    English translation — Bava Kamma 7b

    1The Gemara asks: But if that is the case, we should not provide him with even a slight amount of poor man’s tithe. Since his assets, based on their market value, have a high value, he is not to be classified as a poor person.

    2And the Master, Rabba, said concerning this: No, the halakha that he is provided with only up to half the value of his assets is necessary in a case where he cannot sell due to seasonal fluctuations in price. This is because in the days of the month of Nisan, which is the beginning of the harvest season, the market value of land appreciates, and in the days of the month of Tishrei, a time when the harvest had already been reaped and it is too late to prepare the land for the coming year, the market value of land depreciates.

    3Consequently, everyone generally waits until Nisan and sells only at that point. But this person, since he is in need of money, sells his land in Tishrei according to the current, lower, market price. Accordingly, based on the current market prices, his assets have a low value and there is justification in regarding him as a poor person. Yet, since if he waited until Nisan, as everyone else does, his land would have a high value, he cannot truly be classified as a poor person. Therefore, he is permitted to take only as much poor man’s tithe as will cover his losses. The Gemara explains why he is permitted to take only up to half the value of his land: Since it is the nature of land to depreciate up to half its value, and it is not its nature to depreciate more than that, he is entitled to take poor man’s tithe that is worth up to half the value of his land and the rest he can supplement by selling his land at its current, lower price.

    4Abaye uses a similar distinction to resolve the contradiction he raises: And here also, with regard to damages, if one considers a case where the injured party comes to collect his damages during Tishrei, his legal right is to collect payment from superior-quality land. This will be a relatively large amount of land, owing to the current seasonal depreciation in its value.

    5But if the injured party says to the one liable for the damage: Give me slightly more land of intermediate quality instead, then the one liable for the damage can say to him: If you choose to take superior-quality land, as is your legal right, take a large amount in accordance with the current market value; but if not, and you wish to take intermediate-quality land, take according to the future value in Nisan, after it will have appreciated, which will mean you will be entitled to a smaller amount of land. This can be used to resolve the contradiction: The phrase “of the best of his field,” which indicates that payment is made only from superior-quality land, defines the injured party’s basic rights. The term “he shall recompense,” which indicates that payment may be made in any form, is referring to a case where the injured party forgoes his rights. In such a case the value of the land or item he agrees to receive is appraised based on its appreciated value at the season when it is generally sold.

    6Rav Aḥa bar Ya’akov objects to this suggestion: If so, you have weakened the power of injured parties with regard to intermediate-quality and inferior-quality land, as, by agreeing to receive land of a lower quality than that to which their rights entitle them, they will actually receive less land, since the land is then appraised based on the appreciated market values in Nisan. Such an opinion is untenable, as the Merciful One states that injured parties collect from the best -quality land, clearly intending to enhance their rights, and yet you said he cannot also collect from intermediate-quality and inferior-quality land unless he agrees that the land should be appraised based on the appreciated Nisan values, thereby lowering the value of his payment.

    7Rather, Rav Aḥa bar Ya’akov said: If there is a case to compare to Rabba’s distinction, it is not compared to a case of payment of damages, but we can compare it to a case of a creditor who comes to collect the loan during Tishrei. His legal right is to collect from the borrower’s intermediate-quality land, which will be a relatively large amount owing to the current seasonal depreciation in the value of land. But if the creditor says to the borrower: Give me slightly more land of inferior quality instead, the borrower can say to him: If you choose to take the intermediate-quality land, as is your legal right, take a large amount in accordance with the current market value, but if not, and you wish to take land of inferior quality, take it in accordance with the future, appreciated, market value in the month of Nisan. This would mean that the creditor would be entitled to a smaller amount of land.

    8Rav Aḥa, son of Rav Ika, objects to this suggestion: If so, you have locked the door in the face of potential borrowers, as, according to your suggestion, the creditor is in a disadvantageous position. He can say to the borrower: Were I still to have the money I lent you, I would be able to purchase a large parcel of land in accordance with the current depreciated market value, so why, now that the money is with you, should I be forced to purchase land in accordance with the future, appreciated market value of the month of Nisan? If people are penalized as a result of granting loans, they will cease to do so.

    9Rather, Rav Aḥa, son of Rav Ika, said: If there is a case to compare to Rabba’s distinction, we can compare it to the collection of a woman’s marriage contract where she comes to collect it during Tishrei. As a woman’s legal right in a marriage contract is to collect payment from her husband’s inferior-quality land, which will be a relatively large amount owing to the current seasonal depreciation in the value of land. But if she says to her former husband: Give me slightly less land of intermediate quality instead, her former husband can say to her: If you choose to take the lowest-quality land, as is your legal right, take a large amount in accordance with the current market value, but if not, and you wish to take land of a higher quality, take in accordance with the future appreciated market value of the month of Nisan, which will mean you will be entitled only to a smaller amount of land.

    10The Gemara returns to examine the contradiction raised by Abaye: In any case, the original difficulty still remains.

    11Rava said: Whatever he gives the injured party as payment he must give him of the best of that type. For example, even if he pays in bran he must pay with his best-quality bran, and this is the meaning of the phrase “of the best of his field.” Accordingly, the contradiction is resolved. The term “he shall recompense” indicates that payment can be given in any form, but the phrase “of the best of his field” indicates only that whichever form of payment is used, it must be of a superior quality, and not, as Abaye initially understood it, as limiting the form of payment specifically to land of superior quality.

    12The Gemara asks: But isn’t “the best of his field” written, which suggests that the requirement to pay with one’s best land applies only when one pays with land?

    13Rather, when Rav Pappa and Rav Huna, son of Rav Yehoshua, came from Rav’s academy, they explained it as follows: With regard to payment, all items are classified as property of the best quality, as, if an item cannot be sold here, it can be sold in another city. Since movable items are easily liquidated, they are always considered an acceptable form of payment. This is with the exception of land, which is not always easily sold. Therefore, the halakha is that the one liable for the damage must give the injured party payment from his best -quality land, which is easier to sell. This is in order to ensure the possibility that a buyer will jump at the opportunity to purchase it, thereby providing the injured party with the possibility of liquidating it. This resolves the contradiction. The phrase “of the best of his field” indicates that if payment is made with land it must be with superior-quality land, and the term “he shall recompense” indicates that if payment is made from movable property, anything worth money may be used.

    14§ Rav Shmuel bar Abba from Akronya asked Rabbi Abba: When the court appraises land to determine if it is to be classified as being of superior-quality, does it appraise land based on the quality of a property owner’s other land or does it appraise it based on the quality of the land in the world at large?

    15The Gemara notes: Do not raise the dilemma in accordance with the opinion of Rabbi Yishmael, as he says that we appraise land based on the quality of land owned by the injured party, and therefore payment is made with land that is of a similar quality to the best-quality land of the injured party. Accordingly, it is obvious that the classification is based only on the land of the injured party.

    16When you raise this dilemma, it is in accordance with the opinion of Rabbi Akiva, who says that we appraise land based on the quality of land owned by the one liable for the damage, and he pays with his superior-quality land even if its quality exceeds that of any of the injured party’s land. Consequently, according to Rabbi Akiva it is appropriate to ask whether the appraisal is based only on his other land or based on the land in the world at large.

    17The Gemara asks: What is the answer to the dilemma? When the Merciful One states: “The best of his field” (Exodus 22:4), does the stress in the verse on “his field” serve to exclude only the possibility of appraising land based solely on the value of the land of the injured party, but land is appraised based on the quality of land in the world at large? Or perhaps, does it serve to exclude the possibility of appraising land based on the quality of land of the world at large as well, and it is sufficient if the land he pays with is his best-quality land?

    18Rabbi Abba said to him: The Merciful One states: “The best of his field,” and you say the court appraises land based on the quality of land in the world at large? Certainly the term “his field” teaches that it is sufficient that the land be the best of the land of the one liable for the damage.

    19Rav Shmuel bar Abba raised an objection to this opinion from a baraita that delineates the forms of payment used for paying damages, repaying a debt to a creditor, and paying a marriage contract: If the debtor has only superior-quality land, all of them collect from the superior-quality land. Similarly, if he has only intermediate-quality land, all of them collect from the intermediate-quality land. And if he has only inferior-quality land, all of them collect from the inferior-quality land.

    20If he has superior-quality, intermediate-quality, and inferior-quality land, damages are paid from the superior-quality land, and a creditor collects from the intermediate-quality land, and a woman’s marriage contract is paid from the inferior-quality land. If he has only superior-quality and intermediate-quality land, damages are paid from the superior-quality land, and payment to a creditor and payment of a woman’s marriage contract are made from the intermediate-quality land. If he has only intermediate-quality and inferior-quality land, payments for damages and payments owed to a creditor are made from the intermediate-quality land, while payments of a woman’s marriage contract are made from the inferior-quality land.

    Tosafot

    In the days of Nisan land appreciatesThe Gemara, searching for the circumstances under which the ruling of the Braita is correct says that the Braita is discussing the cyclical change of land prices. Rashi says that during Nison people pay more because they will be able to produce a crop for the coming season. During Tishrai prices are lower because there is insufficient time to prepare the land to produce a crop for this year. And if you ask: This cyclical change in price makes sense for fields as Rashi explains. For one can plow in the summer and plant in Marcheshvan (October), but as far as houses are concerned, what difference is there between Nison and Tishrai? And we can answer: That usually houses become more expensive during the season for renting houses and after the houses are rented the price falls.

    We compare it to [a case of] a creditorThe Gemara was searching for a situation where we could apply the ruling of the cyclical change of price. The Gemara suggests that this could be true of a creditor. If his loan is collectable in Tishrai he is entitled to be paid from the middle quality fields of the debtor at the lower Tishrai prices. If he prefers to be paid with the lowest quality fields he must take them at the higher Nison prices. The Gemara rejects this suggestion because this would have a negative effect on a person’s ability to obtain a loan. The lenders will not want to give loans, because the fact that he gave a loan is being used against him. If he had his cash in hand he would be able to purchase the poorest quality field at the Tishrai prices, now because he gave the person a loan he must take the field at Nison prices. This will discourage people from giving loans. Tosafot wonders why the Gemara does not use the reasoning that it used earlier when the Gemara wanted to apply this ruling to a victim of damages. The Gemara said that forcing the victim to accept the middle or poor quality at Nison prices is weakening the position of the victim. The Torah says that he can collect from the finest and this ruling would in effect say that he cannot collect from the middle or poor quality at Tishrai prices. Why doesn't the Gemara use a similar reasoning here and argue that we are weakening the position of the creditor who can collect from the middle quality and you are saying that he cannot collect from the poorest quality if he so desires. And the Gemara could not have asked, if so, that the creditor must accept the poorest fields at the higher Nison prices, you have weakened the position of the creditor, who is entitled to collect from the middle quality at the lower Tishrai prices and you are weakening his position by ruling that when collecting from the poorest he must accept them at the higher Nison prices. Assuming that the Torah wanted to strengthen the creditor’s ability to collect his debt from the middle quality, the ruling that he must take the poorest quality at higher Nison prices is weakening his position. However, this argument is incorrect because the Torah never strengthened the power of a creditor as it does the power of a damages victim; rather the reverse is true his position is weak because according to Torah law the rule of the creditor is to collect from the poorest. The Torah was not concerned that the creditor is in a weak position, so that would not stop us from forcing him to accept the poorest at Nison prices. It is only because it would discourage potential lenders that we do not force a creditor to accept the poorest at Nison prices.

    Give me slightly more land of inferior qualityWhile the Gemara is searching for a situation where it can apply the cyclical change of price rule, the Gemara suggested that it might be speaking about a creditor who instead of taking one acre of middle quality fields wants an acre and a half of the poorest quality. At this point the Gemara believes that he can be forced to accept the poorest quality field at the higher Nison prices. There was a text in the Gemara that the creditor might be asking for a half acre of the prime quality and that he must accept that at higher Nison prices. Tosafot rejects that version of the Gemara. We do not have the text: or if the creditor wanted a bit less of the finest. If we had this text the Gemara would then be saying that we do give him a half acre of the finest but at the higher Nison prices. For if that were so, why does the Gemara ask in response to the suggestion that we are dealing with a creditor who wants a bit less of the finest: if so, that you force him to take the finest at the higher Nison prices, you are locking the door in the face of borrowers who will not be able to obtain a loan if we force the creditor to accept the finest at the higher Nison prices. This would make sense if the creditor had a right to demand the finest and we would say that you must accept the finest at the higher Nison prices, but since it is not at all his right to collect from the finest, theoretically the debtor can ask for any price he wants for the finest even more than the Nison prices, allowing the creditor to receive the finest at the Nison price is actually improving the position of the creditor, for it is established that the creditor’s rule is to collect from the middle quality and he has no right at all to demand the finest.

    We compare it to a woman's marriage contractThe Gemara finally decides that there is one area where the cyclical change of price rules. That is regarding the collection of a k’suboh. The wife is entitled to collect from the poorest fields. If she wants to take a smaller parcel of a middle or finer quality field the husband can force her to accept it at the higher Nison prices. Tosafot adds: With this same explanation, the Gemara could have said that the circumstances where the cyclical change of price rule can apply are about a creditor, whom the Gemara is already discussing. He says: give me a smaller parcel of the finest. He would have to accept the smaller parcel of the finest at the higher Nison prices. However, since the Gemara started with saying that this cyclical change of price rule applies to damagers, and when the Gemara rejected that attempt it said that we were discussing a creditor. After examining whether this rule is relevant to the first two types of collectors, the Gemara is now content to mention a woman’s K’suboh which is the third type of collector.

    Do not raise the dilemma in accordance with Rabbi Yishmael, as he says we appraise according to [that of] the injured [party]. The Gemara is quite certain that according to R’ Yishmo’ail determining the qualities of finest, middle or poorest cannot be calculated by world standards. Why is the Gemara so sure? Since R’ Yishmo’ail learns from a textual comparison using the words שדה שדה, one ‘שדה’ appears in the verse “the best of his fields… he shall use for payment” and the other ‘שדה’ from the verse “and he will destroy another’s field” which is clearly referring to the field of the victim. The designation of the finest is based only on the field of the victim because it is his field that the Torah is discussing in the verse “and he will destroy another’s (the victim’s) field”. However, according to R’ Akiva it is possible that his intention when he says the field of the person paying is to be used as a barometer for the finest he only comes to exclude the victim’s finest and not the finest according to world standards.

    In the days of Nisan land appreciates The Gemara, searching for the circumstances under which the ruling of the Braita is correct says that the Braita is discussing the cyclical change of land prices. Rashi says that during Nison people pay more because they will be able to produce a crop for the coming season. During Tishrai prices are lower because there is insufficient time to prepare the land to produce a crop for this year. And if you ask: This cyclical change in price makes sense for fields as Rashi explains. For one can plow in the summer and plant in Marcheshvan (October), but as far as houses are concerned, what difference is there between Nison and Tishrai? And we can answer: That usually houses become more expensive during the season for renting houses and after the houses are rented the price falls.

    We compare it to [a case of] a creditor The Gemara was searching for a situation where we could apply the ruling of the cyclical change of price. The Gemara suggests that this could be true of a creditor. If his loan is collectable in Tishrai he is entitled to be paid from the middle quality fields of the debtor at the lower Tishrai prices. If he prefers to be paid with the lowest quality fields he must take them at the higher Nison prices. The Gemara rejects this suggestion because this would have a negative effect on a person’s ability to obtain a loan. The lenders will not want to give loans, because the fact that he gave a loan is being used against him. If he had his cash in hand he would be able to purchase the poorest quality field at the Tishrai prices, now because he gave the person a loan he must take the field at Nison prices. This will discourage people from giving loans. Tosafot wonders why the Gemara does not use the reasoning that it used earlier when the Gemara wanted to apply this ruling to a victim of damages. The Gemara said that forcing the victim to accept the middle or poor quality at Nison prices is weakening the position of the victim. The Torah says that he can collect from the finest and this ruling would in effect say that he cannot collect from the middle or poor quality at Tishrai prices. Why doesn't the Gemara use a similar reasoning here and argue that we are weakening the position of the creditor who can collect from the middle quality and you are saying that he cannot collect from the poorest quality if he so desires. And the Gemara could not have asked, if so, that the creditor must accept the poorest fields at the higher Nison prices, you have weakened the position of the creditor, who is entitled to collect from the middle quality at the lower Tishrai prices and you are weakening his position by ruling that when collecting from the poorest he must accept them at the higher Nison prices. Assuming that the Torah wanted to strengthen the creditor’s ability to collect his debt from the middle quality, the ruling that he must take the poorest quality at higher Nison prices is weakening his position. However, this argument is incorrect because the Torah never strengthened the power of a creditor as it does the power of a damages victim; rather the reverse is true his position is weak because according to Torah law the rule of the creditor is to collect from the poorest. The Torah was not concerned that the creditor is in a weak position, so that would not stop us from forcing him to accept the poorest at Nison prices. It is only because it would discourage potential lenders that we do not force a creditor to accept the poorest at Nison prices.

    Give me slightly more land of inferior quality While the Gemara is searching for a situation where it can apply the cyclical change of price rule, the Gemara suggested that it might be speaking about a creditor who instead of taking one acre of middle quality fields wants an acre and a half of the poorest quality. At this point the Gemara believes that he can be forced to accept the poorest quality field at the higher Nison prices. There was a text in the Gemara that the creditor might be asking for a half acre of the prime quality and that he must accept that at higher Nison prices. Tosafot rejects that version of the Gemara. We do not have the text: or if the creditor wanted a bit less of the finest. If we had this text the Gemara would then be saying that we do give him a half acre of the finest but at the higher Nison prices. For if that were so, why does the Gemara ask in response to the suggestion that we are dealing with a creditor who wants a bit less of the finest: if so, that you force him to take the finest at the higher Nison prices, you are locking the door in the face of borrowers who will not be able to obtain a loan if we force the creditor to accept the finest at the higher Nison prices. This would make sense if the creditor had a right to demand the finest and we would say that you must accept the finest at the higher Nison prices, but since it is not at all his right to collect from the finest, theoretically the debtor can ask for any price he wants for the finest even more than the Nison prices, allowing the creditor to receive the finest at the Nison price is actually improving the position of the creditor, for it is established that the creditor’s rule is to collect from the middle quality and he has no right at all to demand the finest.

    We compare it to a woman's marriage contract The Gemara finally decides that there is one area where the cyclical change of price rules. That is regarding the collection of a k’suboh. The wife is entitled to collect from the poorest fields. If she wants to take a smaller parcel of a middle or finer quality field the husband can force her to accept it at the higher Nison prices. Tosafot adds: With this same explanation, the Gemara could have said that the circumstances where the cyclical change of price rule can apply are about a creditor, whom the Gemara is already discussing. He says: give me a smaller parcel of the finest. He would have to accept the smaller parcel of the finest at the higher Nison prices. However, since the Gemara started with saying that this cyclical change of price rule applies to damagers, and when the Gemara rejected that attempt it said that we were discussing a creditor. After examining whether this rule is relevant to the first two types of collectors, the Gemara is now content to mention a woman’s K’suboh which is the third type of collector.

    Do not raise the dilemma in accordance with Rabbi Yishmael, as he says we appraise according to [that of] the injured [party]. The Gemara is quite certain that according to R’ Yishmo’ail determining the qualities of finest, middle or poorest cannot be calculated by world standards. Why is the Gemara so sure? Since R’ Yishmo’ail learns from a textual comparison using the words שדה שדה, one ‘שדה’ appears in the verse “the best of his fields… he shall use for payment” and the other ‘שדה’ from the verse “and he will destroy another’s field” which is clearly referring to the field of the victim. The designation of the finest is based only on the field of the victim because it is his field that the Torah is discussing in the verse “and he will destroy another’s (the victim’s) field”. However, according to R’ Akiva it is possible that his intention when he says the field of the person paying is to be used as a barometer for the finest he only comes to exclude the victim’s finest and not the finest according to world standards.

    דביומי ניסן יקרא ארעא מפני שהם זרועות וביומי תשרי זילי שהן קצורות רבינו יהונתן ז"ל. ולענין פסק הלכה כתב הרב המאירי ז"ל וזה לשונו היה עשיר והיו לו קרקעות שוים אלף זוז מאכילין אותו מעשר עני ולקט שכחה ופאה עד שימצא למכור ואף לכשימכור אינו חייב לשלם. מצא למכור אלא שמתוך דוחקו אינו מוצא בערך הראוי להם אם לא הוזלו הקרקעות של אחרים ונמצא שאף אלו לא הוזלו מצד עצמן אלא מצד דוחקו מאכילין אותו עד שימצא בערך הראוי להם. הרי זו כאותה ששנינו במסכת פאה בעל הבית שהיה עובר ממקום למקום וכו' מאכילין אותו לקט שכחה ופאה אף על פי שהוא עשיר במקומו ואינו חייב לשלם אף לכשמגיע לביתו ואף זה הואיל ואינו מוצא למכור אלא בהפסד גדול הרי הוא כעני העובר ממקום למקום. ואם הוזלו הקרקעות ונמצא שאין דחקו גורם אין מאכילין אותו אפילו נתוזלו הרבה הואיל ומכל מקום שוות מאתיים. היה דרך אותה העיר שבניסן קרקעות ביוקר ובתשרי בזול וזה היה בתשרי וצריך למכור עכשיו על כל פנים הרי הדבר צריך מיצוע לא להקל בו מכל וכל שהרי אף של כל העולם בזול עכשיו ולא להחמיר בו מכל וכל שהרי כל העולם ממתינין במכירתן עד ניסן וזה אי אפשר לו להמתין ומתוך כך אם הוא מוצא עכשיו מחצית מה שהיה מוצא מהם בניסן אין מאכילין אותו אפילו היו שוות הרבה. וגדולי המפרשים סוברים שכל שאף בניסן מוצא כשער של תשרי והוא עד מחצה אינו נוטל ולא נראה כן. שמועה זו אנו מפרשים אותה בעשיר שאינו מוצא למכור וגירסא שלנו הרי שהיו לו וכו' ככתוב בתוספות. ויש גורסים לשיטה זו אפילו פורתא נמי לא ליספו ליה וכו' אלא דאי יקרי ארעתא ודידיה איידי דנפיק ועייל אזוזי זול ארעא אפילו זול פורתא נמי ליספו ליה שאין לומר שימכור בהפסד ור"ל בהפסד שיש בו רושם כגון שתות או יותר מעט. ויש גורסים אפילו טובא נמי ליספו ליה כלומר אפילו הוא מוצא מהן הרבה הואיל ויש שם הפסד שיש בו רושם והעמידוה דביומי ניסן יקרא ארעתא וכו' שאין לו הפסד מצד דחקו אלא שאינו זמן מכירה והקרקעות רגילין להפסיד בחצי ערך ואינו קרוי הפסד אבל כל שהוזלו ממחצה ואילך מאכילין אותו זו היא שיטתנו ושיטת הגאונים ז"ל. וגדולי הרבנים מפרשים השמועה בעני ולדעתם כל שקרקעותיו שוות מאתיים זוז אפילו הוזלו כמה אין מאכילין אותו וגירסא שלהם הרי שהיו לו וכו' ושאל אי דזול דכולי עלמא בדידיה אפילו טובא נמי וכו' עד אפילו פורתא נמי לא ליספו ליה דאיהו דפשע כשמראה עצמו עייל ונפיק אזוזי וזה של עובר ממקום למקום אינו פושע דאונסא דאורחא גרם ליה ונמצא לדעתם שכל מי שהיו לו בתים שדות וכרמים בשוה מאתיים זוז ואינו מוצא אלא בפחות מכדי דמיהן אם הוזלו אף של שאר בני אדם מאכילין אותו כמה שירצה שהרי אין קרקעותיו שוות מאתיים. היו של שאר בני אדם ביוקר ושלו הוזלו בפשיעתו אינו נוטל שהרי מכל מקום שוות מאתיים. היו שוות מאתיים אלא שהוא צריך למוכרם בשעת הזול רצה לומר תשרי שאף של שאר בני אדם בזול באותה שעה מאכילין אותו עד מחצה רצה לומר מנה וימכור קרקעותיו במנה ונמצאו מאתיים. והדברים ברורים כדעת ראשון שהרי משנה זו דהרי שהיו לו בתים וכו' סתמא תניא אפילו שוות כמה הואיל ואינו מוצא למוכרן. עד כאן לשונו. נזקין דיניה בעידית ואי אמר ליה בתשרי הב לי בינונית טפי פורתא כשעת הזול של עכשיו והיינו פורתא כי הזול שיש בתשרי רוב פעמים מעט הוא וא"ל האיך אי שקלת בעידית כדינך שקול כזולא דהשתא ואי שקלת בינונית לא יהיבנא לך אלא כיוקרא דלקמיה והיינו ישיב לרבות שוה כסף דאי לא בעי עידית מצי לאכרוחיה למשקל בתשרי בינונית כיוקרא דניסן. הראב"ד ז"ל.

    ואי לא שקול כיוקרא דלקמיה פירוש כיון שאתה רוצה למשקל ממה שאינו דינך שקול כיוקרא דלקמיה. ופירש רש"י ז"ל דהכי קאמר קרא ישיב לרבות שוה כסף אפילו סובין כלומר שאם בא הניזק לגבות סובין דהיינו זיבורית או בינונית שהיא סובין לגבי עידית ישלם לו המזיק לפי מה שהם שוה כסף כיוקרא דניסן דאז יקרי ארעתא. מיהו קצת קשה לישנא דאפילו סובין דאדרבה דוקא כשבא ליפרע מסובין אז אמרינן הכי כדפירשתי. ושמא הוה מצי למיפרך מינה אלא דעדיפא מינה קא פריך. ומורי שיחיה פירש דהכי קאמר ישיב לרבות שישלם לו שוה כסף דהאי כיוקרא דלקמיה אם הניזק אינו רוצה לפרוע מן העדית כדינו ואפילו סובין כלומר לא מיבעיא אם בא ליפרע מן הבינונית דמשלם ליה כיוקרא דלקמיה אלא אפילו ליפרע מסובין דהיינו זיבורית אפילו הכי משלם ליה כיוקרא דלקמיה. ואם תאמר למה הוצרך להביא ברייתא דמי שהיו לו בתים היה ליה למימר כגון דביומי ניסן יקרי בלא אריכות. וי"ל דאי לאו ברייתא לא הוה שמעינן מקרא דשוה כסף דשקיל כיוקרא דלקמיה גם כי בא לגבות מבינונית וזיבורית אבל מתוך הברייתא דקתני עד מחצה דרצה לומר מחצה שהן שוין בניסן כדמפדש רבה גם בתשרי משערינן לפי דמי מכירה דבניסן הילכך שמע מינה דשפיר מיקרי שוה כסף יוקרא דניסן בתשרי. תלמיד ה"ר פרץ ז"ל.

    מתקיף לה רב אחא וכו' וא"ת לוקי קרא דישיב בדאמר ליה ניזק הב לי מבינונית טפי פורתא דיהיב ליה כדהשתא ולא כיוקרא דלקמיה. וי"ל דמדנקט לרבות אפילו סובין אם כן משמע דישיב אתא לתקנתא דמזיק ואי הוה יהיב ליה בינונית כדהשתא הוה ליה תקנת ניזק דהוי שקיל על כרחיה דמזיק ועל כרחיה לא מתוקמא קרא בהכי. אי נמי יש לומר דלהא לא איצטריך קרא דסברא הוא דגבי בינונית כדפריך רב אחא בר יעקכ. מהר"י כהן צדק ז"ל.

