1Why would I lie in so ineffectual a manner, and deem her credible? Had she wanted to lie, she could have claimed that she hid, which is a more effective claim. Or perhaps we do not say that principle.

2The Gemara asks: And in what way is this different from that incident where a certain man who rented a donkey to his colleague said to the renter: Do not go on the path of the Pekod River, where there is water, and the donkey is likely to drown. Go on the path of Neresh, where there is no water. And he went on the path along the Pekod River and the donkey died.

3The renter came before Rava and said to him: Yes, I went on the path along the Pekod River; however, there was no water there. The donkey’s death was caused by other factors. Rava said: His claim is accepted based on the principle: Why would I lie. If he wanted to lie, he could have said to him, I went on the path of Neresh. And Abaye said to Rava: We do not say the principle: Why would I lie, in a situation where there are witnesses. This principle, which is a form of miggo , is effective only when his claim does not contradict established facts. In this case, since it is known to all that there is water on the path along the Pekod River, his claim is not accepted. Similarly, as it is an established fact that the women taken captive were certainly raped, her claim is not accepted even though it is based on a miggo .

4The Gemara asks: How can these cases be compared? There, in the case of the donkey, there are certainly witnesses capable of confirming that there is water along that path. Here, in the case of the women, is it clearly established that she was definitely defiled? It is merely a concern, and in a situation where there is merely a concern and not an established fact we say the principle: Why would I lie, and her claim is accepted.

5§ We learned in the mishna: If they have witnesses, even if the witness is a slave and even if the witness is a maidservant, they are deemed credible. The Gemara asks: And is even her personal maidservant deemed credible? The Gemara raises a contradiction from a mishna ( Gittin 73a): With regard to one who divorced his wife conditionally, and the condition was not yet fulfilled, the woman may enter into seclusion with him only on the basis of the presence of witnesses, due to the concern that they will engage in intercourse. If between the drafting of a bill of divorce and its taking effect the husband and wife enter into seclusion together, the bill of divorce must be discarded and a new document drafted in its place.

6And she may enter into seclusion even on the basis of the presence of a slave and on the basis of the presence of a maidservant, except for her personal maidservant, due to the fact that she is accustomed to her maidservant, and her presence will not serve as an impediment that would prevent her from engaging in intercourse. Therefore, with regard to the woman taken captive as well, the testimony of the maidservant is not accepted to establish that she was not defiled. Rav Pappi resolved the contradiction and said: With regard to a captive woman, the Sages ruled leniently. Because the prohibition against intercourse with a captive woman is based on the concern that she was violated, the Sages relied on the testimony of her personal maidservant.

7Rav Pappa resolved the contradiction and said: This halakha in the case of conditional divorce is stated with regard to her maidservant, who is not deemed credible even in the case of a captive woman. That halakha in the case of the captive woman, where they said even the testimony of the maidservant is accepted, is stated with regard to his maidservant to whom the woman is not so accustomed, and therefore her presence serves as an impediment.

8The Gemara asks: And is her maidservant not deemed credible? But isn’t it taught in the mishna: A person is not deemed credible to establish his status by his own testimony? From that statement it may be inferred that the woman is not deemed credible to testify about herself, but her maidservant is deemed credible. The Gemara answers: The legal status of her maidservant is like her own status. Neither is deemed credible.

9Rav Ashi resolved the contradiction and said: Both halakhot are stated with regard to her maidservant, but there is a distinction between the cases. A maidservant sees what transpires and is silent, but does not testify falsely. Therefore, there, in the case of conditional divorce, where the maidservant’s silence with regard to whether her mistress engaged in intercourse renders the woman permitted, as it is sufficient for the maidservant to say merely: I was there, she is not deemed credible due to the concern lest she witnessed them engaging in intercourse and remained silent. However, here, in the case of the captive woman, where the maidservant’s silence would render her mistress forbidden, as a captive woman is presumed to have been violated and the only way to render her permitted is by saying: She was not defiled, she is deemed credible.

10The Gemara asks: Here too there should be concern that she will come and lie for the benefit of her mistress. The Gemara answers: She would not perform two acts of dishonesty. Although there is suspicion that she will refrain from telling the truth, there is no suspicion that she will lie as well. Therefore, if she relates that her mistress was not defiled, she is deemed credible.

11Proof that one is not suspected of both concealing the truth and lying is cited, as in that case of Mari bar Isak, and some say it was Ḥana bar Isak, where someone claiming to be his brother came to him from Bei Ḥoza’a, a district located far from the Jewish population centers in Babylonia. This brother said to him: Apportion me a share in my father’s property. Mari said to him: I do not know you. The brother came before Rav Ḥisda seeking a legal remedy. Rav Ḥisda said to him: Your brother is speaking well and his response is well founded, as it is written: “And Joseph recognized his brothers but they recognized him not” (Genesis 42:8). This teaches that Joseph left the land of Canaan without the trace of a beard and came to meet his brothers with the trace of a beard.

12Rav Ḥisda said to him: Go bring witnesses that you are his brother. He said to Rav Ḥisda: I have witnesses, but they are afraid of Mari, who is a violent man, and will not testify. Rav Ḥisda said to Mari: Go bring witnesses that he is not your brother. Mari said to him: Is that the halakha ? Isn’t the guiding principle in cases of this sort: The burden of proof rests upon the claimant? Let the man claiming part of my inheritance bring proof supporting his claim. Rav Ḥisda said to him: This is how I render judgment for you and for all your fellow violent men; I place the burden of proof upon them. The Gemara asks: Now too, witnesses will come and lie in fear of Mari, and what is accomplished by requiring Mari to bring the witnesses? Apparently, one is not suspected of performing two acts of dishonesty, to both conceal the truth and to lie.

13The Gemara suggests: Let us say that the opinions of the amora’im with regard to the testimony of her maidservant are subject to this dispute between tanna’im . It is taught in one baraita : This testimony that a captive woman was not defiled with regard to which a man and a woman, a male child or a female child, the woman’s father, and her mother, and her brother, and her sister are deemed credible, but not her son and her daughter, and not her slave or maidservant. And it is taught in another baraita : All are deemed credible to testify with regard a captive woman, except for her and her husband.

14The Gemara notes: The opinion of Rav Pappi and the opinion of Rav Ashi are certainly subject to the dispute between tanna’im , as they hold that her maidservant is deemed credible contrary to the first baraita cited. However, with regard to the opinion of Rav Pappa, who distinguishes between her maidservant, who is not deemed credible, and his maidservant, who is, do we say that it is subject to the dispute between tanna’im ? Perhaps the tanna in each baraita holds that her maidservant is not deemed credible, and the baraita that deems everyone credible except for the woman and her husband could be explained in another manner, e.g., the legal status of her maidservant is like her own status.

15The Gemara says: There is no proof that Rav Pappa’s opinion is contingent upon the tannaitic dispute, as Rav Pappa could have said to you: When that baraita that deems everyone credible except for the woman and her husband is taught, it is taught in a case where she is making an unconsidered, incidental remark in the context of a conversation about an unrelated matter. However, direct testimony of her maidservant is not accepted.

16As in that case when Rav Dimi came from Eretz Yisrael to Babylonia; he said that Rav Ḥanan of Carthage relates: An incident came before Rabbi Yehoshua ben Levi for judgment; and some say that Rabbi Yehoshua ben Levi relates: An incident came before Rabbi Yehuda HaNasi, with regard to a person who was making an unconsidered, incidental remark, and said: My mother and I were taken captive among the gentiles. When I went out to draw water, my thoughts were about my mother; to gather wood, my thoughts were about my mother. We were never separated. And Rabbi Yehuda HaNasi deemed her fit to marry into the priesthood on the basis of those remarks, even though with regard to testimony about his mother, a son is disqualified as a witness. The same is true of the woman’s maidservant.

17MISHNA: Rabbi Zekharya ben HaKatzav said: I swear by this abode of the Divine Presence that my wife’s hand did not move from my hand from the time that the gentiles entered Jerusalem until they left, and I know for a fact that she was not defiled. The Sages said to him: A person cannot testify about himself. The legal status of one’s wife is like his own status in this regard. Therefore, your testimony is not accepted, and your wife is forbidden to you.

18GEMARA: The tanna taught in the Tosefta : And even so, despite the fact that the Sages ruled his wife forbidden to him because he was a priest, he did not divorce her. He designated a house in his courtyard for her, but did not enter into seclusion with her, and when she would go out of the courtyard she would go out before her sons so that she would not be alone in the courtyard with her husband, and when she would enter the house, she would enter after her sons, for the same reason.

19Abaye raises a dilemma: What is the halakha regarding whether we have to do likewise with a divorcée? Can a priest who divorces his wife designate a house for her in the courtyard and rely on the children to ensure that the couple will not enter into seclusion? Is it specifically there, in the case of Rabbi Zekharya ben HaKatzav because with regard to a captive woman the Sages ruled leniently, since the prohibition is based on suspicion and not certainty; however here, in the case of a divorcée, where there is a certain Torah prohibition, no, he may not designate a residence for her in the courtyard? Or perhaps, the case of a divorcée is no different.

20The Gemara cites proof to resolve the dilemma: Come and hear proof as it is taught in a baraita : With regard to one who divorces his wife, she may not marry and live in his immediate vicinity, i.e., his courtyard, due to the concern that because of the intimacy they once shared, her living there will lead to transgression.

    Tosafot

לא תתיחד עמו אלא בעדים - She should not seclude herself with him; only if there are witnesses OVERVIEW The גמרא cites a משנה, which rules that she should not seclude herself with her husband if he gave her a provisional גט. There are varying views as to which case the משנה is referencing, and the reason for this ruling. ---------------------– פירוש בקונטרס משום גט ישן – רש״י explained that the reason she should not be מתייחד with her husband is because we are concerned for a גט ישן. ולא פירש לטעמיה דפירש בגיטין (דף עג, א) – And רש״י here did not explain this משנה of לא תתייחד עמו according to his view as he explained it in מס׳ גיטין, where רש״י explains that the rule of לא תתיחד עמו is referring to (the previous משנה [see footnote # 1] which cites) a case where a man gave a גט to his wife and said, this גט should be effective from today, if I will die. The reason why לא תתייחד עמו is as רש״י explains there – דבמהיום אם מתי מגורשת למפרע משעת נתינה ולא תתיחד עמו משום חשש קידושין – Because in the case where one states when giving a גט, ‘the גט should be effective from today if I die’ (מהיום אם מתי), the rule is that when the husband dies, she becomes divorced retroactively, from the time of the giving of the גט, and therefore she should not be מתיחד with her husband after she receives the גט, because there is the concern that during this יחוד, there will be a ביאה for the sake of קידושין, and she will regain her marital status, while she thinks (after her husband died) that she is divorced. This concern and interpretation is – כמו המגרש אשתו ולנה עמו בפונדקי בית הלל אומרים צריכה הימנו גט שני (שם דף פא, א) – Like the case of one who divorced his wife and she slept over with him in an inn, where ב״ה rules that she needs a second גט from him in order to be divorced, for the same reason that there may have been ביאה לשם קידושין. This is how רש״י explains the משנה of לא תתייחד עמו in מס׳ גיטין – [ולא שייך גט ישן כלל לפירוש דהתם] – [And the idea of גט ישן is not at all applicable to his explanation there in גיטין] וכן משמע התם בגמרא – And this is what it seems from the גמרא there that the concern is that she will be מקודשת. This concludes the discussion of פירש״י in גיטין (and here in כתובות). תוספות offers his interpretation: אבל לרבינו תם דמפרש מה היא באותן הימים קאי אמהיום אם מתי – However according to the ר״ת who explains that the question (which the משנה asks there in גיטין עג, א), ‘what is her status in those days’; the ר״ת explains that ‘those days’ refer to the case where the man said to his wife, ‘here is your גט, מהיום אם מתי’; the question of the משנה there is what is her marital status until the husband dies (and according to ר׳ יהודה who maintains that she is considered to be fully married, the גמרא there explains that she is not divorced למפרע from the time of the giving of the גט) - ונעשה כאומר מעת שאני בעולם – for we assume that (when he said מהיום אם מתי) it is as if he said, the גט will be effective from the last moment that I am in the world (alive) – שאין דעתו לגרשה אף על פי שאומר מהיום אלא שעה אחת לפני מיתתו – For even though he said מהיום, nevertheless he does not intend the גירושין to retroactively take effect as of now, but rather his intent is that it takes effect, one ‘hour’ before he dies; according to this explanation – הוי טעמא משום גט ישן ובתוספתא משמע כפירוש רבינו תם : The reason why לא תתייחד עמו is because of גט ישן, and not because of קידושין (since she is still married to him). And in the תוספתא it seems that the reason for לא תתייחד עמו is as the ר״ת explained, on account of גט ישן, for מהיום אם מתי means that the גט goes into effect right before he dies, so there can be no חשש of קידושין. SUMMARY The reason why the משנה rules אל תתייחד עמו בעדים in a case of מהיום אם מתי depends on whether she is מגורשת למפרע (so the reason is because of a ביאה לשם קידושין) or whether she is מגורשת סמוך למיתה (where the reason is because of גט ישן). THINKING IT OVER Why indeed did רש״י change his פשט in כתובות from his explanation in גיטין?!

שפיר קאמר לך דכתיב ויכר יוסף - He answered you properly, for it is written and Yosef recognized OVERVIEW The גמרא cites the story of the two brothers, that when מרי said he did not recognize the newcomer, ר׳ חסדא (seemingly) supported his claim, by saying he is justified in not recognizing you, etc. תוספות will explain why it was necessary to justify his claim; did רב חסדא know whether or not he was the (missing) brother?! -------------------------– זה שבא נולד כאן והלך עם אביו למדינת הים – This new brother that came, was born here and lived here together with his brother מרי, and he later went with his father overseas – ועתה כשחזר ואמר לא ידענא לך מיחזי כשיקרא – And now when he returned and מרי told him, ‘I do not know you’, it appears as a lie – כי היה לו לידע אם הוא אחיו אם לאו כיון שמכירו קודם – For מרי should have known definitely whether he is his brother or not, since he recognized him previously when he lived here with his father; מרי should not have equivocated – להכי קאמר רב חסדא דשפיר קאמר ליה שאינו מכירו כדאשכחן ביוסף: Therefore רב חסדא said that (nevertheless מרי is not necessarily lying for) he answered you correctly that he does not recognize you, as we find by יוסף. SUMMARY מרי knew his brother when the brother was younger. THINKING IT OVER If מרי would have said, ‘he is definitely not my brother’; what would/could/should have been the response of רב חסדא?

אמר ליה אית לי סהדי ומסתפינו מיניה דאיניש אלמא הוא - He said to him, I have witnesses but they are afraid of him for he is a strong man OVERVIEW In the story of מרי and his alleged brother, the brother responded to רב חסדא that he has witnesses that he is a brother, however the witnesses are afraid to testify since מרי is a powerful person. ר״ח then told מרי that he should bring witnesses that they are not brothers. The גמרא (perhaps מרי or the brother) asked that that this too is of no avail since the witnesses will lie (out of fear of מרי), to which the גמרא responded that nevertheless they will not lie. תוספות qualifies this גמרא. -----------------------------– נראה לרבינו יצחק דמיירי שהביא עדים – It is the view of the ר״י that we are discussing a case where the brother (of מרי) brought witnesses to support his claim – ואומרים אותו עדות שאתה שואל לא נאמר לך כלום עליו דרגלים לדבר שהוא אלים – However the witnesses said, ‘we refuse to testify (on your behalf) the testimony which you are requesting’ (regarding his status as a brother to מרי); therefore there are grounds to suspect that מרי is a feared person. תוספות continues with the גמרא – אמר ליה זיל כולי פירוש לך הבא אותם עדים עצמם שיראים להעיד עליך – רב חסדא said to מרי, ‘go, etc. bring witnesses that he is not your brother’; the explanation of the request was, go and bring these same witnesses who are afraid to testify on behalf of your brother (as previously mentioned) – שיעידו שאינו אחיך או שיאמרו שאינם יודעים אם הוא אחיך אם לאו – That they should testify that he is not you brother, or they should say that they do not know whether he is your brother or not – וקאמר השתא נמי כיון שיראים ממנו ישקרו לומר אינו אחיו או שאינן יודעין אם הוא אחיו – And the brother [or מרי] asked on the ruling of ר״ח, since the witnesses are afraid of מרי, now when מרי will present them they will still lie and either say he is not his brother, or that they do not know whether he is his brother (and ר״ח answered that even though they are afraid to testify but nevertheless they will not lie.) תוספות explains that this ruling of ר״ח was only because the עדים said they will not testify – אבל אם אין רגלים לדבר אין נראה כלל שיהא נאמן לומר דגברא אלמא הוא – However if there are no grounds for the accusation that מרי is a גבר אלים, it does not seem that the brother will be believed at all to claim that מרי is a גברא אלמא – תוספות proves his point: דאם לא כן כל אדם יאמר על חבירו שהוא גברא אלמא ויביא הוא עדים ואם לא יביא יפסיד – For if you will not say so, but rather maintain that the brother merely claimed that מרי was a גבר אלים without any substantiating evidence, then every person will claim regarding his (responding) litigant that the opposing litigant is a גברא אלמא and therefore the opposing litigant should bring witnesses to disprove my claim against him, and if he will not bring appropriate witnesses he loses the case. This would be a ludicrous proposition; therefore this proves that the claim of גבר אלים will not be accepted unless it is substantiated. תוספות offers (additional) proof that מרי was required to bring the same עדים: ועוד דקאמר השתא נמי אתו ומסהדי – And in addition the brother [or מרי] said, that now also they will testify falsely on behalf of מרי, this proves that they are the same witnesses, for otherwise if מרי was to bring new witnesses how can the brother claim that the new witnesses will lie because they are afraid of מרי – אטו משום דמסתפו מיניה הני סהדי מסתפו מיניה כולי עלמא: Just because these witnesses that the brother brought are afraid of מרי, does that imply that everybody is afraid of מרי?! Obviously not, therefore we must say we are discussing the same witnesses. SUMMARY One can claim that the opposing litigant is a גבר אלים only if he can substantiate this claim; for instance that the עדים declare that they will not testify; in which case the גבר אלים must (can) use these עדים to validate his claim. THINKING IT OVER תוספות is teaching us two (seemingly) separate rules; one that the claim of גבר אלים is valid only when there is רגלים לדבר, and also that מרי [needed to] (could) use these עדים to prove his point. תוספות however seems to mingle the two rules and considers them as one, because first תוספות brings proof to the first rule and then תוספות writes ועוד and brings a proof (only) to the second rule; are these two rules intertwined?!

תרתי לא עבדי - They will not do two wrongs OVERVIEW רב אשי resolved the contradiction between our משנה where her שפחה is believed that she was not defiled, and the משנה of לא תתייחד עמו where her שפחה is not believed (by her silence) that there was no intimacy, because a שפחה is generally quiet, so regarding לא תתייחד we are concerned that she will be quiet (even if something untoward happened), however by שבויה when she states that לא נטמאה she would not openly lie. The גמרא supported this view of ר״א from the story of מרי where רב חסדא said that the עדים will not do two wrongs. תוספות explains the comparison. תוספות explains that the two wrongs are; one – שישתקו ולא יעידו האמת ועוד שיאמרו שקר וכן גבי שפחה: That they remain silent and not testify to the truth that he is the brother of מרי, and secondly that they will lie and testify that he is not the brother, and similarly regarding the maidservant that she will remain silent regarding the טומאה and in addition lie that her mistress was לא נטמאה; this she will not do. SUMMARY It is easier to be passively wrong than actively wrong. THINKING IT OVER Would the same thinking of ר״ח apply if רמי were to bring different עדים; would we also believe them because תרתי לא עבדי, or is it only regarding the same עדים who were initially silent?

במסיחה לפי תומה - When she was speaking innocently OVERVIEW רב פפא differentiated between the testimonies of her שפחה regarding a שבויה; that generally שפחתה is not believed, however if she is מסיחה לפי תומה, even שפחתה is believed. תוספות will differentiate between שפחתה who is believed by מסיחה לפי תומה and herself and her husband who are not believed even if they were מסיח לפי תומם. -------------------------– ואפילו הכי היא ובעלה אינן נאמנין – But nevertheless (even though that שפחתה [who is generally not believed] is believed by מסיחה לפי תומה, however), the שבויה and her husband are not believed even במל״ת to say that she was not defiled. תוספות anticipates a difficulty: אף על גב דיוחנן אוכל חלות (לעיל דף כו, א) היה נאמן על עצמו במסיח לפי תומו – Even though יוחנן אוכל חלות was believed regarding himself במל״ת regarding his כהונה status, so why by שבויה, the captive and her husband are not believed במל״ת – תוספות replies: הני מילי לתרומה אבל הכא מעלה עשו ביוחסין – When is the subject believed במסל״ת, only regarding תרומה, however here by שבויה, they raised the bar and were more stringent regarding יוחסין, that by יוחסין even מסל״ת is not sufficient for the שבויה and her husband. [אומר רבינו יצחק דמסיח לפי תומו אינו כשר אלא לעדות אשה דרבנן כדאמר ביבמות – The ר״י says that מל״ת is only accepted for testifying for a woman that her husband died (to permit her to remarry) [or for a rabbinic law] as the גמרא states in מס׳ יבמות – והכא בשבויה הקילו]: And here by a שבויה [which is a דרבנן] they were lenient and also accepted מסל״ת (except for her or her husband). SUMMARY The שפחה is believed במל״ת for her mistress but not the subject or her husband. By תרומה (דרבנן) the subject is believed מל״ת. Generally מל״ת is believed by a דרבנן or שבויה and also by עדות אשה. THINKING IT OVER Previously we leant that according to ר״י we do not believe the testimony of an ע״א regarding כהונה (for eating תרומה); however an ע״א is believed regarding שבויה; indicating that תרומה is stricter than שבויה. However here תוספות rules that by מל״ת the subject is believed by תרומה (the case of יוחנן וכו׳), but not by שבויה; indicating that שבויה is stricter that תרומה. How can we reconcile these seemingly opposing rulings?
