    Gittin 36b

    Chapter 4 - HaSholeach

גם: גיטין דף ל״ו ע״ב, פרק ד׳ השולח

    English translation - Gittin 36b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1And the Sages instituted that despite this, the Sabbatical Year still will abrogate debt in the present, in remembrance of the Torah-mandated Sabbatical Year. Hillel saw that the people of the nation refrained from lending to each other so he arose and instituted the prosbol . According to this explanation, the ordinance of Hillel did not conflict with a Torah law; rather, he added an ordinance to counter the effect of a rabbinic law.

2According to this explanation, the Sages instituted that even in the present the Sabbatical Year would bring a cancellation of debt, despite the fact that by Torah law the debt still stands. The Gemara asks: But is there anything like this, where by Torah law the Sabbatical Year does not cancel the debt, and the Sages instituted that it will cancel? It is as though the Sages are instructing the debtors to steal from their creditors, as by Torah law they still owe the money.

3Abaye says: This is not actual theft; it is an instruction to sit passively and not do anything. The Sages have the authority to instruct one to passively violate a Torah law, so long as no action is taken. Rava says: The Sages are able to institute this ordinance because property declared ownerless by the court is ownerless. As Rabbi Yitzḥak says: From where is it derived that property declared ownerless by the court is ownerless? As it is stated: “And whoever did not come within three days according to the counsel of the princes and the Elders, all of his property shall be forfeited, and he shall be separated from the congregation of the captivity” (Ezra 10:8).

4Rabbi Eliezer said: The halakha that property declared ownerless by the court is ownerless is derived from here: The verse states: “These are the inheritances, which Eleazar the priest, and Joshua the son of Nun, and the heads of the fathers’ houses of the tribes of the children of Israel distributed for inheritance” (Joshua 19:51). The Gemara asks: What do the heads have to do with the fathers? It comes to tell you: Just as fathers transmit anything that they wish to their children, so too, heads of the nation transmit to the people anything that they wish. This demonstrates that the court has the authority to take property from one person and to give it to another; therefore, the Sages have the authority to decide that all debts are canceled.

5§ A dilemma was raised before the Sages: When Hillel instituted the prosbol , was it for his generation alone that he instituted it, and the custom developed to continue using it, or did he perhaps institute it also for all generations?

6The Gemara asks: What difference is there whether it was instituted for his generation only or for all generations when either way, it is still in use? The Gemara explains: The difference arises with regard to nullifying the institution of prosbol . If you say that it was for his generation alone that he instituted it, then we can nullify it if we desire. But if you say that he instituted it also for all generations, then there is a principle that a court can nullify the action of another court only if it is greater than it in wisdom and in number. Therefore, we would not be able to nullify the ordinance instituted by Hillel and his court. What, then, is the halakha ?

7The Gemara suggests a resolution to the dilemma: Come and hear that which Shmuel said: We write a prosbol only in the court of Sura or in the court of Neharde’a, as they were the primary centers of Torah study, but not in any other court. And if it enters your mind to say that he instituted it also for all generations, then let them write a prosbol in the other courts as well.

8The Gemara rejects this proof: Perhaps when Hillel instituted the prosbol , he did so for all generations, but only for courts such as his court, which was the primary court of his time, and courts like those of Rav Ami and Rav Asi, as they have the power to remove money from someone’s possession. However, for all other courts, which are not as authoritative, he did not institute this ordinance. Therefore, the statement of Shmuel cannot serve as a proof with regard to the manner in which the prosbol was instituted.

9The Gemara suggests another proof: Come and hear that which Shmuel said: This prosbol is an ulbena of the judges; if my strength increases I will nullify it. The Gemara challenges this statement: How could Shmuel say: I will nullify it? But isn’t it the case that a court can nullify the action of another court only if it is greater than it in wisdom and in number? It must be that Shmuel holds that Hillel did not establish the prosbol for all generations, and in his time it carried the force of a mere custom. The Gemara rejects this proof: It can be explained that this is what he said: If my strength increases so that I become greater than Hillel, then I will nullify the prosbol .

10By contrast, Rav Naḥman said: If my strength increases, I will uphold the institution of the prosbol . The Gemara asks: What is meant by: I will uphold it? Isn’t it upheld and standing? Why does the prosbol require further support? The Gemara explains: This is what he said: If my strength increases, I will say something about it, and I will institute that even though the prosbol was not written, it is considered as though it was written. Then people would no longer need to write a prosbol , as it would be considered as if everyone wrote one.

11A dilemma was raised before the Sages: This ulbena of the judges that Shmuel speaks of, is it a term of insolence, in that the judges are, according to Shmuel, enabling lenders to insolently collect debts that are not due to them, or a term of convenience, in that the judges are saving themselves the inconvenience of having to actually collect the debts detailed in the promissory notes? The Gemara suggests a proof: Come and hear that which Ulla said in describing the Jewish people after they sinned with the Golden Calf immediately following the revelation at Sinai: Insolent [ aluva ] is the bride who is promiscuous under her wedding canopy.

12Rav Mari, son of Shmuel’s daughter, says: What is the verse from which it is derived? “While the king sat at his table, my spikenard sent forth its fragrance” (Song of Songs 1:12). He understands the verse in the following manner: While the king was still involved in his celebration, i.e., God had just given the Torah, the perfume of the Jewish people gave off an unpleasant odor, i.e., they sinned with the Golden Calf. Rava says: Nevertheless, it is apparent from the verse that the affection of God is still upon us, as it is written euphemistically as “sent forth its fragrance” and the verse is not written: It reeked.

13The Gemara continues discussing the meaning of the word ulbena . The Sages taught: Those who are insulted [ ne’elavin ] but do not insult others, who hear their shame but do not respond, who act out of love and are joyful in their suffering, about them the verse states: “And they that love Him are as the sun going forth in its might” (Judges 5:31).

14§ The Gemara asks: What is the meaning of the word prosbol ? Rav Ḥisda said: An ordinance [ pros ] of bulei and butei .

ותקון רבנן דתשמט זכר לשביעית‎—And the רבנן instituted that it should be משמט to commemorate שביעית O VERVIEW The גמרא cited a ברייתא that שמיטת כספים is dependent on שמיטת קרקע, so when שמיטת קרקע ceased so too did שמיטת כספים cease מדאורייתא‎. However the רבנן instituted that there should be שמיטה in order to commemorate שביעית‎. Our תוספות discusses why this תקנה is limited to שמיטה‎. תוספות responds to an anticipated question: והא דלא תקון נמי יובל זכר ליובל‎ – And the reason the רבנן did not institute יובל to commemorate יובל (מדאורייתא) – משום דאין רוב צבור יכולין לעמוד בה ליאסר בעבודת קרקע שתי שנים רצופות: Because a majority of the public is not able to withstand the difficulty to be prohibited working the land for two consecutive years. S UMMARY Not working the land for two years is a גזירה שאין רוב הצבור יכולים לעמוד בה‎. T HINKING IT OVER 1. How can תוספות say that not working the land for two years is a גזירה שאין רוב הצבור יכולים לעמוד בה, when the בנ"י observed it during בית ראשון‎? 2. Why did not the רבנן enact יובל only regarding returning of the fields to their original owners, but not regarding working the fields, thereby eliminating the problem of not working for two years?

אלא אם כן גדול הימנו כולי‎—Unless he is greater than him, etc - O VERVIEW The גמרא stated that if הלל instituted פרוסבול for all generations to follow then no one can nullify this תקנה, since the rule is that one בי"ד cannot nullify the ruling of another בי"ד unless the nullifying בי"ד is greater than the original בי"ד, in wisdom and in number. תוספות discusses this rule. ---------------------- תוספות asks: ואם תאמר היכי דמי אי דפשט ברוב ישראל אפילו גדול הימנו אין יכול לבטל‎ – And if you will say; what situation are we discussing; if this ruling (regarding פרוסבול) was accepted among the majority of Jews, then even if the nullifying בי"ד is greater that the initial בי"ד, it still cannot nullify the initial ruling – כדאמרינן בפרק אין מעמידין (עבודה זרה לו, א) גבי י"ח דבר – As רבב"ח said in the name of ר' יוחנן in פרק אין מעמידין regarding the י"ח דבר (eighteen things) – שאפילו יבא אליהו ובית דינו אין שומעין לו‎ – ‘That even if אליהו הנביא and his בי"ד will come to nullify the י"ח דבר we will not listen to him’ (as רב משרשיא explained), ‘since פשט איסורו ברוב ישראל’ – ואי דלא פשט ברוב ישראל אפילו קטן יכול לבטל‎ – And if (פרוסבול) was not פשט ברוב ישראל, then even a smaller בי"ד בחכמה ובנין can nullify it – כדאמרינן נמי התם גבי שמן דרבי יהודה הנשיא ובית דינו נמנו עליו והתירוהו‎ – As רב משרשיא also states there regarding oil of gentiles that ר"י הנשיא and his בי"ד, voted on it and permitted it – משום דלא פשט איסורו ברוב ישראל‎ – Since לא פשט איסורו ברוב ישראל‎. In summation: תוספות asks that it seems that the rule of אין בי"ד יכול לבטל דברי בי"ד חבירו אא"כ גדול ממנו בחכמה ובמנין, does not apply; for if the גזירה was פשט ברוב ישראל then even גדול ממנו cannot be מבטל (as in י"ח דבר) and if לא פשט then even a קטן can be מבטל (as in שמן עכו"ם). תוספות answers: ויש לומר דהא קאמר התם וסמכו רבותינו על דברי רבן שמעון בן גמליאל‎ – And one can say; for the גמרא there states regarding the היתר שמן, ‘ and our teachers (referring to ר"י הנשיא ובי"ד) depended on the words of רשב"ג – ועל דברי רבי אלעזר בר צדוק שהיו אומרים‎ – And on the words of ר"א בר צדוק who used to say – אין גוזרין גזירה על הצבור אלא אם כן רוב הצבור יכולים לעמוד בה‎ – We do not issue a decree on the public, unless a majority of the public can bear it’ this concludes the citation of the גמרא there – משמע משום דהוה תרתי היה להם כח להתיר דלא פשט וגם לא היו יכולים לעמוד בה‎ – It seems because regarding שמן where there were two reasons להתיר, therefore the בי"ד of ר"י הנשיא had the power to permit it, for it was not פשט ברוב ישראל and also רוב הצבור was not able to bear such a hardship (of not using שמן עכו"ם) – אבל הכא או פשט ולא היו יכולים לעמוד או היו יכולים לעמוד ולא פשט – However here regarding פרוסבול we will say either it was פשט but לא היו יכולים לעמוד, or it was יכולים לעמוד, but לא פשט; in either of these two cases we say אין בי"ד יכול לבטל דברי בי"ד חבירו אא"כ גדול ממנו בחכמה ובמנין‎. In summation: if it is פשט and יכולים לעמוד then no one can be מבטל it (י"ח דבר); if לא פשט and אין יכולים לעמוד then any בי"ד can be מבטל it (שמן); if it is פשט ואין יכולים לעמוד or לא פשט ויכולים לעמוד, then only a בי"ד גדול can be מבטל it (פרוסבול). תוספות presents a contradictory view: ואין משמע כן בירושלמי בפרק קמא דשבת דאמר התם רבי יוחנן בעי ולא כן תנינן‎ – However it does not seem so in תלמוד ירושלמי in first פרק of מסכת שבת; for it says there, ‘ר"י asked (regarding the היתר of שמן עכו"ם) but did we not learn – שאין בית דין יכולין לבטל דברי בית דין חברו אלא אם כן גדול הימנו בחכמה ובמנין‎ – That אין בי"ד יכול לבטל דברי בי"ד חברו אא"כ גדול הימנו בחכמה ובמנין and here – ורבי יהודה הנשיא ובית דינו מתירין מה שאסר דניאל וחבורתו‎ – ר"י הנשיא and his בי"ד are permitting what דניאל and his contemporaries forbade – אלא רבי יוחנן כדעתיה דאמר רבי יוחנן בשם רבי אלעזר בר צדוק‎ – Rather ר"י answers this difficulty by following his view, for ר"י stated in the name of ראב"צ – מקובלני שכל גזירה שבית דין גוזרין על הצבור ולא קיבלו רוב צבור עליהן אינה גזירה‎ – ‘I have received a tradition that any decree which בי"ד issues on the public and the majority of the public did not accept it upon themselves, it is not a valid decree’ – ובדקו ומצאו בגזירתו של שמן ולא קבלו רוב צבור עליהן‎ – And they investigated and found out in regards to the decree of שמן that רוב הצבור did not accept it upon themselves. This concludes the citation from the ירושלמי‎ – אלמא משמע דבהאי טעמא לחודיה סגי – It seems evident that with this (one) reason alone (that לא פשט) it is sufficient for any בי"ד to be מבטל and we do not require two reasons לא פשט and אין יכולים לעמוד‎. תוספות asks an additional question ועוד דבריש מגילה (דף ב, א) פריך ואי סלקא דעתך אנשי כנסת הגדולה י"ד וט"ו הוא דתקון‎ – And furthermore in the beginning of מסכת מגילה the גמרא asks, ‘for if you will assume that the אנשי כנה"ג instituted that the מגילה be read on the fourteenth and fifteenth, is it possible that – אתו רבנן ועקרו תקנתא דתקינו אנשי כנסת הגדולה והתנן אין בית דין כולי‎ – The later רבנן came and uprooted the תקנה which the אנשי כנה"ג instituted, but we learnt in a משנה that אין בי"ד, etc.’ this concludes the citation from מגילה‎ – והתם מסתמא פשט ויכולין לעמוד – And there (regarding reading the מגילה) presumably it was פשט ברוב ישראל and most of the צבור was יכולין לעמוד‎. תוספות answers: ויש לומר דדוקא בי"ח דבר אפילו גדול אין יכול לבטל כדאשכחן בירושלמי – And one can say that only regarding the י"ח דבר then even a בי"ד גדול cannot be מבטל (the י"ח דבר) as we find in תלמוד ירושלמי that even a בי"ד גדול cannot be מבטל the י"ח דבר‎ – מפני שעמדו להם בנפשותיהם‎ – Because they staked their lives on it – כדאיתא התם דתלמידי בית שמאי היו הורגין בתלמידי בית הלל‎ – As is mentioned there that the students of ב"ש were killing the students of ב"ה ובכל דבר גדול יכול לבטל חוץ מי"ח דבר‎ – And regarding any ruling (even if פשט and יכולים לעמוד) a בי"ד גדול can be מבטל except for the י"ח דבר‎ – והיכא דלא פשט כגון שמן אף על גב דעמדו עליהן בנפשותיהן אפילו קטן יכול להתיר‎ – And wherever the איסור was לא פשט for instance שמן עכו"ם even though they risked their lives for it (it was one of the י"ח דבר), nevertheless even a בי"ד קטן can permit it – תוספות anticipates a difficulty: והא דקאמר וסמכו רבותינו אהא דאין גוזרים גזירה על הצבור‎ – And that which the גמרא stated (in ע"ז), ‘ and our Rabbis depended on that which was stated that אין גוזרים גזירה על הצבור unless יכולים לעמוד בה’ – תוספות replies: לא מייתי ההוא טעמא אלא משום דלא תימא הואיל והראשונים נמנו עליו לאוסרו‎ – The גמרא did not mention that reason (of אין גוזרין וכו') in order to explain how they had the power to do it, for that was already explained by saying it was לא פשט, rather the (second) reason was mentioned in order that you should not ask, since the חכמים of prior generations voted to prohibit שמן עכו"ם – למה נמנה הוא עליו להתירו אדרבה היה לו להמנות לאסור‎ – Why did the בי"ד of ר"י vote to permit it; on the contrary they should have voted to continue the prohibition – דאשכחן בכמה דוכתי דראשונים גזרו ולא קיבלו מנייהו ובתראי גזור וקבלו מנייהו‎ – For we find in many places where the earlier חכמים decreed and the people did not accept it from them, and the later חכמים decreed it again and the people did accept it from them; we find this – בפרק קמא דשבת (דף יד, ב) ובפרק קמא דחולין (דף ו, א) – In the first פרק of שבת and in the first פרק of חולין, so here too even though the people did not accept the גזירה on שמן from the ראשונים, nevertheless ר"י ובית דינו should have attempted to uphold the first גזירה instead of abandoning it – להכי קאמר דלא רצה להמנות לאסור משום דחזא דאין רוב צבור יכולין לעמוד בו‎ – Therefore the גמרא explains that ר"י did not want to vote to prohibit שמן עכו"ם, because he saw that אין רוב צבור יכולין לעמוד בו‎. In summation: According to the ירושלמי when an איסור is פשט then only a בי"ד גדול can be מבטל (except for the י"ח דבר), however when it is not פשט then even a קטן can be מבטל‎. תוספות limits the ability of a בי"ד קטן to be מבטל a גזירה which was לא פשט: ומיהו בדבר שלא תקנו שיתפשט האיסור בכל ישראל אלא במקום אחד דוקא‎ – However regarding a תקנה which initially was not intended that it should apply to כל לישראל, but rather for one specific place – כההיא דבפרק כל הבשר (חולין קי, א) דרב איקלע לטטלופוש – Like that incident in פרק כל הבשר where רב came to טטלופוש‎ – דאמר בקעה מצא וגדר בה גדר ואסר להו כחל – Where the גמרא states that רב found an unfenced valley and erected a fence, meaning, he forbade them from eating the udder of a cow – וכן כל הנך דפרק תולין (שבת קלט, א) דשלחו ליה בני בשכר ואסר להם לפי שאינן בני תורה‎ – And similarly all those issues in פרק תולין where the בני בשכר sent to לוי, and רב מנשיא (after the death of לוי) forbade them because they were not בני תורה (even though they would be permitted for others); in all these case even though the איסור was not פשט ברוב ישראל, only in one particular area, nevertheless, only a בי"ד – גדול יכול להתיר ולא קטן: גדול can be מתיר (for these people who were prohibited) but not a בי"ד קטן‎. S UMMARY According to the בבלי a בי"ד גדול can be מבטל only if it is לא פשט or אין יכולין לעמוד בו (like פרוסבול), however if it is פשט and יכולין לעמוד בו (like י"ח דבר) they cannot be מבטל‎. A בי"ד קטן can only be מבטל if it is לא פשט and אין יכולין לעמוד בו (like שמן). According to the ירושלמי it depends solely if it is פשט (then only a גדול) or לא פשט (even a קטן) except for י"ח דבר which no one can be מבטל since עמדו עליהן בנפשותיהן‎. T HINKING IT OVER 1. תוספות writes that by פרוסבול it may have been פשט but לא יכולים לעמוד‎. It seems difficult to comprehend why they were not יכולים לעמוד by פרוסבול since it was for everyone’s benefit (as the גמרא states shortly). 2. תוספות assumes (according to the בבלי) that if פשט ולא יכולין לעמוד then a גדול can be מבטל‎. Seemingly all we can derive from שמן is that for a קטן to be מבטל we need both לא פשט and אין יכולין לעמוד, from פרוסבול we can derive that if לא פשט and יכולין לעמוד a גדול can be מבטל, but if it is פשט and לא יכולין לעמוד we have no reason to assume that even a גדול can be מבטל (and this would also explain י"ח דבר). Why does תוספות assume that a גדול can be מבטל by פשט ולא יכולין לעמוד‎?!

דאלימי לאפקועי ממונא‎—That they are powerful to extricate money O VERVIEW The גמרא stated that even if we assume that הלל was מתקן a פרוסבול for future generations but he limited the power of writing a פרוסבול to a respected בי"ד, which has the power to extricate money. תוספות qualifies this statement. -------------------- רבינו תם כתב פרוסבול כי היה אומר דלא בעינן אלא בית דין חשוב שבדור – The ר"ת wrote a פרוסבול (for those that needed it) for he would say, the only requirement is that it should be a prominent בי"ד of that generation – ואשכחן נמי (לקמן לז, א) שהיו מקילין רבנן דבי רב אשי דמסרי מילייהו אהדדי – And we also find that the students in the academy of רב אשי were lenient (regarding פרוסבול); they would merely ‘give over’ words to each other (without even writing a פרוסבול). תוספות continues with a (seemingly) unrelated issue: תנן במסכת שביעית (פרק י' משנה ה') פרוסבול המוקדם כשר והמאוחר פסול – We learnt in a משנה in מסכת שביעית; ‘a predated פרוסבול is כשר, however a postdated פרוסבול is פסול' – ומפרש בירושלמי משום דפרוסבול אינו מועיל מה שמלוה אחר כתיבת פרוסבול – And he explains in תלמוד ירושלמי, since a פרוסבול is not effective for that which he lends out after the writing of the פרוסבול; it is – אלא למה שהלוה קודם זמן הכתוב בפרוסבול‎ – Only effective for what he lent before [the date written in] the פרוסבול‎ – ולכך מאוחר פסול דמרויח שלא כדין כל מה שהלוה אחר כתיבת פרוסבול עד זמן הכתוב בו: And therefore a post dated פרוסבול is פסול because the lender unlawfully gains all the loans which he lent after the writing of the פרוסבול until the date which is written in the פרוסבול‎. S UMMARY A פרוסבול can be written by a בי"ד חשוב שבדור‎. The פרסבול is effective for all loans that were made before the writing (and dating?) of the פרוסבול‎. Any loans made after the writing of the פרוסבול are not exempt from שמיטת כספים‎. T HINKING IT OVER Are the רבנן דבי רב אשי (who were מסרי מילי אהדדי) arguing against שמואל (who maintains לא כתבינן פרוסבול אלא אי בבי דינא דסורא וכו') or not?

דכתיב נתן ולא כתיב הסריח‎—For it is written נתן, but it is not written הסריח O VERVIEW רבא taught that even though the בנ"י lost their fragrance at הר סיני (by worshipping the עגל) as the פסוק states 'עד שהמלך במסבו נרדי נתן ריחו', nevertheless the בנ"י are still dear to הקב"ה, for the פסוק could have written נרדי הסריח ריחו and it chose a more refined expression to indicate their dearness to הקב"ה. Our תוספות clarifies this proof. --------------------- תוספות anticipates a question: אף על גב דאית ליה למכתב לישנא מעליא – Even though it is necessary to write a refined language (נתן ריחו), and not use coarse language like הסריח‎ – תוספות responds: מכל מקום הוה מצי למכתב עזב: Nevertheless in order to satisfy לישנא מעליא, the פסוק could have written נרדי עזב ריחו (the fragrance left my spice), which would also indicate that there is no fragrance left at all; since it merely wrote נתן ריחו this indicates that it merely gave up some [but not all] of the fragrance. S UMMARY If there was no dearness of the בנ"י to הקב"ה after the עגל, the פסוק should have used a more severe term than נתן, it should have stated עזב (which would have denoted הסריח). T HINKING IT OVER According to תוספות why did the גמרא write, 'ולא כתיב הסריח'; the גמרא should have written 'ולא כתיב עזב'?!
