Superior-quality and inferior-quality land, damages [are paid] from the superior-quality land, and [payments owed to a] creditor and [payments of] a woman’s marriage contract are made from the inferior-quality - by Torah law, a creditor [is paid] from inferior-quality land as is stated later on; it is the Rabbis who decreed that he [can collect from] intermediate-quality land, due to [the desire to prevent] "locking the door to borrowers". In a case where he does not have intermediate-quality land, the decree does not apply.
Let his intermediate-quality land be classified as superior-quality since it is considered "excellent" [Exodus 22:4] as far as he is concerned.
And he sold it after the loan. The intermediate-quality land came under lien to the creditor at the outset, when [the borrower] still held the superior-quality land.
Both this [ baraita ] and that [ baraita> concern cases] where [the borrower] did not have superior-quality - and everyone [that is, the authors of both baraitot ] agrees that [the quality of the borrower's land] is evaluated with respect to the world at large.
And it is not difficult, etc - that which was stated [in the first baraita ] that a creditor and woman's marriage contract [are collected] from the inferior-quality land -- is because his intermediate-quality land is comparable to general superior-quality land.
Both this [ baraita ] and that [ baraita ] concern a case where his intermediate-quality land is equivalent to the intermediate-quality land of the world at large - and where he did not have any superior-quality land to begin with. It is with respect to this that they disagree: the tanna of the first baraita holds that [his lands] are evaluated against those of the world at large, and on account of this the creditor can collect from the intermediate-quality land, according to the [usual] law. The other [ tanna ] holds that [his land] is evaluated [only] with respect to [whatever other land] he owns.
Another version we have the text [instead]: "both this baraita and that baraita concern a case where his intermediate-quality land is equivalend to the superior -quality land of the world at large. The [contradiction], then, is explained as follows: both baraitot concern a case where he had superior-quality land [at the time of the loan] and sold it. It is with respect to this that they disagree: the tanna of the first baraita holds that [his land] is evaluated [only] with respect to [whatever other land] he owns. Since it is intermediate-quality with respect to his [other lands], even though with respect to the world-at-large it is superior-quality land, he pays from [that land]. The tanna of the [second] baraita holds that [his land] is evaluated with respect to the world-at-large. Prefer the first version [of the text].
They disagree with regard to Ulla the tanna of the latter [ baraita ] does not hold of Ulla's decree, but rather goes according to the [original framework of] Scripture: even if he also owns superior-quality land, which means that he has bona-fide intermediate-quality land -- both with respect to his own [property] and with respect to the world-at-large -- nevertheless, [the tanna ] rules that the creditor collects from the inferior-quality land.

Tosafot
[Both] this [braita] and that [braita] The Gemara quotes a Braita that says: if a person owned intermediate and poor quality fields, the victim of his damages and his creditor collect from the intermediate-quality. If he owes a k’suboh it is paid from the poorest- quality. In a second Braita with the same circumstances, a different formula is given. The victim of damages collects from the medium-quality. The creditor and the marriage contact are paid from the poorest-quality fields. Debtor has intermediate and poor-quality fields: Braita A Medium quality: Damages Creditor Poorest Quality: K’suboh Braita B Medium quality: Damages Poorest quality: Creditor K’suboh The Gemara offers four ways of reconciling this contradiction. Our Tosafot will be focusing on the second way. 1) Both Braitas hold that we determine finest, medium and poorest qualities according to the damager’s fields. Braita A is discussing a situation where at the time of the loan the debtor owned even finer fields. Since he owned finer fields, the debt at the outset was payable from the medium-quality fields. Even after the finer fields were sold, and his intermediate quality becomes his finest, the debt must be paid from what is now his finest because initially a lien was established on those fields. In Braita B, there never were any finer fields. The medium-quality fields are his best and the creditor is not entitled to collect from the debtor’s best. He must therefore collect from the poorest fields. 2) In both Braita A and Braita B, the debtor did not have finer fields at the time of the loan which were subsequently sold. Both Braita A and Braita B hold that the quality of the field is measured by world standards. Braita A is speaking about where his intermediate- quality is equal to the world’s intermediate quality and he pays his creditor and damages from the medium-quality. Braita B is speaking about where his medium-quality is equal to the finest quality by world standards. The creditor is not entitled to the finest fields, so he must accept payment from the poorest. The damages are of course paid from the finest. It is this second answer that our Tosafot will be discussing. 3) Both Braitas are speaking of where the debtor’s medium quality is equal to the world’s medium-quality. Braita A holds that payment is made according to world standards and therefore the creditor is paid with medium-quality fields even though they are the finest of the debtor. Braita B holds that payment is made according to the debtor’s fields. Since the field in question is the debtor’s best the creditor who is not entitled to the finest must collect from the poorest. 4) Ulo says in Chapter Haneezokin that by Torah law the creditor can collect only from the poorest. The Rabonon were concerned that potential lenders would be discouraged by the fact that they could only collect from the poorest fields and instituted a rabbinic law allowing them to collect from the intermediate quality fields. Braita A subscribes to Ulo’s ruling while Braita B rejects it. Rashi holds that he rejects Ulo’s ruling altogether and holds that there is no rabbinic law that creditor’s may collect from the intermediate- quality fields. Tosafot disagrees with Rashi’s understanding and hold that in general he agrees with Ulo, it is only in limited circumstances that he disagrees with Ulo. This is our text of the Gemara’s second solution: Both Braita A and Braita B are speaking of where the owner did not have finer fields that were later sold. Braita B is speaking about when his intermediate quality is equal to the world’s finest. Since a creditor is not entitled to the finest, he can now be paid with the poorest. Braita A is speaking of when his medium quality is not equal to the world’s finest. Since they are not equal to the worlds finest they are classified as medium-quality and the creditor is entitled to be paid from the intermediate-quality. Although the Gemara introduced this solution with the explanation that in both Braitas the debtor did not have any finer fields that were sold, there is a major difference between the circumstances of Braita A as opposed to Braita B, as Tosafot will now explain. And that which the Gemara said that both Braita A and Braita B are speaking of when he did not have finer fields that had been sold, the Gemara does not mean to say that both Braitas are speaking of where he did not have any finer fields at all, for if that were so, in Braita B which is speaking of where his middle quality is equal to the world’s finest, why are they called middle-quality? They are his finest, since you are assuming that he never had any better fields and they are the finest by world standards. Why are they referred to as middle-quality? Rather, this is what the Gemara means, both Braita A and Braita B are speaking of where he did not have finer fields that were sold, what this means is: that they are not speaking of where he had finer qualities that were sold, but one Braita, Braita A, is speaking of when he never had any finer fields at all. His finest is equal to the world’s middle-quality and therefore the creditor is paid from his finest which is equal to the world’s middle-quality. And Braita B is speaking of when he had finer fields and still has them. His middle-quality is equal to the worlds finest and they cannot be collected by a creditor. He must collect from the poorest quality. They are referred to as middle-quality because he owns even finer fields and they are in fact, his middle quality. According to this explanation, we need not say that either of the Braitas is speaking of when a field was sold. In Braita A he never had any finer fields. In Braita B he had finer fields and still has them. Nothing was sold in either Braita. And both Braitas hold that the qualities of fields are determined by world standards. That is why in Braita A the debtor pays with what is middle-quality according to world standards, even though they are his own finest. In Braita B the debtor pays with his own poorest, since his own middle-quality is equal to the world’s finest.
And if you wish, say [both] this [baraita] and that [braita concern cases where the borrower] did not have superior-quality [land] and sell it. This Tosafot is discussing the third way of reconciling the contradiction between the two Braitas. See previous Tosafot for an explanation of this solution. There is an alternative text for this third solution. Instead of reading that the debtor’s medium-quality is equal to the world’s medium- quality, that text reads that the debtor’s medium-quality is equal to the world’s finest quality. Tosafot rejects that text, as he will now explain. We do not have the text that in both Braitas the debtor’s middle-quality is equal to the world’s finest quality. For since in this third solution these Braitas are speaking of where the debtor had no finer fields, why are the fields he has called medium-quality fields since according to this text they are the debtor’s finest and the world’s finest? And another reason to reject this text is, for if it were so, that his intermediate-quality is equal to the world’s finest and we were to assume that the debtor did have finer fields which is why the fields under discussion are referred to as intermediate-quality, how can we make sense of Braita A that says that the victim of damages and the creditor are paid from the intermediate-quality. This difficulty is compelling both according to the one who says qualities are determined according to the debtor’s properties, and according to the one who says that qualities are determined by world standards. According to the one who says qualities are determined by the debtor’s property, the victim of damages should collect from the finest and the creditor from the debtor’s intermediate- quality. According to the one who holds that qualities are determined by world standards, the victim of damages should collect from the damager’s medium-quality, which is equal to the world’s finest and the creditor should collect from the debtor’s poorest quality because he is not entitled to the finest by world standards.
What [would] a person typically bring out? The most inferior of his utensils. Ulo is proving that the creditor is paid with the poorest quality since the Torah says that “the man to whom you lend shall bring out the security to you”. That “man” the borrower, given the choice will bring out the least of his utensils. The Torah is giving that “man” the right to pay with that which he sees fit; obviously he will choose the poorest. Tosafot points out that there is another person involved in the process, the court emissary. Even though it is the court emissary who brings out the security to the lender, the court emissary only brought out to the lender that which the borrower gave him. The decision of what to give as security remained with the borrower, who would obviously choose the least valuable of his utensils.
To bring out the most inferior of his utensils The debtor’s right to bring out the least of his utensils is presented as proof that the creditor collects his debt from the poorest by Torah law. The supposition is that the least of the utensils is by definition not the finest. This contradicts what we have learned earlier. And if you ask: Even the least of utensils is “the finest” as the Gemara said earlier (Bava Kamma 7b), all movable items are the finest since they can be transported to where they are sought after. And we can answer: When one brings out utensils it is usual for him to bring out the least valuable and so too, when he brings land it is also usual that he brings the poorest. Since the Torah places the decision in the hands of the borrower, when he offers land he will offer the poorest which the lender must accept. It appears that the correct ruling is that qualities are designated according to the debtor’s property, for that is the opinion of R’ Nachmon in Ketubot 110a. As was pointed out at the end of Tosafot ה מר לית ליה תקנתא דעולא ' ד, in the fourth and final solution, according to both Braitas the designation of qualities is based on world standards. Tosafot felt the need to say that this is not the halachic ruling, rather we follow R’ Nachmon who holds that designation of qualities is based on the properties of the debtor.
[The other] sage is not of [the opinion that the ruling is in accordance with] the ordinance [cited] by Ulla. The Mishna in Haneezokin (48b) says that a creditor collects his debt from intermediate-quality fields. In our Gemara Ulo teaches us that by Torah law the creditor should collect only from the poorest quality fields. The Sages felt that this would have a negative impact on a borrower’s ability to obtain a loan. The potential lenders would not want to give a loan if their right to collect their debt was limited to the poorest quality. They therefore legislated that a creditor can collect from medium-quality fields. Why did they not allow a creditor to collect from the finest fields? The Gemara in Haneezokin (49b) answers that question. They felt that an unscrupulous individual would try to take advantage of an unfortunate person who was in need of cash. The lender would offer the unfortunate borrower a loan with the hope that he would not be able to pay the loan and thus the lender would take possession of the finest fields of the borrower. However, since a creditor could collect from the medium- quality, the honest lender would not be discouraged from offering a loan to a person in need of one. Our Gemara says that the Braita B that says that when a debtor has only intermediate and poor-quality fields the creditor collects from the poorest quality does not hold of Ulo’s rule. Rashi says that he does not hold like the Mishna in Haneezokin and in all cases a creditor collects only from the poorest, even when the debtor owns all three qualities of fields. Tosafot disagrees with Rashi as he will now explain. The Gemara’s statement that this Braita does not hold of Ulo’s rule was said specifically where the debtor has no finer fields than the medium- quality; in that case these medium-quality fields that he does have are the debtor’s finest. This can be seen from the Braita’s mentioning that the debtor owned only medium and poorest. It is in this case that the Braita rules the creditor collects from the poorest. This implies that if the debtor owned finer quality fields the creditor does collect from the medium-quality. Tosafot understands that the Braita specifically set up this case of the debtor not owning any finer quality as one where the creditor must take the poorest quality. Where the debtor does own finer quality the creditor collects from the medium-quality fields. And this Braita holds that since the debtor only has medium and poorest quality, the reason mentioned in Haneezokin that a creditor does not collect from the finest is relevant to the situation of our Braita. The Gemara there says: For what reason does a creditor not collect from the finest? So that he should not gaze upon his neighbor’s beautiful field or beautiful apartment and say: I will hasten and lend him money so that I will collect it, the beautiful field or apartment as payment of my loan. This concern is mentioned there as the reason the creditor does not collect from the finest. Braita B holds that this concern is relevant even where the borrower’s finest field is not the finest by world standards. The creditor cannot collect from the borrower’s finest and must therefore collect only from the borrower’s poorest. Braita A holds that this concern is relevant only where the borrower’s finest are finest by world standards as well, not when they happen to be this borrower’s finest but not the finest by world standards. Since that concern does not apply here, the creditor can collect from the intermediate-quality fields; even though they are the creditor’s finest. According to this fourth solution, both Braitas obviously hold that the designation of qualities is measured by world standards.
All [the buyers] replace the [land’s prior] owner The purchasers of the fields assume the responsibilities of the original owner. The purchaser of the finest field will pay the victim of damages. The purchaser of the medium-quality will pay the creditor and the purchaser of the poorest quality will pay the k’suboh. It is clear that the victim of damages will definitely be able to collect from a field that the damager sold. Tosafot examines this ruling in view of the general rules of collecting from property that was sold. And if you ask: Damages are equivalent to a loan that is not documented, since the obligation is not written in a document and a loan that is not documented cannot be collected from property that was sold by the borrower? Why is our Gemara certain that the victim of damages can collect from property that the damager sold? And we can answer: That when they stood at a Din Torah and the obligation to pay was established by the court, it is equivalent to a documented loan and one is paid from property that the borrower sold, as the Gemara says in HaGozail basro (Bava Kamma 112) and in some other places. Alternatively, damages are a loan that is written in the Torah, which is equivalent to being written in a document and the purchasers of the property are liable to pay. (See Kidushin 13b).
[If he] does not have [they] collect from the previous [buyer] When a debtor sells some of his property, the rule is that we do not collect from property that has been sold when there is unsold property available from which to collect the debt, even if that unsold property is of the poorest quality. Thus the law that the victim of damages collects from the finest and the creditor from the medium quality is circumvented by the sale of those properties to the first and second purchasers. Subsequently, if and when the remaining property is collected to settle a debt, even if that happens after the sale of such property to a third purchaser, the order to be followed when settling the debts is not based on the qualities but on the dates of the sale of the properties. The last sold is the first to be collected and the first sold is the last to be collected. We must also take into account the dates of the obligations. The earliest obligation is collected first and the last obligation is collected last, even though this may be to the detriment of the earliest obligation as Tosafot will now explain. Rivo says: That if they, the victim of damages, the creditor and the woman collecting her k’suboh, all come at once to collect what is owed to them, whoever’s document precedes the others collects from the last purchaser first even if this will be to his disadvantage. If the victim of damages was the earliest, he was damaged on the earliest date; he collects from the last purchaser even if that property happens to be the poorest. The rule that one collects from the last purchaser overrides the victim’s right to collect from the finest. And if the creditor comes after the victim of damages, for example, the date of his loan precedes the date of the k’suboh; he too, collects from the last purchaser. And if he, the last purchaser, does not have any more of the land that he purchased from the debtor, he, the creditor, collects from the preceding purchaser, even if the land the second purchaser has is from the finest of the debtor’s property. Ordinarily the creditor collects from the medium-quality. In this situation we are following the order that the various debts came into existence. That order takes precedence over the rule that the creditor receives payment from the intermediate-quality since that rule has been circumvented by the debtor selling the medium-quality before selling the poorest property. And the woman, who is collecting her k’suboh and happens to be the latest obligation of the three, collects from the very first purchaser even if that property is the finest of the finest. Time line Obligations: Ador 1- damages Ador 2- debt Ador 3- k’suboh – marriage contract Sale of property: Ador 4- finest of the finest Ador 5- finest Ador 6- inferior The damages victim of Ador 1 is the first obligation. He is paid from the field sold last on Ador 6, even though it is inferior-quality. The creditor whose loan is dated Ador 2 is paid from the balance of the inferior if there is any left and if there is nothing left he is paid from the field sold on Ador 5, even though it is the finest. The marriage contract which was dated Ador 3 is paid from the finest if there is any remaining after satisfying the debt. If not, she is paid from the first field sold on Ador 4, even though it is the finest of the finest. See Rosh who adds that the victim of damages may make a private deal with the first purchaser who has the finest property. The first purchaser may then say I give up my right to compel the victim of damages to collect from the last purchaser and will pay him from the finest properties that I purchased from the debtor. This is not considered a violation of the rights of the debtor and the k’suboh. The same may be true of the creditor who can strike a deal with the holder of the medium properties.
Where it is possible to say [that the sale to] one of them preceded [the other sales]. It appears that Rashi understood that the words דאיכא למימר mean that an argument can be made that since one document was written and given before the other, we should consider the first purchaser as the first and his property should be collected last and we should not treat all of the purchasers equally even though all three transactions took place on one day. The Gemara’s conclusion is that since they are all written in one day the effective date of each of these documents is the end of that day. It doesn't really matter that one of them was written earlier than the others. They are in reality all effective at the same point in time, the end of the day on which they were written. Tosafot seems to translate the words דאיכא למימר as ‘it can be said’. This implies that there is an element of doubt. It can be said that one was given before the other and it can be said that one was not given before the other. Tosafot finds this interpretation problematic. If we are speaking in terms of an actual time that the seller handed the documents to the buyers, then one definitely was given before the other. How can we entertain the possibility that one was not given before the other? (It is highly unlikely that the seller handed two documents to two people at precisely the exact same moment.) Tosafot explains that converse of “it can be said that one preceded the other” is not that “it can be said that the two documents were given simultaneously”, but rather, “that we are sure that one preceded the other”. This happens in Y’rusholayim where it was the custom to write not only the date but also the time of day that the document was written. The reason that there is a doubt about which transaction occurred first in places other than Y’rusholayim is because we only write the hour of the day in Y’rusholayim. In Y’rusholayim there is no doubt. Since we write the hour of the transaction in the document we are sure that one document was given before the other.

שהיתה בינונית דידיה כעידית דעלמא ותימה כיון שלא היתה לו עידית אמאי קרי ליה בינונית הא בין לדידיה וכו'. וי"ל ככתוב בתוספות. ושאלתי את ר"מ אם כן אמאי לא קאמר רבותא טפי עידית ובינונית וזיבורית נזקין בבינונית ובעל חוב וכתובת אשה בזיבורית. ותירץ משום דאין דרך להזכיר עידית כיון דאין גובין ממנה. ועוד תירץ דשמא בברייתא כתוב עידית והתלמוד לא הביא אלא בינונית וזיבורית שרצה להקשות מהם. תוספי הרא"ש ז"ל. וקשה למה דחקו התוספות בזה נימא להכי קרי ליה בינונית אף על פי שהיא כמו בינונית דניזק. וי"ל כיון דלכולי עלמא בעל חוב בבינונית דניזק לא שיימינן לא מיקרי בינונית. גליון.
הכי גרסינן אידי ואידי שלא היתה לו עידית ומכרה לא בעי למימר דתרווייהו מיירי שלא היתה לו כלל וכו' כמו שכתוב בתוספות. מיהו מצינו לפרש כפשוטו אידי ואידי שלא היתה לו עידית ומכרה פירוש לאחר שנעשה המלוה לא היתה לו עידית אבל קודם שנעשה החוב היתה לו ולכך נקראת בינונית אבל מכרה קודם שנעשה החוב אז הויא בינונית כמו עידית ולא שקיל לה בעל חוב למאן דאמר דהויא כעידית דעלמא. ופירש דתריץ לעיל שהיתה לו עידית ומכרה היינו לאחר שנעשה החוב נשתעבדה לו אז הבינונית אבל מכרה קודם שנעשה לו החוב אז הויא בינונית כמו עידית ולא שקיל לה בעל חוב למאן דאמר בשלו הן שמין. ולפי זאת הגירסא לא גרסינן ואיבעית אימא אידי ואידי וכו' בעידית דעלמא כמו שכתוב בתוספות. אבל לפי ספרים דגרסי בשינויא קמא אידי ואידי שהיתה לו עידית ומכרה גרסינן שפיר ואיבעית אימא אידי ואידי כגון שהיתה בינונית שלו כעידית דעלמא ובעל חוב דשקיל בינונית היינו למאן דאמר בשלו הן שמין אבל לא מצי למיגרס אידי ואידי כגון שהיתה בינונית שלו כבינונית דעלמא דאם כן אמאי בעל חוב בזיבורית כיון שהיתה לו עידית ומכרה. ומיהו גם גירסא זו רחוקה דכיון דאפשר לו לתרץ כפשוטן של ברייתות דהוה משמע לן מעיקרא כגון שלא היתה לו עידית מעולם והא דקרי ליה בינונית מפני שהיא כבינונית דעלמא אמאי דחיק נפשיה לשנות מסברא זו למימר דמיירי כגון שהיתה לו עידית ומכרה ושויא בינונית דיליה כעידית דעלמא. תוספות שאנץ. וז"ל תלמיד רבינו פרץ ז"ל והא דשויא בינונית דידיה כעידית דעלמא ואז בעל חוב בזיבורית. וא"ת אם כן אמאי קרי ליה בינונית. יש לומר דאינו רוצה לומר שלא היתה לו עידית מעולם אלא שלא היתה לו אחר השעבוד וכו'. וא"ת למה ליה למימר לא היתה לו עידית ומכרה אפילו ישנה בידו עתה מכל מקום בעל חוב בזיבורית כדקתני ולא מבינונית דידיה וכו'. וי"ל דהכי נמי קאמר והאי דקאמר אידי ואידי שלא היתה לו עידית ומכרה לצדדין קתני וכו' ככתוב בתוספות. ונראה למורי שיחיה לפרש כפי הפשט דתרווייהו בלא היתה לו עידית ומכרה שגם עכשיו אין לו עידית אף על גב דההיא ברייתא דמוקמינן לה דהויא בינונית דידיה כעידית דעלמא מתוקמא גם כשיש לו עידית עכשיו מה בכך מכל מקום מיירי נמי בלא היתה לו עידית דהא דקאמר תלמודא אידי ואידי שלא היתה לו עידית לא בא אלא בשביל ברייתא ראשונה דקתני בעל חוב בבינונית וההיא ודאי הוצרך להעמידה דוקא בלא היתה לו עידית כדי להוכיח ממנה בשל עולם הן שמין כמו שהיה רוצה לפשוט מעיקרא שאם היתה לו עידית או יש לו עידית עכשיו אם כן הוה מתוקמא כמאן דאמר בשלו הן שמין וגבי האי ברייתא קמייתא הוי דוקא בשלא היתה לו עידית אבל ודאי ברייתא שנייה מתוקמא בכל ענין כדפירשתי והכי קאמר אידי ואידי בשלא היתה לו כלומר גם ברייתא ראשונה שאתה רוצה להעמידה כשהיתה לו עידית ולהוכיח בשלו הן שמין מחמת ברייתא שנייה ההיא קמייתא אדרבא מיירי דוקא בשלא היתה לו עידית ומשום דסברה בשל עולם הן שמין וברייתא שנייה כבר העמדתיה בלא היתה לו עידית. ע"כ.
ואיבעית אימא אידי ואידי כשהיתה בינונית שלו כבינונית דעלמא ולא גריס כעידית דעלמא וכו' כמו שכתוב בתוספות. וקשה נימא כמו שאמרו התוספות לעיל שלא היתה לו עידית ומכרה אבל היתה לו עידית ועדיין היא אצלו שלא מכרה לתנא קמא גובה מן הבינונית שהבינונית שאצלו היא בינונית ממש דבשלו הן שמין. וכי תימא אם כן אמאי קאמר מציעתא בינונית וזיבורית ניזקין בבינונית דהויא כעידית והלא יש לו עידית והיה להם ניזקין לגבות בעידית דיש לומר דלפיכך גובה ניזקין בבינונית משום דהויא כעידית דניזק אליבא דרבי ישמעאל. אבל קשה דעל כרחך צריך לומר מציעתא דומיא דרישא וכי היכי דברישא הזכיר עידית ובינונית וזיבורית כך היה לו להזכיר במציעתא כיון שיש לו עידית ואף על גב דבברייתא בתרייתא לא הזכיר עידית אף על פי שיש לו שלא הזכיר אלא בינונית וזיבורית והיה לו להזכיר כפי פירוש התוספות מכל מקום אינו קשה כיון שהיא ברייתא בפני עצמה אבל ברייתא קמייתא קשה דהיה לו להזכיר דומיא דרישא. וכי תימא דעידית דרישא איירי דהויא כעידית דניזק וכן בינונית כבינונית דניזק וכן איירי בסיפא דהוו כשל ניזק אם כן למה אומר היו לו עידית ובינונית וזיבורית דהיינו המזיק יאמר היה לו לניזק עידית ובינונית יגבה מן המזיק כמותן אלא ודאי אי אפשר לומר כן ואדרבא מה שאמרו התוספות דחוק שאומרים אידי ואידי כשלא היתה לו עידית ומכרה ומפרשינן חדא שלא היתה לו מעולם וחדא שהיתה לו ועדיין היא אצלו שלא מכרה שהרי שלא היתה לו עידית ומכרה משמע שלא היתה לו מעולם וקאי אתרווייהו. גליון. וז"ל הרא"ש ז"ל ולא גרסינן בעידית דעלמא ואף על גב דפרישנא שלא היתה לו עידית שמכרה אלא שעדיין ישנה בידו ואם כן ניחא דקרי ליה בינונית וניחא נמי למאן דאמר בשלו הן שמין דשקיל בעל חוב הבינונית הני מילי כדאוקימנא שתי ברייתות בשלא היתה לו עידית ומכרה ומפרשא חדא מינייהו בשלא היתה לו עידית מעולם מפרשינן לה נמי בדוחק אאידך שלא היתה לו עידית שמכרה אלא עדיין ישנה בידו אבל לאוקומי תרווייהו כשלא היתה לו עידית שמכרה אי אפשר לפרש כן אלא כשלא היתה לו מעולם. ועוד אי עדיין עידית בידו אמאי תני ניזקין בבינונית ליתיב ליה מעידית שבידו. ע"כ לשונו.
רבינא אמר דכולי עלמא בשל עולם הן שמין והכא בדעולא קא מיפלגי וכו'. מר אית ליה דעולא ומר לית ליה דעולא. אית ספרים דגרסי הכי. ויש מי שפירש דגירסא זו דכולי עלמא בשל עולם הן שמין וכגון שהיתה בינונית שלו כבינונית דעלמא והא דתני ניזקין ובעל חוב בבינונית וכתובת אשה בזיבורית לית ליה תקנתא דעולא דהא כי תקינו רבנן בעל חוב בבינונית הני מילי היכא דאית ליה עידית ובינונית וזיבורית דקיימא עידית קמיה אבל בדלית ליה אלא זיבורית ובינונית לחודייהו לא תקינו רבנן. והראב"ד ז"ל הקשה שאין בלשון הגמרא מר אית ליה תקנתא דעולא אלא מר אית ליה דעולא. ועוד כי התקנה לא היתה דעולא אלא מן המשנה וכדתנן בפרק הנזקין ועולא לא בא אלא לפרש כי דבר תורה בזיבורית. ועוד קשה דאנן קיימא לן דבשלו הן שמין כרב נחמן דאמר הכי בכתובות ואיך נפרש דברי רבינא דהוא בתרא דלא כהלכתא. והוא ז"ל פירש דהכי גרסינן דכולי עלמא בשלו הן שמין והכא בשלא היתה לו עידית מעולם ובדעולא קא מיפלגי מאן דאמר בעל חוב בזיבורית אית ליה דעולא וכיון דנעשית אצלו בינונית כעידית מוקמיה לה אדאורייתא אי נמי אתקנתא דהא זיבורית אצלו נעשה בינונית. והא דאמר בעל חוב בבינונית לית ליה דעולא אלא אית ליה דרבי שמעון דאמר בריש פרק הנזקין מפני מה אמרה תורה בעל חוב בבינונית כלומר אף על פי שהיה ראוי לגבות מן העידית מפני שגמל עמו חסד אלא שלא יראה אדם שדה נאה וכו' הילכך אף על פי שזה נעשית לו הבינונית כעידית גובה ממנה שאין כאן חשש דאקפוץ ואלוונו שהרי עידית כזו מצויה הרבה לקנות ואוקימנא ליה אדיניה. וקמשמע לן כעולא דרבה דהוא בתרא סבירא ליה כוותיה בפרק הנזקין והילכך בעל חוב בזיבורית. כן כתב הרב ז"ל. הרשב"א ז"ל.
בדעולא קא מיפלגי נראה מדלא קאמר אי בעית אימא דכולי עלמא בשל עולם הן שמין דהא קאי אשינויא דשני דפליגי אי בשלו הן שמין או בשל עולם הן שמין משמע דלהאי שינויא ניחא בכל ענין. ולפירוש ר"י דמפרש דלא קאמר הכא דלמר לית ליה דעולא אלא בשיש שתים ולא יותר נראה לי דלמאן דאמר אינו גובה אי סבר בשלו הן שמין אז ניחא ואי נמי סבר בעלמא בשל עולם הן שמין והויא האי בבינונית דעלמא הכא דאין לו אלא שתים לית ליה תקנתא דעולא ומאן דאמר גובה אית ליה תקנתא דעולא ואפילו היכא דאין לו אלא שתים. ואפילו למאן דאמר בשלו הן שמין הני מילי דאית ליה שלושה דכי שקיל מבינונית ליכא נעילת דלת אבל היכא דאין לו אלא שתים אי שקלת מזיבורית יש כאן נעילת דלת. ע"כ. גליון. וז"ל הרב המאירי ז"ל גדולי הגאונים ז"ל פסקו שבעל חוב בבינונית מפני שהם סוברים שמן התורה בעל חוב בעידית וחכמים הורידוהו לבינונית וכמו שפסקו גדולי הפוסקים במסכת גיטין והילכך אף בזו בבינונית ועל זו אמרו לית ליה דעולא ולדברי כולם אין צריך לומר שאם היו לו עידית וזיבורית שהניזקין בעידית ובעל חוב וכתובת אשה בזיבורית. ולגדולי המחברים ראיתי שפסקו בבינונית וזיבורית שדינו של בעל חוב בבינונית אף על פי שפסקו שדבר תורה בזיבורית. נראה שהם מפרשים כאן דמאן דאמר מבינונית קא גבי אית ליה דעולא כלומר אית ליה בתקנתא דעולא שיהא אף בבינונית וזיבורית דכמה בני אדם אין להם אלא שני מיני קרקע בינונית וזיבורית ואי לא גבי מבינונית איכא נעילת דלת ומאן דאמר בזיבורית סבר דתקנתא דעולא לא שייכא אלא לרובא דעלמא דאית להו שלושה גווני ארעא אבל דלית ליה אלא בינונית וזיבורית לא שייכא תקנתא דמילתא דלא שכיחא ולא עבדו בה רבנן תקנתא. כן נראה לי בפירושה לדעת גדולי המחברים. ונראה לי ראיה לפירוש זה שאם לפירוש שפירשנו תחילה הל"ל מדסבירא ליה כעולא דאמר דבר תורה בזיבורית ומדסבירא ליה כרבי שמעון דפליג בפרק הנזקין ואמר דבר תורה בעידית אלא שהעיקר בפירוש זה שנתחדש לנו. ולענין ביאור דברי עולא מה ראיה מביא מקרא דבחוץ תעמוד שיהא מן הקרקע בזיבורית והא קרא במטלטלין כתיב ובמטלטלין כל מילי מיטב הוא. תדע שאין לומר מיטב הוא אלא בפרעון שיכול למכרו ואי לא מזדבן הכא מזדבן הכא אבל קרא במשכון כתיב שאינו עומד לימכר אין לומר בפחות שבו שהוא מיטב וזהו שאמרו בתלמוד ירושלמי למדו קרקעות מן המשכונות. כתבו הגאונים ז"ל דכל שיש ללוה עידית במקומו ובינונית במקום אחר שיגבה מעידית שבמקומו ואינו דוחהו לבינונית שבמקום אחר. מה שאמרנו לדעת ראשון בבינונית וזיבורית שבעל חוב נוטל בזיבורית לא סוף דבר שלא היתה לו עידית מעולם רצה לומר אחר שלוה אלא אף אם היה לו עידית אחרי שלוה שנמצאת בינונית זו משועבדת למלוה ומכרה אנו אומרים כן הואיל ועכשיו מכל מקום אין לו עידית וכל שאנו מזכירין לשון זיבורית פירושו ארץ שעושה פירות אבל כל שאינה ראויה לעבדה אינה בכלל זה כלל. ע"כ. עיין בהר"ן ז"ל בכתובות דף תקל"ו ב'.
מר לית ליה תקנתא דעולא דוקא היכא דלית ליה עידית דהוי האי בינונית עידית לדידיה וכמו שכתבו התוספות. וקשה דלמה קורא אותה בינונית על כרהך משום דהויא כבינונית דעלמא אם כן סובר זה התירוץ בשל עולם הן שמין אם כן מה חדש על התירוץ הראשון שתירץ בשל עולם הן שמין. גליון.

עִידִּית וְזִיבּוּרִית – נִזָּקִין בְּעִידִּית, וּבַעַל חוֹב וּכְתוּבַּת אִשָּׁה בְּזִיבּוּרִית.
If he has only superior-quality and inferior-quality land, damages are paid from the superior-quality land, and payments owed to a creditor and payments of a woman’s marriage contract are made from the inferior-quality land.
קָתָנֵי מִיהָא מְצִיעָא: בֵּינוֹנִית וְזִיבּוּרִית – נִזָּקִין וּבַעַל חוֹב בְּבֵינוֹנִית, וּכְתוּבַּת אִשָּׁה בְּזִיבּוּרִית. וְאִי אָמְרַתְּ בְּשֶׁלּוֹ הֵן שָׁמִין; תֵּעָשֶׂה בֵּינוֹנִית שֶׁלּוֹ – כְּעִידִּית, וְיִדְחֶה בַּעַל חוֹב אֵצֶל זִיבּוּרִית!
The Gemara explains how this baraita poses a challenge: In any event, the baraita teaches in the middle clause: If he owns only intermediate-quality and inferior-quality land, payments for damages and payments owed to a creditor are made from the intermediate-quality land, and payments of a woman’s marriage contract are made from the inferior-quality land. This clause demonstrates that the quality of land is appraised objectively based on the standard of the world at large. The reason for this is that if you say that the court appraises land based on the quality of the land of the one liable for the damage, let his intermediate-quality land be classified as superior-quality land, as that is the best land he owns, and consequently, the creditor should be directed to collect the debt from the inferior-quality land.
הָכָא בְּמַאי עָסְקִינַן – כְּגוֹן שֶׁהָיְתָה לוֹ עִידִּית, וּמְכָרָהּ.
The Gemara rejects this: With what are we dealing here? This is a case where at the time the borrower took the loan he also had superior-quality land and he subsequently sold it. Accordingly, no matter how land is appraised, at the time that the loan was given his intermediate-quality land would be classified as being of intermediate quality. Consequently, the creditor’s lien on the borrower’s land, which took effect from the moment the loan was given, takes effect with regard to the intermediate-quality land. Therefore, the creditor retains his right to collect from that land, regardless of the fact that by the time of collection it was the borrower’s best land and at that point could be reclassified as land of superior quality.
וְכֵן אָמַר רַב חִסְדָּא: כְּגוֹן שֶׁהָיְתָה לוֹ עִידִּית, וּמְכָרָהּ.
And so says Rav Ḥisda: The baraita deals with a case where at the time he took the loan he also had superior-quality land and he subsequently sold it.
הָכִי נָמֵי מִסְתַּבְּרָא – מִדְּקָתָנֵי אַחֲרִיתִי: בֵּינוֹנִית וְזִיבּוּרִית – נִזָּקִין בְּבֵינוֹנִית, בַּעַל חוֹב וּכְתוּבַּת אִשָּׁה בְּזִיבּוּרִית. קַשְׁיָין אַהֲדָדֵי!
The Gemara notes: This too stands to reason, from the fact that another baraita teaches: If a debtor has only intermediate-quality and inferior-quality land, damages are collected from the intermediate-quality land, while payments to a creditor and payments of a woman’s marriage contract are made from the inferior-quality land. These two baraitot are difficult, as they contradict each other. The baraita above teaches that in this case the creditor collects the debt from the intermediate-quality land, whereas this baraita teaches that he collects the debt from the inferior-quality land.
אֶלָּא לָאו שְׁמַע מִינַּהּ: כָּאן שֶׁהָיְתָה לוֹ עִידִּית וּמְכָרָהּ, כָּאן – שֶׁלֹּא הָיְתָה לוֹ עִידִּית וּמְכָרָהּ?
Rather, must one not conclude from it that here, in the baraita above, it is a case where he also had superior-quality land at the time that he took the loan and he subsequently sold it, while there, in the baraita subsequently cited, it is a case where he did not have superior-quality land and he did not sell it. In such a case, since his intermediate-quality land was his best land, it is classified as superior-quality land and accordingly, no lien took effect with regard to it.
וְאִי בָּעֵית אֵימָא: אִידֵּי וְאִידֵּי שֶׁלֹּא הָיְתָה לוֹ עִידִּית וּמְכָרָהּ; וְלָא קַשְׁיָא, הָא דְּשָׁוְיָא בֵּינוֹנִית שֶׁלּוֹ כְּעִידִּית דְּעָלְמָא, וְכָאן דְּלָא שָׁוְיָא בֵּינוֹנִית שֶׁלּוֹ כְּעִידִּית דְּעָלְמָא.
And if you wish, say instead that the contradiction between the baraitot can be resolved differently: Both this baraita and that baraita concern cases where the borrower did not have superior-quality land and sell it. And it is not difficult because this second baraita concerns a case where his intermediate-quality land is equivalent in quality to the superior-quality land of the world at large; therefore, it is classified as superior-quality land and the creditor has no right to collect from it. And here, the first baraita concerns a case in which his intermediate-quality land is not equivalent in quality to the superior-quality land of the world at large but is similar to the intermediate-quality land of the world at large; consequently, the creditor has a claim to it.
וְאִיבָּעֵית אֵימָא: אִידֵּי וְאִידֵּי כְּגוֹן שֶׁהָיְתָה בֵּינוֹנִית שֶׁלּוֹ כְּבֵינוֹנִית דְּעָלְמָא, וְהָכָא בְּהָא פְּלִיגִי – מָר סָבַר: בְּשֶׁלּוֹ הֵן שָׁמִין. וּמָר סָבַר: בְּשֶׁל עוֹלָם הֵן שָׁמִין.
And if you wish, say instead: Both this baraita and that baraita concern a case where the borrower’s intermediate-quality land, which is the best land he owns, is equivalent in quality to the intermediate-quality land of the world at large, and here, the baraitot disagree about this: One Sage, the tanna of the second baraita , holds that the court appraises the debtor’s land based on the quality of his other land, so that his best land is classified as superior-quality land and the creditor has no claim on it. And the other Sage, the tanna of the first baraita , holds that the court appraises the debtor’s land based on the quality of land in the world at large, so that his land is classified as intermediate-quality land and the creditor is entitled to claim it.
רָבִינָא אָמַר: בִּדְעוּלָּא פְּלִיגִי – דְּאָמַר עוּלָּא: דְּבַר תּוֹרָה – בַּעַל חוֹב בְּזִיבּוּרִית, שֶׁנֶּאֱמַר: ״בַּחוּץ תַּעֲמוֹד, וְהָאִישׁ אֲשֶׁר אַתָּה נֹשֶׁה בוֹ יוֹצִיא אֵלֶיךָ אֶת הַעֲבוֹט הַחוּצָה״ – מָה דַּרְכּוֹ שֶׁל אָדָם לְהוֹצִיא לַחוּץ – פָּחוּת שֶׁבַּכֵּלִים. וּמָה טַעַם אָמְרוּ בַּעַל חוֹב בְּבֵינוֹנִית – כְּדֵי שֶׁלֹּא תִּנְעוֹל דֶּלֶת בִּפְנֵי לֹוִין.
Ravina said: Another resolution to the contradiction between the baraitot is that the baraitot disagree with regard to the opinion of Ulla, as Ulla says: By Torah law, a creditor collects from inferior-quality land, as it is stated: “You shall stand outside, and the man you have a claim against will bring his collateral out to you” (Deuteronomy 24:11). One can infer: What item would a person typically choose to bring out for use as collateral and potential payment? Certainly it is the most inferior of his utensils. The verse thereby indicates that a creditor collects from inferior-quality land. But if so, for what reason did the Sages say that a creditor collects from intermediate-quality land? They instituted this ordinance so as not to lock the door in the face of potential borrowers, as, if creditors were limited to collecting from inferior-quality land they would be hesitant to offer loans in the first place.
מָר אִית לֵיהּ תַּקַּנְתָּא דְּעוּלָּא, וּמָר לֵית לֵיהּ תַּקַּנְתָּא דְּעוּלָּא.
Ravina explains: One Sage, the tanna of the first baraita , is of the opinion that the ruling is in accordance with the ordinance cited by Ulla that a creditor collects from intermediate-quality land. And the other Sage, the tanna of the second baraita , is not of the opinion that the ruling is in accordance with the ordinance cited by Ulla, so the creditor has a right to collect from only inferior-quality land, in accordance with Torah law.
תָּנוּ רַבָּנַן: מָכַר לְאֶחָד אוֹ לִשְׁלֹשָׁה בְּנֵי אָדָם כְּאֶחָד – כּוּלָּן נִכְנְסוּ תַּחַת הַבְּעָלִים.
§ The Sages taught in the Tosefta ( Ketubot 12:3): If one owes money to pay damages, repay a loan, and pay a woman’s marriage contract, and he owns inferior-quality, intermediate-quality, and superior-quality land, and he sells all of his land, then if he sold all of the land to one person or to three people simultaneously, all the buyers replace the land’s prior owner with regard to repayment of his debts. At the time when each debt was created, each creditor gained a lien on the plots of the debtor’s land, from which they have a right to collect. As a lien remains in effect even if the land is sold, then even after the sale, each creditor can collect from the plots of land upon which they have a lien. Accordingly, damages are collected from the superior-quality land, the loan is repaid from the intermediate-quality land, and the marriage contract is paid from the inferior-quality land.
בְּזֶה אַחַר זֶה – כּוּלָּן גּוֹבִין מִן הָאַחֲרוֹן. אֵין לוֹ – גּוֹבֶה מִשֶּׁלְּפָנָיו, אֵין לוֹ – גּוֹבֶה מִשֶּׁלִּפְנֵי פָנָיו.
If he sold his plots of land one after the other, all the creditors collect from the last buyer, regardless of the quality of the land he purchased. If that buyer does not have sufficient land purchased from the debtor to pay all the debts, the creditors take the land he has and collect the remaining sums from the one who purchased land before him, and if he also does not have sufficient land, they collect the rest from the one before the one before him, i.e., the first buyer. The Sages instituted that creditors may not collect from land that a debtor sold, even though it is technically still liened to them, as long as the debtor still has sufficient means with which to repay the debt (see Gittin 48b). Accordingly, after the sale of the first plot of land, the creditors’ rights to collect are restricted to the land that remains in the possession of the debtor, and consequently they gain a lien on it, irrespective of its quality. Therefore, even if that land is subsequently sold, their rights to collect are restricted to that land, and only if the value of that land is insufficient to cover the cost of the debt may they utilize the original liens they had on the plots of land that were sold first.
״מְכָרָן לְאֶחָד״ הֵיכִי דָּמֵי?
The Gemara clarifies: With regard to the first case in the baraita , where he sold all the land to one person, what are the circumstances?
אִילֵימָא בְּבַת אַחַת – הַשְׁתָּא לִשְׁלֹשָׁה, דְּאִיכָּא לְמֵימַר חַד מִינַּיְיהוּ קָדֵים, אָמְרַתְּ כּוּלָּן נִכְנְסוּ תַּחַת הַבְּעָלִים; מְכָרָן לְאֶחָד מִיבַּעְיָא?
If we say that he simultaneously sold all of the land to one person, that is difficult. Now that the baraita teaches that if he sold the land to three different people simultaneously, where it is possible to say that the sale to one of them preceded the other sales, yet you say the halakha is that all the buyers replace the land’s prior owner equally, and the possibility that one might have proceeded the other is disregarded, is it necessary to teach that the halakha is the same in a case where all the plots of land were simultaneously sold to one person?
אֶלָּא פְּשִׁיטָא – בְּזֶה אַחַר זֶה.
Rather, it is obvious that the baraita is referring to a case where the plots of land were sold one after the other.
וּמַאי שְׁנָא שְׁלֹשָׁה – דְּכֹל חַד וְחַד אָמַר לֵיהּ: הִנַּחְתִּי לְךָ מָקוֹם לִגְבּוֹת מִמֶּנּוּ;
The Gemara asks: But what is different about the latter clause of the baraita , where the plots of land were sold to three buyers, one after the other, and the creditors collect only from the last buyer? It is different in that each one of the first two buyers can say to any creditor who tries to seize the land they purchased: Do not collect my land, as I left a place for you, a plot of land in the debtor’s possession, from which to collect. In other words, when the first two buyers purchased their land a plot of land remained with the debtor, and therefore the creditor’s rights of collection are restricted to that land.
הַאי נָמֵי – אַכֹּל חַד וְחַד לֵימָא לֵיהּ: הִנַּחְתִּי לְךָ מָקוֹם לִגְבּוֹת מִמֶּנּוּ!
The Gemara continues its question: In this case as well, where all the plots of land were sold to a single buyer, with regard to each one of the first two plots of land that were sold, let the buyer say to any creditor who tries to collect: With my purchase of the first two plots of land, I left a place for you, a plot of land in the debtor’s possession, from which to collect. Therefore, even though the debtor subsequently sold the buyer all of the land, the creditor’s rights of collection are restricted to the last plot of land the debtor sold the buyer, irrespective of its quality. Why then does the baraita rule that in this case each creditor collects from the land that was originally liened to him?
הָכָא בְּמַאי עָסְקִינַן – כְּגוֹן שֶׁלָּקַח עִידִּית בָּאַחֲרוֹנָה. וְכֵן אָמַר רַב שֵׁשֶׁת: כְּגוֹן שֶׁלָּקַח עִידִּית בָּאַחֲרוֹנָה.
The Gemara explains: With what are we dealing here? This is a case where the individual buyer purchased the superior-quality land last. Accordingly, the buyer is satisfied with allowing each creditor to collect from the land that was previously liened to him, rather than having them each collect from the superior-quality land. And so says Rav Sheshet: It is a case where the individual buyer purchased the superior-quality land last.
אִי הָכִי, לֵיתוֹ כּוּלְּהוּ וְלִיגְבּוֹ מֵעִידִּית!
The Gemara asks: If that is so, let them all come and collect from the superior-quality land, as their rights to collect should be restricted to it, since it was purchased last.
מִשּׁוּם דְּאָמַר לְהוּ: אִי שָׁתְקִיתוּ וְשָׁקְלִיתוּ כְּדִינַיְיכוּ – שָׁקְלִיתוּ, וְאִי לָא – מַהְדַּרְנָא שְׁטָרָא דְּזִיבּוּרִית לְמָרֵיהּ, וְשָׁקְלִיתוּ כּוּלְּכוּ מִזִּיבּוּרִית.
The Gemara answers: Because he can say the following threat to them: If you are silent and do not insist on collecting from the superior-quality land, and take the land of a quality that is due to you according to your standard legal rights, as in a case where you collect directly from the debtor, i.e., the injured party will collect from the superior-quality land, the creditor from the intermediate-quality land, and the woman will collect her marriage contract from the inferior-quality land, then take that land and I will allow you to do so. But if not, and you insist on taking the superior-quality land that I purchased last, then I will return the bill of sale of the inferior-quality land to its prior owner, i.e., the debtor, and you will all be forced to collect from the inferior-quality land, because whenever the debtor has land in his possession you are able to collect the debts only from him.