    הב לי זיבורית טפי פורתא כתבו בתופפות דלא גרסינן או עדית בציר פורתא וכו'. ור"מ מקיים גירסא זו ואליבא דמאן דאמר דבר תורה בעל חוב בעידית ומה טעם אמרו בבינונית שלא יהא אדם רואה דירה נאה וכו'. וזהו דוקא דבעי למשקל כי זולא דהשתא אבל אי בעי למשקל כיוקרא דלקמיה יכול לכופו. תוספי הרא"ש ז"ל.

    והראב"ד ז"ל מקיים הגירסא בענין אחר דכי אמרינן בעל חוב דיניה בבינונית הני מילי היכא דבעי לאוקמה קמיה אבל היכא דגילה דעתו שרוצה למכור קרקע זו כי הכא דהא בעי למיתב ליה כיוקרא דלקמיה כי הא ודאי מצי למימר אי הוו לי זוזי שקילת כדהשתא וכו'. והויא נעילת דלת וכן עיקר דמשום הכי שני למילתא דכתובת אשה דלא משכחת ליה בבעל חוב כלל לא בזיבורית ולא בעידית. ע"כ בחידושיו. ותלמיד רבינו פרץ ז"ל כתב וז"ל דלא גרסינן או עידית בציר פורתא דאם כן אמאי אמר ואי לא שקיל כיוקרא דלקמיה אפילו בההיא שעתא מצי אמר ליה הכי דלא יהיב ליה מידי דאין דינו בעידית. ע"כ. כתב הרא"ש ז"ל וריב"א הקשה ונימא בעל חוב לא ניחא לי בתקנתא דרבנן ובעינא למשקל כדינאי בזיבורית. ותירץ דאין אומרים אי איפשי בתקנת חכמים אלא להחזיק את מה שבידו כגון גבי אשה לקמן גבי לוקח אבל להוציא מיד אחר כגון הכא לא. ע"כ. ובהא מיתרצא נמי הא דפריך הר"י הלבן בריש כתובות דקאמר התם הגיע זמן באחד בשבת אינו מעלה לה מזונות ואמאי תימא ליה טעמא מאי איני נישאת משום דתקנתא דידי דשקדו חכמים על תקנת בנות ישראל שיהא שמח עמה שלושה ימים אנא בהאי תקנתא לא ניחא לי כדרבא. אלא יש לומר דתקנתא דרבא לא מהניא להוציא ממון. מהר"י כהן צדק ז"ל.

    ור"מ תירץ דלא שייך למימר אלא היכא שהתקנה לטובתו וכאן התקנה לטובת הלוה שלא תנעול דלת בפני לוין. הרא"ש ז"ל. ותלמיד ה"ר פרץ ז"ל תירץ דהיינו דקא פריך אם כן נעלת דלת כלומר טעמא מאי תיקון רבנן בעל חוב בבינונית משום נעילת דלת ואם כן כל שכן שנעלת דלת אם ישאל זיבורית לפי שיאמר אי איפשי בתקנת חכמים אם לא יתנו לי כי זול דהשתא. ע"כ.

    לכתובת אשה מדמינן ליה כתבו בתוספות הוא הדין דהוה מצי לאוקמי בבעל חוב וכו'. ור"מ תירץ גבי אשה דמן הדין היה לה ליטול בבינונית כבעל חוב אלא מטעם שאמרו חכמים יותר משהאיש רוצה לישא וכו' הילכך היכא דבעיא למשקל בינונית כיוקרא דלקמיה יכולה לכופו אבל בעל חוב דמן התורה דינו בזיבורית ומטעם נעילת דלת תקנו לו בבינונית כולי האי לא יפה כחו שיוכל לכופו שיתן לו עידית כיוקרא דלקמיה. הרא"ש ז"ל. וז"ל תלמיד ה"ר פרץ ז"ל כיון דכתובת אשה אין דינה בבינונית כלל רק בזיבורית אם כן היכי קאמר דשקלא בבינונית כי יוקרא מיהא אפילו בעל כרחו דבעל הא יכול הוא הבעל לעכב לגמרי שלא ליתן כלל כדפרישית גבי בעל חוב בעידית. וי"ל גבי כתובת אשה כששואלת מבינונית אינה מבקשת יותר מדינא דמדינא גביא אף מן העידית למאן דאמר דכתובת אשה דאורייתא דהא כתוב בה כסף ומשום שלא תראה שדה נאה ודירה נאה לבעלה ומתקוטטת עמו כדי שיגרשנה ותגבה מאותו בית או מאותה שדה אפקוה רבנן מדינא דעידית ואוקמוה אזיבורית. ולמאן דאמר דכתובת אשה דרבנן מכל מקום אין לך בעל חוב גדול מזה ודינה בבינונית מן הדין אלא דמשום דיותר משהאיש רוצה לישא וכו' אוקמוה אזיבורית דלא שייך בה נעילת דלת הילכך שפיר הוי דינה בבינונית כדפרישית. ולכך אף על גב דתקינו רבנן דתגבה מן הזיבורית מכל מקום כשמבקשת מבינונית כיוקרא דלקמיה מיהא שקלא אפילו בעל כרחו דבעל ואינו יכול לעכב על ידה כיון דמן הדין הוי דינה בבינונית כדפרישית. ע"כ.

    שם בגמרא אלא א"ר אחא בר יעקב וכו' ב"ח דינו בבינונית ואי אמר הב לי זיבורית טפי פורתא לא שקיל אלא כיוקרא דלקמי' מתקיף לה ר' אחא בר איקא א"כ נעלת דלת וכו'. וקשה מאי ס"ד דר' אחא בר"י שאין המלוה יכול לכופו ליתן לו זיבורית כזולא דהשתא כיון דב"ח דינו בזיבורית מדאוריית' כדעולא אלא תקנת חכמים היה בבינונית לטובת המלוה וא"כ ודאי שיכול המלוה לומר אי אפשי בתקנת חכמים שתיקנו לטובתי ושומעין לו כדאיתא בש"ס ובפוסקים ויותר יש להקשות כן על ר' אחא בר איקא שהקשה מן נעילת דלת שאין זו קושיא כל כך לפ"ז שאין כאן נעילת דלת שאף אם היה המעות בעין ביד המלוה לא היה יכול לכופו שימכור לו שדהו כמו שהק' ר' אחא אילו הוי זוזאי גבאי וכן כ' הרא"ש דלא שייך לומר כן אלא כל היכא שהלוה גילה דעתו שרוצה ליתן לו זבורית כיוקרא דלקמיה אז כופין לו ליתן כזולא דהשתא מטעמא דר"א בר איקא וכן העלה הרא"ש להלכה ע"ש באריכות אבל גם זה דוחק דמה לנו בגילה דעתו ולמה לא יוכל לחזור בו אפילו מזולא דהשתא וא"כ טפי ה"ל להקשות שמחוייב ליתן כזולא דהשתא מטעמא דאי אפשי בתקנת חכמים לכך נ"ל דבין ר' אחא בר"י ובין ר"א בר איקא תרווייהו לא ס"ל כדעולא דב"ח דינו בזיבורית אלא ס"ל כברייתא דר"ש בפ' הנזקין דס"ל להיפוך ד"ת ב"ח דינו בעידית כמו נזקין אלא שחכמים תקנו בינונית שלא יראה אדם בית נאה של חבירו ואומר אקפוץ ואלוונו ואגבה המיטב שלו בחובי וכו' וא"כ לפ"ז א"ש דלא יכול לומר א"א כיון שאפילו מן התורה אין לו שיעבוד על זיבורית לכך הוצרך ר"א בר איקא להקשות מנעילת דלת אבל מ"מ להרא"ש תיקשי מה ראה לפסוק להלכה שאין יכול לכופו אפילו כיוקרא דלקמיה אלא כשגילה דעתו אז מחוייב ליתן לו כזולא דהשתא ות"ל שמחויב ליתן לו כזולא כיון דקי"ל כדעולא. ואף שיש ליישב כיון דמדין תורה אינו יכול לכופו שיתן לו דוקא זיבורית דבלוה תליא מילתא כדכתיב בחוץ תעמוד ודרשינן מה דרכו להוציא ואם כן הלוה יכול ליתן כל מה שירצה זיבורית או עידית מ"מ לא שייך לומר אי שקלת כדינך משמע דכדינו רוצה ליתן לו כזולא דהשתא וא"כ הדרא קושיא לדוכתיה כיון דלעולא עיקר דינו בזבורית יתן לו כזולא דהשתא משמע דכ"ע מודו שאין הלוה יכול לומר אתן לך בינונית כיוקרא דלקמי' ואי לא שקול עידית בציר פורתא כיון שדינו בבינונית. ונ"ל באמת דהרא"ש לא פסק כעולא שהרי בפ' הנזקין הביא הא דר"ש ולא הביא דעולא וע"ש ובספר המלחמות להרמב"ן וכ"כ הר"ן בשם הרמ"ה דלא כעולא:

    בתוספות בד"ה לב"ח מדמינן ליה וכו' עד מדאורייתא דינו בזיבורית כבר כתבתי בסמוך שא"א לפרש כן וא"כ תקשי לדברי התוספות אבל לדידי אין להקשות קושיית תוספות דא"כ הורע כוחו של ב"ח כו' כיון דבאמת התקנה היתה להורע כוחם וגם כאן שייך התקנה שלא יוכל המלוה לומר דוקא בזו אני חפץ וליתן עינו בשדה חבירו לגבותה בע"כ אף אם היא זיבורית וק"ל:
