    English translation — Avodah Zarah 3a

    1This serves to say that even if they fulfill the seven Noahide mitzvot they do not receive a reward for their fulfilment.

    2The Gemara asks: And are they not rewarded for fulfilling those mitzvot? But isn’t it taught in a baraita that Rabbi Meir would say: From where is it derived that even a gentile who engages in Torah study is considered like a High Priest? The verse states: “You shall therefore keep My statutes and My ordinances, which if a person do, and shall live by them” (Leviticus 18:5). It is not stated: Priests, Levites, and Israelites, but rather the general term “person.” From here you learn that even a gentile who engages in the study of Torah is like a High Priest. This demonstrates that gentiles are rewarded for fulfilling mitzvot, despite the fact that they are not commanded to do so.

    3Rather, the verse serves to tell you that they do not receive as great a reward for their fulfillment as one who is commanded and performs a mitzva. Rather, they receive a lesser reward, like that of one who is not commanded and still performs a mitzva. As Rabbi Ḥanina says: Greater is one who is commanded to do a mitzva and performs it than one who is not commanded and performs it.

    4The Gemara returns to the discussion between God and the nations of the world, whose claims are rejected with the rebuttal that they did not receive the Torah because they did not fulfill the seven Noahide mitzvot that were incumbent upon them. Rather, this is what the gentiles say before the Holy One, Blessed be He: Master of the Universe, as for the Jewish people who accepted the Torah, where is the evidence that they fulfilled its mitzvot?

    5The Holy One, Blessed be He, says to them in response: I will testify about the Jewish people that they fulfilled the Torah in its entirety. The nations say before Him: Master of the Universe, is there a father who can testify about his son? As it is written: “Israel is My son, My firstborn” (Exodus 4:22). Since God is considered the Father of the Jewish people, He is disqualified from testifying on their behalf. The Holy One, Blessed be He, said to them: Heaven and earth will testify about them that they fulfilled the Torah in its entirety.

    6The nations say before Him: Master of the Universe, in this matter the testimony of heaven and earth is tainted by a conflict of interest, as it is stated: “If My covenant be not with day and night, I would not have appointed the ordinances of heaven and earth” (Jeremiah 33:25). And concerning this verse, Rabbi Shimon ben Lakish says: What is the meaning of that which is written: “And there was evening and there was morning, the sixth day” (Genesis 1:31)? This teaches that the Holy One, Blessed be He, established a condition with the acts of Creation, and said: If the Jewish people accept My Torah at the revelation at Sinai, all is well, but if they do not accept it, I will return you to the primordial state of chaos and disorder.

    7And this is similar to that which Ḥizkiyya says with regard to a different matter: What is the meaning of that which is written: “You caused sentence to be heard from heaven; the earth feared, and was silent” (Psalms 76:9)? If the earth feared, why was it silent, and if it was silent, why did it fear? One who is afraid does not stay silent, and one who remains silent thereby demonstrates that he is not afraid. Rather, this is the meaning of the verse: At first, when God came to give the Torah to the Jewish people, the earth feared that they might not accept it, and it would be destroyed. This is alluded to by the phrase “You caused sentence to be heard.” But ultimately, when the Jews accepted the Torah, the earth was silent. Consequently, heaven and earth are interested parties and cannot testify about the Jewish people’s commitment to the Torah.

    8Instead, the Holy One, Blessed be He, says to the nations: Let the witnesses come from among you and testify that the Jewish people fulfilled the Torah in its entirety. Let Nimrod come and testify about Abraham that he did not engage in idol worship. Let Laban come and testify about Jacob that he is not suspect with regard to robbery (see Genesis 31:36–42). Let the wife of Potiphar come and testify about Joseph that he is not suspect with regard to the sin of adultery (see Genesis 39:7–12).

    9Let Nebuchadnezzar come and testify about Hananiah, Mishael, and Azariah that they did not prostrate themselves before a graven image. Let Darius come and testify about Daniel that he did not neglect his prayer (see Daniel 6). Let Bildad the Shuhite, and Zophar the Naamathite, and Eliphaz the Temanite, and Elihu, son of Barachel, the Buzite, friends of Job (see Job 2:11 and 32:2) come and testify about the Jewish people that they fulfilled the Torah in its entirety. As it is stated: “All the nations are gathered together… let them bring their witnesses, that they may be justified” (Isaiah 43:9), i.e., the gathered gentiles will submit testimony on behalf of the Jewish people and demonstrate the Jews’ righteousness.

    10The gentiles say before Him: Master of the Universe, give us the Torah afresh and we will perform its mitzvot. The Holy One, Blessed be He, says to them in response: Fools of the world! Do you think you can request this? One who takes pains on Shabbat eve will eat on Shabbat, but one who did not take pains on Shabbat eve, from where will he eat on Shabbat? The opportunity for performing mitzvot has already passed, and it is now too late to ask to perform them. But even so, I have an easy mitzva to fulfill, and its name is sukka ; go and perform it.

    11The Gemara asks: And how can you say so, that it is possible to perform a mitzva after the end of this world? But doesn’t Rabbi Yehoshua ben Levi say: What is the meaning of that which is written: “You shall therefore keep the commandment, and the statutes, and the ordinances, which I command you this day, to do them” (Deuteronomy 7:11)? This verse teaches that today, in this world, is the time to do them, but tomorrow, in the World-to-Come, is not the time to do them. Furthermore, today is the time to do them, but today is not the time to receive one’s reward, which is granted in the World-to-Come.

    12The Gemara explains: But even so, God gave the nations an opportunity to perform a mitzva, as The Holy One, Blessed be He, does not deal tyrannically [ beteruneya ] with His creations, but wants them to feel that they have been judged fairly. The Gemara asks: And why does God call the mitzva of sukka an easy mitzva to fulfill? Because performing the mitzva involves no monetary loss.

    13Immediately, each and every gentile will take materials and go and construct a sukka on top of his roof. And the Holy One, Blessed be He, will set upon them the heat [ makdir ] of the sun in the season of Tammuz, i.e., the summer, and each and every one who is sitting in his sukka will be unable to stand the heat, and he will kick his sukka and leave, as it is stated: “Let us break their bands asunder, and cast away their cords from us” (Psalms 2:3). The Gemara asks: Why does God heat the sun over them? But didn’t you say that the Holy One, Blessed be He, does not deal tyrannically with His creations? The Gemara answers: This is not considered dealing tyrannically with the gentiles, because for the Jewish people as well, there are times

    2ולא? והתניא: היה רבי מאיר אומר: מנין שאפילו עובד כוכבים ועוסק בתורה שהוא ככהן גדול? תלמוד לומר: (ויקרא יח, ה) ״אשר יעשה אותם האדם וחי בהם״, כהנים לוים וישראלים לא נאמר, אלא ״האדם״, הא למדת שאפילו עובד כוכבים ועוסק בתורה הרי הוא ככהן גדול.

    3אלא לומר לך, שאין מקבלין עליהם שכר כמצווה ועושה, אלא כמי שאינו מצווה ועושה, דאמר ר' חנינא: גדול המצווה ועושה יותר משאינו מצווה ועושה.

    4אלא כך אומרים העובדי כוכבים לפני הקב"ה רבש"ע ישראל שקיבלוה היכן קיימוה?

    5אמר להם הקב"ה אני מעיד בהם שקיימו את התורה כולה. אומרים לפניו: רבש"ע כלום יש אב שמעיד על בנו? דכתיב: ״(שמות ד״, כב) ״בני בכורי ישראל״. אמר להם הקב"ה שמים וארץ יעידו בהם שקיימו את התורה כולה.

    6אומרים לפניו: רבש"ע שמים וארץ נוגעין בעדותן, שנאמ' (ירמיהו לג, כה) ״אם לא בריתי יומם ולילה חוקות שמים וארץ לא שמתי״, (דאר"ש) [ואר"ש] בן לקיש: מאי דכתיב: ״(בראשית״, א, לא) ויהי ערב ויהי בקר יום הששי מלמד שהתנה הקב"ה עם מעשה בראשית ואמר אם ישראל מקבלין את תורתי מוטב ואם לאו אני אחזיר אתכם לתוהו ובוהו׃

    8אמר להם הקב"ה מכם יבאו ויעידו בהן בישראל שקיימו את התורה כולה יבא נמרוד ויעיד באברהם שלא עבד עבודת כוכבים יבא לבן ויעיד ביעקב שלא נחשד על הגזל תבא אשת פוטיפרע ותעיד ביוסף שלא נחשד על העבירה׃

    9יבא נבוכד נצר ויעיד בחנניה מישאל ועזריה שלא השתחוו לצלם יבא דריוש ויעיד בדניאל שלא ביטל את התפלה יבא בלדד השוחי וצופר הנעמתי ואליפז התימני ואליהו בן ברכאל הבוזי ויעידו בהם בישראל שקיימו את כל התורה כולה שנאמר ״(ישעיהו מג״, ט) יתנו עידיהם ויצדקו׃

    10אמרו לפניו רבש"ע תנה לנו מראש ונעשנה אמר להן הקב"ה שוטים שבעולם מי שטרח בערב שבת יאכל בשבת מי שלא טרח בערב שבת מהיכן יאכל בשבת אלא אף על פי כן מצוה קלה יש לי וסוכה שמה לכו ועשו אותה׃

    11ומי מצית אמרת: הכי והא אמר רבי יהושע בן לוי מאי דכתיב ״(דברים ז״, יא) אשר אנכי מצוך היום היום לעשותם ולא למחר לעשותם היום לעשותם ולא היום ליטול שכר׃

    12אלא שאין הקב"ה בא בטרוניא עם בריותיו! ואמאי קרי ליה מצוה קלה משום דלית ביה חסרון כיס׃

    13מיד כל אחד [ואחד] נוטל והולך ועושה סוכה בראש גגו והקדוש ברוך הוא מקדיר עליהם חמה בתקופת תמוז וכל אחד ואחד מבעט בסוכתו ויוצא שנאמר ״(תהלים ב״, ג) ננתקה את מוסרותימו ונשליכה ממנו עבותימו מקדיר והא אמרת אין הקדוש ברוך הוא בא בטרוניא עם בריותיו משום דישראל נמי זימני׃

    Kohanim (Priests) The Gemara implies that non-Jews are also called "Adam" (human)This is puzzling, as Bava Metzia 114b states that non-Jewish graves don't convey ritual impurity through ohel (overlapping structure), since the verse specifies "Adam." The verse "You are My sheep...you are Adam" (Ezekiel 34:31) implies this applies only to Jews. Rabeinu Tam differentiates between "Adam" and "ha'Adam." The verse about Hiram (Ezekiel 28:2), "You are (ben) Adam, not God," doesn't contradict this, as "Adam" there is derogatory, not honorific. The verse "When Adam rises against us" refers to a person, not a king (Megillah 11a), or perhaps to Edom, not Adam. Similarly, "What will Adam do to me?" refers to a lowly person. Regarding Gittin 47a, which states non-Jews can acquire land in Israel ("The land was given to the sons of Adam"), Rabeinu Tam explains this means descendants of the first Adam (see Bava Kamma 38a).

    She'Afilu (Even) This refers only to their observance of the seven Noahide laws. Studying other commandments would violate the prohibition against teaching Torah to idolaters (Sanhedrin 59a).

    Harei (Behold) The comparison to a High Priest is because the verse calls Torah "more precious than pearls." Horayos 13a derives from this that Torah surpasses even a High Priest entering the Holy of Holies. While a Torah scholar surpasses a High Priest, a non-Jew studying Torah is merely comparable to one.

    Gadol (Great) One commanded to perform a mitzvah is greater than one who does so voluntarily because they constantly struggle to overcome their inclinations and fulfil God's will.

    Nogim (Touching) The continued existence of heaven and earth doesn't prove their Torah observance, as a father (God) wouldn't testify against his son (Israel). Alternatively, their existence may be due to Israel's acceptance of the Torah.

    Yom (Day) If the Torah was given on the seventh of Sivan, what is the significance of the sixth day? Perhaps God didn't address them on the first day due to travel fatigue. Alternatively, the giving was intended for the sixth but Moshe added a day.

    They Did Not Bow to the Image Rabeinu Tam argues that Nebuchadnezzar's image wasn't an idol but a statue honouring the king. This explains the distinction between Abraham not worshipping idols and Chananyah, Mishael, and Azaryah not bowing to an "image." It also explains Ketubot 33b, which states they would have bowed under torture. Had it been true idolatry, they would have faced death like Rabbi Chanina ben Tradyon (Avodah Zarah 18a) and Rabbi Akiva (Berachos 61b). This also clarifies Pesachim 53b's question about their refusal to bow, as it wasn't true idolatry. Further support comes from Megilah 12a, which questions why Jews were punished for seemingly bowing; they only pretended, as true idolatry would have demanded martyrdom. The verse itself distinguishes: "To your God we will not bow, and to your image we will not prostrate ourselves."

    Today to do them, not tomorrow to do them This doesn't justify the people of Jericho's rushed Shema recitation (Pesachim 57a), which seemingly implied "today on your heart," but not tomorrow. In that context, "today" and "tomorrow" are taken literally. However, in Deuteronomy 7:11, "today to do them" refers to reward, as the verse discusses God repaying His enemies. The righteous are rewarded in the World to Come, not literally "tomorrow."

    לוֹמַר, שֶׁאַף עַל פִּי שֶׁמְּקַיְּימִין אוֹתָן אֵין מְקַבְּלִין עֲלֵיהֶם שָׂכָר יש להקשות איך יתיישב בזה לשון התניא דתני רב יוסף עמד והתירן להם? ועוד קשא דהא ודאי אין הקדוש ברוך הוא מקפח שכר בריה וקחזינן דיהיב שכר לאומות העולם בעולם הזה על דבר טוב שעושין? ונראה לי בס"ד דידוע כל המצות אף על פי שנעשים בדברים גשמיים הם פועלים ברוחניות למעלה יען שכל מצוה ומצוה יש לה שורש למעלה ברוחניות דהנגלה שלה הוא בגשמיות והסוד שלה ברוחניות וכמו שפירש מהר"ם אלשיך ז"ל בפסוק וְאֵלֶּה הַמִּשְׁפָּטִים אֲשֶׁר תָּשִׂים לִפְנֵיהֶם (שמות כא, א) שכל מצוה וכל דין שרשו פתוח אל מים העליונים וכל המקיים מצוה אחת ומשפט אחד מגיע ומאיר שרשו העליון וקונה לו פרקליט ומלאך אחד כי קיום המצות מעורר תוכיות המצות למעלה ומוריד שפע רוחני וקדוש וכו' עיין שם, ולכן אמרו רבותינו ז"ל (קידושין לט.) שכר מצות בהאי עלמא ליכא אלא הַיּוֹם לַעֲשׂוֹתָם (דברים ז, יא) ולמחר לקבל שכרם (עירובין כב.) וקאי זה על שכר של הפעולה שפעל ברוחניות ולכך צריך שיהיה השכר בעולם הרוחני לא בעולם הזה הגשמי אך ימצא בעולם הזה שכר מה בשביל פעולה הגשמית. והנה ידוע מה שפועלת המצוה ברוחניות למעלה אף על פי שהיא נעשית בדבר גשמי למטה היינו כי השם יתברך עשה קשר ודבוק במעשה הגשמיות של המצוה עם הרוחניות אשר למעלה וזה הקשר נעשה על ידי הדבור שיצא מפיו יתברך בעת שצוה על אותה המצוה ומאחר שצוה לבני נח בשבע מצות הנה דבורו יתברך שצוה בשבע מצות עושה קשר ודבקות במעשה הגשמיות של שבע מצות עם הרוחניות שלמעלה. ונמצא לפי זה גם בני נח היו פועלים במעשיהם ברוחניות למעלה ואז ממילא יש להם שכר בעולם הבא מצד זה, אמנם מאחר שהם נצטוו בשבע מצות ולא קימוה 'עמד והתירן להם' כלומר התיר הקשר והדבקות שהיה בין פעולה של דברים הנגלים ובין הרוחניות וממילא אין נעשה על ידי מעשיהם התחתונים פעולה ברוחניות כלל ונמצא אין לכם שכר בעולם הבא שהוא שכר רוחני ואמיתי ורק משום דאין הקדוש ברוך הוא מקפח שכר בריה נותן להם בעולם הזה שכר בשביל פעולה הנגלית שהיא בגשמיות ואין זה שכר אמיתי ולזה אמר רבינא שאין מקבלים עליהם שכר דהיינו שכר הרוחני האמיתי וזהו שאמר רב יוסף 'עמד והתירן להם' רצונו לומר שהיה קושר פועל הגשמי בפועל הרוחני התיר אותו ועל ידי כך אין עושים פועל רוחני וממילא אין להם שכר נצחי כי הטוב שעושים למטה הוא ריקן ואין בתוכו נשמה שהוא הרוחניות. וממילא נבין נמי דמה שאמר רבי מאיר ' שֶׁאֲפִלּוּ נָכְרִי שֶׁעוֹסֵק בַּתּוֹרָה הֲרֵי הוּא כְּכֹהֵן גָּדוֹל ' היינו בעולם הזה קאמר מפני שאין הקדוש ברוך הוא מקפח שכר בריה ונותן לו שכרו בעולם הזה להיות בערך כהן גדול ודייקי לה מדכתיב אֲשֶׁר יַעֲשֶׂה אֹתָם הָאָדָם וָחַי בָּהֶם (ויקרא יח, ה) דקאמר ' הָ אָדָם' בה"א כי אדם בלא ה"א הוא כינוי לישראל דוקא כמו שאמרו רבותינו ז"ל (בבא מציעא קיד:) על פסוק 'אָדָם אַתֶּם' (יחזקאל לד, לא) דאתם קרויים אדם ואין העכו"ם קרויים אדם אך קרויים 'הָאָדָם' כמו שכתבו התוספות ז"ל.

    אָמַר לָהֶם הַקָּדוֹשׁ בָּרוּךְ הוּא אֲנִי מֵעִיד בָּהֶם שֶׁקִּיְּימוּ אֶת הַתּוֹרָה כּוּלָּהּ. נראה לי בס"ד שבודאי ידע הקדוש ברוך הוא שהם ישיבו 'כְּלוּם יֵשׁ אָב מֵעִיד עַל בְּנוֹ' ולכן אמר להם ' אֲנִי מֵעִיד ' כדי שהם יהיו מודים בפיהם שישראל יש להם דין בנים דאז מהניא להו תשובה אפילו דאי אפשר שלא יחטאו ולא תתקיים בהם מאמר החכמה והנבואה שאמרו נֶּפֶשׁ הַחֹטֵאת הִיא תָמוּת (יחזקאל יח, ד) וְחַטָּאִים תְּרַדֵּף רָעָה (משלי יג, כא) וכיון דהם מודים שיש לישראל דין בנים נמצא הקטיגור נעשה סניגור הרי הם חשבו להשיב תשובה שהיא רעה לישראל ולא הרגישו שבתשובה זו יוצא טובה לישראל והעדות יש לה להתקיים מצד אחר. וגם מה שאמר להם ' יָבוֹאוּ שָׁמַיִם וְאָרֶץ וְיָעִידוּ ' גם כן ידע רחמנא שישיבו 'הֵם נוֹגְעִים בְּעֵדוֹת' ונמצא הם מודים שהשמים והארץ קיימים בשביל ישראל ואם כן לפי זה אין קנין בשמים וארץ אלא לישראל וכמו שנאמר באברהם אבינו ע"ה בָּרוּךְ אַבְרָם לְאֵל עֶלְיוֹן קֹנֵה שָׁמַיִם וָאָרֶץ (בראשית יד, יט) אבל הם העכו"ם אין להם חלק ונחלה בשמים ובארץ. גם עוד ממילא מובן דאף על פי שיעקב ועשו חלקו העולמות ועשו נטל עולם הזה יש לישראל זכות בכל עושר וטובת עולם הזה מדין מציל מזוטו של ים כיון דשמים וארץ קיימים רק בעבורם.

    רִבּוֹנוֹ שֶׁל עוֹלָם תְּנֶנָּה לָנוּ מֵרֹאשׁ וְנַעֲשֶׂנָּה (ישעיה מג, ט) נראה לי בס"ד הכונה כי אי אפשר לקיים כל המצות במעשה אך לישראל נתת להם חלק מראש דהיינו כח מעולם המחשבה שהיא בראש ועל ידי כך כל מצות שאין מקיימים במעשה נחשב להם המחשבה כמעשה ובזה יהיו שלימים בכל רמ"ח עשה וגם לנו 'תֵּן לָנוּ' כח מעולם המחשבה שהיא 'בְּרֹאשׁ' ואז 'נַעֲשֶׂנָּה' בשלימות כי מה שחסר במעשה נשלים במחשבה. והשיב להם 'שׁוֹטִים! מִי שֶׁטָּרַח בְּעֶרֶב שַׁבָּת יֹאכַל בְּשַׁבָּת' כן ישראל שהעמיסו על עצמם דבר קשה שהקדימו נעשה לנשמע אז זכו לתת להם חלק מעולם המחשבה שבזה נחשבת המחשבה למעשה אבל אתם מנין תזכו ליקח חלק במחשבה. ואף על פי כן אנסה אתכם במצוה לבדוק מחשבתכם במצוה אם היא לי לשמי או אם בעבור הרווחה דילכון ולפנים אתם מבקשים וניסה אותם בסוכה שאחר כך בעטו בה וברחו דנמצא אין להם חפץ ורצון לב במצוה ואם כן איך יהיה חשיבות למחשבתם שתועיל במקום מעשה. או יובן אומרם ' תְּנָה לָנוּ מֵרֹאשׁ וְנַעֲשֶׂנָּה ' רצו שיתן להם מצות תקיעת שופר שהיא מיוחדת לראש השנה בלבד והיא מצוה קלה מאד וזהו 'תנה לנו מראש'. או יובן כונתם על מצות תפלין של ראש דעליו נאמר וְרָאוּ כָּל עַמֵּי הָאָרֶץ כִּי שֵׁם הֳ' נִקְרָא עָלֶיךָ וְיָרְאוּ מִמֶּךָּ (דברים כח, י) ואמר רבי אליעזר אלו תפילין שבראש (ברכות ו.) נמצא יש להם מורא ממצוה לכן רצו שיתן להם כלי זין זה שהם יראים ממנו שיהיה בעזרם וזהו 'תנו לנו מראש' רצונו לומר ממצוה שבראש ואמר לו ליתן להם מצות סוכה שהיא ביום הראשון כי ראשון של סוכות קראו הכתוב ראש דכתיב וּלְקַחְתֶּם לָכֶם בַּיּוֹם הָרִאשׁוֹן פְּרִי עֵץ הָדָר (ויקרא כג, מ) והרי הוא כמו ראש השנה והיא מצוה קלה.

    מִיָּד כָּל אֶחָד וְאֶחָד עוֹשֶׂה סֻכָּתוֹ בְּרֹאשׁ גַּגּוֹ יש להקשות למאי אצטריך לפרש 'בְּרֹאשׁ גַּגּוֹ' לימא 'עוֹשֶׂה סֻכָּתוֹ' בסתם? ונראה לי בס"ד בא המאמר להודיע רעות לבם כי מעיקרא רצו לעשות הסוכה במקום שיהיה להם פיטור ממנה שהיה לעשותה בחצרותיהם שאין השמש והרוח שולט שם כל כך אך לבם רע שמואס לבם במצוה ולכך עשו אותה בראש הגג ששם שולט חום השמש ותוקף הרוחות כדי שימצאו להם מקום פטור לצאת מתוכה.
