    Gittin 27b

    Chapter 3 - Kol HaGet

    English translation - Gittin 27b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1when the husband admits that he wrote it, in any event he should return it to the woman, and by omission this appears to be the halakha even if a long time has passed since the bill of divorce was lost. And Rabbi Zeira answers: Here, in the mishna where it states that he should not return it, it is stated with regard to a place where caravans are frequently found; there, in the baraita where it states that he should return it, it is stated with regard to a place where caravans are not frequently found.

2The Gemara compares the rulings of Rabba and Rabbi Zeira. There are those who say with regard to Rabbi Zeira’s statement that he should not return it in a place where caravans are frequently found: And this is the case when it is established that there are two people in the town with the identical name. In that case, Rabbi Zeira holds that it should not be returned, and this is the same ruling as that of Rabba. And there are those who say: In a place where caravans are frequently found, even though it is not established that there are two people with identical names, it should not be returned, and he disagrees with the ruling of Rabba.

3The Gemara clarifies: Granted that Rabba did not say a discourse like that of Rabbi Zeira and raise a contradiction from the baraita , as he holds that it is a stronger challenge to raise a difficulty from the mishna in tractate Bava Metzia because the Mishna, redacted by Rabbi Yehuda HaNasi, employs more precise language than baraitot . But what is the reason that Rabbi Zeira did not say a discourse like that of Rabba and raise a contradiction from the mishna in tractate Bava Metzia ?

4The Gemara answers: Rabbi Zeira could have said to you: Does the mishna teach that if he said: Give the found document to the intended recipient, one gives it, and this is so even if a long time passed? This was only an inference from the mishna. Perhaps the mishna should be interpreted differently, so as to teach: If he said: Give it, then one gives it, but this is only as we maintain in the mishna, when it is found immediately, not if a long time has passed.

5The Gemara offers an alternative resolution to the contradiction between the mishna here, on the one hand, and the mishna in tractate Bava Metzia and the baraita , on the other hand. Rabbi Yirmeya said: It is possible to resolve the contradiction in a different way: The latter permit one to return a lost bill of divorce only in a case where the witnesses who signed the bill of divorce say: We have never signed a bill of divorce of Yosef ben Shimon other than this one, in which case there is no concern that the bill of divorce belongs to someone else.

6The Gemara asks: If that is so, what is the purpose of stating that one returns the bill of divorce? Since it clearly belongs to her, there is no question that it must be returned to her. The Gemara answers: It is necessary lest you say that one should be concerned that perhaps it happened that another bill of divorce was written in which the names of the husband and the wife are identical to the names of the husband and wife of the second bill of divorce, and the names of the witnesses on that bill of divorce are identical to the names of the witnesses on this bill of divorce, when in fact they are different witnesses. Therefore, the mishna teaches us that this is not a concern.

7The Gemara suggests an alternative resolution to the contradiction. Rav Ashi said: When do the mishna in tractate Bava Metzia and the baraita rule that one should return the bill of divorce? It is in a case where the one who lost it says: There is a hole in the bill of divorce, next to such and such a letter, as this is a clear-cut distinguishing mark for him. The Gemara comments: And Rav Ashi permits the returning of such a bill of divorce specifically when one says that the hole is next to such and such a letter, as that is a clear-cut distinguishing mark for him. But if he said only that it had a hole without mentioning its precise location, then one should not return the bill of divorce, as that is not considered a clear-cut distinguishing mark.

8The Gemara explains: Rav Ashi is uncertain with regard to whether the obligation to return a lost item to its owner on the basis of distinguishing marks is by Torah law or if it is by rabbinic law. Therefore, in the case of a bill of divorce, he holds that one may rely only on a clear-cut distinguishing mark, as everyone agrees that the requirement to return a lost item to its owner on the basis of a clear-cut distinguishing mark is by Torah law.

9Apropos this discussion the Gemara relates an incident: Rabba bar bar Ḥana lost the bill of divorce that he was transmitting, when he was in the study hall. He said: If they request a distinguishing mark, I have one for it. If it depends on visual recognition, I have methods of recognition for it. They returned the bill of divorce to him. He said afterward: I do not know if they returned it due to the distinguishing mark that I supplied, and they hold that distinguishing marks are used to return lost items by Torah law, or if it was due to my visual recognition, and it is specifically Torah scholars [ tzurva miderabbanan ] like me who are relied upon when they say that they recognize an item, but an ordinary man would not be relied upon to recognize the item and have it returned to him.

10§ The mishna teaches that if one found the bill of divorce immediately, it is valid, but if not, then it is invalid. The Sages taught: What is considered not immediately? Rabbi Natan says: It is when there was a delay equivalent to the amount of time it would take for a caravan to pass by and camp there. Rabbi Shimon ben Elazar says: There is no fixed amount of time; rather, it is within the category of immediately as long as there will be a person that stands and sees that no other person passed there. And some say that he said: It is as long as no person stopped there. Rabbi Yehuda HaNasi says: It is within the category of immediately if there was not a delay equivalent to the amount of time it would take to write the bill of divorce. Rabbi Yitzḥak says: It is equivalent not to the amount of time needed write the bill of divorce, but equivalent to the amount of time it would take to read it. Others say: It is equivalent to the amount of time it would take to write it and to read it.

11The Gemara adds: And even if there was a delay and the bill of divorce has distinguishing marks on it, the marks attest to it and it is considered a valid bill of divorce. This is the halakha where the distinguishing marks are clear-cut, e.g., when they say: It has a hole next to such and such a letter. And one may not testify with regard to distinguishing marks of the physical description of the bill of divorce itself, e.g., where they say: This bill of divorce is long or short, as these are not considered distinguishing marks.

12In a case where one found a bill of divorce tied up in a pouch or in a purse [ arnaki ], or encircled in a ring, and he recognizes the document,

בזמן שהבעל מודה יחזיר לאשה ואפילו לזמן מרובה‎—In a time where the husband admits, it should be returned to the woman; and even after an extended period O VERVIEW ר' זירא inferred from the ברייתא (which stated בזמן שהבעל מודה יחזיר לאשה) that it can be returned even if it was lost לזמן מרובה‎. This seemingly contradicts our משנה (of המביא גט) which stated that we only return it לאלתר, but not לזמן מרובה‎. Our תוספות clarifies this question. --------------------------------- תוספות asks: ואם תאמר כיון דבעל שאמר גרשתי את אשתי נאמן והוא מודה שגירשה‎ – And if you will say; since the rule is that a husband who said, ‘I divorced my wife’ is believed, and in the ברייתא he admits that he divorced her, therefore – אפילו אין הגט שלה ניתן לה לראיה בעלמא ומאי פריך – Even if the גט is not hers (it belongs to another יב"ש), nevertheless we should give it to her just for proof, so what is the sגמרא' question?! תוספות answers: ויש לומר דלא מהימן אלא מכאן ולהבא מיגו שיכול עכשיו לגרשה‎ – And one can say that a husband is not completely believed that he divorced his wife, rather he is only believed that she is divorced regarding her status from now on, since he can divorce her now if he chooses, therefore we believe him as of now – ולא תטרוף פירות אלא מכאן ואילך‎ – So therefore she cannot reclaim the פירות, only from now onwards – אבל למפרע לא כשאומר גירשתיה מזמן הכתוב בגט כדאמרינן ביש נוחלין (בבא בתרא קלד, ב) – However he is not believed retroactively when he claims, ‘I divorced her from the date which is written in the גט’, as the גמרא states in פרק יש נוחלין‎ – והכא שידוע לנו שלא בא לידה עכשיו זה הגט בתורת גירושין‎ – And here where it is known to us that the גט did not come into her possession now, in a divorce process, therefore – אינו נאמן מכאן ולהבא יותר מלמפרע – He is not believed for the future any more than for the past – ויחזיר לאשה דקתני היינו בעדים ותתגרש בחזרה זו אפילו לא נתגרשה עדיין‎ – So when the ברייתא states ‘it should be returned to the wife’, it means with witnesses and she becomes divorced through this returning of the גט to her now, even though she was not divorced as of yet – ולא חיישינן שמא מאחר נפל אפילו לזמן מרובה: And we are not concerned perhaps this גט was lost from another יב"ש, even if it was found לזמן מרובה; this contradicts our משנה which states that we only return לאלתר, but not לזמן מרובה‎. S UMMARY The rule of בעל שאמר גרשתי את אשתי נאמן is only for the future but not for the past. T HINKING IT OVER In יש נוחלין there is a dispute in the case where the husband claims he divorced her in the past, whether he is believed מכאן ולהבא even though he is not believed for the past. According to the opinion that he is believed for the future, the question of תוספות seemingly remains; how can we compare the two cases, since in our case the husband is believed מכאן ולהבא‎?!

מעולם לא חתמנו אלא על גט אחד של יוסף בן שמעון‎—We never signed, only on one Get of Yosef ben Shimon O VERVIEW ר' ירמיה explained that the ברייתא which states that בזמן שהבעל מודה יחזיר לאשה even לזמן מרובה (seemingly contradicting our משנה), is in a case where the עדים testify that they only signed on one גט, which has this name of יוסף בן שמעון‎. Our תוספות explains how this removes the concern that perhaps this is not the correct גט‎. ---------------------- מתוך הלשון משמע שיודעין שלא חתמו אלא על א' – It seems from the language the גמרא uses (מעולם לא חתמנו אלא על גט א' של יב"ש) that the witnesses know that they only signed on one גט of יב"ש – אבל אין מכירים מי הוא אותו יוסף בן שמעון – However they do not recognize who is this יב"ש; whether it is the man who is standing before us or someone else – תוספות asks: ותימה דאם כן אמאי מהימנין ליה לומר שהוא שלו יותר משלא היו אומרים העדים כלום‎ – And it is astounding! For if indeed it is so (that the עדים are unsure if this person is the יב"ש for whom they signed), why do we believe the husband to say that this גט is his (with which he divorced his wife), any more that if the עדים would have said nothing, where in which case – שלא היה נאמן לומר שהוא שלו ולא מהדרינן ליה בטביעות עין‎ – He would not have been believed that it is his גט and we would not have returned it to him based on his recognition of the גט; the reason for this is – דחיישינן שמא הוא משקר – Because we are concerned that perhaps he is lying, so what difference does it make that the עדים say that they only signed on one גט, but perhaps the גט they signed on, was not for this husband (even though it is this גט), so how can we return it and have him divorce his wife with this גט‎?! תוספות answers: ואומר רבינו יצחק דלעולם לא חשדינן ליה שישקר במזיד לומר שהוא שלו לקלקלה – And the ר"י says that we never suspect the husband that he is purposefully lying by saying, it is his גט, in order to ruin her – דמשום להרויח פשיטי דספרא לא היה מקלקלה‎ – For he would not ruin her (even) on account of the few coins to pay the scribe; we know this is true – דהא בעל שאמר גירשתי את אשתי נאמן ולא חיישינן להכי‎ – For a husband who claims ‘I divorce my wife’ is believed, and we are not concerned for this that he intends to ruin her – ולהכי כשאומרים העדים שלא חתמו אלא על גט אחד והוא אומר שעל שלו חתמו נאמן – So therefore when the witnesses say they only signed on one גט and he says they signed on his גט, he is believed – אבל כשאין העדים אומרים כלום חיישינן שמא הוא סבור שהוא שלו‎ – However when the עדים do not say anything, we do not believe him (but not because we think that he is purposefully lying, but rather) we are concerned that perhaps he thinks it is his גט‎ – לפי שאין יודע שיש יוסף בן שמעון אחר או יודע ואין נראה לו לחוש שגם הוא אבד גט‎ – Because he does not know of any other יב"ש, or perhaps he knows but it does not appear to him to be concerned that the other יב"ש also lost a גט‎ – ולכך אומר שהוא מכיר אף על פי שאינו מכיר‎ – Therefore he says he recognizes the גט, even though truthfully he does not recognize it. In summation; in the question תוספות assumed the reason he is not believed (without the עדים) is because we are concerned that he is lying on purpose. In conclusion we say that a person will not lie and ruin his wife’s life, but rather he is not believed because he may be mistaken and assume it is his גט, however when the עדים say that they only signed once we are certain that it is his גט‎. תוספות offers sרש"י' interpretation: ובקונטרס פירש כגון דקאמרי עדים החתומים בו‎ – And רש"י explained the answer to mean, for instance the witnesses who signed the גט, state – מעולם לא חתמנו אלא על גט א' של שם זה ואותו חתמנו לאיש זה התובעו – We never signed on any other גט with this name, and that one which we signed was for this man who is demanding it – ולפי זה צריך לומר שלא ראו עדים חתימת הגט – And according to this interpretation of רש"י it will be necessary to say that the witnesses did not see the signatures on the גט‎ – שאם ראו ואומרים שהוא כתב ידם ולזה חתמו פשיטא שיחזיר ולא היה צריך להשמיענו – For if they saw the signatures and they say it is their handwriting, and they signed the גט for this person, it is obvious that it should be returned and it was not necessary for the ברייתא to teach this to us – דהא ודאי לא חיישינן דלמא איתרמי שמא כשמא ועדים כעדים וחתימה כחתימה – For we are certainly not concerned that perhaps it happened that the names (of the couples) were similar and the names of the witnesses were similar, ‘and the signatures were similar’; that is too far-fetched – ובשינויא נמי אינו מזכיר חתימה כחתימה: And in the sגמרא' answer (why it is not פשיטא according to ר' ירמיה) no mention is made that the signatures are similar, because that is preposterous! Therefore we must conclude according to פרש"י that the עדים did not see the signatures. S UMMARY People do not lie and mess up their wives by claiming that they were divorced when they were not. T HINKING IT OVER 1. Did the עדים see the signatures according to פירוש התוספות‎? 2. תוספות previously stated that we know for a fact that this יב"ש lost a גט‎. Can our תוספות agree with that תוספות and still have a question why the גט is returned?

כגון דקאמר נקב יש בצד אות פלונית‎—For instance that he said, there is a hole on the side of that letter O VERVIEW רב אשי established the משנה and ברייתא, which state that we return a גט even לזמן מרובה, in a case where a סימן was given that there is a נקב בצד אות פלוני‎. Our תוספות discusses who gave the סימן and under what circumstances. ---------------------------- פירש בקונטרס דקאמר השליח אית ספרים דגרסי דקאמרי עדים‎ – רש"י explained that the שליח said this סימן‎. In some texts it reads that the עדים gave the סימן‎ – ויש לומר דעדים מהימני אפילו כשראוהו כבר ושליח לא מהימן אלא כשאומר כן קודם שראהו: And one can say that עדים are believed even if they already saw the סימן (after the גט was found) and they are merely testifying that the גט they signed had this סימן; however a שליח is not believed unless he gives the סימן before he saw it. S UMMARY עדים may verify the סימן even after they saw it, but the שליח must give the סימן before he sees it. T HINKING IT OVER Why does no one say that the husband offered the סימן (after all the ברייתא states בזמן שהבעל מודה)? What would be the status of the בעל testifying; is he like the שליח (who has to state it before he sees it) or is he like the עדים (sinceאינו חשוד לקלקלה במזיד) and he can state it even after he sees it?

סימנין דאורייתא או דרבנן‎—Identifying signs; is it Torah or Rabbinic O VERVIEW The גמרא states that רב אשי was unsure regarding the rule that we return a lost object based on סימנין; whether that is a תורה law or a rabbinic law. -------------------------------- אי סימנין דרבנן הא דמהדרינן אבדה מן התורה היינו בעדים‎ – If we assume that סימנין דרבנן, this that we return a lost object מה"ת that is only with witnesses, who testify that this object belongs to this claimant – ורבנן הוא דעבוד במציאה תקנתא להחזיר בסימנין‎ – However, it is the רבנן who made an enactment by a found object to return it even with סימנין, although there are no עדים‎. תוספות asks: ואם תאמר והא דתנן בפרק אלו מציאות (בבא מציעא דף כז, א) דדבר שיש בו סימן חייב להכריז‎ – And if you will say; and this which the משנה taught in פרק אלו מציאות, that an object which has a סימן, one is obligated to announce it – ושאין בו סימן הרי אלו שלו ואפילו מדרבנן‎ – But if it has no סימן, it belongs to the finder, even מדרבנן; the question is – למה הוא שלו יכריז וזה יביא עדים דמן התורה מה לי זה ומה לי זה – Why can the finder keep it; let him announce it, and the owner will bring witnesses, for מה"ת what difference is there whether or not it has סימנין, for – כיון דבעי עדים כך ימצא עדים בזה כמו בזה‎ – Since מה"ת we require עדים to return it, he will find witnesses where there is no סימן, just as he will find witnesses when there is a סימן‎?! תוספות answers: ויש לומר דעל ידי סימן מכירים העדים בטביעות עין – And one can say that through the סימן, the עדים recognize that it belongs to the owner by טביעות עין‎ – תוספות offers an additional answer: ועוד דעל ידי סימן שואלים אם יש שמכיר אותו דבר שיש בו סימן כך וכך‎ – And furthermore through the סימן, people ask around if there is someone who recognizes that object which has this particular סימן‎ – דעל ידי כך ימצא עדים אבל כשאין בו סימן אין יודע היאך לישאל ומתייאש: So that through mentioning the סימן, witnesses will be found, however when it does not have a סימן, he does not know how to ask, so he gives up hope, and therefore the finder may keep it. S UMMARY The עדים remember better when there is a סימן and people ask around more if there is a סימן, otherwise the owner is מתייאש from finding עדים‎. T HINKING IT OVER 1. If we maintain סימנין דרבנן, will a סימן מובהק be sufficient מה"ת to return an אבידה‎? 2. Why cannot תוספות ask the same question even if we maintain סימנין דאורייתא; we should have to announce every item even if it does not have a סימן, because perhaps he will find עדים to identify it as his?

ודוקא צורבא מדרבנן‎—And it is specifically a rabbinic student O VERVIEW The גמרא qualifies the ruling the ruling of returning a lost object with טביעת עין alone, that it applies only to a צורבא מדרבנן, but not to an ordinary person. -------------------------------- אומר רבינו תם דעם הארץ נמי ידע בטביעות עינא‎ – The ר"ת says that an עם הארץ also recognizes with טביעות עין‎ – כדאמרינן בפרק גט פשוט (בבא בתרא דף קסח, א) האי צורבא מדרבנן דאזיל לקדושי איתתא‎ – As אביי stated in פרק גט פשוט, ‘this צורבא מדרבנן who is going to marry a woman – לידבר עם הארץ בהדיה – Should bring an עם הארץ with him’ – ובפרק גיד הנשה (חולין דף צו, א) נמי מוכח דכולי עלמא אית להו טביעות עינא‎ – And in פרק גיד הנשנה it is also evident that everyone has טביעות עין, not only a צורבא מדרבנן והא דלא מהדרינן לעם הארץ בטביעות עינא משום דלא מהימן: And the reason we do not return a lost object to an עם הארץ with טביעות עין alone, but rather require a סימן, is because he is not believed when he says, ‘this is mine, I recognize it’, but not because he has no טביעות עין‎. S UMMARY Everyone has טביעות עין; however it is only a צורבא מדרבנן who is believed. T HINKING IT OVER Will we return a גט to the woman, if the husband who is an ע"ה, claims he recognizes it with טביעות עין (since תוספות taught us previously that אינו חשוד לקלקה במזיד)?

איזהו שלא לאלתר‎—What is considered not immediately O VERVIEW The גמרא asked; what is the amount of time needed to be considered not immediately, and various תנאים gave different answers. And there are other texts that read; איזהו לאלתר (what is considered immediately). And we can fit the words of the תנאים (who explain the meaning of לאלתר or שלא לאלתר) according to both גרסות‎. S UMMARY We are גורס either שלא לאלתר or לאלתר and the corresponding views of the תנאים‎. T HINKING IT OVER 1. Is there any advantage in one גירסא over the other? 2. What can we infer from the words of the תנאים (in the גירסא of our גמרות) as to which גירסא is the correct one?

שתעבור שיירא ותשרה‎—That a caravan should pass by and camp there O VERVIEW ר' נתן ruled that ‘not immediately’ is considered if enough time elapsed for a caravan to pass by and camp there. תוספות offers an alternate translation of ותשרה‎. -------------------------------- מפרש רבינו תם ותשרה לשון סעודה כמו שירותא (תענית דף יא, ב) – The ר"ת explained that the word 'ותשרה' refers to a meal like the word שירותא‎ – דמתוך שמוציאים כליהם כדי לסעוד חיישינן שמא נפל מהם: For since they take out their utensils in order to dine, it is possible that perhaps the גט fell from them. S UMMARY תשרה means either camped or dining. T HINKING IT OVER What are the advantages of the respective translations?

מצאו קשור בכיס או בארנקי כולי‎—He found it tied to a pouch or a purse, etc. O VERVIEW The ברייתא teaches that if one found a גט (which he lost) tied to a pouch, etc. it is a valid גט‎. Our תוספות discusses whether we can derive from this that סימנין דאורייתא‎. --------------------------------- בפרק בתרא דיבמות (דף קכ, א) מדקדק מכאן דסימנין דאורייתא – In the last פרק of מסכת יבמות, the גמרא infers from this ברייתא that סימנין דאורייתא‎ – תוספות asks: ותימה דבפרק אלו מציאות (בבא מציעא דף כז, א) איבעיא לן אי סימנין דאורייתא או דרבנן‎ – And it is astounding for in פרק אלו מציאות, the גמרא queries whether סימנין are דאורייתא or דרבנן‎ – ולא מייתי לה‎ – And the גמרא in ב"מ does not cite this ברייתא which proves that סימנין דאורייתא‎?! תוספות answers: ואומר רבינו יצחק דבמסקנא דיבמות דמייתי תנאי ומסיק דכולהו סברי דסימנים דרבנן‎ – And the ר"י says that in the conclusion of the גמרא in יבמות, he cites תנאים (who seemingly disagree whether סימנין דאורייתא or דרבנן) and the גמרא concludes there (in the איכא דאמרי) that all the תנאים maintain סימנין דרבנן; according to that מסקנא‎ – איכא לפרושי דהך ברייתא נמי סברא הכי וכגון שיש עדים שהכיס והטבעת שלו – We can explain that this ברייתא also maintains that סימנין דרבנן and for instance there are witnesses that the pouch or the ring were his (the person who lost the גט) – או שמצאו בעצמו ומכיר שהן שלו ונאמן במיגו דאי בעי אמר לא אבדתי‎ – Or that the person who lost it found it himself and he recognizes it that they belong to him, and he is believed with a מיגו, for he could have said I never lost it – תוספות responds to an anticipated difficulty: ומעיקרא דהוה בעי למידק מינה דסימנין דאורייתא‎ – And initially when the גמרא wished to infer from this ברייתא that סימנין דאורייתא‎ – הוה משמע ליה דאיירי כשמצאו אחר ומהדרינן ליה על ידי סימן זה: It seemed to the גמרא that the ברייתא is discussing a case where someone else found it (not the loser), and we return it to the owner through this סימן (and not through עדים), therefore we can infer that סימנין דאורייתא, but in truth it can be either that he found i t himself or עדים testify. S UMMARY If the ברייתא of מצאו קשור בכיס is in a case where another found it and it was returned based on סימנין, we can derive that סימנין דאורייתא, however it may be where the owner found it, or עדים testify (regarding the כיס) in which case we can maintain סימנין דרבנן‎. T HINKING IT OVER Is מצאו קשור בכיס וכו' a case of סימן מובהק or not?
