    Chapter 1 - Betulah Nisset

    English translation - Ketubot 7a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1he is exempt. In this case, exempt means permitted ab initio . Ostensibly, intercourse with a virgin is comparable to creating an opening in an abscess. Why then, would intercourse with a virgin be forbidden on Shabbat? The Gemara rejects the proof: There, the pus in the abscess is pooled in one place and completely removed from the vessels in the flesh. In creating the opening, he creates nothing enduring. Here, however, in the case of the ruptured hymen, even according to the opinion that the blood is pooled, it is not completely removed from the blood vessels in the flesh. Through intercourse, the blood is removed from its place, which constitutes an aspect of a prohibited labor.

2The Gemara relates: Rav Ami permitted one to engage in intercourse with his virgin wife for the first time on Shabbat. The Sages said to him: But her marriage contract is not yet written. Engaging in conjugal relations with one’s wife without a marriage contract is considered an act of promiscuity. He said to them: Have her seize a portion of her husband’s movable property equivalent to the value of her marriage contract, and that will serve as a deposit until he writes the marriage contract. He may then engage in sexual relations with her.

3The Gemara relates: Rav Zevid permitted one to engage in intercourse with his virgin wife for the first time on Shabbat. There are those who say: Rav Zevid himself engaged in intercourse with his virgin wife for the first time on Shabbat.

4It was further related: Rav Yehuda permitted one to engage in intercourse with his virgin wife for the first time on a Festival. Rav Pappi said in the name of Rava: Do not infer and say: It is on a Festival that it is permitted, but on Shabbat it is prohibited, similar to actions involving food preparation, which are permitted on Festivals and prohibited on Shabbat, as the same is true that even on Shabbat it is permitted. And the reason Rav Yehuda issued his ruling with regard to a Festival is due to the fact that the incident that took place, took place in this way.

5Rav Pappa said in the name of Rava: According to Rav Yehuda, on a Festival it is permitted, on Shabbat it is prohibited. Rav Pappi said to Rav Pappa: What is your thinking? Is it: Since causing a wound was permitted on a Festival when performed for the purpose of food preparation, it was also permitted when not performed for the purpose of food preparation? If that is so, it would be permitted to prepare incense [ mugmar ] on a Festival due to the following reason: Since kindling a fire was permitted on a Festival when performed for the purpose of food preparation, it was also permitted when not performed for the purpose of food preparation.

6Rav Pappa said to him: It is about your assertion that the verse states with regard to a Festival: “Save that which every person must eat, that alone may be done by you” (Exodus 12:16), indicating a matter that is equal for every person. Incense is burned only by those who are particularly delicate. It is not equally utilized by everyone, and therefore it is not permitted. Intercourse, on the other hand, is universally practiced.

7Rav Aḥa, son of Rava, said to Rav Ashi: If that is so, if a deer happened to come into his possession on a Festival, since it is not a food that is equal for every person, would the ruling also be that it is prohibited to slaughter it? Rav Ashi said to him: I said a matter that is a need for every person, and deer meat is a matter that although difficult to acquire, is a need for every person. Incense, even when available, is not universally utilized.

8Rabbi Ya’akov bar Idi said: Rabbi Yoḥanan issued a ruling in the city of Tzaidan: It is prohibited to engage in intercourse with one’s virgin wife for the first time on Shabbat. The Gemara asks: And is there a ruling issued to prohibit an action? Typically, that language is utilized in reference to a firmly established ruling. A stringent ruling can be issued even based on uncertainty. In contrast, a lenient ruling can be issued only if the matter is clearly established by means of tradition or the reasoning of the Sage issuing the ruling.

9The Gemara answers: Yes, that language is used with regard to a stringent ruling, as didn’t we learn the following in a mishna ( Nazir 19b): When Queen Helene’s son went to war, she took a vow to be a nazirite for seven years, and she fulfilled that vow for the duration of her stay in the Diaspora? When she immigrated to Eretz Yisrael, Beit Hillel issued a ruling that she shall be a nazirite for seven additional years. Apparently, rulings are issued to prohibit an action as well.

10And alternatively, this is similar to that which is taught in a baraita : If a majority of the spinal cord of an animal is severed, the animal is a tereifa ; this is the statement of Rabbi Yehuda HaNasi. Rabbi Ya’akov says: Even if the spinal cord is perforated but otherwise intact, the animal is a tereifa . The baraita continues: Rabbi Yehuda HaNasi issued a ruling in accordance with the opinion of Rabbi Ya’akov. Here too, the term: Issue a ruling, is employed with regard to a stringent ruling. Rav Huna said: Despite the fact that Rabbi Yehuda HaNasi ruled in accordance with his opinion, the halakha is not in accordance with the opinion of Rabbi Ya’akov, but rather it is in accordance with the opinion of Rabbi Yehuda HaNasi. This is one version of this discussion.

11Rav Naḥman bar Yitzḥak taught this alternative version of the ruling of Rabbi Yoḥanan. Rav Abbahu said: Rabbi Yishmael ben Ya’akov, who is from Tyre, asked Rabbi Yoḥanan in Tzaidan, and I heard the exchange: What is the halakha with regard to engaging in intercourse with one’s virgin wife for the first time on Shabbat? And he said to him: It is prohibited. The Gemara concludes: And the halakha is that it is permitted to engage in intercourse with one’s virgin wife for the first time on Shabbat, and one need not be concerned lest he cause a wound, create an opening, or initiate bleeding.

12§ Rabbi Ḥelbo said that Rav Huna said that Rabbi Abba bar Rav Zavda said that Rav said: Both a virgin and a widow who marry require that the benediction of the grooms be recited. The Gemara asks: Did Rav Huna say that? But didn’t Rav Huna say: A widow does not require that a benediction be recited? The Gemara answers: This is not difficult. Here, where Rav Huna said that a widow requires a benediction, it is with regard to a bachelor who married a widow. There, where Rav Huna said she does not require a benediction, it is with regard to a widower who married a widow.

13The Gemara asks: And does a widower who married a widow not require a benediction to be recited? But didn’t Rav Naḥman say: Huna bar Natan said to me that it was taught: From where is it derived that the benediction of the grooms is recited in a quorum of ten men? It is as it is stated with regard to Boaz, who married Ruth: “And he took ten men of the Elders of the city and said: Sit you here, and they sat” (Ruth 4:2). And when Boaz married Ruth, he was a widower marrying a widow. As that is the primary source for the obligation to recite the benediction, apparently the benediction is recited even in that case.

14The Gemara answers: What is the meaning of: Does not require a benediction, that Rav Huna stated? It means that she does not require a benediction all seven days of the wedding celebration, but everyone agrees that for one day, she requires that a benediction be recited.

15The Gemara asks: However, that which is taught in a baraita , that the Sages were assiduous in seeing to the well-being of Jewish women, ensuring that the groom will rejoice with her three days, and that is why they established that a widow is married on Thursday, with regard to what circumstance is the baraita speaking? If it is with regard to a bachelor who marries a widow, didn’t you say he celebrates seven days; why then did the Sages see to a mere three-day celebration? If it is with regard to a widower who marries a widow, didn’t you say he celebrates for one day? Why then did the Sages see to a three-day celebration?

16The Gemara answers that this can be resolved in several manners. If you wish, say: In the case of a widower marrying a widow, there is one day for benediction and three days for celebration. The wedding is scheduled on Thursday to facilitate a three-day celebration. And if you wish, say instead: In the case of a bachelor marrying a widow, there are seven days for benediction and there are three days for celebration, during which he must refrain from going to work.

    Rashi

She seizes movable property - meaning: he gives her movable items to be in her possession as collateral for the obligation of her ketubah, until they write her the ketubah document with a lien on real estate (land).

Mugmar - spices placed on fire, used to perfume the utensils and the garments.

“Regarding you, the verse says ‘for every soul’ - something that is equal for every soul is permitted; and sexual relations are equal for everyone. But mugmar (perfuming with incense) is only for delicate people.

Is there a ruling for prohibition? - Is prohibition called a ruling? Because any person may be stringent, and one who forbids is not relying on grounds, for even out of doubt, when the halachah is not clear to him, he comes and forbids. But one who permits relies on what he heard or on the reasoning of his wisdom, and that is a ruling.

מתוך שהותרה לצורך - Since it was permitted for a need O VERVIEW רב פפי assumed the reason רב פפא ruled מותר לבעול בתחלה ביו״ט is since חבורה is permitted on יו״ט for a need, it is also permitted when there is no need. תוספות qualifies this leniency of ׳מתוך׳, that there must be some need. -----------------------– פירוש לצורך אוכל נפש הותרה נמי שלא לצורך אוכל נפש – The explanation of the phrase מתוך שהותרה לצורך הותרה נמי שלא לצורך is, that since a מלאכה is permitted for the sake of providing food for a person, it is also permitted even if there is no need of אוכל נפש — ובלבד שיהא צורך הנאת היום או צורך קיום מצוה ביום טוב – Provided that a need of enjoying the יום טוב, or a need to fulfil a מצוה, which needs to be done on יו״ט, is being met. תוספות offers examples of צורך קיום מצוה ביו״ט – כההיא דהוצאת קטן למולו וספר תורה לקרות בו ולולב לצאת בו (ביצה דף יב, א) – Like those cases of taking out a קטן into a רה״ר in order to circumcise him, and taking out a ס״ת into a רה״ר to read it, or taking out a לולב to a רה״ר to fulfill the מצוה of נטילת ד׳ מינים, which the ב״ה permit – אבל שלא לצורך היום כלל לא כמו הוצאת אבנים דמיחייב – However if there is no צורך היום at all, like taking out stones, it is not permitted, and he is חייב (מלקות) for doing a מלאכה ביו״ט. תוספות offers another example of שלא לצורך היום כלל: והאופה מיום טוב לחול לרב חסדא דאמר לוקה (שם דף כא, א) משום דלית ליה הואיל – And similarly one who bakes on יו״ט for the weekday, according to ר״ח who maintains that he receives מלקות, since ר״ח does not agree to the היתר of הואיל, therefore baking מיו״ט לחול is שלא לצורך היום כלל, and therefore he is לוקה. תוספות anticipates some difficulties with his ruling that there must be a צורך היום: ושחיטת עולת נדבה דשרי לבית הלל (שם דף כ, ב) – And regarding the ruling of ב״ה who permit offering an עולת נדבה on יו״ט, where there is seemingly no צורך היום – תוספות responds: היינו משום שלא יהא שלחנך מלא ושלחן רבך חסר – That (עולת נדבה) is permitted in order that it should not be a situation where your table is full (there is ample food for all), and your master’s table (the מזבח) is lacking (because there are no עולות נדבה) – Another anticipated difficulty (in the opposite direction): ומוצא חמץ בתוך ביתו דאמרינן בפרק קמא דפסחים (דף ו, א ושם) דכופה עליו כלי – And regarding one who finds חמץ in his house on פסח, where רב states in the first פרק of מסכת פסחים, that he covers it with a utensil so he should not eat it – ולא שרינן לשורפו משום מתוך – So why do we not permit him to burn the חמץ on account of מתוך; for there is a צורך קיום מצוה ביו״ט? תוספות responds: היינו משום דאסור לשורפו מדרבנן משום מוקצה דאסור לטלטלו – That is because it is forbidden מדרבנן to burn it, for it is מוקצה which is forbidden to be moved – תוספות rejects an alternate solution to this question: אבל אין לומר דאיירי כשביטלו – However we cannot answer that the case of כופה עליו כלי is where he was מבטל the חמץ and therefore there is no צורך מן התורה to burn it, this is not so – דמכל מקום מדרבנן מצוה לשורפו והוי צורך היום – For nevertheless, even if he was מבטל the חמץ, there is a מצוה מדרבנן to burn it and this would be considered a צורך היום which would allow us to burn it on account of מתוך – דבמצוה דרבנן נמי שרינן היכא דאיכא למימר מתוך – For by a מצוה דרבנן which we are obligated to do on יו״ט, we would also permit doing a מלאכה where we can apply the היתר of מתוך. תוספות anticipates an additional difficulty: והא דפליגי בית שמאי ובית הלל (ביצה דף יב, ב) במבשל גיד הנשה ביום טוב ואכלו – And that which ב״ש and ב״ה argue regarding one who cooks a גיד הנשה on יו״ט and ate it, where – דלבית שמאי דלית להו מתוך לוקה ולבית הלל דאית להו מתוך אינו לוקה – According to ב״ש who do not agree with מתוך, he is לוקה and according to ב״ה who maintain מתוך, he is not לוקה; how can we apply מתוך here; since this is a forbidden food there is no צורך היום – תוספות responds: צריך לומר אף על גב דלא חשיב אוכל נפש משום איסור דרכיב עליה – It will be necessary to answer, even though that on one hand it is not considered אוכל נפש because of the prohibition which is ‘riding’ on the גיד הנשה (which explains why he is לוקה according to ב״ש) – מכל מקום צורך היום הוא כיון דאכיל ליה – Nevertheless it is considered צורך היום since he is eating it (it satiates his hunger), so he is not לוקה [only] on account of מתוך according to the ב״ה. תוספות discusses various cases whether they are צורך היום or not: ונראה לרבינו יצחק דהוצאת תינוק לטייל הוי צורך היום And it is the view of the ר״י that carrying out a child to a רה״ר to play with him is a צורך היום – ומיהו הוצאה לצורך נכרי נראה דאסור – However it seems that carrying out something into a רה״ר for a gentile’s need is forbidden – תוספות finds a discrepancy in this ruling: ומה שנהגו עתה להוציא לצורך נכרי היה נראה לרבי שמשון בן אברהם – And initially it was the view of the רשב״א that the reason for the custom nowadays to carry out something for a gentile is – משום דרשות הרבים דידן לא הוי אלא כרמלית דאין רחבין ט״ז אמה – Because our רה״ר is only a כרמלית since they are not wide sixteen אמות – וגבי יום טוב לא גזור רבנן – And on יו״ט the רבנן did not decree not to carry into a כרמלית (as they were גוזר for שבת) – תוספות offers proof that we are more lenient by יו״ט than on שבת: כי היכי דלא תקון רבנן עירובי חצירות ביום טוב – Just as the רבנן did not institute עירובי חצירות on יו״ט, similarly they were not גוזר the איסור הוצאה by כרמלית on יו״ט – תוספות offers a proof that the רבנן did not institute עירובי חצרות on יו״ט – כדמשמע בריש פרק שני דביצה (דף טז, ב) דאמר יום טוב שחל להיות ערב שבת כולי – As it seems in the beginning of the second פרק of מסכת ביצה where the ברייתא states if a יו״ט occurred on ערב שבת, etc. – רבי אומר מערבין עירובי חצירות אבל לא עירובי תחומין – רבי maintains one may make עירובי חצירות, but not עירובי תחומין – לפי שאתה אוסרו בדבר האסור לו ואי אתה אוסרו בדבר המותר לו – Because you may prohibit him in something which he is already prohibited, but you cannot prohibit him in something which he is already permitted – אלמא לא תקון עירובי חצירות ביום טוב והוא הדין דלא גזרו בכרמלית – It is evident (from the statement ואי אתה אוסרו בדבר המותר לו) that the חכמים did not institute ערובי חצירות on יו״ט, and the same applies that they did not issue a decree against carrying in a כרמלית on יו״ט, therefore nowadays where there is no רה״ר דאורייתא only a כרמלית מדרבנן, it is permitted to carry into a כרמלית even לצורך נכרי only. תוספות anticipates a difficulty with the aforementioned that there is no ע״ח on יו״ט: והא דקיימא לן בפרק אמרו לו (כריתות דף יד, א ושם) ובפרק קמא דביצה (דף יב, א ושם) – And regarding this which we have established in פרק אמרו לו and in the first פרק of מסכת ביצה – דיש עירוב והוצאה ליום טוב – That there is עירוב והוצאה on יו״ט ; presumably referring to ע״ח, which contradicts this which תוס׳ just assumed that there is no (need for) עירובי חצירות on יו״ט – תוספות replies: נראה דאיירי בעירובי תחומין – It seems that the term עירוב there means עירובי תחומין but not עירובי חצירות. In summation; the רשב״א maintains one is permitted to carry on יו״ט even לצורך נכרי, since today there is no רה״ר דאורייתא, only a כרמלית, and the רבנן were not גוזר איסור הוצאה by a כרמלית on יו״ט, just as they did not require ע״ח on יו״ט. The רשב״א retracts his previous statement that we may carry for a נכרי: ושוב חזר בו דמחצר שאינה מעורבת אין ללמוד ממנה לכרמלית דחמיר טפי – And later the רשב״א retracted, for we cannot derive a leniency by a כרמלית from a חצר שאינה מעורבת, since the laws of כרמלית are stricter than the laws of ע״ח – כמו שפירשתי במסכת שבת (דף קיז, א) – As I explained in מס׳ שבת. תוספות presents an additional difficulty on the רשב״א: ועוד נראה דהא דקיימא לן דיש עירוב והוצאה ליום טוב בעירובי חצירות מיירי – And additionally it seems that this which we have established that there is עירוב והוצאה for יו״ט, it is referring to עירובי חצירות (and not to עירובי תחומין as the רשב״א claimed previously) – תוספות proves his point that עירוב ליו״ט refers to עירובי חצירות: מדבעי למימר בפרק אמרו לו (כריתות דף יד, א ושם) דאין עירוב והוצאה ליום הכפורים – Since the גמרא wanted to derive in פרק אמרו לו, that there is no עירוב והוצאה on יו״כ (that one may carry on יו״כ מרשות לרשות) – מדתנן התם אם היתה שבת והוציאו בפיו חייב – From the משנה which states there that ר״מ rules if יו״כ occurred on a שבת and he carried it out with his mouth, he is liable for an additional חטאת for transgressing the איסור הוצאה on שבת, but he will not be מחויב this extra חטאת if it is a regular יו״כ, which occurred on a weekday; indicating that there is no איסור הוצאה on יו״כ – וכן בביצה (דף יב, א ושם) בעי למידק דאין עירוב והוצאה ליום טוב – And similarly in מסכת ביצה where רבה wanted to infer that there is no עירוב והוצאה on יו״ט – מדשרו בית הלל להוציא קטן ולולב – Since ב״ה permitted to carry out into a רה״ר a minor or a לולב. In both places the גמרא said אין עירוב והוצאה וכו׳ even though the discussion is (only) about הוצאה – והיינו עירובי חצרות דהשתא מוכח לה שפיר מדשרו הוצאה – So we must say that the עירוב there means עירובי חצירות, for then (if עירוב means ע״ח) it can be properly proven that there is no עירוב for either יו״כ or יו״ט, since הוצאה is permitted מרשות לרשות it follows that ע״ח are also not required – דלא גזרו רבנן אעירובי חצירות אלא משום הוצאה – For the רבנן did not decree the need for ע״ח only because they were concerned about הוצאה. It therefore follows if there is no איסור הוצאה (on יו״כ or יו״ט) there is no need for ע״ח. Therefore the גמרא says אין עירוב (חצירות) והוצאה וכו׳ – אבל עירובי תחומין אין עניינה להוצאה – However the requirement for ע״ת has no connection to הוצאה. So when the גמרא lumps together עירוב והוצאה it must be referring to ע״ח. תוספות responds to the anticipated difficulty: והא דקאמר ואי אתה אוסרו בדבר המותר לו היינו משום דמותר להוציא לצורך: And that which the גמרא said (regarding the ruling of רבי that מערבין ע״ח ואין מערבין ע״ת) ‘ but you cannot prohibit him in something in which he is permitted’, that is because he is permitted to carry out into the רה״ר for a יו״ט need, because of מתוך, but not that there is no דין of ע״ח on יו״ט (where there is no צורך at all). S UMMARY The היתר of מתוך is only if it is לצורך (הנאת) היום (even if it is not לצורך שמחת היום according to the ר״י) or לצורך קיום מצוה ביו״ט. The laws of ע״ח apply to יו״ט as well and we are not permitted to carry לצורך נכרי. T HINKING IT OVER 1. תוספות writes that we cannot burn חמץ on יו״ט since it is מוקצה. However one is permitted to move מוקצה לצורך אוכל נפש, so why do we not say regarding the איסור מוקצה (which is only a דרבנן) that מתוך שהותרה לצורך אוכל נפש הותרה נמי לצורך מצוה (as we say regarding איסור דאורייתא)?! 2. May one burn חמץ on יו״ט if he does not move it, so there is no איסור of טלטול מוקצה? 3. According to תוספות initial view that there is no גזירת כרמלית on יו״ט, is one permitted to carry into a כרמלית on יו״ט even if it is שלא לצורך כלל? 4. תוספות concludes that the meaning of ואי אתה אוסרו בדבר המותר לו means that it is מותר (without עירובי חצירות) if it is לצורך, for then we say מתוך. Seemingly we should also say מתוך regarding עירובי תחומין (for what is the difference); so why does רבי say regarding ע״ת that אתה אוסרו בדבר האסור לו, since by ע״ת we should also say מתוך as we say by ע״ח?!

אלא מעתה יהא מותר לעשות מוגמר ביום טוב - But now it should be permitted to make Mugmor on Yom Tov O VERVIEW רב פפי challenged רב פפא (who ruled that it is מותר לבעול בתחלה ביו״ט), if you are permitting the בעילה on account of מתוך, you should also permit מוגמר on account of מתוך. Our תוספות discusses the view of רב פפי regarding מתוך. ---------------------– תוספות asks: ואם תאמר לדידיה נמי תקשי וכי לא סבר דאמרינן מתוך הא טעמא דבית הלל הכי הוא – And if you will say; the same question (which רב פפי asks רב פפא) applies to רב פפי as well, for does not רב פפי agree that we use the היתר of מתוך, since מתוך is the reason ב״ה allow carrying out on יו״ט – תוספות answers: ויש לומר שהיה סובר דטעמא דבית הלל משום דאין עירוב והוצאה – And one can say; that רב פפי thought that the reason ב״ה permits carrying out (a קטן וכו׳) is because ב״ה maintain there is no need for עירוב חצירות, and no prohibition against carrying out on יו״ט, however (even) ב״ה do not agree to מתוך – כדקא סלקא דעתין מעיקרא בביצה – As רבה initially assumed in מסכת ביצה, that ב״ה is מתיר only because אין עירוב והוצאה ביו״ט – תוספות responds to an anticipated difficulty: אף על גב דהתם פריך עלה דלמא לרב פפי לא שמיע לה – Even though רב יוסף there challenged and refuted this view of רבה (so how can we say that רב פפי follows this view)? תוספות responds; perhaps רב פפי did not hear this refutation (and/or disagrees that it is a refutation) and (therefore) still assumed that the reason of ב״ה is because of אין עירוב והוצאה, but not on account of מתוך. תוספות offers an additional answer to the original question: ועוד יש לומר שהיה סובר הותרה שלא לצורך ובלבד שיהא דבר הרגיל – And additionally one can say; that רב פפי also assumed that ב״ה maintainsמתוך שהותרה לצורך הותרה נמי שלא לצורך, provided that this היתר applies to something usual as carrying out a child, etc. (but not regarding ביאה בתחלה ביו״ט) – ולהכי פריך דזה אינו רגיל טפי ממוגמר: And therefore רב פפי asked רב פפא that this בעילה בתחלה ביו״ט is not more common than מוגמר, and just as you permit (the uncommon) בעילה, you should also permit making מוגמר on יו״ט (which is equally uncommon), which we know is prohibited, so too בעילה should also be prohibited. S UMMARY Either רב פפי assumed that ב״ה maintain אין עירוב והוצאה ביו״ט, or he assumed that מתוך is only by something which is common but not by בעילה ומוגמר. T HINKING IT OVER According to תוספות first answer that רב פפי assumed the reason ב״ה permit הוצאה ביו״ט is because אין עירוב והוצאה ביו״ט (but they do not agree to מתוך), how can we explain the מחלוקת between ב״ש and ב״ה regarding המבשל גיד הנשה ביו״ט?

אמר ליה אנא דבר הצריך לכל נפש קאמינא וצבי צריך לכל נפש - He said to him; ‘I said something which is necessary for all people, and a deer is necessary for all people’ O VERVIEW רב אשי explained to רב אחא בריה דרבא, that (slaughtering) a deer for eating is something in which all people are equal, since they all need to eat; however (making a fire for) מוגמר is only for pampered people and is not צריך לכל נפש. Our תוספות discusses whether ביאה is a דבר הצריך לכל נפש. ---------------------------– וכן ביאה – And similarly ביאה is a דבר הצריך לכל נפש, therefore we can say מתוך regarding ביאה, and consequently it is מותר לבעול בתחלה ביו״ט. מהו לכבות הנר מפני דבר אחר – And the ר״י has a difficulty with this idea that we say מתוך regarding ביאה; for אבא בר מרתא in the end of the second פרק of מסכת ביצה, asked of אביי, what is the ruling whether it is permitted to extinguish a lamp because of דבר אחר – ומסיק דאסור הא הכא שרי משום דצריך לכל נפש – And אביי concluded that it is prohibited to extinguish the light; but here it is permitted to be בועל בתחלה ביו״ט since ביאה is something which is צריך לכל נפש, and we say מתוך, similarly there we should also say מתוך שהותרה כיבוי לצורך אכילה הותרה נמי שלא לצורך, since ביאה is צריך לכל נפש and it should be permitted! תוספות answers: ויש לומר דהכא דוקא בבעילה ראשונה דמצוה היא דהוי צורך מצות היום – And one can say that only here where it is the first ביאה, which is a מצוה, so it is צורך מצוה for this day, that is why we can say מתוך – אבל שאר בעילות אין כל כך צורך היום – However the rest of the בעילות (after the first בעילה) is not considered that much of a צורך היום, for he can do it another time. תוספות offers an alternate answer: ועוד יש לומר דכיבוי הנר מפני דבר אחר הוי כמו מכשירין דאפילו באוכל נפש אסור – And furthermore one can say; that extinguishing a candle because of ד״א, is like מכשירין, which (regarding מכשירין it) is forbidden even if it is for אוכל נפש (and we certainly cannot apply the מתוך ruling to מכשירין – תוספות proves his point: וכן מוכח התם דפריך עלה מהא דתניא דמכבין את הבקעת כדי שלא יתעשן הבית – And this concept is also evident there, for the גמרא there challenges the view of אביי that the כיבוי is אסור, from the ברייתא which states that we may extinguish a log in order the house should not smoke up, so why cannot we extinguish the candle for ד״א – ומשני ההיא רבי יהודה היא דשרי מכשירי אוכל נפש כי קאמינא לרבנן: And אביי answered; that ברייתא is according to ר״י who permits doing מלאכה even if it only מכשירי אוכל נפש, however I gave my ruling prohibiting כבוי according to the רבנן who prohibit מכשירי אוכל נפש. S UMMARY בעילה ראשונה (which is a בעילת מצוה) is certainly a צורך מצות היום (as opposed to שאר ביאות). We do not allow מלאכות which are only מכשירי אוכל נפש (and certainly do not say מתוך by such מלאכות which are מכשירין, such as כבוי הנר for ד״א). T HINKING IT OVER תוספות writes on his second answer that it is מוכח. Why therefore is this (merely) the second answer and not the first (and why is the first answer altogether necessary)?

(שייך לע״א) הורוה בית הלל - ruled for her בית הלל O VERVIEW The גמרא cites this משנה of הורוה ב״ה to prove the term הורוה applies to a הוראה of איסור (as well as היתר). Our תוספות clarifies a difficulty from a historical perspective. ----------------------– גבי הילני המלכה – This הוראה of ב״ה was to הילני the queen as the משנה in נזיר states explicitly. תוספות anticipates a difficulty: אף על גב דמבית חשמונאי היתה שהרי אם מונבז המלך היתה כדאמר ביומא (דף לז, א ושם) – Even though הילני was from the house of the חשמונאים, for she was the mother of King מונבז as the משנה states in מסכת יומא – ומלכות הורדוס מאה ושלש שנה בפני הבית – And the reign of הורדוס began one hundred and three years before the בית המקדש was destroyed – והלל לא נהג נשיאותו עד שלש שנים לאחר מלכות הורדוס – And הלל did not conduct his ‘presidency’ (over the סנהדרין) until three years after the beginning of the הורדוס reign – כדאמרינן (שבת טו, א) הלל ושמעון גמליאל ושמעון נהגו נשיאותן בפני הבית מאה שנה – As the גמרא states that הלל, his son שמעון, his son גמליאל and his son שמעון conducted their נשיאות the last hundred years that the בית המקדש stood, so הלל became a נשיא three years after the reign of הורדוס began. תוספות replies: מכל מקום כבר היו לו אז תלמידים שהורו: Nevertheless, הלל already then (during the time of הילני המלכה) had students who gave rulings. S UMMARY The ב״ה existed and gave rulings even before הלל became a נשיא. T HINKING IT OVER Why did תוספות ask this question here, when he should have asked this question on the משנה in מסכת נזיר (יט, ב), where the source of the story is?

והלכתא מותר לבעול בתחלה בשבת - And the ruling is; it is permitted to be בועל initially on Shabbos O VERVIEW The גמרא concluded the discussion whether it is permitted to be בועל בתחלה בשבת with the final ruling that it is permitted. תוספות derives a subsequent ruling from this. And we are also not concerned that he may slaughter a bird for the meal, and we rely on this ruling to make a feast on שבת for the wedding (since we derive from this גמרא that there is no concern for שמא ישחוט בן עוף). S UMMARY One may make a wedding feast on שבת and there is no concern for שמא ישחוט בן עוף. T HINKING IT OVER Our גמרא merely rules that one is permitted לבעול בתחלה בשבת; how can one derive from this that it is permitted to make a feast on שבת (for we are not חייש לשמא ישחוט בן עוף), perhaps this rule (of מותר לבעול בתחלה בשבת) is limited to the law of ביאה that it is permitted, but it does not (necessarily) allow us to make a feast on שבת, for we are concerned שמא ישחוט בן עוף?

(שייך לע״א) באלמנה שנשאת לבחור - By a widow who became married to a bachelor O VERVIEW The גמרא explained that when ר״ה said in the name of רב that an אלמנה requires ברכת חתנים (all seven days) that was in a case of אלמנה שנשאת לבחור (but not in a case of אלמון שנשא אלמנה). Our תוספות explains the difference. That since both of them are not widowed (just the woman is a widow; the man is a בחור), it is proper to make the ברכת חתנים all seven days. S UMMARY If they are both not widowed we make the ברכת חתנים all seven days. T HINKING IT OVER 1. What was תוספות difficulty that required an explanation? 2. What will be the ruling (regarding ברכת חתנים) by an אלמן שנשא בתולה? 3. How does תוספות know that the reason we are מברך כל שבעה by a בחור שנשא אלמנה, is because they are not both אלמונים, perhaps the reason is because one of them never received the ברכות?

(שייך לע״א) והא בועז אלמון שנשא אלמנה הוה - But בועז was a widower who married a widow O VERVIEW The גמרא asked on the ruling that an אלמון שנשא אלמנה does not require ברכת חתנים, from the fact that by בועז, who was an אלמון שנשא אלמנה and they performed ברכת חתנים there. תוספות clarifies what is meant that בועז was an אלמון שנשא אלמנה. -----------------------------– לאו דוקא אלמנה דכשנשאת למחלון (וכליון) היתה נכרית – רות the wife of בועז was not exactly an אלמנה, for when she married מחלון (her first husband, who eventually died) she was (as of yet) non-Jewish. תוספות explains why we refer to רות as an אלמנה – אלא כיון דבעולה היא כאלמנה חשיב לה: However since she was a בעולה (from מחלון) she is considered as an אלמנה. S UMMARY The logic that an אלמנה does not require ברכת חתנים, applies to a בעולה as well. T HINKING IT OVER Seemingly it should be obvious that a בעולה is like an אלמנה regarding ברכות (since they are the same regarding כתובתן מנה); what is תוספות teaching us?
