    1However, if his wife miscarried he is not a nazirite, since his wife did not give birth to a live child. Rabbi Shimon says: Since it is possible that the fetus was viable, in which case his vow of naziriteship takes effect, he should say the following: If this fetus was viable in terms of its development but died due to other causes, I am hereby an obligatory nazirite in fulfillment of my vow; and if it was not viable, I am hereby a voluntary nazirite. He then proceeds to observe naziriteship.

    2If, subsequent to this, his wife gave birth again, he is a nazirite, since the unattributed opinion in the mishna holds that the condition of his vow has now been fulfilled. Rabbi Shimon says, following his earlier ruling: He must now accept upon himself an additional naziriteship and he should say: If the first fetus was viable then my naziriteship for the first child was obligatory, and this naziriteship is voluntary; and if the first child was not viable, then the naziriteship for the first one was voluntary and this naziriteship is obligatory.

    3GEMARA: With regard to the statement of the mishna that one who vowed to be a nazirite when a son is born to him is a nazirite when his son is born, the Gemara asks: What is the purpose of stating this ruling? Of course he is a nazirite. The Gemara answers: This halakha is stated due to the latter clause of that mishna, which states that if a daughter, a tumtum , or a hermaphrodite are born to him, he is not a nazirite. The Gemara questions this, too: Isn’t that obvious, since he specified a son? The Gemara answers: It is necessary lest you say he did not literally mean a son, but rather he meant to say: When I will be built up by means of any child, including the types listed. The mishna therefore teaches us that this is not the case.

    4The mishna also taught: And if he said: When I have a child, then even if he has a daughter, a tumtum , or a hermaphrodite, his vow takes effect. The Gemara asks: Isn’t it obvious that this is the case? The Gemara answers: It is necessary to state this lest you say that we require a child of the kind that is considered significant by people, and he meant to exclude these other types of children when he vowed. The mishna therefore teaches us that this is not so.

    5§ The mishna taught that if his wife miscarried he is not a nazirite, even though it may have been a viable child. The Gemara clarifies: According to whose opinion is this taught? The Gemara answers: It is the opinion of Rabbi Yehuda with regard to a heap of wheat. Rabbi Yehuda holds that if one vows to be a nazirite if a heap contains a certain amount of wheat and it is unclear whether or not his condition was fulfilled, the halakha is ruled leniently, and he is not a nazirite.

    6The mishna further taught that Rabbi Shimon says that the individual should say: If this fetus was viable in terms of its development but died due to other causes, I am hereby an obligatory nazirite in fulfillment of my vow; and if it was not viable, I am hereby a voluntary nazirite. The Gemara relates that Rabbi Abba inquired of Rav Huna: If one said: I am hereby a nazirite when I will have a son, and his wife miscarried, and he separated an offering for his naziriteship but did not sacrifice it, and his wife gave birth again to a son, what is the halakha with regard to the offering he separated?

    7The Gemara asks: In accordance with whose opinion did Rabbi Abba pose his question? If he asked it in accordance with the opinion of Rabbi Shimon, what dilemma is he raising? Didn’t Rabbi Shimon say: In a case of uncertainty with regard to naziriteship, the ruling is to be stringent? Here too, since the fetus might have been viable, he was required to separate the offerings after she miscarried, and he may not use those offerings for the naziriteship brought about by the later birth. Rather, one should say that the question was in accordance with the opinion of Rabbi Yehuda, who said that in a case of uncertainty with regard to naziriteship, the ruling is to be lenient. The question is as follows: What is the halakha in such a situation? Are the offerings already considered consecrated and need not be consecrated again, or are they not consecrated and therefore he must consecrate them a second time?

    8The Gemara asks: What difference is there? In any case, he is certainly obligated to observe naziriteship now, and he must separate the offerings. The Gemara answers: The question is referring to the issue of its shearing and its labor. If they are considered consecrated from the initial consecration, it is prohibited to shear their wool and use them for labor, like any other consecrated animal. But if they are not yet consecrated, it is permitted to use them. No answer was found for this question, and the Gemara concludes that the dilemma shall stand unresolved.

    9§ With regard to one who accepted naziriteship upon himself that would begin upon the birth of his son, the Sage ben Reḥumi inquired of Abaye: If one said: I am hereby a nazirite when I will have a son, and another heard him and said: And it is incumbent upon me, what is the halakha with regard to the second person? Is the implication of his statement a concurrence to the statement of the first one, which would mean that he too accepts naziriteship upon himself when the first has a son, or is the implication of his statement meant to be understood about himself, i.e., that he has vowed to be a nazirite when he has a son of his own?

    10The Gemara develops the question further: Even if you say that the phrase: And it is incumbent upon me, has the implication of meaning that it is to be understood about himself, what is the halakha if one said: I am hereby a nazirite when I will have a son, and another heard him and said: And I? What is the meaning of the second person’s statement? Is it to be understood that here too, he is speaking of himself, meaning: I shall be a nazirite when I will have a son of my own, or perhaps this is what he is saying: I love you as you love yourself; I would be as happy as you at the birth of your son, and I too will be a nazirite when you have a son.     GemaraWhat is the purpose of stating this - that when his son is born he is a nazirite?

    Lest you saythat which he said [when I will have a son] was not intended to mean literally a son; and when he said "a son" he meant "when I will be built up from her", similar to [the verse] "and that through her I too may have children" (Genesis 30:3), and if a daughter, a tumtum, or a hermaphrodite are born let him also be a nazirite. [Rather,] it comes to teach us that he does not [become a nazirite if a daughter, etc., are born].

    We require a child that is considered significant by peoplethat is, nothing but a son -- [therefore the mishna] teaches us that a daughter, a tumtum and a hermaphrodite are also called "child".

    Rabbi Yehudawho said earlier that uncertainty with regard to naziriteship is treated leniently, as is said in the first chapter (above, Nazir 8a:8) "I am hereby a nazirite on condition that this pile of grain contains one hundred kor, and he went [...] Rabbi Yehuda permits him, since in a case of uncertain naziriteship one is permitted to act leniently."

    And he separated an offering and his wife gave birth again, what is the halacha - is it [considered] consecrated or not?

    In accordance with whose [opinion]are you asking? If according to Rabbi Shimon, it is obvious that it is considered consecrated -- since didn't he say that in a case of uncertainty with regard to naziriteship the ruling is to be stringent? And [even] before his wife gave birth, he would also be considered a nazirite?

    Rather one should say that the question was in accordance with the opinion of Rabbi Yehuda, who said that in a case of uncertainty with regard to naziriteship the ruling is to be lenient. What is the halakha? - Do we say that since he separated [the offering] when she miscarried, and no naziriteship becomes incumbent upon him at all, it is not considered consecrated at all, and he must consecrate it a second time?

    What difference is therewhether it is considered consecrated or not? Because now she has given birth, and naziriteship has taken effect for him.

    The difference is regarding its shearing and its laborand this is what [Rabbi Abba] was asking: if you say that from the time he initially separated [the animal] -- when she miscarried -- it was consecrated, its shearing and its labor would be forbidden to him. But if you say that the naziriteship takes effect only when she gives birth a second time, its shearing and its labor would be permitted to him. What is the halakha? [The dilemma] shall stand [unresolved].

    And another heard him and saidAnd it is incumbent upon me, what is the halakha? [Does he refer] to the statement - of that man, and imply "and it is [also] incumbent upon me to become a nazirite when you will have a son"? Or perhaps he refers to himself, and he implies as follows: "and it is also incumbent upon me to become a nazirite when I will have a son".

    Or perhapshe refers to the other one's statement, and the implication is as if he said "and I love that very same son as much as you do, and I will be a nazirite when you will have a son". And as to the earlier clause, when [Ben Rehumi] asked [about the second person's statement using the formula] "ועלי – and it is incumbent upon me" -- why didn't he ask with this expression ["ואני – and I" too]? [The answer is,] that would not have been possible, because it is not accurate to say the expression "ועלי – and it is incumbent upon me" has the meaning "to love him as much as you do".

    And if you say that anything that he says to another in front of him - whether he said "and it is incumbent upon me" or whether he said "and I", the matter is embarrassing to him -- [that is,] to reply to him that "when I will have a son I will be a nazirite", because if it was his intention to accept naziriteship upon himself when he will have [his own] son, why would he take the vow of naziriteship in front of [the first man]? Let him take the vow of naziriteship privately. Rather, since he said this in front of him, it can be determined that he meant to say as follows: I, too, will be a nazirite when you will have a son.

    לר' יהודה בברייתא דאיתניא לעיל פ"ק (נזיר דף ח.) דקאמר נגנב אינו נזיר הוא דקאמר לעיל דנזיר דכרי דלא הוי נזיר כלל לר' יהודה אבל לא רצה לומר ר' יהודה דהפלאה הוא דאם כן אפילו היה הולד בן קיימא אינו נזיר כיון דבשעת הנדר לא היה הולד בעולם כנ"ל:

    והפילה אשתו והפריש קרבן פי' לנזירותו וילדה פירוש מאותו הריון עצמו ולד קיימא דהשתא יש הוכחה גדולה מדהאי בר קיימא הנפל [הוה] נמי בר קיימא וכלו לו חדשיו דטיפה היא נחלקת לשתים הילכך חלה קדושה על קרבן שהפריש כשהפילה ששוב לא הקדיש אותם הבהמות דאפילו לר' יהודה דאמר לא מחית איניש נפשיה לספיקא הכא דאיכא הוכחה גדולה קדוש הקרבן ליאסר בגיזה ובעבודה או דילמא כי ה"ג דאיכא הוכחה לר' יהודה דלא מחית איניש לספיקא לא חלה הקדושה על הקרבן כלל מכח הפרשה ראשונה דשמא מקצת הטיפה נקלטה מיד ומקצת הטיפה השניה לא נקלטה עד אחר שני ימים או ביום ג' וההוא נפל (כך מסיק הש"ס ואזיל דלר"י קמבעיא ליה דאי אליבא דר' שמעון הא אמר ספק נזירות להחמיר דבלא ילדה נמי הוי קדוש מספק והשתא נמי כי ילדה אינו אלא ספק אלא אליבא דר' יהודה דאי לא ילדה חולין הוא והשתא כי ילדה ליה מי הוי קדוש מספק וכדפי':

    ונפקא מינה לגיזתו ועבודתו [ולא] דלילקי אהאי משום דליכא כי הך סברא דולד אחרון משוי ליה בספק דאי מספקא ליה להש"ס דשמא לילקו בודאי מדשני בר קיימא הראשון אינו נפל א"כ לר' שמעון נמי מצי למיבעי למלקות דאי לא ילדה ליכא קדושה ודאית אלא הוי ספק לר' שמעון והשתא דילדה יקדש בודאי אלא ש"מ דלא משמע ליה להש"ס דלקי דקדושה ודאית אין בו כי נמי ילדה אפי' לר"ש. ע"כ הגה"ה):

    מי שאמר הריני נזיר לכשיהא לי ולד והפילה שנמצא הולד ספק אם בן קיימא אם לאו והפריש קרבנותיו לנזירותו והקדישם בחזקת שהוא בן קיימא להיותם מוכנים לכשישלים נזירותו וניכר בו שאינו בן קיימא ואחר כך ילדה מאותו עבור בעצמו ולד שהוא בר קיימא כגון שהיתה מעוברת תאומים והפילה אחד ואחר כך חזרה וילדה את השני בר קיימא הרי זה ספק אם קרבן זה צריך הפרישו ולהקדישו מתחלה אם לאו שמא הואיל ובשעת הפרשה לא היתה נזירות חלה עליו לדעת ר' יהודה שהלכה כמותו אף עכשו אין אותה הפרשה מועלת כלום וצריך להפרישו פעם אחרת לשם זה וכל שלא הקדישו פעם אחרת מותר בגיזה ועבודה או שמא הואיל ולשם אותה לידה הפרישו וכבר אירע שחל הנזירות באותו עבור בעצמו חלה עליו קדושה עכשו משעת הפרשה והלכך אסור בגיזה ועבודה מספק ואין לוקין עליה ומ"מ כל שהפריש ללידה זו והפילה וילדה מחמת עבור אחר אינו כלום ולר' שמעון חלה עליו ספק קדושה אף מחמת הנפל אלא שאין הלכה כמותו כמו שביארנו:

    מי שאמר הריני נזיר לכשיהא לי בן ושמע חברו ואמר ועלי או ואני או שאמר הראשון הריני נזיר לכשיהא לפלוני בן ושמע חברו ואמר ועלי או ואני הרי חבר זה המתפיס עצמו לראשון ספק לנו בדבורו שמא כונתו לומר כשיהא בן לראשון או לפלוני כלומר שאם אמר הראשון הריני נזיר לכשיהא לי בן כשחזר זה ואמר ועלי או ואני פירושו ועלי לקבל נזירות גם כן או שאני נזיר גם כן לכשיהא לך בן שעל דבורו של ראשון הוא נסמך ולא שנאמר שעל עצמו הוא חוזר לומר ועלי נזירות או ואני נזיר לכשיהא לי בן גם כן דכל באפיה דנודר ראשון כסיפא ליה מילתא שיהא הוא טורח כמוהו בפניו ועושה עצמו מתאנח לבנים או שמא אף הוא צריך לכך ועל עצמו הוא אומר כן וכן כשאומר הראשון הריני נזיר כשיהא לפלוני בן וזה אומר ואני והוא הדין אם אמר ועלי אף זה ספק שמא כונתו לומר על עצמו כשיהא לי בן שהרי עכשו לא כסיפא ליה מילתא שהרי לא בפני אותו פלוני הוא או שמא אף זה על דבורו של ראשון הוא נסמך כלומר אף אני אוהבו כמותך ומקבל עלי כן לכשיהא לו בן ונשארו כלם בספק וכתבו בה גדולי המפרשים שמונה נזירות בין לנזירות בנו של חברו בין לנזירות בנו של עצמו וגדולי המחברים פסקו בה דרכים אחרים שלא נתבררו לנו אלא שכבר הרגישו בהם גדולי המגיהים:

    חזרה וילדה אחר שקבל עליו נזירות והביא קרבן. הרי זה נזיר שמחמת הנפל לא חל עליו נזירות. ולר' שמעון צריך להתנות כבראשונה שמא הראשון היה בן קיימא:

    גמ' והפילה אשתו והפריש קרבן וחזרה וילדה. פירוש בו ביום. ומסיק דמבעיא ליה אליבא דר' יהודה דאמר דעל נפל לא הוי נזיר ואי לא חזרה וילדה פשיטא דלא הוי קדוש. אבל השתא דילדה בו ביום איכא הוכחא דהוי בן קיימא שאין אשה מתעברת וחוזרת ומתעברת וטיפה אחת נחלקה לשתים. או דילמא זה נגמרה צורתו לשבעה והראשון נגמרה צורתו לתשעה ולא כלו חדשיו ולא קדיש והגוזז ועובד בו פטור. אבל לר' שמעון כיון דממה נפשך חייב למנות נזירות ולהביא קרבן קדוש. ואף על גב דאי בעי לא מקבל עליה נזירות ויעמוד בספק זה לעולם ולא יביא קרבן נמצא שאין בהפרשה זו כלום. מכל מקום כיון שהפריש קרבן גילה בדעתו שרוצה לקבל עליו נזירות והוי כאומר הרי אלו בהמות קדושין לקרבן נזירות שאקבל עלי דמסתבר דקדשי. אי נמי כמו שחייב להיות נזיר מספק כמו כן חלה קדושה על הקרבן מספק ואסורין בגיזה ועבודה. הרא"ש ז"ל בפירושיו:

    אי אליבא דר' שמעון הא אמר ספק נזירות להחמיר ואפילו לא ילדה בן קיימא אחרי כן מייתו על הנפל. ואי משום שצריך לה להקדישו להיות נדבה מספק הכי נמי שנולד בן קיימא יצטרך לחזור ולהקדישן. הר' עזריאל ז"ל. אי אליבא דר' שמעון הא אמר ספק נזירות להחמיר. ואפילו לא ילדה אחרי כן בן קיימא מייתי לה על הנפל. ולא מיבעיא ליה לענין אבלות דפשיטא מספק לא יתאבל עליו ולא יהא צריך לפדותו:

    מאי קדוש או לא קדוש מי אמרינן כיון דבשעת הפרשה הויא ספק לידה ולא קדיש הכא נמי לא קדיש בתר הכי אף על גב דאכתי איתיה בשעת לידה גמורה. או דילמא סוף סוף כיון דהשתא ילדה בן מעליא קדיש. למאי נפקא מינה אי קדיש אי לא קדיש הא לא מתכפר בהאי לטעמיה דר' יהודה אלא באידך דמייתי כשחזרה וילדה. אלא קא מיבעיא ליה אי קדיש אי לא קדיש משום גיזתו ועבודתו אי שריא או לא.

    ואם תמצי לומר כל באנפיה כסיפא ליה חרפה היא לו לקבל עליו נזירות בשביל בן אחר אם לא על בן של ראשון. תוספי הרא"ש ז"ל:
