Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1and at the same time he tore another’s silk [ shira’in ]. The question is whether the liability to receive the death penalty exempts him from the liability for payment incurred at precisely the same moment.

2§ The Gemara analyzes the matter itself. Rav Ḥisda said: Rabbi Neḥunya ben HaKana concedes in the case of one who steals another’s forbidden fat and eats it that he is obligated to pay for the fat, as he is already liable for theft before he comes to violate the prohibition against eating forbidden fat. The Gemara comments: Let us say that Rav Ḥisda disagrees with Rabbi Avin, as Rabbi Avin said: One who shoots an arrow from the beginning of four cubits to the end of four cubits in the public domain on Shabbat, thereby performing a prohibited labor for which he is liable to receive a court-imposed death penalty, and the arrow ripped silk as it proceeds, is exempt from the obligation to pay for the silk because he is liable for the more severe punishment for desecrating Shabbat. Although the silk was ripped prior to completion of the prohibited labor, as the arrow had not yet come to rest, he is nevertheless exempt, as lifting is a prerequisite for placement. The prohibited labor of carrying on Shabbat is comprised of lifting of the object and placement. Once he shot the arrow, its movement through the air is a continuation of his act of Shabbat desecration, for which he is liable to be executed. Here, too, say that lifting the fat is a prerequisite for eating, and therefore he should be exempt from payment.

3The Gemara refutes this argument: How can these cases be compared? There, in the case of the arrow, placement is impossible without lifting, as placement without lifting is not a labor prohibited on Shabbat. Therefore, lifting and placement are a single unit. In contrast, here, eating is possible without lifting as, if one wishes, he could bend down and eat without lifting the food to his mouth. Alternatively, there is another difference between the cases: There, in the case of the arrow, even if he seeks to take back the arrow after shooting it, he cannot take it back; therefore, lifting and placement constitute one action. Here, he could replace the fat after lifting it.

4The Gemara asks: What practical difference is there between this formulation, where the criterion is whether the second stage could be performed independent of the first stage, and that formulation, where the criterion is whether the second stage is inevitable after performing the first stage? The Gemara responds: There is a practical difference between them with regard to one who carries a knife in the public domain and tears silk as he proceeds. According to that formulation, where you said: Lifting is a prerequisite for placement, here too, lifting is a prerequisite for placement. As these two stages are inexorably connected, they constitute one action, and the one carrying the knife is exempt from paying the damages. Conversely, according to that formulation where you said: He cannot take back the arrow and that is why they are considered one action, here, he can take back the knife; therefore, lifting and placement are separate actions and he is not exempt from punishment for the damages that he caused.

5§ The Gemara analyzes the matter itself. Rabbi Avin said: With regard to one who shoots an arrow from the beginning of four cubits to the end of four cubits and the arrow rips silk as it proceeds, he is exempt, as lifting is a prerequisite for placement. Rav Beivai bar Abaye raised an objection from that which is taught in a baraita : One who steals a purse on Shabbat is liable for the theft because he was already liable for theft as soon as he lifted the purse. This took place before he came to violate the prohibition against performing prohibited labor on Shabbat by carrying it into the public domain, a violation punishable by stoning. However, if he did not lift the purse but was dragging it on the ground and exiting the private domain, dragging and exiting, he is exempt, as the prohibition against theft and the prohibition of Shabbat are violated simultaneously when he drags the purse out of the owner’s property and into the public domain.

6Rav Beivai concludes: But why is he liable if he carried the purse? Here, too, let us say that lifting is a prerequisite for carrying out, and therefore the theft was performed in the course of performance of the prohibited labor and he is exempt. The Gemara answers: With what are we dealing here? We are dealing with a case where he lifted the pouch in order to conceal it in the same domain, not to carry it out into the public domain, and he reconsidered his plan with regard to the purse and carried it out. In that case the act of lifting was not performed for the purpose of carrying out. Therefore, he is not exempt from the obligation to pay for the theft.

7The Gemara asks: And in a case like that, where he reconsidered, is one liable for carrying out an object on Shabbat? But didn’t Rav Simon say that Rabbi Ami said that Rabbi Yoḥanan said: One who moves objects from one corner of his house to another corner on Shabbat, and he reconsidered his plan in their regard after lifting them and carried them out into the public domain, he is exempt, as the act of lifting was not initially performed for that purpose of carrying from one domain to another. Here, too, since the thief did not lift the pouch with the intention of carrying it out, he is not liable to be stoned.

8The Gemara emends the previous answer: Do not say that he lifted it in order to conceal it; rather, say that he lifted it in order to carry it out. Nevertheless, the case of shooting the arrow and the case of stealing the purse are different, as with what case are we dealing here? It is a case where he stopped in the courtyard before taking the pouch out to the public domain. Therefore, the initial lifting is exclusively theft and not the start of a prohibited labor, as by stopping, he separated the lifting from the carrying out.

9The Gemara asks: This is a case where he stopped. For what purpose did he stop? If he stopped in order to adjust the burden on his shoulder, that is the typical manner of proceeding and would not be considered an interruption in the process of carrying out the object. Rather, it must be in a case of one who stopped to rest, and when he resumes moving he initiates a separate action. The Gemara infers: But if he stopped in order to adjust the burden on his shoulder, what is the halakha ?

    Tosafot

שעקירה צורך הנחה היא - For uprooting is a requirement for placing O VERVIEW The גמרא cited the ruling of רב חסדא that (even) ר׳ נחוניא בן הקנה agrees that if one steals חלב and eats it, he has to pay (even though there is a חיוב כרת for eating חלב), since the חיוב ממון was there (when he stole it) before the חיוב מיתה (when he ate it). The גמרא concludes that רב חסדא can agree to the ruling of ר׳ אבין (that if זרק חץ מתחלת ד׳ לסוף ד׳ וקרע שיראין בהליכתו that he is פטור), either because it is א״א להנחה בלא עקירה however it is אפשר לאכילה בלא הגבהה, or since in a case of א״א לאהדורי all agree that עקירה צורך הנחה and the חיוב מיתה וממון are simultaneous. Our תוספות reconciles this understanding with a seemingly conflicting גמרא. ---------------------– תוספות asks: קשה דאמרינן במרובה (בבא קמא דף ע, ב) גבי גנב ומכר בשבת דפטור – There is a difficulty; for in פרק מרובה, regarding the ברייתא which states that if one stole and sold on שבת he is exempt from paying תשלומי ד׳ וה׳, רב פפא said that the ברייתא is discussing a case where – כגון דאמר ליה זרוק גניבותיך לחצרי ותיקני לי חצירי גניבותיך – For instance the buyer said to the thief, ‘ throw what you stole into my yard and my yard will acquire your stolen goods; in this case the thief is פטור from paying תשלומי ד׳ וה׳ for it is קלב״מ, since he is חייב מיתה for transgressing the מלאכה of הוצאה on שבת, by throwing the גניבה from a רה״ר to a רה״י – ופריך מכי מטי לאויר חצירו קנה ומתחייב בנפשו משום שבת לא הוי עד שתנוח – And the גמרא there asked, the buyer acquires the stolen goods as soon as they cleared the airspace of his yard; however the thief is not מחויב מיתה on account of חילול שבת until it rests on the ground of the yard. The חיוב ממון precedes the חיוב מיתה; there should be no rule of קלב״מ and the thief should pay ד׳ וה׳. The concludes the citation of the גמרא in ב״ק. תוספות continues with his question – ומאי פריך והא עקירה צורך הנחה היא כדאמר הכא. And what is the גמרא asking there; since עקירה is צורך הנחה as the גמרא states here, therefore the חיוב מיתה was already in place when the חיוב ממון began. תוספות offers a partial resolution: ולפירוש רבינו תם אתי שפיר דפירש דאי אפשר לניסוך בלא הגבהה – And according to the explanation of the ר״ת elsewhere it is understood, for the ר״ת explained that pouring (wine for ע״ז) is impossible without picking up the wine first – ואפילו הכי קאמר רב מנסך ממש בהניזקין (גיטין דף נב, ב ושם) – And nevertheless, רב maintains in פרק הניזקין that the משנה means actually pouring the wine for עבודה זרה – ולא קא מפטר משום דקים ליה בדרבה מיניה – And nevertheless he is not exempt from payment on account of קלב״מ for we maintain – כדרבי ירמיה דמשעת הגבהה קונה ומתחייב בנפשו לא הוי עד שעת ניסוך – As ר׳ ירמיה states that he acquires the wine from the time he picked it up and he is not liable for the death penalty until he pours the wine as a libation for ע״ז – והשתא רבי ירמיה לית ליה דהגבהה צורך ניסוך היא – So now we realize that ר׳ ירמיה does not maintain הגבהה צורך ניסוך and therefore even though it is impossible to be מנסך unless one is מגביה first, we do not consider the חיוב מיתה beginning with the הגבהה, but rather the חיוב מיתה begins with the ניסוך which was preceded by the חיוב ממון which began משעת הגבהה – והוא הדין דלית ליה דעקירה צורך הנחה היא – And so the same rule applies that ר׳ ירמיה does not agree that עקירה צורך הנחה and the גמרא in ב״ק which asked that the חיוב ממון precedes the חיוב מיתה agrees with ר׳ ירמיה and therefore we could not answer that עקירה צורך הנחה היא – ולא הוה מפליג בין מצי לאהדורי ללא מצי לאהדורי – And ר׳ ירמיה would not distinguish between a case where he can retrieve (the knife) and a case where he cannot retrieve (the arrow) in all cases we do not say עקירה צורך הנחה היא – תוספות proves that one can maintain that there is no difference whether מצי לאהדורי or לא מצי לאהדורי: תדע ללישנא דאי אפשר להנחה בלא עקירה אמאי נקט רבי אבין זרק חץ לינקוט מעביר – You can know that this is so (that one can maintain there is no difference between מצי לאהדורי and לא מצי לאהדורי), for according the view which maintains that א״א להנחה בלא עקירה (in all instances) why did ר״א mention throwing the arrow, when he could have mentioned moving the arrow (or knife) – אלא ודאי כי הדדי נינהו ומאן דפליג אמעביר פליג נמי אזורק – Bur rather they are certainly the sameת and the one who argues (with ר׳ אבין) concerning מעביר will also argue concerning זורק and maintain in both cases (even where לא מצי לאהדורי) that עקירה לאו צורך הנחה – ואליבא דרבי ירמיה פריך במרובה (בבא קמא דף ע, ב ושם) – And the previously mentioned גמרא in מרובה is asking according to ר׳ ירמיה (that the חיוב ממון precedes the חיוב כרת) – אבל אם אפשר לניסוך בלא הגבהה לא פליג רבי ירמיה אדרבי אבין – However if ניסוך is possible without הגבהה there is no reason to assume that ר״י argues with ר״א so there is no one who maintains עקירה לאו צורך הנחה; the question remains what does the גמרא ask in מרובה regarding תשולמי ד׳ וה׳ that the חיוב ממון precedes the חיוב מיתה since all agree that עקירה צורך הנחה?! תוספות finds support (to the פר״ת) that ר״י argues with ר״א): ובהגוזל בתרא (שם דף קיז, א) משמע קצת דרבי ירמיה פליג אדרבי אבין גבי חזרו לומר אף המנסך – And there is a slight indication in פרק הגוזל בתרא that ר״י argues with ר״א regarding the ברייתא which states; they reconsidered to say even מנסך – דקאמר התם מעיקרא סבור כדרבי אבין ולבסוף סבור כדרבי ירמיה – For the גמרא there said; initially (when מנסך was not included, that was because) they agreed with ר׳ אבין (that עקירה צורך הנחה and it is קלב״מ), and eventually they agreed with ר״י (that הגבהה לאו צורך ניסוך). This proves that they argue. תוספות rejects this proof: [ומיהו יש לדחות דמעיקרא סבור דדמיא לדרבי אבין ולבסוף סבור דדמיא לדר׳ ירמיה]: [However we can discard this proof (for there is no argument between ר״י ור״א); what the גמרא meant is that initially we assumed that the case of מנסך is similar to the case of ר״א (of זרק חץ, and א״א לניסוך בלא הגבהה) and eventually they assumed that it is similar to the case of ר״י (that אפשר לניסוך בלא הגבהה).] S UMMARY If we maintain א״א לניסוך בלא הגבהה we can assume that ר׳ ירמיה maintains עקירה לאו צורך הנחה (even where א״א לאהדוריה). T HINKING IT OVER תוספות maintains that according to the לישנא קמא there is no difference between מצי לאהדורי and א״א לאהדורי. What is the logic behind this?
