    1between these amora’im parallels the disagreement between Rabbi Yehuda ben Beteira and the Rabbis? As we learned in a mishna (27a): If one took an oath to refrain from performing a mitzva and he did not refrain, he is exempt from bringing an offering for an oath on an utterance. If one took an oath to perform a mitzva and he did not perform it, he is also exempt, though it would have been fitting to argue that he is liable to bring the offering, in accordance with the statement of Rabbi Yehuda ben Beteira. As Rabbi Yehuda ben Beteira said: What? If, with regard to an oath concerning an optional matter, for which one is not under oath from Mount Sinai, he is liable for breaking it, then with regard to an oath about a mitzva, for which he is under oath from Mount Sinai, is it not logical that he would be liable for it?

    2The Rabbis said to him: No, if you said that one is liable for breaking an oath concerning an optional action, where the Torah rendered one liable for a negative oath not to perform it like for a positive oath to perform it, shall you also say one is liable for breaking an oath concerning a mitzva, where the Torah did not render one liable for a negative oath like for a positive oath? If one takes an oath to refrain from performing a mitzva and he did not refrain, he is exempt.

    3The Gemara asks: Shall we say that Rav states his opinion in accordance with that of Rabbi Yehuda ben Beteira, who holds that one can be liable for an oath that cannot be inverted, and Shmuel states his opinion in accordance with that of the Rabbis, who hold that one can be liable only if the oath can be inverted?

    4The Gemara rejects this: Everyone, i.e., both Rav and Shmuel, agrees with regard to the opinion of Rabbi Yehuda ben Beteira that one is liable if he took an oath that so-and-so performed an action that he did not in fact perform. The Gemara explains: Now, given that Rabbi Yehuda ben Beteira does not require that it be possible to invert a negative oath to a positive oath, does he require that it be possible for an oath to refer to the future as well as to the past? Shmuel explained that the reason one is not liable for an oath that so-and-so threw a stone into the sea is that it cannot be inverted to address the future, in other words: So-and-so will throw a stone into the sea, as that is not under the oath taker’s control.

    5When they disagree it is with regard to the opinion of the Rabbis: Shmuel holds like the Rabbis, that one is exempt in the case of an oath that cannot be inverted. Accordingly, Shmuel ruled that one who takes an oath that so-and-so threw an item is exempt from bringing an offering if it is found that the statement was false. And Rav holds that the Rabbis do not deem one liable in the case of an oath that cannot be inverted from negative to positive or vice versa, as it is written explicitly: “Or if anyone take an oath clearly with his lips to do evil, or to do good” (Leviticus 5:4). But with regard to the requirement that it be possible to invert an oath referring to the future to refer to the past or vice versa, which is derived from an amplification of the meaning of the verses, the Rabbis deem one liable, as they do not accept the derivation.

    6Rav Hamnuna raises an objection to Shmuel’s opinion from a mishna (29b): If one said: I did not eat today, or: I did not don phylacteries today, and another said to him: I administer an oath to you that your statement is true, and the original speaker said: Amen, he is liable for breaking an oath on an utterance if his statement was false, as responding amen to an oath administered to oneself is equivalent to stating the oath explicitly. Granted, he is liable in the case where he said: I did not eat, since it also would have been possible for him to take an oath saying: I will not eat, but in the case where he said: I did not don phylacteries, would it have been possible for him to take an oath saying: I will not don phylacteries, and in doing so abrogate a positive mitzva?

    7He, Rav Hamnuna, raises the objection and he resolves it: The tanna teaches this mishna disjunctively, referring to two different cases. When he teaches that one is liable for taking the oath: I did not eat, it refers to one’s liability to bring an offering. When he teaches liability for the oath: I did not don phylacteries, it refers to one’s liability to receive lashes for taking a false oath. This liability does not require that it be possible to invert the oath to refer to the future.

