    1. 1“In view of all this, we make this pledge and put it in writing; and on the sealed copy [are subscribed] our officials, our Levites, and our priests.
    2. 2“On the sealed copy [are subscribed]: Nehemiah the Tirshatha son of Hacaliah and Zedekiah,
    3. 3Seraiah, Azariah, Jeremiah,
    4. 4Pashhur, Amariah, Malchijah,
    5. 5Hattush, Shebaniah, Malluch,

    29. 29“And the rest of the people, the priests, the Levites, the gatekeepers, the singers, the temple servants, and all who separated themselves from the peoples of the lands to [follow] the Teaching of God, their wives, sons and daughters, all who know enough to understand,
    30. 30join with their noble brothers, and take an oath with sanctions to follow the Teaching of God, given through Moses the servant of God, and to observe carefully all the commandments, rules, and laws of G OD our Sovereign.
    31. 31“Namely: We will not give our daughters in marriage to the peoples of the land, or take their daughters for our sons.
    32. 32“The peoples of the land who bring their wares and all sorts of foodstuff for sale on the sabbath day—we will not buy from them on the sabbath or a holy day. “We will forgo [the produce of] the seventh year, and every outstanding debt.
    33. 33“We have laid upon ourselves obligations: To charge ourselves one-third of a shekel yearly for the service of the House of our God—
    34. 34for the rows of bread, for the regular grain offering and for the regular burnt offering, [for those of the] sabbaths, new moons, festivals, for consecrations, for purgation offerings to atone for Israel, and for all the work in the House of our God.
    35. 35“We have cast lots [among] the priests, the Levites, and the people, to bring the wood offering to the House of our God by clans annually at set times in order to provide fuel for the altar of the E TERNAL our God, as is written in the Teaching.
    36. 36“And [we undertake] to bring to the House of G OD annually the first fruits of our soil, and of every fruit of every tree;
    37. 37also, the first-born of our sons and our animals, as is written in the Teaching; and to bring the firstlings of our cattle and flocks to the House of our God for the priests who minister in the House of our God.
    38. 38“We will bring to the storerooms of the House of our God the first part of our dough, and our gifts [of grain], and of the fruit of every tree, wine and oil for the priests, and the tithes of our land for the Levites—the Levites who collect the tithe in all our towns subject to royal service., “service,” cf. 5.18 .
    39. 39An Aaronite priest must be with the Levites when they collect the tithe, and the Levites must bring up a tithe of the tithe to the House of our God, to the storerooms of the treasury.
    40. 40For it is to the storerooms that the Israelites and the Levites must bring the gifts of grain, wine, and oil. The equipment of the sanctuary and of the ministering priests and the gatekeepers and the singers is also there. “We will not neglect the House of our God.”

    1. Verse 1

      וּבְכׇל־זֹ֕את אֲנַ֛חְנוּ כֹּרְתִ֥ים אֲמָנָ֖ה וְכֹתְבִ֑ים וְעַל֙ הֶֽחָת֔וּם שָׂרֵ֥ינוּ לְוִיֵּ֖נוּ כֹּהֲנֵֽינוּ׃

      Yet, despite all this Despite all the evil that has come upon us, we are making a trust with the Holy One, blessed be He, to believe and to trust in Him.

      and writing And we are writing on a scroll to accept His kingdom upon us in order that it be to us as a testimony.

      and signed thereon for most of the great and prominent men among us have signed the scroll of the acceptance of the commandments, to be for us as a testimony.

    2. Verse 2

      וְעַ֖ל הַחֲתוּמִ֑ים נְחֶמְיָ֧ה הַתִּרְשָׁ֛תָא בֶּן־חֲכַלְיָ֖ה וְצִדְקִיָּֽה׃

      And signed thereon He now proceeds to enumerate the signatories on the testimonial document of the acceptance of the commandments.

      Nehemiah Hattirshatha It is one name, and this is what I explained (Ezra 2:63) that [the name] Hattirshatha refers to Nehemiah. And why was he called Hattirshatha? Because the Sages permitted him to drink wine of gentiles, because he was the butler of the king.

    3. Verse 29

      וּשְׁאָ֣ר הָעָ֡ם הַכֹּהֲנִ֣ים הַ֠לְוִיִּ֠ם הַשּׁוֹעֲרִ֨ים הַמְשֹׁרְרִ֜ים הַנְּתִינִ֗ים וְֽכׇל־הַנִּבְדָּ֞ל מֵעַמֵּ֤י הָאֲרָצוֹת֙ אֶל־תּוֹרַ֣ת הָאֱלֹהִ֔ים נְשֵׁיהֶ֖ם בְּנֵיהֶ֣ם…

      and all who separated themselves These are the proselytes who separated themselves from the practice of the nations to cling and attach themselves to the Law of the Holy One, blessed be He, and to keep His commandments.

      מַחֲזִיקִ֣ים עַל־אֲחֵיהֶם֮ אַדִּירֵיהֶם֒ וּבָאִ֞ים בְּאָלָ֣ה וּבִשְׁבוּעָ֗ה לָלֶ֙כֶת֙ בְּתוֹרַ֣ת הָאֱלֹהִ֔ים אֲשֶׁ֣ר נִתְּנָ֔ה בְּיַ֖ד מֹשֶׁ֣ה עֶֽבֶד־הָֽאֱלֹהִ֑ים…

      with their brethen Heb — עַל אֲחֵיהֶם with their brothers.

      their noblemen the great ones among them.

      וְעַמֵּ֣י הָאָ֡רֶץ הַֽמְבִיאִים֩ אֶת־הַמַּקָּח֨וֹת וְכׇל־שֶׁ֜בֶר בְּי֤וֹם הַשַּׁבָּת֙ לִמְכּ֔וֹר לֹא־נִקַּ֥ח מֵהֶ֛ם בַּשַּׁבָּ֖ת וּבְי֣וֹם קֹ֑דֶשׁ וְנִטֹּ֛שׁ…

      and all grains Heb — שֶּׁבֶר, grain, like (Gen. 47:14): “... for the grain (בַּשֶּׁבֶר) that they were purchasing.”

      or on holy days This refers to festivals.

      and we shall abandon during the seventh year As is stated (Exod — 23:11): “But throughout the seventh year you shall let it go and abandon it (וּנְטַשְּׁתָּה).”

      and the loan given by every hand This refers to the release of loans during the seventh year.

    6. Verse 34

      לְלֶ֣חֶם הַֽמַּעֲרֶ֡כֶת וּמִנְחַ֣ת הַתָּמִ֣יד וּלְעוֹלַ֣ת הַ֠תָּמִ֠יד הַשַּׁבָּת֨וֹת הֶחֳדָשִׁ֜ים לַמּוֹעֲדִ֗ים וְלַקֳּדָשִׁים֙ וְלַ֣חַטָּא֔וֹת לְכַפֵּ֖ר עַל־יִשְׂרָאֵ֑ל וְכֹ֖ל…

      and all the work of the Temple of our God to do with money.

      וְהַגּוֹרָל֨וֹת הִפַּ֜לְנוּ עַל־קֻרְבַּ֣ן הָעֵצִ֗ים הַכֹּהֲנִ֣ים הַלְוִיִּם֮ וְהָעָם֒ לְ֠הָבִ֠יא לְבֵ֨ית אֱלֹהֵ֧ינוּ לְבֵית־אֲבֹתֵ֛ינוּ לְעִתִּ֥ים מְזֻמָּנִ֖ים שָׁנָ֣ה…

      we cast how much each one should bring.

      the wood offering an offering of wood for the arrangement on the altar.

      to the House of our forefathers which is the House of the sanctity of our forefathers.

    8. Verse 36

      וּלְהָבִ֞יא אֶת־בִּכּוּרֵ֣י אַדְמָתֵ֗נוּ וּבִכּוּרֵ֛י כׇּל־פְּרִ֥י כׇל־עֵ֖ץ שָׁנָ֣ה בְשָׁנָ֑ה לְבֵ֖ית יְהֹוָֽה׃

      the first fruits of our soil The first of every fruit of a tree. They are required by rabbinical injunction.

    9. Verse 38

      וְאֶת־רֵאשִׁ֣ית עֲרִיסֹתֵ֣ינוּ וּ֠תְרוּמֹתֵ֠ינוּ וּפְרִ֨י כׇל־עֵ֜ץ תִּיר֣וֹשׁ וְיִצְהָ֗ר נָבִ֤יא לַכֹּהֲנִים֙ אֶל־לִשְׁכ֣וֹת בֵּית־אֱלֹהֵ֔ינוּ וּמַעְשַׂ֥ר אַדְמָתֵ֖נוּ לַלְוִיִּ֑ם…

      we shall bring to the priests to the chambers for they were usually there.

      who receive tithes in all the cities of our work who take their tithes in all the cities of Israel.

      וְהָיָ֨ה הַכֹּהֵ֧ן בֶּֽן־אַהֲרֹ֛ן עִם־הַלְוִיִּ֖ם בַּעְשֵׂ֣ר הַלְוִיִּ֑ם וְהַלְוִיִּ֞ם יַעֲל֨וּ אֶת־מַעֲשַׂ֤ר הַֽמַּעֲשֵׂר֙ לְבֵ֣ית אֱלֹהֵ֔ינוּ אֶל־הַלְּשָׁכ֖וֹת לְבֵ֥ית…

      at the [Levites’] tithing Heb — בַּעְשֵּׂר ;an expression meaning at the tithing.

      the tithe of the tithe for the Levites would take a tithe from the tithe and bring it up to the priests, who did not leave the Temple.

    1. Verse 1

      וּבְכׇל־זֹ֕את אֲנַ֛חְנוּ כֹּרְתִ֥ים אֲמָנָ֖ה וְכֹתְבִ֑ים וְעַל֙ הֶֽחָת֔וּם שָׂרֵ֥ינוּ לְוִיֵּ֖נוּ כֹּהֲנֵֽינוּ׃

      ובכל זאת, הגם שאנחנו בצרה, אנחנו כורתים אמנה היינו ברית נאמן וקיים, הפך אבותינו שלא עבדו את ה' מרוב כל, ועל החתום, היינו בספר שעליו חתמו, ויתכן לאמר שהיה דרכם בכל דבר הנעשה לקיום לכתוב הדבר בשני ספרים, אחד ספר הגלוי ואחד ספר החתום, וכמ"ש בירמי' (ל"ב י"א י"ד) ובס' הגלוי היו חותמים מבפני' ובספר החתו' היו חותמי' מבחוץ, כמ"ש חז"ל גט פשוט עדיו מתוכו מקושר עדיו מבחוץ, וסדר החתימות היו הכהנים ואח"כ הלוים ואח"כ השרים, וזה היה בספר הגלוי, אבל בספר החתום שקפלו את החתומים לחוץ נתהפך ונקראו האחרון בראשונה, תחלה השרים ואח"כ הלוים ואח"כ הכהנים, וז"ש ועל החתום, היינו ספר החתום, היה הסדר שרינו לוינו וכהנינו:

      וְעַ֖ל הַחֲתוּמִ֑ים נְחֶמְיָ֧ה הַתִּרְשָׁ֛תָא בֶּן־חֲכַלְיָ֖ה וְצִדְקִיָּֽה׃

      ועל החתומים, שהוא בספר הגלוי שם באו החתומים כסדר כהנים ואח"כ לוים ואח"כ שרי העם, וכשתמנה תמצא שחתמו א"ע פ"ג אנשים והם נגד שבעים סנהדרין וי"ג ממונים שחשב הרמב"ם פ"ד מה' כה"מ חוץ מן הכהן גדול (שלא נזכר בין החתומים) סגן ושני קתיקולין וז' אמרכלים וג' גזברים:

      וּשְׁאָ֣ר הָעָ֡ם הַכֹּהֲנִ֣ים הַ֠לְוִיִּ֠ם הַשּׁוֹעֲרִ֨ים הַמְשֹׁרְרִ֜ים הַנְּתִינִ֗ים וְֽכׇל־הַנִּבְדָּ֞ל מֵעַמֵּ֤י הָאֲרָצוֹת֙ אֶל־תּוֹרַ֣ת הָאֱלֹהִ֔ים נְשֵׁיהֶ֖ם בְּנֵיהֶ֣ם…

      ושאר, ר"ל ושאר העם שלא באו עה"ח מחזיקים על אחיהם ומסכימים אל השבועה, וכל הנבדל, היינו הגרים, כל יודע, ר"ל בין נשיהם שאין יודעים בין היודע ומבין כולם מחזיקים וכו':

    4. Verse 31

      וַאֲשֶׁ֛ר לֹא־נִתֵּ֥ן בְּנֹתֵ֖ינוּ לְעַמֵּ֣י הָאָ֑רֶץ וְאֶת־בְּנֹ֣תֵיהֶ֔ם לֹ֥א נִקַּ֖ח לְבָנֵֽינוּ׃

      אשר לא נתן, אף שאינם מז' עממין:

    5. Verse 32

      וְעַמֵּ֣י הָאָ֡רֶץ הַֽמְבִיאִים֩ אֶת־הַמַּקָּח֨וֹת וְכׇל־שֶׁ֜בֶר בְּי֤וֹם הַשַּׁבָּת֙ לִמְכּ֔וֹר לֹא־נִקַּ֥ח מֵהֶ֛ם בַּשַּׁבָּ֖ת וּבְי֣וֹם קֹ֑דֶשׁ וְנִטֹּ֛שׁ…

      ועמי הארץ, קבלו על עצמם איסור מקח וממכר שלא נזכר בתורה בפירוש, ונטוש, לאפוקי ממ"ד שאם אין יובל אין שמיטה, ואין יובל נוהג רק בזמן שכל יושביה עליה:

    6. Verse 33

      וְהֶעֱמַ֤דְנוּ עָלֵ֙ינוּ֙ מִצְוֺ֔ת לָתֵ֥ת עָלֵ֛ינוּ שְׁלִישִׁ֥ית הַשֶּׁ֖קֶל בַּשָּׁנָ֑ה לַעֲבֹדַ֖ת בֵּ֥ית אֱלֹהֵֽינוּ׃

      שלישית השקל, נוסף על מחצית השקל למפ', ועי' (מלכים א' ז' כ"ו) שאז נשתנה המטבע, ושלישית השקל היה כמחצית השקל הקודם, וכמ"ש ביחזקאל (מ"ה י"ב):

      לְלֶ֣חֶם הַֽמַּעֲרֶ֡כֶת וּמִנְחַ֣ת הַתָּמִ֣יד וּלְעוֹלַ֣ת הַ֠תָּמִ֠יד הַשַּׁבָּת֨וֹת הֶחֳדָשִׁ֜ים לַמּוֹעֲדִ֗ים וְלַקֳּדָשִׁים֙ וְלַ֣חַטָּא֔וֹת לְכַפֵּ֖ר עַל־יִשְׂרָאֵ֑ל וְכֹ֖ל…

      ולעולת התמיד, (ולעולת) השבתות והחדשים והמועדים ולקדשים, כמו העומר וכבשי עצרת ושתי הלחם, ולחטאות, שעירי ר"ח ושל מועדות:

      וְהַגּוֹרָל֨וֹת הִפַּ֜לְנוּ עַל־קֻרְבַּ֣ן הָעֵצִ֗ים הַכֹּהֲנִ֣ים הַלְוִיִּם֮ וְהָעָם֒ לְ֠הָבִ֠יא לְבֵ֨ית אֱלֹהֵ֧ינוּ לְבֵית־אֲבֹתֵ֛ינוּ לְעִתִּ֥ים מְזֻמָּנִ֖ים שָׁנָ֣ה…

      והגורלות הפלנו, כמו שבארו זה חז"ל בתענית:

      וּלְהָבִ֞יא אֶת־בִּכּוּרֵ֣י אַדְמָתֵ֗נוּ וּבִכּוּרֵ֛י כׇּל־פְּרִ֥י כׇל־עֵ֖ץ שָׁנָ֣ה בְשָׁנָ֑ה לְבֵ֖ית יְהֹוָֽה׃

      ולהביא את בכורי אדמתנו, חטה ושעורה, ובכורי כל פרי כל עץ, גפן ותאנה ורמון וכו'. ורש"י כתב בכורי כל פרי באילן הם מדברי חכמים, והוא תמוה דמבואר בירושלמי בכורים דאם הביא בכורים חוץ מז' המינים לא נתקדשו, ונראה מפני שמן התורה אין שיעור לבכורים קבלו עליהם להביא לבית ה' מתנה ראויה אחד מששים כתקנת חכמים:

      וְאֶת־בְּכֹר֤וֹת בָּנֵ֙ינוּ֙ וּבְהֶמְתֵּ֔נוּ כַּכָּת֖וּב בַּתּוֹרָ֑ה וְאֶת־בְּכוֹרֵ֨י בְקָרֵ֜ינוּ וְצֹאנֵ֗ינוּ לְהָבִיא֙ לְבֵ֣ית אֱלֹהֵ֔ינוּ לַכֹּ֣הֲנִ֔ים הַמְשָׁרְתִ֖ים בְּבֵ֥ית…

      ואת בכורות בנינו ובהמתנו, היינו בהמה טמאה, שא"צ להביא הפדיון לבית ה', ובכורי בקרינו להביא לבית אלהינו להקרבה:

      וְאֶת־רֵאשִׁ֣ית עֲרִיסֹתֵ֣ינוּ וּ֠תְרוּמֹתֵ֠ינוּ וּפְרִ֨י כׇל־עֵ֜ץ תִּיר֣וֹשׁ וְיִצְהָ֗ר נָבִ֤יא לַכֹּהֲנִים֙ אֶל־לִשְׁכ֣וֹת בֵּית־אֱלֹהֵ֔ינוּ וּמַעְשַׂ֥ר אַדְמָתֵ֖נוּ לַלְוִיִּ֑ם…

      ואת ראשית, הוא נכון מאד לדעת הרמב"ם דבימות עזרא לא היו חייבים בחלה ותו"מ רק מדבריהם [כמ"ש בה' תרומות סוף פ"א] וא"כ כל מה שקבלו ע"ע היה מדברי חכמים, ולדעת הראב"ד שהתרומ' היא מה"ת ורק חלה דרבנן, י"ל שקבלו עליהם תרומות שאר פירות כמ"ש ופרי כל עץ, שלשטתיה [פ"א מה' מעשרות ה"ט] אין חייב מה"ת רק דגן תירוש ויצהר, ועז"א ומעשר אדמתנו, ר"ל מכל מה שגדל באדמה, והם הלוים המעשרים, שהם לוקחים המעשר בכל ערי עבודתנו בכ"מ שעובדים בשדה:

      וְהָיָ֨ה הַכֹּהֵ֧ן בֶּֽן־אַהֲרֹ֛ן עִם־הַלְוִיִּ֖ם בַּעְשֵׂ֣ר הַלְוִיִּ֑ם וְהַלְוִיִּ֞ם יַעֲל֨וּ אֶת־מַעֲשַׂ֤ר הַֽמַּעֲשֵׂר֙ לְבֵ֣ית אֱלֹהֵ֔ינוּ אֶל־הַלְּשָׁכ֖וֹת לְבֵ֥ית…

      והיה הכהן עם הלוים, לדעת חז"ל קנסו ללוים אז שיקחו גם הכהנים את המעשר [עי' מ"ש ביבמות דף פ"ו ע"ב ובחולין קל"א], ור"ל הכהנים היו יכולים ליקח גם את המעשר, ומעשר מן המעשר היו צריכים לתת לכהנים אף מתבואת הלוי:
