    Gittin 39b

    Chapter 4 - HaSholeach

גם: גיטין דף ל״ט ע״ב, פרק ד׳ השולח

    English translation - Gittin 39b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1Did you hear it explicitly said by Rabbi Yehoshua ben Levi, or did you hear it by inference, i.e., did you infer it from some other statement of his? Rabbi Ya’akov bar Idi asked him: What inference could I have drawn? Rabbi Zeira answered: As Rabbi Yehoshua ben Levi says that they said before Rabbi Yehuda HaNasi: If one says: I have despaired of recovering so-and-so, my slave, what is the halakha ? He said to them: I say that his slave has no remedy other than via a bill of manumission.

2The Gemara continues explaining the possible inference. And Rabbi Yoḥanan said: What is the reasoning of Rabbi Yehuda HaNasi? He derived this by means of a verbal analogy, understanding the meaning of “to her [ lah ],” written with regard to a maidservant in the verse: “Nor was freedom given to her” (Leviticus 19:20), from the meaning of “for her [ lah ],” written with regard to a wife: “And he writes for her a bill of divorce” (Deuteronomy 24:3). Just as a wife is released from her husband via a bill of divorce, so too, a slave is also emancipated only via a bill of manumission.

3You heard this statement and deduced from this comparison that with regard to his master’s death, a slave is comparable to a wife. Just as a wife is released by the death of her husband from a prohibition but not from a monetary bond, so too, a slave is also emancipated by his master’s death from a prohibition but not from a monetary bond. Therefore, an adult slave, who can acquire ownership of himself, is freed entirely by means of the death of his master. However, in the case of a minor slave, who cannot acquire possession of his own person, the monetary bond remains, in accordance with the opinion of Abba Shaul.

4Rabbi Ya’akov bar Idi said to him: And if this was derived by inference, what of it? Rabbi Zeira said to him: If you derived this by inference from Rabbi Yehoshua ben Levi’s statement, then, on the contrary, deduce from this to the other side and say as follows: Just as a wife is released by her husband’s death and requires no bill of divorce whether she is an adult or a minor, so too, a slave is also emancipated when his master dies whether he is an adult or a minor, in opposition to the opinion of Abba Shaul. He said to him: I heard explicitly that Rabbi Yehoshua ben Levi said that the halakha is in accordance with the opinion of Abba Shaul.

5And Rabbi Ḥiyya bar Abba says that Rabbi Yoḥanan says: The halakha is not in accordance with the opinion of Abba Shaul. Rabbi Zeira said to Rabbi Ḥiyya bar Abba: Did you hear it explicitly that Rabbi Yoḥanan said it, or did you hear it by inference? Rabbi Ḥiyya bar Abba asked: What inference could have been drawn? Rabbi Zeira answered: For Rabbi Yehoshua ben Levi says that they said before Rabbi Yehuda HaNasi: If one says: I have despaired of recovering so-and-so, my slave, what is the halakha ? He said to them: I say that his slave has no remedy other than via a bill of manumission.

6The Gemara continues explaining the possible inference. And Rabbi Yoḥanan said: What is the reasoning of Rabbi Yehuda HaNasi? He derived this halakha by means of a verbal analogy, understanding the meaning of the words “to her,” written with regard to a maidservant, from the meaning of “for her,” written with regard to a wife. Just as a wife can leave her husband only via a bill of divorce, so too, a slave is also emancipated only via a bill of manumission.

7You heard this statement and deduced from this comparison that with regard to his master’s death, a slave is comparable to a wife. Just as a wife is released by her husband’s death whether she is an adult or a minor, so too, a slave is also emancipated whether he is an adult or a minor, and there is no distinction between a minor slave who receives a bill of manumission and a minor slave whose master dies.

8Rabbi Ḥiyya bar Abba asked him: And if this was derived by inference, what of it? Rabbi Zeira said to him: If you derived this by inference, then, on the contrary, deduce from this to the other side and say as follows: Just as a wife is released by the death of her husband from a prohibition and not from a monetary bond, so too, a slave is also emancipated by his master’s death from a prohibition and not a monetary bond. He said to him: I heard this explicitly from Rabbi Yoḥanan.

9§ In connection with the baraita cited above, the Gemara discusses the matter itself. The Master said above: Rabbi Yehuda HaNasi said to them: I say that his slave has no remedy other than via a bill of manumission. The Gemara challenges: But isn’t it taught in a baraita : Rabbi Yehuda HaNasi says: I say that even the slave himself can give his own monetary value and is emancipated, due to the fact that it is as if the Temple treasurer sold him to himself. This demonstrates that a slave can be emancipated by paying money in addition to receiving a bill of manumission.

10The Gemara answers: This is what he is saying: A slave can be emancipated either via money or via a bill of manumission. And with regard to this master, who despaired of recovering his slave, his monetary hold over this slave is abrogated, and he can be emancipated only via a bill of manumission. And this statement, that generally a slave can be emancipated either via a bill of manumission or by paying money, serves to exclude the opinion of this tanna in the following baraita .

11As it is taught in a baraita that Rabbi Shimon says in the name of Rabbi Akiva: One might have thought that paying money completes the emancipation of a Hebrew maidservant, just as a bill of manumission completes her emancipation. The verse states, concerning a Jewish man who engages in sexual intercourse with a maidservant who had been designated to cohabit with a Hebrew slave: “And whoever lies carnally with a woman that is a bondmaid designated for a man, and not at all redeemed, nor was freedom given to her; there shall be inquisition; they shall not be put to death, because she was not free” (Leviticus 19:20). In this case, neither the Jewish man nor the maidservant is liable to receive the death penalty, in contrast to a man who engages in sexual intercourse with a married woman.

12The halakha of this entire portion of a maidservant who had been designated to cohabit with a Hebrew slave is linked to, i.e., dependent on, only the phrase “nor was freedom given her” by means of a bill of manumission. The reason she does not have the status of a free woman is that she was not granted her freedom by means of a bill of manumission. If the halakha of this portion would be dependent upon the phrase “and not at all redeemed,” this would indicate that the reason she does not have the status of a free woman is that she was not redeemed with money. This is in order to say to you: A bill of manumission completes her emancipation entirely, and money does not complete her emancipation. According to Rabbi Shimon, a slave can be emancipated only via a bill of manumission but not by paying money.

13Rami bar Ḥama says that Rav Naḥman says: The halakha is in accordance with the opinion of Rabbi Shimon. And Rav Yosef bar Ḥama says that Rabbi Yoḥanan says: The halakha is not in accordance with the opinion of Rabbi Shimon.

14The Gemara relates: Rav Naḥman bar Yitzḥak found Rava bar She’eilta when he was standing at the entrance to a house of prayer. He said to him, with regard to this issue: Is the halakha in accordance with the opinion of Rabbi Shimon, or is the halakha not in accordance with his opinion? He said to him: I say that the halakha is not in accordance with his opinion in this matter, and the Rabbis who came from Meḥoza say that Rabbi Zeira said in the name of Rav Naḥman: The halakha is in accordance with the opinion of Rabbi Shimon.

15And when I came to Sura, I found Rabbi Ḥiyya bar Avin, and I said to him: Tell me, my friend [ izi ], the incident itself. What happened, and what exactly did Rav Naḥman say? He said to me that there was a certain maidservant whose master was on his deathbed. She came crying before him and said to him: Until when will that woman, i.e., I, continue to be subjugated? He took his hat [ kumtei ], threw it to her, and said to her: Go acquire this hat and thereby acquire yourself as a free woman. They came before Rav Naḥman for a ruling, and he said to them: He did nothing.

16One who saw this incident thought that he ruled in this manner because he holds that the halakha is in accordance with the opinion of Rabbi Shimon, that a maidservant can be emancipated only via a bill of manumission. But that is not so. Rather, it was because this was a legal act of acquisition formalizing the transfer of ownership that was performed with the items of the one who transfers ownership, and this mode of acquisition takes effect only when the one who transfers ownership acquires an item belonging to the one to whom the ownership is being transferred. Since the item of the owner was used, the maidservant was not emancipated.

17Rav Shmuel bar Aḥittai says that Rav Hamnuna the Elder says that Rabbi Yitzḥak bar Ashyan says that Rav Huna says that Rav Hamnuna says: The halakha is in accordance with the opinion of Rabbi Shimon. The Gemara concludes: And that is not so, as the halakha is not in accordance with the opinion of Rabbi Shimon.