    8Rava also raises an objection to Shmuel’s opinion from a mishna (see 29a): Which oath is an oath taken in vain? It is when one takes an oath to deny that which is known to people to be true, and, for example, says about a stone column that is in such and such a place that it is made of gold. And Ulla says that the phrase: Known to people, in the mishna is referring to when it is a fact that is known to three people. The Gemara explains the objection to Shmuel’s opinion: The reason he is liable for taking an oath in vain is due to the fact that his oath contradicted a fact known to three people. But if it is not known, he violates the prohibition of taking a false oath on an utterance. Given Shmuel’s opinion, why should he be liable? Isn’t it impossible to invert the oath to make it about the future, saying: That column will be of gold?

    9He raises the objection and he resolves it. When the fact is known to three people, the one who takes an oath denying it violates the prohibition of taking an oath in vain. If it is not known, then he violates the prohibition of taking a false oath, for which he receives lashes if he did so intentionally. Nevertheless, he is not liable to bring an offering for falsely taking an oath on an utterance, since this oath cannot be inverted to be about the future.

    10§ Abaye said: And Rav, who holds one liable for an oath on an utterance even if it cannot be inverted to refer to the future, concedes in a case where one says to another: On my oath I know testimony that is relevant to you, and it is found afterward that he did not know testimony that was relevant to him, that in that case he is exempt from bringing an offering for an oath on an utterance. The reason is that it is not in the category of an oath that could be inverted to the negative oath of: I do not know testimony that is relevant to you, as that oath would be an oath of testimony, rather than an oath on an utterance. The Torah states: “And if anyone sin, in that he hears the voice of adjuration, he being a witness, whether he has seen or known, if he do not utter it, then he shall bear his iniquity” (Leviticus 5:1). One is liable to bring an offering for an oath of testimony if he takes an oath falsely denying that he has knowledge of testimony in a monetary matter.

    11But if he takes an oath saying: I knew testimony that is relevant to you, or: I did not know testimony that is relevant to you, the halakha is subject to the dispute between Rav and Shmuel. Similarly, if he took an oath saying: I testified, or: I did not testify, whether or not he is liable to bring an offering for an oath on an utterance depends on the dispute between Rav and Shmuel. In these cases, the oaths cannot be inverted from the past to the future and are also not oaths of testimony, since they do not involve the refusal to testify.

    12The Gemara says: Granted, according to the opinion of Shmuel, who says that an oath about a matter that cannot be inverted to refer to the future is one for which one is not liable when it refers to the past, it is for that reason the Merciful One removed an oath of testimony, which cannot be inverted, from the category of an oath on an utterance and legislated it in a separate verse (see Leviticus 5:1). But according to the opinion of Rav, for what halakha did the Merciful One remove it from the category of an oath on an utterance and relate to it as a distinct category? Every oath of testimony is a case of an oath on an utterance and there is no need to relate to it as a special case.

    13The Sages said before Abaye: An oath of testimony is singled out, according to Rav, in order to render one who takes it falsely liable to bring two sliding-scale offerings for it, one for a false oath on an utterance and one for a false oath of testimony.

    14Abaye said to them: You cannot say that one who takes a false oath of testimony is liable to bring two offerings, as it is taught in a baraita with regard to the sliding-scale offering that is brought for both an oath of testimony and an oath on an utterance: The verse states: “And it shall be, when he shall be guilty in one of these things” (Leviticus 5:5). By inference, for one of the sins that render one liable to bring a sliding-scale offering you may deem him liable, but you may not deem him liable for two.

    15The Gemara asks: And if this is so, then according to Abaye’s understanding of the opinion of Rav, for what halakha did the Merciful One remove an oath of testimony from the category of an oath on an utterance and relate to it as a distinct category?

    16The Gemara answers: An oath of testimony is singled out, as it is taught in a baraita : For every other one of the prohibitions for which one is liable to bring a sliding-scale offering, it is stated in the verse: “And it is hidden from him” (see Leviticus 5:2–4), and here, with regard to the oath of testimony, the phrase: And it is hidden from him, is not stated. This serves to render one liable to bring an offering for taking a false oath of testimony intentionally like one who is liable for doing so unwittingly.

    17The Sages said to Abaye: Say that the oath of testimony was singled out for a different reason: When he takes a false oath of testimony intentionally he is liable to bring only one offering but when he does so unwittingly, he is liable to bring two, one for an oath of testimony and one for an oath on an utterance.

    18Abaye said to them in response: Is this not what they said in a baraita with regard to the verse about the sliding-scale offering: “When he shall be guilty in one of these things” (Leviticus 5:5)? By inference, for one of the sins that render one liable to bring a sliding-scale offering you may deem him liable, but you may not deem him liable for two? And since one does not bring an offering for an intentional false oath on an utterance, if the verse is referring to a case where he intentionally took a false oath of testimony, how could there be a case where one is liable to bring two offerings such that this case needs to be excluded? Consequently, the verse must be referring to a case where he took the oath unwittingly, and it teaches that nevertheless, one brings only one offering for each violation.

    19Rava said in response to the question posed by the Sages: There is no need to derive from a verse that one is liable to bring only one offering for a false oath of testimony. Since an oath of testimony is a matter that was included in a generalization, i.e., the general principle of an oath on an utterance, and it was singled out to teach a new matter with regard to it, you have only the new matter alone to consider. Since an oath of testimony is singled out in that it applies only to potential witnesses in the context of a court, a case of an oath of testimony ceases to be included under the rubric of an oath on an utterance.

    20The Gemara asks: Should one understand by inference that Abaye holds that in cases of an oath of testimony, the oath on an utterance still exists in principle? One does not bring two offerings because of the halakha derived from the verse, but if for some reason the oath of testimony does not take effect, one may still be liable for an oath on an utterance.

    21But didn’t Abaye say that Rav concedes that one is exempt from bringing an offering for an oath on an utterance in a case where one says to another: On my oath I know testimony that is relevant to you, and it was found that he did not know testimony that was relevant to him? In that case he is exempt from bringing an offering for an oath on utterance, since it is not an oath that could be inverted to the negative oath: I do not know testimony that is relevant to you, as that oath would be an oath of testimony rather than an oath on an utterance.

    22The Gemara answers: Abaye retracted that opinion. And if you wish, say instead that

    Of Rabbi Yehuda ben Beteirahe disagrees in the case of one who swears to perform a mitzva, an not in the case of one who swears not to perform a mitzva.

    Where [the Torah] did not render, etc- since the oath can be positive but cannot be negative.

    Shall we say that Rav is in accordance with Rabbi Yehuda ben Beteira - who does not require [that both] negative and positive [versions of the oath be possible in order to be liable] and would likewise not require [that both] past and future [versions of the oath be possible]?

    Everyone agrees with regard to the opinion of Rabbi Yehuda ben Beteirathat is to say, according to Shmuel it is certainly subject to a disagreement between tannaim, since Shmuel would not presume that, according to Rabbi Yehuda ben Beteira, we would exempt him.

    Now negative and positivesince it is written explicitly "to bad or good purpose" [Leviticus 5:4], which implies such cases as "I will eat" or "I will not eat", [and yet Rabbi Yehuda ben Beteira] does not require [that both be possible].

    To the future and to the pastwhich are not explicitly stated [in the verse], how much more so would [Rabbi Yehuda ben Beteira] not require [that both be possible].

    When they disagree it is with regard to the opinion of the Rabbis - that they disagree. Rav would state that even his opinion would be shared by the Rabbis; we would not then say that according to Rav this is subject to a disagreement among tannaim. (Anywhere this type of language ["when they disagree" vs. "shall we say that they disagree"] is used in the gemara, it means that this is its opinion.)

    Would "I will not don" have been possibleas an "oath on an utterance"? Is he not swearing to abrogate a [positive] mitzva?

    When it is known to three peoplethese three already knew that this column was made of stone -- that is an "oath in vain", because once thee people know it, it is [considered] well-known. We have the text: And Rav concedes [in a case] where one says: On my oath I know testimony that is relevant to you, and it is found that he did not know, he is exempt, since it is not in the category of: I do not know testimony [that is relevant] to you.

    And Rav concedes, etc- even though he does not require that [both] future and past [versions of the oath be possible], he does require that [both] positive and negative [versions of the oath be possible]. As for one who says "upon my oath, I know testimony [that is relevant] to you -- the positive version is possible, but the negative version is not possible. "I do not know for you" is not possible, because [one who swears falsely that] "I do not know testimony for you" is not held liable by the All-Merciful on account of an "oath on an utterance" outside the premises of the court, but is only liable on account of an "oath regarding testimony", which applies only in court and to one who is fit to testify.

    "I knew" or "I did not know" is subject to the disputeof Rav and Shmuel, since both the positive and negative [versions of the oath] are possible, but the future [version of the oath] is not possible, since it would be an oath to abrogate a mitzva.

    For that reason the Merciful One removed, etc- and legislated it explicitly [in a separate verse] and with regard to that particular [i.e., guilt] offering. If it had not been written explicitly, [liability] would not have been possible to infer from an "oath on an utterance", since the future [version of the oath regarding testimony] is not possible.

    But according to Rav, for what halakha did the Merciful One write it - and with regard to that particular offering? Is it not also in the category of an "oath on an utterance"?

    Twoif he is fit to testify, and denied [knowledge of the testimony] in court, he should be liable to two [offerings, one] on account of an "oath of testimony" and [another] on account of an "oath on an utterance".

    In oneon the same topic, it is written: "upon realizing guilt in any of these matters" [Leviticus 5:5]

    And according to Abaye, for what halakhaaccording to [Abaye's understanding of the opinion of] Rav.

    For everyfor all [prohibitions] where it is written that [one is liable to bring] a sliding-scale offering: an "oath on an utterance" and Impurity of the Temple and its Sanctified Items, it is written "And it is hidden".

    And hereregarding "oaths on testimony", it is not written "And it is hidden".

    Intentionallywhere [liability for a sacrifice] does not apply to an "oath on an utterance".

    He is liable for onedue to the [oath on] testimony.

    Unwittinglysince it is also possible to obligate him regarding the "oath on an utterance", he should be liable [to bring] two [offerings].

    Is this not what they saidto you, since the verse explicitly excludes him from being obligated [to bring] two [offerings]. You are compelled to say that the verse excludes him in [a case of] unwitting violation, because in an intentional case, would it have been possible [at all] for [him to be liable to bring] two?! Why would he have to be excluded [from an intentional case]? There is no liability for an "oath on an utterance" in intentional cases!

    We have the textAnd if intentionally, how could there be [a case] of two?

    Rava said, etc- that is to say, it is not necessary to exclude him [using the verse of] "in any" [Leviticus 5:5]. The use of "in any" to exclude liability for two is not meant for [ruling out two offerings for an oath on testimony, that is, for liability for both] an "oath on testimony" and an "oath on an utterance", but rather [to rule out two offerings] for a mere "oath on an utterance": [that is,] if he said "I swear not to eat" and he ate wheat bread, barley bread and spelt bread, he is only liable for one [offering]. But it is not necessary to rule out [two offerings for an "oath on testimony"], [one for] "an oath on testimony" and [a second for] an "oath on an utterance". This is because an "oath on testimony" would have been included in the category of "oaths on an utterance" but had been stated separately in order to give a ruling on a novel matter; [namely, that it applies only] with those who are fit to testify, and [that the oath take place] before the court. Therefore, only its novel aspects apply, so he is liable only due to its being an "oath on testimony" and not regarding [its belonging to the category of] "oaths on an utterance".

    By inference that Abayewho requires the verse [of "in any"] to exclude [liability for two offerings].

    The oath exists in principlethat is to say, [when one swears that] "I don't know any testimony for you" that there is still an aspect of an "oath on an utterance", but that the reason that one is not liable for two [offerings] is due to the exclusion? The practical difference would be in a case where it could still be said to be an "oath on an utterance" but not [technically] an "oath on testimony", such as with those who are disqualified from giving testimony, or [if the oath takes place] not before the court. [In those cases,] it would not be possible to exempt him using [the verse of] "in any", so would he then be liable [at least] due to its being an "oath on an utterance"?

    Of Rabbi Yehuda ben Beteira he disagrees in the case of one who swears to perform a mitzva, an not in the case of one who swears not to perform a mitzva.

    Where [the Torah] did not render, etc - since the oath can be positive but cannot be negative.

    Shall we say that Rav is in accordance with Rabbi Yehuda ben Beteira - who does not require [that both] negative and positive [versions of the oath be possible in order to be liable] and would likewise not require [that both] past and future [versions of the oath be possible]?

    Everyone agrees with regard to the opinion of Rabbi Yehuda ben Beteira that is to say, according to Shmuel it is certainly subject to a disagreement between tannaim, since Shmuel would not presume that, according to Rabbi Yehuda ben Beteira, we would exempt him.

    Now negative and positive since it is written explicitly "to bad or good purpose" [Leviticus 5:4], which implies such cases as "I will eat" or "I will not eat", [and yet Rabbi Yehuda ben Beteira] does not require [that both be possible].

    To the future and to the past which are not explicitly stated [in the verse], how much more so would [Rabbi Yehuda ben Beteira] not require [that both be possible].

    When they disagree it is with regard to the opinion of the Rabbis - that they disagree. Rav would state that even his opinion would be shared by the Rabbis; we would not then say that according to Rav this is subject to a disagreement among tannaim. (Anywhere this type of language ["when they disagree" vs. "shall we say that they disagree"] is used in the gemara, it means that this is its opinion.)

    Would "I will not don" have been possible as an "oath on an utterance"? Is he not swearing to abrogate a [positive] mitzva?

    והא ליתיה בלא אניח ואם תאמר והא משכחת לה בכולל ואומר שבועה שלא אניח שום דבר על ראשי, בזה ואי חלה עליו שבועה ואסור להניח תפילין בראשו, וכדמוכח מן הירושלמי שכתבתי (לעיל שבועות כד, א). איכא למי' דאיברא דהיכא שאמר שלא אניח שום דבר על ראשי דודאי אסור להניח תפילין על ראשו, אבל מכל מקום אם עבר והניח לא מחייב קרבן שבועה כיון דמושבע הוא להניח, וכיון שכן ליתא לענין שבועה בלאו והן, כ"כ הרמב"ן (שם), וזה הפירוש לדעת הרב ן' מיגש דסתם נמי מיקרי הן למפרש, אבל לרש"י ל"ק דלדידיה לא מיקרי לאו והן אי לא אמר שלא אניח [תפילין] בפירוש, כמ"ש לא הנחתי תפילין.

    כבר ביארנו כ' ב' שלא נאמ' שהנדרים חלים על דבר מצוה אלא בבטול מצות עשה אבל לא בקיום מצות עשה ולא בבטול מצות לא תעשה ולא בקיומה וכך היא רמוזה באחרון של מכות כמו שביארנו ואף בבטול מצות עשה דוקא בלשון איסור המצוה עליו אבל בלשון איסור עצמו עליה כופין אותו לעשותה כמו שביארנו:

    ממה שכתבנו למדת שבשלשה דברים שבועה חלוקה מנדר בדבר שאין בו ממש ובדבר מצוה ובהתפשה ויש לך רביעית לענין זה והיא שהשבועה אינה חלה על שבועה והנדר חל על נדר ר"ל שאם אמ' הרי עלי קרבן אם אוכל ככר זה הרי עלי קרבן אם אוכלנו ואכלה חייב על כל אחת ואחת כך כתבוה גדולי המחברים אלא שבשני של נדרים י"ז א' נשנית בדרך אחרת כמו שיתבאר שם:

    כבר ביארנו שכל הנשבע על מה שאי אפשר לקיימו לוקה משום שבועת שוא מעתה מי שנשבע שלא אישן שלשה ימים מלקין אותו וישן לכשירצה שהדבר ידוע שאי אפשר לשלשה ימים בלא שינה וכן במה שאפשר לו לעמוד אלא שאם יעמוד הוא מסתכן בו כך הוא הדין ומעתה אם אמ' שבועה שלא אוכל כל שבעה ימים אין אומרין יתעכב עד שלא יהא בו כח לסבול עוד אלא מלקין אותו ויאכל לכשירצה וכן כל כיוצא בזה:

    כל מי שנשבע על אחרי' שיעשו דבר זה או שלא יעשוהו בדבר שאין מעשה זה שהוא מזכיר עליהם תלוי בו כלל כגון שיזרוק פלני צרור לים או שלא יזרוק שיעשה דבר פלני או שלא יעשהו אפי' היו בניו ובני ביתו שהם כפופים לו לקיים את דברו אין כאן שבועה כלל שאין בידו לא לקיים ולא לבטל ומ"מ אין כאן שבועת שוא שאין כאן התראה שהרי אפשר לאותן אחרים שיעשו וכן כתבוה גדולי המחברים ואע"פ שביארנו ג' ב' שהתראת ספק שמה התראה יראה לי בזו הואיל וההתראה תלויה בפעולת אחרים ולא בפעולת עצמו אינה התראה אלא שמכין אותו מכת מרדות ואף אותם אחרים אין מזקיקין אותם לקיים שבועתו של זה אא"כ ענו אמן אחר שבועתו אלא שאם קיימוה הרי אלו משובחי' על שלא גרמו לשבועת שוא ומ"מ אם נשבע במה שעבר כגון שזרק פלוני צרור לים או שלא זרק נחלקו בו רב ושמואל שלדעת שמואל לא נתחייב בו בשבועת בטוי לקרבן אלא שהוא בכלל שוא או בכלל שקר למלקות במזיד ולדעת רב חייב בשבועת בטוי הואיל וישנו בלאו והן אע"פ שאינו בלהבא והלכה כדבריו הא כל שאינו בלאו והן אינו לא בקרבן ולא במלקות ויש חולקי' במלקות מפני שהם עושין לאו והן לרב כשעבר ולהבא לשמואל ומ"מ בנדרים פרק אלו מותרין י"ז א' אמרו בהדיא שהנשבע לבטל את המצוה פטור מן הבטוי הן לקרבן הן למלקות וכן נראה באחרון של מכות כ"ב א' וכן לקיים את המצוה והרי בקיום מצוה במשנתנו מפני שלא עשה בה לאו כהן וא"כ כל לאו והן במשמע אלא שהם חולקין לומר לאו והן של רשות שאני ולענין לשעבר ולהבא אף בלהבא אם נשבע במעשה אחרים במה שהוא תלוי בו או שראוי להתלות בו כגון שבועה שלא יכנס שמעון בביתי או שלא יאכל בסעודתי אע"פ שלא הדירו ובא הלה ונכנס ואכל מדעתו חייב בשבועה ואם שלא מדעתו הרי הוא אנוס ונקרא שמעון עובר על דבר האסור לו:

    כל מיני השבועות חייבין בין בנשבע מפי עצמו בין במושבע מפי אחרים והוא מקבלה כגון שאמ' אמן או הן או מקבל אני שבועה זו וכל כיוצא בזה כמו שיתבאר כ"ט ב' מעתה מי שאמר לא אכלתי היום ולא הנחתי תפלין היום משביעכני ואמר אמן חייב בין לקרבן במקום הראוי לו ר"ל בשוגג בין למלקות במקום הראוי לו ר"ל במזיד ואע"פ שבהנחת תפלין אינו בלהבא ר"ל בלא אניח הואיל וישנו בלאו והן חייב:

    זה שביארנו בשבועת שוא שאחד מחלקיו הוא נשבע לשנות את הידוע פירושו בדבר המפורסם וידוע לכל ושמא תאמר אף לפתיים ולבהמות אינו כן אלא כל שנכר לשלשה בני אדם מן ההמון שהוא כן בלא צד חקירה אלא בידיעה מוחלטת עובר עליה משום שבועת שוא הא אם לא נודע אלא למבין ומצד חקירה או קבלה אע"פ שנכר לכמה דינה כשבועת בטוי:

    בפרש"י בד"ה ידעתי ולא כו' וליתיה בלהבא דנשבע לבטל את המצוה הוא עכ"ל לכאורה בהעדתי ולא העדתי ניחא דאעיד ולא אעיד בלהבא הוי לבטל מצוה אבל בידעתי ולא ידעתי דהיינו אדע ולא אדע ליתיה כלל בלהבא ויש ליישב דודאי בנשבע שלא יהיה יודע לו עדות ליתיה בלהבא דאין זה בידו כדפריך בשלמא לשמואל כו' וכמ"ש הר"ן אבל לא אדע אפשר לפרש דדבר שאני יודע לך עתה לא אדע לך ולא אגיד לך והיינו לבטל את המצוה ודו"ק:

    בד"ה רבא אמר כו' כלומר לא צריך למעוטי מלאחת וכי כו' עכ"ל הוה מצי לפרש דרבא קאי נמי אהא דפריך מעיקרא אלא לרב למאי הלכתא אפקיה כו' קאמר רבא דלהכי אפקיה דהוי דבר שהיה בכלל ויצא כו' אין לך בו אלא חדושו בלבד דהיינו בראוין להעיד בב"ד ואי לאו דאפקיה הוה חייב נמי משום שבועת ביטוי בפסולי עדות ושלא בב"ד וקושטא דמלתא פרש"י דלרבא לא צריך למעוטי שבועות ביטוי מלאחת וכי אתא כו' ושוב ראיתי בפי' בעל המאור שהוא פי' כן הא דקאמר מכלל דאביי סבר איתא לשבועה כו' דהיינו מדלא קאמר אביי לעיל דלהכי אפקיה לידון בדבר החדש ואין לך בו כו' וע"ש באורך לדחות פירוש הרי"ף בזה ועיין בספר מלחמות ליישב דברי הרי"ף שהוא מסכים לפירוש רש"י ועיין ע"ז בר"ן וק"ל:

    תוס' בד"ה ואמר עולא כו' אם לא ראיתי נחש כו' הא אפשר להיות חייב כו' אע"ג דליתיה באראה כו' עכ"ל ומרישא בגמל הפורח באויר לא קשיא להו כהאי גוונא דודאי אי הוה אפשר היה חייב משום דהוה נמי איתיה באראה דגמל שכיח בישוב אבל נחש כקורת כו' אי נמי דהוה אפשר ליתיה באראה שאינו דבר המצוי בישוב (ועוד) [וע"ז] תירצו דאפשר שיטרח כו' וק"ל:

    בד"ה אחת אתה מחייבו כו' שלא אוכל פת חטין ושעורין וכוסמין כו' עכ"ל אין זה מדוקדק דבת"כ איתא פת אכל חדא אבל בכה"ג דאמר חד פת אכולן לא הוה חייב על כל אחד ואחד כדאמרי' בהדיא לעיל ודלמא פת חטין לאכול שעורין וכוסמין לכוס אבל בשאמר פת בכ"א חייב דפת ופת ל"ל ש"מ לחלק וצ"ל שהתוס' קצרו בדברי הת"כ וק"ל:

    בא"ד ושמואל דריש כולה לדרשא דת"כ עכ"ל ר"ל דבין הריבוי ובין המיעוט דדריש להך דרשא דת"כ דהיינו הריבוי דחייב על כל אחת באומר פת חטין ופת שעורין ופת כוסמין והמיעוט דאינו חייב אלא אחת כדתניא בברייתא היינו כשאומר לא אוכל סתם ואכל פת חטין ושעורין וכוסמין דאינו חייב אלא אחת דההיא נמי איתא בת"כ וכפרש"י לקמן לרבא דמיעוטא דאחת ולא שתים דתניא בברייתא מוקי ליה בהכי וע"כ שמואל נמי מוקי ברייתא בהכי מיהו קשה לכאורה את"כ גופיה ה"ל לתוס' לאקשויי מעיקרא דדריש מאחת לחייב על כל אחת ואחת ושוב דריש שם מאחת ולא שתים ושוב ראיתי בת"כ דהך דאחת ולא שתים אינו מפורש שם דדריש ליה מאחת אלא מאשר חטא ולכך הקשו אברייתא דהכא דדריש ליה מלאחת ודו"ק:
