    English translation — Sotah 18b

    1nor as a widow waiting for my yavam to perform levirate marriage, since a woman at that stage is prohibited from engaging in sexual intercourse with any men, nor when married through levirate marriage to the yavam ; amen that I did not become defiled, and if I did become defiled, may all these curses come upon me.

    2Rabbi Meir says that “amen, amen” means: Amen that I did not become defiled in the past, amen that I will not become defiled in the future.

    3All agree that he may stipulate with her through this oath neither with regard to what she did before becoming betrothed to him, nor with regard to what she will do after she becomes divorced from him.

    4Similarly, if a husband divorced his wife, and while divorced she secluded herself with another man and became defiled, and afterward her husband took her back and remarried her, and he then warned her about a specific man, and she secluded herself, and she is now about to drink the water of the sota , he cannot stipulate with her that she take an oath that she did not become defiled during the period in which she was divorced. This is because her husband would become forbidden to her only if she had married another man after being divorced, not if she merely committed an act of promiscuity.

    5This is the principle: In every case where if she would engage in sexual intercourse with someone else she would not become forbidden to her husband due to this act, he may not stipulate with her that her oath include that act. The oath can include only cases in which she would be rendered forbidden to him.

    6GEMARA: Rav Hamnuna says: In the case of a widow awaiting her yavam who committed adultery, she becomes forbidden to her yavam . From where is this derived? It is from the fact that the mishna teaches: Nor as a widow waiting for my yavam to perform levirate marriage, nor when married through levirate marriage.

    7The Gemara explains: Granted, if you say that a woman awaiting levirate marriage who committed adultery is forbidden to the yavam , due to that reason a husband may stipulate with a sota that she take an oath that she did not commit adultery while she was awaiting levirate marriage with him. But if you say that such a woman does not become forbidden, how can a husband stipulate this with her? But didn’t we learn in the mishna that this is the principle: In every case where if she would engage in sexual intercourse with someone else she would not become forbidden to her husband due to this act, he may not stipulate with her that her oath include that act? Clearly she must become forbidden to the yavam if she commits adultery.

    8They say in the West, Eretz Yisrael: The halakha is not in accordance with the opinion of Rav Hamnuna. A woman awaiting levirate marriage who commits adultery does not become forbidden to the yavam .

    9The Gemara asks: But with regard to that which is taught in the mishna: Nor as a widow waiting for my yavam to perform levirate marriage, nor when married through levirate marriage, in accordance with whose opinion is this? It is in accordance with the opinion of Rabbi Akiva, who says: Betrothal does not take effect even for those who would be merely liable for violating ordinary prohibitions were they to be married. All agree that betrothal does not take effect for forbidden unions that carry the punishment of karet , e.g., unions between siblings. However, according to Rabbi Akiva, in matters of personal status an ordinary Torah prohibition is equivalent to prohibitions that carry the punishment of karet . And he therefore holds that just as a wife who commits adultery, rendering her liable to receive karet , is forbidden to her husband and must be divorced, so too, a widow awaiting her yavam who commits adultery, violating an ordinary Torah prohibition, is considered to be a woman forbidden to her yavam .

    10Rabbi Yirmeya raised a dilemma: If a man divorced his wife and then remarried her, and she then secluded herself and came to drink the water of a sota , what is the halakha as to whether a man in that situation may stipulate with her concerning their first marriage? May he compel her to include in her oath that she did not commit adultery then either? Similarly, may a yavam stipulate with his yevama concerning the marriage of his brother, requiring her to attest that she did not commit adultery prior to the brother’s death? What is the halakha ?

    11The Gemara proposes: Come and hear evidence from the conclusion of the mishna: This is the principle: In every case where if she would engage in sexual intercourse with someone else she would not become forbidden to her husband due to this act, he may not stipulate with her that her oath include that act. One may therefore infer that he may indeed stipulate with her concerning any case in which she would become forbidden. In both of the cases in question the woman would have become forbidden to her husband if she had been guilty. Therefore, the Gemara concludes: Indeed, conclude from the mishna that he is entitled to stipulate in these cases.

    12§ The mishna states: Rabbi Meir says that “amen, amen” means: Amen that I did not become defiled in the past, amen that I will not become defiled in the future. With regard to this it is taught in a baraita ( Tosefta 2:2): When Rabbi Meir said: Amen that I will not become defiled in the future, he did not mean to say that if God knows that she will become defiled in the future, the water that she drinks now evaluates whether she will be unfaithful and passes judgment on her from now. Rather, he meant that in the event that she becomes defiled in the future, the water that she drinks now will destabilize her and evaluate then whether she was unfaithful.

    13Rav Ashi raised a dilemma: What is the halakha as to whether a man may stipulate with his wife concerning a later marriage, in the event that he would divorce her and then remarry her? Do we say: Now, at least, if she remains faithful during this marriage, she is not forbidden to him? Or perhaps this includes a later marriage, as sometimes a man divorces his wife and remarries her, and if she then commits adultery she will become forbidden to him.

    14The Gemara answers: Come and hear evidence from the mishna: All agree that he may stipulate with her through this oath neither with regard to what she did before becoming betrothed to him, nor with regard to what she will do after she becomes divorced from him. And if while divorced she secluded herself with another man and became defiled, and afterward her husband took her back and remarried her, he may not stipulate with her with regard to the period in which she was divorced, since that act does not render her forbidden to him. The Gemara infers: But if he remarries her and she then becomes defiled, she would be forbidden to him. Therefore, he may indeed stipulate with her in advance with regard to this. The Gemara states: Indeed, conclude from the mishna that this is so.

    15§ The Sages taught: The verse states: “This is the law of jealousy” (Numbers 5:29), indicating that the same law is to be carried out in all cases of jealousy. This teaches that the woman drinks and repeats, i.e., she must drink a second time if she becomes a sota again.

    16The baraita continues: Rabbi Yehuda says: The word “this” in the verse is a restricting term, indicating that the woman does not drink and repeat. Rabbi Yehuda said: There was an incident in which Neḥunya the ditch digger testified before us in the name of his teachers that the woman drinks and repeats, and we accepted his testimony with regard to two men, but not with regard to one man. Even if she drinks the water of a sota while married to her first husband, she must drink again after violating a warning by her second husband. However, one husband cannot have his wife drink twice.

    17The baraita concludes: And the Rabbis say: The woman does not drink and repeat, whether with regard to one man or with regard to two men.

    18The Gemara asks: But according to the first tanna of the baraita as well, isn’t it written in the verse: “This,” restricting the number of times a woman must drink? And according to the Rabbis mentioned later in the baraita as well, isn’t it written: “The law of jealousy,” amplifying the number of times a woman must drink to include all cases of jealousy?

    19Rava said: Different halakhot apply to different cases: With regard to one husband who accused his wife twice about one paramour, everyone agrees that the woman does not drink and repeat, having been proven innocent once,

    Nor as a widow waiting for my yavam, nor when marriedand if she was his yevamah and he married her and warned her, and she secluded herself, he can extend an oath onto her that she was not defiled while she was a "shomeret yavam". A "shomeret yavam" is one who is anticipating and waiting for her yavam to marry her through levirate marriage. ["Shomeret" is] in the sense of "and his father kept the matter in mind" [Genesis 37:11] and "You would not keep watch over my sin" [Job 14:16].

    Amen that I did not become defiledthat is the acceptance of the oath; and if I did become defiled, let [the waters] come into me -- that is the acceptance of the curse, corresponding to the way that [the priest] administered the oath to her that was described earlier in the Gemara [Sotah 18a:12]: "I administer an oath to you that you were not defiled and that if you were defiled [all these curses] will come upon you". And this is the elaboration of [the clause] "amen on the oath; amen on the curse" that was stated in the beginning of the Mishna.

    Amen that I will not become defiledthat if she will become defiled after some time, the water will destabilize her after she becomes defiled, as is taught in the Baraita in the Gemara [Sotah 18b:12].

    Nor with regard to after she becomes divorced etc- and even according to Rabbi Meir, who says that he does stipulate with her on future events.

    And became defiledduring the period in which she was divorced, since she is only forbidden to return to [her original husband] if she was married [to someone else] by betrothal -- when it says "Then the first husband who divorced her shall not take her [into his household] to become his wife again" [Deuteronomy 24:4], it is referring to after betrothal and marriage, as it says "and becomes [the wife] of another man, then this latter man rejects her" [Deuteronomy 24:2-3].

    She becomes forbidden to her yavamjust as a woman who commits adultery while married to her husband becomes forbidden to her husband.

    From the fact that the mishna teaches "nor as a widow waiting for my yavam" - [from the fact that] he administers an oath to her regarding adultery that she may have committed while she was a widow awaiting her yavam.

    Granted, if you saythat if she committed adultery she is forbidden to him -- that is why he can stipulate through "extension [of an oath]" even regarding that adultery. But if you say that etc....

    Betrothal does not take effectfor a woman who is forbidden by negative mitzva [alone] to the one who betroths her. But the Rabbis argue, and say that it is only with those [forbidden unions] punishable by karet where the betrothal does not take effect; but with those forbidden by negative mitzva [alone], [the betrothal] does take effect. Therefore according to Rabbi Akiva, [unions] forbidden by serious negative mitzvot are equated to [unions] punishable by karet with respect to the additional prohibitions devolving thereof, [such as the ruling that] the offspring [of such unions] is a mamzer. Regarding becoming prohibited to her husband, too -- just when one has sexual intercourse with a married woman, which is punishable by karet, the woman becomes forbidden to her husband, so too when one has sexual intercourse with a widow waiting for her yavam, which is forbidden [by the negative mitzva] "the wife of the deceased shall not become that of another party, outside the family" [Deuteronomy 25:5] -- she will become forbidden to her yavam.

    Is considered to bewith respect to unions forbidden by a negative mitzva

    Concerning the marriage of his brother, what is the halakha[do we] extend [the oath to include] adultery while married to his brother? Because that which was taught in the mishna -- "when I was betrothed, married, a widow waiting for my yavam or married [through levirite marriage]" [Sotah 18a:13] -- was not referring to one woman whom the yavam would make drink and swear about [the period of] betrothal and marriage to [the husband's] brother, but rather was referring to individual cases: if it a husband who is making her drink, he can stipulate with her about [the time when she was] betrothed and married; if it is a yavam who married her who is making her drink, he can stipulate with her about [the time when she was] a widow waiting for her yavam and married [through levirite marriage].

    Therefore he may indeed stipulate with her concerning any case in which she would become forbidden - and she would have become forbidden to him forever on account of her committing adultery during the first period of marriage. The same applies to adultery committed during the period of her marriage to his brother, as is stated in the first chapter [Sotah 2a:3]: "And if her husband dies she performs ḥalitza and may not enter into levirate marriage"

    When Rabbi Meir saidAmen that I will not become defiled in the future, it did not - enter his mind that she would be evaluated [by the water] now on [events that might take place in] the future.

    Will destabilize herthey will return to her throat, like a person who chokes on a liquid appears to gargle. It is the term [expressed in the verse] "they raise a cry of anguish" [Isaiah 15:5].

    Concerning a later marriageaccording to Rabbi Meir who said that he may stipulate about the future, can he stipulate with her using "extension of an oath" that she will not defile herself, if he will divorce her and remarry her and defile herself?

    And afterward her husband took her backthe reason [he may not stipulate with her] is because she was defiled during the time she was divorced, which does not cause her to become forbidden to him. But he may indeed stipulate now [as to a case where] she was defiled after he took her back.

    The law of jealousyone law for all jealousies -- that for all [incidents] he may act with her according to this law.

    Rabbi Yehuda says [the word] "this"is a restrictor: this one, but not another one.

    With regard to two menif her husband who made her drink dies, and she was married to another man, and he warned her and she secluded herself -- we accepted Neḥunya's testimony that the second [husband] makes her drink, because Rabbi Yehuda interprets "this" as a restrictor -- that she does not drink and repeat on account of the first husband warning her again; and he interprets "law of" as an amplifier -- that she drinks a second time on account of her second husband. And because Rabbi Yehuda says that she drinks again on account of the second husband, it implies that the first tanna would hold that even the first husband can make her drink twice. Thus we will ask "but according to the first tanna, isn't it written "this"? What does [the first tanna] consider that to exclude?

    Nor as a widow waiting for my yavam, nor when married and if she was his yevamah and he married her and warned her, and she secluded herself, he can extend an oath onto her that she was not defiled while she was a "shomeret yavam". A "shomeret yavam" is one who is anticipating and waiting for her yavam to marry her through levirate marriage. ["Shomeret" is] in the sense of "and his father kept the matter in mind" [Genesis 37:11] and "You would not keep watch over my sin" [Job 14:16].

    Amen that I did not become defiled that is the acceptance of the oath; and if I did become defiled, let [the waters] come into me -- that is the acceptance of the curse, corresponding to the way that [the priest] administered the oath to her that was described earlier in the Gemara [Sotah 18a:12]: "I administer an oath to you that you were not defiled and that if you were defiled [all these curses] will come upon you". And this is the elaboration of [the clause] "amen on the oath; amen on the curse" that was stated in the beginning of the Mishna.

    Amen that I will not become defiled that if she will become defiled after some time, the water will destabilize her after she becomes defiled, as is taught in the Baraita in the Gemara [Sotah 18b:12].

    Nor with regard to after she becomes divorced etc - and even according to Rabbi Meir, who says that he does stipulate with her on future events.

    And became defiled during the period in which she was divorced, since she is only forbidden to return to [her original husband] if she was married [to someone else] by betrothal -- when it says "Then the first husband who divorced her shall not take her [into his household] to become his wife again" [Deuteronomy 24:4], it is referring to after betrothal and marriage, as it says "and becomes [the wife] of another man, then this latter man rejects her" [Deuteronomy 24:2-3].

    כבר ביארנו במשנה שמגלגל הוא עליה כל ביאה האוסרתה עליו מעתה אם גירשה והחזירה וקינא לה מגלגל הוא עליה אם זינתה בעוד שהיתה תחתיו בנשואין הראשונים וכן להבא מתנה עליה שאם יגרשנה ויחזירנה לא תזנה משיחזיר כמו שביארנו במשנה וכן בנשואי אחיו אם קנא ליבמתו לאחר שכנסה הכל כמו שביארנו במשנה:

    מי שקנא לאשתו ונסתרה ושתת וחזר וקנא לה באותו האיש בעצמו ונסתרה אינו משקה אותה על ידו פעם אחרת אלא שאסורה לו ותצא בלא כתובה אבל אם קנא לה באחר ונסתרה משקה אותה פעם שניה וכן כמה פעמים כל שהקנויים מיוחדים קנוי אחר לאיש אחר וכן אם גירשה זה שהשקה ונשאת לאחר ובעל שני קנא לה בזה שכבר קנא לה בעלה הראשון ושתת עליו ונסתרה הרי זה השני משקה אותה עליו וכן בעל שלישי ורביעי לא נאמר שאינה שותה ושונה אלא מקנוי של בעל אחד על בועל אחד הא קנוי של בעל אחד בשני בועלים או של שני אנשים בבועל אחד שותה ושונה ואין צריך לומר בקנוי של שני אנשים בשני בועלים ויראה מתלמוד שבפרק ראשון שיכול הוא לקנא לה מכמה אנשים כאחד ויראה לי משם דוקא שהזכיר את כלם בפרט הא אם אמר דרך כלל לא תסתתרי עם שום אדם אינו כלום שאם כן אף הוא אומר לה לא תכנסי לבית הכנסת:

    היה נוטל וכו' כבר ביארנו בפתיחת המסכתא על החלק השני שבה שענינו לבאר סדרי הנהגותיו עם הסוטה בעזרה ושזה החלק הוחל ביאורו בראשון בעניני הבאתה לפני הכהן במקדש ודרכי ההנהגות שהיו מתנהגים עמה בהם ונמשך ביאור זה החלק בפרק שני בענין נתינת העפר במים וכתיבת המגלה והשבעתו וקללתו וכן בענין הבאת מנחתה ובאו עכשו בפרק זה להשלים עניני זה החלק ועל זה הצד יחלקו עניני הפרק לחמשה חלקים הראשון להשלים עניני הבאת קרבנה השני לבאר על איזה צד יכולה להפקיע את עצמה מן השתיה אף בלא הודאה וכשיארע כן אחר הבאת המנחה וכתיבת המגלה היאך דנין בה ובמנחתה ובמגלתה השלישי לבאר פעולת המים ואם זכות יכול לעכב את פעולתה או לתלות הרביעי בביאור הסוטות שמנחותיהן נשרפות החמישי שלא מן הכונה אלא שעל ידי שאמר בחלק זה הרביעי שמנחת כהנת נאכלת ומנחת כהן נשרפת הזכיר על ידי גלגול הרבה דברים שדין האשה מתחלק בהם מדין האיש זהו שורש הפרק דרך כלל אלא שיבאו בו דברים שלא מן הכונה על ידי גלגול כענין סוגית התלמוד על הדרך שקדם:
