1for the betterment of the world, so as not to cause an increase in the theft of sacred Jewish ritual objects in order to sell them for large sums of money.

2GEMARA: Rav Budya said to Rav Ashi that one could infer the following from the mishna: It is for more than their actual monetary value that one may not purchase them; however, for their precise value, one may purchase them. Can one learn from the mishna that with regard to a Torah scroll that is found in the possession of a gentile, one can read from it after obtaining it from the gentile, and there is no concern that perhaps the gentile wrote it and it is unfit? Rav Ashi answered: Perhaps this does not mean that the Torah scroll is purchased in order to read from it, but rather in order to inter it and not to use it; however, it is nevertheless purchased so that it will not be desecrated by the gentiles.

3Rav Naḥman says: We have a tradition that a Torah scroll that was written by a heretic should be burned; a Torah scroll written by a gentile should be interred; a Torah scroll found in the possession of a heretic, and it is not clear who wrote it, should be interred. With regard to a Torah scroll found in the possession of a gentile, some say it should be interred and some say that one may read from it.

4The Gemara asks: With regard to a Torah scroll that was written by a gentile, it is taught in one baraita : It should be burned, and it is taught in another baraita : It should be interred, and it is taught in another baraita : One may read from it. There is a three-fold contradiction concerning the halakha of a Torah scroll written by a gentile.

5The Gemara explains: This is not difficult: That which is taught in a baraita , that it should be burned, is the opinion of Rabbi Eliezer, who says: The unspecified intentions of a gentile are for idol worship, and therefore everything he wrote is assumed to be written for the sake of idolatrous worship and must be burned.

6And that which is taught in a baraita , which said that it should be interred, is the opinion of this tanna , as Rav Hamnuna, son of Rava of Pashronya, taught: A Torah scroll, phylacteries, or mezuzot that were written by a heretic or an informer, a gentile or a slave, a woman or a minor, or a Samaritan or a Jewish apostate, are unfit, as it is stated: “And you shall bind them as a sign on your hand… and you shall write them on the doorposts of your house” (Deuteronomy 6:8–9). From this juxtaposition, one can derive the following: Anyone who is included in the mitzva of binding the phylacteries, i.e., one who is both obligated and performs the mitzva, is included in the class of people who may write Torah scrolls, phylacteries, and mezuzot ; but anyone who is not included in the mitzva of binding is not included in the class of people who may write sacred texts. This baraita equates the halakha of a Torah scroll written by a gentile to the halakha of Torah scrolls written by these other types of people, which are interred.

7And concerning that which is taught in a baraita , i.e., that one may read from it, that baraita is in accordance with the opinion of this following tanna , as it is taught in a baraita ( Tosefta , Avoda Zara 3:6): One may purchase Torah scrolls from gentiles in any location, provided that they are written in accordance with their halakhot . And there was an incident involving a gentile in Tzaidan who would write Torah scrolls, and Rabban Shimon ben Gamliel permitted the Jews to purchase the Torah scrolls from him.

8The Gemara asks: And does Rabban Shimon ben Gamliel require that the preparation of the parchment of Torah scrolls, phylacteries, and mezuzot be for their sake, i.e., for the sake of their use in a mitzva, but he does not require that the writing be for their sake?

9The Gemara quotes the source that Rabban Shimon ben Gamliel requires that the parchment be prepared for their sake: As it is taught in a baraita : If one took phylacteries and coated them with gold or patched them with the skin of a non-kosher animal, then they are unfit. However, if one patched them with the skin of a kosher animal, then they are fit, and this is so even though he did not prepare them, i.e., the skin, for their sake, i.e., for the sake of their use in a mitzva. Rabban Shimon ben Gamliel says: Even if he patched them with the skin of a kosher animal they are unfit, until he prepares them for their sake. Being that he holds that the parchment needs to be prepared for their sake, their actual writing should certainly be done for their sake.

10Rabba bar Shmuel says: That incident in Tzaidan involved a convert who returned to his previous corrupt ways [ suro ] by reverting to living like a gentile. He nevertheless remains a Jew. The Gemara asks: If he returned to his previous corrupt ways all the more so should the Torah scroll be rendered unfit, as he is a heretic. Once he learns the Jewish faith and abandons it, he is considered a heretic. Rav Ashi says: This means that he returned to his previous corrupt ways due to fear, and not because he rejected the Jewish faith. He ceased acting like a Jew out of fear of reprisal. Since he is a Jew, it is permitted for him to read from the Torah scrolls that he writes.

11§ The Gemara clarifies the halakha from the mishna that one may not purchase sacred items from a gentile for more than their actual value. The Sages taught: One may increase payment beyond their value up to a terapa’ik . The Gemara asks: What is a terapa’ik ? Rav Sheshet said: It is an istera , worth one half of a dinar.

12The Gemara relates: There was a certain Arab merchant woman [ taya’ata ] who brought a sack [ ḥayeta ] of phylacteries in front of Abaye. He said to her: Would you give me each pair for a date? She became full of anger, and took the phylacteries and threw them into the river because Abaye offered her such a small amount in exchange for them. Abaye said in remorse: I should not have denigrated the phylacteries so much in her presence, but rather, I should have offered to pay her their actual value.

13MISHNA: A man who divorces his wife due to her bad reputation, i.e., he heard that she had committed adultery, may not remarry her, even if it becomes clear that she did not in fact commit adultery. Similarly, if one divorces his wife due to a vow that she took, and he could not live with her under the conditions of her vow, he may not remarry her. Rabbi Yehuda says: If he divorces her due to any vow that the public was aware of, he may not remarry her, but if he divorces her due to a vow that the public was not aware of, he may remarry her.

14The mishna continues: Rabbi Meir says: If he divorces her due to any vow that requires investigation and dissolution by a halakhic authority, he may not remarry her, but if he divorces her due to a vow that does not require investigation and dissolution by a halakhic authority, and is dissolved even without that, he may remarry her. Rabbi Elazar said: They prohibited him from remarrying her in this case, where she stated a vow that requires dissolution by a halakhic authority, only due to that case, where she stated a vow that does not require dissolution by a halakhic authority.

15Rabbi Yosei, son of Rabbi Yehuda, said: There was an incident in Tzaidan involving one man who said to his wife: It is konam , i.e., it is forbidden like an offering, if I do not divorce you, and he divorced her; and the Sages permitted him to remarry her for the betterment of the world.

16GEMARA: Rav Yosef bar Minyumi says that Rav Naḥman says: And the halakha stated in the mishna, which says that in certain cases a man who divorces his wife may not remarry her, is only applicable when he said to her explicitly: I am removing you from the house due to your bad reputation,

    Tosafot

אמרי לה קורין בו‎—Some say we read in it O VERVIEW The גמרא cited a dispute regarding a ספר תורה which was found in the possession of a נכרי, whether we may read from it or not. There is a dispute between רש"י and תוספות how to explain the reason of the one who maintains that it is permitted to read from it. ---------------------------- פירש בקונטרס דהוה ליה ספק ספיקא דשמא ישראל כתבו‎ – רש"י explained the reason for קורין בו is because it is a doubt within a doubt; for perhaps a ישראל wrote it, and then it is surely כשר‎ – ואפילו כתבו עובד כוכבים שמא כתבו למכור לישראל ולא לשם עבודת כוכבים‎ – And even if a נכרי wrote it, perhaps he wrote it with the intent to sell it to a Jew (which would [still] make it כשר), but he did not write it for the sake of ע"ז (which would have made it unfit to use). תוספות disagrees: ואין נראה דרב נחמן קאמר כתבו עובד כוכבים יגנז והיינו אפילו כתבו למכור לישראל‎ – And this explanation of רש"י does not appear to be correct, for ר"נ ruled that if a נכרי wrote a ס"ת it should be interred, and that means even if he wrote it with the intent of selling it to a ישראל; we know this is so – דלקמן מפרש טעמא משום כל שאינו בקשירה אינו בכתיבה – For later the גמרא explains the reason why by כתבו נכרי the rule is יגנז, because whoever is not fit to tie תפילין on himself (a נכרי) is not fit to write תפילין and ס"ת, etc. תוספות offers his interpretation: אלא טעמא דאמרי לה קורין בו משום דאיכא למתלי טפי שישראל כתבו‎ – Rather the reason for those who say קורין בו is because it is more likely that a ישראל wrote the ס"ת, than that a נכרי wrote it – דאין דרך עובד כוכבים לכתוב: Since it is not usual for a נכרי to write a ס"ת. S UMMARY One may read from a ס"ת which is in the possession of a נכרי, either because it is a ספק ספיקא (according to רש"י) or because it is more likely that a ישראל wrote it (תוס'). T HINKING IT OVER The dispute whether קורין בו or not, is that regarding reading it בצבור, however ביחיד all agree that קורין בו, or is the מחלוקת even (only) by a יחיד‎?

והא דתניא יגנז האי תנא הוא‎—And this which was taught that it should be interred; it is this Tannah O VERVIEW The גמרא cites the ברייתא, which was taught by רב המנונא, as the תנא who maintains that a ס"ת שכתבו נכרי יגנז (because כל שאינו בקשירה אינה בכתיבה). Our תוספות explains why the גמרא chose this source. ------------------------------ תוספות responds to an anticipated difficulty: הוה מצי למימר דרבן שמעון בן גמליאל הוא דבעי כתיבה לשמה כדאמר בסמוך – The גמרא could have said that the ברייתא which maintains that a ס"ת שכתוב נכרי יגנז is according to רשב"ג who requires that the writing of כתבי קודש be לשמה, as the גמרא states shortly – תוספות responds: אלא מייתי תנא דאיירי בה בהדיא: The גמרא would rather cite a תנא, who is discussing explicitly the case of a ס"ת שכתבו נכרי that it is פסול (and therefore יגנז). S UMMARY It is preferable to cite an anonymous source which is dealing directly with the subject matter, than a specific source which is discussing a tangential issue. T HINKING IT OVER Are the reasons why ס"ת שכתבו נכרי יגנז, the same according to the ברייתא cited by רב המנונא and רשב"ג, or is there a difference?

כל שישנו בקשירה ישנו בכתיבה‎—Whoever is included in tying is included in writing O VERVIEW The תורה writes; וּקְשַׁרְתָּם לְאוֹת עַל יָדֶךָ וְהָיוּ לְטֹטָפֹת בֵּין עֵינֶיךָ‎. ט וּכְתַבְתָּם עַל מְזוּזֹת בֵּיתֶךָ וּבִשְׁעָרֶיךָ‎. We derive from these פסוקים that only one who is מחוייב בקשירה (excluding a נכרי) can be included in וכתבתם, to write (פרשיות of) the תורה‎. Our תוספות discusses the possibility of expanding this rule. ------------------------------ מכאן אומר רבינו תם דאין אשה אוגדת לולב ועושה ציצית כיון דלא מיפקדה – The ר"ת derives from the גמרא here that a woman may not tie up the לולב or make the ציצית, since she is not commanded to observe the מצות of לולב or ציצית‎. תוספות disagrees: ואין נראה דהא מדפסלינן בריש התכלת (מנחות דף מב, ב) ציצית בעובד כוכבים‎ – And the ר"ת does not appear to be correct, for since in the beginning of פרק התכלת, we invalidate a נכרי from making ציצית‎ – דדריש בני ישראל ועשו ולא בעובדי כוכבים מכלל דאשה כשרה‎ – Because we expound the פסוק that בני ישראל ועשו (the Jews make ציצית), but not the נכרים, we can infer from this דרשה that a woman is fit to make ציצית‎ – ואמרינן נמי סוכת גנב"ך כשרה בפרק קמא דסוכה (דף ח, ב) – And the גמרא in the first פרק of מסכת סוכה also states the סוכת גנב"ך is כשרה‎ – ודוקא בספר תורה ותפילין ומזוזות דכתיב וקשרתם וכתבתם דרשינן הכי: And it is specifically only by ס"ת and תפילין and מזוזות where it is written וקשרתם וכתבתם that we expound it in this manner דכל שאינו בקשירה אינו בכתיבה, but not by other מצות‎. S UMMARY Woman may tie the לולב and make ציצית (not like the ר"ת ruled); it is only by סת"ם that women are ineligible to write them. T HINKING IT OVER When the ר"ת prohibited women from making ציצית, did he mean that they can spin the wool to make ציצית, but they are not permitted to put the ready made ציצית into the garment, or are they also prohibited from spinning the wool for making ציצית‎?

עיבוד לשמן בעי כתיבה לשמן לא בעי‎—Processing Lishmon is required; writing Lishmon is not required?! O VERVIEW The גמרא cited a contradiction between two rulings of רשב"ג. In one ברייתא he rules that one may buy a ס"ת which a נכרי wrote (indicating that we do not need כתיבה לשמה [for presumably the נכרי is not writing לשמה]), while in another ברייתא we find that רשב"ג requires that the עיבוד העורות must be לשמה‎. The גמרא asks if רשב"ג requires the עיבוד לשמה, he should certainly require that the כתיבה be לשמה‎. Our תוספות has a difficulty with this question. תוספות asks: קשה דלמא כתיבה לשמן ודאי לא בעי דמסתמא לשמן קאי – There is a difficulty; perhaps we do not require that the כתיבה be explicitly לשמה, for presumably a ס"ת is written לשמה‎ – אבל סתם עיבוד עורות לאו לתפילין קיימי‎ – However curing hides generally are not intended to be used for תפילין, therefore רשב"ג requires that the עיבוד be specifically לשמה‎ – תוספות anticipates and rejects a possible solution to his question: ולא מסתבר דפריך מעיבוד לעיבוד דמדקאמר כתיבה לשמן לא בעי משמע דמכתיבה פריך: And it is not logical to assume that the גמרא is asking a contradiction from one rule regarding עיבוד (that לשמה is not required) to the other ruling regarding עיבוד (where לשמה is required); we cannot assume that, since the גמרא states ‘do we not require כתיבה לשמה’; this indicates that he is asking from the ruling regarding כתיבה on the ruling of עיבוד (but not from עיבוד לעיבוד), so the question remains that by כתיבה we perhaps do not require an explicit לשמה‎! S UMMARY There is seemingly no contradiction for כתיבה is סתמא לשמה, however by עיבוד עורות it is סתמא לא לשמה, therefore we require עיבוד לשמה‎. T HINKING IT OVER Why indeed did the גמרא not ask מעיבוד לעיבוד as תוספות suggested?!

עד שיעבדם לשמן‎—Until he processes them for its purpose O VERVIEW The ברייתא cited the view of רשב"ג than even the hides of בהמות טהורות must be processed לשמן in order to be able to write סת"ם on them. ---------------------------- כרבן שמעון בן גמליאל קיימא לן דבעי עיבוד לשמה כדמוכח בהנזקין (לקמן דף נד, ב) – We establish the ruling like רשב"ג that the hides must be processed לשמה, as is evident in פרק הנזקין, where it states – דההוא דאתא לקמיה דרבי אבהו אמר ליה ספר תורה שכתבתי גוילין שלו לא עבדתים לשמן‎ – That there was that person who came before ר"א and said to him; ‘I did not process לשמה the parchment on which I have written a ס"ת’ – ומסיק דנאמן אתה להפסיד שכרך ואין אתה נאמן להפסיד ספר תורה‎ – And the גמרא concludes there that ר"א told him, ‘ you are believed to lose your payment, but you are not believed to ruin the ס"ת – תוספות anticipates a difficulty: והא דאיפליגו אביי ורבא בפרק נגמר הדין (סנהדרין דף מח, ב) בהזמנה אי מילתא היא – And regarding the dispute between אביי ורבא in פרק נגמר הדין, whether ‘preparation’ is significant, or not – ומוקי התם פלוגתייהו בפלוגתא דרבן שמעון בן גמליאל ורבנן‎ – And the גמרא there established that the dispute between אביי ורבא is dependent on the dispute between רשב"ג ורבנן regarding עיבוד לשמה; the explanation there – לא כמו שפירש שם בקונטרס דאביי דאמר מילתא היא כרבן שמעון בן גמליאל‎ – Is not like רש"י explained it there that אביי who maintains הזמנה מילתא היא is according to רשב"ג – דבעי עיבוד לשמן – Who requires עיבוד לשמן‎ – דאם כן קשיא הלכתא אהלכתא דקיימא לן כרבא לגבי אביי בר מיע"ל קג"ם – For if indeed it would be as רש"י interprets it there would be a contradiction from one ruling on another ruling, for we always follow רבא against אביי except for their disputes in יע"ל קג"ם, and we also rule like רשב"ג – תוספות offers his explanation of אביי ורבא בפלוגתא דרשב"ג ורבנן: אלא מפרש רבינו תם דאביי כרבנן דלא בעי עיבוד לשמן דסגי בשאר הזמנות‎ – Rather, explains the ר"ת that אביי follows the רבנן, who do not require עיבוד לשמן, for the other preparation are sufficient to make it לשמן‎ – שמתקנין הקלפים ומשרטטין אותם לשמן כיון דהזמנה מילתא היא – For we prepare the parchment and score it לשמן, that is sufficient since הזמנה מילתא היא‎ – ורבא כרבן שמעון בן גמליאל דבעי עיבוד לשמן ולא הזמנה מועטת – However רבא follows רשב"ג who requires a total עיבוד לשמן, but not a minimal preparing since הזמנה לאו מילתא היא‎. תוספות anticipates an additional difficulty: ואף על גב דאמרינן בהתכלת (מנחות דף מב, ב) דרב כרבנן ושמואל כרבן שמעון בן גמליאל‎ – And even though the גמרא in פרק התכלת states that רב is according to the רבנן (who do not require עיבוד לשמן) and שמואל is according to רשב"ג (who requires עיבוד לשמן) – והלכתא כרב באיסורי – And we know that the ruling is like רב in איסור laws against שמואל‎. Seemingly we have here a situation of קשיא הלכתא (כרב) אהלכתא (כרשב"ג)! תוספות responds: הכא הלכתא כשמואל‎ – Here, regarding the laws of עיבוד לשמן, the ruling is like שמואל, not like רב‎ – תוספות anticipates a difficulty: ואף על גב דאמר ליה התם אביי לרב שמואל בר יהודה האי תכלתא היכי צבעיתו לה‎ – And even though that אביי there said to רשב"י, ‘how do you dye the תכלת’ – אמר ליה מייתי לן דם חלזון וסמנים ורמינן לה ביורה ושקלינן פורתא בביעתא‎ – רשב"י answered him, ‘we bring the blood of the חלזון and herbs (for dying) and we place it in a pot, and boil it, and we take some of the dye in an egg shell – וטעמינן לה באודרא ושדינן לההיא ביעתא וקלינן להאי אודרא בנורא – And we test it by dyeing a piece of wool and we throw away that egg with the dye that is inside it and we burn the wool in fire – משמע דבעינן צביעה לשמן – It is apparent that we require that the dyeing of תכלת be לשמן‎ – תוספות responds: צריך לומר דאביי לא קיבלה דאיהו לא בעי לא עיבוד ולא טוייה ולא צביעה לשמן : It will be necessary to say that אביי did not accept what רשב"י told him about making תכלת, for according to אביי there is no requirement of לשמה neither by עיבוד of the hides, nor by spinning of ציצית, and not by dyeing of תכלת‎. S UMMARY תוספות rules that the הלכה is like רשב"ג that we require עיבוד לשמה (and it is in accordance with רבא who maintains הזמנה לאו מילתא היא). T HINKING IT OVER תוספות had two contradictions of הילכתא אהילכתא; one concerning רבא, and the other concerning רב‎. Regarding the רבא contradiction, תוספות remained adamant that the הלכה is like רבא (and not like אביי), however regarding the רב contradiction תוספות simply said that here the הלכה is not like רב, contrary to the rule of הלכתא כרב באיסורי‎. Why the difference in these two cases?

מעלין בדמיהן עד כדי טרפעיק‎—We increase their value up to a Tarp’ik O VERVIEW The ברייתא stated that even though we are not supposed to redeem things (from נכרים) for more than their value, nevertheless we can pay up to a טרפעיק more in order to redeem them. There is a dispute between רש"י and תוספות as to what we are redeeming for an extra טרפעיק‎. ------------------------------- מתוך פירוש הקונטרס משמע דקאי גם אספרים‎ – From the content of sרש"י' explanation it seems that this ruling applies also to ספרי תורה‎ – וקצת תימה דאיך משוה הש"ס ספרים שדמיהן יקרים‎ – And it is slightly puzzling how the גמרא can compare ס"ת, which are expensive – להעלות כדי טרפעיק כמו בתפילין ומזוזות – To raise the payment only up to a טרפעיק, just like תו"מ, which cost much less – לכך נראה דקאי אתפילין ומזוזות: Therefore it seems to תוספות that this addition of only a טרפעיק is regarding תו"מ, however for a ס"ת it would be a greater amount. S UMMARY According to רש"י even for a ס"ת one may pay up to a טרפעיק more, however according to תוס' the addition of (just) a טרפעיק is regarding תו"מ only. T HINKING IT OVER Seemingly תפילין are more expensive than מזוזות, so why is תוספות agreeing that we are מעלה the same טרפעיק for both תפילין and מזוזות‎?!
