    1But according to the one who says that a tereifa can give birth, what can be said? According to this opinion, a tereifa cannot be excluded by the phrase: “To keep seed alive.” The Gemara answers: The verse states with regard to the animals that were brought by Noah into the ark: “You shall bring into the ark, to keep them alive with you” (Genesis 6:19). The term “with you” indicates that the verse is stated with regard to animals that are similar to you, but not a tereifa . The Gemara asks: But perhaps Noah himself was a tereifa . If so, one cannot exclude a tereifa from the comparison of animals to Noah. The Gemara answers: It is written about Noah that he was “complete” (Genesis 6:9).

    2The Gemara challenges: But perhaps the verse means that his ways were complete, but it is not referring to Noah’s physical attributes. The Gemara explains: It is already written about him that he was “righteous” (Genesis 6:9), which means that his actions were perfect. Consequently, when the verse says that he was also complete, it must be referring to his body.

    3The Gemara challenges: But perhaps the verse means that Noah was complete in his manner, and he was righteous in his good deeds. Accordingly, the verse would not exclude the possibility that Noah himself was a tereifa . The Gemara explains: It cannot enter your mind that Noah himself was a tereifa , as, if it enters your mind that Noah was a tereifa , would the Merciful One have said to him: Bring in tereifot like you to the ark, but do not bring in whole and perfect animals?

    4The Gemara asks: And now that it has been established that one derives the disqualification of a tereifa from the term “with you,” why do I need the phrase “to keep seed alive”? The Gemara answers: If one could learn only from “with you,” I would say that Noah brought the animals to the ark only for the purpose of company, and therefore even an animal that is elderly and even one who is castrated can come into the ark, provided that it is not a tereifa . Therefore, the Merciful One writes: “To keep seed alive,” teaching that only animals that could bear offspring may be brought into the ark.

    5§ A dilemma was raised before the Sages: When the mishna teaches that it is prohibited to conduct business with gentiles on the three days before their festival, do the three days include them, i.e., the days preceding the festival and their festival itself, in which case the prohibition applies only to the festival and the two preceding days? Or perhaps it is referring to them without their festival, i.e., the prohibition applies to three full days before the festival.

    6The Gemara suggests a proof from a mishna (7b). Come and hear, as Rabbi Yishmael says: On the three days before the festivals of gentiles and the three days after them, these actions are prohibited. The Gemara analyzes this statement. If it enters your mind that the three days include them and their festival, this would mean that Rabbi Yishmael counts the day of their festival twice, as he counts it initially, as part of the first set of three days, and he also counts it at the end, along with the second set of three days. Clearly, the three days do not include the day of the festival itself.

    7The Gemara rejects this proof: It is possible that the festival is counted as one of the initial three days, i.e., the three days include them and their festival, and is not counted as part of the three days following the festival. But since Rabbi Yishmael taught that these actions are prohibited during the three days before them, he also used the same expression and taught that these actions are prohibited during the three days after them, although what he is actually teaching is that these actions are prohibited only during the two days after it.

    8The Gemara suggests: Come and hear a proof from that which Rav Taḥlifa bar Avdimi says that Shmuel says: According to the statement of Rabbi Yishmael, it is always prohibited to engage in business with Christians, as their festival takes place every Sunday. Since the three days preceding and following their festival are included in the prohibition, one cannot engage in business with them any day of the week. And if it enters your mind that the three days of the mishna include them and their festival, i.e., only the two days preceding and following the festival are included in the prohibition, then according to Rabbi Yishmael there are still Wednesday and Thursday, on which it is permitted to engage in business with Christians.

    9The Gemara clarifies: According to the opinion of Rabbi Yishmael, I have no dilemma, as it is clear that the three days mentioned in the mishna are them without their festival. When I raise the dilemma, it is according to the opinion of the Rabbis: What days are included in the prohibition according to their opinion?

    10Ravina says: Come and hear a proof from the continuation of the mishna (8a). And these are the festivals of gentiles: Kalenda, Saturnalia, and Kratesis. And Rav Ḥanin bar Rava says in explanation of that mishna: When do these festivals occur? Kalenda is held during the eight days after the winter solstice, and Saturnalia is held during the eight days before the winter solstice. And your mnemonic to remember which festival is which is that the festival that occurs after the solstice is mentioned first and the festival that takes place before it is mentioned later, as in the verse: “You have hemmed me in behind and before” (Psalms 139:5), where the word “before” appears after the term “behind.”

    11Ravina explains the proof: And if it enters your mind that the tanna of the mishna counts them and their festival, in this case there are ten days that are included in the prohibition: The eight days of the festival and the two days beforehand. Why, then, would the mishna say that the prohibition applies for only three days? If the three days do not include the festivals themselves, then this difficulty does not apply, as although in practice the prohibition lasts for eleven days, the mishna is not referring to the period of the festival. The Gemara responds: This proof is inconclusive, as the tanna counts all of the festival of Kalenda as one day.

    12Rav Ashi says: Come and hear a proof from the mishna, which specifies that the time that the actions are prohibited is: On the three days before the festivals of gentiles. And if it enters your mind that the mishna is referring to them and their festival, let it teach: At the time of the festivals of gentiles, it is prohibited to engage in business with them for three days. The wording of the mishna indicates that all three days are before the festival.

    13And if you would say: That which is taught in the mishna: Before the festivals of the gentiles, serves to exclude the days following their festivals, i.e., the tanna is clearly indicating that the prohibition applies before, rather than afterward, let the mishna teach: At the time of the festivals of gentiles, it is prohibited to engage in business with them for three days beforehand. Rather, conclude from the wording employed that when the mishna states: The three days before the festivals, it is referring to them without their festival. The Gemara affirms: Conclude from here that this is the case.

    14§ A dilemma was raised before the Sages: Is the reason for the prohibition against conducting business with gentiles in the days preceding their festivals because the gentile might profit, which will bring him joy, and he will subsequently give thanks to his idol on his festival? Or perhaps it is because this is a violation of the prohibition: “And you shall not put a stumbling block before the blind” (Leviticus 19:14), as one who sells an animal to a gentile thereby aids him in engaging in prohibited idol worship.

    15The Gemara explains: What is the practical difference between the two options? The practical difference is in a situation where the gentile already has an animal of his own. If you say that the reason for the prohibition is because he might profit, here too the Jew causes him to profit. But if you say that the reason for the prohibition is due to the prohibition: “You shall not put a stumbling block before the blind,” since the gentile has his own animal, the Jew is not helping him sin.

    16The Gemara challenges: And even if he already has his own animal, does not one who assists him transgress due to the command: “You shall not put a stumbling block before the blind”? But isn’t it taught in a baraita that Rabbi Natan said:

But how can a treifah be excluded if it can give birth and therefore live? Even those who say a treifah cannot give birth concede it can live. So how can "from all living creatures" exclude it? Perhaps the verse means entirely healthy and vigorous creatures, not sickly ones. A treifah, though living, is perpetually ill and deteriorating. Thus, it's excluded more readily than an animal missing a limb, which is otherwise healthy. Rashi offers a similar explanation later (51a).

    With you, those similar to you However, this doesn't exclude animals missing limbs or with blemishes, as only procreation is relevant. But how do we exclude a treifah if we accept they can reproduce? Perhaps "from all living creatures" is needed to exclude those missing a limb. "With you" alone might refer to those missing a limb, not a treifah, as the former is more repulsive. Many treifot are undetectable. The Gemara's earlier question (5b) about excluding treifot refers to "from all living," implying healthy, not treifah. An animal missing an ear is otherwise healthy.

    Perhaps Noah himself was a treifah Although Noah lived many years after, he might have been a treifah at the time, unknowingly bringing one aboard. This is unlikely, as the warning surely concerned only visible treifot. Perhaps the Gemara now follows the opinion that a treifah lives, consistent with the view that it can reproduce.

    Tamim (Unblemished) is written about it Why does Menachot 5b need "from the cattle" to exclude treifot? Why not derive it from "unblemished"? It's logical that "unblemished" excludes blemished animals, which are more offensive offerings than treifot. The verse about blemished offerings ("Offer it to your governor; will he be pleased with you?") highlights their unacceptability. Some treifot aren't readily apparent. Furthermore, the verse explicitly states a blemished animal isn't "unblemished": "It must be unblemished and without defect."

    Now that we have derived from "with you"… If a treifah doesn't give birth and is excluded by "that its offspring may live," why do we need "with you"? We can't dismiss it as standard phrasing, since Sanhedrin 36b derives from it. Perhaps we derive from "with you" that they should be secondary to you, as in Bava Metzia 62a ("Your brother shall live with you" prioritizes your life) and Bereishit Rabbah ("It will be for you and for them" makes them secondary).

    And if you say that they and their festivals are ten days If the Mishnah's three days exclude the festival itself, its brevity is understandable, as festivals can last one, two, or eight days. However, if the three days include the festival, how can the next Mishnah list Kalanda, implying a three-day prohibition, when it's actually ten (eight for Kalenda, plus two)? There must be at least two days between Kalenda and Saturnalia. Since the Gemara suggests the Mishnah should state ten days, there must be two non-festival days before Kalenda. This is logical, as Kalenda's eight days correspond to Adam's eight festivals, likely not instituted immediately after the solstice.

    But learn from this that they [three days] are without their [festival] days—learn from this Why doesn't the Mishnah itself clarify this? "Three days before their festivals" implies exclusion. If inclusive, it should say "two days." A "one day" formulation would have been unambiguous.

    כלומר מכלל ג' ימים הללו יום אידיהם (אלא) או דלמא הן בלא אידיהן. ת"ש ר' ישמעאל אומר ג' לפניהם וג' לאחריהם אסור. ואי ס"ד יום אידיהן עצמו מכלל הג' הוא. ר' ישמעאל חשיב ליה בכלל השלשה שלפני אידיהן. ועוד הדר חשיב ליה מכלל הג' שלאחר אידיהן תרתי זימני חשיב ליה. ופרקי' איידי דתנא ג' לפניהם תנא נמי ג' לאחריהן. ואע"פ שאינם ג' ימים לאחריהן אלא שני ימים בלבד. איני והאמר משמיה דשמואל יום א' לדברי ר' ישמעאל דאית ליה שלשה ימים לפניהן וג' לאחריהן לעולם אסור לישא וליתן עמהן. ואם תאמר ר' ישמעאל הן ואידיהן ג' סבירא ליה והא איכא רביעי וחמישי שמותר. פי' יום ראשון של שבוע לעולם יום אידן הוא וכשתחשוב לו ג' ימים הן ואידיהן אתה מתחיל מיום ששי ו' ז' ויום ראשון הרי ג' ואחריהן ב' וג' כי יום אידם חשוב מכלל הג' נשאר לו רביעי וחמישי שמותר לו לשאת ולתת עמהן. ולמה אמר לעולם אסור.

    ופרקינן אליבא דר' ישמעאל ודאי הן בלא אידיהן ולרבנן מאי. ופשיט רבינא מהא דתנן אלו אידיהן של עובדי כוכבים קלנדס וסטרנליא.

    ואמר רב חנן בר אבא קלנדס (ג') [ח'] ימים אחר התקופה וסטרנליא ח' ימים קודם התקופה פי' ואלו ח' ימים כולם אידם הוא.

    ואי ס"ד הן ואידיהן ג' בשלמא היכא דיום אידם יום אחד הוא משכחת לה שני ימים לפני אידם. ואידם הרי שלשה. אלא קלנדס שאידם ח' ימים וב' ימים לפניהם. י' ימים אסור לשאת ולתת עמהם. אמאי קא פסק ותני ג' אלא ודאי ג' ימים דתנן הן בלא אידיהן. ודחי' לא לעולם הן ואידיהן. ותנא דידן קלנדס כוליה חד יומא חשיב ליה. ואתא רב אשי ופשטה דג' ימים הן בלא אידיהן ואפי' לרבנן.

    ודילמא נח גופיה (טרפא) [טריפה] הוה קשיא לי והלא נח היה אחר המבול שלש מאות שנה וקימא לן דטרפה אינו חיה. ואם תאמר דהכי קאמר, נהח גופיה כי קאמא ליה רחמנא – "אתך" (בראשית ו, יט), לא ידע דאזהריה על טריפה, דאיהו לא ידע דדילמא טריפה הוה, לא היא, דאם כן מאי קא משני ליה – "תמים" כתיב ביה (שם, ט), דמי אמר ליה רחמנא שהוא תמים, והלא לא כתיב אלא – "כי אותך ראיתי צדיק לפני" (שם ז, א). ואם תאמר דאליבא דמאן דאמר טרפה חיה קא מקשה, לא היא, דאם כן הוה ליה למימר הא ניחא למאן דאמר טרפה אינה חיה אלא למאן דאמר טרפה חיה דילמא נח גופיה טרפה הוה, כדמקשי הניחא למאן דאמר טרפה אינה יולדת, ויש לומר דלא אמר טרפה אינה חיה אלא בבהמה ובעוף, אבל באדם איפשר דאית ביה טרפיות דהוא חי בהן, אף על פי שכנגדן אינו חי בבהמה.

    איבעיא [להו] אסור לשאת ולתת עמהם משום הרוחה הוא פירוש דוקא טעמא דלשאת ולתת עמהם קא מיבעיא לן, דדילמא במקח וממכר לא אזיל ומודה, אבל אידך דמתניתין בודאי איכא משום דאזיל ומודה, ולפורען ולהלוותן ולהשאילן ליכא משום לפני עור, אלא משום הרוחה ואזיל ומודה.

    ודילמא תמים בדרכיו וצדיק במעשיו פי׳ תמים לבריות להיות עניו ושפל רוח ורוחם נוחה הימנו וצדיק אצל הקב״ה וק״ל אם כן למה לא שבחו הכתוב אלא כצדיק וי״ל דהא אמרינן אומרין מקצת שבחו של אדם בפניו וכולו שלא בפניו אי נמי שאמר לו מה שהוא עיקר הטעם להצלתו.

    אליבא דרבי ישמעאל לא קא מבעיא לי פירוש דלדידיה אפשר שכשם שמרבה איסור לאחריהם מרבה לפניהם משום הרוחה היא או משום לפני עור פי׳ משום הרוחה נמי היא או משום לפני עור לחוד אבל ללפני עור לכ״ע חיישינן ואיסור תורה נמי הוא.

    כבר ביארנו במשנה ששלשה ימים לפני אידיהן פירושו בלא אידיהן ואפילו היו ימי האיד שלשה או ארבעה או עשרה כלם אסורים עם שלשה ימים שלפניהם:

    כל שהוא מותר לנו ואסור לאחר איסור הנכלל במנין שלנו מצד תורתנו כגון יין לנזיר אסור לנו ליתן לו כוס של יין לשתותו שהרי אנו עוברים בזה על לפני עור לא תתן מכשול ואין צריך לומר מה שאסור לנותן ולמקבל בשוה ואפילו לבן נח אסור להושיט לו אבר מן החי ואם עשה כן עבר משום לפני עור לא תתן מכשול וכן כל כיוצא בזה ממה שהוא מוזהר עליו בדברים האסורים לנו גם כן אבל חלב ונבלה וכיוצא בהן הואיל ואינם מוזהרים עליהם מוכרין להם אע"פ שאסורין לנו וכן מה שאסור להם מתורת נימוסיהם ואינו בכלל מצותינו מוכרין להם ובלבד בהודעה להם אבל לא בטעות כגון נבלה בחזקת שחוטה או דבר האסור להם בחזקת דבר המותר להן שהרי אסור לגנוב דעתן של בריות ואפילו דעתו של גוי:

    כל מה שנאסר לנו משום לפני עור לא תתן מכשול אם הוא רשאי ליקח מאותו דבר בזולתנו מותר לנו למכור לו שהרי אין המכשול בא בשלנו מעתה מותר לנו למכור דבר האסור לו אע"פ שהוא לוקחה לאכילה הואיל והוא מוצא לקנות בזולתנו ומ"מ אסור ליתן לו ואם הוא מוצא במזומן ובלא קנין אף נתינתו מותרת וכל שכן אם היה מאותו דבר בידו ואע"פ שמ"מ גורם לו להרבות באיסור אין בזו נתינת מכשול וכן כל כיוצא בזה ומ"מ ראוי להמנע מסרך מסייע ידי עוברי עבירה וכן מ"מ אם אינו מוצא אלא בטורח אסור להמציא לו בהזמנה:

    שמא מזו אתה דן למשנתנו שאם יש לגוי בהמה אף אנו רשאין למכרה לו שהרי יש לו מכשול זה בזולת זו שאנו מוכרין לו ואינו כן מפני שבזו אע"פ שדין נתינת מכשול בגוף ע"ז אין כאן יש כאן אסור אחר שמתוך שהוא מרויח בקנינו או שיש לו מן הדבר בריוח הולך ומודה ביום האיד לע"ז ויש אצלנו נתינת מכשול בהודאתו אע"פ שאין מכשול בגוף העבודה וכבר ביארנו במשנה שטעם הרוחה אינו נפקע אף במקום שיש בו עיקר האיסור וכל שנפקע עיקר טעם האיסור לאיזו סבה נשאר האיסור מטעם הרוחה ומה ששאל משום הרוחה אסור פירושו אף משום הרוחה כמו שביארנו במשנה ויש לקצת מפרשים בלבולים בסוגיית שאלה זו וכשתדקדק בדברינו אינך צריך להם כלל:
