    Gittin 29b

    Chapter 3 - Kol HaGet

גם: גיטין דף כ״ט ע״ב, פרק ג׳ כל הגט

    English translation - Gittin 29b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1Take an item from her and then give her the bill of divorce, and he went and gave her the bill of divorce and then took the item from her. Rabbi Yoḥanan invalidates the bill of divorce even when given by the first agent, as he deviated from the husband’s instructions, and his agency is canceled, and all the more so does Rabbi Yoḥanan invalidate the bill of divorce when delivered by the first agent’s agent. And Reish Lakish deems the bill of divorce valid when it is delivered by the first agent’s agent, and all the more so when it is delivered by the first agent himself.

2MISHNA: With regard to an agent who is bringing a bill of divorce from a country overseas, who must attest to the fact that he witnessed the writing and signing of the bill of divorce, and he became sick and cannot complete his agency, he appoints another agent in court and sends him. And the first agent says before the court: It was written in my presence and it was signed in my presence, and on the basis of this the court deems the bill of divorce to be valid. And the final agent does not need to say: It was written in my presence and it was signed in my presence. Rather, it is sufficient that he says: I am an agent of the court.

3GEMARA: The Sages said to Avimei, son of Rabbi Abbahu: Raise the following dilemma before your father, Rabbi Abbahu: Can an agent of the first agent also appoint another agent, or not? He said to them: You should not raise this dilemma. From the fact that the mishna teaches: The final agent does not need to say, as opposed to: The second agent does not need to say, it can be seen by inference that the second agent can appoint an agent, resulting in the existence of a final agent, not just a second agent.

4Rather, when you raise the dilemma, this is what you should ask: When the second agent appoints another agent, does he need to appoint him specifically in court, or can he do so even while not in court? They said to him: We do not raise this dilemma, as from the fact that it teaches: Rather, he says: I am an agent of the court, it is clear that any agent in this role must be appointed in court.

5The Gemara cites another version of the discussion. Rav Naḥman bar Yitzḥak would teach like this: The Sages said to Avimei, son of Rabbi Abbahu: Raise the following dilemma before your father, Rabbi Abbahu: When the agent of the first agent appoints another agent, does he need to appoint him specifically in court, or can he do so even while not in court?

6He said to them: And you should raise the dilemma as to whether generally the agent of the first agent can appoint another agent. They said to him: We do not raise this dilemma, as we learned in the mishna: The final agent does not need to say, and by inference it can be seen that the second agent can appoint an agent. Rather, when the dilemma was raised to us, it was with respect to whether this must take place in court, or if it can take place while not in court. He said to them: You should also not raise this dilemma, as the mishna teaches: Rather, he says: I am an agent of the court, which shows that the subsequent appointments must take place in court.

7§ Rabba says: An agent in Eretz Yisrael can appoint several agents, i.e., he can appoint an agent, and the second agent can appoint another agent in his place. All of this can take place outside of court, because when a bill of divorce is sent within Eretz Yisrael there is no need to testify that it was written and signed in the agent’s presence. Rav Ashi says: If the first agent died, then they are all canceled, as all the agents act on the basis of the first agent. With his death, the agency is canceled.

8Mar bar Rav Ashi said: This statement of my father is from the time of his youth, and it is not correct, as, if the husband dies, even if all of the agents are alive, is there is any significance to any of them? All of them, from whose authority do they come to deliver the bill of divorce? They come from the husband’s authority. Therefore, if the husband is alive, then they are all able to act as agents; if the husband is not alive, then they are all not agents. The status of the agents is dependent on the husband, not on the first agent.

9§ The Gemara relates: There was an incident involving a certain man who sent a bill of divorce to his wife with an agent. The agent said: I do not know her. The husband said to him: Go give the bill of divorce to Abba bar Minyumi, as he knows her, and he will go and give it to her. The agent came and did not find Abba bar Minyumi, and he did not know what to do. He found Rabbi Abbahu and Rabbi Ḥanina bar Pappa and Rabbi Yitzḥak Nappaḥa, and Rav Safra was sitting among them. The agent asked them what he should do. The first three Sages said to him: Transfer your words, i.e., your agency, before us, as when Abba bar Minyumi comes, we will give the bill of divorce to him, and he will go and give it to her.

10Rav Safra said to them: But isn’t he an agent who is not granted the ability to effect divorce, as he was given only the authority to transfer the bill of divorce to Abba bar Minyumi? Therefore, he cannot transfer the agency to another person. These Sages were embarrassed that they ruled improperly.

11Rava said: Rav Safra struck [ kappeḥinhu ] a blow to three ordained Sages, as although he was from Babylonia and not ordained, he was correct. Rav Ashi said: With what did he strike them? He did not conclusively refute their opinion, as, did the husband say to the agent: Abba bar Minyumi should deliver the bill of divorce and not you? Rather, he appointed this agent to deliver the bill of divorce, and added that if he cannot find the wife, then he can transfer the bill of divorce to Abba bar Minyumi.

12The Gemara cites another version of the discussion: There are those who say that Rava said: Rav Safra struck three ordained Sages mistakenly. Rav Ashi questioned Rava and said: What was the mistake? After all, what did the husband say to the agent? He said that Abba bar Minyumi should give his wife the bill of divorce, meaning that he and not you should give it, and Rav Safra’s ruling was correct.

13The Gemara relates a similar incident: There was an incident involving a certain man who sent a bill of divorce to his wife with an agent. He said to the agent: Do not give the bill of divorce to her until thirty days have passed. Circumstances occurred within the thirty days that were beyond the agent’s control, and he saw that he would not be able to wait and give the wife the bill of divorce after thirty days, as per the husband’s instructions.

14The agent came before Rava and asked what he should do. Rava said: What is the reason that the mishna permits an agent who became sick to appoint another agent in his place? It is because he is a victim of circumstances beyond his control, and in the case of this one as well, he is a victim of circumstances beyond his control. Rava said to the agent: Transfer your words, i.e., your agency, before us and we will serve as a court, so that after thirty days we will appoint an agent and he will give the bill of divorce to her. The Sages said to Rava: But isn’t he an agent who is not granted the ability to effect divorce, as within the thirty days he does not have the authority to divorce her? He said to them: Since it is so that after thirty days he is able to divorce her, he is considered an agent who is granted the ability to effect divorce.

15The Sages challenged Rava again: But in any case where an agent does not deliver a bill of divorce immediately, let there be a concern that perhaps the husband was mollified and decided not to divorce his wife, thereby canceling the bill of divorce. Didn’t we learn in a mishna (76b): If, before traveling, a husband gives his wife a bill of divorce and says that it takes effect from now if I do not arrive from now until twelve months have passed, and he died within the twelve months, then this is a valid bill of divorce?

16And we discussed this halakha : And let there be a concern that perhaps the husband was mollified and decided not to divorce his wife, and canceled the bill of divorce. And Rabba bar Rav Huna said: This is what my father, my master, Rav Huna, said in the name of Rav: The mishna is referring to a case where the husband says: My wife is deemed credible to say that I did not arrive. Since the husband abrogated his right to contest the validity of the divorce by granting absolute credibility to his wife, there is no concern that he may have canceled the bill of divorce, as even if he were to claim that he had done so, his claim would not be accepted. By contrast, in this incident, where the wife was never granted such credibility, there is a concern that perhaps he canceled the bill of divorce.

17Rava was embarrassed that he ruled incorrectly. Ultimately, the matter was revealed that this woman was the husband’s betrothed and that they had not married. Rava said: If they said that there is a concern with regard to a married woman that perhaps he was mollified, would they say the same with regard to a betrothed woman, whom he does not know well? Therefore, my ruling was correct.

18Rava said: We certainly raise this dilemma:

שקול מינה חפץ והדר הב לה גיטא‎—Take the object from her and give her the Get afterwards O VERVIEW The גמרא cited a dispute between ר"י ור"ל in a case where the husband told the שליח הגט, take an object from my wife and afterwards give her the גט‎. Our תוספות reconciles our גמרא with a seemingly contradictory גמרא‎. ------------------------------- משמע דוקא שהקפיד על לקיחת החפץ תחלה פליגי‎ – It seems that ר"י ור"ל argue only in this case where the husband was insistent that he first take the object, therefore ר"י maintains that it is פסול‎ – אבל הב לה גיטא ושקול מינה חפץ לא – However if the husband would have said, ‘ give her the גט and take an object from her’, there would be no dispute, even ר"י would agree that the גט is כשר‎. תוספות asks: ותימה דבפרק הכותב (כתובות דף פה, א) אמרינן דלא שנא אמר ליה שקול שטרא והב ליה זוזי‎ – And it is astounding! For in פרק הכותב the גמרא states; ‘it makes no difference, whether he told the שליח, ‘take back the שטר חוב and give him the money’ – ולא שנא אמר ליה הב ליה זוזי ושקול שטרא משלם דאמר ליה לתקוני שדרתיך ולא לעוותי‎ – Or whether he said, ‘give him the money and take back the שטר’, in either case the שליח must pay, for the sender can say to the שליח, ‘ I sent you for my benefit, but not for my ruin’’; the reason the שליח is always liable is – כיון שהזכיר לקיחת השטר אף על פי שהזכיר לבסוף – Since the sender mentioned taking the שטר, even though he mentioned taking the שטר back last (he said הב ליה זוזי ושקול שטרא), for the שליח should have understood on his own that before he pays, he should take back the שטר‎. Similarly the same ruling should be here, since the owner wants the object, the שליח should not have given her the גט, until he retrieved the object. תוספות answers by distinguishing between the two cases: ויש לומר דשאני התם שפרעון המעות תלוין בשטר – And one can say; that there it is different, for the payment of money is dependent on the שטר‎ – ובהזכרת לקיחת השטר גלי דעתיה שירא שלא יאמרו סיטראי נינהו: So when he mentioned taking back the שטר, he let it be known that he was concerned that they should not claim these monies are for another debt. S UMMARY Paying a חוב and retrieving a שטר are intertwined, therefore no matter what he said first, the שליח should have retrieved the שטר first. The same cannot be said regarding a גט and קבלת חפץ‎. T HINKING IT OVER The inference of תוספות answer (as explained in footnote # 5) is that it is self-understood that the שליח should request the שטר even if the לוה did not tell him. However one may ask that if the לוה would not tell him, the שליח may think that it was a מלוה ע"פ without a שטר‎. Therefore there is seemingly no indication from the fact that the לוה asked him to retrieve the שטר, that he was concerned for סטראי נינהו, it could merely be that he was informing him that it is a מלוה בשטר‎!

רבי יוחנן פוסל בו וכל שכן בשלוחו‎— Rabi Yochonon disqualifies it by him and certainly by his agent O VERVIEW The משנה taught that if the husband says to the שליח הגט, ‘take from her a certain item which is mine’, the שליח may not send it (the גט) with someone else, because אין רצונו שיהא פקדונו ביד אחר (he does not want his deposit to be in another’s possession). The גמרא cited a dispute in a case where the husband said to the שליח, ‘take the item from her and afterwards give her the גט’, however in fact the שליח gave her the גט first and then retrieved the item from her. ר' יוחנן maintains that whether it was the original שליח who did not follow the directive of the husband, and certainly if it was a second שליח (appointed by the first שליח), the גט is פסול‎. While ריש לקיש maintains that it is כשר in both cases. There is a dispute between רש"י and תוספות how to understand this גמרא‎. -------------------------------- פירש בקונטרס דקפידת הבעל אינו אלא שלא ישאר החפץ ביד האשה‎ – רש"י explained that the husband is only insistent that the item should not remain in his wife’s possession – אבל במה שאמר ליה שיטול הימנה חפץ והוא משלח ביד אחר אין הגט נפסל – However regarding this which the husband told the שליח that he should take the item from her, and the שליח a ppointed another שליח to retrieve the item; that will not cause that the גט should be disqualified, for even though the husband may be particular as to who will receive the item from his wife, nevertheless it is not sufficient to disqualify the גט – תוספות clarifies a potential difficulty according to פרש"י: ולא ישלחנו ביד אחר דקתני במתניתין היינו טעמא שמא לא ימסור לשני דברים כהוייתן‎ – And this which our משנה stated; ‘and he should not send it through another שליח’, the reason for this ruling is that perhaps the first שליח may not give over the instructions properly to the second שליח‎ – או השני לא ידקדק בהן ויפסול הגט – Or perhaps the second שליח will not be that careful to follow those instructions, and the גט will become פסול‎. This concludes פרש"י (according to תוספות). תוספות comments on פרש"י: ולפי זה הא דקתני שאין רצונו שיהא פקדונו ביד אחר היינו ביד אשתו‎ – And according to this interpretation (of רש"י), this which the משנה states (as a reason why לא ישלחנו ביד אחר, is because) ‘ he does not want that his deposit should be by someone else’, this אחר refers to his wife, but not to the second שליח‎ – In summation; ר' יוחנן rules that if the husband told the שליח to first take the item and then give the גט, we assume that the husband is מקפיד that the item should not be by the woman (ביד אחר), so therefore if the שליח (the first or the second) gave the גט before retrieving the item, the גט is פסול‎. The משנה teaches us that the first שליח should not appoint a second שליח in this case, since there is the likelihood that the husband’s instructions will not be followed. תוספות disagrees with פרש"י: וזה נראה דוחק וגם זה דוחק דלא ישלחנו ביד אחר שלא ישכח לומר כאשר אמר הבעל‎ – And this explanation seems to be strained, and it is also difficult that the reason why לא ישלחנו ביד אחר is because we are concerned that the first שליח should not forget to tell the second שליח the directive which the husband gave him – תוספות offers his interpretation: ונראה לרבינו יצחק בן אברהם דכשאמר שקול מינה חפץ והדר הב לה גיטא‎ – And it seems to the ריב"א that when the husband said to the שליח, ‘ take the item from her, and afterwards give her the גט’ – שתולה שליחות הגט בחפץ פוסל רבי יוחנן נמי כשמשלח ביד אחר‎ – So the husband made the delivery of the גט dependent on retrieving item, therefore ר"י disqualifies the גט, when the first שליח sends it with another שליח‎ – אפילו לא שינה שליח השני מדעת הבעל ונטל ממנה החפץ קודם נתינת הגט‎ – Even though the second שליח did not change the wishes of the husband and took the item from her before he delivered the גט; it is still פסול‎ – דכיון שתולה שליחות הגט בחפץ כל מה שמשנה מדעת הבעל בחפץ נפסל הגט‎ – For since the delivery of the גט is dependent on retrieving the item, whatever the first שליח changes from the husband’s wishes regarding the item (like appointing another שליח in his stead), will disqualify the גט‎ – והכי פירושו רבי יוחנן פוסל בו בשליח ראשון כששינה וכל שכן בשלוחו ואפילו בלא שינוי‎ – And this is the explanation of the גמרא that ר"י is פוסל בו meaning the first שליח, in a case where he changed the order (and gave the גט first), and ר"י is certainly פוסל by the second שליח, even if he did not change, but followed the instructions – ולא ישלחנו ביד אחר אפילו לא ישנה דקפיד הבעל שאין רצונו שיהא פקדונו ביד אחר‎ – And when the משנה stated לא ישלחנו ביד אחר'’, it means even if the second שליח will not change, since the husband is particular about wanting the first שליח only, for אין רצונו שיהא פקדונו ביד אחר‎ – פירוש ביד השליח השני וריש לקיש כולי כדפירש בקונטרס: Which (אחר) means in the hands of the second שליח, however ר"ל maintains, etc. that it is a גט כשר in both instances as רש"י explained. S UMMARY According to רש"י the ruling of ר"י is when the שליח (either one) was משנה, and the משנה rules that לא ישלחנו ביד אחר, because maybe he will be משנה‎. According to תוספות when the משנה states לא ישלחנו ביד אחר it will be פסול if he sends it with another שליח, even if he is not משנה‎. T HINKING IT OVER תוספות explains that when ר"י ruled וכ"ש בשלוחו it means that it is פסול even if לא שינה‎. Why therefore did ר"י say that by שלוחו it is כ"ש that it is פסול, why is it a כ"ש, in fact since the שליח שני was not משנה, why should it be פסול at all?!

הכי גרס רבינו תם אמר רב אשי מאי טעותא מי קאמר ליה אבא בר מניומי ולא את‎—This is how ר"ת is גורס; “רב אשי said; what is the mistake, did he say to him, ‘אבא בר מניומי but not you’” O VERVIEW A person sent a שליח to divorce his wife. When the שליח said, ‘I do not know her’, the husband said, give it to אבא בר מניומי; he knows her and will give it to her’. The שליח could not find אבא when he met three other sages, and they said, ‘give us the גט (and say בפ"נ וכו') and we will give it to אבא’. However רב ספרא said that this שליח is not a שליח שניתן לגירושין and therefore cannot give it over to others (except for אבא). There are two versions of what followed. רבא either said that רב ספרא undermined these three sages, or he said רב ספרא was incorrect in his objection. רש"י maintains that in both versions, רב אשי disagreed with רבא‎. Our תוספות disagrees. ------------------------------- וקאתי רב אשי לפרש מאי טעותא ולב' הלשונות רב אשי מכוונים‎ – And in the second version, רב אשי is explaining why sרב ספרא' objection was erroneous as רבא maintained, and according to both versions, רב אשי is consistent that רב ספרא was incorrect stating that he was a שליח שלא ניתן לגירושין‎ – ולא קאי איכא דאמרי אלא אמילתא דרבא: And when the גמרא stated איכא דאמרי; indicating that this is a different version; that was referring only to רבא, but not to רב אשי‎. S UMMARY רב אשי always maintains that he is a שליח לגירושין T HINKING IT OVER What are the relative advantages of these two גירסאות‎?
