    Gittin 35a

    Chapter 4 - HaSholeach

    English translation - Gittin 35a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1Due to the increased desirability that this would bring her when trying to remarry, since this would ensure she would bring assets with her into a new marriage, the Sages were lenient with her, as the Sages issued several decrees in connection with the marriage contract in order to enable women to collect more easily. Therefore, the mishna teaches us that this is not the case.

2§ The mishna taught that the court refrained from administering an oath to her. The Gemara asks: What is the reason that they refrained from administering oaths to widows? If we say that it is because of the statement of Rav Kahana, as Rav Kahana says, and some say that it was Rav Yehuda who says that Rav says: There was an incident involving a person during years of famine who deposited a gold dinar with a widow, and she placed the gold dinar in a jug of flour and unwittingly baked it in a loaf of bread along with the flour, and she gave the bread as charity to a poor man.

3After a period of time, the owner of the dinar came and said to her: Give me my dinar. She said to him: May poison benefit, i.e., take effect on, one of the children of that woman, i.e., my children, if I derived any benefit from your dinar. It was said: Not even a few days passed until one of her children died, and when the Sages heard of this matter, they said: If one who takes an oath truthfully is punished in this way for sin, one who takes an oath falsely, all the more so.

4The Gemara first clarifies the details of the incident: What is the reason that she was punished if she in fact did not derive any benefit from the dinar? The Gemara answers: Because she benefited [ ishtarshi ] from the place of the dinar, as the dinar took up space in the bread, enabling her to use less flour. Therefore, she did derive some small benefit from the dinar.

5The Gemara asks: If she in fact did derive benefit from the dinar, then what is meant by the statement: One who takes an oath truthfully? Wasn’t her oath actually false? The Gemara answers: It means that she was like one who took an oath truthfully, as her oath was truthful to the best of her knowledge. In any case, this woman was punished severely for a small mistake. The severity of taking a false oath, even inadvertently, is why the Sages ceased administering oaths to widows.

6The Gemara questions if this could be the reason for the ordinance: If they refrained from administering oaths due to this reason, then why would this be limited specifically to a widow? Even a divorcée should not be allowed to take an oath to collect her marriage contract as well. Why then does Rabbi Zeira say that Shmuel says: They taught this only with regard to a widow; however, with regard to a divorcée, the court does administer an oath to her? Why would this concern not apply in the case of a divorcée as well?

7The Gemara answers: A widow is different, as she continues to live in the house with the orphans and performs many services for them in the running of the home. Therefore, there is a concern that due to the benefit they receive from her as a result of the efforts she exerts for the orphans, she will rationalize and permit herself to take an oath that she had not collected any of her marriage contract, when in fact she had received a part of it.

8§ Rav Yehuda said that Rabbi Yirmeya bar Abba said: It is Rav and Shmuel who both say that they taught only that an oath is not administered to the widow in court, as the oath that one takes in court is a severe oath, which involves the mentioning of God’s name and the holding of a sacred object. However, outside of court, where an oath is not taken in this manner, the judges administer an oath to her. The Gemara asks: Is that so? But Rav does not collect payment of a marriage contract for a widow because she has not taken an oath, which indicates that he also would not administer an oath to her outside of the court. The Gemara answers: This is difficult, as it contradicts the statement of Rav Yehuda.

9In the city of Sura they taught the statement with regard to the opinions of Rav and Shmuel like this, as stated above. However, in the city of Neharde’a they taught the statement with regard to the opinions of Rav and Shmuel like this: Rav Yehuda says that Shmuel says that they taught only that an oath is not administered to the widow in court; however, outside of court the judges administer an oath to her. And Rav says: Even outside of court as well, the judges do not administer an oath to her.

10The Gemara points out that according to this version of their statements, Rav conforms to his standard line of reasoning, as Rav does not collect payment of a marriage contract for a widow in any case. The Gemara asks with regard to Rav’s practice: Let him administer a vow to the widow, instead of an oath, and collect the marriage contract in accordance with the mishna, which states that a widow can take a vow in place of the oath. The Gemara answers: In Rav’s time vows were treated lightly, and Rav was concerned that widows would not treat the prohibition created by the vow with appropriate severity. This would result in the orphans losing out on part of their inheritance, and the widows violating the prohibitions created by their vows.

11The Gemara relates: There was an incident involving a certain widow who came before Rav Huna and attempted to collect payment of her marriage contract from the orphans. He said to her: What can I do for you, as Rav does not collect payment of a marriage contract for a widow. The widow said to him: Isn’t the reason that I cannot collect payment only because of a concern that perhaps I already took some payment of my marriage contract? I swear as the Lord of Hosts lives that I did not derive any benefit from my marriage contract. Rav Huna says: Even though the court does not administer an oath to a widow, Rav concedes with regard to one who leaps and takes an oath of her own initiative that her oath is accepted, and she can collect payment of her marriage contract.

12The Gemara relates: There was an incident involving a certain widow who came before Rabba bar Rav Huna to collect payment of her marriage contract. He said to her: What can I do for you, as Rav does not collect payment of a marriage contract for a widow, and my father, my master, i.e., Rav Huna, does not collect payment of a marriage contract for a widow?

13She said to him: If I cannot collect payment of the marriage contract, then provide sustenance for me from my husband’s property, to support me until I remarry. He said to her: You also do not have any right to sustenance, as Rav Yehuda says that Shmuel says: One who demands payment of her marriage contract in court has no right to receive sustenance any longer. The husband committed to provide for her sustenance only as long as she does not wish to remarry. Generally, once a widow demands payment of her marriage contract, she demonstrates that she wishes now to remarry and is no longer entitled to receive sustenance from her deceased husband’s property.

14The widow became angry and said to Rabba bar Rav Huna: May his chair be overturned, i.e., he should fall from his position of power, as he ruled for me in accordance with the different opinions of two people. Since Rabba bar Rav Huna was concerned about her curse, he overturned his chair in order to fulfill the curse literally, and then stood it up, and even so, he was not saved from the weakness that resulted from her curse.

15With regard to this issue, the Gemara recounts: Rav Yehuda, the student of Shmuel, said to Rav Yirmeya Bira’a: If a widow comes to collect payment of her marriage contract, administer a vow in court and administer an oath outside of court, and let the report be received in my ears that you did so, as I desire to perform an action, i.e., to enable a widow to collect payment of her marriage contract, in contrast to the statements of Rav’s students, who hold that a widow cannot collect payment of her marriage contract.

16§ The Gemara returns to the matter itself. The mishna taught that the court does not administer an oath to a widow in order to enable her to collect payment of her marriage contract. Rabbi Zeira says that Shmuel says: They taught this only with regard to a widow; however, with regard to a divorcée, the court does administer an oath to her.

17The Gemara asks: Is that to say that if the court administered a vow to a divorcée and not an oath, then this is not sufficient to enable her to collect payment of her marriage contract? But didn’t they send from there, from Eretz Yisrael, a document that states the following: How so-and-so, the daughter of so-and-so, received a bill of divorce from the hand of Aḥa bar Hidya, who is called Ayya Mari, and she took a vow and prohibited the produce of the world to herself, based on the truth of her statement that she did not receive from her marriage contract anything other than one coat [ gelofkera ], and one book of Psalms, and a book of Job, and a book of Proverbs, all of which were worn out.

    Tosafot

לא היו ימים מועטים‎—It wasn’t but a few days O VERVIEW The גמרא relates a story of a person who deposited a דינר by a woman, who in turn placed it in her flour jug, and mistakenly baked it in a loaf of bread. When the מפקיד returned to claim his דינר she swore that one of her children should be poisoned if she derived any benefit from the דינר‎. Shortly one of her children died. תוספות discusses why was she punished since she thought she was swearing truthfully. -------------------- תוספות asks: ואם תאמר ומאי טעמא איענש‎ – And if you will say; and why was she punished; it was a mistaken oath – הא אמרינן בפרק ג' דשבועות (דף כו, א) האדם בשבועה פרט לאנוס‎ – For the ברייתא states in the third פרק of מסכת שבועות; the פסוק states האדם בשבועה (the person in an oath), this excludes a forced false oath; the גמרא there gives an example of אנוס‎ – כדרב כהנא ורב אסי דמר משתבע הכי אמר רב ומר משתבע הכי אמר רב‎ – Like רב כהנא and רב אסי, where one would swear, ‘this is what רב said’, and the other would swear, ‘this is what רב said’; they would argue what רב taught – וכי אתו לקמיה דרב ואמר כחד מינייהו אמר ליה אידך ואנא בשקרא אישתבעי – And when they came before רב to settle their dispute and רב said like one of them, so the other said to רב, ‘ and so did I swear falsely’?! ואמר ליה את לבך אנסך – And רב answered him, ‘you did not swear falsely, your heart forced you to swear this way, because you were certain that this is what I said. תוספות anticipates a possible answer, and rejects it: וליכא למימר דלא ממעט קרא התם אלא למפטר מקרבן אבל עונש איכא‎ – And one cannot answer that the פסוק there does not exclude an אנוס completely, but merely excludes him from the obligation to bring a קרבן (since he was an אנוס), however there is still a punishment מן השמים for swearing falsely – תוספות attempts to prove his point: כדאשכחן בפרק ב' דנדרים (דף יז, א) גבי נשבע לבטל את המצוה – As we find in the second פרק of מסכת נדרים, regarding swearing to nullify a מצוה דמיבעי לן תרי קראי חד למיפטריה מקרבן וחד למיפטריה מלאו – Where the גמרא requires two פסוקים, one to exempt him from a קרבן, and the other to exempt him from transgressing a לאו‎ – [והכא דליכא אלא חד קרא למיפטריה מקרבן] אבל עונש דשבועת שוא איכא‎ – [And here where there is only one פסוק, this will exempt him from a קרבן], but there is the punishment for transgressing the לאו of a שבועת שוא‎. This would seemingly explain why the woman was punished even though she was an אנוסה – תוספות rejects this answer: דהא לבך אנסך משמע ולא נשבעת לשקר – For the answer of רב to ר"כ ור"א that ' לבך אנסך' indicates that you did not swear falsely and not merely that you are not obligated to bring a קרבן‎. The question remains why was she punished since she was an אנוסה‎. תוספות strengthens his question: ועוד דבפרק ג' דנדרים (דף כה, ב) מייתי דרב כהנא ורב אסי אשבועות שגגות‎ – And furthermore in the third פרק of מסכת נדרים, the גמרא there cites the previously mentioned incident of ר"כ ור"א regarding שבועות שגגות‎ – דתניא בגמרא כשם שנדרי שגגות מותרות כך שבועות שגגות מותרות‎ – For the גמרא there cites a ברייתא which states, ‘ just as נדרי שגגות are permitted so too are שבועות שגגות permitted – ומפרש שבועות שגגות כדרב כהנא ורב אסי דמשמע דמותרות ואפילו עונש ליכא‎ – And the גמרא explains שבועות שגגות to mean as the incident with ר"כ ור"א, so it seems from that גמרא that it is permitted and there is even no punishment – תוספות responds to an anticipated difficulty: ולא דמי לנשבע לבטל את המצוה דאיכא עונש שבועת שוא‎ – And שבועות שגגות is not similar to נשבע לבטל את המצוה, where there could be a punishment for a שבועת שוא‎ – דהתם מיבעי לן ב' קראי אחד למיפטר שוגג מקרבן ואחד למיפטר מזיד ממלקות – For there we need two פסוקים, one to exempt a שוגג from a קרבן and the other to exempt a מזיד from מלקות‎ – וכשפטר שוגג לגמרי פטרו מעונש ומקרבן‎ – And when the פסוק (of להרע או להיטיב) exempts a שוגג (regarding נשבע לבטל את המצוה), it exempted him entirely, both from עונש and from קרבן‎ – והוא הדין גבי האדם בשבועה פרט לאנוס דפטור לגמרי‎ – And the same rule applies regarding the מיעוט of האדם בשבועה which exempts an אנוס that he is totally exempt even from עונש‎. The question remains, why was this woman punished! תוספות answers: ויש לומר דהכא גבי פקדון הוה לה להזהר יותר לשמרו היטב‎ – And one can say; that here by a deposit she should have been very careful to guard it properly – והוה לה לאסוקי אדעתא שתבא לידי שבועה: And she should have been aware that she may come to take an oath for this deposit. Therefore she was punished. S UMMARY Generally a אנוס by a שבועה is פטור from עונש; however here the woman is at fault for not protecting the פקדון properly, realizing that she make come to take an improper oath. T HINKING IT OVER 1. Initially תוספות inferred from the fact that two פסוקים are required by נשבע לבטל את המצוה (one for קרבן and one for the לאו), that by אנוס (where there is only one פסוק) he is פטור from a קרבן and חייב an עונש‎. Subsequently תוספות argues that it is not so. What changed in תוספות understanding of this issue? 2. Was the woman punished because she did not guard the דינר properly, or because she swore (falsely)? Appendix The מהרש"ל (and מהרש"א) are not גורס the bracketed insert: והכא דליכא אלא חד קרא למיפטריה מקרבן‎. 1. The question of תוספות is that there (by נשבע לבטל את המצוה) there are two פסוקים that exempt him from קרבן and מלקות, but nevertheless he is punished for a שבועת שוא (he swore in vain) since his שבועה is not effective. Similarly here too by אנוס even though he is פטור מקרבן, he should be חייב for שבועת שוא‎. 2. תוספות rejects this because לבך אנסך indicates that there was no שבועת שקר‎. 3. At the end תוספות explains why by נשבע לבטל there is עונש שבועת שוא and by אנוס there is no שבועת שוא, because the עונש שבועת שוא is only by מזיד and not by שוגג‎.

דמוריא היתרא‎—She teaches herself a leniency O VERVIEW The גמרא explained the reason why בי"ד would not administer an oath to an אלמנה (as opposed to a גרושה), is because the אלמנה is מורה היתר to take money from the יתומים for her [paid up] כתובה, for she feels she is working so hard for them she deserves something extra. תוספות discusses what בי"ד does to insure that she is truthful. ------------------- ולכך נמנעו מלהשביעה שעונש שבועה מרובה אלא בהדרה דלא חמיר כולי האי‎ – And therefore בי"ד was unwilling to administer an oath to her, because the punishment for a false oath is severe; rather they imposed that she take a vow, which is not that severe if it is transgressed – והשתא בזמן הזה תקנו לקבל חרם במקום שבועה שלא יהא העונש גדול כל כך: And nowadays in this time they instituted a חרם ban instead of a שבועה, so the punishment for transgressing the חרם will not be so severe. S UMMARY The חכמים did not want to administer an oath to an אלמנה because since she is מורה היתר, she may be severely punished; instead they made her take a vow. Nowadays we proclaim a חרם if she is lying. T HINKING IT OVER Why cannot we say that נמנעו מלהשביעה, because since she is מורה היתר, the שבועה is of no avail, for she will swear falsely since she is מורה היתר‎?! [Alternately; if she is מורה היתר, what purpose is there in her making a נדר‎?!]

לא שנו אלא בבית דין‎—This was not taught universally ; only in בי"ד O VERVIEW רב ושמואל both ruled that when the משנה stated that נמנעו להשביעה that is only in בי"ד, however we do administer an oath to the אלמנה outside of בי"ד. Our תוספות discusses the various differences how we administer an oath. -------------------- פירש בקונטרס דחמירא משום דהויא באנקוטי חפצא ואיכא עונש טפי‎ – רש"י explained that a שבועה in בי"ד is more strict than a שבועה שלא בבי"ד, for it is performed while holding an object of קדושה and there is a greater punishment for transgressing such a שבועה‎ – והא דאמר בהכותב (כתובות דף פח, א) אי פקח הוא מייתי לה לידי שבועה דאורייתא – And that which was taught in פרק הכותב; if he is wise he will cause her to take a תורה oath; the explanation there – לא כמו שפירש בקונטרס (שם) דנפקא מינה בין דאורייתא לדרבנן לענין אנקוטי חפצא‎ – Is not how רש"י explained it there, that the difference between a תורה oath and a רבנן oath is regarding holding an object of קדושה, that is not so – דאפילו שבועה דרבנן הויא באנקוטי חפצא כדפירש הקונטרס בעצמו כאן‎ – For even a שבועה דרבנן requires a נקיטת חפץ as רש"י himself explained here – אלא יש לחלק בין דאורייתא לדרבנן כמו שמפרש בערוך דשבועה דאורייתא הויא בכבוי נרות- But rather we can distinguish between a תורה oath and a רבנן oath, as explains the ערוך explains that a דאורייתא oath is performed with extinguishing the candles (presumably to frighten the one who is swearing). תוספות adds that there are additional differences between a שבועה דאורייתא and a שבועה דרבנן: ועוד בריש שבועת הדיינים (שבועות דף מא, א) מפרש חילוק בין דאורייתא לדרבנן – And in addition in the beginning of פרק שבועת הדיינים the גמרא explains the difference between a תורה and רבנן oath – (ובההיא פירקא מפרש מאי איכא בין שבועה דאורייתא לדרבנן‎ – And in that פרק the גמרא explains the difference between a שבועה דאורייתא and a שבועה דרבנן‎ – והתם לא מידכר חילוק דכבוי ולאנקוטי חפצא): And he does not mention (there) the difference of extinguishing candles and holding an object of קדושה‎. S UMMARY רש"י (here) and תוספות agree that there is נקיטת חפץ both by a שבועה דאורייתא and a שבועה דרבנן (in בי"ד). The difference between a שבועה דאורייתא and דרבנן is in כיבוי נרות (and the different ramifications mentioned in מסכת שבועות). T HINKING IT OVER Seemingly the גליון is disproving the פירוש הערך (as well). How can he reject this proof and maintain the שיטת הערוך‎?

ונודרת ואוסרת פירות שבעולם עליה שלא קיבלה מכתובתה כולי‎—And she vows and prohibits herself from fruits of the world that she did not receive from her כתובה, etc. O VERVIEW The גמרא relates an incident where a woman took a vow that the fruits of the world should be forbidden to her if she received for her כתובה more than she declared. In רש"י the text reads that she forbade כל פירות שבעולם‎. However תוספות disagrees with this גירסא and maintains that the correct גירסא is פירות שבעולם (without כל). The discussion revolves whether a נדר which is impossible to keep is a valid נדר‎. -------------------- לא גרסינן כל פירות – The text does not read כל פירות (all the fruits); meaning that she is taking a vow which is impossible to keep. The reason that we are not גורס 'כל פירות', is not because it is impossible to keep (and therefore it is not a valid נדר) – דאף על גב דנדר חייל אף על דבר שאינו יכול לקיים‎ – For even though a vow [נדר] is effective even regarding something which he cannot fulfill, (so the נדר of כל פירות is valid); תוספות proves that a נדר is חל even if it is a דבר שאינו יכול לקיים‎ – כדאמר בפרק שני דנדרים (דף טו, א) גבי קונם עיני בשינה‎ – As the משנה states in the second פרק of מסכת נדרים regarding one who says קונם my eyes from sleeping – דפריך ואי לא יהיב שיעורא למילתיה מי שבקינן ליה עד דעבר באיסור בל יחל – Where the גמרא asks, ‘and if he does not place a limit to his vow (for how long he will not sleep) will we let him be until he transgresses the prohibition of בל יחל‎?! והא אמר רבי יוחנן שבועה שלא אישן ג' ימים מכין אותו וישן לאלתר – But ר' יוחנן ruled, if one took an oath that I will not sleep for three days, we administer lashes to him and he may go to sleep immediately. תוספות anticipates a difficulty with the concept that a נדר which cannot be fulfilled is nevertheless effective: והא דנדרי הבאי מותרים כדאמר בפרק ג' דנדרים (דף כד, ב) – And that which the משנה states in the third פרק of מסכת נדרים that exaggerated vows are permitted – תוספות responds: לאו משום דאסר עצמו במה שאינו יכול לקיים‎ – It is not permitted because he forbade himself in something which he cannot fulfill – כגון דאמר יאסרו כל הפירות שבעולם עלי‎ – For instance that he said, ‘all the fruits of the world should be forbidden to me אם לא ראיתי גמל פורח באויר ונחש כקורת בית הבד – if I did not see a camel flying in the air, or a snake similar to the beam of an olive press’ – אלא לפי שאין דעתו לומר ממש גמל ולא ממש כקורת בית הבד‎ – But rather (the reason they are מותר is) since his intention is not to say an actual camel and not actually like an olive press beam – אלא מה שהוא טרוף בגבו מאד ומשונה משאר נחשים קורא כקורת בית הבד‎ – But rather a snake that has many cracks in his back and is different from other snakes; he refers to this snake that it is like an olive press beam – וחיל גדול מאד שראה קורא כעולי מצרים‎ – And when he says a very large army he refers to it as an amount equal to those that went up from מצרים (i.e. six-hundred thousand people) – ואינו אומר כן אלא להחזיק דבריו‎ – And he is not saying these things seriously; but only to maintain what he says that he saw something unusual and he is exaggerating to impress the truth of what he saw. תוספות differentiates between נדרי הבאי and שבועות הבאי: ודוקא שבועות הבאי אסור מדרבנן דהחמירו משום דכתיב בה לא ינקה‎ – And it is only specifically regarding שבועות הבאי which are אסור מדרבנן, for the רבנן were stricter by שבועה than by נדר, because by שבועה it is written לא ינקה (ה' will not cleanse the sin of שבועת שוא) – אבל נדרי הבאי ואפילו לא אמר כל הפירות אלא אסר עליה חד פירא שרי בנדר‎ – However regarding נדרי הבאי, and even where he did not say all the פירות should be אסור for me (which is א"א לקיים) but rather he forbade upon himself one fruit (which he can be מקיים), nevertheless it will be permitted by נדרי הבאי‎ – ואין חילוק בין כל פירות ובין חד פירא‎ – And there is no difference between all fruits or one fruit. In summation: תוספות explains that נדרי הבאי are מותר, not because it is א"א לקיים (for a נדר even if it is א"א לקיים is a valid נדר), but rather since it is assumed that he did not mean literally what he said (he was merely exaggerating). Seemingly we can be גורס 'כל פירות', since the נדר is חל even if it was for a דבר שא"א לקיים‎ – מכל מקום הכא לא גרסינן כל פירות‎ – Nevertheless here we are not גורס 'כל פירות'. תוספות explains – דאף על פי שעוברת לאלתר בבל יחל אם קבלה מכתובתה‎ – For even though she immediately transgresses the בל יחל if she did receive payment from her כתובה, so seemingly this should be a deterrent, nevertheless – כיון דמשם ואילך לא מיתסרא כדאמר מכין אותו וישן לאלתר‎ – Since that from that point (when she is עובר בל יחל immediately) onward she is not forbidden in כל פירות as the גמרא stated that we administer lashes and he may go to sleep immediately, therefore – אינה חוששת הואיל ואינה עומדת באיסור כל ימיה כדמפרש בסמוך – She is not concerned by making this vow (untruthfully), since she will not remain with this prohibition forever as תוספות explains shortly. תוספות asks: ואם תאמר בפרק בתרא דנדרים (דף פט, ב) דאמר ההוא גברא דאמר‎ – And if you will say; in the last פרק of מסכת נדרים where the גמרא states, ‘there was this person who said – תיתסר הנאות דעלמא עלי אי נסיבנא איתתא עד דלא תנינא הלכתא כולי‎ – ‘if I marry a woman before I study the laws, etc. then all pleasures of the world should be forbidden to me’ – ואתא רב אחא ושבשיה ואנסביה איתתא ושרקיה טינא כדי שלא יהנה מן העולם – And רב אחא came and fooled him and had him marry a woman and smeared lime over him in order he should not benefit from the world. This concludes the citation from the גמרא‎. תוספות concludes his question – מה מועיל מאי דשרקיה דכי אנסביה מיד עבר כיון שאין יכול בסוף לקיים – What did smearing his face accomplish, for as soon as he married he immediately transgressed the בל יחל, since he cannot ultimately keep his vow?! תוספות answers: ויש לומר דדוקא בשעה שנודר אם אי אפשר לו לקיים עובר לאלתר – And one can say; he transgresses לא יחל immediately only if at the time of the נדר, he cannot keep it – אבל התם בשעה שנדר היה יכול לקיים דאפשר לו שלא ישא‎ – However there (by רב אחא), when he made the נדר it was possible for him to keep it, for it is possible that he should not marry a woman, therefore – אף על גב דכי אנסביה אין יכול לקיים אינו עובר לאלתר עד שיהנה: Even though once he married he cannot keep the נדר, nevertheless he does not transgress the לאו of בל יחל until he actually benefits. S UMMARY A נדר which one cannot fulfill is a valid נדר to the extent that he receives מלקות for בל יחל‎. However he is immediately permitted in what he forbade himself. נדרי הבאי are permitted because he is exaggerating (however שבועות הבאי are prohibited, since the תורה writes לא ינקה, the חכמים were מחמיר). בי"ד will not accept a נדר שא"א לקיים as an assurance (since people are not that concerned of transgressing a one time איסור); they are concerned for a continuing prohibition. T HINKING IT OVER 1. תוספות asks regarding the conduct of רב אחא that the שרקיה בטינא was of no avail since he was עובר מיד‎. Seemingly this question is not relevant to our discussion; תוספות should have asked that question in נדרים but not here! 2. Can we distinguish between the נדר of שלא אישן (where מלקין אותו וישן מיד) and the נדר of כל פירות שבעולם יהיו אסורין עלי וכו'? In the case of שלא אישן he must fall asleep (within three days), therefore מלקין אותו וישן מיד; however concerning כל פירות שבעולם it is not inevitable that he must eat, he can die of hunger and still keep the נדר‎!
