    Gittin 22a

    Chapter 2 - HaMevi Batra

גם: גיטין דף כ״ב ע״א, פרק ב׳ המביא בתרא

    English translation - Gittin 22a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1as he can take the pot with the leaf inside it and give it to her. Rava says that it is invalid. Although it should be valid if he gave her the leaf together with the potted plant, the Sages instituted a decree that it is invalid, lest one detach the leaf and give it to her. In that case, all agree that a bill of divorce that is fully written while attached is invalid.

2§ The Gemara has another discussion with regard to a perforated pot: In the case of a pot that belongs to one person and the plants in it belong to another person, if the owner of the pot sold it to the owner of the plants, then once the owner of the plants pulled the pot, he has acquired the pot, as it is a movable object, which can be acquired via pulling. However, if the owner of the plants sold the plants to the owner of the pot, then the owner of the pot does not acquire the plants until he takes possession of the plants themselves, e.g., by raking or weeding the dirt surrounding them. Since the plants are considered to be attached to the ground, as they are in a perforated pot, they are considered to be part of the ground, which cannot be acquired by pulling.

3If the pot and plants belong to one person, and he sold them to another person, then once the buyer took possession of the plants and acquired them, he acquired the pot as well. And this is an example of the principle that we learned in a mishna ( Kiddushin 26a): Property that does not serve as a guarantee, i.e., movable property, can be acquired with property that serves as a guarantee, i.e., land, through the giving of money, or with a document, or by taking possession. Therefore, once one takes possession of the plants, which are considered to be like land, he also acquires the pot, which is a movable object.

4However, if the buyer took possession of just the pot, then he does not even acquire the pot, as movable property cannot be acquired through taking possession, until he takes possession of the plants. To acquire the pot, one must either perform an act of acquisition specific to movable items, such as pulling, or acquire the plants through taking possession of them, resulting in the acquisition of the pot, as stated earlier.

5The Gemara discusses another issue with regard to perforated pots: If a perforated pot was on the border of Eretz Yisrael, and its perforation was in Eretz Yisrael but its branches were outside of Eretz Yisrael, then what is the halakha with regard to mitzvot that apply to produce grown in Eretz Yisrael, such as terumot and tithes? Abaye said: We follow its perforation, and it is considered to be growing in Eretz Yisrael. Rava said: We follow its branches, and it is considered to be growing outside of Eretz Yisrael.

6The Gemara notes: In a case where the plant in the pot took root in the ground, everyone agrees that it has the status of a plant that grows in the place where its roots are. When they disagree, it is with regard to a case where it did not take root. Since its roots are contained within the pot, there is a disagreement whether we follow the perforation or the branches in determining its status.

7The Gemara challenges: And do they not disagree with regard to a case where it took root? Do all agree that its status is determined by where the roots are? But didn’t we learn in a mishna ( Bava Metzia 118b): In a case of two gardens that belong to two different people that are on adjacent terraces one above the other, and leafy vegetables are growing between them on the wall of the step between the two gardens, Rabbi Meir says: These leafy vegetables belong to the owner of the upper garden, and Rabbi Yehuda says: These leafy vegetables belong to the owner of the lower garden. In this case, the roots emerge from the upper garden, but the vegetables grow into the airspace of the lower garden. This seems to be analogous to the case where the roots are in Eretz Yisrael and the branches are outside of Eretz Yisrael, or vice versa, and there is a dispute as to who is the owner of the vegetables.

8The Gemara makes a distinction between the two cases: There, in the case cited in the mishna in Bava Metzia , the reason for that halakha is as is taught in the mishna, that Rabbi Meir said: What if the owner of the upper garden would wish to take his earth? This would result in a situation where there are no more vegetables, as the vegetables would not have earth from which to draw nutrients. The fact that the owner of the upper garden has the ability to destroy the vegetables is an indication that he is the owner.

9Rabbi Yehuda said: What if the owner of the lower garden would wish to fill the airspace above his garden with earth? This would result in a situation where there are no more vegetables, as they would be covered in the earth added by the owner of the lower garden. The fact that the owner of the lower garden has the ability to destroy the vegetables is an indication that he is the owner. Their dispute is not with regard to how to define where the vegetables are growing; rather, they disagree with regard to who has control over the continued existence of these plants. Therefore, this dispute is not related to the issue of the plant that is growing on the border.

10The Gemara asks: But still, do they not disagree with regard to a case where the plant took root? But isn’t it taught in a baraita ( Tosefta , Ma’asrot 2:22): If there is a tree, and part of it is in Eretz Yisrael and part of it is outside of Eretz Yisrael, then untithed produce and non-sacred produce are mixed together in each one of these tree’s fruits; this is the statement of Rabbi Yehuda HaNasi. Rabban Shimon ben Gamliel says: The fruits in the part of the tree that is growing in a place that has an obligation to separate tithes, in Eretz Yisrael, are obligated. And the fruits that are growing in a place that has an exemption from separating tithes, outside of Eretz Yisrael, are exempt.

11What, is it not discussing a case where some of its branches are in Eretz Yisrael and some of its branches are outside of Eretz Yisrael, although its roots are in one of the two locations, and both Rabbi Yehuda HaNasi and Rabban Shimon ben Gamliel agree that the place of the roots does not define the status of the tree?

12The Gemara rejects this: No, it discusses a case where some of the roots are in Eretz Yisrael and some of the roots are outside of Eretz Yisrael. The Gemara asks: And what is the reasoning of Rabban Shimon ben Gamliel? It is not possible to determine which fruits drew nutrients from which roots, so how can he rule that some of the fruits are obligated in tithes and some are not? The Gemara answers: Rabban Shimon ben Gamliel’s statement is referring to a case where a rock divides the roots up to the trunk, and therefore it is possible to distinguish between the parts of the tree that draw nutrients from Eretz Yisrael and the parts that draw nutrients from outside of Eretz Yisrael.

13The Gemara asks: If it is so that the roots are clearly distinguishable, what is the reasoning of Rabbi Yehuda HaNasi? Why does he view the fruits as being a mixture? The Gemara answers: He holds that although there is a division between the roots, they cannot be distinguished from one another, as they then become mixed in the body of the tree.

14The Gemara asks: With regard to what principle do they disagree? The Gemara answers: One Sage, Rabbi Yehuda HaNasi, holds: The air above the ground mixes the nutrients, and one Sage, Rabban Shimon ben Gamliel, holds: This part of the tree stands alone and this part of the tree stands alone. From the roots up to the branches, it is as if the tree were cut along the line of the border.

15§ The mishna taught that Rabbi Yehuda ben Beteira says that one may not write a bill of divorce on a material that enables forgery. Consequently, one may not write a bill of divorce on erased paper or on unfinished leather. The Gemara now clarifies what is defined as unfinished leather. Rabbi Ḥiyya bar Ami said in the name of Ulla: There are three hides, i.e., three stages in the process of tanning hides. At each stage, the hide has a different name: Matza , ḥifa , and diftera .

16Matza , as per its plain meaning, with no additives. It is not salted, and not treated with flour, and not treated with gallnuts. The Gemara clarifies: For what halakha is this type of leather mentioned? There is a halakha that mentions the minimum measure of this type of leather for which one is liable if he carries it out from one domain to another on Shabbat. And how much is the measure that determines liability for carrying out this hide on Shabbat? As Rav Shmuel bar Rav Yehuda teaches: It is equivalent to that which is used to wrap around a small weight. And how big is this small weight? Abaye said: A quarter of a quarter of a litra in the system of weights in use in Pumbedita.

17Ḥifa is hide that is salted, and not treated with flour, and not treated with gallnuts. For what halakha was this type of leather mentioned? There is a halakha that mentions the minimum measure of this type of leather for which one is liable if he carries it out from one domain to another on Shabbat. And how much is the measure that determines liability for carrying out this hide on Shabbat? As we learned in a mishna ( Shabbat 78b): The measure that determines liability for carrying out this hide is equivalent to that which is used to make an amulet.

18Diftera is hide that is salted, and treated with flour, and not treated with gallnuts. For what halakha was this type of leather mentioned? There is a halakha that mentions the minimum measure of this type of leather for which one is liable if he carries it out from one domain to another on Shabbat. And how much is the measure that determines liability for carrying out this hide on Shabbat? The measure that determines liability for carrying it out is equivalent to the amount on which a bill of divorce is written.

19The mishna taught that the Rabbis deem valid bills of divorce that were written on erased paper or on unfinished leather. The Gemara asks: Who are these Rabbis? The amora Rabbi Elazar said:

    Tosafot

עציץ של אחד וזרעים של אחר‎—A flowerpot belonging to one, and the plants belonging to another O VERVIEW The גמרא teaches us that if one owns a flowerpot and the other owns the plants in the flowerpot, if they wish to transfer ownership, the plant owner can acquire the עציץ through משיכה, however the בעל העציץ cannot acquire the זרעים במשיכה, since it is considered like קרקע and needs to be acquired בחזקה‎. Our תוספות discusses the advantage of teaching us this rule in this particular manner. -------------------------- תוספות comments: הוא הדין דהוה מצי לאשמועינן הכל בעציץ וזרעים של אחד – It is just as true that the גמרא could have informed us all these laws in a situation where the עציץ and the זרעים belonged to one person – אלא לרבותא נקט הכי דאף על גב דבעל עציץ קונה זרעים לא קנה‎ – Rather the גמרא mentioned this situation for a novelty, that even though it is the owner of the עציץ who is acquiring the זרעים, nevertheless he does not acquire the זרעים (with משיכה) – אף על פי שהם בתוך העציץ שלו: Even though the זרעים are within his עציץ‎. S UMMARY There is a novelty that the בעל העציץ does not acquire the זרעים which are in his עציץ‎. T HINKING IT OVER 1. Why indeed cannot the בעל העציץ be קונה the זרעים through קנין חצר (like the cases of כליו של קונה, which are considered his חצר)? 2. Why cannot we learn this ruling by עציץ וזרעים של אחד, where he sold both to one person and he made a משיכה (in the עציץ) and nevertheless he is not קונה the זרעים‎?!

החזיק בזרעים קנה עציץ‎—He took possession of the plants, he acquired the flowerpot O VERVIEW The גמרא rules that if one sells a flowerpot with plants in it, as soon as he makes a חזקה in the זרעים he acquire the עציץ‎. Our תוספות discusses whether the מוכר is required to say אגב וקני in order for the buyer to acquire the עציץ‎. ------------------------------- צריך עיון אם צריך לומר אגב וקני כמו בעלמא כדאמרינן בפרק קמא דקידושין (דף כז, א) – Contemplation is required to decide whether it is necessary for the seller to say, ‘אגב וקני’, just as this requirement is elsewhere, as the גמרא rules in the first פרק of מסכת קידושין‎ – או שמא הכא לא צריך דכיון דצריך עציץ לזרעים בטל אגב זרעים‎ – Or perhaps here it is not necessary that he be told אגב וקני, for since the עציץ is necessary for the זרעים, the עציץ is בטל to the זרעים‎ – תוספות cites a similar case: וכן גבי שטר כיון שהחזיק בקרקע נקנה השטר בכל מקום שהוא‎ – And similarly by שטר where the rule is, as soon as he takes possession of the land he acquires the שטר wherever it is; the same query applies, whether the seller is required to tell him אגב וקני regarding the שטר, or he is קונה the שטר even without אגב וקני – ושמא התם לא בעינן אגב משום דשטר אפסרא דארעא הוא: And perhaps there (by the שטר) we do not require that the מוכר say אגב, because the שטר is the ‘reins of the land’. S UMMARY תוספות is uncertain whether אגב וקני is required by an עציץ and a שטר‎. T HINKING IT OVER Is it possible to say that by עציץ there is more reason to assume that אגב is not required, even more so than by שטר‎?

בתר נקבו אזלינן‎—We follow its perforation O VERVIEW אביי ruled that if there was an עציץ נקוב, whose perforation was in ארץ ישראל, however the branches extended into חוץ לארץ, we look at the נקב, and since the נקב is in א"י, it is מחוייב במעשר‎. Our תוספות contrasts the nourishment received through the perforation with another type of nourishment. ----------------------------- למאן דאמר בהעור והרוטב (חולין קכח, א.) בדלעת הנטוע בעציץ שאינו נקוב – According to the one who maintains in פרק העור והרוטב regarding a squash, which is planted in a non-perforated עציץ‎ – ויצאה חוץ לעציץ הטמא בטומאתו והטהור בטהרתו – And part of the squash extended outside of the עציץ, the טמא retains its טומאה status, and the טהור retains its טהרה status; according to this מ"ד – הוא הדין אם עציץ בחוצה לארץ ונופו נוטה לארץ‎ – The same ruling will apply if the עציץ is in חו"ל and its branch extends into א"י – דמהני יניקת הנוף לענין נוף גופיה וחייב במעשר‎ – That the nourishment of the branch from א"י will be effective regarding this branch itself that it is חייב במעשר, but not the part that is within the עציץ‎ – מכל מקום לא חשיבא יניקת הנוף כיניקת שורש‎ – Nevertheless the יניקת הנוף is not as significant as the nourishment of the root – דהא לא מטהרה יניקת הנוף מה שבתוך העציץ והכא מחייב נוף מחמת יניקת העיקר: For the יניקת הנוף does not bestow טהרה on what is growing within the עציץ, only on what grows outside the עציץ, however here the נוף is obligated in מעשר on account of the nourishment of the main part of the plant. S UMMARY The nourishment that the plant receives from the ground by an עציץ נקוב is greater than the nourishment it receives from the ground through its branches. T HINKING IT OVER 1. תוספות finds it necessary to distinguish between the ruling of אביי (that the entire עציץ is מחויב במעשר), and the ruling in חולין (by ר"ש) that only the extended part is considered מחובר (or is מחויב במעשר). However the חכמים disagree with ר"ש (there) and maintain that the entire עציץ is טהור (and will be מחויב במעשר); why is it necessary to reconcile אביי with a דעת יחיד‎?! 2. רבא argues with אביי and maintains that בתר נופו אזלינן and it is פטור‎. However according to תוספות that יניקת השורש is stronger than יניקת הנוף, so if the חכמים maintain that we follow יניקת הנוף, so in our case of עציץ נקוב we should certainly follow יניקת השורש, and it should be מחויב במעשר‎!

ובדאשרוש לא פליגי והתנן שתי גנות כולי‎ —And do they not argue when it took root; but be learnt, ‘two gardens, etc.’ O VERVIEW The גמרא said that אביי ורבא both agree that if the עציץ נקוב took root in the ground, that we follow the root, but not the branch. The גמרא challenged this assumption that we follow the root, from a משנה where there is a dispute whether we follow the root or the plant. ------------------------- קא סלקא דעתין דהא דקתני סיפא אמר רבי מאיר ומה אם ירצה העליון כולי – The questioner (who asked ובדאשרוש לא פליגי) assumed that this which it states in the סיפא of that משנה (cited here), ‘ ר"מ argues, and what if the upper owner will want, etc.’; regarding this statement, the questioner assumed – שאין זה עיקר הטעם מדקתני נמי התם‎ – That this logic of ומה אם ירצה העליון וכו' is not the main reason why ר"מ maintains that it belongs to the עליון, since the משנה also states there – אמר רבי מאיר מאחר ששניהן יכולין למחות זה על זה רואין מהיכן ירק זה חי – ‘ר"מ said; since both of them can protest one on the other, we should see from where this vegetable is sustained’; from this statement of ר"מ – משמע דבסברא פליגי אי זה מהן עיקר‎ – It seems that they argue in the logic which one of them is the main sustenance – תוספות supports this contention: ואמרינן נמי התם בגמרא בפרק הבית והעלייה (בבא מציעא דף קיח, ב) ואזדו לטעמייהו‎ – And the גמרא there also states that ר"מ ור"י follow their reasoning elsewhere, regarding – אילן היוצא מן הגזע כולי ותנן נמי גבי ערלה כי האי גוונא – ‘A tree that emerges from the trunk, etc.’, and we also learnt regarding ערלה in a similar fashion – תוספות asks: ותימה דלא מייתי הכא מערלה: And it is astounding, that the גמרא here did not cite the case of ערלה, where we see that even בדאשרוש there is still a dispute. S UMMARY Initially we assumed that the basis of the מחלוקת between ר"מ ור"י (is not who can destroy the plant, but rather it) is whether we follow the root or the plant. T HINKING IT OVER תוספות asks why the גמרא did not cite the case of ערלה‎. Why did not תוספות ask, why the גמרא did not cite the (previous) case of אילן היוצא וכו' regarding a sale?!

לא על נייר מחוק‎—Not on erased paper O VERVIEW ר' יהודה בן בתירא stated in our משנה that a גט may not be written on a paper which was erased. תוספות qualifies this ruling. -------------------------- שהכתב על הנייר שאינו מחוק ועדיו על המחק אבל שניהם על המחק כשר – The ruling of ריב"ב is valid when the writing of the גט was on paper wich was not erased, and the witnesses signed on the erased part of the paper; however if both the גט and the signatures were on the erasure, the גט is כשר‎ – כדאמרינן בריש גט פשוט (בבא בתרא קסד, א) דאינו דומה נמחק פעם אחת לנמחק שתי פעמים: As רב states in the beginning of פרק גט פשוט that an erasure one time is not similar to an erasure two times ; the difference is discernable. S UMMARY One can distinguish between a single erasure and a double erasure. T HINKING IT OVER What would be (according to ריב"ב) if a woman brings us a גט where the signatures are on an erasure, but the גט is written on regular (un-erased) paper (where ריב"ב prohibits us from writing such a גט), is she מגורשת or not? What would the חכמים maintain in such a case?

שלש עורות הן‎—There are three hides O VERVIEW The גמרא here mentions three types of hides (and the amount needed to be חייב for carrying each one on שבת). However the גמרא does not mention (a hide which was completely processed to be) parchment. רש"י and תוספות offer differing explanations. --------------------------------- פירש בקונטרס דקלף גמור לא חשיב בהדייהו דלא שמיה עור‎ – רש"י explained that he does not include finished parchment among these three, because parchment is not called hide – ועוד אומר רבינו יצחק דלא מני בהדייהו קלף‎ – And additionally, says the ר"י, that he does not count קלף among the three – משום דבהדיא תנן ששיעורו כדי לכתוב פרשה קטנה שבתפילין – Because its amount to be liable for הוצאה on שבת is explicitly stated in the משנה, namely there should be sufficient קלף in order to write a small פרשה of תפילין‎ – תוספות anticipates a difficulty with his explanation: ואף על גב דשיעור חיפה דהוי כדי לעשות קמיע שנוי במשנה – And even though that the amount of חיפה hide needed to be חייב for הוצאה, which is a sufficient amount to make an amulet, is also taught in the משנה, so why is it mentioned here again – תוספות responds: מכל מקום לא הזכיר חיפה בהדיא במתניתין: Nevertheless there is a difference, for חיפה is not mentioned explicitly in the משנה, however קלף is mentioned explicitly. S UMMARY קלף is not mentioned either because it is not considered ‘hide’ anymore (רש"י), or because its שיעור was already explicitly mentioned in a משנה elsewhere (תוס'). T HINKING IT OVER Why was תוספות dissatisfied with פירש"י‎?

כדי לכתוב עליו את הגט‎—In order to write a Get on it O VERVIEW The גמרא writes that the שיעור to be חייב for carrying out the דיפתרא hide on שבת, is that it is large enough to write a גט on it. -------------------------------- היינו כרבנן דמכשרי אדיפתרא ולהכי מייתי לה הכא – This ruling (that the שיעור הוצאה for דיפתרא is כדי לכתוב עליו את הגט) is according to the רבנן of our משנה, who permit writing a גט on דיפתרא hide, and that is the reason why the גמרא cites here this ruling of ר"ח בר אסי משמיה דעולא‎ – ואלו השיעורין אינן לפי חשיבות העור דיש שהוא חשוב ושיעורו גדול מן הגרוע ממנו – And these amounts (for the חיוב הוצאה לשבת ) is not according to the value of the hide, for there is a hide which is more valuable and his שיעור is greater than a hide that is his inferior – אלא כל א' שיעורו במה שרגילין לעשות ממנו: Rather the שיעור of each hide is dependent on what this hide is customary used for. S UMMARY The שיעורים of the various עורות depends on their usage [and דיפתרא (according to the חכמים) is used to write גיטין]. T HINKING IT OVER What is the connection between the beginning of תוס' (היינו כרבנן וכו') to the end of תוס' (אלא כל א' שיעורו וכו')?

מאן חכמים רבי אלעזר‎—Who are the Chachomim ; Rabi Elozor O VERVIEW The משנה stated that ריב"ב maintains that a גט may not be written on erased paper or on דיפתרא (since it can be forged); however the חכמים permit it. ר' אלעזר (the אמורא) says that the חכמים of the משנה is ר' אלעזר (the תנא), who maintains עדי מסירה כרתי‎. Our תוספות first cites פרש"י who explains why according to ר"א a גט can be written on something which can be forged, qualifies his ruling, and disagrees with רש"י regarding the view of ר' מאיר‎. --------------------------------- פירש בקונטרס דאמר עדי מסירה עיקר והבאה להנשא צריכה להביא עדי מסירה‎ – רש"י explained that the חכמים who are מכשיר is ר"א, who maintains that the עדי מסירה are the main witnesses who effectuate the גט, so a woman who comes before us to remarry, must bring the עדי מסירה, and they will verify that it was not forged – תוספות comments on this requirement to bring ע"מ if she wants to remarry: ודוקא הכא על דבר שיכול להזדייף אומר רש"י דצריכה עדי מסירה בשעה שבאת להנשא‎ – And it is only specifically here when the גט is written on something which can be forged, does רש"י say that she is required to bring ע"מ when she wants to remarry (according to ר"א) – אבל בגיטין הכתובים בדבר שאינו יכול להזדייף יכולה להנשא על ידי עדי חתימה‎ – However by גיטין which are written on something which cannot be forged, she can remarry based on the ע"ח if they are authenticated, and she is not required to bring the ע"מ – ואפילו לרבי אלעזר כדתנן בפרק בתרא (לקמן פו, א) ומייתי ליה בריש מכילתין – And this ruling (that ע"ח are sufficient) is true even according to ר"א (who maintains ע"מ כרתי) as we learnt in a משנה in the last פרק and it is cited in the beginning of our מסכת‎ – שאין העדים חותמין על הגט אלא מפני תיקון העולם – ‘That witnesses sign on a גט only on account of a global beneficial enactment.’ תוספות cites and disagrees with רש"י regarding ר"מ: אבל מה שפירש בקונטרס דלרבי מאיר אשה הבאה לינשא בגט הכתוב על דבר שיכול להזדייף‎ – However this which רש"י explained that according to ר"מ, a woman who comes to remarry with a גט which is written on a דבר שיכול להזדייף ; this woman – אינה צריכה עדי מסירה ועדים החתומים בו אינה מביאה לפנינו אם יש מכירין חתימתן – Does not require ע"מ at all, and she does not bring the ע"ח who signed the גט, if there are others who recognize their signature ואי הוה ביה תנאה וזייפתיה ליכא דידע‎ – So if there was a stipulation in the גט (detrimental to the woman) and she forged it (removing or altering that stipulation) no one will know. Therefore according to ר"מ a גט cannot be written on a דבר שיכול להזדייף‎. This concludes פרש"י. תוספות comments – משמע דאי הוי סהדי קמן הוה כשר‎ – It seems from רש"י that if the עדים were brought before us it would be כשר (if the woman brought the actual ע"ח or ע"מ) – ואי אפשר לומר כן דלרבי מאיר בעינן שיהא מוכח מתוכו כדמשמע בריש כל הגט (לקמן כד, ב) – And it is impossible to say this (that the גט will be כשר if the ע"ח (or ע"מ) come and testify that nothing was altered), for according to ר"מ we require that it should be מוכח מתוכו, as it seems in the beginning of פרק כל הגט‎ – ובדבר שיכול להזדייף אין מוכיח מתוכו כלום: And when the גט is written on a דבר שיכול להזדייף, nothing is מוכח מתוכו‎. S UMMARY A woman must bring ע"מ (according to ר"א), only if it is a כתב שיכול להזדייף, otherwise we can rely on the ע"ח. According to ר"מ even if she brings עדים that nothing was changed it is not effective since it is not מוכח מתוכו (רש"י seems to disagree). T HINKING IT OVER According to (תוספות understanding of) רש"י that if the ע"ח come before us it will be כשר even according to ר"מ; what is the difference between ר"מ who is פוסל on a כתב שיכול להזדייף and ר"א who is מכשיר, since both agree (and require) that if the עדים come before us (the ע"ח according to ר"מ, or the ע"מ according to ר"א), it will be valid?!
