    English translation — Bava Kamma 16a

    1The entire mishna is in accordance with the opinion of Rabbi Tarfon; the first part of the latter clause is stated with regard to a jointly owned courtyard, which under the terms of their partnership is designated for the use of one of them, i.e., the injured party, to keep his produce there, and for this one and for that one to keep their oxen there. Accordingly, with regard to damage of the category of Eating caused by one partner’s ox to the injured party’s produce in that courtyard, it is equivalent to the case of a courtyard owned exclusively by the injured party, and the ox’s owner is liable for all the damage. But with regard to damage of the category of Goring, since they are both allowed to keep oxen there, the courtyard is equivalent to a public domain, and if one’s innocuous ox causes damage there, one is liable for only half the cost of the damage.

    2Rav Kahana said: I stated this teaching of Rabbi Elazar before Rav Zevid of Neharde’a, and he said to me: Are you really able to interpret that the entire mishna is in accordance with the opinion of Rabbi Tarfon? But doesn’t the mishna teach: Concerning acts of damage performed with the tooth, the animal is considered forewarned with regard to eating that which is fitting for it to eat. This indicates that only if what it eats is fitting for it, then yes, one is liable for the full cost of the damage, but if it eats something that is not fitting for it, the owner would not be liable for the full cost of the damage, but only for half the cost of the damage.

    3Rav Kahana explains his difficulty: And if the mishna is in accordance with the opinion of Rabbi Tarfon, the owner should be liable to pay the full cost of the damage even if his animal ate something not fitting for it, as doesn’t Rabbi Tarfon say: The halakha of cases of Goring performed by an innocuous animal, which is atypical, done in the courtyard of the injured party, is that the owner of the ox pays the full cost of the damage even if the ox is innocuous.

    4Rather, Rav Kahana said: Actually it must be that the entire mishna is in accordance with the opinion of the Rabbis and the mishna is incomplete and this is what it is teaching: The opening clause should be understood as saying: There are five damage-causing acts that animals can perform twice and remain innocuous, but if they were warned for performing those acts three times, with regard to the five acts they are considered forewarned, i.e., the mishna is not referring to two different sets of damages, five acts for which the animal is considered innocuous and five for which it is considered forewarned. Rather, both statements in the initial clause of the mishna are referring to the same five acts of Goring, and they teach that although the animal is initially considered innocuous with regard to these five acts, it can become forewarned.

    5The next part of the mishna then provides another halakha : But for damage of the categories of Eating and Trampling, an animal is considered forewarned from the outset. The next two items in the mishna: A forewarned ox and an ox that causes damage on the property of the injured party, should be understood as a question and an answer: And where does their forewarned status with regard to these acts apply? It applies in the courtyard of the injured party. According to Rav Kahana’s explanation, the statement: In the courtyard of the injured party, refers only to cases of Eating or Trampling, not to acts classified as Goring, and therefore it is true even according to the opinion of the Rabbis.

    6Ravina objects to this explanation: Doesn’t the mishna below (24b) teach: With regard to the case of an ox that causes damage to the property of the injured party on the property of the injured party, stated in the mishna here (15b), how so, i.e., what are the circumstances in which one is liable to pay the full cost of the damage? The mishna below (24b) proceeds to list acts of damage classified as Goring. Ravina states his objection: Granted, if you say that the mishna here (15b) discusses that case, i.e., that it is referring to Goring, it is due to that ruling that the mishna below teaches: How so, and proceeds to discuss one’s liability for Goring, as it is elucidating the case mentioned in the mishna here. But if you say, as Rav Zevid suggests, that the mishna here (15b) does not discuss Goring, what is the meaning of the mishna below when it asks: How so, and then proceeds to discuss one’s liability for Goring?

    7Rather, Ravina said: The mishna is incomplete and this is what it is teaching: There are five damage-causing acts that animals can perform twice and remain innocuous, but if they were warned for performing those acts three times with regard to the five acts, they are considered forewarned.

    8The next part of the mishna then provides another halakha : But for damage of the categories of Eating and Trampling, an animal is considered forewarned from the outset, and this is a case in which all agree that the animal is classified as a forewarned ox. And there is the case of an ox that causes damage to the property of the injured party, on the property of the injured party, which is subject to a dispute between Rabbi Tarfon and the Rabbis. And there is the case of an ox that causes damage to the property of the injured party, on the property of the injured party, which is subject to a dispute between Rabbi Tarfon and the Rabbis.     10There are those who raise this issue as a contradiction and through doing so arrived at the same conclusions, as follows: We learned in the opening clause of the mishna: There are five damage-causing acts that animals can perform twice and remain innocuous, and there are five damage-causing acts for which an animal is considered forewarned. With regard to this, one can ask: But is there nothing else? But aren’t there the cases mentioned in the continuation of the mishna: The wolf, the lion, the bear, the leopard, the bardelas , and the snake? These are considered to be forewarned even if they had never caused damage before.

    11And they resolve the contradiction through that which Ravina said: The mishna is incomplete and this is what it is teaching: There are five damage-causing acts that animals can perform twice and remain innocuous, but if they were warned for performing those acts three times with regard to the five acts, they are considered forewarned. The next part of the mishna then provides another halakha : But for damage of the categories of Eating and Trampling, an animal is considered forewarned from the outset, and this is a case in which all agree that the animal is classified as a forewarned ox. And there is the case of an ox that causes damage to the property of the injured party, on the property of the injured party, which is subject to a dispute between Rabbi Tarfon and the Rabbis.     12§ The mishna teaches: An animal is not considered forewarned with regard to Goring, i.e., not for goring with its horns, nor for pushing with its body, nor for biting, nor for crouching upon items in order to damage them. Rabbi Elazar says: They taught this only with regard to large vessels, as it is atypical for an animal to crouch upon them, and therefore the act is classified as a subcategory of Goring. But if the animal crouched upon small vessels, since that is its typical manner of behavior, it is classified as a subcategory of Trampling, for which the animal is considered forewarned from the outset.

    13The Gemara suggests: Let us say that the following baraita supports the opinion of Rabbi Elazar: An animal is considered forewarned, from the outset, to walk in its typical manner and to break or crush a person, or an animal, or vessels. The baraita indicates that an animal’s typical manner is to crush vessels, presumably by crouching down upon them. This would seem to contradict the mishna that states that such behavior is atypical. It would appear the only resolution to this contradiction is if one accepts the distinction made by Rabbi Elazar that the mishna concerns large vessels and the baraita concerns small vessels.

    14The Gemara rejects this: Perhaps the baraita concerns a case where the animal pushed against the utensils from the side and crushed them against a wall, but it does not concern a case where it crouched upon them.

    15There are those who say a different version of this discussion, as follows: Rabbi Elazar says: Do not say that the mishna’s ruling refers only to large vessels, as it is atypical for an animal to crouch upon them, but if the animal crouched upon small vessels, that is its typical manner and for that type of damage the animal is considered forewarned. Rather, the mishna refers even to small vessels, as it is atypical for an animal to crouch upon them.

    16The Gemara raises an objection from a baraita : An animal is considered forewarned, from the outset, to walk in its typical manner and to break or crush a person, or an animal, or vessels.

    17Rabbi Elazar said: Perhaps the baraita concerns only a case where the animal pushed against the utensils from the side and crushed them against a wall.

    18There are those who raise this issue as a contradiction: We learned in the mishna: An animal is not considered forewarned with regard to Goring, i.e., not for goring with its horns, nor for pushing with its body, nor for biting, nor for crouching upon items in order to damage them. In order to resolve this contradiction, Rabbi Elazar said: It is not difficult; here, in the mishna, the reference is to large vessels, while there, in the baraita , the reference is to small vessels.

    19§ The mishna teaches: The wolf, the lion, the bear, the leopard, the bardelas , and the snake; these are considered to be forewarned even if they had never caused damage before. The Gemara asks: What is a bardelas ? Rav Yehuda said: It is a nafreza . The Gemara asks: What is a nafreza ? Rav Yosef said: It is an appa .

    20The Gemara raises an objection from a baraita : In addition to the list of animals that are considered forewarned, Rabbi Meir says: Also the hyena [ tzavo’a ]. Rabbi Elazar says: Also the snake. And Rav Yosef said in explanation of the baraita : The hyena mentioned by Rabbi Meir, this is the animal called an appa . If Rav Yosef understands a hyena to be an appa , how could he also claim, above, that it is a bardelas ?

    21The Gemara explains: It is not difficult: Here, in the baraita , Rabbi Meir is referring to a male hyena, and there, in the mishna, the reference is to a female hyena.

    22And it is apparent that a male hyena is distinct from a female one, as it is taught in a baraita : A male hyena after seven years metamorphoses into an insectivorous bat [ atalef ]; an insectivorous bat after seven years metamorphoses into a herbivorous bat [ arpad ]; a herbivorous bat after seven years metamorphoses into a thistle [ kimosh ]; a thistle after seven years metamorphoses into a briar [ ḥo’aḥ ]; and a briar after seven years metamorphoses into a demon. Similarly, a person’s spine, seven years after his death, metamorphoses into a snake. The Gemara qualifies the last statement: And this matter applies only to a case where that person did not bow during the blessing of thanksgiving, the eighteenth blessing of the Amida prayer.

    23The Gemara analyzes the baraita : The Master says above: In addition to the list of animals that are considered forewarned, Rabbi Meir says: Also the hyena.

    [The] entire [mishna] is [in accordance with the opinion of] Rabbi TarfonSee Tosafot 14a ד"ה לא לזה ולא לזה לפירות אלא דחד, note 2, for a lengthy discussion of the material that we are discussing in this Tosafot. A short review: The text of our Gemara here and on 14a is that the area that the Braita on 14a and the Mishna on 15b are speaking about is a jointly owned courtyard where both partners, Reuven and Shimon, have the right to bring their oxen, but only one partner, Reuven, may store his produce there. This is the text of Rashi, Rif and Rambam. This area is equivalent to a public domain as far as keren is concerned, since both oxen have the right to be there as they do in a public domain and is considered Reuven’s private courtyard in regard to shain and regel, since he has exclusive rights to store his produce in the courtyard. Rabbeinu Tam vehemently disagrees with this text, because he holds that it is impossible to consider this area as a private domain for shain and regel, when the oxen that damage by shain and regel are allowed to be there. He alters the text to read: this one and that one do not have the right to bring in oxen, thus it is a private domain for shain and regel. For keren it is equivalent to a public domain, since both partners equally do not have the right to bring in their oxen. In our Gemara we are once again searching for an area that has a dual function, where for keren it will be a public domain and according to R’ Tarfon a tam will pay only half damages, whereas for shain and regel it will serve as a courtyard of the nizok where they are liable. In our Gemara we find R’ Elozor who disagreed with Rav Chisdo on 13b and 14a, expressing his opinion as to when a courtyard has a split ruling. This should be very telling about the exact dispute with Rav Chisdo. Here as well we amend the text to read: It is designated for one of them, Reuven, for produce, and not for this one, Reuven, nor for that one, Shimon, for oxen. This is bewildering! For it is to be understood from R’ Elozor who says the jointly owned courtyard is a private domain for shain and regel because it is designated for only one of them, Reuven, for produce, but if it would be designated for both, Reuven and Shimon, for produce, one would be exempt for shain and regel. And if so, we should resolve from this Gemara that they, Rav Chisdo and R’ Elozor, argue about the question of R’ Zeira, who asked: “How can an area be considered a courtyard of the nizok when the damager may also store his produce there?” and the solution of Abaye, who answered that it is considered the courtyard of the nizok because the damager had no right to bring his oxen there, and earlier in the Gemara on 14a, the Gemara is in doubt about whether they disagree at all. On 14a the Gemara was not sure that R’ Elozor disagrees with Rav Chisdo who holds that when even both have the right to store their produce in the courtyard it is still considered a private domain. However, here on 16a it is clear that R’ Elozor who is reconciling our Mishna in accordance with R’ Tarfon is saying that it is considered a private domain when only one, Reuven, has the right to store his produce there. R’ Elozor holds that if both have the right to store their produce there it is not a courtyard of the nizok for shain and regel. Why does the Gemara on 14a even have the slightest doubt about R’ Elozor’s position in this matter? The fact that R’ Elozor expresses his opinion here about what is considered a jointly owned courtyard with a split ruling presents a problem to the text of Rashi, Rif and Rambam as well. And according to the manuscripts that have the text that the courtyard was designated for this one, Reuven, and for that one, Shimon, for oxen, the reverse is difficult, that the Gemara should resolve that they, Rav Chisdo and R’ Elozor on 14a do not argue when the courtyard is designated for both for produce when neither has the right to bring in oxen, and they agree that this area is considered a courtyard of the nizok, and there is no dispute between them, because he, R’ Elozor, here on 16a, considers a jointly owned courtyard as a courtyard of the nizok, even though the damager has the right to leave his ox there, as he clearly states his position on this matter in our Gemara, where he says that when both have the right to bring in their oxen and only one has the right to store his produce it is a courtyard of the nizok, certainly, when the courtyard is not designated for oxen at all, it should be considered a courtyard of the nizok even though it is designated for both Reuven and Shimon for produce.

    [If it] is fitting for it, [then] yes; [if it] is not fitting for it, [then] no. R’ Elozor in the name of Rav said that all the cases of our Mishna can be in accord with R’ Tarfon. Rav Z’vid of N’hardo challenges this contention. The Mishna clearly states that shain is muad and pays full damages for that which is suitable for it, namely food; this implies that shain is not muad for eating things that are not suitable to be eaten such as garments and utensils. In effect this means that for eating garments and utensils the ox owner will pay only half damages, even though the damage occurred in the courtyard of the nizok. This undoubtedly does not concur with R’ Tarfon who holds that keren pays in full when the damage occurs in the nizok’s domain. Tosafot suggests that there might be another way of understanding the implication of the Mishna that shain is not a muad for garments and utensils that can concur with R’ Tarfon. We should not ask: Perhaps that, which the Gemara says that shain is a muad for eating that which is suitable for it, that means that the owner is liable to pay from his choicest assets and the payment is not limited to the value of the ox. And when the animal eats that which is not suitable for it such as garments and utensils, even though the owner pays full damages in accordance with R’ Tarfon, the Mishna is saying that he is not a muad in regard to paying from choicest assets, as the Gemara says in the second Perek (below 18b), that according to R’ Tarfon a tam pays full damages in the courtyard of the nizok, but only from its body. Thus even this sentence of the Mishna concurs with R’ Tarfon. Tosafot needs to prove that the term “it is not a muad” may be interpreted as meaning that one is not required to pay from his choicest assets, even though full payment is required. And the term muad can be used for this purpose, to indicate that the payment must be made from the choicest assets and is not limited to its body, as the Gemara says (below 18b): a chicken hopping and sends pebbles flying and they break utensils is not muad, and some say it is muad. And the dispute is about this issue, that one master who says the chicken is not muad, holds that payment is to be made only from its body, and the other master who says that the chicken is muad, holds that payment is to be made from the choicest assets of the chicken owner. We see that the term muad can be used to indicate that payment must be made from general assets and ‘not muad’ means that payment is limited to the body of the damager. Thus, it survives through the millennium and will be the initial component from which his body will be resurrected. And now, when that bone becomes a snake, he will not be resurrected because the bone that is used as the initial component of his resurrected body will not be available because it is a snake and will not live in the time to come, when the dead will be resurrected. It is not logical to say that one will punished so harshly for committing this relatively minor transgression. For we have learned in a Mishna (Sanhedrin 90a): All of Yisro’ail has a share in the world to come. Even though there are exceptions as mentioned in the Mishna there, not bowing when reciting modim is not listed among the exceptions nor is it as severe a transgression as some of the exceptions and it cannot be compared to them.

    [The] entire [mishna] is [in accordance with the opinion of] Rabbi Tarfon See Tosafot 14a ד"ה לא לזה ולא לזה לפירות אלא דחד, note 2, for a lengthy discussion of the material that we are discussing in this Tosafot. A short review: The text of our Gemara here and on 14a is that the area that the Braita on 14a and the Mishna on 15b are speaking about is a jointly owned courtyard where both partners, Reuven and Shimon, have the right to bring their oxen, but only one partner, Reuven, may store his produce there. This is the text of Rashi, Rif and Rambam. This area is equivalent to a public domain as far as keren is concerned, since both oxen have the right to be there as they do in a public domain and is considered Reuven’s private courtyard in regard to shain and regel, since he has exclusive rights to store his produce in the courtyard. Rabbeinu Tam vehemently disagrees with this text, because he holds that it is impossible to consider this area as a private domain for shain and regel, when the oxen that damage by shain and regel are allowed to be there. He alters the text to read: this one and that one do not have the right to bring in oxen, thus it is a private domain for shain and regel. For keren it is equivalent to a public domain, since both partners equally do not have the right to bring in their oxen. In our Gemara we are once again searching for an area that has a dual function, where for keren it will be a public domain and according to R’ Tarfon a tam will pay only half damages, whereas for shain and regel it will serve as a courtyard of the nizok where they are liable. In our Gemara we find R’ Elozor who disagreed with Rav Chisdo on 13b and 14a, expressing his opinion as to when a courtyard has a split ruling. This should be very telling about the exact dispute with Rav Chisdo. Here as well we amend the text to read: It is designated for one of them, Reuven, for produce, and not for this one, Reuven, nor for that one, Shimon, for oxen. This is bewildering! For it is to be understood from R’ Elozor who says the jointly owned courtyard is a private domain for shain and regel because it is designated for only one of them, Reuven, for produce, but if it would be designated for both, Reuven and Shimon, for produce, one would be exempt for shain and regel. And if so, we should resolve from this Gemara that they, Rav Chisdo and R’ Elozor, argue about the question of R’ Zeira, who asked: “How can an area be considered a courtyard of the nizok when the damager may also store his produce there?” and the solution of Abaye, who answered that it is considered the courtyard of the nizok because the damager had no right to bring his oxen there, and earlier in the Gemara on 14a, the Gemara is in doubt about whether they disagree at all. On 14a the Gemara was not sure that R’ Elozor disagrees with Rav Chisdo who holds that when even both have the right to store their produce in the courtyard it is still considered a private domain. However, here on 16a it is clear that R’ Elozor who is reconciling our Mishna in accordance with R’ Tarfon is saying that it is considered a private domain when only one, Reuven, has the right to store his produce there. R’ Elozor holds that if both have the right to store their produce there it is not a courtyard of the nizok for shain and regel. Why does the Gemara on 14a even have the slightest doubt about R’ Elozor’s position in this matter? The fact that R’ Elozor expresses his opinion here about what is considered a jointly owned courtyard with a split ruling presents a problem to the text of Rashi, Rif and Rambam as well. And according to the manuscripts that have the text that the courtyard was designated for this one, Reuven, and for that one, Shimon, for oxen, the reverse is difficult, that the Gemara should resolve that they, Rav Chisdo and R’ Elozor on 14a do not argue when the courtyard is designated for both for produce when neither has the right to bring in oxen, and they agree that this area is considered a courtyard of the nizok, and there is no dispute between them, because he, R’ Elozor, here on 16a, considers a jointly owned courtyard as a courtyard of the nizok, even though the damager has the right to leave his ox there, as he clearly states his position on this matter in our Gemara, where he says that when both have the right to bring in their oxen and only one has the right to store his produce it is a courtyard of the nizok, certainly, when the courtyard is not designated for oxen at all, it should be considered a courtyard of the nizok even though it is designated for both Reuven and Shimon for produce.

    [If it] is fitting for it, [then] yes; [if it] is not fitting for it, [then] no. R’ Elozor in the name of Rav said that all the cases of our Mishna can be in accord with R’ Tarfon. Rav Z’vid of N’hardo challenges this contention. The Mishna clearly states that shain is muad and pays full damages for that which is suitable for it, namely food; this implies that shain is not muad for eating things that are not suitable to be eaten such as garments and utensils. In effect this means that for eating garments and utensils the ox owner will pay only half damages, even though the damage occurred in the courtyard of the nizok. This undoubtedly does not concur with R’ Tarfon who holds that keren pays in full when the damage occurs in the nizok’s domain. Tosafot suggests that there might be another way of understanding the implication of the Mishna that shain is not a muad for garments and utensils that can concur with R’ Tarfon. We should not ask: Perhaps that, which the Gemara says that shain is a muad for eating that which is suitable for it, that means that the owner is liable to pay from his choicest assets and the payment is not limited to the value of the ox. And when the animal eats that which is not suitable for it such as garments and utensils, even though the owner pays full damages in accordance with R’ Tarfon, the Mishna is saying that he is not a muad in regard to paying from choicest assets, as the Gemara says in the second Perek (below 18b), that according to R’ Tarfon a tam pays full damages in the courtyard of the nizok, but only from its body. Thus even this sentence of the Mishna concurs with R’ Tarfon. Tosafot needs to prove that the term “it is not a muad” may be interpreted as meaning that one is not required to pay from his choicest assets, even though full payment is required. And the term muad can be used for this purpose, to indicate that the payment must be made from the choicest assets and is not limited to its body, as the Gemara says (below 18b): a chicken hopping and sends pebbles flying and they break utensils is not muad, and some say it is muad. And the dispute is about this issue, that one master who says the chicken is not muad, holds that payment is to be made only from its body, and the other master who says that the chicken is muad, holds that payment is to be made from the choicest assets of the chicken owner. We see that the term muad can be used to indicate that payment must be made from general assets and ‘not muad’ means that payment is limited to the body of the damager.     ראוי לה אין וא"ת אמאי לא אוקמוה כשאינה מיוחדת לא לזה ולא לזה לכסות ולא לכלים או במיוחדת לשניהם לכסות ולכלים ולחד לפירות. ויש מי שתירץ דלהכי לא אוקמוה בהכין דאם כן אמאי נקט מתניתין השן מועדת לאכול את הראוי לה יאמר מועדת לשאינו ראוי לה דהיינו שמיוחדת לאחד לכלים והוי רשות הניזק וחייבת נזק שלם ואינה מועדת לראוי לה דהיינו שמיוחדת לשניהם לפירות דהויא לה רשות הרבים ופטר בה השן. ויש דוחין תירוץ זה דאיכא למימר דלהכי לא קתני מתניתין השן מועדת לאכול שאינו ראוי לה משום דמשמע השן מועדת היינו לשלם נזק שלם דסתם מועד הכי משמע אבל אינה מועדת משמע דחייבת קצת דהיינו חצי נזק ואי מיוחדת לשניהם לפירות פטור לגמרי להכי קאמר התנא השן מועדת לאכול את הראוי לה דהיינו מיוחדת לחד לפירות כי היכי דנדייק מינה הא לשאינו ראוי לה אינו מועד דהיינו מיוחדת לשניהם לכסות דמשלם חצי נזק ואינו פטור לגמרי. ותירץ מהר"ם דאין דרך שתהא מיוחדת לפירות טפי מכסות וכלים או איפכא אבל דרך הוא דאינה מיוחדת לשניהם לשוורים לפי שדרכן בטינוף ודריסה. גליון ותלמידי ה"ר ישראל ז"ל. עוד כתבו תלמידי ה"ר ישראל ז"ל דליכא לאוקמה הכי דהא רבי אלעזר בעצמו מוקי לה כרבי טרפון ורבי אלעזר בעצמו אמר בסמוך לא שנו אלא פכין גדולים אם כן מיוחד לאחד לפכין. ע"כ.

    וזה לשון תלמיד ה"ר פרץ ז"ל ראוי לה אין וכו' והשתא ליכא לפרש כדלעיל דהכא מיירי במידי דאכילה לא בקרן. ע"כ.

    ראוי לה אין שאין ראוי לה לא כתבו בתוספות אין להקשות דילמא הא דקתני מועדת היינו לשלם מן העלייה וכו' עד כדאמרינן הידוס אינו מועד וכו'. הקשה מורי הרב מה ראיה הם מביאים מהידוס דהתם איירי בשני צדדין דמה שקורא התם אינו מועד משום דמגופו משלם ומשום דמשלם חצי נזק אבל אין לקרות אינו מועד היכא דמשלם נזק שלם ומגופו דהוי בצד אחד. ויש לומר דעל כרחך התם נמי בצד אחד קורא אותו אינו מועד שהרי כשדחה התלמוד לשם ואמר לא בפלוגתא דרבנן וסומכוס פירש דלמאן דאמר מועד היינו כסומכוס ראמר צרורות נזק שלם משלם והא דאמר אינו מועד כרבנן דאמרי חצי נזק משלם דאם אינו קורא אינו מועד אלא אם כן יש בו שני צדדין דהיינו מגופו וחצי נזק אם כן נפשוט אליבא דרבנן דחצי נזק צרורות מגופו משלם ומדלא פשיט אלא העמיד בפלוגתא דרבנן וסומכוס שמע מינה דקרי אינו מועד אפילו היכא דליכא אלא צד אחד דהיינו מן העלייה וחצי נזק כך נמי דעת התוספות דאף על גב דמשלם נזק שלם כיון דאינו משלם מגופו קרי ליה אינו מועד. גליון. והרא"ש ז"ל תירץ לקושיות התוספות דעל כרחך העדאה דהכא לענין נזק שלם דהא שור המזיק בדשות הניזק קרי ליה מועד ואינו משלם אלא מגופו. ע"כ. וזה לשון תלמיד הר"פ ז"ל יש לומר דלקמן פרק ב' מפרש מתניתין דהכא דהשן מועדת לאכול הראוי לה כיצד אכלה אוכלים הראויין לה ושתתה משקין הראויין לה משלמת נזק שלם אלמא לענין נזק שלם קאמר ודכוותה דייקינן שאינו ראוי לא משלם נזק שלם. ע"כ.

    אלא לעולם דרבנן וחסורי מחסרא והכי קתני מצאתי כתוב שרש"י ז"ל במהדורא קמא פידש כן חסורי מיחסרא וכו' חמשה תמין הן נגיפה נשיכה נגיחה בעיטה רביצה, ואם הועדו חמשתן מועדין וזה אחד מן החמשה מועדין, שן ורגל מועדין מתחילתן הרי שלושה ושור המועד לא תני במתניתין בחד דהא מנייה שהרי תנא אם הועדו חמשתן מועדין אלא הא דקתני שור המועד שור המזיק ברשות הניזק פירושו קא מפרש והכי קתני שור המועד שור המזיק וכו' כלומר היכן העדתם דשן ורגל ברשות הניזק והאדם היינו ארבעה והיינו דקא פריך רבינא דחמשה מועדין תנן והני ארבעה הוו דקאמר שור המועד ושור המזיק ברשות הניזק אשן ורגל קאי ולא טעי תנא בין ארבעה לחמשה. ועוד הא תני לקמן בפרק כיצד דקא מפרש לכלהו מועדין דפרק קמא כיצד הן וקא מפרש נמי שור המזיק ברשות הניזק כיצד אי אמרת בשלמא איירי בקרן תמה ברשות הניזק בנזק שלם בפרק קמא היינו דקתני פירושא בפרק כיצד ומפרש פלוגתא דרבי טרפון אלא אי אמרת לא איירי בהאי פירקא מאי כיצד ואהיכא קאי. וזהו שור המועד הא דאמרן ואם הועדו חמשתן מועדין זהו שור המועד הכתוב בתורה והוא חד מן המועדין, ושור המזיק וכו' מחלוקת רבי טרפון ורבנן בפרק ב' והאדם וחמשה מועדין דמתניתין ארבעה וחמשה מחלוקת ויש מועדין וכו' סיפא דמתניתין קא מפרש אחרים שאינה בהמה אלא חיה כיוצא באלו דשן ורגל והיינו שן דחיה דמפרש בפרק ב' מדרשא דחיה בכלל בהמה ונחש נמי יש לו הנאה בהיזקא ששותה את הדם והא דלא מנא להו במנינא דמועדין ברישא משום דלא דמו אהדדי. אחר כך כתב רש"י במהדורא בתרא ככתוב בספרי הדפוס ומחק מה שכתב במהדורא קמא. ובהאי לישנא בתרא דפירש רש"י אני יצחק מגמגם דהא מתניתין דחמשה תמין אוקימנא בחצר הניזק כדסברנא למימר אלא לאו רבנן היא ושינויין דחצר השותפין שבקנא ליה ואי אהכי נמי קאי מניינא דחמשה מועדין לאו תני תנא כהאי גוונא ברישא סתם שאין נזק שלם להם בחצר הניזק אלא על ידי העדאה והדר אמר בשור המזיק ברשות הניזק שאין סתמא דרישא עיקר אלא מחלוקת היא רבי טרפון וחכמים מרישא נמי הוה ליה למימר הכי דבשלמא ללישנא קמא כולה חדא בבא היא מחדא מניינא דתמין ומועדין דנקיט ברישא עד האדם אלא ללישנא בתרא מדקאי אשן וארגל שבקיה דמניינא קמא ונקט ליה בבא אחרי. ומ"ש דעד השתא לא אשמועינן מחלוקת רבי טרפון וחכמים. ותו מתניתין דפרק ב' יוכיח דקא מפרש בגווה ותני לה כגון בור ואש דלא תני מכלל דחמשה דהתם היינו חמשה דהכא ומשום הכי לא תנא בור ואש דלא איירי אלא בבעלי חיים. עוד קשה על פירוש אחרון דקאמר תלמודא איכא דרמי לה מירמא הנך חמשה תמין וחמשה מועדין ותו ליכא דהא איכא הארי והדוב והנמר וכו' בשלמא אי שן ורגל ושור המועד ואדם ממנינא היינו דרמי האיכא נמי הני אבל אי הני לאו ממנינא אלא חמשה תמין שהועדו מאי פריך מארי ודוב ונמר לפרוך נמי משן ורגל ואדם. ע"כ.

    כל זה מצאתי כתוב ברש"י כתיבת יד והרשב"א ז"ל היתה לפניו מהדורא קמא דרש"י ז"ל דכתב וז"ל גירסת הספרים מתקיף לה רבינא הא קתני לקמן וכו' ולא גרסינן חדא דאנן חמשה תנן ורש"י ז"ל גריס לה ומפורשת בפירושיו. ע"כ.

    וזה לשון תלמיד ה"ר פרץ ז"ל חסורי מחסרא והכי קתני חמשה תמין הן ואותן עצמן אם הועדו הרי אלו מועדין ושן ורגל מועדין מתחילתן והיכן העדאתן ברשות הניזק כלומר שור המזיק לא מיירי בקרן אלא אשן ורגל קאי ולכך הוצרך לומר חמשה תמין וכו'. ואם הועדו חמשתן מועדין דהא כיון דשור המזיק קאי אשן ורגל לא הוי ממניינא וחמשה לא משכחנא בסיפא אלא ארבעה שן ורגל ושור מועד והאדם ולכך פירש הקונטרס דהמועדין קאי אהנך תמין ולא אמנינא דסיפא וסיפא לא הוי אלא מוסיף ולא נחת למעבד מניינא בההוא סיפא. ומיהו קשה להר"מ להאי לישנא אמאי נקט בסיפא שור המועד דבאיזה מועד איירי אי קרן תנינא אם הועדו חמשתן מועדין ואי שן ורגל הא תנא ליה. הכי גרסינן מתקיף לה רבינא הא קתני לקמן וכו' אלא אמר רבינא חמשה מועדין וכו' וזהו שור המועד עכשיו אגב שיטפיה שהוצרך להניח מאי דאמרינן שור המזיק קאי אשן ורגל מיישב בשור המועד מאי דהוה קשה להר"מ לעיל למאי הלכתא תנו והשתא מיישב דקאי אשן ורגל וזהו שור המועד מתחילתן. ע"כ.

    וזה לשון הראב"ד ז"ל ורבי אלעזר משמיה דרבא אמר כולה רבי טרפון היא ורישא דקתני השן מועדת וכו'. בחצר המיוחדת לאחד מהן לפירות ולזה ולזה לשוורים. נ"א ולא לזה ולא לזה לשוורים ולגבי שן הויא לה שדה ניזק להיכן הדעה בחצר הניזק זהו פירוש של שור המועד ושור המזיק ברשות הניזק ואשן ורגל קאי. אלא אמר רבינא וכו' והוא השור המועד מתחילתו והם השן ורגל ושור המזיק ברשות הניזק מחלוקת רבי טרפון ורבנן כלומר שור המזיק ברשות הניזק גם הוא מועד לדעת רבי טרפון. ואם תקשה מה הועלנו בחיסור המשנה ובתוספתא והלא סיפא דמתניתין לרבי טרפון היא דקא חשיב לה בהדי מועדין מתחילתן שהרי במשנתנו לא הזכיר בה מחלוקת. עתה בין ותדע כי בתחילה כשהיינו סבורין כי החמשה מועדין ששנה בתחילה הן אותן שמפרש בסוף כמו שמפרש המועדין מתחילתן והיה שור המזיק ברשות הניזק אחד מהן היה קשה לנו רישא סתם לנו כרבנן וסיפא כרבי טרפון ועכשיו שאמרנו כי החמשה מועדין לא בא לפרש המועדין מתחילתן אלא על התמין עצמן שאם הועדו יהיו מועדין לאו סתמא היא כרבי טרפון כלל. ועוד אמרנו כי שור המועד ששנינו בתוך המועדין אשן ורגל קאי וממעט הקרן דהא אמרינן וזהו שור המועד כלומר אלו הן מועדין מתחילתן לדברי הכל מכלל דשור המזיק ברשות הניזק דקתני בסמוך לאו דברי הכל היא והוא הקרן. ויש מועדין אחרים כיוצא באלו פירוש כמו הרגל והשן והאדם. ע"כ.

    בגמרא רבי אליעזר משמיה דרב אמר כולה ר"ט היא ובחצר מיוחדת לפירות לאחד ולזה ולזה לשוורים כן נראה שהוא גירסת רש"י והוצרך ר"א לפרש במיוחדת לפירות לא' לפי שיטתו דלעיל דפטר בחצר השותפים בשן ורגל לכך מוקי לה במיוחדת לפירות לא' דבכה"ג לא הוי חצר השותפים לענין שן ואף לפי מאי דקאמר הש"ס לעיל דפליגי באתקפתא דר"ז ור"א ס"ל כר"ז דאף במיוחדת לשניהם לפירות לחוד לא מיקרי שדה אחר מ"מ לק"מ והיינו לפי מ"ש לעיל דלר' זירא דעיקר שדה אחר קאי על הפירות לכך מקשה דכשמיוחדת לפירות יש לפוטרה משן אבל אם אינם שותפים לפירות לא איכפת לן לענין שן ורגל במה שמשותפים לשוורים דכיון שאינה מיוחדת לפירות שדה אחר קרינן בה ואף לפי' ראשון שכתבתי שם בדף י"ד גבי אתקפת' דר"ז יש לפרש הסוגיא כאן אלא שלא רציתי להאריך כיון שנראה לי עיקר כפי' השני שכן מוכח מלשון הש"ס לעיל וכאן ותן לחכם ויחכם עוד:

    שם בתוספות בד"ה כולה ר"ט היא וכו' ולספרים דגרסינן לזה ולזה לשוורים קשיא איפכא וכו' כ"ש היכא דאין מיוחדת וכו' עכ"ל. זה לפי שיטתם לעיל בדף י"ד בד"ה לא לזה ולא לזה אבל לפמ"ש כאן בגמרא וכן לעיל באריכות אין כאן מקום תימא כלל דלר"ז עיקר הענין תלוי במיוחדת לפירות לענין שן וא"כ מה שכתבו כ"ש היכא דאין מיוחדת לשוורים ואע"פ שמיוחדת לפירות ליתא לפי זו הסברא ולזה הסכימו רוב הפוסקים ועיין ברא"ש ודו"ק:

    בגמ' אלא אמר רבינא חסורי מיחסרא וכו' ויש לך מועדים אחרים כיוצא באלו הזאב וכו' עכ"ל. יש לדקדק כאן דאמאי הוצרך לפרש רבינא ולהוסיף דוקא ויש מועדים אחרים כיוצא באלו. דלכאורה אדרבא דלפי מאי דס"ד עד השתא דשן ורגל ואדם עד הזאב כל אלו מחמשה מועדים הם א"כ ביותר ראוי להקשות אמאי חילק התנא הזאב והארי בפני עצמם ולא מנאם במנין המועדים אבל לפי מה דמשני רבינא דמניינא דמועדים לא קאי אלא אקרן דשור ותולדותיו ואם כן משן ורגל ואילך לאו אמניינא קאי וא"כ מאי קשיא ליה עד שהוצרך לומר ויש אחרים כיוצא באלו. ונ"ל דאדרבה לפי מאי דס"ד מעיקרא דמניינא דה' מועדים אכולהו קאי עד הזאב אין להקשות כלל אמאי לא חשיב נמי הזאב וכו' במניינא דפשיטא ליה דלא קא חשיב במניינא דה' מועדין אלא אותן בעלי חיים השנוין כבר במשנתינו בכל הפרק והן אותן אבות דכתיבי בהדיא אבל הזאב ואינך לא כתיבי כמו הנך כדפרישית וכ"ש שלא שנו עדיין כלל במשנה ולכך לא ערבינהו אבל עכשיו לפי' רבינא דחמשה מועדין לא קאי אשן ורגל וא"כ כבר סילק התנא ממניינא וקשיא עליה שפיר אמאי שונה לאלו בפ"ע והיינו מדנקט הזאב בלא וא"ו משמע דבבא אחרת היא ועי"ל דלמאי דס"ד מעיקרא דר"ט תני לרישא דמתניתין א"כ יש לומר דר"ט ס"ל כר"א דחילק בין בני תרבות וא"כ לערבינהו אבל עכשיו דאמרת דמלתא דתליא בפלוגתא אפ"ה קתני קשיא שפיר. וא"ל דהא דנקט להו בפ"ע בלא וא"ו היינו משום דר"א פליג בהו דא"כ תקשי נחש אמאי לא תני בהדי אינך לכך הוסיף לפ' ויש מועדים אחרים ופירושו דמשום דלא כתיבי כמו הנך לא ערבינהו אפי' בסיפא ושונה אותם בפ"ע כפרש"י וק"ל:

    צָבוּעַ [זָכָר] לְאַחַר שֶׁבַע שָׁנִים נַעֲשֶׂה עֲטַלֵּף נראה הכונה אחר שימות בשבע שנים מתהוה מן העפר שלו תולע כצורת עטלף וכן הענין בכל אלו דזכר כאן וכן נמי מה שאמר על שדרו של אדם גם כן הכונה כך דאחר שנעשה עפר יתהווה מאותו עפר תולע דומה לנחש.

    וְהוּא דְּלָא כָּרַע בְּמוֹדִים ראה לי בס"ד הטעם שבעבור דלא כרע במודים יהיה שדרו נחש דאיתא בשער הכונות לרבינו האר"י ז"ל בכריעת מודים מוריד טיפת החסדים דרך חוט השדרה יעוין שם וידוע כי החסדים נרמזו באותיות המים והיינו ה' מים כי החסדים שרשם חמשה וכל חסד נקרא מים. ואמרתי רמז נכון בס"ד דאותיות המים במילואם כזה מ"ם יו"ד מ"ם תמצא אותיות המילוי הם אותיות מודים בדקדוק כי במודים מוריד טיפת החסדים. ובזה פרשתי בס"ד רמז הכתוב שַׁלַּח לַחְמְךָ עַל פְּנֵי הַמָּיִם (קהלת יא, א) והיינו 'שַׁלַּח לַחְמְךָ' החסדים כי לחם הוא סוד החסדים כנודע 'עַל פְּנֵי הַמָּיִם' כלומר במודים הרמוז בתוך ופנימיות של אותיות 'מים'. וידוע כי הפך המים שהם חסדים יש האש שהוא גבורה ודין וידוע דהנחש הוא מיסוד האש ולכך אמרו רבותינו ז"ל (סנהדרין לז:) מי שנתחייב שריפה מכישו נחש שבארס שלו עושה שריפה. ועל כן זה דלא כרע במודים להוריד טיפת החסדים שהם בסוד המים דרך חוט השדרה לכך שדרו נעשה נחש שהוא מצד האש שהוא הפך החסדים.
