    Chapter 2 - HaMevi Batra

גם: גיטין דף י״ט ע״ב, פרק ב׳ המביא בתרא

    English translation - Gittin 19b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1It is taught in a baraita in accordance with the opinion of Rav: In the case of witnesses who do not know how to sign, one tears a blank piece of paper for them, and they fill in the gaps with ink.

2Rabban Shimon ben Gamliel said: In what case is this statement said? For bills of divorce. However, for bills of manumission and for all other documents, if the witnesses know how to read and how to sign, then they sign, and if they do not know how to read and sign they do not sign.

3The Gemara asks: With regard to reading, who mentioned anything about it? Why does Rabban Shimon ben Gamliel mention the need for witnesses to be able to read when the discussion is about a witness who does not know how to sign? The Gemara answers: The baraita is incomplete, and this is what it is teaching: In the case of witnesses who do not know how to read, one reads the document in their presence and they sign. And in the case where they do not know how to sign, then one tears paper in the form of a stencil and they fill in the gaps with ink. With regard to this, Rabban Shimon ben Gamliel said: In what case is this statement said? For bills of divorce. However, for bills of manumission and for all other documents, if the witnesses know how to read and how to sign, then they sign, and if not they do not sign.

4Rabbi Elazar says: What is the reason of Rabban Shimon ben Gamliel, who permitted this only for bills of divorce? He holds that there is reason to be lenient with bills of divorce, so that the daughters of Israel should not be deserted. Requiring literate witnesses for bills of divorce could lead to a scenario in which a husband wishes to travel and wants to give his wife a bill of divorce in case he shall not return, but if he does not find literate witnesses he may leave without divorcing her, leaving her unable to remarry.

5Rava says: The halakha is in accordance with Rabban Shimon ben Gamliel. And Rav Gamda said in the name of Rava: The halakha is not in accordance with Rabban Shimon ben Gamliel. The Gemara asks: Rather, in accordance with whose opinion is the halakha ? Is it in accordance with the opinion of the Rabbis, and it is permitted to do this for any document?

6But wasn’t there a certain person who performed an action, and allowed witnesses to trace their names in a case of other documents that were not bills of divorce, and Rav Kahana ordered that he be flogged for doing so? The Gemara answers: Rav Gamda interpreted the statement of Rava only with regard to reading, meaning that the halakha is in accordance with the Rabbis and not Rabban Shimon ben Gamliel only with regard to the question of whether other documents may be read to the witnesses, but not with regard to whether they may sign other documents by means of a stencil.

7It is told that Rav Yehuda was nearly blind in his old age. He could barely read and he took great pains to read and sign documents as a witness or a judge. Ulla said to him: It is not necessary for you to do this, as the court scribes would read in the presence of Rabbi Elazar the master, i.e., the halakhic authority of Eretz Yisrael, and he would sign; and the court scribes would read documents before Rav Naḥman and he would sign; and you may do the same. The Gemara notes: And this was done specifically in a case like that of Rav Naḥman and the court scribes, as they had fear of him because he was a great man and a judge to whom they were subservient. Therefore, there was no concern that they would not read it correctly. However, for Rav Naḥman and other scribes, or the court scribes and another person, no; the document may not be read to the witness, as the scribes may read it incorrectly to him.

8The Gemara recounts the behavior of another amora who had documents read to him: When documents that were written in Persian and that were produced in gentile courts came before Rav Pappa, who did not know how to read Persian, he would have it be read by two gentiles, each one not in the presence of the other and in a way that each one would speak offhandedly, without knowing that they were giving testimony. Once he clarified what was written in the document he would collect payment with it even from liened property that had been sold, as he held that such a document is entirely valid with regard to monetary law.

9Rav Ashi said that Rav Huna bar Natan said to me that so said Ameimar: With regard to this Persian document, on which Jews are signed as witnesses, the court is able to collect payment with it, even from liened property that had been sold.

10The Gemara asks: But they don’t know how to read, as most Jews did not read Persian. The Gemara answers: Ameimar’s statement applies when they know how to read Persian. The Gemara questions how the court can rely upon such a document: But don’t we require all legal documents to be written in a writing that cannot be forged; and it is not so in documents produced by Persians, as the Persians were not particular about this when writing their legal documents. The Gemara answers: His statement applies in a case where the paper of the documents was processed with gall. Consequently, it is not possible to forge the writing. But we require a document to recap the essential topic of the document in its last line; and it is not so in the case of Persian documents. The Gemara answers: Ameimar’s statement applies in a case where the document recapped the essential topic of the document in the final line.

11The Gemara asks: But if Ameimar’s statement applies only when all these conditions are met, then what is he teaching us, that a document that is properly written in any language is valid? We already learned in a mishna (87b): In the case of a bill of divorce that he wrote in Hebrew and its witnesses signed in Greek, or one that he wrote in Greek and its witnesses signed in Hebrew, it is valid. If this is written in the mishna, Ameimar’s statement would not simply repeat it.

12The Gemara answers: This cannot serve as a clear proof, because if the only source for this halakha were from that mishna then I would say: This statement applies only for bills of divorce, where the Sages were lenient so that a woman would not be unable to remarry. However, for other documents, no. Consequently, Ameimar teaches us that other types of documents are valid if they are written in other languages as well.

13§ Shmuel says: If a man gave his wife a blank piece of paper and said to her: This is hereby your bill of divorce, then she is divorced. Why? We are concerned that perhaps he wrote it with gall water, rendering it a valid bill of divorce, and the writing was subsequently absorbed into the paper so that it was no longer visible.

14The Gemara raises an objection based on what was taught in a baraita ( Tosefta 8:2): If a husband said to his wife: This is hereby your bill of divorce, and instead of opening it and looking at it she took it and threw it into the sea, or into a fire, or into anything that destroys it; and he later said: It wasn’t actually a bill of divorce, rather it is a document of appeasement [ shetar passim ], a symbolic promissory note meant only for display so that the person holding it will be considered to be wealthy; or he said: It is a document of trust, which is a false promissory note given by one person to another, trusting that he will not make use of it until there has been an actual loan; then she is divorced. And he does not have the power to make her forbidden to everyone else as a married woman by saying that it was not a bill of divorce and they are still married.

15The Gemara makes an inference from the baraita : The reason she is divorced is because this bill of divorce has writing, and there is no way to ascertain what was written, but if it did not have writing, then no, there is no concern that perhaps it was a valid bill of divorce written with gall water. This runs counter to the statement of Shmuel. The Gemara answers: When Shmuel said that the woman was divorced with a blank piece of paper, it was in a case where we check the paper with a colored liquid [ maya denara ]. If the paper expels the writing, then it expels it and it is a valid bill of divorce. And if it does not expel it, then the document is nothing and she is not divorced.

16The Gemara asks: And if the paper expels the writing, what of it? It is possible that only now it expels the writing and the letters become visible, but from the beginning there was no legible writing and therefore the document should be considered invalid. The Gemara answers that even Shmuel said only: We are concerned, and he does not hold that it is a valid bill of divorce. Rather, the court takes into account the possibility that what he gave her in the beginning was a valid bill of divorce, and the halakha is that it is uncertain if she is divorced.

17Ravina said: Ameimar said to me that so said Mareimar in the name of Rav Dimi: These two witnesses who testify that the bill of divorce was given in their presence are required to read it. The Gemara raises an objection to this based on what was taught in a baraita : If a man says to a woman: This is hereby your bill of divorce, and instead of opening it and looking at it she took it and threw it into the sea, or into a fire, or into anything that destroys it, and he later said: It wasn’t actually a bill of divorce, but rather, it is a document of appeasement, or it is a document of trust; then she is divorced, and he does not have the power to make her forbidden to everyone else as a married woman by saying that it was not a bill of divorce and they are still married. And if you say that the witnesses need to read the bill of divorce, then is the husband able to say this to her after they read it?

18The Gemara answers: No, it is necessary for Rav Dimi to teach his halakha in a case where after they read it, the husband placed it under his arm, and later took it out, and gave it to the woman without it being read again. Lest you say that he switched it with another document, and what he gave her was not a bill of divorce but a document of appeasement or trust as he claims, Rav Dimi teaches us that the court need not be concerned that he switched it.

19The Gemara tells: There was a certain man who threw what he claimed was a bill of divorce to his wife, into her courtyard, among the barrels, and in the end a mezuza was found there. The question is: Is there a concern that he threw her a bill of divorce, and the bill of divorce was destroyed, and the mezuza happened to be in the same location? Or perhaps he threw her the mezuza and only claimed that it was a bill of divorce. Rav Naḥman said: A mezuza is infrequently placed among the barrels, and it can be assumed that he threw the mezuza and not a bill of divorce.

20The Gemara comments: And this statement applies only when one mezuza was found. However, if two or three mezuzot were found, then the assumption is that as this, the other mezuza , was there, this mezuza was also there before the husband came, and as to the bill of divorce, say that the mice later took it, and the woman was already divorced from the moment it reached her courtyard.

21It is told: There was a certain man who entered the synagogue, took a Torah scroll, and gave it to his wife. And he said to her: This is your bill of divorce. Rav Yosef said: For what is there to be concerned for it? If you say that there should be a concern due to gall water, that perhaps he wrote a bill of divorce on the outside of the Torah scroll’s parchment with gall water, and this writing is now invisible, gall water is not permanent when applied on top of gall water. Since parchment for the Torah scroll is processed with gall water, it is not possible to write something with gall water that will remain permanently on the parchment itself. Therefore, there is no concern that he wrote a bill of divorce on the parchment.

    Tosafot

טעמא דאיכא כתב הא ליכא כתב לא‎—The reason is because there is writing, but if there is no writing; no O VERVIEW שמואל ruled that if a husband gave his wife a blank paper and said to her, ‘here is your גט’, she is divorced, because there is the possibility that he wrote it במי מילין‎. The גמרא challenges the ruling of שמואל from a ברייתא (regarding שטר פסים). תוספות clarifies the question and also the ruling of שמואל including the meaning of נייר חלק‎. ------------------------ תוספות asks: ואם תאמר הא דבעינן דאיכא כתב משום דחזר ואמר שטר פסים הוא‎ – And if you will say; the reason we require that there is writing in order that it should be a גט, is because he later said it is a שטר פסים‎ – וכי האי גוונא הכא גבי נייר חלק אם חזר ואמר נייר חלק הוא היה נאמן‎ – And if it were in the same situation here regarding the blank paper, if he later said it is a blank paper, he would be believed – אבל לעולם כל זמן שאמר גט הוא מגורשת ולא קשה מידי לשמואל – However, as long as he said it is a גט and did not retract, she is divorced, so there is no difficulty to reconcile שמואל with the ברייתא of שטר פסים‎. תוספות answers: ויש לומר [דכיון] דסלקא דעתין השתא דמגורשת ודאי קאמר שמואל – And one can say; that since we presently assume that שמואל meant that she is certainly מגורשת (not just merely that we are concerned that perhaps she is מגורשת) – אם כן לא חשיב ריעותא במאי שהוא נייר חלק – If this is indeed so (that if he gave her a נייר חלק she is מגרושת ודאי) therefore the fact that it is a נייר חלק, that is not considered a defect in the גט‎ – ואם כן כשחזר ואמר נמי נייר חלק הוא אית לן למימר דלאו כל הימנו לאוסרה‎ – So therefore even when he later states it is a נייר חלק we should rule that he is not believed to prohibit her from marrying someone else (not as תוספות assumed in the קושיא) – כמו היכא דאיכא כתב – Just as he is not נאמן לאוסרה when there is a כתב (in the case of שטר פסים). תוספות asks: ואם תאמר והיכי סלקא דעתין דמגורשת ודאי קאמר כיון דנראה שהוא נייר חלק‎ – And if you will say; how could it even have entered our minds that שמואל meant she is ודאי מגורשת since visibly it is a נייר חלק‎?! תוספות answers: ויש לומר כיון דאמר הרי זה גיטך בדבר מועט מהימנינן לבעל‎ – And one can say; since the husband said; ‘here is your גט’, we believe the husband even with a minimal proof that there is a גט (written במי מילין) – תוספות supports this concept from elsewhere: כי היכי דאמרינן בעל שאמר גירשתי אשתי נאמן הואיל ובידו לגרשה – Just as we rule that a husband who claims, ‘I divorced my wife’, he is believed, since it is in his power to divorce her – תוספות offers another option why we assumed that she is ודאי מגורשת by a נייר חלק: אי נמי דאיירי דקריוה בי תרי מעיקרא ועייליה לבי ידיה ואפקיה – Or you may also say; that we are discussing a case where initially two עדים read the גט, and after they read it the husband took it in his hands and he brought it out and gave it to her. We initially assumed that she is ודאי מגורשת (even though she is now holding a נייר חלק) – דלא חיישינן דלמא חלפיה‎ – For, we are not concerned that perhaps he exchanged the גט, which the עדים read, with a נייר חלק, but rather we assume that it is the same גט‎. Now תוספות addresses the issue, how come it is blank now?! ונייר חלק דקאמר שמואל לא בשעת נתינה ראו שהוא נייר חלק – And when שמואל said נייר חלק, it does not mean that when the גט was given people saw that it is a נייר חלק‎ – דאם כן אפילו היה ודאי כתוב במי מילין אינו גט כיון דבשעת נתינה כבר נבלעו האותיות‎ – For if indeed this is the meaning of נייר חלק, then even if it was certainly written with מי מילין, it would not be a valid גט, since at the time of נתינה the letters were already absorbed into the נייר and are not visible – כדאמר בסמוך כי פליט מאי הוי השתא הוא דפליט – As the גמרא shortly states, ‘so what of it that the letters came forth; they only came forth now’, but not when the גט was handed to her – אלא שעה אחת אחר נתינה כשיעור שהאותיות יכולות להבלע ראו שהיה נייר חלק – But rather the meaning of נייר חלק is that a certain amount of time after the giving of the גט, the amount of time required for the letters (of מי מילין) to be absorbed in the נייר, then the people saw that it is a נייר חלק‎. תוספות offers a final resolution to נייר חלק: ועוד יש לומר דבשעת נתינה ראו מרחוק ודומה להם נייר חלק‎ – And one can also say; that at the time of נתינת הגט people saw from afar and it appeared to them as a נייר חלק‎ – ושמא אם היו מעיינין היו האותיות ניכרים: But perhaps if they would have looked closely the letters would have been apparent. S UMMARY The גמרא assumed that שמואל maintains that it is a גט even if later he said it was just a נייר חלק‎. In the הו"א the גמרא assumed that she is מגורשת ודאי (by נייר חלק) either because the בעל is always נאמן (for הואיל ובידו לגרשה), or because it was actually read before they gave it to her, or because they viewed the גט from afar. T HINKING IT OVER 1. According to the first אוקימתא of תוספות (that the בעל is נאמן since it is בידו לגרשה), does שמואל agree with the ruling of רב דימי, that צריכי למקרייה or not? 2. According to the last אוקימתא of תוספות (that the people saw the גט from afar), why does שמואל say חיישינן במי מילין כתבו, when he should have said, ‘if they were closer they would have seen the כתב’?! 3. Of the three אוקימתא in תוספות (נייר חלק, קריוהו בי תרי and ראו מרחוק) which is the most lenient (in allowing the גט to be כשר) and which is the strictest?

מיא דנרא‎— O VERVIEW The גמרא says that we need to examine the נייר with מיא דנרא to verify whether it was written במי מילין or not. רש"י explains that נרא is a dye called פוייל"י and we spread the מי נרא over the נייר‎. Our תוספות cites a different view. פירש רבינו חננאל מי קליפת רימון וכן בערוך: The ר"ח explained that מיא דנרא is the extract of the bark of a pomegranate tree, and similarly in the ערוך it is also explained in this manner. S UMMARY נרא is קליפת רמון‎. T HINKING IT OVER If we were בודק with the מיא דנרא (according to רש"י) and no writing appeared, what will be the ruling according to the ר"ח (if his מיא דנרא is not available) or vice versa?

ושמואל נמי חיישינן קאמר‎—And שמואל also said, we are concerned O VERVIEW The גמרא concluded that when שמואל ruled that a woman is מגורשת even with a נייר חלק, he meant that we are concerned that perhaps she is מגורשת‎. Our תוספות clarifies the ruling of שמואל according to the מסקנא‎. ----------------------- השתא לא צריכי לאוקמי דבדקיניה דכי לא בדקיניה נמי איכא למיחש – Now ( that we understand that שמואל is only חושש for גירושין, but not that she is מגורשת ודאי) it is not necessary to establish the ruling of שמואל, regarding a נייר חלק, in a case where we examined the נייר חלק with מיא דנרא, for even if we did not examine the נייר, we can still be concerned that she may be מגורשת – ומיהו ודאי אי בדקיניה ולא פליט לאו כלום הוא: However, it is certain that if we examined the נייר חלק with מיא דנרא and nothing came up, the גט is meaningless ; there is not even a חשש גירושין. S UMMARY If one gives his wife a נייר חלק and says הרי זה גיטך there is a חשש גירושין, even if we did not examine it במיא דנרא‎. If however it was examined and no letters showed up, there is no חשש of גירושין‎. T HINKING IT OVER 1. Why was it necessary for תוספות to teach us that if it was examined and לא פליט there is no חשש‎. Seemingly this is obvious, the גמרא states so clearly (ואי לא פליט לאו כלום הוא), why mention it?! 2. From the גמרא it appeared that the ruling of שמואל is only if בדקינן ליה במיא דנרא‎. However, according to תוספות that when the גמרא concluded שמואל נמי חיישינן קאמר, the ruling of שמואל is even without בדקינן, the גמרא should have said 'אלא', etc. to indicate that there is new understanding of שמואל‎!

צריכי למיקרייה‎—They are required to read it O VERVIEW The גמרא cited a ruling in the name of רב דימי that the עדי מסירה must read the גט‎. Our תוספות discusses when the גט should be read. -------------------------- קודם נתינה איירי מדמשני בסמוך לא צריכא דלבתר דקריוה עייליה כולי – We are discussing before the giving of the גט (that is when it needs to be read according to רב דימי), since the גמרא shortly answers, ‘it was only necessary in a case where after they read it they placed it in the folds of his garment, etc. ואי לא קרייה נראה דלא הוי גט מדלא משני הכא במאי עסקינן דלא קרייה – However, if they did not read the גט before it was given to the wife, it is the view of תוספות that it is not a valid גט, since the גמרא did not answer, ‘we are discussing here a case where they did not read it’ – משמע דאי לא קרייה אינה מגורשת‎ – This indicates that if they did not read it she is not divorced. תוספות asks: ואם תאמר דתנן לקמן בהזורק (דף פ, א) כתב גט לאיש ושובר לאשה וטעה ונתן כולי‎ – And if you will say; for we learnt in a משנה later in פרק הזורק, ‘ the סופר wrote a גט for the husband (to give it to the wife) and a receipt for the woman (to give it to her husband when he pays the כתובה), and the סופר erred and he gave etc. (the גט to the woman and the שובר to the husband) – ולאחר זמן גט יוצא מתחת ידי האיש ושובר מיד האשה תצא מזה ומזה‎ – And after a while they realized that the man is in possession of the גט and the woman is in possession of the שובר, the rule is that the woman must leave both her new husband and old husband. This concludes that משנה‎ – ודייק עלה בהאשה רבה (יבמות דף צא, ב) מאי הוה לה למעבד‎ – And the גמרא in פרק האשה רבה infers from the previously mentioned משנה of יבמות, where it is a case of ‘ what could she have done’ so why is it תצא מזה ומזה; seemingly proving that we do not say מאי הוה לה למיעבד‎ – ומשני איבעי לה לאקרויי גיטא‎ – And the גמרא there answered she should have read the גט before she remarried; therefore it is not a case of מאי הוה לה למעבד‎. This concludes the גמרא‎. Now תוספות continues with his question – והשתא אי לא קרייה אפילו לא הוחלפה להם אינה מגורשת – But now that we say that the גט must be read for it to be valid, so if they did not read the גט (as is evidenced by the answer איבעי לה לאקרויי גיטא), then even if the גט and the שובר were not mixed up (but rather she received the גט from her husband), nevertheless she is not מגורשת since the גט was not read! תוספות answers: ויש לומר דנהי דאסורה לינשא בדלא קרייה מכל מקום אם נשאת לא תצא‎ – And one can say; granted that she is initially forbidden to remarry if the גט was not read by the ע"מ, nevertheless if she remarried (without the גט being read), she is not required to leave her new husband (provided it is a valid גט) – תוספות offers an alternate solution: אי נמי התם בעייליה לבי ידיה וקנסינן לה דאיבעי למיהדר מיד לאקרויי או לאחר נתינה‎ – Or you may also say; there (by the גט ושובר) we are discussing a case where after the עדים read it, the סופר put the גט ושובר in their (opposite) respective hands, so we punish her that תצא מזה ומזה, for she should have read it again immediately (to make sure that the proper document was given to each party, or she should have read it at least after it was given to her (since there were two documents). That is why we punish her that תצא מזה ומזה‎ – מאחר שבאה לידי קלקול – Since it resulted in a calamity. ומיהו אינה אסורה לינשא אי לא קראה שנית כדאמר הכא לאו כל הימנו לאוסרה – However, she is not forbidden to remarry if she did not read it a second time, as the גמרא states here (regarding the שטר פסים), ‘he does not have the authority to prohibit her from remarrying – אף על גב דעל כרחיך לא קראה בתר הכי – Even though that perforce she did not read it again afterwards. והיה רגיל רבינו יצחק לקרות קודם הנתינה ולאחר הנתינה‎ – And the ר"י was accustomed to read the גט before it was given and after it was given – ומיהו פשיטא דאי לא קראה קודם הנתינה וקראה לאחר הנתינה דבר פשוט הוא דמגורשת: Nevertheless, it is obvious that if the גט was not read before it was given, but it was read after it was given; it is a simple matter that she is divorced. S UMMARY The גט should be read by the ע"מ before the נתינה (and preferably after the נתינה), otherwise she may not remarry (unless it is read after the נתינה). [If the גט was not read at all there is a dispute whether אם נשאת תצא or not.] T HINKING IT OVER תוספות asks if the גט is not valid without קריאה then in the case of גט ושובר it should be invalid even if they were not mixed up. However, if they were not mixed up, then it is not פסול, for we can read it now as תוספות concludes shortly! 2. Is it preferable to read the גט before the נתינה or after the נתינה‎?
