    Kiddushin 7a

    Chapter 1 - HaIshah Nikneit

גם: קידושין דף ז׳ ע״א, פרק א׳ האשה נקנית

    English translation - Kiddushin 7a

Translation: William Davidson Edition - English. Read alongside the Aramaic below; numbers match the passages of the daf.

1and I will be betrothed to you by means of these one hundred dinars that you give to that individual, she is betrothed, as derived from the halakha of a guarantor. How so? With regard to a guarantor, is it not the case that he commits himself to repaying the debt even though he receives no benefit, as the money from the loan is given to the debtor? And with regard to this woman too, even though she receives no benefit, as the one hundred dinars are given to someone else, nevertheless she commits and transfers herself to the man who gives the money.

2The Gemara discusses a similar case: If a man gives one hundred dinars to a woman and says to her: Here are one hundred dinars for you, and with this money you become betrothed to so-and-so, she is betrothed, as derived from the halakha of emancipating a Canaanite slave. With regard to a Canaanite slave, is it not the case that he acquires himself and is freed when someone gives his master money to emancipate the slave, even though he loses nothing of his own? With regard to this man too, i.e., the third party, even though he loses nothing of his own, he acquires this woman by means of the other man’s payment.

3The Gemara discusses a similar case: A woman says to a man: Give one hundred dinars to so-and-so and I will be betrothed to him. If he gives the money, she is betrothed, as is derived from a combination of the halakha of both of these cases, that of a guarantor and a Canaanite slave. How so? With regard to a guarantor, is it not the case that he commits himself to repaying the debt even though he receives no benefit? With regard to this woman too, even though she receives no benefit, nevertheless she commits and transfers herself.

4This consideration alone is insufficient, as one could still ask: Are these cases comparable? In the case of a guarantor, the one who acquires the item in question, which in this case is the commitment of the guarantor, is the one who loses money when he gives the loan. By contrast, in the situation at hand, this man, the third party, acquires the woman and loses nothing of his own. Therefore, the Gemara comments: The emancipating of a Canaanite slave can prove it, as he does not lose his own money and nevertheless he acquires himself.

5This consideration alone is insufficient, as one could still ask: Are these cases comparable? There, with regard to a slave, the one who transfers ownership is the one who acquires it, as the master transfers ownership of the slave to the slave, and he himself acquires the money from the donor. Here, this woman transfers herself and she does not acquire anything. Rather, in this regard the case of a guarantor can prove it, as even though he receives no benefit from the creditor, nevertheless, he commits himself, just like the woman in this case. In this manner one can derive that the woman is betrothed in this case from a combination of those two halakhot .

6Rava raises a dilemma: If a woman said to a man: Here are one hundred dinars and I will be betrothed to you, what is the halakha ? Mar Zutra said in the name of Rav Pappa: She is betrothed. Rav Ashi said to Mar Zutra: If so, this is an example of a case in which property that serves as a guarantee is acquired with property that is not guaranteed. Land is property that serves as a guarantee, and, as derived by way of a verbal analogy, the same applies to people. Money is property that does not serve as a guarantee. Through his acquisition of the money, this man acquires the woman as well.

7Rav Ashi asks: But we learned the opposite in a mishna (26a): Property that does not serve as a guarantee can be acquired with property that serves as a guarantee through giving money, through giving a document, or through taking possession of them. By contrast, property that serves as a guarantee cannot be acquired by means of acquiring property that does not serve as a guarantee. Mar Zutra said to Rav Ashi: Do you maintain that she wants her acquisition to be performed by means of money, i.e., he will acquire her as well through monetary acquisition? Not so, as here we are dealing with an important man, as, due to the benefit she receives from the fact that he consents to accept a gift from her, she agrees to transfer herself to him.

8The Gemara reverts back to the earlier discussion with regard to the derivation from the cases of a guarantor and a Canaanite slave. It was also stated in the name of Rava: And similarly, with regard to monetary matters, one can conduct a valid acquisition in the modes derived from the cases of a guarantor and a Canaanite slave. The Gemara comments: And it is necessary to state this halakha with regard to both betrothal and monetary acquisitions.

9The Gemara elaborates: As, had he taught us only the case of betrothal, one would have said that this halakha applies specifically in that case, because a woman is amenable to be betrothed with any form of benefit, in accordance with the statement of Reish Lakish. As Reish Lakish said: There is a popular saying among women: It is better to sit as two bodies, i.e., be married, than to sit alone like a widow. A woman prefers any type of husband to being left alone. Consequently, she would be willing to commit herself to betrothal by any form of benefit. But with regard to monetary matters, one might say that these types of unusual acquisitions are not effective.

10And conversely, if he had taught us only that this is the halakha with regard to monetary matters, one might have said that it applies solely to a case of this kind, because a monetary claim can be waived. One can relinquish his claim to money that is in someone else’s possession without receiving anything in return. But with regard to betrothal, which does not entirely depend on the will and agreement of the woman, as she must actually receive her betrothal money, one might say that the halakhot of a guarantor and a Canaanite slave are not comparable to this case. Therefore, it is necessary to state that this is the halakha in both cases.

11§ Rava says that if a man says to a woman: Be betrothed to half of me, she is betrothed. But if he said to her: Half of you is betrothed to me, she is not betrothed. Abaye said to Rava: What is different between the two cases that if he says: Half of you is betrothed to me, she is not betrothed? Is it because the Merciful One states: “When a man takes a woman, and marries her” (Deuteronomy 24:1), indicating he must take “a woman,” and not half a woman? So too, the Merciful One states: “A man,” and not half a man.

12Rava said to Abaye: How can these cases be compared? There, a woman is not eligible for two men. If one attempts to betroth half a woman it means he wants to leave her other half for someone else. This is impossible, as a woman cannot be married to two men. But isn’t a man eligible to marry two women? And when he declares: Be betrothed to half of me, this is what he is saying to her: If I wish to marry another woman, I will marry another woman.

13Mar Zutra, son of Rav Mari, said to Ravina: But in a case where he says to her: Half of you is betrothed to me, let the betrothal spread through all of her, and she will be completely betrothed. Isn’t it taught in a baraita ( Tosefta , Temura 1:5) that if one says about an animal: The leg of this animal is a burnt-offering, all of it is a burnt-offering, as the sanctity of the leg spreads throughout the animal’s entire body?

14Mar Zutra adds: And even according to the one who says that it is not entirely a burnt-offering, that statement applies only where he consecrated the leg of the animal, which is not a matter upon which the animal’s life depends. It is possible for an animal to survive the removal of a leg. But if one consecrates a matter upon which the animal’s life depends, everyone agrees that all of it is a burnt-offering. Here too, as the woman cannot survive without half of her body, why doesn’t the betrothal spread throughout all of her?

15The Gemara rejects this opinion: Is it comparable? There, in the case of the animal, it involves a creature without intellectual capacity. Here, the issue depends on another mind, that of the woman herself. The woman must indicate that she wants the betrothal to be effective.

16This case is comparable only to that halakha which Rabbi Yoḥanan says: With regard to an animal that belongs to two partners, if one of them consecrated the half of it that belonged to him, and he goes back and acquires the other half from his partner and consecrates the other half, it is consecrated, despite the fact that it was consecrated on two separate occasions. But although it is consecrated, it may not be sacrificed, because when he first sanctified it the animal was not fit to be sacrificed. The consecration does not spread throughout the entire animal without the consent of the other partner. This flaw cannot be remedied and the animal is permanently disqualified from being sacrificed as an offering.

17But, as it is consecrated now, this is enough to render a non-sacred animal that is exchanged with it a substitute. If one exchanges this animal with another, non-consecrated, animal, the second animal becomes consecrated as well. And yet its substitution is like it, i.e., it too is consecrated but may not be sacrificed either.

18The Gemara comments: One can learn from the statement three halakhot .

    Rashi

And I will be betrothed to you - when he gives [the 100 dinars] to [the other man], he says "be betrothed to me" -- she is betrothed, even though she receives no benefit.

From the halakha of a guarantor - we can derive from that which we find in the Torah, that a guarantor becomes responsible to the lender.

Here are one hundred dinars for you, and you become betrothed to so-and-so - and he [acts as] his agent, except that he is betrothing her using his own [money].

She is betrothed - even though the money does not belong to the principal.

From the halakha of a Canaanite slave - as is stated in a mishna later on [Kiddushin 22b:6]: "And he can acquire himself by means of money given by others" -- that others can redeem him with their own money, and he acquires himself and goes out to freedom, even though [the slave] loses nothing at all of his own money.

And I will be betrothed to him - to the same so-and-so to whom you give the money on my behalf.

From the halakha of both of these - from both of these laws: we derive it from that of the guarantor and that of the Canaanite slave.

There, the one who transfers - the owner of the slave who transfers the slave into freedom is the one who acquires the money that he receives for the slave's redemption.

And I will be betrothed to you - and he accepts [the money] and says to her: "you are betrothed to me with this."

She is betrothed - as [the Gemara] goes on to explain below.

Property that serves as a guarantee - a person [in this case, the woman] is compared to land, as is written, "you may keep them as a possession." [Leviticus 25:46]

With property that is not guaranteed - that one who sells or gives land and movable property, and the other pulls the movable property, and the land is transferred to him through the pulling of the movable property.

But we learned the opposite - that it is necessary to acquire the land using one of the three methods by which land is acquired; namely: money, a document, or by taking possession. [Taking possession means] where he locked [the door of the property], or fenced it or breached [its fence even] a bit [Bava Batra 42a:9]. Then, the movable property is acquired by way of [the land].

We are dealing with an important man - who does not usually [deign to] receive gifts.

Due to the benefit etc - - that she would want to give a peruta to someone who would flatter [the important man] into accepting a gift from her.

And similarly, with regard to monetary matters - this [entire] discussion of Rava's, in which we derive [the law of] betrothal from the law of a guarantor and from the law of a Canaanite slave -- it is likewise applicable to the matter of monetary transactions. If one sold a field to another, and said to him, "give the money to so-and-so and my field is sold to you" -- it is [indeed] thereby acquired, from the law of a guarantor. [If he said:] "Here is 100 dinars, and your field shall be sold to so-and-so" -- that so-and-so acquires it, from the law of a slave. [If he said:] "Give 100 dinars to so-and-so, and my field shall be sold to him" -- he thereby acquires it, from the laws of both of them.

It is amenable to her - to be acquired with any [form of benefit], with an acquisition of any amount, and even the mere benefit of discretion.

Tan du - as two bodies, a husband and his wife, even if she only has the mere [benefit of being able] to instruct [the husband on the disposition of money].

Because it can be waived - since one is permitted to waive [his monetary claim].

There, it is an animal - and it belongs to him, and there is nothing preventing him from sanctifying it. Therefore his utterance has the power to spread [the sanctification across both halves of the animal]. But here, there is another mind as significant as his which can prevent the thing -- since if the woman does not want it, [the money] does not work to betroth her. Only half of her was persuaded, so his words do not effect her [betrothal].

This case is comparable only etc - - [this passage serves as] the conclusion of the [Gemara's] reply [rejecting the possibility that the betrothal can spread to both halves]. This case is comparable only to that of an animal belonging to two partners, where there likewise is another mind that can prevent [the sanctification from spreading]. There, we did not say that the animal is fully sanctified by [the actions of] one of them.

It may not be sacrificed - since at the initiation of its sanctification it was not fit to be sacrificed, since only half of it was sanctified. It must be sold and another animal sacrificed using its value.

    Tosafot

"If so, then it would be property that has capacity for mortgage [i.e. the wife, that is bought along with property that doesn't, i.e. the maneh, which doesn't work]!" Rashi's explanation: "Because humans are compared to land, as it is written, 'You will inherit them [Canaanite slaves] as an inheritance holding [a phrase normally applied to land]'. Problem: This verse is written about a slave, but a freeman is not compared [to land] except only in [the case of one who vowed to bring to the Temple by saying] "My own value is upon me", since [that person] is evaluated like a slave as we see in the first chapter of Sanhedrin (15b), and a slave [being similar to land] is anyway subject to a dispute in the first chapter of Baba Kama (12a) whether they are similar to land or moveable property! Solution: [Rav Ashi's objection] is not specifically [based on the fact that people] have capacity for mortgage, but even if they don't have capacity for mortgage, there is no case where moveables can be acquired "on the back of" moveables [unlike land, for which you can acquire all the moveables "on its back"], since [the idea of] "on its back" is not relevant for property that doesn't have capacity for mortgage. Alternative solution: This is what he meant to say: You're forced to say, if a wife is acquired "on the back of" moveables, a field could also be acquired "on the back of" moveables, for we derive the acquisition of money for a wife from the field [of Efron] from [the ג״ש of] "purchase" "purchase", and if a field can't be acquired [in this way], from where would you derive it for a wife!?

"Let the kiddushin spread through all of her! Is it not taught etc." Problem: Terumah 11b derives [the law in the case of] "This [animal's] leg is an olah" and "with regard to a vital organ" from a verse, as it is written, "Anything that he gives from it to God", but regarding a wife there are no verses written [to derive this information]. If this is so, how [can Mar Zutra] challenge "Aren't they not similar!?" Solution: It is because of this that Rashi was particular and explained that this "mekudeshet" that [the man] said to [his prospective wife] is the terminology of "sanctified property (hekdesh)" [and did not mean "betrothed"], and this is like at the beginning of this chapter [of Kiddushin] that [kiddushin is like hekdesh through analogy] "he forbade her to everyone else like hekdesh", that a man can make her like hekdesh. Therefore, it is possible that the ruling of this case could be like hekdesh [since this is what the man in the case actually said]. However, if he had said "engaged" or any of the other earlier formulae [for betrothing a woman, see Kiddushin 6a], then it would not have been possible [for Mar Zutra] to raise the challenge "Let the kiddushin spread through all of her".

"Even according to the one who said it is not all an olah". There in Temurah 11b it is explained that according to the one who said it is not all olah, what does he do with it? And it says that he sells it except for the value of the leg that was sanctified [and gives the money to the Temple] for the needs of [buying] olot. And it challenges: How can he be exempt from his olah [that he promised to bring by doing this]—this is a lacking olah [since the leg is excluded]! And it responds: This is like one who said "Behold this will be upon me as an olah however I find it" [i.e. including if it were missing a leg].

"He came back and bought [the other half]" - The reason [R. Yohanan's case] is specifically "He came back and bought it" and isn't "A cow owned by 2 partners, each of which made their half hekdesh", is because that, for that case, the line [later in R. Yohanan] "if he made an exchange then its exchange is the same" would not be relevant since partners can't make exchanges, as is said in Temurah 13a and in the first chapter of Zevahim 6a.
