Chapter 5 - HaSokher et HaPoel

English translation - Avodah Zarah 63b

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1neither with regard to the prohibitions concerning Sabbatical -Year produce, nor with regard to restrictions on the consumption of tithe, nor with regard to the prohibition against consumption of wine used for a libation. This is because whatever food or drink that they acquire, they acquire it of their own volition, and the employer does not bear responsibility for their actions.

2But if he said to them: Go and eat and I will reimburse you, or: Go and drink and I will reimburse you, he must be concerned with regard to the possibility that his workers will transgress a prohibition with the money, whether with regard to prohibitions concerning Sabbatical- Year produce, or with regard to restrictions on the consumption of tithe, or with regard to the prohibition against consuming wine used for a libation. This is because if they acquire forbidden food or drink, it is tantamount to his acquiring these items and giving them to the laborers.

3Rav Sheshet infers: Apparently, when he pays his laborers after some time has elapsed, it is considered as though he is paying money for forbidden items, even though the forbidden items no longer exist. Here too, when people borrow Sabbatical-Year produce with the intent of paying for it afterward, when one pays, he is paying for a forbidden purchase.

4Rav Ḥisda interpreted this baraita with regard to a storekeeper who regularly gives credit to the employer, so that the employer incurs the debt to him at the moment the storekeeper gives the food or drink to the laborers. This is because, since it is his custom to give him credit, it is considered as though the storekeeper acquires the dinar from him at that moment. Therefore, if the laborers bought from him Sabbatical-Year produce, it is considered as though the employer paid his laborers with Sabbatical-Year produce, which is prohibited. Therefore, this case is not comparable to the case of the Sages who borrowed Sabbatical-Year produce.

5The Gemara asks: But in the case of a storekeeper who does not give credit to the employer, what is the halakha ? Is it permitted for the employer to send his laborers to buy food, committing to reimburse them afterward? If so, rather than the tanna teaching that if the employer says: Go and eat with this dinar, or: Go and drink with this dinar, he does need to be concerned that they will buy forbidden food, let him distinguish and teach the distinction within the case itself where he says: Go and eat and I will reimburse you.

6The tanna could teach as follows: In what case is this statement said, i.e., that if the employer says: I will reimburse you, he cannot allow his laborer to buy forbidden food? It is stated with regard to the case of a storekeeper who regularly gives credit to the employer, such that the employer incurs the debt to him at the moment the storekeeper gives the food or drink to the laborers. But in the case of a storekeeper who does not give credit to the employer, it is permitted for the employer to instruct his laborers in this manner.

7And furthermore, there is another difficulty with this interpretation: In the case of a storekeeper who does not give credit to the employer, does he not incur the debt to him? But doesn’t Rava say that in the case of one who says to another: Give one hundred dinars to so-and-so and all of my property will be transferred to you, he acquires it by the halakha of a guarantor? Just as a guarantor for another person’s loan renders himself liable to pay for someone else’s debt, so too, the owner of the property renders himself liable to give the property in exchange for the one hundred dinars that the acquiring party gives that so-and-so. Here too, the employer renders himself liable to pay the storekeeper when the storekeeper gives food to his laborers at his request.

8Rather, Rava says: There is no difference whether the storekeeper gives him credit, and there is no difference whether he does not give him credit. Any commitment to pay causes a liability. But although he incurs a debt to him, since he does not designate specific coins as payment for his debt the employer’s conduct is not prohibited. Therefore, the Sages of the school of Rabbi Yannai acted in a permitted manner.

9The Gemara asks: But here, in the baraita , why does the employer need to be concerned with regard to the prohibitions concerning Sabbatical- Year produce? He does not designate specific money as payment for his debt here. Rav Pappa said: The baraita is referring to a case where the employer first paid the storekeeper a dinar for the food he would provide to the laborers, before they actually purchased food. Therefore, the employer is considered to have acquired forbidden items and paid his laborers’ wages with them.

10Rav Kahana said: I stated this halakha before Rav Zevid of Neharde’a. He said to me: If so, if the latter clause of the baraita is understood as referring to a case where the employer paid the storekeeper a dinar in advance, rather than teaching a case where the employer said to his laborers: Go and eat, go and drink, and I will reimburse you, the tanna should have taught a case where he said: Go and eat, go and drink, and I will calculate the amount that should be deducted from the dinar I gave him. Rav Kahana said to him: That is not difficult; teach the baraita as stating: Go, and I will calculate the amount that should be deducted from the dinar I gave him.

11Rav Ashi said: The baraita is referring to a case where the employer took the food and drink from the storekeeper and gave it to the laborers with his own hand. Rav Yeimar said to Rav Ashi: If that is so, rather than teaching that the employer said: Go and eat, go and drink, the tanna should have taught a case where he said: Take and eat, take and drink. Rav Ashi said to him: Teach the baraita as stating: Take and eat, take and drink.

12§ Rav Naḥman and Ulla and Avimi bar Pappi were sitting, and Rabbi Ḥiyya bar Ami, who was studying with them, was sitting among them, and they were sitting and a dilemma was raised before them: If one hired a person to break barrels of wine used for a libation so the wine will spill out, what is the halakha ? Do we say that since he has an interest in the preservation of the barrels until he breaks them, so that he can be paid for breaking them, his wage is forbidden, or perhaps should it be reasoned that any action that one performs to reduce impropriety [ tifela ] is permitted, even if he is paid for the actual breaking?

13Rav Naḥman said: He may break them, and let a blessing come upon him. The Gemara suggests: Let us say that a baraita supports his opinion: One may not hoe together with a gentile in a field that contains a forbidden mixture of diverse kinds,

    Rashi

Not because of Shevi‘it - Lest they take Shevi‘it produce from someone suspected of selling it. And it was taught in Sukkah (39a) One may not hand over the money of Shevi‘it produce to an am ha’aretz more than the value of three meals.

Nor because of ma‘aser (tithes) - For if they are amei ha’aretz and buy produce that is not tithed, it would turn out that this man causes them to eat untithed produce. But here he is not actually feeding them anything directly — he only gives them coins.

Nor because of yayin nesech (forbidden wine) - If they are gentiles, it would turn out he is causing them to drink yayin nesech, since he is responsible for their food, and thus he benefits from yayin nesech.

And I will pay - He himself is (effectively) the one purchasing the prohibition and feeding them. For now he has not withdrawn himself from it with the coins.

Who extends him credit - Who regularly extends him credit.

There is a lien on him - That employer: from the moment the shopkeeper gives produce [to the worker], it is as if he gave it directly into the workers’ hands.

[The shopkeeper] acquires the dinar that is with him [the employer] - The shopkeeper relies on this, as he is familiar with him [the employer]. that wherever the dinar is located, it is acquired by the shopkeeper, therefore it is a proper exchange. But those in the case of the household of R. Yannai, since the poor who lend them the produce are not shopkeepers who regularly extend them credit, they do not rely to the same extent [as the shopkeepers in getting repaid], and there is no real lien on the household of R. Yannai. Therefore when they repay at a later time [after prohibition] it is not considered an exchange of Shevi'it produce

If so - That the reason [it is forbidden] is the shopkeeper regularly gives him credit, but if he does not normally give credit it is permissible.

Why learn - In the first case, where the Tanna is looking for a case which is permitted, and only found the scenario of go out and eat with this dinar [that he hands to them] and thus removes himself with [handing over] these coins.

Let there be a [narrower] differentiation and learn - The permitted scenario, even when he has not removed himself [entirely], for example in the case of go and out and I will pay, and where the shopkeeper does not normally extend him credit and therefore there is no lien on the employer. And all the more so [it will be permitted] where he removes himself entirely

Further a shopkeeper who is not his credit-giver - If he gave [produce] to the householder’s messenger.

Does he not become obligated - to him [the shopkeeper]; the householder from that moment [of handing over the produce]. [And how is it] that you permitted the house of Rabbi Yannai based on this reasoning?

And Rava said - One who says to his fellow, “Give a maneh to so-and-so, and my property shall be acquired to you - With that maneh and he gave it.

He acquires it - The purchaser, the [donors] property, even though the benefit of that maneh did not reach him.

By the law of a guarantor - From that dinar {alternative text 'from that law'} that a guarantor becomes obligated to pay even though no benefit reached him. And here too it is the same. It follows, then, that even when it is not his regular shopkeeper, if he gave to his [the employer’s] messenger, the householder becomes obligated [from now].

Rather, Rava said - Do not teach that the reason of the baraita was “because of the lien” (shi’abuda), and only when it is his regular shopkeeper. For even when it is not his regular shopkeeper, a lien exists. However as for the house of R. Yannai there is no difficulty, as whether it was a regular shopkeeper or not.

Even though there is a lien - Assets to pay.

Since he did not designate a lien - He did not immediately designate money to him for this, it is not a proper exchange, and therefore the prohibition [of Shevi‘it does not transfer].

This is the correct version - 'And here Rav Pappa said' and we do not read 'Rather here the baraita says we are concerned says Rav Pappa'

When he advanced him - The employer a dinar to the shopkeeper before sending them [the workers] to him, that now they are eating directly from the employer’s money, and the prohibition is upon him.

And I will pay - He has already paid.

It should say and I will calculate - I will make a calculation from that which I have already given him.

That he handled - From the hands of the shopkeeper and gave to them, that now he is [directly] supplying them with the prohibited, and this is not because of the later payment, rather he acquires it with Meshicha (handling of the goods), and it transpires that he has taken possession of wine used for libation and given it to drink to his workers. But the house of R. Yannai when they take possession of the produce it is at a permitted time, and when they subsequently compensate at the time Shevi'it is forbidden it is no longer considered an exchange that effects a transfer [of the restrictions]

Go - Implies that he is not going with them (to the shop).

To break the yayin nesech - To break barrels, and to pour out the wine.

What is the law - That the wages are permitted?

Do we say since - That this Jew wants these barrels to remain intact, that the should not break by themselves, until he breaks them and takes payment it should be forbidden?

One may not hoe - May not dig
