    Gittin 23b

    Chapter 2 - HaMevi Batra

גם: גיטין דף כ״ג ע״ב, פרק ב׳ המביא בתרא

    English translation - Gittin 23b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1one can learn by inference that a slave is fit. Rav Asi says that Rabbi Yoḥanan says: A slave cannot become an agent to receive a bill of divorce for a woman from the hand of her husband, because he is not included in the halakhot of divorce and betrothal, and one can act as an agent only in a matter that applies to him.

2Rabbi Elazar objects to this explanation as to why a slave cannot act as an agent: The reason that a slave is unfit is that this agency pertains to a matter whose halakhot he is not included in, but for a matter whose halakhot he is included in, i.e., a mitzva that applies to a slave, is he fit to serve as an agent?

3But what of a gentile and a Samaritan, who are included in the halakhot of teruma with regard to their own produce, i.e., they must designate a portion of it for the priest, as we learned in a mishna ( Terumot 3:9): With regard to a gentile and a Samaritan that separated teruma from their own produce, their teruma is considered teruma . And yet we learned in a different mishna ( Terumot 1:1): In the case of a gentile who separated teruma from a Jew’s produce, i.e., acted as his agent, even if he did so with permission from the Jew, his teruma is not teruma .

4What is the reason for this? Is it not because it is written “you” in the verse that is the source for the halakhot of agency: “So you also shall set apart a gift unto the Lord of all your tithes” (Numbers 18:28), and the Sages expound the expression “so you also” to mean the following: Just as you, the ones appointing the agents, are Jews, so too, your agents must be Jews. Since slaves are not full-fledged Jews, they should be disqualified from ever acting as agents, even in a matter in which they are included in its halakhot .

5The Sages from the school of Rabbi Yannai say: No, the verse should be expounded in the following manner: Just as you, the ones appointing the agents, are members of the covenant, so too, your agents must be members of the covenant. Gentiles cannot serve as agents because they are not members of the covenant. Slaves, whose masters are commanded to circumcise them and who are obligated in some of the mitzvot, are members of the covenant, and they can serve as agents in a matter in which they are included in its halakhot .

6The Gemara quotes a related statement: Rabbi Ḥiyya bar Abba says that Rabbi Yoḥanan says: A slave cannot become an agent to receive a bill of divorce for a woman from the hand of her husband, because he is not included in the halakhot of divorce and betrothal. And although we learned: If a person said to his female slave: Behold you are still a maidservant and your unborn child is a freeman, if she was pregnant at that time, then she acquired freedom for the unborn child.

7The Gemara first clarifies: What is the connection between the initial statement of Rabbi Yoḥanan and the clause: If she was pregnant at that time, she acquired freedom for the unborn child? When Rav Shmuel bar Yehuda came, he said: Rabbi Yoḥanan said two distinct statements: The first statement was that a slave cannot be appointed as an agent to receive a bill of divorce for a woman from her husband, and the other was: It appears that a slave can receive a bill of manumission for his fellow slave from the hand of his fellow’s master, but not from the hand of his own master if both of them are enslaved by the same person.

8And if a person will whisper a question to you, saying: This ruling, that a slave cannot receive a bill of manumission for his fellow slave from their common master, is difficult, as a halakha was taught that states the opposite: If a maidservant was pregnant at that time, then she acquired freedom for the unborn child, and the child and mother both belong to the same master, then say to him that two greats of the generation already explained the matter, and they are Rabbi Zeira and Rabbi Shmuel bar Rav Yitzḥak.

9One of them said: In accordance with whose opinion is this? It is in accordance with the opinion of Rabbi Yehuda HaNasi, who says: With regard to one who emancipates half of his slave, the slave acquires freedom for half of himself, and one of them added an explanation and said: What is the reasoning of Rabbi Yehuda HaNasi for this ruling? He holds: A fetus is considered as its mother’s thigh, i.e., a part of its mother’s body, and it is as though the master transferred ownership of one of her limbs to her. Since the maidservant is pregnant, the child is considered to be a part of her, and it is as though he emancipated a portion of her body. Therefore, the mother is not acting as an agent for the child, and this halakha does not present a difficulty for Rabbi Yoḥanan’s opinion.

10MISHNA: There are instances in which a woman’s testimony that another woman’s husband has died is not deemed credible ( Yevamot 117a). If there is a presumption that due to their familial relationship the two women hate each other, there is concern that the woman is testifying falsely in order to harm the other woman. By doing so, she can cause the other woman to remarry. If her original husband then proves to be living, she will be required to leave her second husband. This mishna teaches: Even the women who are not deemed credible to testify on behalf of a woman and say: Her husband died, and she is permitted to remarry, are deemed credible to bring her bill of divorce. The relatives of the woman who are not deemed credible to testify that her husband has died are: Her mother-in-law; and her mother-in-law’s daughter; and her rival wife, i.e., another wife of her husband’s; and her yevama , i.e., her husband’s brother’s wife; and her husband’s daughter.

11The mishna explains: What is the difference between a bill of divorce and death, that certain women are deemed credible to testify about one but not the other? With regard to a bill of divorce, it is so that the writing proves that the husband is divorcing his wife, and the testimony is needed only to supplement the bill of divorce. Similarly, the woman herself may bring her own bill of divorce, provided that she is required by the court to state in its presence: It was written in my presence and it was signed in my presence, as the Gemara will explain.

12GEMARA: The Gemara asks: But isn’t it taught in a baraita : Just as these women are not deemed credible to say: Her husband died, so too, they are not deemed credible to bring her bill of divorce. Rav Yosef said: It is not difficult. Here, this mishna is referring to a case that took place in Eretz Yisrael. There, the baraita is referring to a case that took place outside of Eretz Yisrael.

13The Gemara explains the difference: In a case that takes place in Eretz Yisrael, where, to validate the bill of divorce we do not rely on her statement of: It was written in my presence and it was signed in my presence, she serves only as an agent. Consequently, she is deemed credible to bring the bill of divorce. However, in a case that takes place outside of Eretz Yisrael, where we rely on her statement of: It was written in my presence and it was signed in my presence, and no one can contest the validity of the bill of divorce after her statement has been accepted, she is not deemed credible, as there is a concern that this woman may be intentionally lying in order to cause harm.

14Abaye said to him: On the contrary, the opposite is more reasonable, and the distinction should be: In Eretz Yisrael, where if the husband were to come and contest the validity of the bill of divorce, we would pay attention to him and rule that they are not divorced, where it could be said that the woman who hates her intends to do her harm by having her remarry based on a bill of divorce that was later contested, she is not deemed credible. However, outside of Eretz Yisrael, where if the husband were to come and contest the validity of the bill of divorce, we would not pay attention to him, she is deemed credible, as she does not have the power to make trouble for the other woman and cause her to have to leave her second husband.

15The Gemara notes that it is taught in a baraita in accordance with the opinion of Abaye ( Tosefta 2:6): Rabbi Shimon ben Elazar says in the name of Rabbi Akiva: A woman is deemed credible to bring her own bill of divorce through an a fortiori inference: Just as women about whom the Sages said: They are not deemed credible to say: Her husband died, are nevertheless deemed credible to bring her bill of divorce, with regard to the woman herself, who is deemed credible to say that her husband died, is it not right that she is deemed credible to bring her own bill of divorce?

    Tosafot

אין העבד נעשה שליח כולי‎—A slave cannot become an agent, etc - O VERVIEW The משנה stated that a נכרי is פסול to bring a גט‎. The גמרא discussed what is the rule concerning an עבד כנעני; to which רב אסי said in the name of ר' יוחנן that an עבד cannot be a שליח to receive a גט‎. -------------------------------- תוספות asks: ואם תאמר ומתניתין ליתני עבד וכל שכן עובד כוכבים – And if you will say; why does not our משנה teach us that an עבד is פסול to be a שליח הגט, and we would know that a נכרי is certainly פסול‎ – תוספות offers a partial response: וללישנא דאמר רבי יוחנן לעיל זו אין תורה ניחא‎ – And according to the version that ר"י said previously, ‘this is not the law’, it is understood – דנקט עובד כוכבים למידק דלענין כתיבה אפילו עובד כוכבים כשר – That the reason our משנה mentions a נכרי (that he is פסול to be a שליח), is for the inference, that he is only פסול for a שליח, however regarding writing a גט, even a נכרי is כשר‎ – אבל להך לישנא דמוקי רבי יוחנן כרבי אלעזר קשה מהך דרבי יוחנן דהכא – However according to the version that ר"י establishes the משניות like ר"א (that we require כתיבה לשמה) there is a difficulty from this ruling of ר"י here – תוספות answers: ואומר רבינו תם דנקט עובד כוכבים לאשמועינן עובד כוכבים ונתגייר פסול – And the ר"ת answers that the משנה mentions a נכרי to inform us the rule that if he was a נכרי when he received the גט and he was later מתגייר he is פסול to deliver the גט even after he was נתגייר‎ – אף על פי שבאותה שעה היתה דעתו להתגייר – Even though that at that time when he received the גט as a נכרי he intended to be מתגייר, nevertheless he is פסול; this חידוש‎ – דהוי בעובד כוכבים רבותא טפי מבעבד שאין בידו להשתחרר: Is a greater novelty by a נכרי, who has the ability to be מתגייר than by an עבד who does not have the ability to be freed. S UMMARY The משנה mentions נכרי (not עבד) either for the inference that he is כשר for כתיבה, or that even though he intended to be מתגייר he still cannot be a שליח‎. T HINKING IT OVER Why should there be even a הוה אמינא that since he intends to be נתגייר, he should be כשר to be a שליח, since as of now he is still a נכרי and cannot be a שליח‎?!

לפי שאינו בתורת גיטין וקדושין‎—Because he is not included in the laws of divorce and betrothal O VERVIEW The גמרא concluded that an עבד cannot receive a גט on behalf of a woman since he is not בתורת גיטין וקידושין‎. Our תוספות reconciles our גמרא with a seemingly contradictory גמרא‎. ----------------------------- תוספות replies to an anticipated difficulty: והא דמתגרשת בעבד שלה היינו מטעם חצר: And this that she becomes divorced through her own עבד; that it an account of קנין חצר, but not that he is a שליח‎. S UMMARY A woman can be divorced if the גט is given to her עבד on account of קנין חצר‎. T HINKING IT OVER There is a dispute whether the קנין חצר is משום ידה איתרבאי or משום שליחות איתרבאי‎. How will we answer תוספות question if we maintain חצר משום שליחות איתרבאי; for since the קנין חצר is on account of שליחות and an עבד cannot be a שליח‎?!

העובד כוכבים והכותי שתרמו כולי‎—A Gentile and a Kuti who were Toiraim, etc. O VERVIEW The גמרא cited a משנה which states that if a נכרי or a כותי separated תרומה, it is a valid תרומה and it is forbidden to be eaten by non-כהנים‎. The issue at hand is whether the produce of a נכרי is חייב בתרומה‎. --------------------------------- פירוש בקונטרס דקסבר אין קנין לעובד כוכבים – רש"י explained, the reason there is a חיוב הפרשת תרומה, is because the תנא of this משנה maintains that a נכרי has no acquisition in ארץ ישראל to a degree that he should be able to remove its קדושה regarding תרומות ומעשרות‎ – תוספות offers an alternate interpretation: ונראה לרבינו יצחק דאפילו למאן דאמר יש קנין משכחת לה‎ – And it appears to the ר"י that we can find such a case of חיוב תרו"מ even according to the one who maintains that a נכרי has a קנין in א"י to remove its קדושה regarding תרו"מ; that is in a case כשגדלה שליש ביד ישראל וקנה ממנו עובד כוכבים – When the produce grew a third of its entire growth by a ישראל and the נכרי bought it from him afterwards – תוספות responds to an anticipated difficulty: ולא מיפטר מטעם לוקח דתבואת זרעך קרינא ביה כיון שגדלה הרבה ביד עובד כוכבים‎ – And it does not become now exempt from תרו"מ by the נכרי on account that it was purchased, because we ‘read’ (call) this produce as being תבואת זרעך (produce of your seed), since it grew a lot by the נכרי‎ – תוספות offers an alternate scenario: אי נמי כשזרעה העובד כוכבים ומכרה לישראל וגדלה שליש וחזר וקנאה ממנו‎ – Or you may also say that it is discussing a case where the נכרי planted it, and he sold it to a ישראל, and it grew a שליש by the ישראל, and the נכרי then bought it back from the ישראל‎. Another suggestion: ועוד דפירש רבינו תם בסוף פרק קמא דבכורות (דף יא, ב דיבור המתחיל טבלים) – And additionally, for the ר"ת explained in the end of the first פרק of מסכת בכורות‎ – דלא מיפטר לוקח היכא דלקח קודם שנתמרח – That a buyer is not exempt from תרו"מ in a case where he bought it before מירוח, so we can be discussing a case where the נכרי bought the produce from a ישראל (so it is מחוייב בתרו"מ) before מירוח (so there is no issue of לקוח) – A final alternative: אי נמי בחכר שדה מישראל חייב הגדל בו בתרומה ואפילו יש קנין לעובד כוכבים: Or you may also say; that the נכרי rented a field from a ישראל, in which case whatever grows there is חייב in תרומה, even if we maintain יש קנין לעכו"ם. S UMMARY There is a חיוב for תרו"מ for the produce of a נכרי if we maintain אין קנין לעכו"ם בא"י וכו'. There can be a חיוב even if we maintain יש קנין וכו' if it grew a שליש by a ישראל (either initially or later). Produce which was purchased קודם מירוח or through a חכירה is חייב even if it is by a נכרי‎. T HINKING IT OVER תוספות writes that even if יש קנין לעכו"ם וכו', nevertheless if it was גדלה שליש ביד ישראל and the rest by the נכרי it is מחוייב בתרו"מ and it is not considered לקוח since it grew (so much) by the נכרי it can be called תבואת זרעך‎. However this seems to be self-contradictory, for if it is called תבואת זרעך of the נכרי, so it is not מחויב בתרו"מ since יש קנין לעכו"ם וכו'?!

תרומתו תרומה‎—His T’rumoh is a valid T’rumoh O VERVIEW The משנה cited in our גמרא states that if a נכרי separated תרומה from his produce it is a valid תרומה (and it is forbidden to זרים). תוספות reconciles our גמרא with a seemingly contradictory גמרא‎. ---------------------- תוספות anticipates a difficulty: והא דאמרינן בזבחים בפרק בית שמאי (דף מה, א) ופרק קמא דתמורה (דף ב, ב) – And this which the גמרא states in מסכת זבחים in פרק ב"ש and in the first פרק of מסכת תמורה‎ – דקדשי עובדי כוכבים אין בהן משום מעילה – That items which נכרים sanctified (were מקדיש) there is no חיוב מעילה, if one derives benefit from them – ומפרש טעמא משום דילפינן חט חט מתרומה ובתרומה כתיב בני ישראל – And the גמרא explains the reason (why there is no מעילה by קדשי נכרים), because we derive מעילה from תרומה with the גזירה שוה of חט א חט א, and by תרומה it is written בני ישראל (that only בנ"י make תרומה), so too by מעילה it must be a הקדש by בנ"י, but not by נכרים‎. תוספות responds: אתיא כרבי שמעון דפליג הכא בסיפא ובריש פרק שני דקידושין (דף מא, ב) מייתי לה: Those גמרות are according to ר"ש who argues here in the סיפא of this משנה, and his opinion is cited in the second פרק of מסכת קידושין, however the חכמים maintain that a נכרי can be מפריש תרומה. S UMMARY There is a dispute between the רבנן and ר"ש whether a נכרי can be מפריש תרומה (the רבנן), or not (ר"ש). T HINKING IT OVER What will the רבנן (who say that a נכרי can be מפריש תרומה) maintain regarding מעילה of קדשי נכרים, is there מעילה or not, since they cannot derive it from תרומה‎?

ותנן עובד כוכבים שתרם את של ישראל כולי‎—And the Mishneh taught, a Gentile who separated תרומה which belonged to a ישראל, etc. O VERVIEW The גמרא first inferred that if the נכרי is included in a concept he can become a שליח for a ישראל, but we see regarding תרומה, where a נכרי can be מפריש תרומה, and yet he cannot be מפריש תרומה as a שליח for a ישראל‎. Our תוספות offers an answer. ------------------------- תוספות comments on this question: הוה מצי לשנויי דאתיא כרבי שמעון דסבר דליתא בתרומה דנפשיה בפרק שני דקדושין (דף מא, ב) – The גמרא could have answered that this משנה (that a נכרי cannot be a שליח for תרומה), is according to ר"ש, who maintains in the second פרק of מסכת קידושין that a נכרי is not included in being מפריש his own תרומה‎ – תוספות responds: אלא דעדיפא מיניה משני: However the גמרא offered a better answer (that a נכרי cannot become a שליח at all). S UMMARY The answer that this משנה is according to ר"ש, is not as good as the sגמרא' answer. T HINKING IT OVER What would have been the advantage of תוספות proposed answer, over the sגמרא' actual answer, that תוספות even suggests it?

מה אתם בני ברית‎—Just as you are members of a covenant O VERVIEW The גמרא concluded that we derive from the פסוק of כן תרימו גם אתם that just like you are בני ברית, so too your שלוחים must be ב"ב, excluding נכרים (who are not ב"ב). Our תוספות discusses how ר"ש derives this rule ------------------------------ תוספות asks: ואם תאמר דבפרק ב' דקידושין (גם זה שם) משמע דלרבי שמעון‎ – And if you will say; that in the second פרק of מסכת קידושין it seems that according to ר"ש – לא איצטריך ליה למידרש מה אתם בני ברית ומוקי לה לדרשא אחריתי – It is not necessary for him to expound מה אתם בני ברית (to exclude נכרים), and he utilizes the פסוק of גם אתם, for a different דרשה‎ – ואם כן לדידיה מנא לן הא דקיימא לן בכל דוכתי דעובד כוכבים לאו בר שליחות הוא‎ – So therefore, according to ר"ש how do we derive this which has been established in many places that a נכרי cannot be a שליח; this includes – לענין זכיה ורבית בפרק איזהו נשך (בבא מציעא דף עא, ב) – Regarding זכיה, and also regarding interest payments in פרק איזהו נשך‎. The question is from where does ר"ש derive this rule that a נכרי is not בתורת שליחות‎?! תוספות answers: ויש לומר דמכל מקום כיון דדרשינן שליחות מתרומה מגם אתם ומינה ילפינן בעלמא‎ – And we can say that nonetheless since ר"ש derives שליחות from תרומה using the פסוק of גם אתם, and from this דרשה we derive elsewhere the rules of שליחות‎ – מסתמא דלא מרבינן בעלמא אלא דומיא דאתם: Presumably we do not include שליחות elsewhere only if the שליח is similar to the אתם, meaning a ישראל but not a נכרי. S UMMARY According to ר"ש, elsewhere by שליחות, we (also) use the מה אתם ב"ב (which is written by תרומה) to exclude a נכרי from שליחות‎. T HINKING IT OVER תוספות writes that we derive שליחות דעלמא from תרומה‎. However from the גמרא in קידושין (cited here in this תוספות) it seems that we derive שליחות בעלמא from גירושין and קרבן פסח (and תרומה only teaches מה אתם וכו'), so perhaps we can derive שליחות לנכרי בעלמא from גירושין and קרבן פסח (and a נכרי should be included in שליחות)?!

מאי טעמא דרבי גרסינן‎—Our text reads, what is the reason of Rebbe O VERVIEW ר' יוחנן ruled (according to רב שמואל בר יהודה) that an עבד cannot receive a גט שחרור on behalf of his fellow עבד who belongs to the same master; this rule is valid despite that there is a הלכה that if a master tells his שפחה here is a שטר שחרור for your fetus, it is a valid שחרור, even though they both have the same master. This was reconciled by two גדולי הדור, one said that the ruling regarding a שפחה is according to רבי, who maintains that one can be משחרר חצי עבדו (free half of his slave), and the other said, what is the reason of רבי by the שפחה (since it is not a case of חצי עבד), since an עובר is ירך אמו‎. There seemed to have been a גירסא (not מ"ט דרבי, but) מ"ט דר' יוחנן‎. Our תוספות negates this גירסא‎. ------------------------- ולא גרסינן דרבי יוחנן‎ – And our text do not read מ"ט דר"י – דבהערל (יבמות דף עח, א) סבר רבי יוחנן דעובר לאו ירך אמו הוא וכן מוכח סוגיא התם: For ר"י, in פרק הערל, maintains that an עובר is not ירך אמו, and this is also evident in the גמרא there. S UMMARY The גירסא is מ"ט דרבי, since ר"י maintains עובר לאו ירך אמו הוא‎. T HINKING IT OVER If we would be גורס (as others are) מ"ט דר' יוחנן, how would we understand it; which rule of ר"י does 'עובר ירך אמו הוא', explain?

ונעשה כמי שהקנה לה אחד מאבריה‎—And it becomes as if he granted her one of her limbs O VERVIEW רבי rules that if a master freed the fetus of his שפחה, she can be זוכה for him and the fetus is free. The גמרא explained that this rule is valid (even though one עבד cannot be מקבל a שטר שחרור on behalf of his fellow עבד), because רבי maintains המשחרר חצי עבדו קנה and עובר ירך אמו הוא, so therefore it is as if הקנה לה אחד מאבריה (he freed half [part] of the שפחה). ------------------------------- תוספות asks: תימה לרבינו יצחק היתה עוברה היאך זכתה לו‎ – The ר"י is astounded! In this case where the שפחה was pregnant, how can the שפחה acquire the שטר שחרור on behalf of the fetus ; for – אף על גב דירך אמו הוא כיון דידה היא כיד רבה שלא שיחרר אלא העובר‎ – Even though the עובר is ירך אמו, nevertheless, since her hand is still like her master’s hand because the master only freed the עובר, not the שפחה‎ – ואפילו שיחרר כולה חוץ מידה לא הוה לה לזכות לו‎ – So even if he freed her completely besides her hand, which the master retained for himself, she would not be able to acquire the שחרור on the sעובר' behalf – תוספות responds to an anticipated difficulty: דכשמשחרר כולה יש לה כח לזכות משום דגיטה וידה באין כאחד – For it is only when he frees her completely that she has the power to acquire the שטר שחרור for herself, because of the concept that her emancipation and her hand come simultaneously – כדאמרינן בפרק קמא דקידושין (דף כג, א): As the גמרא states in the first פרק of מסכת קידושין‎. Our תוספות does not answer this question. S UMMARY How can the woman be זוכה the שחרור for the עובר, since ידה כיד רבה‎? T HINKING IT OVER How does תוספות explain the rule of רבי that המשחרר חצי עבדו קנה; how can that be since יד עבד כיד רבו‎?!

אדרבה איפכא מיסתברא‎—On the contrary; logically it is the opposite O VERVIEW רב יוסף stated that the spiteful women can be bring a גט in א"י, because we do not need their testimony. However in חוץ לארץ, where they need to say בפני נכתב ובפ"נ they are not believed. אביי challenged רב יוסף saying, on the contrary, since in חו"ל, the husband cannot challenge the גט once the שליח says בפ"נ ובפ"נ, so there is no concern that they will ruin her, but in א"י, where the husband can be מערער, they should not be believed to deliver the גט‎. Our תוספות explains the rational of רב יוסף‎. --------------------------- ורב יוסף סבר דמכל מקום יכולה לקלקלה בחוץ לארץ על ידי עדים וראיה שלא שלח לה הגט: And ר"י maintains that nonetheless (even though the בעל cannot be מערער), the spiteful woman can still ruin the wife, even in חו"ל by bringing witnesses and proof that the husband did not send her the גט‎. S UMMARY The spiteful woman can ruin her even in חו"ל, by עדים וראיה‎. T HINKING IT OVER According to תוספות, why can the spiteful women bring the גט in א"י, she can surely ruin the wife whether by the ערעור הבעל, or by bringing עדים וראיה‎?!
