    English translation - Ketubot 24b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1Here too, it is referring to a case where the second donkey driver comes with the tools of his trade in his hand, clearly indicating that he too came to sell his produce. Therefore, when the other driver praises his produce, there is room for concern that there was collusion and that in the next city their roles will be reversed. However, when there is no proof of collusion, the Rabbis were not concerned.

2The Gemara asks: And where is the solution of Rabbi Ḥama bar Ukva stated? It is stated concerning that which we learned in a mishna ( Teharot 7:1): In the case of a potter who fashioned his vessels in ritual purity, and abandoned his pots, and descended to drink water from the river, there is concern that in his absence ritually impure people came into contact with his pots. The inner pots are pure, and the outer pots are impure.

3The Gemara asks: But isn’t it taught in a baraita : Both these inner pots and those outer pots are ritually impure? Rabbi Ḥama bar Ukva said: That baraita is referring to a case where the tools of the potter’s trade are in his hand, indicating that he intends to sell his pots. Since all potential buyers touch pots when examining them before purchase, the concern is that among those people there is one who is ritually impure.

4The Gemara asks: But isn’t it taught in another baraita : Both these inner pots and those outer pots are ritually pure? Rabbi Ḥama bar Ukva said: That baraita is referring to a case where the tools of the potter’s trade are not in his hand, indicating that he does not intend to sell his pots. Therefore, strangers will not touch them at all.

5The Gemara asks: But if so, the ruling in the mishna: The inner pots are pure and the outer pots are impure, under what circumstances can this case be found? When the tools of the potter’s trade are in his hand, all the vessels are impure, and when the tools of the potter’s trade are not in his hand, all the vessels are pure.

6The Gemara answers: The tanna of the mishna is referring to a case where the tools of the potter’s trade are not in his hand. However, he leaves his pots adjacent to the public domain, and in an area demarcated from the public domain due to the stakes or other objects that are placed on the sides of the public domain to distance passersby from the walls of the private domain, and due to crowding, people will be pushed to the sides and inadvertently render the outer pots impure. They do not pass close to the inner pots and will not touch the pots to examine them, because they are not for sale.

7The Gemara proceeds to cite an additional resolution to the contradiction between the opinions of Rabbi Yehuda and the Rabbis, with regard to collusion in terms of the presumptive status of priests and in terms of produce merchants. And if you wish, say instead that the dispute between Rabbi Yehuda and the Rabbis in the matter of presumptive priestly status is unrelated to collusion. Rather, it is with regard to whether one elevates one who eats teruma to the presumptive status of priesthood for the purpose of lineage that they disagree. Rabbi Yehuda holds that one elevates from teruma to lineage and therefore requires full-fledged testimony by two witnesses to enable the person to partake of teruma . The Rabbis maintain that one does not elevate from teruma to lineage, and each matter is considered separately. For the purpose of partaking of teruma , any testimony is sufficient; for the purpose of lineage, full-fledged testimony by two witnesses is required.

8§ A dilemma was raised before the Sages: What is the halakha with regard to elevating from documents indicating that one is a priest, to priestly lineage? The Gemara asks: What are the circumstances? If you say that it is written in the document: I, so-and-so, a priest, signed as a witness, in that case who is testifying about him that he is a priest? He is the only source asserting his priesthood.

9The Gemara answers: No, this halakha is necessary in a case where it is written in the document: I, so-and-so, a priest, borrowed one hundred dinars from so-and-so, and witnesses signed the document, what is the halakha ? Do the witnesses testify only concerning the loan of one hundred dinars in the document? Or, perhaps they testify concerning the entire matter and confirm with their signatures that every detail written in the document is true, including the fact that the borrower is a priest. With regard to the halakhic ruling, there is a dispute between Rav Huna and Rav Ḥisda. One said: One elevates from documents to priestly lineage, and one said: One does not elevate.

10A dilemma was raised before the Sages: What is the halakha with regard to elevating from the lifting of hands for the Priestly Benediction to priestly lineage? Is the presumptive status of a person who recites the Priestly Benediction in the synagogue that of a priest in terms of lineage as well? The Gemara notes: Raise the dilemma according to the one who said: One elevates from teruma to lineage; and raise the dilemma according to the one who said: One does not elevate from teruma to lineage.

11The Gemara notes: Raise the dilemma according to the one who said: One elevates from teruma to lineage. In his opinion, perhaps this applies only to teruma , where a non-priest who partakes of teruma performs a transgression whose punishment is death at the hand of Heaven. One would not partake of teruma and risk that punishment if he were not a priest. However, with regard to the Priestly Benediction, where a non-priest who recites it violates a prohibition stated as a positive mitzva, no, one cannot be certain that one would not recite the blessing if he were not a priest. Therefore, one does not elevate from the lifting of hands to priestly lineage. Or, perhaps there is no difference, and in both cases because there is a transgression involved one can assume that he would not risk performing a transgression were he not a priest.

12Raise the dilemma according to the one who said: One does not elevate from teruma to lineage. In his opinion, perhaps this applies only to teruma that is eaten in private. Therefore, a non-priest might partake of teruma when he believes that no one is watching. However, with regard to the lifting of hands, which is recited in public [ parhesya ], if one is not a priest, he would not be insolent to the extent that he would comport himself like a priest in public. Therefore, although partaking of teruma is not a clear indicator that he is a priest, reciting the Priestly Benediction is a clear indicator. Or perhaps, there is no difference, and due to the concern lest a non-priest partake of teruma in private and recite the Priestly Benediction in public, neither action can facilitate elevating the person to the presumptive status of a priest in terms of lineage.

13There is a dispute with regard to the halakhic ruling between Rav Ḥisda and Rabbi Avina. One said: One elevates from the Priestly Benediction to lineage, and one said: One does not elevate. Rav Naḥman bar Yitzḥak said to Rava: What is the halakha with regard to elevating from the lifting of hands to lineage? Rava said to him: There is a dispute between Rav Ḥisda and Rabbi Avina.

14Rav Naḥman bar Yitzḥak asked Rava: What is the halakha ? Rava said to him: I know and base the halakhic ruling on a baraita , as it is taught in a baraita that Rabbi Yosei says: Great is the legal authority of presumptive status, as one may rely upon it in determining halakhic practice, as it is stated: “And of the children of the priests: The children of Habaiah, the children of Hakkoz, the children of Barzillai, who took a wife of the daughters of Barzillai the Gileadite, and was called after their name. These sought their register of the genealogy, but it was not found; therefore were they deemed tainted and put from the priesthood. And the Tirshatha said unto them that they should not partake of the most sacred items, until there stood up a priest with Urim VeTummim” (Ezra 2:61–63).

15Rabbi Yosei explains: Nehemiah said to the priests whose status was uncertain: You maintain your presumptive status. Of what did you partake in the Babylonian exile? It was the consecrated items eaten in the outlying areas, i.e., teruma . Here too, you may continue to partake of the consecrated items eaten in the outlying areas, but you may not partake of offerings, with regard to which you have no presumptive status of priesthood. The Gemara asks: And if it enters your mind to say that one elevates from the lifting of hands to lineage, they will come to elevate those priests whose status was uncertain to priestly status in terms of lineage, since they lifted their hands and recited the Priestly Benediction in exile.

16The Gemara answers: Here it is different. There was no concern lest they elevate them to lineage because their presumptive status was undermined by the fact that they did not partake of offerings like the other priests. As, if you do not say that one relies on the fact that their status was undermined, according to the one who said: One elevates from teruma to lineage, since they partake of teruma , there should be concern lest they come to elevate them to lineage. Rather, is the reason that this is not a concern not due to the fact their presumptive status was undermined, and it is clear to all that there is uncertainty with regard to their status as priests? However, one may not infer from the time of Nehemiah to a time when all priests eat teruma and recite the Priestly Benediction, and there is no factor that indicates that they are anything less than full-fledged priests. Perhaps, then, one elevates from teruma and from the lifting of hands to lineage.

For it is forbidden from a positive commandment - "So shall you bless" (Numbers 6). You [priests] and not non-priests. And a negative commandment that comes from a positive commandment is [called] a positive commandment.

בשכלי אומנותו בידו - When the tools of his trade are in his hand OVERVIEW רבא reconciled the view of the רבנן in the ברייתא of אני כהן (where they maintain לא חיישינן לגומלים) and the רבנן in the משנה of החמרין (where they maintain חיישינן לגומלים); that one of these is in a case where כלי אומנתו בידו. According to רש״י the answer was that the case of the חמרין is where the one who deprecated his wares was nevertheless holding on to his tools of the trade; indicating that in the next city the two חמרים will reverse their claims. תוספות offers an alternate explanation. --------------------------– פירש רבינו חננאל זה שאומר עליו שהוא כהן יש בידו כלים שמשמשין בהן בטהרה – The ר״ח explains that ה״נ בשכלי אמונתו בידו means that this person, on whom he is testifying that he is a כהן, has in his possession the types of utensils that are used when one desires to conduct himself בטהרה – כגון כלי גללים כלי אבנים כלי אדמה שאין מקבלין טומאה – For instance כלים from dung, stone כלים, or earthen כלים, which are not מקבל טומאה – שכל הרואה כלים הללו בידו מתרחק ממנו מלטמאותו ודומה שהוא כהן ולכך האמינוהו חכמים: So that whoever sees these כלים in his possession distances himself from him in order not to be מטמא him, and it is likely that he is a כהן, therefore the חכמים believed him (to say וחברי כהן). SUMMARY The case of אני כהן וכו׳ נאמן is when שכלי אומנתו בידו. THINKING IT OVER Are the רבנן concerned for גומלים or not?

ואיבעית אימא רבי יהודה ורבנן במעלין מתרומה ליוחסין קמיפלגי - And if you wish, I can say; ר״י ורבנן are arguing whether we are מעלה מתרומה ליוחסין OVERVIEW The גמרא cited a ברייתא and משנה in which ר״י ורבנן are seemingly giving self-contradictory rulings. The גמרא now is offering a new answer to resolve this contradiction. תוספות discusses this answer and its ramifications. ----------------------– תוספות qualifies the scope of this answer: ולא אתא לשנויי אלא קשיא דרבי יהודה אדרבי יהודה – And the גמרא is offering this answer only to resolve the contradiction from ר״י on ר״י (that regarding וחברי כהן he is not believed, and regarding the חמרין he is believed) – אבל דרבנן אדרבנן לעולם צריך לתרץ בשכלי אומנותו בידו – However regarding the contradiction from the רבנן on the רבנן, we still require the answer of בשכלי אומנתו בידו. תוספות asks: הקשה הרב שמואל מווארדין ומעיקרא היכי בעי למימר דטעמא דרבי יהודה משום גומלין – הר׳ שמואל מווארדין asked; and how did the גמרא initially want to say that the reason ר״י does not believe the כהן to say וחברי כהן is because of collusion – והא בלא גומלים על כרחך סבר רבי יהודה בשילהי פרקין (לקמן דף כח, ב) דמעלין מתרומה ליוחסין – For even without the concern of גומלים, the כהן will not be believed since perforce ר״י maintains in the end of our פרק that מעלין מתרומה ליוחסין?! תוספות answers: ותירץ רבינו יצחק דמעיקרא סלקא דעתין דאי לאו טעמא משום גומלים – And the ר״י answered that initially the גמרא assumed that if not for the reason of גומלים – לא היינו מפסידים את הכהן מן התרומה כדי לומר מעלין – We would not have caused the כהן to lose the תרומה in order to rule מעלין מתרומה ליוחסין – כיון דמן הדין ראוי לחלוק על פי חבירו ואדרבה קודם היינו אומרים אין מעלין – Since according to the law it is proper for this כהן to collect תרומה by the testimony of his friend; and on the contrary we would prefer to say אין מעלין מתרומה ליוחסין to protect his תרומה rights – תוספות anticipates a difficulty: אף על גב דגבי עבד אמר לקמן לרבי יהודה דאין חולקין לו תרומה משום דמעלין – Even though that ר״י states later regarding an עבד כנעני, that we do not disburse תרומה to him because of the concern of מעלין מתרומה ליוחסין; why do we not say there as well that we do not want to cause the עבד a loss of תרומה (and we should enact that אין מעלין מתרומה ליוחסין) – תוספות replies: התם אין כל כך חששא בהפסד של עבד זה אם אין חולקין לו תרומה בלא רבו – There by עבד there is not such a concern for the loss of the עבד if we do not disburse תרומה to this עבד without his master, since he will receive תרומה through his master. However, regarding the כהן if his friend is not believed he will lose the תרומה entirely. תוספות asks: ואם תאמר ובאיזו סברא פליגי – And if you will say; but what is the logic of their dispute – לימרו תרוייהו דמעלין ונצטרך שני עדים בתרומה Let either both ר״י ורבנן agree that מעלין מתרומה ליוחסין and two עדים should be required to allow him to receive תרומה – או לימרו תרוייהו דלא מעלין ולא יצטרך אלא עד אחד בתרומה – Or let them both agree that אין מעלין וכו׳ and we will require only one עד for תרומה – תוספות answers: ויש לומר דבהא פליגי דמר סבר חיישינן שמא יעלו מתרומה ליוחסין לפיכך הצריכו שני עדים – And one can say; that their argument is, that ר״י maintains that we are concerned that perhaps the people will mistakenly be מעלה מתרומה ליוחסין, therefore there is a requirement for two עדים to testify that he is a כהן and be allowed to receive תרומה – ומר סבר דלא חיישינן: And the רבנן maintain that we are not concerned that the people will mistakenly be מעלה מתרומה ליוחסין; everyone knows that יוחסין is special and even though he is receiving תרומה they will not consider him a מיוחס, so therefore there is no concern (even) if we allow him to receive תרומה ע״פ ע״א. SUMMARY The dispute whether מעלין מתרומה ליוחסין is not regarding a law or enactment but rather whether there is a concern that mistakenly we may be מעלה מתרומה ליוחסין. THINKING IT OVER It appears from תוספות that according to ר׳ יהודה since there is a חשש גומלין therefore אין מעלין לכהונה ע״פ ע״א (and therefore מעלין מתרומה ליוחסין), implying however when there is no חשש גומלין then we would be מעלה ע״פ ע״א. How can ר״י maintain that מעלין מתרומה ליוחסין, since there is the possibility to be מעלה לכהונה ע״פ ע״א where there is no חשש גומלין for instance if he claims אני ישראל וחברי כהן?! 2. What is the connection between the beginning of תוספות with the subsequent question of ר״ש מווארדין and with the final וא״ת?

אמנה שבשטר קמסהדי - Are they testifying on the money in the note OVERVIEW The גמרא queried whether we are מעלה משטרות ליוחסין or not, in a case where the עדים signed on a שטר in which one of the parties was referred to as a כהן. The question is whether the עדים when they sign on the שטר are only testifying that the loan took place and they pay no attention to the details whether the מלוה or the לוה is a כהן or a ישראל (and therefore אין מעלין משטרות ליוחסין) or do we say that the עדים also verify these details (and therefore מעלין משטרות ליוחסין). Our תוספות discusses the view of אמנה שבשטר קא מסהדי. ---------------------------– תוספות asks: ואם תאמר ואי לאו אכולא מילתא קמסהדי – And if you will say; and if the עדים do not testify on all the details of the שטר, but rather they are only testifying אמנה שבשטר – אם כן עדים חתמי אף על גב דלא ידעי אי כהן הוא אי לאו – If that is indeed so, the עדים sign even if they do not know if he is a כהן or not – ואם כן הא דתנן בגט פשוט (בבא בתרא דף קעב, א) שני יוסף בן שמעון הדרין בעיר אחת – If indeed this is so; that which the משנה teaches in פרק גט פשוט, if there are two יוסף בן שמעון who live in one city we must write a third generation (their grandfathers’ names) in order to distinguish between them – אם היו משולשין יכתבו כהן – If they had identical names even up to the third generation, they should write ׳כהן׳ if only one of them was a כהן, and that will distinguish between them. This concludes the משנה. תוספות continues with his question – ומה מועיל כיון שעדים חותמין אף על פי שאין מכירים בו אם הוא כהן – But what would it help writing ׳כהן׳, since the עדים sign regardless whether they know if he is a כהן or not – והרי הוא יכול להערים ולכתוב שטר אחר בשם חבירו כהן ויוציא ממון מחבירו כהן – So one can be sly and write a שטר in the name of his חבר the כהן and the מלוה will take away the money from his friend the כהן! תוספות answers: ויש לומר דהיכא דהוחזקו שני יוסף בן שמעון ודאי אכולא מילתא קא מסהדי – And one can say that in a place where it is established that there are two יוסף בן שמעון, the עדים certainly testify on all the details – כי אז הן צריכין לידע אם בן כהן הוא – Because in that situation they are required to know if he is the son of a כהן or not, to assure that it is the correct לוה – והתם ודאי מעלין משטרות ליוחסין והכא מיבעיא לן היכא דלא הוחזקו: And in that situation we are certainly מעלה משטרות ליוחסין, since the עדים are required to verify in this case that he is a כהן; however here we are asking what is the ruling in a situation where it was not established that there are two יוסף בן שמעון. SUMMARY Even if we assume אמנה שבשטר הן מעידין, nevertheless if הוחזקו שני יוסף בן שמעון then we say אכולא מילתא קמסהדי and we are מעלה משטרות ליוחסין. THINKING IT OVER תוספות asked that if אמנה שבשטר הם מעידין so the לוה can write הכהן (even though he is not a כהן), for the עדים will not notice and the כהן will lose money שלא כדין. However, granted that the עדים will not notice, but the מלוה will notice that he wrote הכהן (when indeed he is not a כהן) and will protest because he knows that if he will go to the כהן, the כהן will (rightfully) deny the loan and the מלוה will have difficulties collecting it. How can there be a הערמה?

חד אמר מעלין - One said, we elevate OVERVIEW The גמרא cites a dispute whether we are מעלה משטרות ליוחסין (and similarly whether we are מעלה מתרומה ליוחסין, or מנשיאות כפים ליוחסין, etc.). תוספות explains why (according to the מ״ד מעלין in these respective מחלוקות) these cases are not mentioned in the משנה which discusses the various approved proofs for כהונה. ---------------------– תוספות asks: ואם תאמר ואמאי לא חשיב ליה בהדי הנך דתנן בעשרה יוחסין (קדושין דף עו. ושם) – And if you will say; why does he not mention the case of שטרות among those which the משנה taught in פרק עשרה יוחסין that – אין בודקין מן המזבח ולמעלה ולא מדוכן כולי – ‘We do not investigate beyond the מזבח and not beyond the דוכן, etc.’ תוספות answers: ויש לומר דהך דשטרות מלתא דפשיטא היא – And one can say; that in this case of שטרות, it is an obvious ruling that he is considered a כהן – דכיון דאכולא מלתא קמסהדי אם כן הוי עדות גמור – For since (according to the מ״ד מעלין משטרות ליוחסין the reason we are מעלין is because) the עדים testify on the entire statement of the שטר (including the אני פלוני כהן), therefore it is a valid testimony, and obviously he is a כהן – ולכך לא קא חשיב עדים – And therefore the משנה in קדושין does not mention עדים either (that if עדים testify that someone is a כהן מיוחס, there is no further need of בדיקה), for it is obvious. תוספות asks: ואם תאמר ואמאי לא חשיב תרומה ונשיאות כפים למאן דאמר מעלין – And if you will say; why does not the משנה in קדושין mention the exemption from בדיקות where he receives תרומה or he preforms נשיאות כפים, according the one who maintains that we are מעלה from either תרומה or נשיאות כפים to יוחסין? תוספות answers: ואומר רבינו תם דתרומה בכלל מזבח ונשיאות כפים בכלל דוכן – And the ר״ת answers that תרומה is included in the exemption of מזבח and נשיאות כפים is included in the exemption of דוכן – תוספות anticipates a difficulty: אף על גב דההוא דוכן היינו שיר כדמשמע התם בגמרא – Even though that דוכן which is mentioned in the משנה in קדושין means the platform that was used by the לוים for song, as indicated there in the גמרא; so how can תוספות say that נשאית כפים is בכלל דוכן when they are completely different from each other? תוספות responds: מאן דאמר מעלין הוה מוקי לה נמי בדוכן כהנים שבגבולים – The one who maintains מעלין מנשיאת כפים ליוחסין will establish that which the משנה writes דוכן to also include the נשיאת כפים of the כהנים in all of א״י (this too exempts from any further בדיקות), and not only to the דוכן which was in the ביהמ״ק for the שיר הלויים. תוספות asks: ומיהו קשה אמאי לא חשיב ספר תורה שקרא בחזקת כהן כדלקמן – However there is a difficulty; why does not the משנה mention ס״ת, where one read from the תורה first that he is בחזקת כהן, which the גמרא states later?! תוספות answers: ויש לומר דאיכא למימר דתנא ושייר כולהו – And one can say; that the משנה taught some exemptions and left out mentioning all the other cases which are mentioned here (שטרות, תרומה נש״כ, ס״ת). תוספות offers an alternate answer: ובספר הישר פירש רבינו תם דלאו בעבודת מזבח ממש איירי – And the ר״ת in ספר הישר explained that when the משנה mentions מזבח it is not referring to actually doing service for the מזבח (for that is too obvious that he requires no additional בדיקה) – אלא כגון הפשט וניתוח דברים הכשרים בזרים – But rather the משנה is referring other types of מזבח service, for instance skinning off the hide or cutting up the קרבן, which are permissible for a זר to perform, but nevertheless by doing them they are exempted from further בדיקה – דלא היו מניחין לעשות אותם אלא למיוחסין מן המשיאין לכהונה – Since they would only allow those whose ancestry allows them to marry into כהונה to perform those duties, therefore it is sufficient to exempt them from further בדיקות – אבל מילי דכהונה כגון תרומה ונשיאות כפים וספר תורה לא איצטריך למתני: However regarding items which belong to כהונה exclusively such as תרומה ונשיאות כפים וס״ת, it was not necessary to mention them in the משנה, for it is obvious that in these cases there is no need for additional בדיקות. SUMMARY The משנה in קדושין did not include the various cases of מעלין (either because תנא ושייר or) because it is obvious (שטרות) or already included (תרומה ונש״כ). Alternately it only mentions things which are כשרים בזרים, not exclusively for כהנים. THINKING IT OVER 1. תוספות maintains that by reading first in the ס״ת we are מעלין ליוחסין. However the גמרא merely states later that רב אמי העלה לכהונה, but it may have been just for אכילת תרומה and not for יוחסין! 2. According to the ספר הישר anything which is exclusively for כהנים the משנה did not mention. Why therefore did the משנה mention דוכן which (seemingly) was exclusively for the use of the לויים?!

(לעיל) או דלמא אפילו למאן דאמר אין מעלין הני מילי תרומה דמתאכלא בצינעה כולי — Or perhaps even according to the מ״ד אין מעלין; that is only by תרומה, which is eaten discreetly, etc. OVERVIEW The גמרא presented a query whether we are מעלה מנשיאות כפים ליוחסין. This query is valid even if we maintain אין מעלין מתרומה ליוחסין, for the reason we are not מעלה מתרומה ליוחסין is because תרומה is מתאכלא בצינעה; however נשיאת כפים is בפרהסיא, so it is likely that he would not be נושא כפיו if he is not a כהן. Our תוספות discusses the concept of (אין מעלין מתרומה ליוחסין because תרומה is) מתאכלי בצינעה. ----------------------– תוספות asks: תימה מה תולה באכילה והא פשיטא דלכולי עלמא אין מעלין מאכילת תרומה ליוחסין – It is astounding! How can the גמרא relate the idea of אין מעלין מתרומה ליוחסין, to the fact that תרומה is eaten בצנעא?! For it is obvious according to everyone that we cannot be מעלה to יוחסין based on the fact that he is eating תרומה; the reason is – דהא איכא למיחש דלמא עבד כהן הוא – For there is the concern that perhaps this person who is eating תרומה is the slave of a כהן who is permitted to eat תרומה. Obviously we cannot be מעלה anyone to יוחסין based on the fact that he is eating תרומה! אלא בחלוקת תרומה בגורן הוא דפליגי אם מעלים ליוחסין אם לאו – Rather the dispute whether we are מעלה מתרומה ליוחסין or not, is where they distributed תרומה to this individual in the threshing place (as תוספות will shortly explain). Why therefore does the גמרא mention that תרומה is eaten בצנעה since it is irrelevant to our discussion here?! תוספות proves his point that the issue of whether מעלין מתרומה ליוחסין or not, is dependent on חלוקת תרומה בבית הגרנות (but not with אכילת תרומה): ובמעלין מתרומה ליוחסין לא איפליגו בה תנאי בהדיא – For there is no explicit argument of תנאים regarding מעלין מתרומה ליוחסין – אלא דתליא הא פלוגתא בפלוגתא אם חולקין תרומה לעבד בלא רבו אם לאו – Rather the dispute whether מעלין מתרומה ליוחסין depends on the dispute whether we distribute תרומה to a slave without his master present or not – למאן דאמר חולקין אין מעלין דדלמא עבד הוא – According to the מ״ד חולקין תרומה לעבד בלא רבו, he will also maintain אין מעלין מתרומה ליוחסין, because perhaps this person who received תרומה is an עבד. In conclusion it is evident (according to תוספות) that all agree that we are not מעלה to יוחסין based on the fact that he eats תרומה, for he can be an עבד. The מחלוקת whether we are מעלה מתרומה ליוחסין refers to one who receives תרומה בבית הגרנות, and issue is whether we distribute תרומה בבית הגרונות to an עבד or not. תוספות continues to explain how the גמרא should have worded the query regarding מעלין מנשיאות כפים ליוחסין: והכי איבעי ליה למימר הכא אפילו למאן דאמר אין מעלין – And this is how the גמרא should have stated its question; here regarding מעלין מנש״כ ליוחסין, it is possible that even the one who maintains אין מעלין מתרומה ליוחסין – הני מילי תרומה דחולקין לעבד בלא רבו ואיכא למיחש דלמא עבד הוא – That is only regarding תרומה where we distribute תרומה to an עבד without his master, so there is the concern that perhaps the person who received the תרומה is an עבד – אבל נשיאות כפים לעולם אימא לך דמעלין דאין עבד נושא כפיו: However regarding נשיאות כפים, I will tell you that everyone agrees that מעלין מנש״כ ליוחסין since an עבד is not נושא כפיו. [נראה לי דשפיר נקט דמתאכלא בצינעא – It seems to me that the גמרא correctly mentions מתאכלי בצינעא regarding the distinction between תרומה and נש״כ (despite תוספות reservations) – דלמאן דאמר מעלין מאכילת תרומה נמי מעלין – For the one who maintains מעלין מתרומה ליוחסין maintains that מעלין ליוחסין מאכילת תרומה also, and not only מחלוקת תרומה בבית הגרנות – ובענין דליכא למיחש שהוא עבד שיצא מבית הספר – And this is so when it is in a manner that there is no concern that the person eating תרומה is an עבד, for instance if he was seen leaving a Jewish school – וטעמא כיון דעון מיתה הוא חיישינן שמא יעלוהו ליוחסין – And the reason we are מעלה (מאכילת) תרומה ליוחסין is since it is a capital crime for a זר to eat תרומה, therefore we are concerned that perhaps (a mistaken בי״ד) will be מעלה ליוחסין someone who is eating תרומה – ולכך איצטריך שני עדים להאכילו בתרומה ולכך נמי אין חולקין לעבד אלא אם כן רבו עמו – And therefore in order to circumvent this mistaken בי״ד, they required two עדים to testify that he is a כהן to allow him to eat תרומה, and therefore for the same reason we also do not distribute תרומה לעבד unless his master is with him. ומאן דאמר אין מעלין אף על גב דעון מיתה הוא לא חייש להכי שמא יעלוהו – And the one who maintains אין מעלין מתרומה ליוחסין (because one may eat תרומה בע״א) is not concerned that a mistaken ב״ד may be מעלה him to יוחסין even though it is a capital crime – כיון דבצנעא הויא אכילת תרומה וכן חלוקה – Since the eating of תרומה and similarly the distribution of תרומה is done discreetly, therefore there is no concern that some may mistakenly be מעלה him מתרומה ליוחסין – אבל נשיאות כפים דאיפרסם איבעיא ליה אי חיישינן שמא יעלוהו – However regarding נש״כ which is publicized, the גמרא queries whether in this case there is the concern that they may elevate him to יוחסין (even according to the מ״ד that אין מעלין מתרומה ליוחסין) – משום דאי לאו דכהן הוא לא הוה חציף כולי האי – Because if he were not a כהן he would not be so brazen to be נושא כפיו in public. The ת״י explained why the גמרא can and does use the case of אכילת תרומה. Now the ת״י will reject that which תוספות suggested that the גמרא should have said: ולא הוי מצי למנקט כמו שכתבו התוספות אפילו למאן דאמר אין מעלין – And the גמרא could not have said as תוספות suggested that the query if מעלין מנש״כ ליוחסין is even according to the מ״ד אין מעלין מתרומה ליוחסין, and that is – משום דאיכא למיחש דלמא עבד הוא – Because regarding being מעלה [מחלוקת] תרומה ליוחסין there is the concern that perhaps he is an עבד (since the מ״ד אין מעלין מתרומה ליוחסין maintains חולקין תרומה לעבד בלא רבו); this is what תוספות suggested that the גמרא should have said. However the תו״י rejects this – דלא תליא בהכי דאפילו היכא דליכא למיחש דלמא עבד הוא אין מעלין – For whether we are מעלה מתרומה ליוחסין or not, does not depend on whether there exists the concern that he may be an עבד, for even when there is no concern that perhaps he is an עבד, we are not מעלה מתרומה ליוחסין according to that מ״ד; the case where there is no concern that he may be an עבד is – כמו ביוצא מבית הספר או שמעידין עליו שאינו עבד – Like, for instance, when we see him leaving a בי״ס or people testify that he is not an עבד (however the עדים do not know whether he is a כהן or not), nevertheless this מ״ד maintains אין מעלין מתרומה ליוחסין – ואדרבה הא דחולקין לו בלא רבו היינו משום דאין מעלין – And on the contrary, the reason that מ״ד maintains חולקין לעבד בלא רבו is because he maintains אין מעלין מתרומה ליוחסין – ועיקר טעמא דפלוגתייהו משום מעלין ואין מעלין – And the main cause of their dispute (whether we require one עד or two עדים for אכילת תרומה) is whether we are concerned for מעלין מתרומה ליוחסין (and therefore we require two עדים) or there is no concern that we will be מעלה מתרומה ליוחסין (and therefore one עד is sufficient for אכילת תרומה) – דאי לאו הכי קשה באיזה סברא פליגי כמו שהקשו לעיל ] (תוספות ישנים): For if it is not so (but rather as תוספות maintains that the מחלוקת whether מעלין or לא מעלין depends on whether we are חולק לעבד תרומה בלא רבו) what is the logic of their respective opinions, as תוספות asked previously!] The bracketed section is from the תו״י. SUMMARY תוספות maintains that we are only מעלה מחלוקת תרומה ליוחסין (according to the מ״ד מעלין), but not מאכילת תרומה since he may be an עבד. The reason why we are מעלין is because אין חולקין לעבד בלא רבו. However the תו״י maintains that the dispute whether חולקין לעבד בלא רבו is a result of whether מעלין מתרומה ליוחסין or not THINKING IT OVER 1. תוספות asks that it is obvious that the concept of מעלין מתרומה ליוחסין does not refer to אכילת תרומה (but rather to חלוקת תרומה). How can תוספות state this when the גמרא previously said that (we cannot compare תרומה to יוחסין since) by תרומה there is a עון מיתה, and that is obviously discussing אכילת תרומה for there is no מיתה for חלוקת תרומה לזר?! 2. תוספות writes that the מחלוקת of מעלין מתרומה ליוחסין is dependent on the מחלוקת whether we are חולק תרומה לעבד בלא רבו. How will this תוספות responds to תוספות question previously ׳וא״ת ובאיזה סברא פליגי׳?!

שאני הכא דריע חזקייהו - was flawed חזקה It is different here, for their OVERVIEW The ברייתא relates that נחמיה (התרשתא) forbade this family (בני ברזילי) from eating קדשי מזבח (since they could not find the proper documentation) but permitted them in תרומות and נשיאות כפים. The גמרא asked if we maintain מעלין מנש״כ ליוחסין, they will give this family all the rights of proper כהנים. The גמרא answered that there is no concern in this case since ריע חזקייהו. There is a dispute between רש״י and תוספות as how to interpret ריע חזקייהו. -------------------– פירש בקונטרס שהכל רואים שאר כהנים אוכלין שאר קדשי מזבח ואלו אין אוכלין – רש״י explained that it is ריע חזקייהו, since everyone sees all the other כהנים eating all sorts of קדשי מזבח and this family (בני ברזילי) are not eating קדשי מזבח. תוספות disagrees with רש״י: וקצת קשה דמכל מקום תיקשי למאן דאמר מעלין אמאי לא אסקינהו לקדשי מזבח וליוחסין – And there is a slight difficulty with פרש״י, for notwithstanding that ריע חזקייהו, you may ask that according to the מ״ד מעלין מנש״כ ליוחסין, why indeed were they not מעלה this בני ברזילי family from נש״כ to קדשי מזבח and יוחסין?! תוספות offers his interpretation: ונראה לרבינו תם דריע חזקייהו היינו שהיו מיחסים אותם אחר בני ברזילי שהיה ישראל – And it is the view of the ר״ת that ריע חזקייהו means that they attributed the genealogy of that family to the בני ברזילי who was a ישראל – ועוד שלא מצאו כתבם והיכא דאיתרע חזקה אין מעלין לכולי עלמא – And in addition they did not find their provenance, so wherever there is a flaw in the חזקה, all agree that we are not מעלה (מנש״כ ליוחסין). תוספות asks: אבל קשה דפריך מעיקרא אתי לאסוקינהו הוה ליה למיפרך אמאי נגאלו כלל מן הכהונה – However there is another difficulty; for instead of the גמרא asking initially, ‘but (according the מ״ד מעלין מנש״כ ליוחסין) it will come that the בני ברזילי would be elevated to complete כהונה’, the גמרא should have asked, ‘why were they invalidated from the כהונה at all’ in the first place – תוספות answers: ויש לומר דשפיר הוה ידע דריע חזקייהו ומשום הכי לא אסקינהו – And one can say; that indeed the גמרא knew even in the question that ריע חזקייהו (since לא מצאו כתבם) and therefore לא אסקינהו – אלא דהוה סלקא דעתין דאף על גב דריע חזקייהו איכא למיחש – However, it may have entered our minds, that even though ריע חזקייהו (and therefore נחמיה voided them from the כהונה), nevertheless there is the concern – דלמא אתי לאסוקינהו לבסוף שלא ידעו שלא מצאו כתבם: That perhaps eventually in later generations they will be elevated, for then no one will know that לא מצאו כתבם and ריע חזקייהו. People may assume that since they are נושאים כפיהם they are valid כהנים, so נחמיה should have taken away from them all their rights of כהונה even those which they had בגולה. SUMMARY ריע חזקייהו according to רש״י is because they did not eat קדשים, and according to תוספות it is because they were מתייחס to a ישראל and they could not find כתבם. THINKING IT OVER תוספות answers that even in the הו״א the גמרא knew that ריע חזקייהו. What then was the sגמרא׳ answer that ריע חזקייהו, since the מקשן was already aware of it?!
