1and the court forced her master to emancipate her, and he made her a free woman. And Rav Naḥman bar Yitzḥak said in explanation of why they forced him to do this: They took liberties with her, i.e., people engaged in sexual intercourse with her freely. This demonstrates that it is permitted to free a slave to prevent people from violating prohibitions.

2The Gemara rejects this proof: How can these cases be compared? There, in the case of a half-maidservant half-free woman, she is not fit for marrying a slave and she is not fit for marrying a freeman. This is why she is available to all, and the only way to solve this problem is to emancipate her. Here, in the case of the maidservant, it is possible for the master to assign her to marry his slave, and that slave will guard her from people who wish to be promiscuous with her. Therefore, it is not necessary to emancipate her.

3§ The Gemara returns to discussing the matter itself cited above. Rav Yehuda says that Shmuel says: Anyone who emancipates his slave violates a positive mitzva, as it is stated: “Of them may you take your bondmen forever” (Leviticus 25:46). This is a positive mitzva requiring that one subjugate slaves their entire lives. Therefore, it is prohibited to emancipate them.

4The Gemara raises an objection from a baraita : There was an incident involving Rabbi Eliezer, who entered a synagogue to pray, and he did not find a quorum of ten men, and he emancipated his slave and had him complete a quorum of ten. This demonstrates that one is permitted to emancipate his slave. The Gemara answers: Freeing a slave to enable the performance of a mitzva, e.g., completing a quorum, is different. This does not demonstrate that in general one is permitted to emancipate his slave.

5The Gemara raises an objection from a baraita to the proof citing the incident involving Rabbi Eliezer: The Sages taught: “Of them may you take your bondmen forever,” is optional; this is the statement of Rabbi Yishmael. Rabbi Akiva says: It is an obligation. The Gemara now explains the Gemara’s objection: But perhaps Rabbi Eliezer holds in accordance with the opinion of the one who says that it is optional. Therefore, the incident involving Rabbi Eliezer cannot serve as a proof that even those who hold that it is prohibited to free a slave would hold that it is permitted to free a slave to enable the performance of a mitzva.

6The Gemara answers: It cannot enter your mind to say that Rabbi Eliezer holds that enslaving them permanently is optional, as it is taught explicitly in a baraita that Rabbi Eliezer says: “Of them may you take your bondmen forever” is an obligation.

7In connection with this issue, Rabba said: With these three matters homeowners become impoverished: That they emancipate their slaves; and that they inspect their property on Shabbat; and that they set their meals on Shabbat at the time of the sermon in the study hall, so that they miss it, as Rabbi Ḥiyya bar Abba says that Rabbi Yoḥanan says: There were two families in Jerusalem, one that set its meal on Shabbat and one that set its meal on the eve of Shabbat, and both of them were uprooted. One family was uprooted because they caused the suspension of Torah study, and the other was uprooted because by eating their meal on Shabbat eve, they did not properly distinguish between Shabbat and Shabbat eve.

8§ Rabba says that Rav says: With regard to one who consecrates his slave, the slave is emancipated. The Gemara explains: What is the reason for this? He did not consecrate the slave himself, as the slave cannot become consecrated to be an offering. If you say that it is only with regard to his monetary value that he is consecrated, i.e., the owner pledges to give the value of his slave to the Temple, his owner did not say this. Therefore, it must be that he said that this slave should be a member of the sacred nation, meaning that the slave should be emancipated and become a Jew.

9And Rav Yosef says that Rav says: With regard to one who renounces ownership of his slave, the slave is emancipated. The Gemara points out: According to the one who says that one who consecrates his slave emancipates him, this is all the more so with regard to one who renounces ownership. But according to the one who says that one who renounces ownership of his slave emancipates his slave holds that this is the halakha only if one renounces ownership of his slave; but one who consecrates his slave does not emancipate him, as perhaps when he consecrated his slave he said that his slave is consecrated with regard to his monetary value, he should be sold and the profit donated toward the Temple maintenance.

10A dilemma was raised before the Sages: In both of these cases, where the slave is emancipated after his owner renounces his ownership of him or consecrates him, does the slave require a bill of manumission, or does he not require a bill of manumission? The Gemara suggests a proof to resolve this dilemma: Come and hear that which Rav Ḥiyya bar Avin says that Rav says: In both this case, where one consecrates his slave, and that case, where one renounces ownership of his slave, the slave is emancipated but nevertheless requires a bill of manumission.

11Rabba said: And we raise an objection from a baraita to our halakha that Rav said that one who consecrates his slave emancipates him: With regard to one who consecrates all his possessions, and among them were slaves, the Temple treasurers are not allowed to emancipate them. However, they may sell the slaves to others, and these others may emancipate them. Rabbi Yehuda HaNasi says: I say that even the slave himself can give his own monetary value and is emancipated, due to the fact that it is as if the Temple treasurer sold him to himself. This demonstrates that the act of consecrating one’s slave does not emancipate him. The Gemara rejects this argument: Do you raise an objection to Rav from a baraita ? Rav himself is a tanna , and, as such, has the authority to dispute the determination in the baraita .

12The Gemara raises another objection from a baraita to the opinion of Rav: Come and hear: “Notwithstanding, no dedicated thing that a man may dedicate to the Lord from all that he has, whether of man or beast, or of the field of his possession, shall be sold or redeemed” (Leviticus 27:28). The Sages interpret the verse as follows: “Of man”; these are his Canaanite slaves and maidservants. This demonstrates that one may consecrate his slaves and they are not emancipated as a result. The Gemara answers: With what are we dealing here? This is referring to a case where the master said explicitly that he is consecrating them with regard to their monetary value.

13The Gemara asks: If that is so, then why not say that the other baraita quoted above is also referring to a case where one said explicitly that the slave is consecrated with regard to his monetary value? Why is it necessary to answer that Rav disagrees with that baraita ?

14The Gemara answers: If that is so, that the baraita is referring to one who said that the slaves are consecrated only with regard to their monetary value, then why does the baraita state that the Temple treasurers [ gizbarim ] are not allowed to emancipate them. The Temple treasurers; what are they doing in this discussion? They would never be able to emancipate the slaves, as the slaves were never actually consecrated.

15And furthermore, the baraita states: However, they may sell the slaves to others, and these others may emancipate them. Others; what are they doing in this discussion? They also should not be able to emancipate the slaves. And furthermore, the baraita states: Rabbi Yehuda HaNasi says: I say that even the slave himself can give his own monetary value and is emancipated, due to the fact that it is as if the Temple treasurer sold him to himself. And if the slave was consecrated only with regard to his monetary value, what is the meaning of: Due to the fact that it is as if the Temple treasurer sold him to himself? The baraita makes sense only according to the opinion that one who consecrates a slave consecrates the slave himself, and since there is nothing for the Temple to do with the slave, he must be redeemed and the money used in his place. Therefore, the baraita contradicts Rav’s opinion.

16The Gemara raises another objection to Rav’s opinion from a baraita : Come and hear: In a case of one who consecrates his slave, the slave works and is sustained as compensation for his labor, as the master consecrated only his monetary value and donates that sum to the Temple treasury. This demonstrates that the slave does not become consecrated, as he may still work for the master, and he is also not emancipated.

On Erev Shabbat - On the night of Shabbat. There is no honour given here to Shabbat, because honour of the day is more important than honour of the night, and they did this so that they would miss the Shabbat drasha. There are those who explain that the issue with their actions was that they ate their meal before Shabbat started, and one is meant to start Shabbat with an appetite.

גופיה לא קדיש‎—His body is not sanctified O VERVIEW רב taught if one is מקדיש his slave (he said, ‘my slave should be הקדש’), the slave is freed. The גמרא explains the reason is because גופו לא קדיש (the body is not sanctified) and לדמי לא קאמר (the master did not say that I am מקדיש him for his value). There is a dispute between רש"י and תוספות how two explain these two reasons. There are three types of קדושת דמים (which are not brought as a קרבן) which are discussed in this תוספות‎. 1. קדושת בדק הבית where the item itself is used to repair or improve the ביהמ"ק (such as being מקדיש stones, wood, etc.). 2. קדוש לימכר, where the item itself cannot be used directly to repair the ביהמ"ק, but the גזבר sells the item (a בהמה בעלת מום) and the money is used for בד"ה. 3. דמיו עלי, where the person says, ‘I am donating to the ביהמ"ק the value of this item’; the item (which does not necessarily need to belong to the נודר), remains in the possession of the owner, but whoever made this נדר must pay הקדש its value. -------------------------- פירש בקונטרס שאינו ראוי למזבח ולא לבדק הבית – רש"י explained that גופיה לא קדיש, for the עבד is not fit either for the מזבח (to be brought as a קרבן) nor is he fit for the בדק הבית; רש"י continues explaining the גמרא, we cannot say he meant to give הקדש the value of the slave, for – לדמי לא קאמר דהיה לו לומר דמי עבדי עלי‎ – He did not say I am obligating myself to pay הקדש the value of this slave, for if that was his intention, the master should have said, I am giving to הקדש the value of my slave. רש"י continues responding to an anticipated question – ולא דמי למקדיש בהמה טמאה דהתם כיון דליכא למימר למיהוי עם קדוש קאמר‎ – And the case of עבד is not similar to one who is מקדיש a בהמה טמאה (where the rule is that he has to pay הקדש the value of the בהמה טמאה; however we do not say this regarding המקדיש עבדו), for there (by המקדיש בהמה טמאה) since we cannot say that the master meant that the בהמה should be part of the עם קדוש, therefore – על כרחך לדמי קאמר אף על גב דלא אמר דמיה עלי הרי היא קדושה לימכר קאמר‎ – Perforce we must say that he meant to be מקדיש its value, even though he did not say, ‘I am giving its value’, nevertheless it is understood that he meant, ‘ the animal is קדושה in order to sell it (and give its value to הקדש) – אבל הכא דשייכא בגופיה לשון קדושה לא אמרינן דלדמי קאמר – However here where the קדושה is applicable to the body of the עבד (he can become a part of the עם קדוש), we do not assume that he meant to be מקדיש merely the value of the slave, rather he meant the slave should be holy as part of the עם קדוש‎. This concludes תוספות citation of רש"י. תוספות asks on פירש"י: ואם תאמר ואמאי לא קאמר נמי קדוש לימכר לא קאמר כיון דמילתא אחריתא היא – And if you will say; but why did not the גמרא also explain that the master did not mean that the עבד is קדוש to be sold; the גמרא should have explained this since this is a different issue – תוספות answers: ויש לומר כדפירש בקונטרס בסמוך דאפילו אמר כן בהדיא שיהא קדוש לימכר יצא לחירות‎ – And one can say; as רש"י explains shortly that even if he said so explicitly that the עבד should be קדוש so that he should be sold; the עבד goes free – מידי דהוה אמתפיס תמימים לבדק הבית דאין יוצאין מידי מזבח לעולם‎ – For it is similar to one who designates whole [unblemished] animals for בד"ה, where the rule is they never leave the sanctity of the מזבח (they are to be brought as קרבנות), similarly here since according to רב when he is מקדיש his עבד, the עבד is fit to become part of עם קדוש (similar to a בהמה תמימה which is ראויה למזבח), so even if he says קדוש לימכר (which is similar to מתפיס תמימים לבד"ה) the עבד becomes free, part of עם קדוש (just like the תמימים are not יוצא מידי מזבח לעולם) – ולהכי לא מוקי ההיא דאין הגזברין כגון דאמר שיהו קדושין לדמיהן‎ – And therefore the גמרא does not establish that ברייתא of אין הגזברין in a case where for instance the master said regarding his slaves that they should be קדושין for their value (meaning קדוש לימכר), for even if he said so, they still go free. In Summation: רש"י interprets גופו לא קדיש to mean that the עבד is not fit for the מזבח or בד"ה. לדמי לא קאמר means the master did not say that he wants to give הקדש the value of the עבד‎. Therefore the עבד is freed even if the master said he is קדוש לימכר, for it is similar to מתפיס תמימים לבד"ה. תוספות has a difficulty with פירש"י: ומיהו קשה דאי מדמינן למתפיס תמימים‎ – However there is a difficulty; if we are comparing מקדיש עבדו to מתפיס תמימים‎ – נימא דאף על פי שהעבד יצא לחירות צריך לפדייה ויפלו דמיו לבדק הבית – Let us say that even though the slave is freed, he still requires redemption and the redemption money should be allocated for the בד"ה – כמו במתפיס תמימים שתימכר לצורכי מזבח כדאמרינן בהמנחות והנסכים (מנחות קא, א) – Just as it is by מתפיס תמימים for the בד"ה where the rule is that the animal is sold for usage on the מזבח, as the גמרא states in פרק המנחות והנסכים‎ – כשהן נפדין אין נפדין אלא למזבח והדמים הם לבדק הבית‎ – That when they (the תמימים that were נתפס לבד"ה) are redeemed they can only be redeemed for use of the מזבח and the money paid for the redemption goes to the בד"ה – כדאמר בפרק קמא דתמורה (דף ו, א) דאף על פי שהוא בלא תעשה מה שעשה עשוי‎ – As the גמרא states in the first פרק of מסכת תמורה, that even though the one who was מתפיס תמימים לבד"ה transgressed a לא תעשה, nevertheless what is done is done and בד"ה receives the פדיון money. Similarly the same should be true here as well that the פדיון money for the עבד should go to בד"ה – ולכאורה משמע דליהוי עם קדוש קאמר ואינו נותן שום דמים להקדש – But seemingly it appears from our גמרא that the master meant that the עבד should be עם קדוש, but no money needs to be given to הקדש‎. The question is why is there a difference between מתפיס תמימים לבד"ה and מקדיש עבדו, since רש"י maintains they are similar?! תוספות has an additional question: ועוד מאי קפריך מאך כל חרם‎ – And furthermore why does the גמרא ask on רב (who said המקדיש עבדו יצא לחירות) from the ברייתא of אך כל חרם (where it states that it belongs to הקדש) – דהתם דאמר בלשון חרם לא שייך לומר דלמיהוי עם קדוש קאמר‎ – For there (in the case of the ברייתא) where he used the term of חרם, it is not applicable to say that למיהוי עם קדוש קאמר (for חרם has no connection to עם קדוש) therefore we can say he meant קדוש לימכר (like by a בהמה טמאה) but when he is מקדיש an עבד where we can say למיהוי עם קדוש קאמר, we say that יצא לחירות‎ – תוספות continues to ask on פירש"י: ועוד כי משני דאמר לדמי והיינו לפירוש הקונטרס דאמר דמי עבדי ושפחתי עלי – And in addition when the גמרא answered that the ברייתא of אך כל חרם is discussing a case where the master said לדמי explicitly, which according to פירש"י [ must] mean that the master said, I am obligated to give the value of my עבד ושפחה (only in that case do they not go free); the reason רש"י must interpret לדמי in this manner is – דאם הקדישם לדמים יצאו לחירות – For if he was מקדיש them for their value (הקדישם לימכר) they would go out free – ואם כן מאי איריא עבדיו ושפחותיו אפילו דחברו נמי‎ – So if this is indeed so (that לדמי means merely דמיו עלי) then why does the ברייתא teach the case by his servants and שפחות, even if they are the עבדים ושפחות of his friend and he said דמיהם עלי, he is also obligated to pay בד"ה their value – תוספות continues to press his point – ועוד מאי שנא כנענים אפילו עבדיו ושפחותיו העברים נמי‎ – And also why are כנענים different, even by עבדיו ושפחותיו העברים the law is also that he must pay בד"ה‎! This concludes תוספות questions on פירש"י. In summation: תוספות asks on פירש"י; 1. Why is there no חיוב פדיון on the עבד if he meant/said קדוש לימכר as there is by מתפיס תמימים‎. 2. How can the גמרא ask from חרם, there it cannot mean עם קדוש‎. 3. If the ברייתא of אך חרם is in a case of דמיהם עלי then why does it need to be his slave, and 4.why an עבד כנעני it could even be an עבד עברי‎. תוספות offers his interpretation of גופיה לא קדיש and לדמי לא קאמר: ונראה לפרש גופיה לא קדיש פירוש ליאסר בהנאה כמו בהמה טמאה שמועלין בה‎ – And the preferred explanation is that גופיה לא קדיש means that his body will not become אסור בהנאה like a בהמה טמאה which was הוקדש where one transgresses מעילה if he derives any benefit from her – וכן בקרקע אם עקר ממנו חוליא ואפילו במחובר איסורא מיהא איכא‎ – And similarly by one who was מקדיש the ground, if he uprooted a spade full and even if he derived benefit from the קרקע while it is still attached, there still is a prohibition (מדרבנן) ; however if he was מקדיש an עבד there can be no איסור הנאה‎. תוספות continues when the גמרא says – לדמי לא קאמר שיהא גופיה קדוש לימכר – He did not say לדמי; it means the master did not say that the body of the עבד should be קדוש that we sell it. תוספות concluded explaining these two expressions (גופו לא קדיש and לדמי לא קאמר), and now continues with explaining the גמרא – והשתא פריך שפיר מכל חרם דמיתפסא בהון קדושה ליאסר בהנאה כמו מחרים שאר נכסים- And now it is well understood that the גמרא ask from כל חרם for we see there that קדושה takes hold of the עבדים ושפחות that they become אסור בהנאה like one who is מחרים the rest of his assets – ומשני דאמר לדמי שיהיו לימכר ולא מיירי במקדיש בלשון חרם‎ – And the גמרא answered that he said לדמי meaning that they should be sold for הקדש and we are not discussing that he was מקדיש them using the term חרם, but rather he was מקדיש them לימכר (which means לדמי) – והשתא ניחא דדוקא עבדיו ושפחותיו הכנענים – And now it is understood that this applies exclusively to עבדיו ושפחותיו הכנענים‎ – ופריך אידך נמי דאמר לדמי – So the גמרא asked let us say that the other ברייתא of אין הגזברין is also discussing a case where he said לדמי (meaning קדוש לימכר) – ומשני אי הכי גזברין מאי עבידתייהו דאותו שהקדישו לדמיו הוא יפדנו ויהיה שלו: And the גמרא answered if so (that he was מקדיש them לימכר) why are the גזברין involved here; whoever was מקדיש the עבדים for דמיו he will redeem them and it will belong to him (and [only] he will be able to free the עבד). S UMMARY רש"י maintains הקדיש עבדו לימכר he is freed, while תוספות maintains he is not freed. T HINKING IT OVER According to תוספות that if one merely owns קנין ממון he cannot be משחרר the עבד, so regardless of רב, the ברייתא of אין הגזברין is difficult, for מאי עבידתייהו since they only have a קנין ממון‎. Why is the גמרא asking on רב‎?!

אין הגזברין רשאין להוציא אותן לחירות‎—The treasurers are not permitted to set them free O VERVIEW The ברייתא stated that if someone was מקדיש his עבדים, the גזברין are not permitted to set the עבדים free, rather they may sell the עבדים to others (with the money going to הקדש), and the buyers may free them. תוספות explains the reason for this rule. --------------------------- וכן אמר בפרק הנזקין (לקמן נב, א) גבי יתומין‎ – And the גמרא states a similar ruling in פרק הנזקין regarding orphans – דאין האפוטרופסין רשאין להוציא אותן לחירות אבל מוכרין אותן לאחרים כולי‎ – that the trustees of the estate are not permitted to set the slaves free, but rather they can sell the slaves to others, etc. and the others may free them – ונראה דהיינו טעמא דאסור דרך שיחרור דסברי דקא מזלזלי בנכסי יתומים והקדש – And it seems that this is the reason, that it is forbidden to dispose of the slaves by means of emancipating them since the trustees (and the גזברים) are demeaning the property of יתומים and הקדש‎ – אבל דרך מכירה ידעי כולי עלמא שמוכרין אותן בשויין: However, when the dispose of the עבדים by selling them, everyone knows that the אפוטרופסין וגזברין are selling them for their full value. S UMMARY גזברין and אפוטרופסין cannot free the עבדים (even if they pay the full value of their redemption) because people are suspicious that they took less than the true value. T HINKING IT OVER Why does not תוספות learn like פירש"י here (and in הנזקין) that the גזברין (or אפוטרופסין) cannot be משחרר the עבדים since אין גופן קנוי להם‎?
