דין מקבל שרוצה להסתלק מפני רעת השדה. ובו ב סעיפים:
המקבל שדה מחבירו ולא עשתה אם יש בה כדי להוציא סאתים יתר על ההוצאה חייב המקבל ליטפל בה שכך כותב לבעל הקרקע אנא אקום ואזרע וכו' ואעמיד כרי לפניך ותטול חלקך וכו' (ואפי' לא כתב כך כמאן דכתיב דמי) (המגיד פרק י"ח דשכירות וב"י בשם התו' והרא"ש):
לא עבדה אלא הובירה כולה או מקצתה שמין אותה כמה היא ראויה לעשות ונותן לו חלקו שהי' מגיע לו ואם התנה עמו אם אוביר ולא אעביד אשלם אלף זוז הרי זו אסמכתא ואינו חייב לשלם אלא נותן כפי מה שראויה לעשות בלבד:
