    Chapter 4 - HaSholeach

גם: גיטין דף מ״ו ע״א, פרק ד׳ השולח

    English translation - Gittin 46a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1or: I am removing you from the house due to a vow. The Gemara explains that Rav Naḥman holds: What is the reason that he is prohibited from remarrying her? This is due to potential harm caused to her. If he would wish to remarry her after she had married someone else, he may cast aspersions on the validity of the bill of divorce by claiming that he gave it under a false impression. This may lead to her child from her second marriage to be considered a mamzer . Therefore, if he said to her at the time of the divorce that this is the reason he is divorcing her, then he will be able to cause this harm to her, but if he did not state this explicitly at the time of the divorce, he will not be able to cause this harm to her, as his claim will be disregarded.

2There are those who say a different version of Rav Yosef bar Minyumi’s statement. Rav Yosef bar Minyumi said that Rav Naḥman said: He must say to her: Be aware that I am removing you from the house due to your bad reputation, or: Be aware that I am removing you from the house due to a vow. The Gemara explains that Rav Naḥman holds: What is the reason that he is prohibited from remarrying her? So that Jewish women will not be promiscuous with regard to forbidden sexual relations or lax with regard to vows. The Sages penalized these women who acted improperly by instituting that if they were divorced due to their actions, they cannot return to their husbands. Therefore he must say this to her: Be aware. It will therefore serve as a warning for other women.

3The Gemara comments: It is taught in a baraita in accordance with the first version of Rav Yosef bar Minyumi’s statement citing Rav Naḥman, and it is taught in another baraita in accordance with the latter version.

4It is taught in a baraita ( Tosefta 3:4) in accordance with the first version: Rabbi Meir said: For what reason did they say that a man who divorces his wife due to her bad reputation may not remarry her, and one who divorces his wife due to a vow may not remarry her? Perhaps she will go and marry another man, and later the matter will be found to have been fabricated, i.e., he will find that the rumor was false or that it was possible to dissolve the vow, and he will say: If I would have known that it is like this, then even if they would have given me one hundred times one hundred dinars to divorce her I would not have divorced her; and the bill of divorce will be found to be void, and her children from her second husband will be considered mamzerim . Therefore, one says to him from the outset: Be aware that a man who divorces his wife due to her bad reputation may not remarry her, and one who divorces his wife due to a vow may not remarry her.

5It is taught in a baraita ( Tosefta 3:4) in accordance with the latter version: Rabbi Elazar, son of Rabbi Yosei, said: For what reason did they say that a man who divorces his wife due to her bad reputation may not remarry her, and one who divorces his wife due to a vow may not remarry her? So that Jewish women will not be licentious with regard to forbidden sexual relations or lax with regard to vows. Therefore, in order to publicize this matter, one says to him upon divorcing his wife: Say to her: Be aware that I am removing you from the house due to your bad reputation, or: I am removing you from the house due to a vow.

6§ The mishna taught that Rabbi Yehuda says: If he divorced her due to any vow that the public was aware of, he may not remarry her, but if he divorced her due to a vow that the public was not aware of, he may remarry her. Rabbi Yehoshua ben Levi said: What is the reason of Rabbi Yehuda? Based on what does he make the distinction of whether the public is aware of the vow or not? As it is written in the Torah portion describing the interaction of the Jews with the people of Gibeon: “And the children of Israel did not strike them, for the leaders of the congregation swore to them” (Joshua 9:18). This teaches that a vow taken in the presence of the public cannot be dissolved. In this case as well, if she took an oath that is known by the public, it cannot be dissolved.

7And the Rabbis, who hold that such a vow can also be dissolved, respond to this claim in the following manner: There, did the oath take effect with regard to them at all? Since the people of Gibeon said to them: “We came from a far country” (Joshua 9:6), and they did not come from a far country, the oath did not take effect with regard to the Jewish people at all, as it was taken under false pretenses. And this, that the Jewish people did not kill the Gibeonites, like they did to the other nations who resided in the land of Canaan, despite the fact that the vow did not take effect, was due to the sanctity of God’s name. If they would have killed them, they would have desecrated God’s name by not fulfilling their word, although this vow did not take effect.

8The Gemara asks: And how many people constitute the public with regard to this halakha ? Rav Naḥman says: Three people. Rabbi Yitzḥak says: Ten people. The Gemara explains their opinions.

9Rav Naḥman says: Three, and he derives this from a verse written with regard to a zava . The verse states: “And if a woman has an issue of her blood for many days [ yamim rabbim ]” (Leviticus 15:25). Rav Naḥman holds that “days” are a minimum of two, so the addition of the word “many” indicates that it means three days. Here too, where the mishna uses the term many [ rabbim ], it is a minimum of three people. Rabbi Yitzḥak says: The halakha that a vow taken in the presence of the public cannot be dissolved is referring to a vow taken in the presence of at least ten people, as it is written in the Torah portion discussing the people of Gibeon, which is the source for this halakha : “For the leaders of the congregation swore to them,” and a congregation consists of at least ten people, as is derived from the episode concerning the spies.

10§ The mishna taught that Rabbi Meir says: If he divorced her due to any vow that requires investigation and dissolution by a halakhic authority, he may not remarry her; however, if he divorced her due to a vow that does not require investigation and dissolution by a halakhic authority, he may remarry her. It is taught in a baraita that Rabbi Elazar says: They prohibited him from remarrying her in the case where she stated a vow that requires dissolution by a halakhic authority only due to a case where she stated a vow that does not require dissolution by a halakhic authority.

11The Gemara asks: With regard to what principle do they disagree? The Gemara explains that Rabbi Meir holds: A man desires, i.e., does not mind, that his wife should be disgraced in court. Even though her vow would necessitate dissolution by a halakhic authority, the husband may still claim that had he known that it could be dissolved, he would not have divorced her. However, with regard to a vow that did not require dissolution by a halakhic authority but could have been nullified by the husband, he would not be deemed credible to state that he was not aware that he had the ability to nullify it. In such a case, if he were to claim that the divorce was in error, his claim would be disregarded.

12And Rabbi Elazar holds: A man does not desire that his wife should be disgraced in court. Therefore, if he were to claim that had he known that her vow could have been dissolved by a halakhic authority he would not have divorced her, his claim would have been disregarded. He is, however, deemed credible if he were to state that he did not know that he had the ability to nullify her vow. Therefore, in the case of a vow that does not require dissolution by a halakhic authority, the Sages instituted that he would not be permitted to remarry her, lest he bring the validity of the divorce into question, as explained earlier. Rabbi Elazar also holds that once the Sages instituted this ordinance with regard to vows that do not require dissolution by a halakhic authority, they applied this ordinance with regard to vows that do require dissolution by a halakhic authority as well.

13Rabbi Yosei, son of Rabbi Yehuda, said: There was an incident in Tzaidan involving one man who said to his wife: It is konam if I do not divorce you, and he divorced her; and the Sages permitted him to remarry her, for the betterment of the world. What did the mishna teach that causes Rabbi Yosei, son of Rabbi Yehuda to teach this incident? The mishna had just discussed a case where the woman took a vow, and it relates an incident where the man took a vow.

14The Gemara answers: The mishna is incomplete and this is what it is teaching: In what case is this statement said? When she took a vow, since he may not remarry her in that case. However, if he took a vow, he may remarry her. And Rabbi Yosei, son of Rabbi Yehuda, said: There was also an incident in Tzaidan involving one man that said to his wife: It is konam if I do not divorce you, and he divorced her; and the Sages permitted him to remarry her, for the betterment of the world.

    Tosafot

אי אמר לה הכי מצי מקלקל לה‎—If he told her this he can ruin her O VERVIEW רב נחמן stated that the ruling of the משנה that one may not remarry his wife whom he divorced because of a שם רע or נדר, is only if he explicitly told her when he was divorcing her that he is doing so because of the ש"ר or נדר‎. The reason, says ר"נ, is because if he stated it so, he can ruin her. There is a dispute between רש"י and תוספות as to what מקלקל לה means and how the חכמים prevent this from happening. -------------------------------- נראה דחששא זו אינה כי אם לעז בעלמא ולא שיהיה ממש גט בטל ובניה ממזרים‎ – It appears to תוספות that this concern of מצי מקלקל לה, is merely that he will spread a rumor that her divorce is invalid, but not that the גט should be actually nullified and her children from her second husband will be ממזרים‎ – דהא לא אמר על מנת – For he did not make a stipulation when he divorced her; he merely said, ‘I am divorcing you because of this reason’ – תוספות anticipates a difficulty: דאף על גב דבכמה דוכתי מהני גילוי דעת כמו שטר מברחת דהאשה שנפלו (כתובות דף עט, א) – For even though in many instances a ‘revelation of one’s mindset’ is effective to nullify a transaction (even without saying ע"מ), like the case of a שטר מברחת in פרק האשה שנפלו‎ – וזבין ולא איצטריכו ליה זוזי דפרק אלמנה ניזונת (שם דף צז, א) – And in the case in פרק אלמנה ניזונת, where he sold his property for he needed the money to buy something else, and it turned out that he did not need the money; the rule is that the sale is nullified because of this גילוי דעת‎. The question is why his גילוי דעת here is not sufficient to invalidate the גט‎?! תוספות responds: הכא ליכא למימר הכי מדבעי לרבי מאיר תנאי כפול – Here we cannot say that גילוי דעת should be effective; תוספות proves this, since according to ר"מ, we require a double stipulation – לכך נראה דלא אתי אלא ללעז בעלמא שיוציא עליה לעז כדי להחזירה – Therefore (since he cannot be מבטל the גט) it appears to תוספות that it will only be merely a rumor; that he will spread the rumor that the divorce is invalid, in order to have his wife return to him – תוספות responds to an anticipated difficulty: אף על גב דכבר נישאת לאחר שריא ליה דזנות דשוגג הוא – And even though she already married someone else, nevertheless he assumes that she is permitted to him for it was a זנות בשוגג‎ – לכך אמרו חכמים דלא יחזיר דהשתא שוב לא יוציא לעז – Therefore the חכמים ruled that he cannot take her back (even if she did not remarry), so now he will not be מוציא לעז‎. In summation; according to תוס' if the rule would be יחזיר (if she did not remarry), he will claim the גט is void (in an attempt to take back his wife), and that will make a לעז on the children. Therefore the חכמים made a תקנה that he cannot take her back ever (even if she does not remarry), in which case there is no reason for him to be מוציא לעז, since he will never be able to have her back. תוספות cites sרש"י' explanation (why there is no concern): ורש"י פירש דאפילו יאמר אילו הייתי יודע כולי אינו נאמן‎ – And רש"י explained that even if he will say; ‘if I would have known that my reasons are unfounded, etc. (I would not have divorced her) ’ he would (still) not be believed – דכיון דיודע שאסור להחזירה ולא חש להמתין ולבדוק אחר הדברים‎ – For since he knows that he is forbidden to take her back and he was not concerned to wait and verify these issues – גילה בדעתו שלא היתה חביבה עליו‎ – He revealed his mind that she is not so dear to him, so he will not be believed when he said. ‘if I knew this was not true I would have not divorced you’. תוספות responds to an anticipated difficulty: ולרבי מאיר דבעי תנאי כפול כי לא כפליה למילתיה אפילו לעז ליכא – And according to ר"מ who requires a תנאי כפול, if he was not כופל the תנאי, there will not even be לעז‎ – תוספות responds to another anticipated difficulty: והא דקאמר רבי מאיר כל נדר שצריך חקירת חכם לא יחזיר – And this which ר"מ stated in our משנה; ‘any נדר which the woman made that requires the examination of a חכם, he may not take her back’ – היינו בדכפליה למילתיה ולא כפליה לתנאיה – This is in a case where he repeated the statement, but did not double the תנאי‎ – דאי כפליה לתנאיה אין מועיל מה שלא יחזיר דלעולם איכא קלקולא: For if he doubled the תנאי, the rule that he may never take her back is ineffective, for there will always be the problem of קלקול‎. S UMMARY According to רש"י the concern is that he will be מבטל the גט and the תק"ח accomplishes that we do not believe him. According to תוספות the concern is for לעז, and the תק"ח assures us that he will not be מוציא לעז‎. T HINKING IT OVER 1. תוספות states that in our case (of מוציא משום ש"ר ונדר), a גילוי דעת is insufficient to nullify the גט (as opposed to other situations where it is sufficient). תוספות goes on to prove it. However תוספות does not explain why indeed a גילוי דעת is insufficient here. What could be the reason why indeed a גילוי דעת is insufficient here?! 2. Will the last two questions of תוספות apply to פרש"י as well?

שלא יהו בנות ישראל פרוצות כולי‎—So that Jewish women should not be promiscuous, etc. O VERVIEW The משנה stated that if one is divorcing his wife משום ש"ר or because of a נדר, he may never take her back as a wife. Various תנאים in the משנה (namely ר"י, ר"מ, ר"א) qualify this rule somewhat. The גמרא cited two versions in the name of רב יוסף why this prohibition was enacted; one was because of קלקול and the other because of פריצות‎. ----------------------------------- הני תרי לישני דרב יוסף אליבא דתנא קמא פליגי – These two versions of ר"י are arguing (only) according to the ת"ק of the משנה‎ – דלישנא קמא סבר כיון דקתני במתניתין נמי משום שם רע‎ – The first version (of קלקול) maintains that since the משנה also teaches regarding one who is divorcing because of a ש"ר – והתם אין שייך פריצות דמה לה לעשות אם מוציאין שם רע עליה – And there (by ש"ר) the reason of פריצות is not applicable, for what can she do if people are gossiping about her – אלא טעמא משום קלקולא הוא – But rather the reason for לא יחזיר is because he may ruin her – ולישנא בתרא סבר דבמוציא שם רע לא מצי מקלקל לה – And the latter version (פריצות) maintains that by מוציא ש"ר he cannot ruin her – דכיון דמשום שם רע מגרשה דעתו בכל ענין לגרשה אפילו יהא בטל‎ – For since he is divorcing her because of a ש"ר, his intent is to divorce her in any event even if the ש"ר is retracted, therefore the reason must be because of פרוצות‎ – וכן בנדרים דמסתברא דחד טעמא הוי בתרוייהו‎ – And similarly by נדרים the reason is because of פרוצות (and not because of קלקול) for presumably there is one reason (פריצותא) for both cases of ש"ר and נדר‎ – תוספות responds to an anticipated difficulty: והשתא אתי שפיר דמייתי תניא כלישנא קמא מדרבי מאיר אתנא קמא‎ – And now it is quite justified that the גמרא cites a proof (from a ברייתא) to the ל"ק, from ר"מ to the ת"ק – דלא מייתי אלא דשייך במוציא שם רע משום קלקולא והוא הדין לתנא קמא – For he is not offering a proof that ר"מ maintains קלקול, but rather that the concept of קלקולא is applicable by מוציא ש"ר (according to ר"מ) and similarly according to the ת"ק – תוספות asks: ואם תאמר ללישנא בתרא דרב יוסף דטעמא משום פריצותא‎ – And if you will say; according the last version of ר"י that the reason for לא יחזיר is because of פריצותא, but not on account of קלקולא‎ – מנא לן דפליגי רבנן עליה דרבי יהודה וסברי דנדר שהודר ברבים יש לו הפרה‎ – How does the גמרא know that the רבנן argue with ר"י and maintain that a נדר which was made in public can be annulled; we know the גמרא assumes this – דקאמר ורבנן מי חיילא כולי‎ – For the גמרא states, ‘and the רבנן will respond to ר"י saying, ‘did that נדר take effect, etc.’ – תוספות answers: ויש לומר דהך סוגיא אתיא כלישנא קמא דטעמייהו משום קלקול – And one can say; that this סוגיא which assumes that the רבנן argue with ר"י is according to the ל"ק that the reason of the ת"ק is because of קלקול‎ – תוספות offers an alternate solution: אי נמי הא דקאמר ורבנן היינו רבי מאיר ורבי אלעזר דאמרי לא אסרו צריך כולי‎ – Or you may also say, this which the גמרא states, ‘ורבנן’, that means (not the ת"ק of our משנה, but rather) ר"מ ור"א who say[s] they did not forbid צריך, etc. – דקסברי טעמא משום קלקולא‎ – For they maintain the reason for לא יחזיר is because of קלקולא‎ – ואפילו בהודר ברבים קאמר דלא אסרו אלא מפני שאינו צריך‎ – For even in a case of הודר ברבים, which ר"א may rule לא יחזיר, however ר"א stated that they only prohibited צריך because of אינו צריך; this would indicate that the איסור is not because of פריצותא‎ – דאי ברבים אסור משום פריצותא הוי ליה למיסר לא ידעו בו רבים אטו מפני דידעו בו רבים‎ – For if a נדר ברבים is אסור משום פריצותא, he (ר"א) should have forbidden לא ידעו בו רבים on account of ידעו‎ – ולא מפני שאין צריך: And not that צריך is אסור because of אין צריך‎. S UMMARY The two לשונות (of קלקולא and פריצותא) are only according to the ת"ק; however ר"י maintains פריצותא and ר"מ ור"א follow קלקולא‎. T HINKING IT OVER תוספות proves that ר"א maintains קלקולא rather than פריצותא, since when he was אוסר in all cases, he was גוזר צריך אטו אינו צריך, but was not גוזר לא ידעו בו רבים אטו ידעו‎. However how is that sufficient proof; in any event he is אוסר by all נדרים, why should he choose to mention ידעו בו רבים over אין צריך‎?!

כיון דאמרו מארץ רחוקה וכולי‎—Since they said, from a far land, etc - O VERVIEW The גמרא taught that ר' יהודה derived his ruling that a נדר שהודר ברבים אין לו הפרה, from the story of the גבעונים, where the נשיאי העדה swore to make peace with them. The רבנן, who disagree with ר"י and maintain that יש לו הפרה, say that the שבועה was never effective since it was mistakenly made, for the גבעונים claimed that they were from far away (not from the ז' אומות), so there was no need even for הפרה, the reason they did not kill the גבעונים is because of קדושת השם‎. ----------------------------- תוספות asks: ואם תאמר בלאו הכי מי חיילא שבועה והא הוי נשבע לבטל את המצוה‎ – And if you will say; without this issue that they made a false statement (so the שבועה was בטעות); can this שבועה take effect, but it is a שבועה to nullify a מצוה‎ – דכתיב (דברים כ, טז) לא תחיה כל נשמה – For it is written, ‘you should not allow any soul to live’ – תוספות anticipates a possible solution to his question: ואף על גב דאמרינן בירושלמי דשביעית פרק ששי אמר רבי שמואל בר נחמני‎ – And even though that in תלמוד ירושלמי in the sixth פרק of מסכת שביעית; רשב"נ stated – שלש פרוזדוגמאות שלח יהושע לארץ ישראל עד שלא יכנסו לארץ‎ – יהושע sent three messages to the inhabitants of א"י before the בנ"י entered א"י – מי שהוא רוצה לפנות יפנה להשלים ישלים לעשות מלחמה יעשה מלחמה‎ – Whoever desires to vacate, should vacate; to make peace, let them make peace; to wage war, let them wage war – גרגשי פינה והלך לאפריקא‎ – The nation of גרגשי vacated and went to אפריקא‎ – גבעונים השלימו שנאמר (יהושע י, א) וכי השלימו יושבי גבעון את ישראל‎ – The גבעונים made peace as it states, ‘and that the inhabitants of גבעון made peace with ישראל’ – שלשים ואחד מלכים עשו מלחמה ונפלו‎ – Thirty one kings waged war and were defeated; this would seemingly answer the question – תוספות rejects this answer: היינו קודם שעברו את הירדן כדקאמר עד שלא יכנסו לארץ‎ – This offer for peace was only before the בנ"י crossed over the ירדן as the ירושלמי stated, ‘before the בנ"י entered the land’ – אבל משנכנסו משמע שלא היו יכולין להשלים‎ – However, it seems that once the בנ"י entered א"י they could no longer make peace and would have to be killed – ולכך הוצרכו להערים ולומר מארץ רחוקה באנו‎ – So therefore the גבעונים needed to be sly and say, ‘we came from a far land and we are not from the ז' אומות’. תוספות answers: ויש לומר דעל כרחך באין רוצים להשלים כתיב לא תחיה כל נשמה‎ – And one can say that perforce we must say that when the תורה writes לא תחיה כל נשמה that is only if they do not want to make peace – כדמוכחי קראי (דברים כ) וקראת אליה לשלום וגומר ואם לא תשלים עמך וגומר‎ – As is evident from the פסוקים; the פסוקים begin, ‘ and you shall call out to her for peace, etc. and if they will not make peace with you, etc.; the פסוקים continue – רק מערי העמים וגומר לא תחיה כל נשמה‎ – Only from the cities of the nations, etc. leave no one alive’ – תוספות asks: ואם תאמר מאי טעמא דרבי יהודה הא ודאי שבועה בטעות הואי – And if you will say; what is the reasoning of ר"י (that he derives from this story that נדר שהודר ברבים אין לו הפרה); but is was certainly a mistaken שבועה‎ – An additional question: ועוד לרבי יהודה איך הניחום בארץ הכתיב (שמות כג, לג) לא ישבו בארצך וגומר‎ – And furthermore how, according to ר"י, did the בנ"י allow the גבעונים to live in ארץ ישראל; but it is written, ‘they shall not live in your land, etc.?! והוה ליה נשבע לבטל את המצוה ועל כרחך משום חילול השם הוא כדאמרי רבנן‎ – So it is a case of swearing to be מבטל a מצוה which is ineffective, so perforce we must say like the רבנן say, that they kept the ‘oath’ only because otherwise it would be a חילול השם‎! תוספות answers: ויש לומר דקסבר רבי יהודה דאי איתא דיש לו הפרה לא היה בדבר חילול השם – And one can say; that ר"י maintains that if it is so that a נדר שהודר ברבים יש לו הפרה, there would not be a חילול השם if they annulled the נדר‎ – תוספות asks: ואם תאמר בלא חילול השם נמי אין יכולין להורגן כיון דבאין להתגייר‎ – And if you will say; even without the reason of חילול השם, the בנ"י could not have killed the גבעונים since they came to convert – כדאמרינן לעיל (דף מה, א) לא ישבו בארצך פן יחטיאו אותך לי‎ – As the ברייתא stated previously on the פסוק, ‘they should not settle in your land, lest they cause you to sin against me’, the ברייתא states – יכול בעובד כוכבים שקיבל עליו שלא לעבוד עבודת כוכבים כולי‎ – I may think that this applies even to a נכרי who accepted upon himself not to worship idols, etc. so we derive from another פסוק that they may remain in the land – ואמרינן נמי בפרק אלו נאמרין (סוטה דף לה, ב) – And ר' שמעון also stated in פרק אלו נאמרין‎ – וכתבו להן מלמטה למען אשר לא ילמדו אתכם לעשות וגומר‎ – And they wrote on the bottom for (the nations), ‘ in order that they should not teach you to do, etc. הא למדת שאם חוזרין בתשובה שמקבלין אותן וההוא קרא בז' אומות כתיב‎ – You may derive from this that if they would repent that we would receive them, and that פסוק (of אשר לא ילמדו and לא ישבו) was written regarding the ז' אומות, the question is why the need to mention חילול השם‎ – תוספות answers: ויש לומר דאי לאו חילול השם נהי שלא היו יכולין להרגן היו יכולין לגרשן מעריהם‎ – And one can say, that if not for חילול השם, so granted that they would not be able to kill the גבעונים (as תוספות just proved), nevertheless they could have chased them away from their cities (in which the בנ"י lived) – An alternate answer: ועוד דבאותה שעה לא באו להתגייר כי אם אחרי כן: And additionally at that time they did not come to be מתגייר (only not to be killed), but rather it was only later that they agreed to be מתגייר‎. S UMMARY The rule of לא תחיה כל נשמה is only if they chose not to make peace. One may not kill anyone even from the ז' אומות if he wishes to be מתגייר‎. There would not have been a חילול השם according to ר"י if they were able to be מפיר the נדר שהודר ברבים‎. T HINKING IT OVER תוספות writes (in one answer) that indeed they could not kill the גבעונים, since they came להתגייר, but they could have chased them out of the cities. However the גמרא states explicitly that they did not kill them because of קדושת השם‎?!

רב נחמן בר יצחק אמר שלשה‎—Rav Nachman Bar Yitzchok said, three O VERVIEW ר' יהודה ruled that a נדר שהודר ברבים has no הפרה‎. The גמרא asked what is considered a רבים‎. According to רנב"י it means three people. תוספות discusses what are the requirements for a נדר על דעת רבים (which has no הפרה). ------------------------------ נראה דעל דעת רבים לא בעי אלא שנים‎ – It is the view of תוספות that a נדר על דעת רבים only requires two people, not three – דבפרק שבועת הדיינין (שבועות דף לט, א) כשאמר להם משה לישראל‎ – For in פרק שבועת הדיינים, the גמרא states, when משנה told the Jews – הוו יודעים שלא על דעתכם אני משביע אתכם וכולי‎ – ‘You should know that I am not adjuring you according to your mind, etc., but rather according to my mind and the mind of הקב"ה’ – ופירש שם בקונטרס דהיינו על דעת רבים – And רש"י explained there that משה meant to say that it is על דעת רבים‎ – תוספות anticipates a difficulty: ומיהו לפי זה לא היה היתר לחרמות בזמן הזה‎ – However according to this understanding that two are sufficient to make it a נדר ע"ד רבים, which has no הפרה, there would be no היתר for חרמות nowadays – תוספות offers his explanation: ונראה דלא אמר משה כן אלא שלא יערימו כדמפרש התם משום קניא דרבא‎ – And it is the view of תוספות that משה did not say this (לא על דעתכם וכו' אלא ע"ד המקום וכו') in order to make it a נדר ע"ד הרבים, but rather so that they should not be deceitful as the גמרא explained there, because of the reed of רבא‎ – וכן עתה אין עושין אלא בשביל כך‎ – And similarly now we do not do this (saying על דעתנו), only because of this concern for הערמה, but not to make it a נדר ע"ד רבים‎. תוספות asks: ואם תאמר על דעת יחיד נמי לא יהא לו הפרה כיון דתלה בו נדרו‎ – And if you will say; that in a case where he makes the נדר ע"ד one individual it should also not have a הפרה, since he make his נדר dependent on this person – תוספות answers: ויש לומר דמבטל דעתו משום רבים ולא משום יחיד: And one can say that a person nullifies his mind to many, but not to an individual. S UMMARY According to רש"י when משה (or a בי"ד) state לא על דעתך וכו' it is in order to make this a נדר ע"ד רבים, while according to תוספות it is to prevent deceit. T HINKING IT OVER 1. According the מסקנא of תוספות, how many are required to make it a נדר ע"ד רבים (since he disagrees with פרש"י)? 2. Is there any connection between תוספות question, וא"ת כו', with that which תוספות stated previously?
