    1The Gemara asks: With regard to the payment made by conspiring witnesses, which is categorized as monetary restitution, as the witnesses pay the precise sum that they conspired to cause the defendant to lose, let Rabbi Oshaya also teach it as one of the categories on his list. The Gemara answers: Rabbi Oshaya holds in accordance with the opinion of Rabbi Akiva, who says that conspiring witnesses do not pay on the basis of their own admission. Evidently, theirs is not a payment of monetary restitution; rather, it is a fine, as only one who was found liable based on the testimony of witnesses pays a fine, not one who was found liable based on his own admission.

    2The Gemara asks: If Rabbi Oshaya holds in accordance with the opinion of Rabbi Akiva, let him teach two distinct types of categories of damage under the rubric of Ox: Let him teach one category for an ox that damages an ox or other property belonging to another person, and let him also teach the case of an ox that injures a person.

    3The Gemara explains its question: As we learned in a mishna (33a): In a case where the two parties damaged each other concurrently, Rabbi Akiva says: The owner of the innocuous ox that injured a person also pays the full cost of the damage with regard to the difference between the damage caused by his ox and the damage that the person caused the ox. Rabbi Akiva holds that if an innocuous ox injures a person, the owner pays the full cost of the damage, whereas if an innocuous ox damages another’s property then the owner is liable only for half the cost of the damage. Since the owner’s liability in the two cases is different, each case should be classified as a distinct category, and Rabbi Oshaya should list them separately in his baraita .

    4The Gemara answers: Didn’t Rabbi Akiva break the force of his fist [ gezizeih ], i.e., he significantly tempered the force of his statement, as it is taught in a baraita that Rabbi Akiva says: One might have thought that even in the case of an innocuous ox that injured a person, the owner of the ox would pay from his superior-quality property and not merely from the body of his animal, as in the case of an innocuous ox that damages property; therefore, the verse states with regard to an ox that gores a person: “According to this judgment shall it be done to him” (Exodus 21:31), from which it is derived that the owner of the ox pays restitution exclusively from proceeds of the sale of the body of his ox, and he does not pay from his superior-quality property. The mishna states that one pays restitution from his superior-quality property in instances of all primary categories of damage. Since in the case of an innocuous ox that injured a person even Rabbi Akiva concedes that the owner does not pay from his superior-quality property, it should not be included in a list of the primary categories.

    5The Gemara asks: As for the rapist, and the seducer, and the defamer, all of which are cases in which the offender pays monetary restitution, let Rabbi Oshaya teach them as categories in his list.

    6The Gemara explains why Rabbi Oshaya did not teach them as separate categories: Whichever way you look at it, they should not be listed. If the payments listed by Rabbi Ḥiyya are for damage caused to the woman’s body, which reduces her value, he already taught it; if the payments are for pain, he already taught it; if the payments are for humiliation, he already taught it; if the payment is for degradation, that too is a payment for damage, which he already taught. What, then, have you to say? What is the nature of the payments paid by the rapist and the seducer mentioned by Rabbi Ḥiyya? In these cases, each payment paid is considered a fine [ kenasa ], and as explained, with regard to cases in which one is liable to pay a fine, Rabbi Oshaya does not speak.

    7The Gemara asks further: And one who causes another’s teruma to become ritually impure, and one who mixes teruma with another’s non-sacred food, and one who pours another’s wine as a libation for idolatry, each of which is a case in which the offender must pay monetary restitution to compensate the owner for his loss due to the lowered value of his food or wine, let Rabbi Oshaya teach them as categories in his list.

    8The Gemara answers: Whichever way you look at it, these cases should not be listed. If Rabbi Oshaya holds that damage that is not evident, i.e., where the object is physically unchanged but its halakhic status is changed, is characterized as damage for which one is liable to pay restitution, Rabbi Oshaya already taught, i.e., included in his list, restitution for damage, and if he holds that damage that is not evident is not characterized as damage for which one is liable to pay restitution, then it is a fine, and, as explained, with regard to cases for which one is liable to pay a fine, Rabbi Oshaya does not speak.

    9The Gemara suggests: Since Rabbi Ḥiyya lists these cases as distinct categories, let us say that Rabbi Ḥiyya holds that damage that is not evident is not characterized as damage for which one is liable to pay restitution, as, if it were characterized as damage for which one is liable to pay restitution, didn’t he already teach, i.e., include in his list, restitution for damage? The Gemara rejects that suggestion: Even if he holds that damage that is evident is characterized as damage for which one is liable to pay restitution, he distinguishes between different types of damage. He teaches cases of damage that is evident and he teaches cases of damage that is not evident.

    10The Gemara considers the fact that each of the lists of primary categories is introduced with the number that they total: Granted, according to the tanna of our mishna, he taught the number of four primary categories in introducing his list to exclude those additional categories of Rabbi Oshaya. And similarly, Rabbi Oshaya taught the number of thirteen primary categories to exclude those additional categories of Rabbi Ḥiyya. But what does the number of twenty-four primary categories of Rabbi Ḥiyya serve to exclude?

    11The Gemara answers: He taught that number in order to exclude the cases of an informer, who provides information to the authorities leading them to confiscate another person’s property; and to exclude the case of a priest who renders an offering piggul by performing the sacrificial rites for one offering with the intent to sacrifice it for the sake of another offering, in which case the person who brought the offering must replace it with another.

    12The Gemara asks: And let Rabbi Ḥiyya teach these cases. Granted, he did not include the case of a priest who renders an offering piggul . Perhaps, with regard to cases involving consecrated items, Rabbi Ḥiyya does not speak. But with regard to the case of an informer, what is the reason Rabbi Ḥiyya did not teach it and include it in his list of categories? The Gemara answers: The case of an informer is different, as the damage is caused through speech, and with regard to damage caused through speech, Rabbi Ḥiyya does not speak.

    13The Gemara asks: But isn’t there the case of a defamer, where the damage is caused through speech, and yet Rabbi Ḥiyya teaches it and includes it in his list? The Gemara answers: He includes that case because it is a case of speech that involves an action. One who defames his wife is liable only if he made his allegation after engaging in intercourse with her.

    14The Gemara asks: But isn’t the case of conspiring witnesses a case of speech that involves no action, as they are liable for their testimony, and Rabbi Ḥiyya teaches it and includes it in his list? The Gemara answers: There, although it involves no action, the Merciful One characterizes it as an action, as it is written: “And you shall do to him as he conspired to do unto his brother” (Deuteronomy 19:19).

    15The Gemara considers the subcategories of the various primary categories listed: Granted, according to the tanna of our mishna, his terminology is understandable, as he taught primary categories, which, by inference, means that there are also additional forms of damage that are subcategories of those primary categories. But according to Rabbi Ḥiyya and Rabbi Oshaya, why did they employ the terminology they employed? They employed the term primary categories, which, by inference, means that there are subcategories. What are the subcategories of the primary categories they listed? It appears that they enumerated all the various categories of damage.

    16Rabbi Abbahu says: When Rabbi Ḥiyya and Rabbi Oshaya characterize, as primary categories, the various categories of damage that they listed, it is not to indicate that there are subcategories; rather, it is to indicate that all of them are characterized as primary categories, in the sense that one is liable to pay from one’s best -quality property.

    17The Gemara asks: What is the reason for this, i.e., from where is it derived? The Gemara explains: It is derived using a verbal analogy from the terms “in place of,” “giving,” “he shall pay,” and “money.” The term “in place of” is written with regard to a forewarned ox that gores (Exodus 21:36); “he shall give” is written with regard to an ox that kills a slave (Exodus 21:32); “he shall pay” is written with regard to the categories of damage of Eating and Trampling (Exodus 22:4); and “money” is written with regard to Pit (Exodus 21:34). The halakha that one must pay from his best-quality property is stated explicitly in each of those four verses. In each of the twenty-four categories listed by Rabbi Ḥiyya one of those four terms is written, so by means of a verbal analogy, the requirement to pay from one’s best-quality property applies to each of them.

    18§ The mishna states: The defining characteristic of the primary category of Ox is not similar to the defining characteristic of the primary category of Maveh . The Gemara asks: What is the mishna saying? Rav Zevid said in the name of Rava that this is what the mishna is saying: Let the Merciful One write one of the primary categories and derive the other categories from it. Then the tanna says: It is not possible to derive one category from one other category, as each category has its unique characteristics.

    19The mishna continues: And the defining characteristics of this category of Ox and that category of Maveh , in which there is a living spirit, are not similar to the defining characteristic of the category of Fire, in which there is no living spirit. The Gemara asks: What is the tanna saying? Rav Mesharshiyya said in the name of Rava that this is what the tanna is saying:

    Tosafot

    Didn't Rabbi Akiva break [the force] of his fist? The Gemara has stated that the Braita does not present the opinion of R’ Akiva about an ox that injures a person who is liable for full payment even the first time it damages. Tosafot wants to explain why the Braita cannot present this opinion. We will soon see Tosafot’ objection to Rashi’s explanation. One cannot say that because we are taught in the Braita that he, the tam who injured a person pays from his body, which indicates that he is a regular tam who only pays half,we now know that R’ Akiva changed his mind, and no longer holds that a Tam that injures a person pays in full. In Shemot 21, 28, the Torah is discussing an ox that gores a person. First the law of a tam is discussed and then the law of a muad. In verse 31, the Torah says “whether it gores a boy or it gores a girl, in accordance with this law shall be done to him”. Our rabbis disagree about the meaning of “in accordance with this law”. For in Chapter Hamaineeach (later 33a), the Gemara clearly states that R, Akiva says that the payment for a tam that gores a person is “in accordance with this law” (Shemot 21, 31), the law mentioned last in the verse, the muad that pays in full, and not the law mentioned first, the tam that pays half. The same Braita continues, one might think that he must pay from the choicest etc. and the Braita proceeds to teach that payment is from its body. We see that the same Braita that teaches us that R’ Akiva holds that the tam that injures a person pays in full also holds that it pays from its body. This disproves the contention that when R’ Akiva realized that a tam pays from its body he retracted about the full payment as well. And according to Rashi’s explanation there also is a difficulty. For he explained: that even though there will sometimes be less than full payment, because the ox is not worth the full value of the damage, and since there will not always be full payment the Braita does not mention it. This is inadequate; in any case the Braita should teach two types of shor, because sometimes there will be full payment. Even though there will not always be full-payment, the fact that there will sometimes be full-payment is sufficient reason for Tam that injures a person to be listed. And we can answer: that since the tam that injures a person pays only from its body, it cannot be listed together with the other avos, because later (on this page) we say that they, those listed in the Braita of R’ Ḥiyya, are all like avos in regard to the fact that they pay from the choicest. It is only the fact that they pay from the choicest that qualifies them as avos. The tam that injures a person that does not pay from the choicest cannot be listed with the other avos.

    The rapist, and the seducer, and the defamer, which are monetary restitutionThe Gemara asked that the rapist, seducer and slanderer be included in the Braisa because there is a payment of damages (shame and a reduction of value) in addition to the fine. Tosafot points out that this is true only in reference to the rapist and the seducer, and not for the slanderer. For the slanderer there isn't any financial payment at all, only the hundred silver pieces and those are a fine. However the Gemara mentions him, the slanderer, because of the others. This trio usually appears together throughout the Gemara and that is why the slanderer is mentioned here together with the others.

    One who causes to become ritually impure, and one who mixesThe Gemara asked that these should also be included in the Braisa of R’ Oshayo. Tosafot says that this question could have been deflected simply. The Gemara could have said that they were not listed because they are not liable when the damage was done unintentionally, whereas all the avos are liable when done intentionally or unintentionally. Since they need not pay if the damage was unintentional and thus they are different than the other Avos mentioned in the Braisa.

    If it were recognized as damageThe Gemara seems to be upset with the fact that R’ Chiya’s Braisa would hold that unrecognizable damages are not considered damages. Tosafot wonders why? Ḥizkiyya who holds the position that they are considered damages is refuted in Perek Hanizakin (Gittin 53:), if so, why does the Gemara feel that it must find a way to reconcile the Braita with that refuted opinion? And even though Ḥizkiyya who says that unrecognizable damage is called damage is refuted in HaNizakin (Gittin 53b), even so, the Gemara would be more contented to establish the Braita of R’ Ḥiyya his father to concur with him.

    And teaches damage that is not evidentThe Gemara answered that there is a need to mention forms of damage that are unnoticeable. Tosafot questions why is it necessary to mention three different forms? And the reason that the Braita teaches three varieties of unnoticeable damages is because they are taught together in פרק ניזקין, Gittin 52b. This system of mentioning all three varieties of unnoticeable damage because they are taught together elsewhere, even though it is only necessary to teach one in order to bring out the desired point is already employed in the Braita. In order to teach us that one is liable for indirect damage on 4b the Braita taught an unpaid guardian, the borrower, a paid guardian and the lessee. It is unnecessary to mention all of these to make his point, even so he taught many varieties of indirect damage, because elsewhere they are always mentioned together.

    He taught the number to excludeUsually the word למעוטי means to exclude. If taken literally the Gemara is saying that our Mishna is excluding R’ Oshayo’s avos. This implies that the Mishna does not agree that they are avos. Tosafot tells us that we should not make the error of thinking that our Mishna actually holds that they are not avos. This term to exclude the avos of R’ Ḥiyya, is not because he does not hold of R’ Ḥiyya’s avos. R’ Oshayo definitely agrees that they are avos. Rather, what is meant is that they are excluded from the Braita because he is not discussing them. He chose not to list them in his Braita because he did not want to discuss fines.

    To exclude an informer, etcThe Gemara says that R’ Ḥiyya’s count excludes an informer and one who renders another’s sacrifice pigul. Tosafot tells us that those exclusions are not the only ones. The Gemara could have said that the count comes to exclude the payment of kofer and the thirty sh’kolim for the death of a slave who is killed by keren. And the reason that the Braita does not teach them is because he is not discussing payments for the death of the victims. And an informer and one who renders another’s sacrifice pigul, even according to the one who does not hold one liable for indirectly causing a damage, in these cases are liable because of a fine instituted to discourage such actions. This can be seen in the Gemara in Hagozel Batra 117a.

    Speech that involves an actionThe Gemara defines the slanderer who is damaging his wife primarily by what he is saying about her, as דיבורא- words that are accompanied by an action. What is the action? For in פרק נערה, Ketubot 46a, R’ Eliezer B’ Yacov says that these words, the punishment of a slanderer, were only said when he, the husband, had relations with her, and that is the action that causes liability. And R’ Yehuda holds there that the slanderer is not liable until he hires witnesses to testify falsely.

    All of them are characterized as primary categories to pay from [one’s] best. It appears from the Gemara’s answer that the avos mentioned in the Braitas of R’ Oshayo and R’ Ḥiyya are called avos only because they pay from the choicest. It seems that to be liable to pay from the choicest is a characteristic reserved for avos and not for toldos. This is not true as Tosafot points out. And even though the toldos of the avos of our Mishna also pay from the choicest which shows that paying from the choicest is not reserved only for avos, if so, why does the Gemara say that they are called avos because they pay from the choicest? However, those avos of R’ Ḥiyya and R’ Oshayo, if they were not called avos by the Braita we would not know that they pay from the choicest. There is reason to believe that this group is weaker than the others. The Gemara said that R’ Oshayo did not list R’ Ḥiyya’s avos because they are fines. Our Mishna does not list R’ Oshayo’s avos because some of them are indirect damagers. Perhaps there is no requirement to pay from the choicest. Since they do not have Toldos, the designation as avos can only mean that the Braita intended to elevate them to the level of other avos that they pay from the choicest.

    In place of giving, etcRashi ד"ה תחת נתינה in a lengthy exposition of all the words and avos shows how we can derive that each av pays from the choicest. The derivation of בושת -embarrassment is a bit vague. Rashi says it may be included in the תחת mentioned in the Torah in the verses dealing with a rapist or in the verses dealing with one who wounds another. Tosafot brings to our attention that there is another source that he feels is more reasonable. In Sifrei we learn that embarrassment is paid from the choicest from the verse in D’vorim 25, 12, “ you shall cut off her hand and you shall not show pity”. In that verse we see that one is liable for embarrassing another person and he learns from the zom’mim witnesses where it is also written in D’vorim 19, 21, “ and you shall not show pity” that just as the zom’mim witnesses pay from the choicest, so too, embarrassment is paid from the choicest. And it should not be said that this is a regular “common word” method of learning, because the Gemara here does not say that we learn that avos pay from the choicest from תחת, נתינה and עיניך. Since our Gemara does not include the word עיניך among the four words of the “common word” method, it seems that our Gemara does not hold that this derivation is a proper “common word”. And as far as the zom’mim witnesses themselves, Rashi says that we learn that they pay from the choicest because it is written about them נפש בנפש “a life for a life”, even though the word תחת does not appear in that verse, the meaning of the verse is understood as if תחת was written in the verse and that is sufficient for the “common word” method. Zom’mim witnesses present an interesting dilemma. They usually pay exactly as they planned to cause their victim to pay. If so, why do we need to learn that they pay the choicest, let us see what the victim would have paid? And we must say that even when they testify falsely about a tam ox that damaged that does not pay from the choicest, or they testified that p’lonee owes p’lonee a moneh, one hundred zuz, whose law is to pay from the poorest, the zom’mim witnesses pay from the choicest, even though this not what they planned to do to their victim. Tosafot is basing his conclusion on an obvious question. Why is it necessary to have a verse teach us that zom’mim witnesses pay the choicest? For if they sought to make their victims pay from the choicest, we would not need a verse to teach us that they pay from the choicest, because we would learn from כאשר זמם that we do to them as they planned, that they are liable to pay from the choicest. Just as they planned that their victim would pay from the choicest, so too, they must pay from the choicest. The additional verse is necessary to teach us that even when they did not plan that their victim should pay from the choicest; the zom’mim witnesses still pay from the choicest.

    What is [the Mishnah] saying? The comparisons of subjects by the term לא ראי are legion. The Gemara never seems to have a problem understanding them. Why does the Gemara here suddenly need to ask; what does he mean? Because this לא הרי cannot be explained as the all other לא הרי that appear throughout the Talmud, the Gemara wonders, what was meant?

    Didn't Rabbi Akiva break [the force] of his fist? The Gemara has stated that the Braita does not present the opinion of R’ Akiva about an ox that injures a person who is liable for full payment even the first time it damages. Tosafot wants to explain why the Braita cannot present this opinion. We will soon see Tosafot’ objection to Rashi’s explanation. One cannot say that because we are taught in the Braita that he, the tam who injured a person pays from his body, which indicates that he is a regular tam who only pays half,we now know that R’ Akiva changed his mind, and no longer holds that a Tam that injures a person pays in full. In Shemot 21, 28, the Torah is discussing an ox that gores a person. First the law of a tam is discussed and then the law of a muad. In verse 31, the Torah says “whether it gores a boy or it gores a girl, in accordance with this law shall be done to him”. Our rabbis disagree about the meaning of “in accordance with this law”. For in Chapter Hamaineeach (later 33a), the Gemara clearly states that R, Akiva says that the payment for a tam that gores a person is “in accordance with this law” (Shemot 21, 31), the law mentioned last in the verse, the muad that pays in full, and not the law mentioned first, the tam that pays half. The same Braita continues, one might think that he must pay from the choicest etc. and the Braita proceeds to teach that payment is from its body. We see that the same Braita that teaches us that R’ Akiva holds that the tam that injures a person pays in full also holds that it pays from its body. This disproves the contention that when R’ Akiva realized that a tam pays from its body he retracted about the full payment as well. And according to Rashi’s explanation there also is a difficulty. For he explained: that even though there will sometimes be less than full payment, because the ox is not worth the full value of the damage, and since there will not always be full payment the Braita does not mention it. This is inadequate; in any case the Braita should teach two types of shor, because sometimes there will be full payment. Even though there will not always be full-payment, the fact that there will sometimes be full-payment is sufficient reason for Tam that injures a person to be listed. And we can answer: that since the tam that injures a person pays only from its body, it cannot be listed together with the other avos, because later (on this page) we say that they, those listed in the Braita of R’ Ḥiyya, are all like avos in regard to the fact that they pay from the choicest. It is only the fact that they pay from the choicest that qualifies them as avos. The tam that injures a person that does not pay from the choicest cannot be listed with the other avos.

    The rapist, and the seducer, and the defamer, which are monetary restitution The Gemara asked that the rapist, seducer and slanderer be included in the Braisa because there is a payment of damages (shame and a reduction of value) in addition to the fine. Tosafot points out that this is true only in reference to the rapist and the seducer, and not for the slanderer. For the slanderer there isn't any financial payment at all, only the hundred silver pieces and those are a fine. However the Gemara mentions him, the slanderer, because of the others. This trio usually appears together throughout the Gemara and that is why the slanderer is mentioned here together with the others.

    One who causes to become ritually impure, and one who mixes The Gemara asked that these should also be included in the Braisa of R’ Oshayo. Tosafot says that this question could have been deflected simply. The Gemara could have said that they were not listed because they are not liable when the damage was done unintentionally, whereas all the avos are liable when done intentionally or unintentionally. Since they need not pay if the damage was unintentional and thus they are different than the other Avos mentioned in the Braisa.

    If it were recognized as damage The Gemara seems to be upset with the fact that R’ Chiya’s Braisa would hold that unrecognizable damages are not considered damages. Tosafot wonders why? Ḥizkiyya who holds the position that they are considered damages is refuted in Perek Hanizakin (Gittin 53:), if so, why does the Gemara feel that it must find a way to reconcile the Braita with that refuted opinion? And even though Ḥizkiyya who says that unrecognizable damage is called damage is refuted in HaNizakin (Gittin 53b), even so, the Gemara would be more contented to establish the Braita of R’ Ḥiyya his father to concur with him.

    And teaches damage that is not evident The Gemara answered that there is a need to mention forms of damage that are unnoticeable. Tosafot questions why is it necessary to mention three different forms? And the reason that the Braita teaches three varieties of unnoticeable damages is because they are taught together in פרק ניזקין, Gittin 52b. This system of mentioning all three varieties of unnoticeable damage because they are taught together elsewhere, even though it is only necessary to teach one in order to bring out the desired point is already employed in the Braita. In order to teach us that one is liable for indirect damage on 4b the Braita taught an unpaid guardian, the borrower, a paid guardian and the lessee. It is unnecessary to mention all of these to make his point, even so he taught many varieties of indirect damage, because elsewhere they are always mentioned together.

    He taught the number to exclude Usually the word למעוטי means to exclude. If taken literally the Gemara is saying that our Mishna is excluding R’ Oshayo’s avos. This implies that the Mishna does not agree that they are avos. Tosafot tells us that we should not make the error of thinking that our Mishna actually holds that they are not avos. This term to exclude the avos of R’ Ḥiyya, is not because he does not hold of R’ Ḥiyya’s avos. R’ Oshayo definitely agrees that they are avos. Rather, what is meant is that they are excluded from the Braita because he is not discussing them. He chose not to list them in his Braita because he did not want to discuss fines.

    To exclude an informer, etc The Gemara says that R’ Ḥiyya’s count excludes an informer and one who renders another’s sacrifice pigul. Tosafot tells us that those exclusions are not the only ones. The Gemara could have said that the count comes to exclude the payment of kofer and the thirty sh’kolim for the death of a slave who is killed by keren. And the reason that the Braita does not teach them is because he is not discussing payments for the death of the victims. And an informer and one who renders another’s sacrifice pigul, even according to the one who does not hold one liable for indirectly causing a damage, in these cases are liable because of a fine instituted to discourage such actions. This can be seen in the Gemara in Hagozel Batra 117a.

    Speech that involves an action The Gemara defines the slanderer who is damaging his wife primarily by what he is saying about her, as דיבורא- words that are accompanied by an action. What is the action? For in פרק נערה, Ketubot 46a, R’ Eliezer B’ Yacov says that these words, the punishment of a slanderer, were only said when he, the husband, had relations with her, and that is the action that causes liability. And R’ Yehuda holds there that the slanderer is not liable until he hires witnesses to testify falsely.

    עדים זוממין אין משלמין על פי עצמן מפני שחיובן אינו אלא קנס ומכל מקום אם הוזמו והלכו להם בבית דין אחר ואמרו העדנו שקר והוזמנו בבית דין פלוני משלמין כמו שיתבאר במקומו מכות ג' א':

    יראה מסוגיא זו שעדים זוממין שהעידו להפסיד זבורית או בינונית כגון שהעידו על חוב או לכתובת אשה שהוא משלם דמי מה שרצה להפסיד בעדית שהרי סתם אמרו על כלם לשלם ממיטב ואף בתוספות כתבוה כן ואין נראה לי כן אבל מה שנאמר כאן לדעתי אינו אלא שרצו להפסיד מעות ואין להם מעות לשלם ומשלמין ממיטב אבל כל שבאו להפסיד זבורית אינו משלם אלא זבורית וכן כתבו גדולי המפרשים:

    מטמא ומדמע ומנסך אין חיובם בא מן הדין אלא שלא יהא כל אחד הולך ומטמא טהרותיו של חברו ואומר פטור אני כמו שהתבאר במסכת גיטין נ"ג א':

    ליתני תרי גווני שור ליתני שור וכו' על כרחיך בתם דומיא דתנן רבי עקיבא אומר תם שחבל וכו'. ותימה מה מקשה ושמא דוקא במועדים קא מיירי ולא בתמין. וי"ל דהכי פריך וליתני שור דאזיק שור במועד ושור דאזיק אדם בתם והיינו תרי גווני שור. מהר"י כהן צדק ז"ל.

    הא תבריה רבי עקיבא לגזיזיה לפירוש רבינו תם ז"ל דמפרש תבריה לגזיזיה משום דאמרינן לקמן כלם כאבות לשלם ממיטב מאי איצטריך למימר תבריה לגזיזיה ואפילו אי לא תבריה לגזיזיה לא מצי למיתני תרי גווני שור דעל כרחך שור דאזיק שור איירי בתם דאי לא אידי ואידי נזק שלם הוא דמשלם כדקאמר לעיל. וי"ל דהכי קאמר ליתני שור דאזיק שור דהיינו בין תם בין מועד ובנזקי אדם אין חילוק כלל ומשני תבריה לגזיזיה דבאדם נמי יש חילוק. ע"כ גליון.

    המטמא והמדמע כתבו בתוספות דהוה מצי למימר דלא תני להו משום דלא מחייב בשוגג. וקשה והרי בושת שאינו חייב בשוגג דאינו חייב בבושת עד שיתכוון. וי"ל דבשלמא בושת מצינו שם בושת בעלמא שחייב בשוגג כגון שנתכוון לבייש את זה ובייש את זה אבל גבי מנסך ומדמע ומטמא לא מצינו בהם חיוב בשוגג כלל. גליון.

    אי היזק שאינו ניכר לא שמיה היזק הוה ליה קנסא תימה דמה צריך לומר הוה ליה קנסא תיפוק ליה דהוה מדרבנן כיון דלא שמיה היזק ור' אושעיא לא תני אלא דחייבים מדאורייתא. וי"ל כיון דכולן חייבין לא שנא דרבנן ולא שנא דאורייתא. מיהו קשה לי דתיפוק ליה כיון דלא כתיבי באורייתא למה יקרא אב. ע"כ ממהר"י כהן צדק ז"ל.

    לימא קסבר רבי חייא היזק שאינו ניכר הוי היזק וא"ת כי נמי לא שמיה היזק תיקשי דאם כן הוה קנסא וכבר תנא ליה קנסא. י"ל דגבי קנס יש לו לשנות כל הצדדין אבל אי שמיה היזק הא ודאי דלא בא לפרש כל הענינים שאדם יכול להזיק. ועוד אומר מורי ז"ל דאי לא שמיה היזק אלא קנס איצטריך שפיר למיתני דלא הוי בכלל קנסא דתנן כבר דהא לא איירי רק בקנס דאורייתא כגון מפתה וכו' והכא קנסא דרבנן הוא אבל אי שמיה היזק אם כן דאורייתא הוא כשאר נזק ואם כן בכלל נזק הוא. תלמיד רבינו פרץ ז"ל.

    וקתני היזק שאינו ניכר ומכל מקום תנא להו כלהו השלושה וחשבינהו בשלושה משום דהוי שמות מחולקים מידי דהוה שוכר דדינו כשומר חנם או כשומר שכר ואפילו הכי חשיב ליה. אי נמי משום דהא מצריך להו בגיטין. תלמיד רבינו פרץ ז"ל.

    תנא מניינא למעוטי דרבי חייא דהא לעיל דייקי מאי טעמא לא תנא להו אלא משום דלא איירי בהו ולא תננהו כדקאמר לעיל וכן הא דקאמר בסמוך למעוטי מסור ומפגל היינו כדפרישנא דלא תננהו אבל ודאי למעוטי היינו דלא איירי בהו. תלמיד רבינו פרץ ז"ל.

    בגמרא אי ר"ע ליתני תרי גווני שור וכו' צ"ל דמקרן קפריך דבשן ורגל ודאי אין חילוק בין שור דאזיק שור בין שור דאזיק אדם ואין לחלק בין תם למועד אלא בקרן ואם כן צ"ל דהסוגיא אליבא דרב דנקט שור וכל מילי דשור אבל לשמואל לא שייכי כל הסוגיא דהא אפילו שור דאזיק שור בקרן לא הוי במניינא דרבי אושעיא וכן במשנה והטעם דלא איירי בתמין ולבסוף מועדין ותם גופיה הוי קנסא ומתניתין ור' אושעיא לא איירי בקנסא ועיין לקמן:

    שם לימא ס"ל לר"ח היזק שא"נ לא שמיה היזק לפמ"ש לעיל תקשי דמאן דס"ל הכי הוי מדרבנן ולא שייך לקרותן אבות ועוד דמילי דרבנן ודאי הוי טובא יותר מכ"ד לכ"נ בדוחק דלמאי דס"ד דר"ח ס"ל לא שמיה היזק היינו שאינו דומה להיזק הניכר אבל מ"מ הוו היזק מדאורייתא:

    בפרש"י בד"ה מפגל כהן ששחט קרבנו של ישראל חטאת לשם שלמים שאין הקרבן עולה לשם בעליו וצריך אחר עכ"ל. לכאורה יש לתמוה מי סניא ליה לפרש מפגל ככל פגול דעלמא דהיינו במחשבת חוץ לזמנו או מחשבת חוץ למקומו. וכן פרש"י בגיטין גבי הא גופיה דכהנים שפגלו במקדש חייבין ע"ש. ונראה ליישב דרש"י אזל לשיטתו שכתב לעיל בשמעתין דלא שייך לפרש מנסך שעירב נסך ביין כשר דאם כן היינו מדמע וכבר פירשתי שיחתי דקשיא ליה דא"כ חסר ליה מניינא דכ"ד ואם כן נראה מכוונתו דשני מיני נזקין שוין לא שייך למנותן אלא אחד וא"כ ה"נ אם נפרש מפגל דהיינו פיגול קשה דהיינו מנסך דכמו שהמנסך ע"י מעשיו אוסר יינו של חבירו בהנאה הכי נמי במפגל לכך פרש"י דמפגל דהכא היינו שלא לשמה וא"כ לא דמי כלל למנסך דמפגל כה"ג הזבח כשר לגמרי אלא אפ"ה שייך בכלל ניזקין כיון שאינו עולה לבעלים וצריך אחר כנ"ל נכון ודו"ק. אלא דאכתי קשה דהא בחטאת לשם שלמים גופא הקרבן פסול כמו ששנינו בריש זבחים ותו קשיא לי כאן דלפרש"י החיוב תשלומין משום שצריכין קרבן אחר אם כן ה"ל לפרש בשלמים לשם חטאת דהקרבן כשר ולא עלו לבעלים וצריך קרבן אחר. תו קשיא לי אהא דמחייב במפגל דהא לקמן ממעטינן מרעהו ולא של הקדש וכתבו שם תוספות דאפילו אדם המזיק נמי פטור ובשלמא למ"ד דמפגל בלא"ה לא מחייב אלא משום קנסא דרבנן למ"ד לא שמיה היזק א"ש אלא למ"ד שמיה היזק ומשמע שם בפ' הניזקין דחייב מדאורייתא דמקשה למ"ד שמיה היזק האי מפני תיקון העולם מדאורייתא הוא וא"כ קשה מאי קושיא הא מדאורייתא ודאי פטור דממעטינן מרעהו ומחמת כל זה היה נראה בעיני לפום ריהטא להגיה בלשון רש"י שלמים לשם חטאת ולפ"ז א"ש דאתיא כר"י הגלילי דמוקמינן לקמן מתניתין דנכסים שאין בהם מעילה כוותיה ומזה כתבו רוב הפוסקים דהלכה כמותו כמו שאבאר שם וא"כ א"ש דשלמים קדשים קלים הוא והוי ממון בעלים לר"י הגלילי וכמ"ש שם רש"י הטעם מפני שאחריותן עליו והיינו נמי שכתב כאן וצריך אחר דמש"ה הוי ממון בעלים והשתא א"ש שכתוב דוקא במשנה בשחיטה שלא לשמה משום דמסקינן לקמן כי קאמר ר"י הגלילי מחיים אבל לאחר שחיטה לא קרינן ביה רעהו נמצא דהשחיטה שלא לשמו הוי שפיר ממון בעלים דכיון דקודם שחיטה ה"ל ממון בעלים וכיון שהתחיל לשחוט שלא לשמו ובשחיטה זו אפסדיה לבעלים ה"ל כטבח שקלקל בשחיטה דחייב וה"נ דכוותיה כיון ששחט ממון בעלים בפסול אפסדיה בהכי שצריך ליקח אחר חייב משא"כ בפיגול גמור חוץ לזמנו וחוץ למקומו לא משכחת ליה בתחילת שחיטה דאין מפגלין בחצי מתיר. ועוד דאין מחשבת פגול נקבע אלא בזריקה נמצא דכיון דבתחילת שחיטה תו לא הוי ממון בעלים ולא קרינן ביה רעהו אין לחייבו על מה שפסל אח"כ כך נ"ל. אלא שקשה בעיני להגיה הספרים. ועוד דאכתי קשה א"כ אמאי מפרש בגיטין בענין אחר ואף שהיה אפשר ליישב שם בדוחק כמו שאפרש שם בעזה"י אלא שנ"ל דוחק להעמיד המשנה דכהנים שפגלו במקדש כיחידאי ובקדשים קלים דוקא. לכן נלע"ד ליישב בענין אחר דכאן משמע לרש"י דברייתא דר"ח ס"ל היזק שא"נ שמיה היזק וחייב מדאורייתא והיינו דקתני כ"ד אבות נזיקין וחשיב מטמא מדמע ומנסך דכולהו אבות נינהו והיינו מדאורייתא דמילי דרבנן לאו אבות נינהו כמו שכתבתי בסמוך בחידושי והיינו דקאמר נמי שייר מפגל אלמא דמפגל נמי מדאורייתא הוא ומתוקמא שפיר אליבא דר"ע דלא ממעטינן מרעהו ולא של הקדש אלא בענין דהתשלומין להקדש אבל היכא שהתשלומין לבעלים קרינן ביה שפיר רעהו וזה שכתב רש"י וצריך אחר מש"ה קרינן ביה רעהו. א"כ א"ש מה שפי' רש"י שאין הקרבן עולה דמש"ה חייב בתשלומין ולא משום שהקרבן פסול והא דבפ' הזהב משמע דקדשים שחייב באחריותן פטור דלר' שמעון נמי לא מיקרי רעהו היינו לענין כפל דוקא אבל לענין הקרן כ"ע מודו דממון גמור של בעלים היא כיון שצריך אחר והוא שיטת הרמב"ם שכתב להדיא. והא דמוקמינן לקמן בקדשים קלים ואליבא דר"י הגלילי ולא מוקי לה ככ"ע ובשלמים שחייב באחריותן מיקרי רעהו מבואר לקמן שם דנזקי בהמתו לא שייך לחייבו בכה"ג ע"ש ולפ"ז הוצרך רש"י לפרש דוקא לענין שלא לשמו ובחטאת לשם שלמים דפסול וכיון שפסל בשחיטה חייב מדאורייתא כמו בטבח אומן שקלקל ואף על גב דפסול שלא לשמו ע"י מחשבה בעלמא הוא ואפילו היזק שאינו ניכר לא הוי כיון דלא עביד שום מעשה בידים כמ"ש הרמב"ן בדיני דגרמי שלו בחידושים ב"ב מ"מ שאני הכא כיון דגוף השחיטה מעשה בידים הוא וכיון ששחטו שלא כהוגן ה"ל כאילו קטליה בידים כמ"ש הרמב"ן זה הטעם לענין טבח אומן שקלקל דחייב אפילו למ"ד היזק שא"נ לא שמיה היזק ואפילו קלקלה בשהיה או בדרסה ע"ש באריכות משא"כ בפיגול חוץ לזמנו וחוץ למקומו לא שייך לחייבו בתשלומין מדאורייתא דאפילו היזק שא"נ לא הוי כאן דלא עביד מעשה ולא שייך הכא לומר דה"ל כאילו קטליה כיון שאין נקבע בפסול אלא בזריקה ובשעת זריקה נקבע ממילא למפרע נמצא שבשעת שחיטה לא מינכר מעשה הפיגול ולא שייך לומר כאילו קטליה כנ"ל נכון. והא דבגיטין מפרש לה בפיגול דחוץ לזמנו וחוץ למקומו היינו משום דאליבא דהלכתא איירי דקי"ל כמ"ד היזק שא"נ לא שמיה היזק וההיא דמזידין חייב היינו מדרבנן משום קנסא וא"כ חייב בכל ענין. אלא דעדיין צ"ע קצת דלכאורה נראה דההיא דאין מחשבת פגול אלא בזריקה היינו לענין כרת דוקא ולא לענין פסול ויש ליישב ודו"ק:

    אמנם אח"ז מצאתי לרש"י ז"ל סוף מס' פסחים שכתב גבי פגול מטמא ידים משום חשדי כהונה דכתב שלא לשחוט שלמים לשם חטאת משום שחטאת כולה לכהנים משא"כ משלמים אין להם אלא חזה ושוק ולפ"ז נראה להגיה כמו שכתבתי לעיל שלמים לשם חטאת ומש"ה לא מפר' נמי במחשבת פגול דחוץ לזמנו. אלא דאכתי קשה לי דהא שלמים ששחט לשם חטאת אכתי שלמים נינהו ויש ליישב וצ"ע:
