    Gittin 42a

    Chapter 4 - HaSholeach

גם: גיטין דף מ״ב ע״א, פרק ד׳ השולח

    English translation - Gittin 42a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1The mishna is referring to a slave belonging to two partners, and in that case everyone agrees that each one of them can emancipate his portion of the slave. Consequently, there could be a half-slave half-freeman even according to Rav Yosef’s understanding of the opinion of the Rabbis.

2§ The Gemara discusses another dispute with regard to one who emancipates half of his slave. Rabba said: The dispute between Rabbi Yehuda HaNasi and the Rabbis concerning whether the slave can be half-emancipated applies only when the master freed half of him and left the other half of him unaffected. However, if he freed half of him and sold the other half of him, or gave the other half of him as a gift to someone else, then, since the slave left him entirely, as the original master no longer owns any portion of the slave, everyone agrees that the slave has acquired half of his freedom.

3Abaye said to him: And do they not disagree with regard to a case where he is released entirely? But it is taught in one baraita : In the case of one who writes his property to his two slaves, i.e., gives it to them via a document, they acquired the property and they free each other, because each one has ownership over half of the other slave. And it was taught in another baraita that in the case of one who says: All of my property is given to so-and-so and so-and-so my slaves, they did not acquire even themselves, and all the more so they did not acquire the property. Seemingly, the two baraitot contradict each other.

4Abaye continues his question: What, is it not that the way to reconcile the baraitot is to say that this, the first baraita , is in accordance with the opinion of Rabbi Yehuda HaNasi, that emancipation can take effect with regard to half a slave? And that, the second baraita , is in accordance with the opinion of the Rabbis, who maintain that even when the master retains no hold on the slave, a slave cannot be partially released?

5The Gemara offers a different reconciliation: No, both this and that baraita are in accordance with the opinion of the Rabbis. This first baraita is discussing a case where one said that he is giving all of his property to each one of the slaves. Since he gave everything to both of them, they each acquire the property, including each other, emancipate each other, and divide the property between them. That second baraita is discussing a case where one said that he is giving half of his property to one slave and half of it to the other, so neither is fully emancipated.

6The Gemara challenges this explanation: But from the fact that the latter clause of the second baraita teaches: But if he said that he is giving half of his property to one slave and half of it to the other, they did not acquire the property, it may be inferred that the first clause is discussing a case where he said that he is giving all of his property to each one of them, and yet they do not acquire the property. The Gemara answers: There are not two separate cases in the baraita . Rather, the second clause is explaining the first clause of the baraita , as follows: They did not acquire even themselves. How so? For example, this is the halakha in a case where the master said that he is giving half of his property to one slave and half of it to the other.

7The Gemara comments: So too, it is reasonable to say this, for if it enters your mind to say that the first clause of the baraita is discussing a case where he said that he gives all of his property to his slaves, and yet they do not acquire it, then the latter clause is unnecessary. Now that the mishna taught that if one said that he gives all of the property to his two slaves, then each slave did not acquire himself, is it necessary to state in the second clause that this is true when one gives half of his property to one slave and half of it to the other?

8The Gemara answers: If it is due to that reason, there is no conclusive argument. One could say that the tanna taught the latter clause to shed light on the first clause, so that you do not say: The first clause is discussing only a case where one said that he gives half of his property to one slave and half to the other, but if one said that he gives all of it to both of them, then they did acquire the property. Therefore, the tanna taught the latter clause, where it explicitly discusses a case where he said that he gives half to one and half to the other, and by inference it is clear that the first clause must be discussing a case where he said that he gives all of it to both of them, and even so they did not acquire the property.

9And if you wish, say instead that it is not difficult. It is possible to reconcile the two baraitot differently: Here, in the second baraita , where they did not acquire the property, this is a case where the master wrote everything in one document. The reason the slaves do not acquire themselves is that it is not possible to emancipate two slaves with one document. There, in the first baraita , which rules that they did acquire the property, the case is one where the master wrote the transfer of property in two documents.

10The Gemara asks: If the second baraita is referring to a case where he wrote everything in one document, why specifically mention that the slaves do not acquire themselves when he gave half to one and half to the other? Even if he said all of it as well, they did not acquire the property, as was taught explicitly in the beginning of the baraita . The Gemara answers: That is also what the tanna is saying: They did not acquire even themselves. In what case is this statement said? In a case where the master wrote everything in one document. But if he wrote it in two documents, they acquired the property. And if the master said that he gives half to one and half to the other, then even if he wrote it in two documents they also did not acquire the property.

11And if you wish, say instead that it is not difficult, and it is possible to reconcile the two baraitot differently: Here, the first baraita , where they did acquire the property, is referring to a case where he gave them the documents simultaneously. There, the second baraita , where they did not acquire, the property is referring to a case where he gave them the documents sequentially.

12The Gemara questions this explanation: Granted, if the master gave the documents sequentially, the last slave did not acquire, for the first slave had already acquired him, as the second slave was among the possessions transferred via the first document. However, the first slave should acquire himself and should also acquire the other slave, as he was given all of the property in one document. Due to this objection, the Gemara concludes: Rather, it is clear as we initially answered, and in any case it is referring to when he gave both documents simultaneously.

13Rav Ashi said: The contradiction between the baraitot can be resolved by noting that it is different there, in the second baraita , because the master calls them: My slaves. By writing: All of my property is given to so-and-so and so-and-so my slaves, he indicates that he does not intend to free them. Rafram said to Rav Ashi: But perhaps when he says: My slaves, he is referring to those who were his slaves in the past.

14Rafram attempts to prove that the expression my slaves can be used in this manner. Didn’t we learn in a mishna ( Pe’a 3:8): In the case of one who writes all of his property to his slave, i.e., gives it to him via a document, the slave has been emancipated. But if he reserved for himself even any amount of land, then he has not been emancipated. Rabbi Shimon says: Actually, the slave is a freeman until the master says the following: All of my property is given to so-and-so my slave except for one ten-thousandth of it, as in that case it is possible that the master meant to include the slave in the portion that he is not giving.

15Rafram continues his proof: The reason the slave is not emancipated is specifically because the master said: Except for one ten-thousandth of it. But if he did not say this, then the slave acquires the property. Rafram asks: According to your reasoning, why does he acquire the property? Didn’t he call him a slave? Rather, it must be that when he called him: My slave, he meant that he was his slave in the past. Here also, when he said: My slaves, he meant: Those who were my slaves in the past. Therefore, Rav Ashi’s attempt to resolve the contradiction between the baraitot cannot be accepted.

16§ If a half-slave half-freeman, who works for himself and his master on alternating days, was gored by an ox and damaged, then, if he was gored on the day of his master, the reimbursement for the damage caused is paid to his master. If it was on his own day, it is paid to the slave himself. The Gemara asks: However, if that is so, if he is viewed as entering and leaving a state of slavery each day, then on the day of his master he should be able to marry a maidservant and on his own day he should be able to marry a free woman. However, the mishna states that he cannot marry anyone. The Gemara answers: We are not saying that he is viewed as entering and leaving a state of slavery each day with regard to prohibitions.

17Come and hear a proof with regard to this issue: When a Canaanite slave is killed by an ox, in addition to the ox being put to death, the owner of the ox pays a fixed penalty of thirty shekels to the slave’s owner. If a freeman is killed by an ox, in addition to the ox being put to death, the freeman’s value is paid to his heirs. If an ox killed a half-slave half-freeman, then the owner of the ox gives half of a penalty, i.e., fifteen shekels, to his master

    Tosafot

בעבד של שני שותפין ודברי הכל‎—By a slave of two partners and according to everyone O VERVIEW The גמרא explained that the case of a חצי עבד וחצי בן חורין is where the slave belonged to two partners, where everyone agrees that each one of them can free his share of the slave, so if one of them frees his part, the עבד is a חצי עבד וחצי בן חורין‎. -------------------------------- תוספות asks: ואם תאמר והא לרבי אליעזר דבפרק החובל (בבא קמא דף צ, א) אינו יכול לשחרר חלקו – And if you will say; but according to ר"א in פרק החובל, a partner in an עבד cannot free his share – כמו שאינו יוצא בשן ועין דבעינן עבדו המיוחד לו‎ – Just like this עבד who has two masters cannot go free if his tooth or eye are destroyed, for we require that it should be ‘ his slave’ one who is designated specifically for him, but not that it is designated for others as well – ומוקי התם אליביה הא דאמר אמימר איש ואשה שמכרו בנכסי מלוג לא עשו ולא כלום – And the גמרא there established this which אמימר ruled, ‘a man and his wife who sold the נכסי מלוג they did not accomplish anything’, this ruling is according to the teaching of ר"א – תוספות concludes his question וקאמר התם חציו עבד וחציו בן חורין‎ – And the גמרא there cites a ברייתא, which states, ‘a חצי עבד וחצי בן חורין‎ – וכן עבד של שני שותפין [פירוש אליביה דרבי אלעזר] אין יוצאין בראשי איברים – And similarly an עבד of two partners do not go out if the tips of their limbs' were cut off, as it is by a regular עבד, and רבא there explained that this ברייתא is according to ר"א, so just as he cannot go out בראשי אברים since he is not עבדו המיוחד לו, he also cannot free him, so how can the גמרא here say that a חציו עבד וחציו בן חורין is possible by an עבד של ב' שותפין according to everyone, when we see from the גמרא in ב"ק that by an עבד של ב' שותפין neither one can free him (on their own). תוספות answers: ויש לומר דשותפין דהתם היינו לזה גוף ולזה פירות – And one can say that the term שותפין there in the ברייתא means that one owns the גוף and the other owns the פירות‎ – כמו מוכר עבדו לאחר ופסק עמו על מנת שישמשנו ל' יום דהוי דומיא דאיש ואשה – It is like the case of one who sold his slave to another with the stipulation that he should still service him (the seller) for thirty days, which that case is also similar to a man and his wife regarding their ownership of נכסי מלוג; it is only in these cases where there is the issue of המיוחד לו and therefore neither owner is considered his total owner, and he will not be able to free him either – אבל כשיש לו גוף ופירות יכול לשחרר חציו‎ – However, when each of the partners owns half the גוף and half the פירות, either one can free his half of the עבד‎ – תוספות responds to an anticipated difficulty: והא דקאמר התם חציו עבד וחציו בן חורין היינו למשנה אחרונה – And this which the ברייתא states there that a חצי עבד וחצי ב"ח does not go out בראשי אברים, that it (only) according to the latter משנה that ב"ה agreed to ב"ש that we force the remaining master to free the slave – תוספות asks: ואם תאמר והא אמימר גופיה אית ליה לעיל לחד לישנא דמפקיר עבדו יש לו תקנה בשטר‎ – And if you will say; but אמימר himself maintained previously according to one version, that one who frees his slave there is recourse for this slave to gain his complete freedom if the owner gives him a שטר שחרור‎ – תוספות answers: ויש לומר דשטר ודאי מפקיע האיסור כדאמרינן לעיל מה אשה איסורא ולא ממונא: And one can say that a שטר can certainly remove the prohibition, as the גמרא states previously, just like a woman the גט removes only the prohibition aspect, but not any monetary obligation, the same is with a שטר שחרור of an עבד‎. S UMMARY The restriction of ר"א regarding 'המיוחד לו', is only if one owns קנין הגוף and the other קנין פירות, but not if they are שותפין in both. A שטר שחרור, however is effective to remove איסור but not ממון‎. T HINKING IT OVER 1. תוספות asks how can it be אליבא דכו"ע, when ר"א (seemingly) disagrees. Why cannot we answer that when the גמרא states 'ואליבא דכו"ע' it means according to both רבי ורבנן who we were discussing previously, however we did not mean כו"ע literally (especially since ר"א שמותי הוא he follows ב"ש which is אינה משנה במקום ב"ה); so what is תוספות question?! 2. תוספות writes that the ruling of אמימר regarding נכסי מלוג is according to ר"א (as part of the question). Seemingly why was it necessary at all for תוספות to cite the ruling of אמימר, why is the question from the ברייתא (of שותפין) insufficient?! 3. תוספות asks a contradiction from אמימר‎. Seemingly the same question can be asked directly on our משנה; how can we say that we force him to be משחרר the עבד, but he only has a קנין הגוף on the עבד‎?!

הא דאמר חצי חצי‎—Here is where he said; half - half O VERVIEW The גמרא is attempting to reconcile two contradictory ברייתות regarding one who delivered all his assets to his two slaves. The ברייתא which states that the slaves acquire the assets is where he wrote over the entire assets to both slaves, and the ברייתא which states that they do not acquire the assets is where he wrote חצי חצי‎. There is a dispute between רש"י and תוספות as to the meaning of חצי חצי‎. פירש בקונטרס שכתב בשטר אחד חצי נכסיי לך וכן בשני לחברו‎ – רש"י explained that חצי חצי means that he wrote in one שטר, ‘half of my assets are yours’, and he wrote the same thing in the second שטר to the other עבד‎ – ואפילו מסר בבת אחת לא קנו דדלמא חד פלגא הוא דכתב לתרוייהו ואיכא שיור – So even if he delivered both שטרות simultaneously to both עבדים, they do not acquire his assets, for perhaps it is the same half of his assets that he wrote to both of his slaves, so there is a remainder, and therefore they are not קונה – תוספות asks on פרש"י: וקשה לרבינו שמואל דהא מדקאמר כל נכסיי משמע שמפרש בשטר‎ – And the ר"ש has a difficulty with this explanation, for since the ברייתא of חצי חצי states 'כל נכסי נתונין לפלוני ולפלוני עבדי', this indicates that it was explicit in the שטר‎ – שחציו שנתן לזה לא נתן לזה אלא הכל נתן לשניהם‎ – That the half which he gave to this slave he did not give to the other slave, but rather he gave all his assets to both slaves, so how can רש"י state that he meant the same half, how would that fit with the expression כל נכסי‎?! Another question on פרש"י: ועוד מדמפליג בין אמר כולו לאמר חצי משמע דוקא אמר כולו קנו‎ – And additionally since the גמרא differentiates whether he said כולו (where the עבדים are קונה) or whether he said חצי (where they are not קונה), this indicates that the עבדים are קונה only if he said כולו‎ – אבל חצי אפילו פירש שלא חצי אחד נותן לשניהם אלא הכל אפילו הכי לא קנה – But if he said 'חצי', even if he specified that he is not giving them both the same half, but rather he is giving them everything, nevertheless they are not קונה, but according to רש"י if he gave them everything בבת אחת even if he said חצי they would be קונה‎! תוספות offers his interpretation: ונראה לרבינו שמואל דרבה לטעמיה דאית ליה בפרק שני דקידושין (דף נ, ב) – And it is the view of the ר"ש that חצי חצי is never קונה even if he explicitly gave it all away, for רבה follows his reasoning in the second פרק of מסכת קידושין‎ – ובמי שהוציאוהו (עירובין נ, א) כל שאין בזה אחר זה אפילו בבת אחת אינו‎ – And in the פרק מי שהוציאוהו that anything which is not effective when it occurs consecutively, it is not effective even when it occurs simultaneously – ובזה אחר זה לא קנה כיון דשייר – And by חצי if it were done consecutively, the עבדים would not be קונה, since he left over part of the עבד, so therefore they will not be קונה even בב"א – תוספות responds to an anticipated difficulty: ולא דמי לשיחרר חציו ומכר חציו דהתם הוי בזה אחר זה אם מכר חציו תחילה‎ – And this case of חצי is not similar to a case where he freed half the slave and sold half the slave בב"א where it is effective; because there it would be effective בזה אח"ז if he first sold half the slave and then freed the other half, so he is not משייר in the שחרור, however here by חצי חצי it can never take effect בזה אח"ז therefore it cannot take effect by ב"א. תוספות asks: וקצת קשה לפירושו דאם כן כי אמר כולו נמי לא ליקני בבת אחת‎ – And there is a slight difficulty with the explanation of the ר"ש, for if indeed it is so that since it is not effective בזה אח"ז it is not effective even בב"א, so even if he said 'כולו' it should also not be effective even בב"א – כיון דבזה אחר זה שני לא קני כמו במקדש שתי אחיות דאינן מקודשות‎ – Since by בזה אח"ז the second עבד will not acquire anything, so it should be like one who is מקדש two sisters that both are not מקודשות‎ – כיון דבזה אחר זה לא תפסי קדושין בשניה – Since in a case where he was מקדש them בזה אח"ז the קידושין does not take effect by the second one, the same should be here that since if he gave them his assets בזה אח"ז the second one receives nothing so (even) if he gave it to both of them בב"א neither should receive anything! תוספות explains why the rule of כל שאין וכו' does not apply everywhere: אלא ודאי לא שייך כל שאינו בזה אחר זה אלא היכא שהראשון מונע את השני מלחול‎ – Rather the rule of כל שאין בזה אח"ז is certainly not applicable unless the first act prevents the second act from taking effect – כמו בשתי אחיות שמונעים קידושי הראשונה מלחול קידושי שניה‎ – As it is by the case of the two sisters that the קידושין of the first sister prevents the קידושין of the second sister from taking effect אבל הכא הא דלא קני שני בזה אחר זה לאו משום דלא חזי לקנות‎ – However here by the עבד this that the second עבד cannot acquire the assets where it was בזה אחר זה is not because the second עבד is not fit to acquire the assets (as it is by the second sister who is now not fit to be מקודשת to her sister’s husband because of her sister) – אלא משום דכבר נסתלק הנותן ואין לו בהן כלום‎ – Rather the reason the second עבד is not קונה is because the grantor has already been removed from his assets and he owns nothing of them anymore; he has nothing what to give. The case of the two עבדים‎ – מידי דהוה אנותן כל נכסיו לשנים וכתב לכל א' נכסיי נתונין לך במתנה‎ – Is similar to a case where one gives his assets to two people and wrote to each of them my assets are given to you as a gift – וזיכה להן בבת אחת דקנו כל הנכסים – And he was מזכה it to them בב"א that they both acquire all the assets equally – ואין לדמות ממון הראוי לחלק ואיתיה לחצאין כדאמר התם אמעשר : For we cannot compare money which can be separated and divided, as the גמרא states there concerning מעשר‎. S UMMARY רש"י maintains that the reason they are not קונה by חצי is because it may be the same חצי‎. According to the ר"ש they are not קונה even if it is a different חצי, since כל שאין בזה אח"ז אפי' בב"א אין‎. The difficulty with this is why are they קונה by כולו‎. There is a need to differentiate between קידושין and ממון which is divisible. T HINKING IT OVER According to the 'קצת קשה', what would be the ruling by חצי חצי where it was made clear that between the two of them they acquire everything, are they קונה or not?

מאי איריא חצי אפילו כולו נמי‎—Why teach ‘half’, it is also even by ‘all’ O VERVIEW The גמרא reconciles the two ברייתות, saying that the ברייתא which stated לא קנו is where it was בשטר אחד‎. The גמרא asked why then does the סיפא of this ברייתא state that if it was חצי חצי in one שטר they are not קונה, but why mention חצי (which is more reason not to be קונה [since he is משייר]), since the rule of לא קנו applies even if he said כולו‎. Our תוספות explains why the גמרא did not attempt to answer this question with the same answer it gave previously in a similar situation. ------------------------------------- תוספות responds to an anticipated difficulty: הכא ליכא לשנויי תנא סיפא לגלויי ארישא – Here the גמרא could not have answered תנא סיפא לגלויי ארישא‎ – דפשיטא דבשטר אחד אין חילוק בין אמר חצי חצי לאמר כולו: For it is obvious that the רישא is discussing even כולו, for if he gave them both one שטר, there is no difference whether he said חצי חצי or whether he said כולו‎. It is (the same) פסול in either case S UMMARY By one שטר there is no conceivable difference between חצי and כולו‎. T HINKING IT OVER Why can’t we say that without the סיפא we would have thought that the רישא is only by חצי, and by writing חצי in the סיפא it is לגלויי ארישא that it is even by כולו because of לה ולא לה ולחברתה‎?

יום של רבו לרבו‎—The day of his master; it goes to his master O VERVIEW The גמרא states that if an ox gored a חצי עבד וחצי בן חורין on the day he is supposed to work for his master, the payment for the damage by the ox is paid to his master. Our תוספות discusses the practical application of this הלכה ---------------------------------- היינו למשנה ראשונה דלמשנה אחרונה מעשה ידיו שלו – This ruling that יום של רבו לרבו is only according to the first משנה, however according to the last משנה, the handiwork of the עבד belongs to him – דבסמוך מדמי ליה למעוכב גט שחרור – For shortly the גמרא compares a חעוחב"ח to one who is held back from marrying a בת ישראל because he does not have a שטר שחרור‎ – תוספות responds to the anticipated difficulty: ומיהו נפקא מינה אף למשנה אחרונה כגון בשל יתומים קטנים דלאו בני כפייה נינהו‎ – However there is relevance to this rule of יום רבו לרבו even according to the משנה אחרונה in a case where for instance the חצי עבד belonged to minor orphans, who cannot be coerced to free their חצי עבד‎ – או בחציה שפחה וחציה בת חורין ולא נהגו בה מנהג הפקר‎ – Or in a case of a חציה שפחה וחציה בת חורין where they were not acting with her in a promiscuous manner – תוספות asks: וקצת תימה כיון דלפי משנה אחרונה מעשה ידיו שלו‎ – And it is slightly puzzling; since according to the משנה אחרונה the מעשה ידיו of a חעוחב"ח belong to the עבד, but not to the master, so – מה הרויח לעיל ההוא גברא דאקני לבנו קטן‎ – Previously, regarding that person who was מקנה his חצי עבד to his minor son; what did he gain by it – והא מכי משחרריה חבריה לפלגיה מיד זכה העבד בעצמו והוה ליה מעוכב גט שחרור – For as soon as his partner freed his half, the עבד immediately acquired ownership for himself that he is not required to work anymore for the remaining partner, and he became a מעוכב גט שחרור‎ – ואין יכול להקנות לבנו אלא מה שיש לעצמו בו אבל טפי לא‎ – And the remaining partner can be מקנה to his son, only whatever rights he owns in this עבד, but no more, so since he has no rights in the מעשה ידיו of the עבד, what did he gain by transferring ownership to his son; the עבד no longer works for them! תוספות answers: ושמא הקנה לבנו קודם ששחררו חבירו לפי שהיה יודע שחברו היה רוצה לשחרר חלקו: And perhaps he was מקנה the עבד to his son before his partner freed the עבד, for he realized that his partner wants to free his share of the עבד‎. S UMMARY Once an עבד is freed halfway, he no longer works for his remaining master. T HINKING IT OVER תוספות taught previously (בד"ה בעבד) that if one owns the גוף without the פירות, one cannot sell this asset. Why then did not תוספות ask how was it at all possible for the father to be מקנה the עבד to his son, since after his partner was מפקיר his half the father only retains a קנין הגוף in this עבד (he has no קנין פירות since the חצי עבד no longer works for him), and by קנין הגוף only, one cannot transfer his ownership?!