18Rabbi Zeira says that Rabbi Ḥanina says that Rav Ashi says that Rabbi Yehuda HaNasi says: In the case of a slave who marries a free woman in the presence of his master,

    Tosafot

מה אשה איסורא ולא ממונא‎—Just as by a woman it is prohibitory but not monetary O VERVIEW ר' זירא assumed that ריב"א derived from a (separate) statement of ריב"ל that ריב"ל maintains הלכה כאבא שאול (regarding the יתומים קטנים of a גר שמת that the rule is כל הקודם בהם זכה בהם). The statement ר"ז was referring to is where ריב"ל taught in the name of רבי that if a master said ‘I have given up on my slave’; the slave is not completely freed unless he receives a שטר שחרור first. ר' יוחנן explained because we derive עבד from אשה that just as an אשה leaves her husband only with a שטר (גט), similarly an עבד cannot be completely freed unless he receives a גט שחרור‎. This (concludes ר"ז) is from where ריב"א possibly derived that ריב"ל rules like אבא שאול, for we derive from the גז"ש לה לה (in addition), that just like by a woman, the גט merely releases her from her איסור relationship with her husband, but not from a monetary relationship (which does not exist), similarly the שטר שחרור of the עבד releases him from the איסור עבדות, but cannot release him from the ממונות relationship with his master. רבי must be discussing an עבד who (after the יאוש) has only an איסור relationship with his master, but not a monetary one (since the master was מפקיר him through the יאוש, the עבד acquired his ‘monetary’ freedom). However by an עבד קטן where there still remains a monetary connection to the master (even after the יאוש/הפקר, for the קטן cannot acquire himself), there is no freedom at all and he is still מותר בשפחה כנענית and the שטר will not be effective since it can only release him from the איסור aspect but not from his ממון aspect. This proves that ריב"ל who cites רבי agrees with אבא שאול‎. ----------------- תוספות asks: ואם תאמר היאך עבד משתחרר בשטר לאבא שאול אם לא יפקירנו תחלה‎ – And if you will say; according to אבא שאול how can an עבד be emancipated with a שטר, unless the master first frees him – דמה אשה איסורא ולא ממונא אף כולי‎ – For just like a woman (who is divorced by a גט), it is only איסורא and not ממונא similarly, etc. an עבד who is freed by a שטר the שטר can only effect איסורא but not ממונא, this can be accomplished only by the master first being מפקיר the עבד and then giving him the שטר שחרור‎. This seems to be too far-fetched. תוספות considers a possible solution: וכי תימא דלשון הכתוב בשטר כגון הרי את בן חורין הרי את לעצמך הוי לשון הפקר‎ – And if you will say that the language which is written in the שטר, for instance; ‘you are a free man’, or ‘ you belong to yourself’, these are expressions of הפקר, therefore it is indeed considered as if he is (first) מפקיר the עבד and consequently משחרר him, which would seemingly answer our question – תוספות negates this solution: אם כן לשמואל למה לי שטרא יפקירנו – If this is indeed so, why, according to שמואל is a שטר necessary to be משחרר the עבד, he can just be מפקיר him, since the expressions of שחרור, namely הרי את בן חורין, etc. are really expressions of הפקר‎! תוספות continues to ask: ועוד דאפילו על ידי הפקר היאך משתחרר קטן לאבא שאול – And in addition, even with הפקר how can one emancipate an עבד קטן according to אבא שאול (who maintains that a קטן has no יד לזכות and therefore is not הפקר even from a monetary standpoint)?! תוספות answers: ואומר רבינו יצחק דדוקא בקנין דמיתה דילפינן מאשה – And the ר"י explains that only regarding acquiring oneself through death of the master which we derive from אשה‎ – אמרינן איסורא ולא ממונא דומיא דאשה – Do we say that the power of the master over the עבד need be איסורא ולא ממונא just like אשה (and it can only release the איסור aspect but not the ממון aspect) – אבל שטר שכתוב בהדיא בקרא או חופשה לא ניתן לה (ויקרא יט) משוחררת בשטר לחודיה – However regarding emancipation by שטר, which is written explicitly in the פסוק that 'או חופשה לא ניתן לה'; she is emancipated with a שטר alone without needing הפקר to precede it, even though it is איסורא וממונא‎ – דמקרא מלא דיבר הכתוב – Since it is an explicit verse, that a שפחה/עבד can be emancipated (with a שטר) – תוספות offers an additional explanation that שטר is effective for ממונא as well – ועוד דאיתקש שטר לקנין כסף דכתיב (שם) והפדה לא נפדתה – And furthermore, שטר was likened to קנין כסף as is written, ‘and [redeemed] she was not redeemed’ – ועיקר קנין כסף מפקיע ממון כדאמר הכא נתייאשתי מפלוני עבדי אין לו תקנה אלא בשטר‎ – And the main aspect of קנין כסף (to redeem the slave) is that it removes the money obligation to the master, as the גמרא states here, if the master said, ‘ I have abandoned my slave’, there is no recourse for the עבד except for a שטר שחרור‎ – אבל בכסף לא דפקע ליה כספיה מכי אפקריה: However (in this case of יאוש בעלים), the עבד will not be redeemed with כסף (the עבד cannot pay the master his value and become a בן חורין [as he usually can]), for the monetary connection to the master has been removed when he was מפקיר the עבד (at the time of יאוש); the only solution is a שטר שחרור‎. Therefore, just as כסף is מפקיע ממון, so too a שטר שחרור is also מפקיע ממון‎. S UMMARY The comparison of מה אשה איסורא ולא ממונא so too עבד is איסורא ולא ממונא is referring only to the שחרור העבד through מיתת האדון, but not through שחרור בשטר‎. T HINKING IT OVER תוספות asks since we assume מה אשה איסור וכו' אף עבד וכו', how can an עבד be freed with a שטר שחרור‎. Seemingly, just as the master can sell the עבד with a שטר מכר, where he transfers the ממון and איסור to the buyer, why cannot we say the same when gives the שטר שחרור to the עבד that he is transferring to the עבד the complete ownership of the עבד‎?

אמר להן לא עשה ולא כלום‎—He said to them; he accomplished nothing O VERVIEW A שכיב מרע threw his hat to a שפחה and told her, ‘acquire the hat and acquire yourself’ (as a בת חורין). רב נחמן ruled that nothing was accomplished by this exchange. תוספות explains why other rulings do not set her free. -------------------- פירש בקונטרס משום דדברי שכיב מרע ככתובין וכמסורין דמו ליכא‎ – רש"י explained that there is no cause that the שפחה should be freed because of the ruling that דברי שכ"מ ככתובין וכמסורין דמו‎ – שהרי לא צוה כמוסר לבניו להקנותה לעצמה אלא בקנין זה נתכוון לשחררה והרי הוא טעות‎ – Because he did not command that she should belong to herself (through מתנת שכ"מ) in a manner as one who is transmitting his wishes to his children (the usual מתנת שכ"מ), but rather he intended to free her through this קנין (of acquiring the hat), and that קנין was a mistake (for the קנין is ineffective, as the גמרא explains). This concludes פירש"י. תוספות takes issue with פירש"י: ולא שייך להזכיר כאן מתנת שכיב מרע דהויא ליה במקצת – And the concept of מתנת שכ"מ is not applicable here that רש"י should mention it, since it is a partial gift. If anything – ולמצוה לקיים דברי המת איכא לדמויי אם היה כמוסר לבניו: It could have been compared to מצוה לקיים דברי המת, if he was transmitting his wishes to his children. S UMMARY מתנת שכ"מ במקצת requires a קנין‎. We say מצוה לקיים דברי המת if he was כמוסר לבניו‎. T HINKING IT OVER רש"י states that she cannot be freed based on דברי שכ"מ because he was not צוה כמוסר לבניו, etc., while תוספות says because it is מתנת שכ"מ במקצת, and therefore the entire concept of מתנת שכ"מ is לא שייך כאן‎. Why, according to תוספות explanation, is מתנת שכ"מ not applicable here, more that according to sרש"י' explanation?!

משום דהוה ליה כליו של מקנה‎—Because it was the vessels of the grantor O VERVIEW The גמרא explained the reason the woman did not acquire her freedom through the קנין חליפין (of her master’s hat) is because the חליפין were done using the כלי of the grantor and not the כלי of the acquirer as is wont to be. תוספות discusses the manner in which קנין חליפין is performed. ------------------------- אבל אם היה כליו של קונה היתה זוכה עצמה בחליפין‎ – However if it were done with the כלים of the קונה, then she would acquire her freedom through קנין חליפין‎ – דתניא בהדיא בפרק קמא דקידושין (דף כב, ב) דעבד כנעני נקנה בחליפין – For we learnt explicitly in a ברייתא in the first פרק of מסכת קידושין that an עבד כנעני is acquired through קנין חליפין‎ – משום דחליפין דמו לכסף וכל היכא דכסף קני חליפין נמי קני לבר מאשה‎ – Since קנין חליפין is similar to קנין כסף, so wherever כסף acquires, חליפין also acquires, except regarding a woman by קידושין where she is not נקנה בחליפין‎ – משום דבפחות משוה פרוטה לא מקניא נפשה כדאמר בריש קדושין (דף ג, א) – Because a woman will not deliver herself for less than a פרוטה, as the גמרא states in the beginning of מסכת קדושין‎. תוספות derives a halachic ruling from our גמרא: ומכאן יש להוכיח דהלכה כרב דאמר בכליו של קונה בפרק הזהב (בבא מציעא מז, ב) – And we can prove from the גמרא here that the הלכה is like רב who maintains in פרק הזהב that קנין חליפין must be done with the כלים of the קונה (the acquirer) – תוספות offers an additional proof that הלכה כרב and קונין בכליו של קונה: ועוד אמרינן התם במנא דכשר למקנייה ביה לאפוקי מדלוי‎ – And furthermore רב ששת בריה דרב אידי stated there that the expression ' במנא דכשר 'למקנייה ביה, is used to exclude the view of לוי, that קונין בכליו של מקנה‎. This proves (also) that the הלכה is בכליו של קונה like רב‎. תוספות rejects an anticipated refutation of this last proof: ולא דמי להא דאמר בפרק המגרש (לקמן פה, ב) דאתקין רבא מיומא דנן ולעלם – And the case here is not similar to that which the גמרא states in פרק המגרש that רבא instituted to write in the גט that the husband is divorcing his wife ‘from this day on and forever’; the גמרא there explained that the words מיומא דנן were included in order – לאפוקי מרבי יוסי דאמר זמנו של שטר מוכיח עליו – To exclude the view of ר' יוסי who states the date of the שטר proves when it is effective (and it is not necessary to add that the שטר is effective from this date because it is self-understood), רבא however disagrees with this. It would seem therefore that the הלכה is not like ר"י, since the גמרא states לאפוקי מר"י – אף על גב דרב גופיה פסיק כוותיה בההיא פרקא‎ – Even though that רב himself rules like ר"י in that פרק‎. This indicates that even though the גמרא states 'לאפוקי', that does not mean that the הלכה is not like him, similarly here too, even though the גמרא said לאפוקי מלוי‎. That does not necessarily mean that the הלכה is not like לוי‎. תוספות differentiates between the two גמרות: דהתם לשופרא דשטרא אתקין‎ – For there (regarding גיטין) רבא instituted to write מיומא דנן for the betterment of the שטר (it was an additional improvement), therefore this cannot disprove ר"י; אבל הכא למאן דאמר בכליו של מקנה לא מהני בכליו של קונה‎ – However here (regarding חליפין) according to the one (לוי) who maintains בכליו של מקנה, the חליפין will not be effective בכליו של קונה‎. תוספות brings the dissenting view of רש"י: ובקונטרס פירש בהזהב (בבא מציעא מז, א) דלוי דאמר בכליו של מקנה כ"ש בכליו של קונה – And רש"י explained in פרק הזהב that לוי who maintains בכליו של מקנה the certainly כליו של קונה is effective. תוספות disagrees with רש"י: ואין נראה כיון דאמר דגואל נתן לבעז לא מהני אלא בענין זה‎ – And this does not seem to be correct, since לוי maintains that the גואל gave the shoe (for קנין חליפין) to בעז, it can only be effective in this manner and no other – כמו לרב נחמן דאמר פירי לא עבדי חליפין משום דבעינן דומיא דנעלו‎ – Just like according to ר"נ who maintains that food cannot be used for חליפין, because we need the חליפין to be similar to נעלו (which is the חליפין which was used in the פסוק regarding בועז) – ולא אמרינן דהואיל דכלי שוה פרוטה קני – And we do not say (according to ר"נ) that since a כלי which is worth only a פרוטה is קונה (as חליפין), so כל שכן פירות שוים אלף זוז דאיכא הנאה טפי דגמר ומקני – Certainly food which is worth a thousand זוז, where there is so much more benefit that the מקנה should decide and grant the item to the קונה; we do not say this, rather we say since the פסוק writes נעלו it is only כלים that are fit for חליפין and not פירי, similarly if we assume (as לוי does) that the גואל (the מקנה) gave the חליפין to בועז (the קונה) that it is effective only in this manner תוספות offers one last proof that the הלכה is בכליו של קונה: ועוד אמרינן בנדרים בהשותפין (דף מח, ב) דסודרא קני על מנת להקנות הוא: And in addition רב נחמן states in מסכת נדרים in פרק השותפין that קנין סודר (חליפין), is a case where the מקנה is told acquire the סודר in order to grant the קונה an item. It is evident from that גמרא that we use the כליו של קונה (for חליפין), which the מקנה acquires with the intent that in turn he is מקנה the item to the קונה‎. S UMMARY An עבד can acquire freedom through קנין חליפין, provided it is with כליו של קונה as it is by all חליפין‎. T HINKING IT OVER Why was it necessary for תוספות to explain why an עבד כנעני is נקנה בחליפין (and distinguish עבד from אשה)?
