    English translation - Ketubot 17b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1However, for one who taught others, there is no measure for the number of people attending the funeral.

2The mishna continues: And if there are witnesses that she went out of her father’s house to her wedding with a hinnuma her marriage contract is two hundred dinars. The Gemara asks: What is a hinnuma ? Surḥav bar Pappa said in the name of Ze’eiri: It is a canopy of myrtle over the bride’s head. Rabbi Yoḥanan said: It is a veil [ kerita ] covering the bride’s face under which the bride dozes [ menamna ].

3The mishna continues: Rabbi Yoḥanan ben Beroka says: Even testimony that there was distribution of roasted grain constitutes proof that she is a virgin. It was taught with regard to the mishna: In Judea, that is proof; however, what are the customs at the weddings of virgins in Babylonia? Rav said: Smearing fragrant oil on the heads of the Sages was customary. Rav Pappa, who was unfamiliar with that practice, said to Abaye: Is the Master saying oil for shampooing the hair? Calling him an orphan because he was ignorant of the custom, he said to him: Orphan, didn’t your mother perform for you smearing of oil on the heads of the Sages at the time of the performance of your wedding ceremony? As this was the case when one of the Sages who arranged for his son to marry into the family of Rabba bar Ulla attended the wedding, and some say that it was Rabba bar Ulla who arranged for his son to marry into the family of one of the Sages; and he smeared oil on the heads of the Sages at the time of the performance of the wedding ceremony.

4The Gemara asks: What is the custom at the wedding of a widow? Rav Yosef taught: A widow does not have roasted grain [ kisanei ] distributed at her wedding.

5The mishna continues: And Rabbi Yehoshua concedes in a case where one says to another: This field belonged to your father, and I purchased it from him, that he is deemed credible. The Gemara asks: And let the mishna teach: Rabbi Yehoshua concedes in a case where one says to another: This field belonged to you, and I purchased it from you.

6The Gemara answers: Although Rabbi Yehoshua concedes that his claim is accepted even in that latter case, he addressed the case where the field originally belonged to the father due to the fact that the tanna wanted to teach in the latter clause that if there are witnesses that it was the father’s field, and he says: I purchased it from him, he is not deemed credible. That is the halakha only with regard to a field that belonged to the father, and not to the claimant himself. Were it referring to a field that he purchased from the claimant, what are the circumstances?

7If it is a case where the one in possession of the field consumed its produce for the three years necessary to establish presumptive ownership, why is his claim that he purchased the field not deemed credible? After three years of unchallenged possession, the purchaser’s claim is sufficient to establish ownership without documentation. And if he did not consume its produce for the three years necessary to establish presumptive ownership, it is obvious that his claim is not deemed credible. Since the distinction between a case where witnesses are present and a case where there are no witnesses present does not apply when the field in question was the property of the claimant, the tanna cited a case where the field belonged to the father.

8The Gemara asks: If so, the same difficulty may be raised with regard to a field belonging to the claimant’s father as well: If the one in possession of the field consumed its produce for the three years necessary to establish presumptive ownership, why is his claim that he purchased the field not deemed credible? And if he did not consume its produce for the three years necessary to establish presumptive ownership, it is obvious that his claim is not deemed credible. The latter clause is no more applicable to the father’s field than it is to the claimant’s field. Why did the tanna prefer to cite a case where the field belonged to the claimant’s father?

9The Gemara answers: Granted, with regard to the case where the field belonged to his father, a circumstance can be found where there is uncertainty with regard to the presumptive ownership of the field, where the one in possession of the field consumed its produce for two of the three years necessary to establish presumptive ownership during the lifetime of the father and one year during the lifetime of the son after the death of his father. And this is in accordance with the opinion of Rav Huna, as Rav Huna said: One cannot establish presumptive ownership of the property of a minor, even after he reached majority. This is because the minor is unaware of the property owned by his father; the fact that he did not challenge the claim of the one in possession of the field proves nothing. Therefore, only two of the three years necessary to establish presumptive ownership have passed.

10The Gemara asks: And since the mishna can be explained only in the case delineated by Rav Huna, did Rav Huna come to teach us a mishna? There is no need for an amora to teach matters that appear in a mishna, as the content of mishnayot is known by all. The Gemara answers: If you wish, say that Rav Huna is stating the inference from the mishna, as the circumstances are not written explicitly in the mishna. And if you wish, say instead that he is teaching us that even if during the year after the father died his son was no longer a minor, one may not establish presumptive ownership of the property of a minor, even after he reached majority. From the mishna, one could learn only a case where during the third year the son was still a minor.

11The Gemara asks: And let the tanna teach the halakha in a case where the one in possession of the field says that he purchased the field from the claimant himself. And let him establish the mishna in a case where the one in possession of the field consumed its produce in the presence of the claimant, who was the original owner of the field, for two of the three years necessary to establish presumptive ownership, and consumed its produce not in his presence for one year. And that scenario is in a case where the claimant fled and therefore, the fact that he did not challenge the claim of the one in possession of the field proves nothing.

12The Gemara asks: That scenario is referring to one who fled due to what reason? If it is that he fled due to the fact that his life was in jeopardy, it is obvious that the one claiming presumptive ownership is not deemed credible, since the owner of the field is unable to protest, as he fears for his life. And if he fled due to money that he owes, and that is why he does not return to protest the possessor’s occupation of the field, he ought to protest from afar, as we maintain that a protest lodged not in the presence of the one using the field is a legitimate protest. He could have lodged in a court in his place of exile his protest against the illegal occupation of his field.

13This is as we learned in a mishna ( Bava Batra 38a): There are three independent lands in Eretz Yisrael with regard to establishing presumptive ownership: Judea, Transjordan, and the Galilee. If the original owner of the field was in Judea and another occupied his field in the Galilee, or if he was in the Galilee and another occupied his field in Judea, that does not establish presumptive ownership, until the one occupying the field will be with the original owner in the same country.

14And we discussed that mishna: What does this tanna hold? If he holds that a protest lodged not in the presence of the one using the field is a legitimate protest, then even in the case where one is in Judea and one is in the Galilee the protest should also be legitimate. And if he holds that a protest lodged not in the presence of the one using the field is not a legitimate protest, then even in the case where one is in Judea and the other one is in Judea as well, the protest should also not be legitimate.

15Rabbi Abba bar Memel said: Actually the tanna holds that a protest lodged not in the presence of the one using the field is a legitimate protest, and the Sages taught this mishna with regard to a crisis period, when travel is perilous and information cannot be transmitted from Judea to the Galilee. Therefore, although no protest was received from the original owner, the occupier does not establish presumptive ownership of the field, because the lack of protest can be attributed to the perilous situation.

16The Gemara asked: And if it is due only to the exigent circumstances that the protest is ineffective, what is different about Judea and the Galilee that the tanna cited specifically these two lands? Ostensibly, even within one of the three lands, if travel and communications are restricted, the same halakha would apply.

    Rashi

It has no fixed measure - and from this we automatically hear that for one who did not read and did not learn, we do not suspend (Torah study) if there are people involved with him sufficient for the needs of burial alone. In the She’iltot of Rav Achai Gaon, I found this stated.

אבל מאן דמתני לית ליה שיעורא - However concerning one who teaches תורה, he has no limit O VERVIEW The ברייתא taught us that מבטלין ת״ת להוצאת המת. The גמרא qualified it by saying that if there are a sufficient amount of participants, this rule does not apply. However, this exception was limited only to those who were קרי ותני but if the deceased taught others, then there are no exceptions; all must come and (even) be מבטל ת״ת. It is not clear what is the ruling concerning someone who was a לא קרי ולא תני. ---------------– בשאלתות דרב אחאי כתיב וממילא שמעינן למאן דלא קרי ולא תני – It is written in the שאלתות of רב אחאי that we can therefore infer that for one who did not read תנ״ך and did not study משנה – אין מבטלין אם יש לו מתעסקין כדי קבורה – We do not interrupt (the study of תורה) to attend his funeral if there are sufficient people engaged in the burial. תוספות qualifies this ruling: ונראה לרבינו יצחק דלענין מלאכה מבטלין כל בני העיר – And the ר״י is of the opinion, that this ruling of the שאלתות is only concerning ביטול תורה; however concerning working, all the inhabitants of the city must interrupt their work להוצאת המת – ואסור אפילו למאן דלא קרי ולא תני דלא מפליג מידי באלו מגלחין (מועד קטן דף כז, ב): And it is forbidden to work (during the funeral) even if the deceased was one who was לא קרי ולא תני for in פרק אלו מגלחין the גמרא does not distinguish at all in the prohibition of working whether the deceased was קרי ותני or not. S UMMARY According to the שאלתות we are not מבטל ת״ת להוצאת המת if the מת was לא קרי ולא תני. The ר״י comments, that work is (nevertheless) prohibited. T HINKING IT OVER 1. Do the ר״י and the שאלתות disagree? 2. Do we go to a funeral to honor the נפטר per se, or is it to honor him on account of the תורה that he learnt?

אלמנה מאי - What is done by a widow O VERVIEW After the גמרא mentions some of the customs that were instituted to distinguish a חופת בתולה, the גמרא asks אלמנה מאי. This question is seemingly difficult to understand. Indeed by an אלמנה nothing was done. That itself was the sign. In fact this (obvious answer) seems to be the answer the גמרא gives. תוספות will explain the question and answer of the גמרא. ---------------– ביהודה בעי שלא היה אלא חילוק קליות לכך בעי אלמנה מאי – The גמרא has this query (only) in regards to the land of יהודה where there was no other sign for a בתולה except for the custom to distribute קליות, therefore the גמרא asks what will be if she is an אלמנה – והלא פעמים אפילו בלא חופה היו רגילין לחלוק ויש לחוש שמא חילוק בחופת אלמנה – for, even without a חופה, at times they were accustomed to distribute these קליות at various festive occasions, so there is the concern that perhaps they distributed these קליות (even) by the חופה of the אלמנה. The חכמים should therefore institute a special custom in יהודה to distinguish a חופת אלמנה. תוספות now explains the answer of the גמרא: ומשני לית לה כיסני פירוש היו נזהרין הרבה שלא יחלקו קליות בחופת אלמנה – And the גמרא answered that the אלמנה has no קליות distributed at her חופה; the explanation of (this answer and) the phrase that לית לה כיסני is they were exceedingly careful not to distribute קליות by the חופה of an אלמנה. There was, therefore, nothing to be concerned about. S UMMARY There was no concern of confusing a חופת בתולה with a חופת אלמנה even though the custom of חילוק קליות was prevalent on many occasions. Nevertheless extreme care was taken not to distribute קליות by a חופת אלמנה. T HINKING IT OVER Was it necessary to be careful in בבל not to distribute קליות by a חופת אלמנה?

And let the teach us that ר״י admits if one said this field was yours, etc. O VERVIEW The משנה states that ר״י admits to ר״ג ור״א that a מגו is effective in the following case. If a ‘buyer’ claims that he bought a field from the father of an individual, the buyer is believed, since there is a הפה שאסר הוא הפה שהתיר; the buyer could have claimed that it never belonged to your father. The גמרא is now asking that this same מודה could have been taught without a ‘father’. ר״י is מודה that if one says to another I bought this field from you, then the buyer is believed. He has the same הפה שאסר וכו׳. Our תוספות explains why the proposed case is better than how it is presently written in the משנה. -------------------– תוספות explains that the proposed case is better – דהוי רבותא טפי דהוי ברי וברי – For this is a greater novelty, since it is a case where the ‘buyer’ is certain (that he bought it) and the ‘seller’ is certain (that it once belonged to him and he never sold it ) and nevertheless the ‘buyer’ is believed even against a ברי; as opposed to the case of the משנה where it is a ברי ושמא, the son cannot be certain whether his father sold the field to this individual or not. In that case it is not such a great חידוש that a מגו is effective when the בעל המגו is a ברי against a שמא. S UMMARY There is a greater חידוש that he is believed in the case of שדה זו שלך היתה (even though it is a ברי וברי) than that he is believed in the case of שדה זו של אביך (where it is merely a ברי ושמא). T HINKING IT OVER Why does not תוספות explain the sגמרא׳ question as רש״י does; what advantage is there in של אביך over שלך?

ואחת בחיי הבן - And one year in the lifetime of the son O VERVIEW The גמרא explains that when the משנה states that if there were עדים that it belonged to the father, the מחזיק is not believed; it is true even in a case where the מחזיק was in possession of the field for three years. The reason it is not considered a חזקה is because one of those years was after the demise of the father. The חזקה was completed during the lifetime of the son. This type of חזקה is not valid. תוספות will qualify this statement. There are times when a חזקה בחיי הבן is valid and times when it is not valid. ----------------– ודווקא כשהוא קטן כפירוש הקונטרס אבל אם הוא גדול הוי חזקה – This is only when the son was a minor; that it is not considered a חזקה, as רש״י explains; however if the son was an adult; over בר מצוה it is considered a חזקה if the מחזיק ate the produce two years while the father was alive and one year after his demise, if the son was an adult – כדאמרינן בחזקת הבתים (בבא בתרא מב, א ושם) – as the גמרא cites a ברייתא in פרק חזקת הבתים that if the מחזיק – אכלה בפני האב שנה ובפני הבן שנה ובפני לוקח שנה הרי זו חזקה – consumed the produce in the presence of the father for a year and in the presence of the son for a (second) year and in the presence of the buyer for a (third) year, this is a valid חזקה; he was in possession of the field for three consecutive years. He may retain the field even if he has no שטר מכירה. It is obvious from that גמרא that a חזקה can be made בחיי הבן. It is therefore necessary to distinguish whether the son was a קטן (were a חזקה is not valid, as in our גמרא), or whether he was a גדול (where the חזקה is valid, as in the case in ב״ב). תוספות offers an alternate view: ורבינו שמואל פירש אהא דאמר בסמוך ואפילו הגדיל – And the ר״ש (ב״ם) explained concerning that which the גמרא shortly states that it is not a חזקה if the son was a קטן; that it means and even if he matured; the רשב״ם explains this גמרא to mean (that not only is it not a חזקה if the son matured after the demise of the father, but rather it is not a חזקה) – אפילו הגדיל בחיי האב דגדול לגבי מילי דאבוה קטן הוא – Even if the son matured in the lifetime the father ; it is still not a חזקה. The reason is because an adult in regards to his father’s affairs is considered a minor; he is not aware of his father’s (previous) dealings. תוספות anticipates a difficulty. According to the רשב״ם that a גדול is considered a קטן in his father’s affairs even if הגדיל בחיי האב; then how is it possible to have a חזקה בפני הבן? תוספות answers: ואומר רבינו תם דלפירושו הא דאמר בחזקת הבתים (גם זה שם) דהויא חזקה בפני הבן – And the ר״ת says that according to the sרשב״ם׳ interpretation we must say, that which the previously cited ברייתא says in פרק חזקת הבתים that it is a valid חזקה if (some of) it took place in the presence of the son – היינו כשהיה גדול בתחילת החזקה – That is (only) if the son was an adult at the beginning of the חזקה. The son was then aware that his father owned this property. If the son makes no מחאה after the death of his father, while the מחזיק is in possession of the field, it is included in the חזקה years. If however when the חזקה began the son was a קטן, then even if he became a גדול while the father was alive, any time that the מחזיק was in possession of the field during the lifetime of the son cannot be included in the חזקה years. The son may have never been aware that this field once belonged to his father. This is what the רשב״ם meant when he said that אפילו הגדיל בחיי האב; that he became a גדול after the חזקה commenced. S UMMARY If the son was not a גדול at the beginning of the חזקה, there is no חזקה בחיי הבן. (However, according to רש״י it is not a חזקה, only if the son was a קטן when the father died.) T HINKING IT OVER Why did the רשב״ם interpret ׳ואפילו הגדיל׳ to mean even בחיי האב?

ורב הונא מתניתין אתא לאשמועינן - Is ר״ה coming to teach us what we learnt in our משנה O VERVIEW The גמרא initially stated that our משנה teaches us that אין מחזיקין בנכסי קטן as רב הונא indicated elsewhere. The גמרא immediately asks if our משנה teaches this, why does ר״ה repeat it. תוספות will explain what is meant by the question; ‘why does ר״ה have to repeat what it says already in the משנה’. -----------------– תוספות anticipates a difficulty: לאו דווקא נקט רב הונא דהא לא איירי רב הונא התם אלא במורידן קרוב לנכסי קטן – Mentioning רב הונא was not specific. The question of the גמרא is not on ר״ה per se, for ר״ה is not discussing there the rule of אין מחזיקין בנכסי קטן, but rather ר״ה was teaching the rule concerning whether בי״ד appoints a relative to administer the estate of a minor. והא לא שמעינן ממתניתין – And this ruling is not derived from our משנה. Why does the גמרא ask, ורב הונא מתניתין אתא לאשמועינן? תוספות replies: אלא כלומר רבא דדייק התם שמע מינה דרב הונא דאין מחזיקין בנכסי קטן – But rather the גמרא means to ask on רבא, who infers there from the abovementioned ruling of ר״ה, that we can derive from the ruling of ר״ה that one cannot make a חזקה in the properties of a קטן. This is what רבא derives from רב הונא. Our גמרא asks on this derivation of רבא – מאי אתא לאשמועינן: What is רבא coming to teach us that we can derive from ר״ה that אין מחזיקין בנכסי קטן, when we know this already from our משנה! S UMMARY The question ורב הונא מתניתין אתי לאשמועינן is really on רבא who derives the rule of אין מחזיקין בנכסי קטן from a ruling of ר״ה. T HINKING IT OVER 1. Why did not תוספות ask his question when the גמרא initially said: וכדר״ה דאר״ה אין מחזיקין בנכסי קטן? תוספות should have asked that ר״ה never said it. 2. How are we to understand the (first) answer of the גמרא that ׳ר״ה דיוקא ׳דמתניתין קאמר?

מחאה שלא בפניו כולי - A protest made not in his presence, etc. O VERVIEW The גמרא discusses whether a מחאה שלא בפניו is a valid מחאה or not. תוספות argues initially that the proper term for this discussion should be whether a חזקה שלא בפניו is a חזקה or not; and not if a מחאה שלא בפניו is a מחאה or not. Why does the גמרא always mention the term an absentee protest?! The גמרא should have mentioned an absentee possession, etc. The relevant issue here is whether the חזקה שלא בפניו is a valid חזקה or not. The גמרא should use the expression חזקה שלא בפניו and discuss whether it is or is not a חזקה; not מחאה. תוספות answers: ויש לומר דעיקר הטעם תלוי במחאה דחזקה ודאי יש לה קול אפילו שלא בפניו – And one can answer, that the main cause whether or not there is a חזקה depends on the status of the מחאה; whether the מחאה can reach the מחזיק or not; for a חזקה certainly has publicity even if the חזקה takes place not in the presence of the מרא קמא – ואפילו הכי אי מחאה אין לה קול לא הוי חזקה – And nevertheless if there is no publicity for the מחאה it will not be a חזקה; even though it is assumed that the מ״ק heard about the חזקה, and we know that he did not make a מחאה, nevertheless it will not be a חזקה, since the מ״ק can claim I did not make a מחאה because it is useless. The מחזיק will claim that he did not hear it. And therefore, since it all depends on whether the מחאה has sufficient publicity, he mentions מחאה as opposed to חזקה. S UMMARY The expression used in the גמרא is מחאה שלא בפניו; because the validity of the חזקה depends on whether the מחאה has a קול or not; regardless that the חזקה has a קול. T HINKING IT OVER What changed in תוספות understanding between the קושיא and the תירוץ? Alternately; what would be amiss if the expression would be
