    Gittin 46b

    Chapter 4 - HaSholeach

גם: גיטין דף מ״ו ע״ב, פרק ד׳ השולח

    English translation - Gittin 46b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1The Gemara discusses the formulation of the vow taken by the husband: What is meant by the expression: Konam , as stated by the husband? Generally this term is used when stating a vow of consecration; how does such a vow render her forbidden to him? Rav Huna said that the case is when he says: All the produce that is in the world will become forbidden to me if I do not divorce you.

2The mishna taught: And they permitted him to remarry her. The Gemara asks: It is obvious that this is the case, as why shouldn’t he be able to remarry her? The Gemara answers that lest you say: Let us institute a decree due to the statement of Rabbi Natan. As it is taught in a baraita that Rabbi Natan said: One who vows, it is as if he built a personal altar during the time the Temple stood, when it became prohibited to build a personal altar to God outside the Temple. And one who fulfills a vow, it is as if he sacrificed an offering on this personal altar, thereby doubling his sin. Therefore, it would be possible to suggest that the husband is penalized and prohibited from remarrying her because he sinned by taking a vow and fulfilling it. Therefore, it teaches us that this is not the case.

3The end of the mishna stated that the reason for this halakha was for the betterment of the world. The Gemara asks: What betterment of the world is there in allowing him to remarry her? Rav Sheshet said: This statement refers back to the first clause of the mishna. The expression: For the betterment of the world, is not an explanation of Rabbi Yosei bar Yehuda’s statement, but rather, it is meant to explain why there is a penalty that one may not remarry a woman whom he divorced due to her bad reputation or due to a vow she had taken.

4Ravina said: Actually, this expression applies to the latter clause of the mishna, and this is what it taught: This is not for the betterment of the world. In other words, when they instituted that he may not remarry her for the betterment of the world, it is only with regard to a case where the woman has taken a vow. However, when the husband takes a vow, there is no element of the betterment of the world and he is permitted to remarry her in that case.

5MISHNA: With regard to one who divorces his wife because she is a sexually underdeveloped woman who is incapable of bearing children [ ailonit ], meaning that after their marriage it became clear that she was sexually underdeveloped, Rabbi Yehuda says: He may not remarry her, and the Rabbis say: He may remarry her.

6If, after he divorced her, this ailonit married another man and had children from him, meaning that she was not actually an ailonit , and she is demanding payment of her marriage contract from her first husband, claiming that he unlawfully divorced her without paying her marriage contract as he claimed that she was an ailonit and their marriage was a mistaken transaction, Rabbi Yehuda said that he may say to her: Your silence is preferable to your speech, meaning that it is preferable for her to withdraw her claim. If she persists, he may say that he divorced her only because he believed her to be an ailonit , casting aspersions on the validity of the divorce and the status of her children. Therefore, it would be wise of her to withdraw her claim.

7GEMARA: The Gemara clarifies the dispute in the mishna: Is this to say that Rabbi Yehuda is concerned about potential harm, i.e., the harm that she may later incur if he casts aspersions on the validity of the divorce, and therefore rules that he may not remarry her, ensuring that he will divorce her only if he is absolutely certain that he wishes to do so, and the Rabbis are not concerned about potential harm? But didn’t we learn that they each said the opposite?

8As we learned in the previous mishna (45b): A man who divorces his wife due to her bad reputation may not remarry her. And if one divorces his wife due to a vow that she stated, and he could not live with her under the conditions of the vow, he may not remarry her. Rabbi Yehuda says: If he divorced her due to any vow that the public was aware of, he may not remarry her, but if he divorced her due to a vow that the public was not aware of, he may remarry her. Apparently, the Rabbis are concerned about potential harm, and consequently, they do not make a distinction between one vow and another; and Rabbi Yehuda is not concerned about potential harm, and he makes a distinction between a vow that may lead to permissiveness and one that does not.

9Shmuel said: Reverse the opinions in this mishna. Rather, say that it is Rabbi Yehuda who says that he may remarry her, and he is not concerned about potential harm, while the Rabbis say he may not remarry her, and they are concerned about potential harm.

10The Gemara challenges: But from the fact that it teaches in the last clause of the mishna: If, after he divorced her, this ailonit married another man and had children from him, and she is demanding payment of her marriage contract from her first husband, Rabbi Yehuda said that he may say to her: Your silence is preferable to your speech, and one can learn by inference that Rabbi Yehuda is concerned about potential harm. The Gemara answers: Here too, reverse the opinions, and it is the Rabbis who stated the last case of the mishna.

11Abaye said: Actually, do not reverse the opinions, and say that Rabbi Yehuda is concerned about potential harm. The distinction is that in that mishna, which discussed a woman who took a vow, he holds in one matter in accordance with the opinion of Rabbi Meir, and he holds in another matter in accordance with the opinion of Rabbi Elazar. In the case of a vow that requires dissolution by a halakhic authority he holds in accordance with the opinion of Rabbi Elazar that there is no concern about potential harm in such a case, as a husband would not desire that his wife be disgraced before the court. In the case of a vow that does not require dissolution by a halakhic authority he holds in accordance with the opinion of Rabbi Meir, who maintains that the husband would not be deemed credible if he were to state that he was unaware that he could nullify her vow.

12Rava said: Is it difficult to reconcile the statement of Rabbi Yehuda in this mishna with the statement of Rabbi Yehuda in the previous mishna, but it is not difficult to reconcile the statement of the Rabbis in this mishna with the statement of the Rabbis in the previous mishna? Abaye only addressed how to explain the contradiction between the statements of Rabbi Yehuda.

13Rather, Rava said: It is not difficult to reconcile the statement of Rabbi Yehuda in this mishna with the statement of Rabbi Yehuda in the previous mishna, as we answered. Additionally, it is not difficult to reconcile the statement of the Rabbis in this mishna with the statement of the Rabbis in the previous mishna, as who are the Rabbis in this mishna? It is Rabbi Meir, who said: We require a compound condition stipulating both positive and negative outcomes. And with what are we dealing here? We are dealing with a situation where he did not compound his condition, as he stated only that he is divorcing her because she is an ailonit , but did not state that he would not divorce her if she were not an ailonit . Therefore, his condition is disregarded, and he may remarry her.

14MISHNA: With regard to one who sells himself and his children as slaves to gentiles, he is not redeemed, but the children are redeemed after their father’s death, as there is no reason to penalize them.

15GEMARA: Rav Asi says: And this halakha , that he is not redeemed, applies only when he sold himself for a first time and was redeemed, and repeated his action by selling himself a second time and was redeemed, and repeated his action by selling himself a third time. Since he sold himself repeatedly, the Sages penalized him by instituting that he may not be redeemed.

16The Gemara relates: There were those residents of Bei Mikhsi who borrowed money from gentiles, and they did not have sufficient funds to repay them. As a result, the gentiles came and seized them as slaves. They came before Rav Huna and requested that he instruct the Jews to redeem them. Rav Huna said to them: What can I do for you, as we learned in a mishna: With regard to one who sells himself and his children as slaves to gentiles, he is not redeemed.

17Rabbi Abba said to Rav Huna: Our master taught me: And this halakha applies only when he sold himself, and repeated a second time, and repeated a third time, which was not the case in this incident. Rav Huna said to him: These people do this habitually, and it is as though they sold themselves for a second and third time.

18The Gemara relates: A certain man sold himself to gladiators [ luda’ei ]. He came before Rabbi Ami and said to him:

הנודר כאילו בנה במה‎—One who makes a vow is as if he built a Bomoh O VERVIEW ר' נתן taught that one who makes a vow is sinning as if he bult a במה (at the time when במות are prohibited). תוספות explains the connection between נודר and (building) a במה ------------------------------ מפרש רבינו אליהו משום דאתיא בגזירה שוה דחדלה‎ – ר"א explained because we derive the connection between נדר and במה through the גז"ש of the word חדלה (refraining) – כתיב הכא (דברים כג, כג) כי תחדל לנדור It is written here regarding נדרים, ‘ if you will refrain from making a vow’ – וכתיב התם (ישעיה ב, כב) חדלו לכם מן האדם וגומר כי במה נחשב הוא‎ – And it is written elsewhere, ‘you should refrain from listening to a person, etc. for what is his importance’ – ודרשינן אל תיקרי במה אלא במה (ב' ומ' קמוצים) – And we expound the word במה, saying do not read it as במה (what is he), but rather read it as במה (a private altar) – ובריש פרק ארבעה נדרים (נדרים כב, א) יליף בהאי גזירה שוה דנקרא רשע‎ – And in the beginning of פרק ארבעה נדים the גמרא derives through this גז"ש of חדלה that one who is נודר is called a wicked person; for it says חדל by נדר‎ – דכתיב שם רשעים חדלו רוגז (איוב ג, יז): And it is also written, ‘there the רשעים refrain from their anger’. S UMMARY The connection between נדר and במה (as well as רשע) is based on the גז"ש of חדלה‎. T HINKING IT OVER Why was it necessary for תוספות to cite the גמרא in נדרים; what does that add?!

המוציא אשתו משום אילונית‎—One who divorces his wife because she is an אילונית O VERVIEW The משנה is discussing one who divorced his wife because she was an אילונית‎. Our תוספות examines whether an אילונית requires a גט or is it קדושי טעות‎. --------------------------- משמע הכא דאילונית בעיא גט‎ – It seems from the משנה here that an אילונית requires a גט, (meaning that even though the husband was not aware that she is an אילונית, nevertheless she is considered married to him and in order to marry someone else she requires a גט) – תוספות asks: ותימה דבריש יבמות (דף ב, ב) משמע דלא בעיא גט דהוו קדושי טעות – And it is astounding; for in the beginning of מסכת יבמות it seems that an אילונית does not require a גט, since it is a mistaken קידושין‎. תוספות explains his proof – דתנן וכולן שמתו או שמיאנו או שנמצאו אילונית צרותיהן מותרות‎ – For the משנה teaches, and all of them who died or were ממאן, or were found to be אילונית, there rival wives are permitted to be מתייבם‎. תוספות answers: ויש לומר דהכא מיירי בספק אילונית ומוציאה משום חשש אילונית‎ – And one can say that here in our משנה we are discussing a possible אילונית and he is divorcing her because of his concern that she may be an אילונית, therefore she requires a גט for it is not קדושי טעות (with a certainty) – תוספות proves that we are discussing a ספק אילונית: תדע מדקתני סיפא נישאת לאחר והיו לה בנים ואילו ודאי אילונית אין לה רפואה‎ – You should know that we are discussing a ספק אילונית, since in the סיפא of our משנה it states, ‘she married another person and she had children from him’, this proves that she was not a ודאי אילונית, for a ודאי אילונית cannot be healed; she will always be barren. תוספות goes on to prove that a ודאי אילונית אין לה רפואה‎ – מדפליגי רבי יהושע ורבי עקיבא בהערל (שם דף עט, ב) בסריס חמה דיש לו רפואה‎ – Since (ר"י) [ר"א] ור"ע argue in פרק הערל regarding a born eunuch who can be healed, whether – וחולץ וחולצין לאשתו ובאילונית לא פליגי‎ – He can perform חליצה and whether חליצה can be performed on his widowed wife, however they do not argue regarding an אילונית, all agree that there is no requirement to give her חליצה, the reason for this is - – ודרשינן בפרק קמא דיבמות (דף יב, א) אשר תלד פרט לאילונית – As we expound in the first פרק of מסכת יבמות, the פסוק of אשר תלד (which she will give birth to) to exclude an אילונית (who cannot bear a child), from the whole פרשה of יבום וחליצה‎. Therefore an אילונית ודאי does not require a גט, for it is קדושי טעות (since she can never bear children) however our משנה is discussing a ספק אילונית, therefore a גט is required. תוספות responds to an anticipated difficulty: והא דאמר (שם דף סד, ב) שרה אמנו אילונית היתה אין מזכירין מעשה נסים‎ – And this which רב נחמן states that our matriarch שרה was an אילונית (even though she later had a child; which seemingly contradicts this which תוספות maintains that an אילונית cannot bear a child); this is not a question because we do not mention miracles (שרה gave birth through a נס; naturally she was incapable of having children) – כדאמרינן גבי איוב בריש אלו טריפות (חולין דף מג, א) – As the גמרא states regarding איוב in the beginning of פרק אלו טריפות‎ – תוספות anticipated another difficulty: והא דפליגי בהמדיר (כתובות דף עג, א) בקדשה על תנאי וכנסה סתם דבעיא גט‎ – And regarding this which רב and שמואל argue in פרק המדיר in a case where a person was מקדש a woman with the stipulation that she has made no vows, and he married her סתם (without mentioning his תנאי); רב maintains that she requires a גט‎ – משום דאין אדם עושה בעילתו בעילת זנות – Because a person does not make his בעילה a promiscuous ביאה and the ביאה was made לשם קידושין‎ – תוספות responds היינו בשאר מומין דמחיל אבל באילונית לא מחיל – When do we say אין אדם עושה בעילתו בעילת זנות by other blemishes (like נדרים) where he is willing to forgo his תנאי by the בעילה, however regarding an אילונית he is not מוחל and is not בועל לשם קדושין if she is an אילונית‎ – תוספות offers another distinction: ועוד דמומין מסיק אדעתיה שמא לא יתקיים התנאי דשכיחי ובועל לשם קדושין – And furthermore by regular מומין he is aware that perhaps the תנאי will not be fulfilled (she will have נדרים) for it is common for women to have this מום, so he is aware that his initial קדושין may be invalid and therefore he is בועל לשם קדושין‎ – אבל אילונית דלא שכיח לא מסיק לבעול לשם קדושין – However regarding an אילונית, which is uncommon it does not enter his mind to be בועל לשם קדושין‎ – תוספות anticipates a further difficulty: והא דתנן פרק אלמנה ניזונת (שם ק, ב) הממאנת והשניה והאילונית אין להן כתובה‎ – And regarding this which the משנה taught in פרק אלמנה ניזונית that a ממאנת and a שניה and an אילונית, receive no כתובה payment if divorced or widowed – דמשמע אבל גיטא בעי‎ – Which indicates that they require a גט‎. This is in contradiction to what תוספות maintains that an אילונית is קידושי טעות and does not require a גט‎. תוספות proves that this is the general inference when it states אין לה כתובה (that a גט is required) : דהכי דייק בהמדיר (שם דף עג, א) גבי כנסה סתם ונמצאו כולי‎ – For this is what the גמרא in פרק המדיר infers regarding the משנה of כנסה סתם ונמצאו, etc. תוספות responds: משום שניה נקט הכי דעל כרחך ממאנת לא בעיא גט‎ – This implied inference of הא גיטה בעיא is only regarding a שניה (but not for an אילונית) for perforce you must say that a ממאנת does not require a גט and neither does an אילונית‎ – תוספות offers an alternate solution: אי נמי בהמדיר לא דייק אלא משום דתני ברישא אינה מקודשת ובסיפא תצא שלא בכתובה‎ – Or you may also say that the only reason the גמרא makes this inference in פרק המדיר (that כתובה הוא דלא בעיא הא גיטא בעיא) is because in the רישא of the משנה it states, ‘she is not מקודשת’ (which mean no גט is required) and in the סיפא it states differently, תצא בלא כתובה (but it does not state אינה מקודשת; indicating that there is קדושין, and a גט is required); however in the משנה in אלמנה ניזונית where there is no statement of אינה מקודשת, only the statement of אין להן כתובה, that is insufficient to infer that גיטה בעיא‎. תוספות anticipates one more final question: והא דאמרינן (יבמות סא, ב) קטן וקטנה לא חולצין כולי קטנה שמא תמצא אילונית – And regarding the ברייתא which states that we do not perform חליצה by a קטן וקטנה and also no יבום, the reason given why there is no יבום, is that the קטנה may turn out to be an אילונית‎ – ולא אמרינן תתייבם ממה נפשך דאי אילונית היא הרי הן קדושי טעות ושריא לשני‎ – But why do we not say that this קטנה should be מתייבם in any case. For if she is an אילונית‎. her קידושין to the deceased brother was קדושי טעות so she is permitted to marry the second brother (she is not אשת אחיו)?! This would seem to disprove תוספות that by an אילונית it is קדושי טעות‎! תוספות responds: אומר רבינו תם דהתם בדקבלה עילויה וכהאי גוונא משני בפרק בן סורר (סנהדרין דף סט, ב): The ר"ת explains that there the case is where the deceased brother accepted to marry this קטנה even if she should turn out to be an אילונית, and we use this answer also in פרק בן סורר‎. S UMMARY תוספות maintains that an אילונית does not require a גט even if there was ביאה‎. T HINKING IT OVER 1. תוספות offers two explanations why regarding an אילונית we do not say א"א עושה בעילתו בעילת זנות‎. Is there any advantage of one answer over the other, and is there any נפקא מינה between the two answers? 2. תוספות asks a question from פרק אלמנה ניזונית where it states regarding an אילונית that אין להן כתובה; inferring that they require a גט, in contradiction to תוספות opinion. Why does not תוספות answer here (as he answered before) that the משנה in אלמנה ניזונית is referring to a ספק אילונית‎?!

אומר לה שתיקותיך יפה מדבוריך‎—He says to her; your silence is better than your talking O VERVIEW ר' יהודה rules in our משנה that if someone divorces his wife because she is an אילונית, he may never take her back as a wife. If she married someone else and bore children, and demands her כתובה payments from her first husband, ר"י rules that the (first) husband says to her שתיקותיך יפה מדיבוריך; meaning that if you persist in claiming the כתובה, I will be מבטל the גט, for I only divorced you because I assumed that you were an אילונית, but now that it turns out that you are not an אילונית, I may be מבטל the גט (and your marriage to the second husband will be null and the children will be ממזרים). This is how he is able to deny her request by making this threat. תוספות reconciles our גמרא with seemingly contradictory גמרות‎. ------------------------------ תוספות asks: ואם תאמר ואם היא שתקה אנן מי שתקינן‎ – And if you will say; and if she is quiet, will we be quiet – דהכי פריך רב פפא בסוף פרק הבא על יבמתו (יבמות דף סה, א) גבי נשאת לרביעי והיו לה בנים‎ – For this is what רב פפא asks in the end of פרק הבא על יבמתו regarding the case where she married a fourth husband and bore children to him – תוספות answers: ויש לומר דהתם נמי לא הוי אלא לעז דהא סתם גירשה ולא התנה כדפרישית הכא – And one can say that there too (in יבמות) we are only concerned for rumor mongering, but not to nullify the גט, since he divorced her explicitly without making any stipulations or reasons, as I explained here – תוספות responds to an anticipated difficulty: ופריך רב פפא דהוה לן לתקן נמי התם דלא יחזיר שלא יהא לעז כדתקין הכא – And sרב פפא' question was that that the חכמים should have enacted also there that he cannot take her back in order that there should be no לעז as they instituted here (by אילונית, etc.) – ומשני אלא ודאי בלאו הכי אפילו לעז ליכא דהשתא הוא דברית – And the גמרא there answers that even without the תקנה of לא יחזיר, there certainly will not be even a לעז, for we will say, that she became healthy now when she married the fourth man ומהאי טעמא לא מצי למתבע כתובה‎ – And for this very same reason she cannot claim her כתובה from the third husband – תוספות explains now why here we do not say איהי שתקה אנן מי שתקינן: אבל הכא אם היא שתקה אנן נמי שתקינן דליכא לעז כיון דתקון דלא יחזיר‎ – However here (by the אילונית) if she is silent (and does not claim her כתובה), we will also be silent for there is no concern of לעז by an אילונית since the חכמים enacted that לא יחזיר‎ – ואי אתיא למתבע כתובה מצי אמר לה אדעתא דיהיבנא כתובה לא גירשתיך – And if the אילונית comes to claim her כתובה payment, he can tell her, ‘I did not divorce you with the intent a paying you the כתובה’ – תוספות responds to another anticipated difficulty: והתם דאיירי בעקרה דוקא שייך השתא הוא דברית‎ – For only there where she was ( merely) a barren woman (not an אילונית) can we say השתא הוא דברית‎ – אבל הכא דאיירי בספק אילונית כדפירשנו לא שייך לומר השתא הוא דברית – However here in our משנה where we are discussing a ספק אילונית, as we explained, it is not possible to say השתא הוא דברית‎ – In summation; firstly in all cases there is only a concern of לעז, but not of ביטול הגט (since he divorced סתם). There are two ways in which לעז can be prevented; either by being מתקן that לא יחזיר (this is applicable in the cases of אילונית, etc. where the סברא of השתא הוא דברית is not applicable), or by the סברא of השתא הוא דברית (which is applicable by the four marriages), in which case there is no need to make a תקנה of לא יחזיר‎. תוספות responds to an additional anticipated difficulty: ואפילו לרבנן דלא חיישי הכא לקלקולא פריך התם שפיר אנן מי שתקינן – And even according to the רבנן of our משנה who are not concerned for a problem (they maintain יחזיר and are not concerned for לעז), nevertheless the גמרא there in יבמות, correctly asks, אנן מי שתקינן‎ – תוספות responds: דמודו רבנן התם דמשום דאין לה בנים גירשה שכבר נשאת לשנים ולא היו לה בנים – There the רבנן admit that there is a concern of לעז, since he divorced her because of no children, for she was already married to two people and she had no children – תוספות asks: ואם תאמר בסוף פרק קמא דנדה (דף יב, ב) גבי אשה שאין לה וסת פריך פשיטא דלא יחזיר‎ – And if you will say; we learnt in a ברייתא in the end of the first פרק of מסכת נדה, regarding a woman who has no וסת, that he needs to divorce her and never take her back; the גמרא there asked; ‘it is obvious that לא יחזיר’ ; why does the ברייתא need to teach it to us – ומשני לא צריכא דהדר איתקן מהו דתימא ליהדרה‎ – And the גמרא answered, it was necessary to teach us this rule even in a case where, she improved and she now has a וסת, I would think perhaps he may take her back – קא משמע לן זימנין דאזלה ומינסבה כולי – Therefore the ברייתא teaches us that he may not, for sometimes she may go and marry, etc. This concludes the citing of the גמרא‎. תוספות asks ואמאי לא אמרינן התם השתא הוא דברית‎ – But why do we not say there (as we said in יבמות) that השתא הוא דברית; in which case there is no לעז‎?! תוספות answers: ויש לומר דהתם כיון שנתרפאת הרי היה מועיל לה סם רפואה ולהכי מצי מקלקל לה‎ – And one can say that there (by the וסת) since she was healed, this shows that a medicine can cure her (to give her a וסת), therefore he can ruin her – דאומר אילו הייתי יודע שיש רפואה לזו הייתי מבקש לה סם לרפואה: For he will say, ‘if I would have known that this (וסת problem) can be healed I would have found for her this medicine to heal her’, but the same cannot be said for the case in יבמות‎. S UMMARY Where we can apply the logic of השתא הוא דברית (in יבמות) we do not make the תקנה of לא יחזיר; however where that סברא does not apply (by אילונית and וסת) we are מתקן לא יחזיר to prevent לעז‎. There may be a greater concern for לעז in יבמות than by אילונית‎. T HINKING IT OVER תוספות asks his question from our משנה of אילונית to the גמרא in יבמות regarding איהי לא שתקה אנן מי שתקינן‎. Seemingly תוספות could have asked the same question (also) on the previous משנה of המוציא את אשתו משום ש"ר ומשום נדר‎. Why did תוספות only ask his question on our משנה‎?!
