מירוח העכו"ם, but not whether יש קנין‎ – תוספות concludes that since ר"מ maintains יש קנין‎ – וכי פריך הכא לרבי אלעזר הוה מצי למימר אנא דאמרי כרבי מאיר אלא דמשני שפיר: So therefore when the גמרא here challenged ר"א (who maintains יש קנין) from sources which maintain אין קנין, he could have answered, ‘I agree with ר"מ’ who maintains יש קנין, but anyway the גמרא answers properly that there is no question from this source. S UMMARY רבה maintains אין קנין except in סוריא‎. ר"מ maintains יש קנין‎. T HINKING IT OVER תוספות asks on רבה from the גמרא in השואל‎. Why does not תוספות answer that the גמרא in השואל is discussing סוריא where רבה agrees that יש קנין (as תוספות answered before)?!

מר סבר דיגונך ולא דיגון עובד כוכבים‎—One master maintains, ‘your piling’, but not the gentile’s piling O VERVIEW The גמרא cites a מחלוקת whether יש קנין לעכו"ם וכו' להפקיע ממעשרות (the view of ר"א) or אין קנין (the view of רבה‎. The גמרא explains that they argue how to understand the word דגנך (as in מעשר דגנך). ר"א understand it literally (grain); only your grain (which grows in the sישראל' field) is liable for מעשר, but not דגן עכו"ם, while רבה understands דגן to mean דיגון (piling up of the grain) therefore דגנך comes only to exclude דיגון עכו"ם, but not דגן עכו"ם. There is a dispute between רש"י and תוספות as how to understand the מחלוקת between ר"א ורבה‎. --------------------------------------- מתוך פירוש הקונטרס משמע דהא בהא תליא‎ – From the content of sרש"י' explanation it seems the one (יש קנין or אין קנין) is dependent on the other (מירוח נכרי פוטר or לא פוטר) – דלרבה דאמר אין קנין ודריש דיגונך ולא דיגון עובד כוכבים‎ – That according to רבה who maintains אין קנין, for he expound דיגונך (not דגנך) to exclude דיגון נכרי only, but not דגן נכרי – אית ליה מירוח העובד כוכבים פוטר‎ – He will maintain that מירוח נכרי exempts from מעשר‎ – ולרבי אלעזר דאמר יש קנין ודריש דגנך ולא דגן עובד כוכבים‎ – And according to ר"א, who maintains יש קנין because he expounds 'דגנך' to exclude דגן נכרי‎ – אית ליה דמירוח העובד כוכבים אינו פוטר – He will therefore maintain that מירוח נכרי does not exempt from מעשרות‎. תוספות asks on פרש"י: וקשה דכמה תנאים נחלקו במירוח העובד כוכבים‎ – And this is difficult to accept for many תנאים argue whether מירוח נכרי is פוטר or not – ואם כן כל אותם תנאים נמי נחלקו ביש קנין ואין קנין‎ – So therefore it will turn out (according to פרש"י) that all those תנאים will also argue whether יש קנין or אין קנין וזהו דוחק דרבה ורבי אלעזר נחלקו בפלוגתא דכל הנהו תנאי – And this is a difficulty to say that רבה ור"א are arguing in the dispute of all these תנאים‎ – An additional question on פרש"י: ועוד דמשמע במנחות בפרק רבי ישמעאל (דף סז, א) – And furthermore it seems in מסכת מנחות in פרק ר"י – דכולהו תנאי דרשי דיגונך ולא דיגון עובד כוכבים ואפילו מאן דמחייב מירוח העובד כוכבים‎ – That all the תנאים (both those that maintain מירוח נכרי פוטר and those that maintain אינו פוטר) expound דגנך to mean דיגונך ולא דיגון עכו"ם and even the one who obligates מירוח נכרי in מעשר‎ – אלא דדריש מיעוט אחר מיעוט דתרי דגנך כתיבי – However that תנא, who maintains דיגון נכרי חייב, expounds ‘an exclusion after an exclusion’, for דגנך is written twice – תוספות offers his interpretation: לכך נראה דרבה ורבי אלעזר אתו ככולי עלמא‎ – Therefore it appears to תוס' that רבה ור"א can work out according to everyone, whether we maintain מירוח נכרי פוטר or not – ודריש נמי רבי אלעזר דיגונך ולא דיגון עובד כוכבים מדכתיב דגנך ולא כתיב תבואתך – And ר"א also expounds דיגונך ולא דיגון עכו"ם (to exclude מירוח נכרי) even though he expounds דגנך ולא דגן עכו"ם, since it written דגנך and it is not written תבואתך; the תורה could have written תבואתך‎ – דאי הוה כתיב תבואתך הוה דרשינן שפיר נמי תבואתך ולא תבואת עובד כוכבים‎ – For if תבואתך were written we would have also correctly expounded it to mean תבואתך (of a ישראל), but not תבואת עכו"ם – תוספות responds to an anticipated difficulty: ומכל מקום דריש נמי דגנך ולא דגן עובד כוכבים מדלא כתיב דיגונך בהדיא – But nevertheless we also expound דגנך to mean דגנך ולא דגן עכו"ם, since it is not written דיגונך explicitly – תוספות asks: ואם תאמר כי היכי דדרשינן גבי דיגונך למאן דמחייב מירוח העובד כוכבים‎ – And if you will say, according to the one who obligates מירוח נכרי, so just as we expound דיגונך which is written twice to be מחייב מירוח נכרי, since – אין מיעוט אחר מיעוט אלא לרבות הכי נמי נדרוש גבי דגנך‎ – אין מיעוט אחר מיעוט אלא לרבות, we should similarly expound regarding דגנך (which excludes תבואת נכרי) and say אין מיעוט אחר מיעוט אלא לרבות and תבואת נכרי should be חייב‎ – תוספות answers: ויש לומר דלא מיסתבר לאוקמי מיעוט אחר מיעוט לכל מילי: And one can say that it is not logical to assume that we should establish the rule of מיעוט אחר מיעוט for all aspects of this דרשה (both for דגן and for דיגון) it is sufficient that we apply it to only one דרשה (of דיגון). S UMMARY According to (תוספות understanding of) רש"י, the two לימודים of דגנך and דיגונך are mutually exclusive, however according to תוספות both לימודים are applied since the תורה did not write תבואתך or דיגונך‎. The concept of אין מיעוט אחר מיעוט אלא לרבות, is applied only to דיגונך but not to דגנך‎. T HINKING IT OVER Once תוספות explains that דגנך is written twice, we can answer that ר"א derives both לימודים (of יש קנין and מירוח נכרי פוטר) from the two times that דגנך is written, why is it necessary to get involved that it does not say תבואתך or דיגונך‎?!

אדעתא דעובד כוכבים מי מפקרי‎—Did he make it ownerless intending a Gentile O VERVIEW The גמרא assumes that when a ישראל is מפקיר, he intends it to be הפקר only for other Jews but not for נכרים‎. Our תוספות reconciles our גמרא with a seemingly contradictory גמרא‎. ------------------------- תוספות anticipates a difficulty: והא דפליגי רבי יוחנן וריש לקיש בירושלמי דפרק ו' דמסכת פאה‎ – And regarding the dispute between ר"י ור"ל in the sixth פרק of מסכת פאה in the תלמוד ירושלמי‎ – בהפקיר לישראל ולא לעובדי כוכבים דרבי יוחנן אמר הפקר – In a case where one was מפקיר for ישראל only, but not for עכו"ם, where ר"י maintains that it is a valid הפקר‎ – תוספות responds: הני מילי כי שקיל ליה ישראל אבל כי שקיל ליה עובד כוכבים הפקר בטעות הוא ואינו הפקר: When did ר"י maintain that it is a valid הפקר, when a ישראל took it, however if a נכרי took it, it is considered as a mistaken הפקר, and it is not הפקר‎! S UMMARY הפקיר לישראל ולא נכרי is הפקר only if the ישראל was זוכה the הפקר‎. T HINKING IT OVER How can תוספות compare the case there where there was an actual הפקר (and therefore it may include even נכרים; regardless of what he said) to our case here where he left it as לקט שכחה ופאה (not הפקר) for עניי ישראל exclusively, therefore a נכרי cannot acquire it!
