    Ketubot 10a

    Chapter 1 - Betulah Nisset

    English translation - Ketubot 10a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1§ It was stated: Rav Naḥman said that Shmuel said in the name of Rabbi Shimon ben Elazar: The Sages instituted the marriage contract for Jewish women: For a virgin two hundred dinars and for a widow one hundred dinars. And they deemed the groom credible in that if he says with regard to his virgin bride: I encountered an unobstructed orifice and she is not a virgin, he is deemed credible, causing her to lose her marriage contract. The Gemara asks: If so, and the Sages deemed him credible, what did the Sages accomplish in their ordinance that the marriage contract of a virgin is two hundred dinars, if his claim that she is not a virgin is effective?

2Rava said: The ordinance is effective due to the presumption that a person does not exert himself to prepare a wedding feast and then cause it to be lost. Investing in the wedding preparations clearly indicates that the groom’s intention is to marry the bride and rejoice with her. If, nevertheless, he claims that she is not a virgin, apparently he is telling the truth.

3§ A Sage taught in a baraita : Since payment of the marriage contract is a penalty instituted by the Sages, she may collect only from the husband’s land of the most inferior quality. The Gemara asks: A penalty? What penalty is there in a marriage contract? Rather, emend the baraita and say: Since it is a rabbinic ordinance and not a Torah obligation, she may collect only from the husband’s land of the most inferior quality. Rabban Shimon ben Gamliel says: The marriage contract of a woman is an obligation by Torah law.

4The Gemara asks: And did Rabban Shimon ben Gamliel say that? But isn’t it taught in a baraita that it is written with regard to a seducer: “He shall pay money according to the dowry of virgins” (Exodus 22:16)? The Torah establishes that this fine will be like the dowry of a virgin, and that the dowry of a virgin will be like this fine, i.e., fifty silver sela , or two hundred dinars. From here the Sages based their determination that a woman’s marriage contract is an obligation by Torah law. Rabban Shimon ben Gamliel says: The marriage contract of a woman is not an obligation by Torah law, but is by rabbinic law.

5The Gemara resolves the contradiction between the statements of Rabban Shimon ben Gamliel: Reverse the attribution of opinions in this baraita . The Gemara asks: And what did you see that led you to reverse the attribution of opinions in the latter baraita ? Reverse the attribution of opinions in the former, in the baraita , and say that Rabban Shimon ben Gamliel is the one who holds that the marriage contract is a rabbinic ordinance.

6The Gemara answers: The reason is that we learned that it is Rabban Shimon ben Gamliel who said elsewhere that the marriage contract of a woman is an obligation by Torah law, as we learned in a mishna (110b) that Rabban Shimon ben Gamliel says that if a man marries a woman in Cappadocia, where the currency is more valuable, and he divorces her in Eretz Yisrael, he gives her payment for the marriage contract from the money of Cappadocia. From the fact that he is obligated to pay the marriage contract in the currency of the place where he undertook the obligation, apparently the marriage contract of a woman is an obligation by Torah law.

7And if you wish, say instead that the entire latter baraita is in accordance with the opinion of Rabban Shimon ben Gamliel, but the baraita is incomplete and it is teaching the following: From here, the Sages based their determination that a woman’s marriage contract in the case of a virgin is an obligation by Torah law. However, the marriage contract of a widow is not an obligation by Torah law but is an ordinance by rabbinic law, as Rabban Shimon ben Gamliel says: The marriage contract of a widow is not an obligation by Torah law but is an ordinance by rabbinic law.

8§ The Gemara relates: A certain man who had never been married came before Rav Naḥman and said to him: I encountered an unobstructed orifice when I consummated the marriage. Rav Naḥman said in his regard: Flog him with palm branches [ kufrei ]; prostitutes [ mevarakhta ] are common around him. As he was never previously married, how was he able to determine whether or not the orifice was unobstructed, if he did not gain experience with prostitutes?

9The Gemara asks: But isn’t Rav Naḥman he who said that he is deemed credible when he claims that he encountered an unobstructed orifice? The Gemara answers: Yes, he is deemed credible, and nevertheless, we flog him with palm branches. Rav Aḥai answered: Here, in the case where he is flogged, it is with regard to a bachelor, who is not accorded credibility, because he lacks experience. There, in the case where he is accorded credibility, it is with regard to one who has been married.

10The Gemara relates a similar incident from an earlier era: A certain man who came before Rabban Gamliel said to him: I encountered an unobstructed orifice. Rabban Gamliel said to him: Perhaps you diverted your approach and therefore, you encountered no obstruction? I will tell you a parable to which this is similar. It is similar to a man who was walking in the blackness of night and darkness and he arrived at the entrance to the house; if he diverts the object preventing the door from opening, he finds it open; if he does not divert it, he finds it locked. Perhaps you too diverted your approach and entered from a different angle and that is why you did not encounter an obstruction.

11Some say this is what Rabban Gamliel said to him: Maybe you diverted your approach intentionally and you displaced the door and the bolt. I will tell you a parable to which this is similar. It is similar to a man who is walking in the blackness of night and darkness and he arrives at his entrance. If he diverts intentionally, he finds it open; if he does not divert intentionally, he finds it locked.

12The Gemara relates: A certain man who came before Rabban Gamliel bar Rabbi Yehuda HaNasi said to him: My teacher, I engaged in intercourse and did not find blood. The bride said to him: My teacher, I was a virgin. Rabban Gamliel bar Rabbi Yehuda HaNasi said to them: Bring me that cloth [ sudar ] on which you consummated the marriage. They brought him the cloth, and he soaked it in water and laundered it and found upon it several drops of blood from the rupture of the hymen. Rabban Gamliel bar Rabbi Yehuda HaNasi said to the groom: Go take possession of your acquisition, as she was a virgin and there is no need for concern.

13Huna Mar, son of Rava, from Parzakya, said to Rav Ashi: Let us do so as well in similar cases and examine whether there is blood that is obscured by semen or another substance. Rav Ashi said to him:

The Sages instituted [the obligation of] a ketubah for a woman, etc - - That is to say, if her ketubah were [an obligation] from the Torah, he would not be believed to nullify it, except with established testimony. But since her ketubah was instituted by the Sages, they said, and they said (i.e., the Sages both established it and defined its rules), they who instituted it said that he is believed to cause her to lose [the ketubot], even with the claim of ‘an open opening’.

There is a presumption that a person does not go to the trouble of preparing a wedding feast, etc. — We are not concerned that a person would make such a claim falsely. Rather, it is truly the case, because if he had hated her from the outset, he would not have gone to the trouble of preparing a wedding feast, marrying her, and losing the cost of the feast for nothing; instead, he would have separated from her from the beginning.

Rather, from inferior land - If she comes to collect her ketubah, and he has superior land and inferior land, but no intermediate quality land, she cannot say, ‘Give me superior land or intermediate land at its equivalent value.’ Rather, if he comes to give her inferior land at its equivalent value, he may give it.

“He gives her from the money of Kapotkia” - In the last chapter, we learned in a Mishnah: If he married a woman in Eretz Yisrael and divorced her in Kapotkia, he gives her from the coinage of Eretz Yisrael, which is lighter (i.e., of lower value). If he married her in Kapotkia and divorced her in Eretz Yisrael, he gives her from the coinage of Eretz Yisrael. From where (do we learn) that what’s written in the ketubah is that we follow the more lenient / lower-value standard? Rabban Shimon ben Gamliel says: He gives her from the coinage of Kapotkia, because those are the coins with which he obligated himself - like any other loan - since he holds that the ketubah is a Torah obligation.

They whipped him with "kofri" - - They struck him with lashes, with sticks made from palm branches, which have sharp points on them, like thorns, as we say in tractate Sukkah (daf 33a), and if you would say: ‘kofra [as something unpleasant]—but it is written: Her ways are ways of pleasantness (Proverbs 3:17),

Mevarkheta is beaten for him - The prostitutes of this city, whose name is Mevarkheta, are beaten down (i.e., humiliated or debased) and constantly lie before him in order to engage in prostitution, since he is experienced in an ‘open opening’.

אמר רב נחמן אמר שמואל חכמים תיקנו כולי - רב נחמן said in the name of שמואל; the sages instituted, etc. O VERVIEW ר״נ said in the name of שמואל that the חכמים instituted a כתובה of מאתיים for a בתולה and a כתובה of מנה for an אלמנה, etc. תוספות discusses the inference from this statement which seemingly indicates that the obligation to give כתובה payments is only מדרבנן and not מן התורה, where there are indications elsewhere that כתובה is מדאורייתא. ---------------------– משמע דכתובה דרבנן וכן בהאשה רבה (יבמות פט, א ושם) גבי אין לה כתובה קאמר – It seems ( from the statement of ר״נ אמר שמואל that ח כמים תקנו וכו׳ לבתולה מאתיים כו׳) that the obligation for a husband to give a כתובה is מדרבנן, and similarly in פרק האשה רבה regarding the ruling of the משנה that she does not receive her כתובה, the גמרא there comments – מאי טעמא תקינו לה רבנן כתובה שלא תהא קלה בעיניו להוציאה כולי – ‘What is the reason the רבנן instituted a כתובה payment for a woman, in order that it should not be easy in the eyes of the husband to divorce her, etc.’; it is again apparent from the statement מ״ט תקינו לה בנן כתובה that the חיוב כתובה is מדרבנן. אלמא סתמא דהש״ס סבר דכתובה דרבנן – It is evident that the general consensus of the גמרא is that כתובה is a רבנן obligation. תוספות asks: וקשה דנהגו לכתוב בכתובה כסף זוזי מאתן דחזו ליכי מדאורייתא – And there is a difficulty; for it is customary to write in the כתובה document that he is obligating to pay her (if he predeceases her or divorces her) ‘ two hundred זוזים which you deserve מדאורייתא’; indicating that כתובה is מדאורייתא! תוספות answers: ואומר רבינו תם דסמכינן ארבן שמעון בן גמליאל דמתניתין דפרק בתרא (דף קי, ב) – And the ר״ת says that we depend on רשב״ג cited in a משנה in the last פרק – דמייתי לה נמי בסמוך דאמר נותן לה ממעות קפוטקיא דקסבר כתובה דאורייתא – Which is also mentioned shortly, who states, ‘he pays her with money of קפוטקיא’ because רשב״ג maintains כתובה דאורייתא – וקיימא לן כרבן שמעון בן גמליאל במשנתנו – And we have an established rule that we follow the rulings of רשב״ג where his opinion is mentioned in a משנה. תוספות offers an alternate explanation: ועוד אומר רבינו יצחק דלא קיימא לן כרב נחמן – And furthermore says the ר״י; that we do not follow the ruling of ר״נ אמר שמואל (who states that כתובה is a תקנת חכמים) - דאשכחנא רב אשי דהוא בתראה דפליג עליה כדמתרץ לקמן ברייתא (that he did not hide the דם בתולים) cannot have טענת בתולים, not whoever did not check (עיי״ש ברש״י ד״ה כל), (דף יב, א) – For we find רב אשי, who is a later אמורא, argues with ר״נ, as he reinterprets the ברייתא later that – תני כל שלא מושמש אינו יכול לטעון טענת בתולים – It should read ‘whoever was not checked cannot claim טענת בתולים’ – אלמא דחייש לשמא משקר ולא אמרינן חזקה אין אדם טורח בסעודה ומפסידה – It is evident that he is concerned that perhaps the husband is lying with his טענת בתולים, and we do not say as ר״נ does that there is a חזקה that אין אדם טורח בסעודה ומפסידה. וכן פירש רבינו יצחק בן רבינו מאיר דרב אשי פליג אדרב נחמן – And the ריב״ם also explained it in this manner that ר״א argues with ר״נ. תוספות resolves the remaining question: והא דאמרינן בהאשה רבה (יבמות פט, א ושם) מאי טעמא תקינו רבנן כתובה – And that which the גמרא states in פרק האשה רבה, ‘why did the רבנן institute a כתובה; indicating that כתובה דרבנן – הכי פירושו מאי טעמא תקינו רבנן כתובה היכא דתקינו – This is the explanation of that גמרא; why did the רבנן institute a כתובה in those cases where the רבנן did institute a כתובה – כגון באלמנה שלא תהא קלה בעיניו להוציאה – For instance by an אלמנה; the reason was in order שלא תהא קלה בעיניו להוציאה – הכא נמי תקינו שלא יהא לה כדי שתהא קלה בעיניו להוציאה: Here too (by this woman whose husband returned after she remarried ע״פ ע״א) the רבנן instituted that she should not have a כתובה in order שתהא קלה בעיניו להוציאה. S UMMARY The כתובה of a בתולה is מדאורייתא. T HINKING IT OVER According to the explanation of the ר״ת (that we follow רשב״ג) is the הלכה like ר״נ (that חזקה א״א טורח וכו׳ and he is believed) or like רב אשי (that without משמוש he is not believed)?

חזקה אין אדם טורח כולי - It is presumed; a person does not toil, etc. O VERVIEW רבא explained the reason the husband is believed by טענת בתולים is because of the חזקה that אין אדם טורח בסעודה ומפסידה. This means that by claiming this טענה, he will lose his wife and would have wasted the entire expense of the wedding. Therefore if it is not true that she is not a בתולה he would not make a claim to hurt himself. תוספות questions whether indeed in all cases of טענת בתולים does the husband harm himself. This line of reasoning is acceptable in a case where she is the wife of a כהן (the one claiming טענת בתולים is a כהן) or her father was מקדש her when she was less than three years old, in which cases she is forbidden to him, therefore it makes sense to say that since he loses her, he is believed (with his טענת בתולים) – תוספות mentions an additional situation where he loses his wife if he claims טענת בתולים: ולמאן דאמר נמי לקמן כנסה בחזקת בתולה ונמצאת בעולה אין לה כתובה כלל ניחא – And also according to the one who maintains later that if he married her with the assumption that she is a בתולה and she was found to be a בעולה, she receives no כתובה at all, it is also understood – דהשתא נמי מפסידה שהרי מקח טעות הוא – For in this case as well he loses her, since it is a mistaken deal – אבל למאן דאמר יש לה כתובה מנה לא מפסיד מידי – However according to the one who maintains that by כנסה בחזקת בתולה ונמצאת בעולה, she receives a כתובה of a מנה, the husband is not losing anything with his טענת בתולים – אלא שבא להפסידה מכתובתה מנה אבל הסעודה לא מפסיד ואמאי מהימן – But rather his intent is to make her lose a מנה from her כתובה, but he does not lose the expense of the wedding feast, so why should he be believed?! And it is the view of תוספות that he is not believed with טענת בתולים according to the מ״ד that כנסה בחזקת בתולה ונמצאת בעולה כתובתה מנה, unless she was an אשת כהן or קבלה אביה קדושין פחותה מבת ג׳. S UMMARY The חזקה of א״א טורח בסעודה וכו׳ is effective only according to the מ״ד that כנסה בחזקת בתולה ונמצאת בעולה מקח טעות however according to the מ״ד that יש לה מנה it is effective only when she is אסורה עליו. T HINKING IT OVER 1. If we maintain כנסה בחזק בתולה וכו׳ מקח טעות, does that mean that the marriage is completely annulled (and no גט is required) and if he wishes to remain with her she requires new קדושין, or not? 2. According to the תוה״ר (in footnote # 6) there is seemingly no difference whether we maintain כנסה בחזקת בתולה ונמצאת בעולה אין לה כתובה or כתובתה מנה, for in either case if he wishes to divorce her immediately he is believed (and she either receives nothing or only a מנה), but if he agrees to remain married to her he is not believed (and her כתובה is מאתיים); why then does תוס׳ differentiate between the two?!

הואיל ותקנת חכמים היא לא תגבה כולי - Since it is an enactment of the sages she will not collect, etc. O VERVIEW The גמרא states that since the right of a woman to receive a כתובה is a תקנת חכמים (and not a תורה obligation on the husband) therefore she collects only from the inferior properties (זיבורית) of the estate. However רשב״ג maintains that the כתובה obligation is דאורייתא (and derives it from the פסוק of כסף ישקול כמוהר הבתולות), but he does not say whether she collects from זיבורית or not. תוספות explains that even if we maintain that כתובה דאורייתא she may not collect her כתובה from עידית. For ר״מ maintains later in פרק אע״פ that כתובה is a תורה obligation – ובפרק הניזקין (גיטין מח, ב ושם) אמרינן דקסבר רבי מאיר דכתובת אשה בבינונית משום חינא – And in פרק הנזקין the גמרא states that ר״מ maintains that כתובת אשה collects from the intermediate fields because of ‘charm’ – וכיון דהויא דאורייתא דינה בעידית כדנפקא לן בריש בבא קמא (דף ה, א) – But since the כתובה obligation is דאורייתא, she should lawfully receive the superior fields, as the גמרא derives in the beginning of מסכת ב״ק, where it states – וכולן כאבות לשלם ממיטב דאתיא תחת נתינה ישלם כסף ואמאי הפקיעו דינה – And all of them (who are required to pay) are like אבות in that they need to pay from the choicest properties, for we derive this from the גזירה שוה of תחת נתינה ישלם כסף, so why did the חכמים nullify her legal right to עידית?! In summation: if we maintain כתובה דרבנן, it is understood why כתובה collects from זיבורית (for this was the תקנת חכמים); however if we maintain כתובה דאורייתא (as ר״מ does), the payment should be בעידית as other דאורייתא payments are, why does ר״מ maintain that כתובה אשה בבינונית (and not בעידית)?! תוספות has an additional question: ועוד דלא מישתמיט תנא בשום מקום דאית ליה כתובת אשה ממטלטלי אלא לרבי מאיר – And furthermore we do not find any תנא anywhere, except for ר״מ, who maintains that כתובת אשה can be collected from movable assets – כדאמרינן בכל דוכתין (יבמות צט, א) הא מני רבי מאיר היא דאמר מטלטלי משתעבדי לכתובה – As the גמרא states everywhere, ‘this (ruling that she can collect מטלטלין) is according to ר״מ who maintains that מטלטלין are pledged for כתובה payments’; the question is – ולמאן דאמר דאורייתא אמאי לא גבי ממטלטלי כמו ניזקין כיון דמהתם ילפינן – And according to the one who maintains that כתובה is דאורייתא (meaning רשב״ג of our גמרא) why cannot the woman collect מטלטלין for her כתובה, just as ניזקין can collect from מטלטלין, since we derive כתובה from ניזקין?! תוספות answers that these restrictions (of not collecting from עידית or from מטלטלין) are a תקנת חכמים: ויש לומר דטעמא שלא יפרשו מהן בני אדם אם יצטרכו למכור עידית או מטלטלים – And one can say; that the reason (that כתובת אשה does not collect עידית or מטלטלין) is in order that people should not avoid marrying women (which they may do), if it will be necessary for them to sell עידית or מטלטלין to pay for the כתובה – וחשו כדי שיקפצו עליהן בני אדם: And the חכמים were concerned for the women and ruled that the men need not give up their עידית or מטלטלין for the כתובה, in order that men will jump at the opportunity to marry these women. S UMMARY Women cannot collect עידית (or מטלטלין) for their כתובה even if we maintain כתובה דאורייתא, since this may prevent people from wanting to marry. T HINKING IT OVER 1. Could תוספות have asked his question on ר״מ without our גמרא, since on one hand he maintains כתובה דאורייתא and on the other he maintains כתובת אשה בבינונית (and not בעידית); why ask the question here?! 2. According to the מסקנא of תוספות what is the meaning of כתובת אשה בבינונית משום חינא; is חינא the reason why she does not receive זיבורית or the reason why she does not receive עידית?

נותן לה ממעות קפוטקיא - He gives her from the money of Kaputkayo O VERVIEW רשב״ג argues with the חכמים and maintains that if he married a woman in קפוטקיא and divorced her in א״י he is required to pay her כתובה with the monies of קפוטקיא, which are larger than the monies of א״י. This proves that רשב״ג maintains כתובה דאורייתא, and since the שעבוד became effective in קפוטקיא (where they married and he wrote the כתובה) therefore he must pay her ממעות קפוטקיא. Our תוספות discusses what difference is there with which money he pays her, that there should be any proof that כתובה דאורייתא. -------------------------– תוספות asks: תימה לרבינו יצחק מה ריוח הוא לה שנותן לה מאותם המעות – It is astounding to the ר״י! What profit does she gain when he pays her with מעות קפוטקיא, since – מכל מקום אינו נותן לה אלא שוה נ׳ שקלים – In any event he only pays her the value of fifty שקלים?! תוספות entertains a possible solution: ואם היינו אומרים דלעולם צריך ליתן לה שקלים שעומדין שם – And if we would assume that the husband is always required to pay her with fifty שקלים of the place in which they reside, meaning that – בקפוטקיא נ׳ שקלי קפוטקיא ובארץ ישראל נ׳ שקלים של ארץ ישראל הוה ניחא – In קפוטקיא the כתובה is fifty שקלי קפוטקיא and in א״י fifty שקלי א״י, it would be understood – תוספות shows that there is such a possibility that the payment must be with the local coin: כדאמרינן גבי ה׳ סלעים דפדיון בכור בפרק יש בכור (בכורות נ, א ושם) – As רב אחא said regarding the five סלעים for the redemption of the first-born in פרק יש בכור – לישדר מר תילתא אחרינא דאוסיפו עלייהו ושדר להו – Let the master (רב אשי) send me three more זוזים which they added on the original סלע) and רב אשי sent it to רב אחא – תוספות rejects this solution: מיהו אין נראה דהתם כשהוסיפו בכל מקום הוסיפו – However it does not seem to apply here; for there in בכורות when they added to the size of a סלע, it was added everywhere; the value of a סלע or שקל was increased universally; all payments in שקל הקודש needed to be increased everywhere – אבל כשמוסיפין במקום אחד אין נראה שבכך תשתנה מדה דאורייתא – However when one place adds to the size of its שקל it does not seem right that by this action the תורה measurement should change and one should be required to give fifty of the larger שקלים. תוספות reverts to the previous solution: ומיהו בירושלמי דפירקין גרסינן אמתניתין דכתובה מאתים – However in the תלמוד ירושלמי of our פרק we read regarding our משנה which states that the כתובה is two hundred זוז, the ירושלמי comments – רבי מונא בשם שמואל אמר בשקל הקדש – ר׳ מונא in the name of שמואל ruled that these two hundred זוז need be in the holy שקל, however – רבי אבא בר בונא אמר מטבע יוצא וכן מסקי התם כמה אמוראי: ר׳ אבא בר בונא ruled the two hundred זוז need to be in issued currency, and many אמוראים there conclude similarly. S UMMARY There are opinions that if the שקל is increased in a particular place the כתובה payment increases. T HINKING IT OVER It seems that (regarding the גמרא in בכורות) the חכמים increased the value of the שקל הקודש (not any [specific] government). How then does תוספות compare (even in the הו״א) the case of בכור where the חכמים dictated that the שקל increased and more money is due for פדה״ב, etc., to the case of קפוטקיא where the government issued larger שקלים?! Why would that affect the חיוב כתובה?!

מברכתא חביטא ליה - is pressed down before him מברכתא O VERVIEW A person came before רב נחמן and claimed פתח פתוח מצאתי. ר״נ ordered that he should be whipped with palm fronds (כופרי), saying ׳מברכתא חביטא ליה׳. The גמרא asked but ר״נ maintains that the claim of פ״פ is believed, why should he be whipped. The גמרא replied it is no contradiction; he is believed but nevertheless he should be whipped since מברכתא חביטא ליה. However רב אחא answered that there is a difference between a בחור who should be whipped and someone who was married previously who is believed. תוספות offers two interpretations of this גמרא. -------------------– פירוש הלקוהו שמוציא שם רע על בת ישראל שהרי משקר – The explanation of this גמרא is that ר״נ said, smite him for he is spreading a bad name on a Jewish daughter, for he is certainly lying with his claim of פ״פ — וכי זונות חבוטות לפניו שיהיה בקי הלכך לא מהימן – For are זונות חבוטות before him that he should be acquainted with what is or is not a פ״פ, therefore he is not believed with his claim of פ״פ. The גמרא asked – והא אמר רב נחמן מהימן ומשני מהימן ומסבינן ליה כופרי – But ר״נ ruled that one who claims פ״פ is believed (how can we say that he is not believed)?! And the גמרא answered that according to ר״נ he is believed and we smite him with כופרי, meaning – ורב נחמן דאמר אסבוהו לא משום שלא היה מאמינו – That when ר״נ ordered, ‘smite him’, it was not because ר״נ did not believe him (as we initially assumed) – אלא היה מאמינו ואמר להלקותו לפי שחשוד על הזנות – But rather he believed him and ordered to smite him because he was suspect for זנות; otherwise how would he know whether it is a פ״פ or not – ורב אחא משני כדסבירא לן מעיקרא דלא מהימן ואיירי בבחור – And ר״א answered as we originally assumed that ר״נ did not believe him, for we are discussing a בחור who was never married, however when ר״נ rules that פ״פ is נאמן that is by one who was already married. תוספות offers an alternate explanation of the גמרא: ועוד יש לומר בניחותא מברכתא חביטא ליה – We can also interpret the מברכתא חביטא ליה as a declarative statement even in the הו״א (not as a rhetorical question as in the first explanation), meaning ר״נ said – אף על פי שהוא נאמן הלקוהו לפי שחשוד על הזנות – Even though he is believed (with the פ״פ claim), nevertheless smite him because he is suspect of זנות (that מברכתא חביטא ליה; otherwise he would not know). The גמרא asked – והאמר רב נחמן נאמן ולא פירש להלקותו – But ר״נ merely ruled that he is believed (to claim פ״פ) and ר״נ did not clarify that he be smitten (seemingly indicating that whoever claims פ״פ need not be smitten) – ומשני מהימן ומסבינן ליה ורב נחמן לא איירי במלקות – And the גמרא answered, no; he is believed and he is smitten, but ר״נ was not discussing lashes (when he ruled that האומר פ״פ מצאתי נאמן) – רב אחא אמר לעולם נאמן דאמר רב נחמן היינו בלא מלקות ובנשוי: ר״א answered that indeed the נאמן of ר״נ is without lashes, provided the claimant was previously married; however in this case he was still a בחור. S UMMARY In the הו״א we can learn that ר״נ either believed him or not; in the conclusion we maintain that even though פ״פ is believed he still may receive lashes (only if he is a בחור according to רב אחא). T HINKING IT OVER 1. Is there a difference in the understanding of רב אחא between the first interpretation of תוספות and the second? 2. What are the relative advantages and disadvantages of each explanation?
